Explora a importância de resgatar a história oficial da cidade hegemônica e as histórias vivas da cidade marginalizada. Utilizando a História Oral como metodologia, o estudo visa jogar luz e compreender os processos de ressignificação do território e das identidades negras na comunidade ao se reconhecer como quilombo.

The notion of burden of proof and its companion notion of presumption are central to argumentation studies. This book argues that we can learn a lot from how the courts have developed procedures over the years for allocating and reasoning with presumptions and burdens of proof, and from how artificial intelligence has built precise formal and computational systems to represent this kind of reasoning. The book provides a model of reasoning with burden of proof and presumption, based on analyses of (...) many clearly explained legal and non-legal examples. The model is shown to fit cases of everyday conversational argumentation as well as argumentation in legal cases. Burden of proof determines under what conditions an arguer is obliged to support a claim with an argument that backs it up and how strong that argument needs to be to prove the claim in question. In his article, ‘Recovering Humanity: Movement, Sport, and Nature’, Doug Anderson addresses the place of endurance sport, or more generally sport at large, as a potential catalyst for the good life. Anderson contrasts transcendental themes of Henry David Thoreau and Ralph Waldo Emerson with the pragmatic claims of William James and John Dewey, who focus on human possibility and growth. Our aim is to pursue the pragmatic line of thought championed by James and Dewey as a contrasting but not mutually (...) exclusive motive to Anderson’s analysis. We contend that movement can provide humanizing possibilities even more pronounced for those subscribing to pragmatic themes (i.e., growth and the strenuous mood). We will use running and cycling to demonstrate how the strenuous mood enhances the possibility for this humanizing condition. Specifically, we argue that moving in a committed fashion allows us to deepen our relationship with the respective practice and thus opens the possibilities for ‘recovering our humanity’. (shrink)

Douglas N. Walton considers the question of whether the conventions of informal conversation can be articulated more precisely than they are at present. Specifically, he addresses the problem of the fallacy of ad hominem argumentation as it occurs in natural settings. Can rules be formulated to determine if criticisms of apparent hypocrisy in an argument are defensible or refutable? Walton suggests that they can, and ultimately defends the thesis that ad hominem reasoning is not fallacious per se. He carries (...) his analysis to the core of action--theoretic reasoning--by examining a number of specimen arguments. As suggested by the title, the conclusion of ad hominem argument is demonstrated to be relative to the arguer's position. In the appendixes of the book, articles by Gerald McAuliffe and Gordon R. Shepard's notion of “internalisation” is better interpreted as a simile than a metaphor. A fractal encoding model of visual perception is sketched, in which image elements are transformed in such a way as to maximise symmetry with the current input. This view, in which the transforming system embodies what has been internalised, resolves some problems raised by the metaphoric interpretation. [Hecht; Shepard].

Science is one of the most important forces in contemporary society. The most reliable source of knowledge about the world, science shapes the technological possibilities before us, informs public policy, and is crucial to measuring the efficacy of public policy. Yet it is not a simple repository of facts on which we can draw. It is an ongoing process of evidence gathering, discovery, contestation, and criticism. I will argue that an understanding of the nature of science and the scientific process (...) should be the central goal for scientific literacy, rather than a grasp of specific (often disciplinary) facts. With this understanding of science as a backdrop, the paper then turns to modes for citizen engagement with science. This paper articulates different ways citizens can engage with science, including four avenues for legitimate contestation of scientific claims. I then look more closely at contestation of science on the basis of values. That science can be legitimately contested by non-experts on a range of grounds means that science communication should not just aim at getting citizens to accept scientific claims, but rather to engage in a more robust two-way conversation about science. This paper presents a formalization of informal logic using the Carneades Argumentation System, a formal, computational model of argument that consists of a formal model of argument graphs and audiences. Conflicts between pro and con arguments are resolved using proof standards, such as preponderance of the evidence. CAS also formalizes argumentation schemes. Schemes can be used to check whether a given argument instantiates the types of argument deemed normatively appropriate for the type of dialogue.

Argumentation schemes are forms of argument that capture stereotypical patterns of human reasoning, especially defeasible ones like argument from expert opinion, that have proved troublesome to view deductively or inductively. Much practical work has already been done on argumentation schemes, proving their worth in A1 [19], but more precise investigations are needed to formalize their structures. The problem posed in this paper is what form justification of a given scheme, as having a certain precise structure of inference, should take. It (...) is argued that defeasible argumentation schemes require both a systematic and a pragmatic justification, of a kind that can only be provided by the case study method of collecting key examples of arguments of the types traditionally classified as fallacies, and subjecting them to comparative examination and analysis. By this method, postulated structures for schemes can be formulated as hypotheses to solve three kinds of problems: (1) how to classify such arguments into different types, (2) how to identify their premises and conclusions, and (3) how to formulate the critical questions used to evaluate each type of argument. Argument invention is a method that can be used to help an arguer find arguments that could be used to prove a claim he needs to defend. The aim of this paper is to show how argumentation systems recently developed in artificial intelligence can be applied to the task of argument invention. One such system called Carneades is featured. Carneades can be used to analyze arguments, evaluate arguments, to make an argument diagram, and to construct arguments from a database. Plausible (eikotic) reasoning known from ancient Greek (late Academic) skeptical philosophy is shown to be a clear notion that can be analyzed by argumentation methods, and that is important for argumentation studies. It is shown how there is a continuous thread running from the Sophists to the skeptical philosopher Carneades, through remarks of Locke and Bentham on the subject, to recent research in artificial intelligence. Eleven characteristics of plausible reasoning are specified by analyzing key examples of it recognized as important (...) in ancient Greek skeptical philosophy using an artificial intelligence model called the Carneades Argumentation System (CAS). By applying CAS to ancient examples it is shown how plausible reasoning is especially useful for gaining a better understanding of evidential reasoning in law, and argued that it can also be applied to everyday argumentation. Our analysis of the snake and rope example of Carneades is also used to point out some ways CAS needs to be extended if it is to more fully model the views of this ancient philosopher on argumentation. The notions of burden of proof and presumption are central to law, but as noted in McCormick on Evidence, they are also the slipperiest of any of the family of legal terms employed in legal reasoning. However, recent studies of burden of proof and presumption (Prakken et al. 2005; Prakken and Sartor 2006). Gordon et al. (2007) offer formal models that can render them into precise tools useful for legal reasoning. In this paper, the various theories and formal models are (...) comparatively evaluated with the aim of working out a more comprehensive theory that can integrate the components of the argumentation structure on which they are based. It is shown that the notion of presumption has both a logical component and a dialectical component, and the new theory of presumption developed in the paper, called the dialogical theory, combines these two components. This issue includes a number of papers on reproductive ethics, broadly construed. In a recent book, Anja Karnein proposed that embryos created in vitro should be offered up for adoption before being discarded or used in research;1 here Timothy Murphy offers a critical response . Elsewhere, Tak Chan and Stark & Delatycki debate the role of medical professionals in providing parentage determination. Chan argues that doctors are obliged to provide parentage tests when this is requested by parents, provided there is (...) a low risk that the child will be abandoned . Stark & Delatycki discuss some difficulties raised by the ‘risk of abandonment’ condition . Finally, papers by Kate Greasley and David Lang discuss the controversy surrounding the criminal prosecution of abortion doctor Kermit Gosnell. Greasley criticises the way in which some commentators capitalised on horror at Gosnell's extreme practices to advance more general anti-abortion objectives . Lang argues, against Greasley, that the dominant pro-life response to the case was neither self-contradictory nor intellectually dishonest .The issue is dominated, however, by discussions of ‘bioenhancement’ – the use of biomedical technologies to augment human capacities. A common criticism of bioenhancements is that they are anti-social: though they may benefit the user, they will have a negative effect on society-at-large. Such concerns are perhaps well placed in relation to the most obvious contemporary examples of bioenhancement: doping in sport, aesthetic medicine, and the use of stimulants to enhance examination performance. This paper offers a dialogue theory of explanation. A successful explanation is defined as a transfer of understanding in a dialogue system in which a questioner and a respondent take part. The questioner asks a special sort of why-question that asks for understanding of something and the respondent provides a reply that transfers understanding to the questioner. The theory is drawn from recent work on explanation in artificial intelligence (AI), especially in expert systems, but applies to scientific, legal and everyday (...) conversational explanations. Marriage is a subject of perennial interest, and we should like to be able to assess the exact degree of importance which the Greeks attached to this institution. One of the chief questions is how the formality of marriage, or the lack of it, affected the children of a union; above all, was illegitimate birth a bar to citizenship even in democratic Athens? Unfortunately there is still no general agreement about the answer to this question.

Suggesting that much of social science is still wedded to the ‘dogma of the ghost in the machine,’ I discuss my ethnomethodological and conversation analytic approach to the assembly of cognitive objects. It is important to reverse the usual social psychological metalanguage of mind causing behavior, and see how practices in interaction operate to display cognitive states of participants. Two examples are given: one in regard to the assembly of gestalts, including social actions in talk, and the other concerning the (...) production of responses as accountable phenomena in the survey interview. While advances are being made in brain imaging, the connections between the neurobiology of the mind and the practices embedded in human conduct are tenuous at best. For the social scientist, approaching cognition through practices puts ghosts and other ephemera in abeyance and allows for analysis of the detail exhibited in behavior when minds are purportedly at work. This article examines Shaikh Amadu Bamba Mbacké and his theology as a cogent response to White Supremacy as expressed in French Colonization of Africa. White Supremacy has as its primary goal, the recreation of the whole world in the image of Whiteness upon the premise that the possession of White skin makes one inherently superior. Theism counters this ontological assault with an unabashed turn to a believer's God. Shaikh Amadu Bamba Mbacké's insistence on Islam counters White Supremacy thereby providing an (...) ideological and metaphysical space for the non-whites of Senegal to exist without succumbing to the temptation to aspire to a Euro-centric ideal. Walton offers a comprehensive, flexible model for physician-patient decision making, the first such tool designed to be applied at the level of each particular case. Based on Aristotelian practical reasoning, it develops a method of reasonable dialogue, a question- and-answer process of interaction leading to informed consent on the part of the patient, and to a decision--mutually arrived at--reflecting both high medical standards and the patient's felt needs. After setting forth his model, he applies it to three vital ethical issues: (...) acts of omission, the cessation of treatment, and possible side effects of treatments. In the final chapter, Walton shows how his method functions in light of the real-life complexities of the clinical encounter and how it bears on ethical questions concerning health-care policy, attitudes toward treatment and toward the medical profession, reasonableness of expectations, and the setting of realistic goals of treatment. Most early modern philosophers held that our emotions are always passions: to experience an emotion is to undergo something rather than to do something. Spinoza is different; he holds that our emotions – what he calls our ‘affects’ – can be actions rather than passions. Moreover, we can convert a passive affect into an active one simply by forming a clear and distinct idea of it. This theory is difficult to understand. I defend the interpretation R.G. Collingwood gives of it (...) in his book, The Principles of Art. An affect, it turns out, is passive when it is ambiguous whether we or somebody else is the subject of the affect. An affect is active when we fully accept the affect as our own. Here, I outline Collingwood's interpretation and then develop it further. (shrink)

This paper makes a case for a refined look at the so- called ‘fallacy of hasty generalization’ by arguing that this expression is an umbrella term for two fallacies already distinguished by Aristotle. One is the fallacy of generalizing in an inappropriate way from a particular instance to a universal generalization containing a ‘for all x’ quantification. The other is the secundum quid (‘in a certain respect’) fallacy of moving to a conclusion that is supposed to be a universal generalization (...) containing a ‘for all x‘ quantification while overlooking qualifications that have to be added to the more limited kind of generalization expressed in the premise. It is shown that these two fallacies relate to two different kinds of generalization. (shrink)
