Answer-set programming (ASP) has emerged as a declarative programming paradigm where problems are encoded as logic programs, such that the so-called answer sets of theses programs represent the solutions of the encoded problem. The efficiency of the latest ASP solvers reached a state that makes them applicable for problems of practical importance. Consequently, problems from many different areas, including diagnosis, data integration, and graph theory, have been successfully tackled via ASP. In this work, we present such ASP-encodings for problems associated (...) to abstract argumentation frameworks (AFs) and generalisations thereof. Our encodings are formulated as fixed queries, such that the input is the only part depending on the actual AF to process. We illustrate the functioning of this approach, which is underlying a new argumentation system called ASPARTIX in detail and show its adequacy in terms of computational complexity. (shrink)

Bioethicists tend to focus on the individual as the relevant moral subject. Yet, in highly complex and socially differentiated healthcare systems a number of social groups, each committed to a common cause, are involved in medical decisions and sometimes even try to influence bioethical discourses according to their own agenda. We argue that the significance of these collective actors is unjustifiably neglected in bioethics. The growing influence of collective actors in the fields of biopolitics and bioethics leads us to pursue (...) the question as to how collective moral claims can be characterized and justified. We pay particular attention to elaborating the circumstances under which collective actors can claim ‘collective agency.’ Specifically, we develop four normative-practical criteria for collective agency in order to determine the conditions that must be given to reasonably speak of ‘collective autonomy’. For this purpose, we analyze patient organizations and families, which represent two quite different kinds of groups and can both be conceived as collective actors of high relevance for bioethical practice. Finally, we discuss some practical implications and explain why the existence of a shared practice of trust is of immediate normative relevance in this respect. (shrink)

The paper proposes to integrate literary studies in consciousness research to develop a strong ethical and existential dimension in the field. More specifically, it considers the value of fictional narrative for developing concepts of selfhood and personal identity that cohere with the reductionist explanations of human consciousness and self in modern empirical consciousness research. My central claim is that looking to the literary representations of human consciousness and existence that reject or are free from conventional essentialist ideas of self, agency, (...) and anthropocentrism can help 'normalize' the reductionist scientific descriptions of humans and reduce their psychologically and socio-culturally disruptive impact. The paper uses Virginia Woolf's The Waves as an example, showing how the novel's non-anthropocentric and non-essentialist conceptions of self and consciousness overlap with materialist theories in neuroscience and -philosophy but present these in a distinctive narrative framework and poetic terms that bring out the inherent emancipatory potential of the materialist explanation of human existence and offer the reader the possibility of relating to these experientially and emotionally. In this article I challenge the standard view that clarity and coherence in moral philosophy and ethics are always good and obscurity necessarily bad. The appraisal of clarity, I argue, entails a risk of reducing and misrepresenting the complex and multifaceted nature of good, productive and true thinking and communication. Uncertainty and obscurity do not necessarily lead to vagueness, imprecision or meaning-obstruction. There are productive forms of uncertainty and there are unproductive forms. Indeed, to be precise, lucid and truthful sometimes (...) requires respecting and linguistically and conceptually reproducing the incoherence, obscurity and uncertainty of reality. (shrink)

Because it is often argued that surrogacy should not be treated as contractual, the question arises in which terms this practice might then be couched. In this article, I argue that a phenomenology of surrogacy centering on the notion of trust provides a description that is illuminating from the moral point of view. My thesis is that surrogacy establishes a complex and extended reproductive unit––the “surrogacy triad” consisting of the surrogate mother, the child, and the intending parents––whose constituents are bound (...) together by mutual trustful commitments. Even though a trust-based approach does not provide an ultimate answer to whether surrogacy should be sanctioned or prohibited, it allows for at least some practical suggestions. In particular, I will argue that, under certain conditions, surrogacy is tenable within familial or other significant relationships, and I will stress the necessity of acknowledging the new relationships and moral commitments that result from this practice. Human reproduction in the age of reprogenetics raises fundamental ethical and political questions. Critics of so-called liberal eugenics like Jürgen Habermas have sparked an ethical debate on whether selective genetic manipulation might undermine the natural basis of the moral self-conception and autonomy of future generations. Contrary to this perception, the authors of this article argue for a dialectic understanding of the moral challenges arising from human natality: Freedom and dependency, sociality and human embodiment, autonomy and relatedness likewise determine our human (...) existence as moral beings. As an answer to these challenges, the authors develop a dialectic understanding of parenthood in the age of reprogenetics, thereby transcending present debates of modern reproductive medicine. ZusammenfassungDie rechtliche Regelung der Fortpflanzungsmedizin ist dringend reformbedürftig. Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

BackgroundThe bioethical debates concerning living donation and surrogacy revolve around similar ethical questions and moral concepts. Nevertheless, the ethical discourses in both fields grew largely isolated from each other.MethodsBased on a review of ethical, sociological and anthropological research this paper aims to link the ethical discourses on living kidney donation and surrogacy by providing a comparative analysis of the two practices’ relational dimension with regard to three aspects, i.e. the normative role of relational dynamics, social norms and gender roles, and (...) reciprocity. Based on this analysis, we derive conclusions for the framing of living organ donation and surrogacy in ethical theory and practice.ResultsFirst, our analysis emphasizes the relevance of acknowledging the complex relational implications of living kidney donation and surrogacy. Underestimating this relational dimension may not only lead to individual crises but endanger existing as well as newly emerging familial relationships. Second, we point out differences in the normative assessment of social norms and gender roles in the ethical debates about living kidney donation and surrogacy. In particular, we show how different evaluations of altruism affect the understanding of autonomy in both contexts. In addition, we sensitize for biased perceptions of gender roles. Finally, we argue that challenges resulting from unresolved reciprocity are an issue in living kidney donation and surrogacy independent of whether the exchange of body parts or bodily services is framed as a gift or commercial exchange. By pointing out the limits of financial compensation, we stress the relevance of non-material, relational rewards as potential remedy. (shrink)

CILT is a theory-oriented series which welcomes contributions from scholars who have significant proposals to make towards (...) the advancement of our understanding of language, its structure, functioning, and development. Current Issues in Linguistic Theory is especially designed, by offering an alternative outlet for meaningful contributions to the current linguistic debate, to furnish the community of linguists the diversity of opinion which a healthy discipline must have. With the rise of the scientific authority of neuroscience and recent neurotechnological advances, the understanding of the human being and its future is beginning to undergo a radical change. As a result, a normative and existential vacuum is opening and hopes as well as fears about the future are flourishing. Some philosophers are anticipating a broad neuroscientific disenchantment, sociocultural disruption and a new existential anxiety related to the clash of the neuroscientific and humanistic image of humans. Others are expecting the (...) technological and scientific developments to lead to human enhancement and existential emancipation. In the first part of this commentary, I outline these two contrasting responses to the rise of neurocentricism and non-anthropocentrism. In the second part, I argue that the divide between the old anthropocentric paradigm and the emerging neuroscientific is misconceived and that literature and fictional narrative are particularly illustrative of the possibility of integrating scientific materialism with humanism. I use the contemporary literary-philosophical work The Creative Act by Rick Rubin to show that humanist ideas can indeed cohere with anti-essentialist and neuroscientific notions of personal identity and self and how existential meaning and comfort can be found in a neuroscientifically and deterministically explained world. Patient visitor restrictions were implemented in unprecedented ways during the COVID-19 pandemic and included bans on any visitors to dying patients and bans separating mothers from infants. These were implemented without high quality evidence they would be beneficial and the harms to patients, families and medical personnel were often immediately clear. Evidence has also accumulated finding strict visitor restrictions were accompanied by long-term individual and societal consequences. We highlight numerous examples of restrictions that were enacted during the COVID-19 pandemic, including (...) some that continue to be in place today. We outline six specific concerns about the nature and effects of the visitor restrictions seen during the COVID-19 pandemic. These considerations may help provide both an ethical and science-based framework, through which healthcare workers, families and government entities can work towards safeguarding patient and family rights and well-being. ZusammenfassungIn der ethischen Debatte um die Forschung mit Biobanken wird selten zwischen verschiedenen Biomaterialien differenziert. Vor diesem Hintergrund widmet sich die vorliegende qualitative Interviewstudie erstmals den praktischen Herausforderungen, die sich bei der Sammlung von postmortal gewonnenem menschlichem Gehirngewebe zu Forschungszwecken aus Sicht von in diese Praxis involvierten Experten in Deutschland stellen. Im Zentrum der ethischen Analyse stehen Herausforderungen der Spenderrekrutierung, der Kommunikation über eine Gehirnspende sowie der informierten Zustimmung. Unsere Ergebnisse relativieren zum einen die Annahme eines sogenannten Spendermangels, insofern insbesondere (...) Kliniker eine Gatekeeper-Rolle bei der Spendergewinnung innehaben. Deren Einstellungen sollten daher als ein die Praxis unmittelbar beeinflussender Faktor stärker berücksichtigt werden; zudem sollten im Wissen um bestehende moralische Vorbehalte Ansätze zur Verbesserung der professionellen Kommunikation entwickelt werden. Bezüglich der Regelung der Einwilligung in postmortale Forschungsspenden wurde in unserem Sample das Bemühen deutlich, den ethischen Vorrang der Organspende nicht zu gefährden und die Postmortalspende vor Assoziationen mit der Organspende zu bewahren. Zur Sicherung des Vertrauens in die Forschung sowie der Autonomie von Spendern befürworteten die Experten nicht nur die Anwendung einer Zustimmungsregelung, sondern auch ein den Familienangehörigen explizit eingeräumtes Recht, einer Gehirnspende selbst dann zu widersprechen, wenn der Verstorbene seine Zustimmung erteilt hat. Die Erfahrung zeigt, dass eine offene Kommunikation über das Erfordernis eines familiären Konsenses zu einer hohen Akzeptanz des Spenderwillens in der Praxis führt. Daher könnte ein solcher, auf den Dialog von Spender und Angehörigen zu Lebzeiten bauender Ansatz auch instruktiv für die Realisierung von Spenden im Kontext der Organspende sein. (shrink)

In this paper, we consider three different search strategies for a cut-free sequent system formalizing orthologic, and estimate the respective search spaces. Applying backward search, there are classes of formulae for which both the minimal proof length and the search space are exponential. In a combined forward and backward approach, all proofs are polynomial, but the potential search space remains exponential. Using a forward strategy, the potential search space becomes polynomial yielding a polynomial decision procedure for orthologic and the word (...) problem for free ortholattices. (shrink)

With the analysis of the scattering ashes in a Norwegian context as its point of departure, the article sets out to explore ash scattering and how it relates to the governance of deathscape and religion/worldview in the public space. Referring to ethnographic study, the focus is on the bereaved and the deceased in the governance process for ash scattering and on critically rethinking the governance of ash scattering from the private actors’ experiences. I argue that ash scattering is in the (...) process of establishing a spatial ritual institution, deregulated vis-à-vis organized religion/worldview, which, on the one hand, opens up the possibility for the privatization of death and provides ideals of individuality, privacy and discretion, and, on the other hand, this takes place paradoxically not in private but rather within public space.
