The Environmental Protection Agency has adopted new regulations that prevent the agency from conducting or funding intentional exposure research involving children, pregnant women, or fetuses. I argue that these regulations overprotect children, and that the EPA should revise them to conform with Subpart D of the Department Health and Human Services’ regulations governing research with humans.

The Cuyahoga River is a small Ohio river with an outsized influence in U.S. environmental history. The 1969 river fire ignited the public imagination, galvanized the environmental movement, and spurred the creation of the federal Environmental Protection Agency (EPA) and Clean Water Act. Water quality has since improved markedly, yet several controversial dams continue to obstruct the Cuyahoga’s flow, reducing environmental quality. The U.S. and Ohio EPAs recently announced plans to remove all such dams by 2023. In this paper, I (...) develop a rich environmental case study rooted in philosophy and environmental history about the Cuyahoga’s transition from literally being on fire to a 100-mile long, free flowing river from its headwaters to Lake Erie in less than 100 years. This transition involves dimensions of public policy with slow-moving, often reactive public institutions, corporations operating in bad faith with respect to informed dialogue in the public interest, and spirited environmental activists. I develop an environmental pragmatism to make sense of the negotiated shift in values and attitudes concerning our nation’s waters that emerged through public dialogue between GOs, NGOs, energy providers, activists, and local residents. More specifically, I leverage contemporary environmental pragmatism’s emphasis on value pluralism combined with John Dewey's insights about public reason concerning science policy in democratic polities and the tension between technical expertise and democratic decision-making in particular. This article provides an overview of the origins and development of green chemistry. Aiming to contribute to the understanding of green chemistry, basically from a historical point of view, this overview argues that contextual influences and the user friendliness of the term are drivers for the explosive growth of green chemistry. It is observed that political support for its development has been significant, in which the Pollution Prevention Act of 1990 was a formal political starting-point, but informally the origins of (...) green chemistry go back to before 1990. The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives and assesses the institutional characteristics of the Equator Principles Association from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of corporations, and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in which nation-states are virtually absent. We argue that (...) Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. Contemporary research highlights multiple societal and environmental benefits in addition to potential economic advantages associated with renewable energy utilization. As federal and state incentives for investments in RE technologies become more prevalent, RE sources represent increasingly viable alternatives to established fossil fuel energy. RE utilization is recognized as a key component of “green” product innovation that helps firms reduce the environmental impact of production processes and diminish their ecological footprints and energy consumption. Yet, despite consistent evidence that corporate sustainability initiatives (...) are favorably associated with firm performance, the limited research that examines associations between RE initiatives and firm performance yields mixed results and an explicit link has yet to be established. Drawing on the natural resource-based view of the firm, we examine the association between RE utilization and firm financial performance over time. Annual ROI, Tobin’s Q, and operating margin for large U.S. firms identified as exceptional users of RE in the EPA’s Fortune 500 Top Green Power Partners list are compared with their respective industry medians over a 7-year period and post hoc bootstrapping and sensitivity analyses are performed to further validate the study findings. Our research advances current knowledge about the influence of RE utilization by demonstrating that top RE user firms consistently generated superior financial performance compared to their industry competitors. As such, the study findings lend credence to the existence of a business case that complements the societal and environmental benefits of RE utilization. (shrink)

I argue that although the judgments required to reach statistical risk assessments may reflect policy values, it does not follow that the task of evaluating whether a given risk assessment is warranted by the evidence need also be imbued with policy values. What has led many to conclude otherwise, I claim, stems from misuses of the statistical testing methods involved. I set out rules for interpreting what specific test results do and do not say about the extent of a given (...) risk. By providing a more objective understanding of the evidence, such rules help in adjudicating conflicting risk assessments. To illustrate, I consider the risk assessment conflict at the EPA concerning the carcinogenicity of formaldehyde. (shrink)

This paper posits that organizational variables are the factors that lead to the moral decline of companies like Enron and Worldcom. The individuals involved created environments within the organizations that precipitated a spiral of unethical decision-making. It is proposed that at the executive level, it is the organizational factors associated with power and decision-making that have the critical influence on moral and ethical behavior. The study has used variables that were deemed to be surrogate measures of the ethical violations (OSHA (...) and EPA violations), the risky shift phenomenon (executive team size), banality of wrong-doing (reputation score for firms) and escalating commitment (tenure with the firm/change in revenue for declining firms). The research found that there were small correlations between ethical violations and the three organizational variables. (shrink)

This article gives an overview about the ethical dispute on preimplantation genetic diagnosis (PGD), its legal status and its practical usage in Europe. We provide a detailed description of the situation in Germany wherein prenatal diagnosis is routinely applied, but PGD is prohibited on the basis of the internationally unique embryo protection act (EPA) that was put into force in 1991. Both PGD and stem cell research were vigorously debated in Germany during the last four years. As regards the PGD (...) debate specifically, the voices of the ones directly affected were not adequately taken into consideration. We describe the predominant lines of argumentation in this debate and some essential results of our "bioethical field study" of opinions on and usage of PGD in Germany and their implications for the German legislation and ethical theory. To understand the behavior of a complex system, you must understand the interactions among its parts. Doing so is difficult for non-decomposable systems, in which the interactions strongly influence the short-term behavior of the parts. Science's principal tool for dealing with non-decomposable systems is a variety of probabilistic analysis that I call EPA. I show that EPA's power derives from an assumption that appears to be false of non-decomposable complex systems, in virtue of their very non-decomposability. Yet EPA is extremely (...) successful. Pokazalo se da u svijetu »množina« vladaju zakonitosti koje određuju današnjeg čovjeka više nego je to filozofija spremna detektirati. Snaga i uvjerljivost epa danas je sadržana u malim sloganima, uz pomoć kojih se upravlja javnim mnijenjem i masama massmedijski oblikovanih (...) potrošača informacija. Slogani su sonde pomoću kojih globalne korporacije osvajaju strukture mišljenja i govora. It seems that in a world of “plurals” there are laws that define today’s man more than philosophy is prepared to detect. The strength and convincingness of epics is sublimated into little slogans, used to manipulate public opinion and hordes of information consumers shaped by the mass media. Slogans are really probes with which global corporations conquer the structures of opinion and speech. The multiplication of advertising messages, political slogans, warmongering sentences and spectacular meaninglessness – ends up in a copy/paste culture, which is, unaware of mechanisms and technologies, slowly but surely starting to take its place on the store-shelves of global marketers. McLuhan’s work "Mechanical Bride" was the first to seriously consider the meaning that the seemingly common advertising slogans can have for the shaping of a conscious and unconscious position of the consumers. By analyzing his approach in this less known work and comparing it with certain suggestive modern phenomena in the Croatian and world public – we outline a context, which should not be eft out of the sight of the modern philosophic thought. President Barack Obama ordered federal regulatory agencies to engage in a retrospective regulatory review process in early 2011. This paper reports the initial results of an analysis of participation in the notice and comment process by business and public interest groups. The focus of the analysis is on comments given to the Environmental Protection Agency (EPA). Some attention is given to the EPA’s identification of regulations to be reviewed, as a result of this process.

Genetically engineered organisms have been at the center of ethical debates among the public and regulators over their potential risks and benefits to the environment and society. Unlike the currently commercial GE crops that express resistance or tolerance to pesticides or herbicides, a new GE crop produces two bioactive nutrients and docosahexaenoic acid ) that heretofore have largely been produced only in aquatic environments. This represents a novel category of risk to ecosystem functioning. The present paper describes why growing oilseed (...) crops engineered to produce EPA and DHA means introducing into a terrestrial ecosystem a pair of highly bioactive nutrients that are novel to terrestrial ecosystems and why that may have ecological and physiological consequences. More importantly perhaps, this paper argues that discussion of this novel risk represents an opportunity to examine the way the debate over genetically modified crops is being conducted. (shrink)

This paper investigates the impact of the historical factor on language choice in Protestant Churches in Cameroon. It is based on the postulate that religious languages are more stable than their secular counterparts, not only in their forms, but also in their variety. Therefore, it was hypothesized that the first language group to come in contact with the mother mission society of a religious variety is likely to remain the major group in the church, and its language, the liturgical language. (...) To verify this hypothesis, the researcher analysed language use in three Protestant parishes located in the Yaoundé metropolis: the Oyom-Abang parishes of the Eglise Evangélique du Cameroun and Eglise Presbytérienne Camerounaise, and the Yaoundé-Melen-Philadelphie parish of the Eglise Protestante Africaine. The data were collected via participant observation and informal interviews. Their analysis revealed that the use of indigenous languages for key parts of a church service in the three parishes selected was usually associated with the place where the Church was founded, which is the area where its mother mission society first settled in the country. In that vein, the following languages were reported: Bamileke at EEC Oyom-Abang, Basaa at EPC Oyom-Abang, and Ngumba at EPA Yaoundé-Melen-Philadelphie. (shrink)

Calendrical astronomy had a parallel but separate development in China and in India. Both were eventually lunisolar and utilized circumpolar stars, which made Ursa Major and the pole star ideologically important. Initially the Early Harappans could orient their towns according to cardinal directions and the sun probably symbolized the king. Their calendar was heliacal with Aldebaran as the new year star. Indus Civilization created the lunisolar calendar, the nakṣatras, started the new year with the Pleiades, used the gnomon, and knew (...) planets. “Bull of Heaven” and “Sky Garment” were borrowings from Mesopotamia. The paper also deals with the heavenly crocodile and its connection with crocodile cult, the Śunaḥśepa legend, and God Varuṇa’s heavenly banyan tree, which is connected with the pole star’s Dravidian name and its function in Purāṇic cosmology. The purpose of this study is to understand the trust formation expectations of stakeholders in the implementation of information and communications technology for development (ICT4D) projects.,This paper uses a qualitative methodology inspired by a critical approach. It uses a thematic analysis approach, and draws the results using a constant comparison method. It is guided by the Pierre Bourdieu’s theory of practices. This is an empirical study that uses semi-structured interviews for the data collection.,Lack of an integrated view of emancipatory expectations (...) has a negative impact on the trust levels of stakeholders. An integrated view of emancipation has physical, moral and social dimensions.,The study brings forth the concept of entry point activities (EPAs). To the author’s knowledge, this is the first application of this concept in ICT4D research. EPAs can be used to develop trust relationships between the stakeholders of ICT4D projects. (shrink)

A great deal has been made of the question of whether nano-materials provide a unique set of ethical challenges. Equally important is the question of whether they provide a unique set of regulatory challenges. In the last 18 months, the US Environmental Protection Agency has begun the process of trying to meet the regulatory challenge of nano using the Toxic Substances Control Act (1976)(TSCA). In this central piece of legislation, ‘newness’ is a critical concept. Current EPA policy, we argue, does (...) not adequately (or ethically) deal with the novelty of nano. This paper is an exploration of how to do a better job of accounting for nanomaterials as ‘new.’ We explore three alternative ways that nanomaterials might be made to fall under the TSCA regulatory umbrella. Since nanomaterials are of interest precisely because of the exciting new properties that emerge at the nano-scale, each of these three alternatives must meet what we call the ‘novelty condition’ and avoid what we call the ‘central paradox’ of existing regulatory policy. Failure to meet either of these conditions is a moral failure. We examine both the strengths and weaknesses of each alternative in order to illuminate the conceptual, practical, and moral challenges of novelty. (shrink)

This study examines the relationship between corporate diversification strategy and the pollution activity of subsidiaries within the U.S. chemical industry using TRI data (EPA's Toxic Release Inventory). The subsidiaries of conglomerates were found to exhibit higher pollution levels for direct emissions than those of firms pursuing more related diversification strategies. Additionally, the subsidiaries of conglomerates exhibited more variance in overall pollution emissions compared to related diversified firms.

Multiple scholars and institutions have asked what distinguishes public health research from public health practice. Most often, they ask in order to have a clear definition of what one does in various public health settings to assess oversight and/or regulation of human subjects research. More importantly, however, whether something is considered public health research or public health practice has real ethical implications in terms of the general moral considerations at stake and the obligations of public health researchers/practitioners to the populations (...) they serve or study.Numerous examples in recent history of research ethics, including the Kennedy Krieger Lead Abatement Study and EPA’s Children’s Environmental Exposure Research Study, suggest that an exploration of the ethics of public health, or more generally population-based research, may be warranted. Although we acknowledge that there are important ethical issues to consider in the implementation of public health practice, we leave that discussion for other authors. (shrink)

Animal suffering seems to undermine several well-known traditional theistic responses to the problem(s) of evil, such as the appeal to the Fall of Humanity or to human free will. The soul-making theodicy is also inapplicable to non-human animals, if it should turn out that they do not have souls capable of being improved by suffering. Recently, however, it has been suggested by Trent Dougherty that when the soul-making theodicy is combined with the Adams-Chisholm notion of the defeat of evil and (...) other hypotheses regarding the animal afterlife, such a theodicy can overcome the challenge posed by animal suffering. We highlight problems for this strategy, showing that it ultimately keeps the fundamental reason for suffering obscure and requires the addition of several auxiliary hypotheses, thus offering no epistemic improvement over generic Skeptical Theism. We also consider the strategy in the light of a newer argument known as the Expanded Problem of Animal Suffering (EPAS), showing that this puts additional strain on Dougherty’s theodicy. (shrink)

This study examined the influence of corporate giving programs on the link between certain categories of corporate crime and corporate reputation. Specifically, firms that violate EPA and OSHA regulations should, to some extent, experience a decline in their reputations, while firms that contribute to charitable causes should see their reputations enhanced. The results of this study support both of these contentions. Further, the results suggest that corporate giving significantly moderates the link between the number of EPA and OSHA violations committed (...) by a firm and its reputation. Thus, while a firm's reputation can be diminished through its violation of various government regulations, the extent of the decline in reputation may be significantly reduced through charitable giving. A new approach to environmental policy analysis is introduced that is designed to mitigate the exacerbation of environmental problems, which can result from the application of traditional approaches in environmental decision making. These approaches are problematic because they tend to rely on technical fixes, a single-discipline focus, and optimality. When such traditional approaches are applied, complex environmental problems are simplified beyond recognition, and the solution produced no longer matches the original problem. An alternative approach has been developed at the U.S. (...) Environmental Protection Agency (EPA) that is designed to improve the utilization of scientific research results and data (social, physical, and biological) through a more inclusive problem-solving process aimed particularly at difficult and complex environmental issues. Using a policy application pertaining to the EPA’s 1995 decision to approve a fuel additive, the authors illustrate how integrated environmental policy decision analysis can be made operational using this new approach. Focusing on the recent explosion in the use of bottled water, this article—originally written for my NASTS conference presentation—will examine the rhetoric used by the bottled water industry and home purification system providers to affect the public’s idea of clean, pure, dirty, and polluted water. Bottlers argue that the Food and Drug Administration (FDA) provides better regulation of bottled water than the Environmental Protection Agency (EPA) could ever do for tap water, though the EPA and the FDA use basically the (...) same set of guidelines. The EPA and FDA definitions in terms of concentrations of specific substances are very different from the ideas of muddy or “dirty” water. This article will examine the impact of the public’s perception of good drinking water and the perception that if it is off the shelf, it is cleaner and tastier. (shrink)

In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...) the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future. In the early 1970s, the idea of precaution—of heeding rather than ignoring scientific evidence of harm when there is uncertainty, and taking action that errs on the side of safety—was so appealing that the US Congress used it as the basis of the toxics provisions of the Clean Water Act of 1972, the federal Environmental Protection Agency based its proposals for implementing those provisions on it, and the courts frequently tended toward it when resolving conflicts over the implementation of pollution (...) control law. In other words, precaution was written into toxic water pollutant control law and was beginning to be written into policy and regulations. By 1976, the tables were completely turned. The EPA abandoned the safety-providing approach in the implementation of the law, even though the law required it, and adopted a risk-taking approach in the creation of standards for the vast majority of toxic water pollutants. The article examines how this change was brought about. It builds on recent work on undone science as an obstacle to regulation and contributes to the development of an account of the creation of the regulatory system, with both its achievements and its limitations. ChurchillRecent essays in Perspectives and Biology and Medicine, including "Can Clinical Ethics Survive Climate Change" by Andrew Jameton and Jessica Pierce and "Ethical Maxims for a Marginally Inhabitable Planet" by David Schenck and Larry R. Churchill, both appearing in the Autumn 2021 issue, inspired conversations between us, among our colleagues, and with various (...) contributors to this symposium. We asked of ourselves and each other: where can, should, or must bioethics as a field go to make what bioethicists know and publish about in the academic literature relevant to public policy decisions, health and technological innovation, and a general public? In other words, where do we, practically speaking, go with our bioethical insights and discoveries to make a tangible impact on issues like climate change—though that is only one of the various topics that the authors in this symposium tackle.This translational work of connecting scholarly innovation back to overt practical innovation is often peripheral to academic bioethics. It is not the work the academy typically recognizes in its credit system. Yet this translational work is becoming a critical, central duty of bioethics for the 21st century, while the kinds of work the academy most valorizes may be the least important at this time. In particular, the need for translational initiatives is increasingly evident as pandemics linger into a new normal, the long history and ongoing impacts of racism become even more evident at institutional levels, and the devastating health implications of global warming emerge. [End Page 515]Bioethicists function in privileged proximity to the deleterious effects of failed health and social policy, as well the interplay between seemingly personal health choices, such as those related to diet or lifestyle, and inequitable conditions that impact the options available to individuals and groups. We are increasingly distressed by what we see from this privileged window into health. The COVID-19 pandemic has made preexisting social and policy inequities impacting health impossible to ignore. At the same time, the patterns of carbon pollution portend health crises of unprecedent severity and magnitude in the near future—and will likely deepen inequities and disparities already occurring between those most contributing to, and those most harmed by, climate change.As a field, bioethics has, since its start, been at the intersection of theory and practice. But it is not sufficient for the field to reside passively at this crossroads. The field must be constantly innovating new byways and highways, new offshoots from existing pathways and connector roads between them, that build out both the theory and practice of bioethics in a mutually innovative relationship to each other. Bioethics does not make sense without attention to the real-world practices and the lived realities of health and care. The practical engagement is what deepens and enriches theory, in ways that are more responsive to the real world in which bioethicists toil. But it also is not enough to merely contribute to the body of bioethics scholarship. The translational bioethics we envision is also about using novel theories and concepts to actively shape practices and realities; it is a bioethics in which theory and practices mutually influence each other, each reaching out to generate and change the other.This collection of essays, drawn from a diverse number of scholars, offers several promising paths forward. The essays were written in the spring of 2022, two years into the COVID-19 pandemic, two years after the murder of George Floyd and international attention to the movement for Black lives, and for the most part in the weeks just prior to a set of US Supreme Court decisions with enormous impacts on health, including the June 24 Dobbs v. Jackson Women's Health Organization and the June 30 West Virginia v. EPA decisions.The authors are diverse in age, spheres of work, discipline, sex, race, and ethnicity. They expand our vision for what bioethics can and should be. While we have grouped the essays by subject matter, most of the pieces speak to the field as a whole and invite cross-fertilization. In The Political Limits of Environmental Regulation: Tracking the Unicorn, Bruce Yandle identifies some of the key weaknesses of federal environmental regulation, including its regressive effects, its tendency to better serve selected political interests than the cause of environmental protection, and the EPA's failure to follow sensible priorities. Additional problems may also be cited, including the tendency to exclude citizens? voices from deliberations regarding the degree of pollution control. But Yandle's conclusion regarding the likely superiority of decentralized and market?sensitive alternatives (...) to centralized regulation is overstated. Any such alternatives necessarily will continue to be grounded in relatively uniform national standards. Moreover, in the context of American political economy, market?based controls would continue to deny many citizens real voice and choice. The quest continues to be for the combination of controls that best preserves both the environment and liberty. (shrink)

In this article, we have examined how Japan has supported ASEAN's economic integration through ODA and other diplomatic measures, and showed how Japan's engagements in ASEAN economic integration evolved over time. In addressing these issues, we took into account the growing influence of China's ascent in Southeast Asia, and assumed that Japan's China policy of mixed became explicit in Japan's ASEAN policy. The pronouncement of support for ASEAN integration, disbursement of aid to the region, forging of bilateral and regional FTAs/EPAs (...) with ASEAN, and its recent initiatives and proactive involvement in the Mekong regional development are indicative of Japan's reactive posture on China's growing influence in the region. Japanese diplomatic initiatives in ASEAN are intended, in part, to accommodate and balance China's increasing prominence in Southeast Asia. This explains the simultaneous existence of competitive and cooperative initiatives of the two countries with ASEAN. (shrink)

Abstractabstract:Long before COVID-19 made social distancing familiar, people with cystic fibrosis (CF) already practiced such behaviors. CF is held up as a classic example of genetic disease, yet people with CF are also susceptible to bacteria from the environment and from other CF patients. Starting in the 1980s, a bacterial epidemic in the CF population highlighted clashing priorities of connection, physical safety, and environmental protection. Policymakers ultimately called for the physical separation of people with CF from one another via recommendations (...) that reconfigured the CF community. Simultaneously, medical researchers recognized that one highly transmissible CF pathogen called cepacia was being developed for environmental applications and got the EPA to limit cepacia's environmental deployment. Environmental regulations speak to the challenge of useful microbes that harm a minority, but CF cross-infection also involves legal implications for microbial and genetic discrimination, social consequences for CF communities, and ethical questions about balancing autonomy, harms, and benefits. As scientists increasingly study connections between host genetics, microbial genetics, and infectious risks, CF is a vital referent. (shrink)

Estimates of unknown quantities are influenced by both self-generated anchors (SGAs) and externally provided anchors (EPAs; e.g., the advice of others). It was hypothesised that people use the degree of similarity between these anchors to render final responses. Thus we tested predictions drawn from metacognitive accounts of anchoring using procedures similar to the traditional anchoring paradigm. In a single experiment we manipulated SGA–EPA similarity, EPA level, and EPA source credibility. Results showed that the relationship between SGA–EPA similarity and the decision (...) weight given to the EPA, relative to the weight given to the SGA, depended on source credibility. Bolstering the metacognitive framework, participants were most confident about their final responses when their SGA was similar to the EPA and the EPA came from a highly credible source. These results support a metacognitive account of the anchoring heuristic. (shrink)

ZusammenfassungIn einem Modellprojekt soll durch die Einführung einer persönlichen, einrichtungsübergreifenden, elektronischen Patientenakte nicht nur die Behandlungskontinuität verbessert, sondern auch das Recht auf informationelle Selbstbestimmung dahingehend realisiert werden, dass jeder Patient zum Administrator einer Datencloud gemacht wird, die alle seine Gesundheitsdaten enthält. Eine systematische Literaturrecherche zum Thema „elektronische Patientenakten “ soll mögliche ethische Herausforderungen in Verbindung mit der oben genannten PEPA antizipieren. Von initial 2487 Publikationen wurden 51 Publikationen ausgewertet: 30 empirische Studien, 10 medizinethische Analysen und 11 Meinungspapiere. In den empirischen (...) Studien wurden als erste Effekte einer EPA vor allem eine vollständigere medizinische Aktenlage beschrieben. Mit der Einsichtsmöglichkeit für den Patienten in die EPA konnten zusätzlich ein besseres Krankheitsverständnis und damit erhöhte Compliance des Patienten nachgewiesen werden. Eine Verbesserung der Behandlungsqualität wurde auf die Fehlervermeidung durch Patienteneinsicht, effektivere Nutzung der Arzt-Patienten-Besuche und das verbesserte Verständnis für das Therapiekonzept zurückgeführt. Ebenfalls wurde in den Studien eine Stärkung des Vertrauensverhältnisses von Arzt und Patient beschrieben. Bedenken gab es im Vorfeld vieler Studien hinsichtlich des Datenschutzes, eines möglichen Verlustes der persönlichen Arzt-Patienten-Beziehung und einer potentiellen Überforderung des Patienten. In der Beurteilung der EPA spielte die Abwägung zwischen ärztlicher Fürsorge und Patientenautonomie eine große Rolle. Die von medizinethischer Seite geäußerten Bedenken bezüglich eines Vertrauensverlustes oder einer Störung des Arzt-Patienten-Verhältnisses konnten in den empirischen Studien nicht bestätigt werden. Die befürchteten Risiken im Datenschutz wurden von den Betroffenen zugunsten des potentiellen Nutzens einer EPA abgewogen. Unter Wahrung des Datenschutzes hat daher die PEPA das Potential, durch die Mitbeteiligung des Patienten das Arzt-Patienten-Verhältnis positiv zu beeinflussen. Die spezifischen ethischen Herausforderungen, die mit der Co-Verwaltung der PEPA einhergehen, werden im Modellprojekt untersucht. (shrink)

The debate over euthanasia and physician-assisted suicide continues to ignore the philosophical anthropology on which certain critical claims rest. In this paper, I offer several anthropologically based arguments against one prominent justification for EPAS: the Argument from the Evil of Suffering. I demonstrate that the argument is, at its core, a utilitarian one, and that a sound rebuttal can be found by examining Karol Wojtyla/Pope John Paul II's view of suffering as a transformative experience for the human person. Wojtyla both (...) rejects the secular bioethics vision of meaningless, quantifiable suffering, but also offers to take Christian bioethics far beyond the story of Job and into the realm of phenomenological change. By focusing on participation of the suffering sick in community with others, and rejecting alienation, Christians can arrive at a more complete conception of suffering that embraces the complementarities of philosophy and theology. After summarizing what I take to be the main contribution of Norton’s book––his proposal for a new vocabulary for public discourse as it pertains to environmental stability––I attempt to locate his work among some of the current debates regarding sustainability and public policy. I detail some of the ways in which this work constitutes a further development of themes he presented in 1991 in Toward unity Among Environmentalists. I discuss his prescriptions for defusing confrontations regarding environmental policy by functionalizing issues (...) in ways that cut across historically entrenched interest groups. From the standpoint of method, I␣argue that Norton has stacked a Habermas- type proceduralism on top of a pragmatic experimentalist platform (and I add that if he had constructed his method the other way around it would not have worked.) In all this I find Norton’s proposals both imaginative and full of promise. (shrink)
