This book puts forward a much-needed reappraisal of Immanuel Kant's conception of and response to skepticism, as set forth principally in the Critique of Pure Reason. It is widely recognized that Kant's theoretical philosophy aims to answer skepticism and reform metaphysics--Michael Forster makes the controversial argument that those aims are closely linked. He distinguishes among three types of skepticism: "veil of perception" skepticism, which concerns the external world; Humean skepticism, which concerns the existence of a priori concepts and synthetic (...) a priori knowledge; and Pyrrhonian skepticism, which concerns the equal balance of opposing arguments. Forster overturns conventional views by showing how the first of these types was of little importance for Kant, but how the second and third held very special importance for him, namely because of their bearing on the fate of metaphysics. He argues that Kant undertook his reform of metaphysics primarily in order to render it defensible against these types of skepticism. Finally, in a critical appraisal of Kant's project, Forster argues that, despite its strengths, it ultimately fails, for reasons that carry interesting broader philosophical lessons. These reasons include inadequate self-reflection and an underestimation of the resources of Pyrrhonian skepticism. (shrink)

We create a database of company codes of ethics from firms listed on the Standard & Poor's 500 Index and, separately, a sample of small firms. The SEC believes that "ethics codes do, and should, vary from company to company." Using textual analysis techniques, we measure the extent of commonality across the documents. We find substantial levels of common sentences used by the firms, including a few cases where the codes of ethics are essentially identical. We consider these results in (...) the context of legal statements versus value statements. While legal writing often mandates duplication, we argue that value-based statements should be held to a higher standard of originality. Our evidence is consistent with isomorphic pressures on smaller firms to conform. (shrink)

Deryck Beyleveld has forged a theory of ethical rationalism that has made an important impact on legal and moral philosophy—that this collection of essays makes clear. He has not only refined and improved the original account developed by Alan Gewirth, but provides us with ethical rationalism’s most prolific defender today. One area of particular insight is Beyleveld’s many applications of ethical rationalism to practice and, most especially, to medical law and ethics which has been especially influential. This work has set (...) the bar for all proponents and critics alike. -/- We focus narrowly on a specific concern that we have with ethical rationalism: its primacy of rationality over other characteristics, such as our emotions. This is not to deny the importance of reason in our thinking about law and ethical concerns. But we have concerns with any view that holds that reason is the only key to how any tensions should be resolved. Such a position claims for reason a privileged status it does not have or merit. One problem for us is that, in our view, ethical rationalism does not appear to adequately consider the importance of emotions and so it does not provide a satisfactory account of law and morality as a result. We examine this concern in the first part of our chapter. -/- This chapter’s second part raises concerns with the application of ethical rationalism as a model for understanding sexual offences. We highlight both the need to foreground emotion in order to understand the current law, as well as the dangers from a normative perspective of appearing to marginalise the role of emotion in sexual offences. Not only would a prioritisation of rationality fail to reflect the role emotion can play in current rape law, but we would argue, is particularly problematic in this area of law in terms of promoting justice. In summary, Beyleveld’s ethical rationalism exercises an important impact on legal theory and legal practices. Nonetheless, we raise some reservations about its connection to these impacts that lead us to support revisions to this approach. (shrink)

Resumen El proyecto Es.Var.Atenuación se interesa por el estudio de la atenuación pragmática a nivel lingüístico, estructural, enunciativo y situacional, en corpus discursivos del español, a fin de reconocer las posibles estrategias atenuantes de un acto comunicativo. Para llevar a cabo el análisis se parte de una ficha de trabajo. Onomázein, 28, pp. 288–319; Albelda, Briz, Cestero, Kotwica y Villalba, 2014. Ficha metodológica para el análisis pragmático de la atenuación en corpus discursivos del español.. Oralia, 17, pp. 7–62) organizada en (...) cinco bloques de factores: funciones de la atenuación, procedimientos lingüísticos de la atenuación, factores estructurales, factores enunciativos y factores situacionales. A partir de esta ficha de trabajo, el propósito de nuestra investigación es considerar la implicación del componente fonoprosódico de la lengua, de modo que nos centramos en el segundo bloque de factores de la ficha indicada. Dicho bloque contiene 22 tácticas lingüísticas de atenuación; de ellas, la táctica 21 se refiere a los elementos prosódicos, paralingüísticos o gestuales y su papel en la expresión de atenuación. Esta táctica, no obstante, debe ser desarrollada para valorar mejor el peso de lo prosódico en la atenuación; se cuenta para ello con la experiencia previa del proyecto Fonocortesía, donde se manejan parámetros segmentales y suprasegmentales relevantes para la expresión de cortesía verbal. El objetivo de este trabajo es, en fin, desarrollar metodológicamente la descripción del componente prosódico en la actividad atenuadora, y precisar a través de parámetros acústicos objetivables en qué pueda consistir ese papel atenuante. This article argues that Nietzsche’s meta-ethics is basically a form of sentimentalism, but a form of sentimentalism that includes cognitive components in the sentiments that are involved. The article also ascribes to Nietzsche the more original position that the moral sentiments in question vary dramatically between historical periods, cultures, and even individuals, sometimes indeed to the point of becoming inverted between one case and another. Finally, the article also attributes to Nietzsche a hermeneutic insight into certain problems that this situation (...) causes for the accurate interpretation of other people’s viewpoints. Along the way, the article in addition argues that Nietzsche’s positions on all these issues were molded not only by such well-known influences as Paul Rée and Hume, but also, and indeed more strongly, by Herder, and it develops some grounds for thinking that the positions in question are highly plausible ones. Skyrms's formulation of the argument against stochastic hidden variables in quantum mechanics using conditionals with chance consequences suffers from an ambiguity in its "conservation" assumption. The strong version, which Skyrms needs, packs in a "no-rapport" assumption in addition to the weaker statement of the "experimental facts." On the positive side, I argue that Skyrms's proof has two unnoted virtues (not shared by previous proofs): (1) it shows that certain difficulties that arise for deterministic hidden variable theories that exploit a nonclassical (...) probability theory extend to the stochastic case; (2) the use of counterfactual conditionals relates the Bell puzzle to Dummett's (1976) discussion of realism in quantum mechanics. In diesem zweiten Teil wird zuerst gezeigt, dass Hegel sich am Anfang seiner Jenaer Zeit genau wie Schelling am §76 der Kritik der Urteilskraft mit Kants Gedanken eines Urgrunds orientiert, in dem Sein und Denken, Subjektives und Objektives zusammenfallen. Nach Schellings Weggang 1803 kommt Hegel aber durch seinen Freund Schelver zunehmend mit Goethe in Kontakt, dessen Methodologie eines intuitiven Verstandes im Sinne von KdU §77 Schelver als neuberufener Botanikprofessor und Direktor des botanischen Gartens in die Praxis umzusetzen hat. Hegel übernimmt (...) diese Methodologie zuerst, im sog. zweiten Jenaer Systementwurf von 1804/5, teilweise, ab 1805 in den Vorlesungen zur Geschichte des Philosophie ganz, wobei er sie aber in einem entscheidenden Punkt weiterentwickelt. Sie liegt auch der Phänomenologie des Geistes zugrunde. Zugleich wird deutlich, warum der Systemteil ‚Logik und Metaphysik’ aufgegeben und die Metaphysik selbst zur Logik werden muss, der nun allerdings eine solche ‚Phänomenologie des Geistes’ vorangehen muss. Introducción: Los docentes universitarios requieren nuevos saberes para enfrentar los diversos retos que plantea la educación superior; dichos desafíos se relacionan con el dominio de saberes disciplinarios, profesionales, laborales, pedagógicos y didácticos e incluso axiológicos. Lo que aquí se presenta son los resultados de una investigación llevada a cabo en la Universidad Autónoma del Estado de México en el periodo de enero de 2014 a abril de 2015. El objetivo: fue determinar los saberes específicos, métodos de enseñanza y valores sociales (...) que deben poseer los profesores universitarios desde la perspectiva de los estudiantes para la identificación de aquellos principios que deben orientar la formación y actualización docente. Método: consideró el cualitativo y la técnica de la encuesta; fueron aplicados 119 cuestionarios diseñados en Escala de Likert, a igual número de estudiantes; el instrumento de 48 reactivos fue construido con base en tres grandes "baterías" o ejes: "Saberes de un buen docente", "Métodos o estrategias de enseñanza", y "Actitudes y valores". Resultados: se resaltan los saberes pedagógicos y didácticos como aquéllos que los estudiantes visualizan que les hacen falta a sus docentes; de éstos, son los métodos de enseñanza eminentemente prácticos, y aquellos vivenciales o más cercanos a la realidad los que se consideran como importantes. En términos de las actitudes y valores sociales que deben tener y demostrar los profesores, se encuentran la actitud profesional, la actitud de servicio, así como la responsabilidad y la ética. Conclusiones: se discute aquello que se considera deben saber, y lo que necesitan mejorar los docentes universitarios. Introduction: Professors require new knowledge to face the different challenges that higher education has. Those challenges are related with the mastery of disciplinary, professional, pedagogic, work-related, didactic and even axiological knowledge. The results of a research that was carried out at the Universidad Autónoma del Estado de México from January, 2014 to April, 2015; are presented in this article. Objective: To determine specific knowledge, teaching methods and social values that professors must have from the perspective of the students for identifying the principles which should lead teaching formation and updating. Method: The qualitative method and the survey as a procedure were considered. One hundred nineteen questionnaires that were designed in Likert scale were also applied to the same number of students; the instrument of 48 reagents was based on 3 axes: 'Knowledge of a good professor', 'Teaching methods or strategies' and 'Attitudes and values'. Results: Pedagogic and didactic knowledge is emphasized, for instance the one students consider their professors should have. However, the professors consider those teaching methods essentially practical, based on past experiences or closer to the reality as the most important ones. There are some attitudes and social values that professors must have and demonstrate, as well as the professional attitude, the service attitude, responsibility and ethics. Conclusions: the ideas that must be known and improved by the professors are discussed here. (shrink)
