Proceeding from the insights of Petrażycki, Polish-Russian legal realists distinguished legal theory, legal dogmatics, and legal policy. Legal theory describes legal phenomena in a value-free way and formulates causal laws concerning those phenomena. Legal dogmatics and legal policy are, by contrast, value-laden sciences involving the subject's—i.e., the scientist's—own attitudes toward existing or imagined phenomena: Dogmatics evaluates behaviors based on the subject's adoption of given normative sources as binding, while legal policy evaluates the effects produced by given NSs based on causal (...) laws and on the subject's goals. PRRs then conceptualize custom as a representation of people behaving in a certain way : We have a custom on the threefold condition that Rc is believed true by a given X, Rc causes the existence of a given normative psychical experience in X, and X expressly refers to—or would refer—to Rc in justifying an NPE. PRRs use the term customary law to refer to legal experiences caused and justified by an Rc. From a theoretical perspective, both the subject's adoption of custom as a binding NS and its truth are irrelevant. It is only the presence of a customary NPE in the X under study that matters. From a dogmatic perspective, by contrast, what matters is whether the dogmatician—qua subject—adopts custom as a binding NS, whether it is true that people behave in a given way bw, and whether bw resembles the behavior that is deontically qualified in the norm under dogmatic evaluation. Finally, from a legal-political viewpoint, PRRs hold that customary law in modern societies, owing to its conservative nature, should be eradicated for the goal of removing inequalities and fostering benevolence. A pesquisa “Formação do leitor: o processo de mediação do docente” enfoca práticas mediadoras de leitura do texto literário, em ambiente escolar, nas séries iniciais do Ensino Fundamental. Inicialmente buscou-se investigar as práticas de leitura literária desenvolvidas em turmas de 3ª série e na biblioteca escolar de escolas localizadas em Caxias do Sul. As ações desenvolvidas são restritas e ante o quadro, o projeto organiza propostas de leitura literária a partir de diversos gêneros literários. O subprojeto “Leitura e mediação do (...) conto popular” focaliza o conto popular como gênero presente na formação do leitor literário, uma vez que a análise do corpus coletado aponta que há falhas na abordagem dessa narrativa. Provavelmente isso ocorre pela falta de clareza sobre as qualidades que conferem a uma obra o estatuto de literatura. Também se nota a predominância de concepções estruturalistas de leitura na prática docente, produzindo leituras autoritárias, que prevalecem sobre práticas mediadoras. Para estudar a natureza do conto popular, buscas e apoio em Jolles (1976), Jesualdo (1982), Cascudo (1998, 2002) e Azevedo (2008a, 2008b). A partir da análise do conto e dos dados coletados, constroem-se princípios e estratégias para a mediação de leitura do texto literário infantil, utilizando estudos de Saraiva (2001) e Saraiva e Mügge (2006). Esse referencial embasa a elaboração de roteiros de leitura para obras literárias infantis, entre elas A lenda do guaraná: mito dos índios sateré-maué, de Fittipaldi, objeto de estudo dessa proposta de trabalho. Acredita-se que a apresentação de propostas de leitura literária contribua para a formação continuada do docente, para qualificar a interação entre objeto de leitura e leitor iniciante. (shrink)

An individual, as this term will be understood here, is an entity to which the concepts of unity and identity fully and determinately apply. That is to say, an entity x is an individual just in case x determinately counts as one entity and x has a determinate identity. Many philosophers tacitly assume that all entities are individuals in the foregoing sense, and indeed that it is a necessary truth that they are. But this can certainly be disputed. It is, (...) very arguably, both logically and metaphysically possible for there to be nonindividuals. The aim of this chapter is to clarify and explore both the notion of an individual and that of a nonindividual, to propose a typology of entities based on the individual/nonindividual distinction, and to illustrate the potential of these notions for application within and across the sciences. In QALY-thinking, an activity that takes N people from a bad state (including 'dying') to the state of healthy for X years should have priority over an activity that takes N other people from the same bad state to a state of moderate illness for the same number of years (given equal costs). An empirical study indicates that this view may not be shared by the general public in Norway. Subjects tended to emphasise equality in value of life and in (...) entitlement to treatment rather than level of health after treatment. The relevance of costs per QALY in prioritising between different health care programmes in Norway is thereby brought in to doubt. While the sample in the study is too small to support firm policy conclusions, the results should contribute to an increased interest among health economists in actually measuring people's ethical preferences in matters of prioritising, rather than taking it for granted that their own values are shared by the general public. Studies examining the ways in which the training of engineers and scientists shapes their research strategies and scientific identities.

In this paper I evaluate the ICE-theory of function ascriptions to technical artefacts as proposed by Houkes and Vermaas, 2004a and Houkes and Vermaas, 2004b. This account adds non-structural concepts to functional description of artefacts, which are typically not employed by engineers when they ascribe functions to artefacts. The aim of this paper is to analyse to what extent the ICE-theory can reproduce the engineering view that artefacts have their functions in virtue of their physicochemical structure. It is shown that (...) this theory can reproduce this engineering view for components of artefacts but not for the artefacts themselves: engineers can ascribe functions to components on the basis of only the physicochemical structure of artefacts; but when engineers ascribe functions to artefacts as a whole, they have to consider explicitly the goals for which agents use artefacts and the actions that constitute this use.Keywords: Function theory; Technical artefacts; Components; Physics and chemistry; Engineering; Action theory. Substance addiction affects millions of individuals worldwide and yet there is no consensus regarding its conceptualisation. Recent neuroscientific developments fuel the view that addiction can be classified as a brain disease, whereas a different body of scholars disagrees by claiming that addictive behaviour is a choice. These two models, the Brain Disease Model and the Choice Model, seem to oppose each other directly. This article contends the belief that the two models in the addiction debate are polar opposites. It shows (...) that it is not the large amount of addiction research in itself what sets the models apart, but rather their extrapolated conclusions. Moreover, some of the most fiercely debated aspects - for instance, whether or not addiction should be classified as a disease or disorder - are irrelevant for the conceptualisation of addiction. Instead, the real disagreement is shown to revolve around capacities. Discussing addiction-related capacities, especially regarding impaired control, rather than the assumed juxtaposition of the two models can be considered the true addiction debate. More insight into the extent to which the capacities of the addicted individual were affected would be highly useful in various other areas, especially legal responsibility. (shrink)

This paper argues that environmental virtue ethics requires the adoption of an ethical ideal in order to guide the identification and practice of virtues. I recommend friendship as one such ideal due to emphasis such an ideal places upon the quality of the relationship with nature rather than the evaluation of individual actions. After describing the value of friendship as an ethical ideal, I respond to some of the objections that have been raised against it in the context of environmental (...) virtue. (shrink)

Academia bases reputation and standing on the number of published articles. As a result, the abilities and potential of researchers are also being judged by the number of articles they write, as well as on the impact factor of the journals in which their articles are being published. In itself this is not a problem, although one could of course question the assumption that the quantity of the output reflects the competence of individual researchers. As Altman has stated: “The length (...) of a list of publications is a dubious indicator of ability to do good research.”1 However, if senior faculty decide that the career progress of junior researchers in academia should be based on these criteria, academic medicine is bound to fail in fulfilling its role, namely maximising the quality of medical research and doing research for the right reasons. Whether we like it or not, whether we realize it or not, the methods of science impinge upon and affect our daily lives. In the four centuries during which they have been properly understood and used, these scientific methods not only have enlarged man's stock of knowledge many thousandfold but also have helped bring about changes in outlook and, indeed, in man's physical environment, far outstripping the changes that took place throughout all the rest of recorded human history. Yet, one (...) of the paradoxes of our time is that, while we live in an increasingly scientific and technological society, the ordinary citizen's knowledge of and interest in scientific and technical matters seem, in fact, to be declining. This lack of interest sometimes amounts almost to hostility. As a result, leadership, possibly even direct control, of world affairs may be well pass to those nations which are prepared to cultivate their science and technology, while, on a national scale, if the trend continues, only an esoteric "scientific priesthood" will be able to make many of the most important decisions. The sole answer - the only defense - is knowledge. To arouse the interest of laymen and students in scientific and technical matters is E. L. Dellow's purpose in writing this book. To achieve this aim, he exploits a trait inherent in most of us - a delight in watching other people work. Rather than setting out to dazzle us by reciting the achievements of science and technology, however, he shows how scientific knowledge, which makes the spectacular achievements possible, is gained, and he gives us some insight into the way in which scientists and technicians think and work. Patient rights are universal values which we have to adopt. It is not so easy, however, to put such values and principles into effect. As approaches and attitudes differ from individual to individual, from society to society, and from country to country, a uniform application of these values is difficult. If we want to reach a general conclusion about the status of patient rights in the world as whole, we should examine the situation in individual countries. As far as Turkey (...) is concerned, we can say that, although the idea of patient rights is accepted in principle, patient rights have yet to be adequately implemented. (shrink)
