In several jurisdictions, sex offenders may be offered chemical castration as an alternative to further incarceration. In some, agreement to chemical castration may be made a formal condition of parole or release. In others, refusal to undergo chemical castration can increase the likelihood of further incarceration though no formal link is made between the two. Offering chemical castration as an alternative to further incarceration is often said to be partially coercive, thus rendering the offender’s consent invalid. The dominant response to (...) this objection has been to argue that any coercion present in such cases is compatible with valid consent. In this article, we take a different tack, arguing that, even if consent would not be valid, offering chemical castration will often be supported by the very considerations that underpin concerns about consent: considerations of autonomy. At the core of Swedenborg’s thought is the understanding that our purpose in this life is to progress spiritually—to learn, to grow, to do good works, and, ultimately, to allow as much of God’s love as possible to enter into us and manifest through us. Scattered throughout his works are descriptions of our mind and how it relates to both the physical and spiritual worlds. In this book, Taylor pulls these loose threads together and weaves them into a simple, coherent (...) whole, presenting Swedenborg’s teachings as a system that anyone can follow. Taylor describes the external or natural mind as primarily concerned with material things, and the inner mind, in its essence, as love. As we elevate our thoughts toward higher and higher types of love and wisdom, we draw closer to God and begin the process of regeneration, or rebirth as spiritual beings. This is the first time in many decades that a book has been published on Swedenborg’s philosophy of the mind. As frequently pointed out in this discussion, one of the most characteristic features of Mayr's approach to the history of biology stems from the fact that he is dealing to a considerable degree with his own professional history. Furthermore, his main criterion for the selection of historical episodes is their relevance for modern biological theory. As W. F. Bynum and others have noted, the general impression of his reviewers is that “one of the towering figures of evolutionary biology has now (...) written a towering history of his discipline.”138 Bynum is here referring to The Growth of Biological Thought, but this observation holds equally true for Mayr's other historical writings: One must surely read this book [One Long Argument] not only for its content in itself, but for what it tells of its author. And certainly as one does so, one comes away full-handed. Many, if not all, of the disputes and controversies that have driven Mayr through his long intellectual life reappear, stated as forcefully and elegantly as ever.139Up to this point, most reviewers agree; the bone of contention is, rather, how to evaluate Mayr's historical work, considering this observation. The two related characteristics of his work-I will call them subjectivity and presentism-stand in opposition to a widespread approach in the history of science exemplified by Kuhn's suggestion that “insofar as possible..., the historian should set aside the science that he knows. His science should be learned from the textbooks and journals of the period he studies.”140 There are, however, historians who consider the close connection between Mayr and the subject matter of his historical studies to be an advantage.141On the other hand, it is assumed that the connection between past and present must result in a distortion of the historical truth and lead to a historiographical fallacy, commonly referred to as “Whig history”. Herbert Butterfield, who in 1931 gave the term its now generally accepted meaning, believed that “real historical understanding is not achieved by the subordination of the past to the present, but rather by our making the past our present and attempting to see life with the eyes of another century than our own”142. Unfortunately, Butterfield's definition of what he considers Whig history remains somewhat vague, and modern authors have emphasized what they consider most important. Butterfield's “subordination of the past to the present” is referred to in respect to the selection of subjects (there are more biographies of Charles Darwin than of, let's say, Louis Agassiz),143 to the evaluation of historical authors,144 or, more generally, to all kinds of histories “with one eye, so to speak, upon the present.”145 The underlying tendency of Whig historians is to produce a “historical account told from the viewpoint of those in power,”146 leading to a “glorification of the present.”147 It is obvious that Mayr's strongly presentist approach to the history of biology can be called Whiggish, if we apply the criteria of “selection” or “reference.” However, it might be worth mentioning that the program of writing a strictly historicist account of the history of science is challenged by various authors.148 For Mayr, it is not only legitimate but necessary to compare the present situation with the past. “Whiggish” is only the evaluation of an author in terms of our time.149I cannot discuss the Whit/anti-Whig controversy in any detail here, apart from saying that Mayr has defended himself rather extensively against the charges of being Whiggish.150 Nevertheless, it may be useful to touch on some of the criticisms that are predominant in reviews of his writings. First, we encounter the notion that historians can write a true and convincing historical account only if they have no personal interest or interpretation of their own; Mayr, on the other hand, because he “has such strong interpretations of his own, ... cannot possibly convince everyone that he is right about everything.”151 It makes one wonder, what historian has ever been able to convince everyone that he or she is right about everything? But apart from this peculiar idea, it unquestionably poses certain dangers if the subject matter of historical scrutiny and the author are identical. At the same time, this identity brings certain advantages with it, especially firsthand experiences of the period in discussion. Whether these personal memories ultimately result in a distorted picture of the past has to be decided in every particular instance. The notion that a scientific study can be conducted by a completely detached observer from a neutral standpoint has been shown to be impossible in physics, and it is also an illusion in historiography. The question is not whether, but which kind of interest are the underlying motivation for a historian. At this point, Mayr is ahead of his critics when he suggests that our understanding of the past always has a subjective component: The main reason, however, why histories are in constant need of revision is that at any given time they merely reflect the present state of understanding; they depend on how the author interpreted the current zeitgeist of biology and on his own conceptual framework and background. Thus, by necessity the writing of history is subjective and ephemeral.152Second, the temporal proximity between the event and the historical analysis makes difficulties inevitable and will finally result in certain false assessments. But this applies to all historians when they discuss recent problems, regardless of whether they are personally involved or not: As long as the battle between Darwinism and Lamarckism was raging, it was quite impossible to undertake an unbiased evaluation of Lamarck. ...[The] definite refutation of Lamarck's theory of evolutionary causation clears the air. We can now study him without bias and emotion and give him the attention that this major figure in the history of biology clearly deserves.153Third, Mayr is primarily interested in biological problems and not, for instance, historiographical, sociological, or psychological questions. Several authors have remarked that since the beginning of the professionalization of the history of science in the 1960s, a rift between two groups has developed, resulting from the heterogeneous professional backgrounds and interests of the people involved: the authors who were originally biologists and became interested in the history of their discipline only later on, and the authors who were trained as historians.154 Whereas the first group, the “biologists,” tend to be laymen in history proper, the “historians” are in most cases laymen in biology. Different professional backgrounds obviously shape the historical perspective in both groups, but neither approach is necessarily superior. The great number of important books in the history of biology written by “biologist” documents how valuable this point of view can be. On the other hand, it cannot be denied that the writings of biologists in the history of science tend to have a strong “internalist” tendency and often neglect the professional, cultural, and political context of science. Mayr's approach is that of a “biologist”; it is “internalist,” and typical for scientists who turn to the history of their discipline.I want to conclude my analysis with a quotation from a review by Douglas J. Futuyma, which gives a perceptive glimpse of Mayr's personality and style: One cannot help standing in awe of the germanic capacity for vast, allembracing synthesis: consider the lifelong devotion of Goethe to Faust, or Wagner's integration of the arts into a Gesamtkunstwerk in which all of human history and experience is wrought into epic myth. It is perhaps in this tradition that Ernst Mayr's The Growth of Biological Thought stands: a history of all of biology, a Ring des Nibelungen complete with leitmotivs such as the failures of reductionism, the struggle of biology for independence from physics, and the liberation of population thinking from the bounds of essentialism.155 Within this style of thinking Mayr has “to offer...nothing less than a vision of biology that places neodarwinian evolutionary theory firmly at the centre.”156 There may be other visions of biology, but few of them have as indefatigable and able representatives as Darwinism has in Ernst Mayr. The Nature and Status of Critical Questions in Argumentation Schemes.

Can philosophy be a source of hope? Today it is common to believe that the answer is no - that providing hope, if it is possible at all, belongs either to the predictive sciences or to religion. In this exciting and simulating book, however, Alexander Douglas argues that the philosophy of Spinoza can offer something akin to religious hope. Douglas shows how Spinoza is able, without appealing to belief in any traditional afterlife or supernatural grace, to develop a (...) profound and original theory of how humans can escape from the conditions of death and sin. Douglas argues that this theory of escape, which Spinoza calls beatitude, is the centrepiece of his entire philosophy, though scholars have often downplayed or ignored it. One reason for this scholarly neglect might be the difficulty of understanding Spinoza's theory, which departs from the standard doctrines and methods of Western philosophy. Douglas's interpretation therefore seeks inspiration beyond the Western tradition, drawing especially on the classical Daoist text Zhuangzi and its commentaries. Here, Douglas argues, surprising resonances with Spinoza's core ideas can be found, leading to a new way of understanding his strange yet compelling theory of beatitude. (shrink)

This paper shows how the critical questions matching an argumentation scheme can be mod-eled in the Carneades argumentation system as three kinds of premises. Ordinary premises hold only if they are supported by sufficient arguments. Assumptions hold, by default, until they have been questioned. With exceptions the negation holds, by default, until the exception has been supported by sufficient arguments. By “sufficient arguments”, we mean arguments sufficient to satisfy the applicable proof standard.

This paper compares the features and methods of the two leading implemented systems that offer a tool for helping a user to find or invent arguments to support or attack a designated conclusion, the Carneades Argumentation System and the IBM Watson Debater tool. The central aim is to contribute to the understanding of scholars in informal logic, rhetoric and argumentation on how these two software systems can be useful for them. One contribution of the paper is to explain to these (...) potential users how the two tools are applicable to the task of inventing arguments by using some simple illustrative examples. Walton's book is a study of several fallacies in informal logic. Focusing on question-answer dialogues, and committed to a pragmatic rather than a semantic approach, he attempts to generate criteria for evaluating good and bad questions and answers. The book contains a discussion of such well-recognized fallacies as many questions, black-or-white questions, loaded questions, circular arguments, question-begging assertions and epithets, ad hominem and tu quoque arguments, ignoratio elenchi, and replying to a question with a question. In addition, Walton develops several (...) artificial dialogue games and has an excellent discussion of burden of proof in nonlegal contexts. The discussion is for the most part nontechnical and does not presuppose any training in formal logic. It is illustrated with many (sometimes overlong) examples of fallacies drawn from real life--mostly debates in the Canadian House of Commons. . . . Walton's book breaks new ground on a number of issues. Choice This first full-length study of logical fallacies, errors, faults, illicit attacks, blunders, and other critical deficiencies in interrogation and reply has been written in the tradition of informal fallacies in logic. It is especially valuable, readable, and interesting because of the 139 case studies it presents, many of these case studies come from political debates and some from interviews, legal cross-examinations, and other sources. Walton uses these challenging examples of tricky, aggressive, argumentative, or fallacious questions to develop coherent and pragmatic guidelines for criticizing questionable questions (and in some cases their replies) on logical grounds. Among the types of problematic questions analyzed are: the traditional so-called fallacy of many questions, illustrated by the famous Have you stopped beating your wife?; black and white questions; terminologically loaded questions; and questions containing personal attacks. These and other types of problematic questions as well as evasive replies and replying to a question with a question are studied. Critical errors of reasoning are identified and analyzed by developing context-based, normative models of reasonable dialogue in which a questioner must have freedom to ask informative and probing questions, and the respondent must be constrained to give reasonably direct, not overly evasive answers. In this era of negative and evasive political campaigning, with candidates employing skillful tactics of manipulating public opinion to assure election rather than taking clear stands and seriously debating issues in an informed and sincere manner, Question-Reply Argumentation is especially relevant reading for those who take democracy seriously. The methods used reflect a significant shift from earlier semantically based theories to current pragmatic, dialogue-based models, and will be of interest to logicians and linguists. The volume's conclusions should challenge some current preconceptions. Recommended reading for courses in logic, speech communications, linguistics, philosophy of language, areas of political science relating to political discourse and debate, courses on questioning in cognitive psychology, and courses on critical thinking in education. This paper emphasizes that, contrary to the claims of ECT experts and the ECT industry, a majority, not "a small minority," of ECT recipients sustain permanent memory dysfunction each year as a result of ECT. The paper exposes the convulsion hypothesis, upon which ECT is allegedly based, as mythological. Finally, through hidden and comparative electrical parameters, it exposes the extreme destructive power of today's "new and improved" ECT devices.

Robertson's earlier work, The New Renaissance projected the likely future impact of computers in changing our culture. Phase Change builds on and deepens his assessment of the role of the computer as a tool driving profound change by examining the role of computers in changing the face of the sciences and mathematics. He shows that paradigm shifts in understanding in science have generally been triggered by the availability of new tools, allowing the investigator a new way of seeing into questions (...) that had not earlier been amenable to scientific probing. The 1991 war against Iraq was one of the first televised events of the global village in which the entire world watched a military spectacle unfold via global TV satellite networks.1 In retrospect, the Bush administration and the Pentagon carried out one of the most successful public relations campaigns in the history of modern politics in its use of the media to mobilize support for the war. The mainstream media in the United States and elsewhere tended to be a compliant (...) vehicle for the government strategy to manipulate the public, imperiling democracy which requires informed citizens, checks and balances against excessive government power, and a free and vigorous critical media (see Kellner 1990 and 1992). Indeed, if the media do not adequately inform citizens, provide a check against excessive government power and corruption, and adequately debate the key issues of the day, democracy is undermined. M oreover, the U.S. media, especially CNN, completely dominated global coverage of the event. CNN had cameras and reporters in Baghdad throughout the war, a large crew in Israel, and live coverage of all U.S. military and government press conferences. Thus its images, discourses, and material tended to shape global coverage of the event. This meant that the Bush administration and Pentagon was able to control the flow of images and discourses and thus to manage the TV spectacle of the Gulf War.2 In this chapter, I first discuss the production of the text of the "crisis in the Gulf" and then "the Gulf war." This will involve analysis of disinformation and propaganda campaigns by the Bush administration, the Pentagon, and their allies, as well as dissection of the constraints produced by the so-called pool system. I also indicate how the political economy of the media in the United States facilitated the manufacturing of consent for U.S. government policies. Then I analyze the meanings embedded in the text of the war against Iraq and the reception of the text/event by the audience.. (shrink)

This article concerns a recent methodological debate in American sociology that generated widespread attention in the United States. It was a debate that spanned at least four journals: American Journal of Sociology, Sociological Methods & Research, Qualitative Sociology and American Journal of Cultural Sociology. As the debate was not just about methods per se but about the ‘theory of reality’ underlying each method and its ‘social ontology’, critical realism has much to say about it. Although at the end everyone comes (...) around to critical realism's position of methodological pluralism, what makes the debate interesting is the reasoning, the ontological assumptions, and the surprising directions of attack. Above all this article will take issue with the assumption common to all disputants that people tend ‘to give self-contradictory and inadequate accounts of their actions and motives’. (shrink)

This article considers what can be learned regarding the ethical acceptability of intrusive interventions intended to halt the spread of infectious disease (‘Infection Control’ measures) from existing ethical discussion of intrusive interventions used to prevent criminal conduct (‘Crime Control’ measures). The main body of the article identifies and briefly describes six objections that have been advanced against Crime Control, and considers how these might apply to Infection Control. The final section then draws out some more general lessons from the foregoing (...) analysis for the ethical acceptability of different kinds of Infection Control. (shrink)

How should we teach controversial issues? And which issues should we teach as controversies? In this paper, I argue that educators should heed what I call a ‘psychological condition’ in their practical efforts to address these questions. In defending this claim, I engage with the various decision criteria that have been advanced in the controversial issues literature: the epistemic criterion, behavioral criterion, political criterion and politically authentic criterion. My argument is that the supporters of these various criteria have focused too (...) closely on the socio-political and epistemic qualities of controversial issues in deriving their controversial issues pedagogies and have thereby overlooked the necessary subjective conditions for teaching controversial issues. If our pedagogical efforts to cultivate students’ reason by means of controversial issues are to be successful, then we must understand controversy as fundamentally a psychological phenomenon consisting in an intellectual tension in the minds of students. In the final pages, I conclude by recommending several forms of directive teaching that promise to be instrumental for creating such intellectual tension. (shrink)

I strongly agree with Main and Kho’s primary contention that a relational approach can provide clarity regarding how empathy-related processes become increasingly coordinated over the lifespan. However, I go further to suggest that their “relational approach” should be expanded to include the larger social, cultural, economic, political, and moral contexts that shape and influence more intimate interpersonal relations, including empathic processes. Such an ethnographic, comparative approach has the advantage of helping us ascertain the extent to which empathic processes vary in (...) different times and places (including the ways in which “empathy” is defined and conceptualized), but also aids us in identifying more accurately what is most “basic” or translocal about these processes.
