Taking up the idea that sanity is a necessary condition for responsibility, Susan Wolf sets forth two criteria for determining whether an actor is sane. I argue that the second criterion is inappropriate for this determination since it invokes some hidden axiological standard. I reexamine a case study that Wolf describes and arrive at a different judgment about the responsibility of the actor. I argue that the foremost criterion for determining whether an actor is sane is functional rather than axiological. (...) The theory of responsibility, rather than the notion of sanity, must do the work of appraising the value of an actors’ behavior, and that must be done in light of the fact that responsible moral agents enjoy varying degrees of sanity. Summary Our basic intuition seems to suggest that the moral biography of an individual matters in our treatment of the individual. We do keep criminal records on file, and we do care about the moral progress of individuals. At times our desire to fix responsibility seems too strong, and in our zeal we invent a definite, metaphysical character on which to pin crimes. However, some moral philosophers have tried to redirect our attention to affix responsibility in a way that attends (...) to actions, deeds done. Two ways to affix responsibility have been reviewed—the SR and the PRA. In the case of Tom Joad we could arrive at the conviction that Tom was responsible through use of either the SR or the PRA. In the end the difference was not that one method held Tom culpable and one exculpated him. The difference was seen in the way the PRA included the earlier commission of the same crime in its evaluation of responsibility. To include in the evaluation of Tom's murder of George the earlier murder of Herb is to entertain a definite theory about the relation of Herb's murderer to George's murderer. I have suggested one possible candidate for that theory, Derek Parfit's theory of person stages. (shrink)

R. E. Ewin has argued that corporations are moral persons, but Ewin describes them as being unable to think or to act in virtuous and vicious ways. Ewin thinks that their impoverished emotional life would not allow them to act in these ways. In this brief essay I want to challenge the idea that corporations cannot act virtuously. I begin by examining deficiencies in Ewin''s notion of corporate personhood. I argue that he effectively reduces corporations to the status of incompetent (...) patients. I shall make use of a richer notion of corporate personhood as I explore the logical relationship between corporate action and the quality of the corporate emotional life. After discussing an alternate methodology for making moral assessments of action I consider briefly two corporate disasters: the crash on Mt. Erebus, the Imperial Foods plant fire. These cases are used to show the inadequacy of Ewin''s thesis that only corporate managers are capable of displaying vice. (shrink)

In this essay I focus upon John Martin Fischer’s notion of taking on responsibility. In his view moral actors must acquire a proper self-understanding to take on moral responsibility. I question whether Fischer steps out of his role as a subjectivist, when he maintains that having only guidance control is a necessary condition for moral responsibility. I suggest that subjectivists are committed to the notion that taking on responsibility includes the acquisition of a proper phenomenology of freedom. If the agent responsible for an action is to be given praise or blame by the moral community for that action, then accurate responsibility ascriptions must be made. Since the moral community may have to evaluate the actions of corporate agents, care must be taken to insure that the assumption of Methodological Individualism (MI) does not infect that process. Nevertheless, there is no guarantee that accurate responsibility ascriptions will be made in cases connected with corporate action as long as corporate (...) scapegoating may occur. Because corporate scapegoating is a behavior pattern that attempts to falsify correct responsibility ascriptions it will be of interest to the moral theorist. Once I have considered three objections to the idea of corporate scapegoating I shall offer a fictional description of it found in Ayn Rand''s work,Atlas Shrugged. Finally, I shall raise a question about its present day use by corporations in our society. (shrink)

Taking Hobbesian logic as my starting point, I argue that Hobbesian diffidence, one of the causes of quarrel in the state of nature, does not disappear once the citizens enter civil society. Rather, diffidence is merely contained by the sovereign. Following Alice Ristroph, I argue that diffidence comes to shape what citizens demand of the state/sovereign in the criminal law. However, I show that Ristroph does not fully appreciate that the concept of diffidence is a racialized one, and as such, (...) race underlies how the citizens understand their own diffidence, what citizens demand of the sovereign, and how they demand it. Further, because diffidence itself is racialized, criminal law need not make explicit appeals to race. Once racialized diffidence becomes embedded in the criminal law, it remains there regardless of any conscious racial animus. I show that racial profiling is a prime example of how this racialized diffidence manifests. Thus, I present Hobbesian diffidence as a framework from which to understand racial oppression. This paper is primarily an application of Hobbes to contemporary issues rather than an exegesis and analysis of Hobbes’s views. (shrink)

The debate between compatibilists and incompatibilists depends in large part on what ordinary people mean by ‘free will’, a matter on which previous experimental philosophy studies have yielded conflicting results. In Nahmias, Morris, Nadelhoffer, and Turner (2005, 2006), most participants judged that agents in deterministic scenarios could have free will and be morally responsible. Nichols and Knobe (2007), though, suggest that these apparent compatibilist responses are performance errors produced by using concrete scenarios, and that their abstract scenarios reveal the folk (...) theory of free will for what it actually is—incompatibilist. Here, we argue that the results of two new studies suggest just the opposite. Most participants only give apparent incompatibilist judgments when they mistakenly interpret determinism to imply that agents’ mental states are bypassed in the causal chains that lead to their behavior. Determinism does not entail bypassing, so these responses do not reflect genuine incompatibilist intuitions. When participants understand what determinism does mean, the vast majority take it to be compatible with free will. Further results indicate that most people’s concepts of choice and the ability to do otherwise do not commit them to incompatibilism, either, putting pressure on incompatibilist arguments that rely on transfer principles, such as the Consequence Argument. We discuss the implications of these findings for philosophical debates about free will, and suggest that incompatibilism appears to be either false, or else a thesis about something other than what most people mean by ‘free will’. I argue that an adequate account of non-reductive realization must guarantee satisfaction of a certain condition on the token causal powers associated with (instances of) realized and realizing entities---namely, what I call the 'Subset Condition on Causal Powers' (first introduced in Wilson 1999). In terms of states, the condition requires that the token powers had by a realized state on a given occasion be a proper subset of the token powers had by the state that realizes it on that (...) occasion. Accounts of non-reductive realization conforming to this condition are implementing what I call 'the powers-based subset strategy'. I focus on the crucial case involving mental and brain states; the results may be generalized, as appropriate. I first situate and motivate the strategy by attention to the problem of mental causation; I make the case, in schematic terms, that implementation of the strategy makes room (contra Kim 1989, 1993, 1998, and elsewhere) for mental states to be ontologically and causally autonomous from their realizing physical states, without inducing problematic causal overdetermination, and compatible with both Physicalism and Non-reduction; and I show that several contemporary accounts of non-reductive realization (in terms of functional realization, parthood, and the determinable/determinate relation) are plausibly seen as implementing the strategy. As I also show, implementation of the powers-based strategy does not require endorsement of any particular accounts of either properties or causation---indeed, a categoricalist contingentist Humean can implement the strategy. The schematic location of the strategy in the space of available responses to the problem of mental (more generally, higher-level) causation, as well as the fact that the schema may be metaphysically instantiated, strongly suggests that the strategy is, appropriately generalized and instantiated, sufficient and moreover necessary for non-reductive realization. I go on to defend the sufficiency and necessity claims against a variety of objections, considering, along the way, how the powers-based subset strategy fares against competing accounts of purportedly non-reductive realization in terms of supervenience, token identity, and constitution. Our book Relevance (Sperber and Wilson 1986) treats utterance interpretation as a two-phase process: a modular decoding phase is seen as providing input to a central inferential phase in which a linguistically encoded logical form is contextually enriched and used to construct a hypothesis about the speaker's informative intention. Relevance was mainly concerned with the inferential phase of comprehension: we had to answer Fodor's challenge that while decoding processes are quite well understood, inferential processes are not only not understood, (...) but perhaps not even understandable (see Fodor 1983). Here we will look more closely at the decoding phase and consider what types of information may be linguistically encoded, and how the borderline between decoding and inference can be drawn. It might be that all linguistically encoded information is cut to a single pattern: all truth conditions, say, or all instructions for use. However, there is a robust intuition that two basic types of meaning can be found. This intuition surfaces in a variety of distinctions: between describing and indicating, stating and showing, saying and conventionally implicating, or between truth-conditional and non-truth-conditional, conceptual and procedural, or representational and computational meaning. In the literature, justifications for these distinctions have been developed in both strictly linguistic and more broadly cognitive terms. The linguistic justification goes as follows (see for example Recanati 1987). Utterances express propositions; propositions have truth conditions; but the meaning of an utterance is not exhausted by its truth conditions, i.e. the truth conditions of the proposition expressed. Abstract This paper aims to shed some light on the difficulties we face in constructing a generally acceptable normative framework for thinking about public health. It argues that there are three factors (...) that combine to make theorising about public health difficult, and which when taken together defeat simplistic top-down and bottom-up approaches to the design of public health policies. The first factor is the problem of complex systems, namely that the distribution of health both affects and is affected by the distribution of other goods. The second is the difficulty of defining the goals of public health: we still need to get clear about what we should mean by health in this context, and what the goals of public health should be. The third is that we stand in need of an account of how important health is relative to the importance of other goods that a just society should be trying to secure for its citizens. The paper argues that these problems should lead us to abandon the search for a ‘one-size fits all’ normative framework for thinking about public health. Marcelo Fischborn discusses the significance of neuroscience for debates about free will. Although he concedes that, to date, Libet-style experiments have failed to threaten “libertarian free will”, he argues that, in principle, neuroscience and psychology could do so by supporting local determinism. We argue that, in principle, Libet-style experiments cannot succeed in disproving or even establishing serious doubt about libertarian free will. First, we contend that “local determination”, as Fischborn outlines it, is not a coherent concept. Moreover, determinism is unlikely (...) to be established by neuroscience in any form that should trouble compatibilists or libertarians—that is, anyone who thinks we might have free will. We conclude that, in principle, neuroscience will not be able undermine libertarian free will and explain why these conclusions support a coherent compatibilist notion of causal sourcehood. (shrink)

First, we briefly familiarize the reader with the emerging field of “experimental philosophy,” in which philosophers use empirical methods, rather than armchair speculation, to ascertain laypersons’ intuitions about philosophical issues. Second, we discuss how the surveys used by experimental philosophers can serve as valuable pedagogical tools for teaching philosophy—independently of whether one believes surveying laypersons is an illuminating approach to doing philosophy. Giving students surveys that contain questions and thought experiments from philosophical debates gets them to actively engage with the (...) material and paves the way for more fruitful and impassioned classroom discussion. We offer some suggestions for how to use surveys in the classroom and provide an appendix that contains some examples of scenarios teachers could use in their courses. (shrink)

The French philosopher Simone Weil worked on (but did not finish) Venice Saved, a tragedy about the conspiracy to overthrow the Republic of Venice in 1618. It has been largely ignored and has never been published in an English translation. Interest in Weil’s work has increased massively since her death and continues to grow, so that publishing this play in English will enable readers to expand their view of a writer whose work is in fragments. We have also translated the (...) notes that Weil wrote about Venice Saved and her sketches for the unwritten scenes, and have written four introductory chapters on: Weil’s life and significance; how the play came to be written and what it has to say; Weil’s view of tragedy; the issues raised by writing an English version of this play. Acute exercise consistently benefits both emotion and cognition, particularly cognitive control. We evaluated acute endurance exercise influences on emotion, domain-general cognitive control, and the cognitive control of emotion, specifically cognitive reappraisal. Thirty-six endurance runners, defined as running at least 30 miles per week with one weekly run of at least 9 miles (21 female, age 18-30 years) participated. In a repeated measures design, participants walked at 57% age-adjusted maximum heart rate (HRmax) (range 51-63%) and ran at 70% HRmax (range 64-76%) (...) for 90 minutes on two separate days. Participants completed measures of emotional state and the Stroop test of domain-general cognitive control before, every 30 minutes during, and 30 minutes after exercise. Participants also completed a cognitive reappraisal task after exercise. Functional near-infrared spectroscopy tracked changes in oxygenated and deoxygenated hemoglobin levels in the prefrontal cortex (PFC). Endurance exercise elevated positive emotion and cognitive reappraisal success. Endurance exercise reduced Stroop response time and test-evoked PFC oxygenation during exercise. Results suggest that even at relatively moderate intensities, endurance athletes benefit emotionally from running both during and after exercise, and task-related prefrontal cortex oxygenation reductions do not appear to hinder prefrontal-dependent cognitive control. Esta normalización se concretiza en las prácticas asociadas a las políticas públicas y la intervención social. Para iluminar estas prácticas utilizamos el concepto de dispositivo propuesto por Foucault. En (...) este contexto, uno de los dispositivos relevantes es la teoría de factores de riesgo. Ella surge del concepto de riesgo, y a través de una reconstrucción histórica de esta noción, mostramos que ésta no reconstruye una condición natural de algunas personas, sino que es una distinción contingente utilizada en el contexto de la gubernamentalidad neoliberal. The present study was designed to investigate the relationships between role strains following the transition to secondary school and academic achievement. Academic engagement was hypothesized to mediate between role strain and achievement. The sample consisted of 749 students in their first year of secondary school. Four types of role strain were investigated: parent, teacher, school and peer. Parent and teacher role strains appeared to be negatively associated with academic achievement, as mediated through academic engagement. Parent and school role strain were (...) directly and negatively associated with achievement. Results are discussed in the light of parenting practices and the developmental mismatch hypothesis. This article introduces a symposium on Daniel Hausman’s Valuing Health: Well-Being, Suffering and Freedom. The symposium contains papers by Elselijn Kingma, Adam Oliver, Anna Alexandrova, Erik Nord, Alex Voorhoeve and James Wilson, with replies by Daniel Hausman. In Valuing Health, Hausman argues that, despite apparently measuring health, projects such as the Global Burden of Disease Study in fact measure judgments about the value of health. Once this has been clarified, the key question is how the value of health should (...) be measured. Hausman argues that existing instruments measure the private value of health, that is, health’s ‘contribution to whatever the individual cares about or should care about’, whereas what should be measured for resource allocation purposes is the public value of health, that is, the value health should be accorded from the perspective of the liberal state. Hausman argues that the public value of health should be measured by the extent to which suffering and activity limitations are relieved. It is not possible to face a text and announce "I shall now talk about character" in the same way that one might say "I shall now talk about plot" or "metaphor." For several reasons—not least of which is the absence of a thoughtful critical tradition—character is much more difficult to talk about than most other literary concepts. Most of what has been written on the subject of character, whether in recent years or in the distant past, can be seen (...) to come under one of four possible headings. I do not think of these classifications as being mutually exclusive, although the emphasis upon one aspect of the problem of character probably tends to pull one towards a definite position. Briefly, these positions are: that characters are products of the author's mind—memories, encapsulations of his experience or else split-off slivers of his mind or self; that characters are functions of the text in which they appear—embodiments of theme and idea—to be considered much as tokens, pieces, or counters in a game; that characters are entirely artificial, constructs to be analyzed in terms of the compositional techniques that have gone into their making; that characters are, for the purposes of critical reading, to be considered as if they were actual persons, and the emphasis in criticism—its sole business, in fact—to discuss the response they engender in an intelligent reader. Rawdon Wilson, associate professor of English at the University of Alberta, has written widely on English and Spanish literature. His previous contribution to Critical Inquiry, "On Character: A Reply to Martin Price," appeared in the Autumn 1975 issue. Part 1 of this exploratory study demonstrated that for terminal, instrumental, and work values, supervisors could only accurately assess the extent to which their terminal values are congruent with their employees, whereas, employees could only accurately describe degrees of alignment with their supervisors' work values. Thus, supervisors appear to possess conscious awareness of the terminal values held by their employees and employees similarly possess conscious awareness of their supervisors' work values. Part 2 of the study examined what each of these (...) two parties might do with their conscious knowledge concerning value congruence with the other member. Supervisor ratings and employee self-ratings concerning employee job performance, citizenship, climate fit, working relationship (LMX), and other issues, were correlated with supervisor terminal value congruence estimates and employee work value congruence estimates respectively. For supervisors, only one significant finding was noted, indicating a positive relationship between the supervisors' awareness of terminal value congruence with the employee and the supervisors' estimate of the employee's potential for future promotion. For employees, seven hypotheses received support demonstrating relationships between the employees' awareness of supervisor/employee work value congruence and self-ratings of work behaviours, citizenship behaviours, volunteerism behaviours, work climate behaviours, work climate attitudes, work climate organizational-wide attitudes, and the supervisor/employee working relationship. The form of Western mainstream film is the crux of its ideological efficiency: by using established formal techniques, films ensure audiences un- derstand that aesthetic decisions support and clarify the narrative to ensure maximum spectatorial satisfaction. However, some films exploit their formal aesthetics in order to prevent clarification, thwarting satisfaction in favour of viewing practices that can be considered perverse in that they withhold, suspend or obstruct immediate pleasure. Contemporary Western filmmaking in the mid-1990s witnessed the emergence of a distinct (...) group of filmmakers and films that, in the popular discourse of cinematic criticism, were together coded as “difficult” or “perverse.” These films were, as a result of the characteristics we identify below, situated obliquely in relation to the larger economic and artistic struc- tures of a commercially oriented “mainstream” cinema. Included in this new form of cinematic production were films from directors such as Tim Burton: Edward Scissorhands ; David Cronenberg: eXistenZ ; David Fincher: Se7en ; Peter Greenaway: The Baby of Maçon ; David Lynch: Lost Highway ; Quentin Tarantino: Pulp Fiction and Lars von Trier: Breaking the Waves . Whilst Western cinema as a whole has a long history of exploring “difficult” or “perverse” material within the overt or covert content of narrative, plot and story, such films demonstrate a particular relationship between the content being explored and the specific formal characteristics utilised in the delivery of that content. Thus where previous examples would utilise standardised formal techniques as a way of both delivering and containing the difficult or objectionable material, the films instead offer instances where the material of the narrative content seems to bleed backwards, affecting the form and rendering the very materiality of the film itself suspect and problematic. This book examines the relationship between race, religion, and economics within the black church. The book features unheard voices of individuals experiencing economic deprivation and the faith communities who serve as their refuge. Thus, this project examines the economic ethics of black churches in the rural South whose congregants and broader communities have long struggled amidst persistent poverty. Through a case study of communities in Alabama's Black Belt, this book argues that if the economic ethic of the Black Church remains (...) accommodationist, it will continue to become increasingly irrelevant to communities that experience persistent poverty. Despite its historic role in combatting racial oppression and social injustice, the Church has also perpetuated ideologies that uncritically justify unjust social structures. In The Vision of the Soul, James Matthew Wilson seeks to conserve the great insights of the western tradition by giving us a new account of them responsive to modern discontents. The western— or Christian Platonist—tradition, he argues, tells us that man is (...) an intellectual animal, born to pursue the good, to know the true, and to contemplate all things in beauty. Wilson begins by reconceiving the intellectual conservatism born of Edmund Burke’s jeremiad against the French Revolution as an effort to preserve the West’s vision of man and the cosmos as ordered by and to beauty. After defining the achievement of that vision and its tradition, Wilson offers an extended study of the nature of beauty and the role of the fine arts in shaping a culture but above all in opening the human intellect to the perception of the form of reality. Through close studies of Theodor W. Adorno and Jacques Maritain, he recovers the classical vision of beauty as a revelation of truth and being. Finally, he revisits the ancient distinction between reason and story-telling, between mythos and logos, in order to rejoin the two. Story-telling is foundational to the forms of the fine arts, but it is no less foundational to human reason. Human life in turn constitutes a specific kind of form—a story form. The ancient conception of human life as a pilgrimage to beauty itself is one that we can fully embrace only if we see the essential correlation between reason and story and the essential convertibility of truth, goodness and beauty in beauty.
