Attempts to illuminate the nature of “blame” have shaped recent philosophical discussion of free will and moral responsibility. In this paper I show how, in at least one context, this search for a theory of blame has led us astray. Specifically, I focus on the contemporary debate about the “standing” to blame and argue, first, that theorizing about blame-in-general in this context has assumed an impoverished moral psychology that fails to reflect the range of blaming emotions and that conflates these (...) emotions’ distinctive logics; and, second, that such theorizing has encouraged the propagation of misleading theories of blame’s “norms.” Rather than searching for the nature of blame, I employ and defend an alternative methodological approach that focuses on the psychology and ethics of specific reactive emotions. I then show how an agent’s own bad behavior can alter the appropriateness of these various attitudes in distinctive ways. Marking these distinctions leads to some surprising conclusions. For example, it allows us to move beyond the assumption that the wrongness of standingless blame is fundamentally a matter of hypocrisy. (shrink)

When a person commits a testimonial injustice, the unjust thing they do consists in their reaction to an assertion (theorists diverge on the details; paradigmatically the relevant unjust thing consists in prejudicially refraining from believing the assertion). Whatever reactions to questions are analogous to these reactions to assertions, those things are "interrogative injustices". I explore some models of those things and apply them to some non-ideal cases. One of the models appeals to mental states like curiosity and wonder, telling us (...) that interrogative injustice occurs when hearers prejudicially refrain from adopting those mental states. Other models appeal to common conversational goals – these goals including the answering of questions. On these models, interrogative injustice occurs when a person asks a question, and another person prejudicially blocks the answering of that question from joining the common goals. Or, if they don’t block said answering, perhaps they believe that it should be thus blocked. Or perhaps they merely resist the question, not fully blocking its answering from joining the common goals but instead pushing back against it in some other way. Or perhaps they merely believe that they should resist the question. I endorse a pluralism on which each of these things can be an interrogative injustice. (shrink)

Existing ethical guidelines that aim to guide the development of mental health apps tend to overemphasize the role of Western conceptual frameworks. While such frameworks have proved to be a useful first step in introducing ethics to a previously unregulated industry, the rapid global uptake of mental health apps requires thinking more deeply about the diverse populations these apps seek to serve. One way to do this is to introduce more intercultural ethical perspectives into app design and the guidelines that (...) aim to encourage best practices. In addition to this, existing ethical guidelines can also benefit from the ethical scholarship from the feminist and disability traditions, both of which highlight specific ethical considerations for vulnerable users. Rethinking the ethical responsibilities of mental health app designers through the prisms of feminism, disability studies, and intercultural philosophy leads us to a more global and inclusive set of ethical considerations in app design. This white paper explores what existing guidelines for the regulation of mental health apps are missing. It also explores how these guidelines could be improved for users who inhabit an increasingly diverse and globalized world. (shrink)

Moral egalitarianism will depend on one of two basic ideas. The first is the idea of equality itself. We might believe that it is a good thing if different people have equal shares of resources, or if their lives score equally well in terms of whatever makes lives valuable, at least if there is no reason based on some other moral value for one person to do better than the other. Equality is a relationship between the lives of different people. (...) This version of egalitarianism claims that the existence of the relationship makes an outcome better. Reductionism, in the sense of the doctrine that theories on different levels of reality should exhibit strict and general relations of deducibility, faces well-known difficulties. Nevertheless, the idea that deeper layers of reality are responsible for what happens at higher levels is well-entrenched in scientific practice. We argue that the intuition behind this idea is adequately captured by the notion of supervenience: the physical state of the fundamental physical layers fixes the states of the higher levels. Supervenience is weaker than (...) traditional reductionism, but it is not a metaphysical doctrine: one can empirically support the existence of a supervenience relation by exhibiting concrete relations between the levels. Much actual scientific research is directed towards finding such inter-level relations. It seems to be quite generally held that the importance of such relations between different levels is that they are explanatory and give understanding: deeper levels provide deeper understanding, and this justifies the search for ever deeper levels. We shall argue, however, that although achieving understanding is an important aim of science, its correct analysis is not in terms of relations between higher and lower levels. Connections with deeper layers of reality do not generally provide for deeper understanding. Accordingly, the motivation for seeking deeper levels of reality does not come from the desire to find deeper understanding of phenomena, but should be seen as a consequence of the goal to formulate ever better, in the sense of more accurate and more-encompassing, empirical theories. In this paper, I reflect on the idea, hinted at by Kant in a footnote to §16 of the B- Deduction that is not often discussed (KrV B 134n.), that transcendental logic is the ground of logic as a whole. This has important repercussions for the way we should see the role of transcendental logic with respect to the question of truth as well as the nature and scope of transcendental logic in relation to cognition, and in relation to general (...) or formal logic as such. To illustrate one of the ways in which transcendental logic is fundamental to our way of thinking, I address an issue that is brought up by Kant’’s counterfactual claim at B 132 that if a representation is not accompanied by an ‘‘I’’ thought, it is ‘‘either impossible’’ or at least ‘‘nothing for me’’, suggesting to some recent commentators that by the former Kant means the impossibility of thinking contradictory thoughts. Unlike these commentators, I do not think Kant is saying here that we cannot think contradictory thoughts. To believe he is betrays a misunderstanding of the metaphysical nature of transcendental logic, or so I shall argue. It is because transcen- dental logic is a metaphysical logic that Kant can claim that transcendental logic grounds even the whole of logic, including the possibility of thinking contradictory thoughts. This book explains the background and rationale of the German poet Johann Wolfgang von Goethe's notorious attack on Isaac Newton's classic theory of white light and colors. Though the merits of Goethe's color science, as advanced in his massive Zur Farbenlehre, have often been acknowledged, it has been almost unanimously proclaimed invalid as physics. How could Goethe have been so mistaken? In his book, Dennis Sepper shows that the condemnation of Goethe's attacks on Newton has been based on erroneous (...) assumptions about the history of Newton's theory and the methods and goals of Goethe's color science. By illuminating the historical background and the experimental, methodological, and philosophical aspects of Goethe's work, the author shows that his color theory is in an important sense genuinely physical and that, as simultaneously poet, scientist, historian, and philosopher, Goethe managed to anticipate important twentieth-century research not only in the history and philosophy of science, but even in color science itself. This essay analyzes the eco-religious “God’s Gardeners” group as they appear in Margaret Atwood’s Oryx and Crake and The Year of the Flood as a possible model of capitalist “non-existence,” exploring the alternative potentials at which they arrive in relation to waste throughout the text. The Gardeners present an affective mode of consumer non-participation as a possible first step toward a reflexive awareness of the role trash plays in our subjective experiences of the world. Through a process of symbolic embodiment, (...) the Gardeners exist in marginalized space and so re-situate waste for themselves as objects and spaces with new potential boundaries. This leads to a confrontation with social reality itself, piercing the reality-building project of capitalist logic in order to uncover the fabricated “antagonism between the Excluded—the ‘animals’ according to global capital—and the Included—the ‘political animals’ proper, those participating in capitalism” that structures characters’ experiences. The focus here is not only on re-situating waste but re-inscribing it in the domain of social discourse in a way that subverts consumer expectations and challenges the limits of desire. In these texts, enjoyment is displaced onto waste objects as a point of psychological investment transmitted from subject to subject. In building reality through these kinds of direct relations, Atwood implies, one may challenge the imposition of ideology and expand its apparent limits in order to re-symbolize the spaces and objects marginalized as waste, proceeding in the end to a renewed interconnection between subject, object, and excess. In this essay, it is submitted that consent comes in degrees and the wrongfulness and harmfulness of conduct is contingent on the degree of voluntariness underwriting the particular consent decision. A fully free decision to consent changes the normative nature of the act: genuine gift-giving is not theft. Lovemaking is not rape. Partially free decisions to consent can change the nature of the act if it makes the act less harmful and thus less wrongful. Partial consent is not about claiming (...) that the conduct was partially justified, but rather about demonstrating the particular act was less harmful and thus deserving of a less serious crime label than is found in the label rape simpliciter. A second theme picked up in this essay is the issue of conditional consent. It is submitted that breaching a condition (conditions such as D is rich, D is a pacifist, D does not have HIV and so on) of consent to sexual intercourse will not change otherwise consensual nature of the sexual intercourse itself, but it may give rise to criminal liability for the collateral harm caused such as HIV infection. In this chapter, I show that there is at least one crucial, non-short, argument, which does not involve arguments about spatiotemporality, why Kant’s subjectivism about the possibility of knowledge, argued in the Transcendental Deduction, must lead to idealism. This has to do with the fact that given the implications of the discursivity thesis, namely, that the domain of possible determination of objects is characterised by limitation, judgements of experience can never reach the completely determined individual, i.e. the thing in itself (...) or the unlimited real, but only objects as objects of possible experience. As such, it can be shown by reference to a key argument from Kant, that Hegel’s famous criticism that Kant is not licensed, on the basis of his core arguments concerning the original-synthetic unity of apperception, to restrict our knowledge to appearances, is mistaken on purely systematic grounds. More specifically, I argue that idealism follows already from the constraints that the use of the categories, in particular the categories of quality, places on the very conceivability of things in themselves. My claim is that, although it is not only possible but also necessary to think things in themselves, it does not follow that by merely thinking them we have a full grasp of the nature of things in themselves, as some important commentators claim we have. We must therefore distinguish between two kinds of conceiving of things in themselves: conceiving in the standard sense of ‘forming the notion of’, and conceiving in the narrow sense of ‘having a determinate intellectual grasp’. So although we must be able notionally to think things in themselves, as the grounds of their appearances, we cannot even conceive, through pure concepts, of how they are in themselves in any determinate, even if merely intellectual, sense. To put it differently, we cannot have a positive conception of things in themselves (this is in line with Kant’s distinction between noumena in the negative and positive senses; cf. B307–9). For support, I resort to a much overlooked chapter in the Critique, concerning the transcendental Ideal, where Kant discusses what it is for a thing to be a thing in itself proper, namely, something that is thoroughly determined. This concerns the real ontological conditions of things, which are not satisfied by the modal categories alone, namely, their existence conditions. I claim that the chief reason why, given Kant’s view of determinative judgement, we cannot determine a thing in itself is because of two connected reasons: (1) a thing in itself is already fully determined and therefore not further determinable and (2) we cannot possibly determine all of the thing’s possible determinations. In this context, I also discuss the notion of material (not: empirical) synthesis—of which Kant speaks in the chapter on the transcendental Ideal—which must be presupposed as the ground of the formal a priori synthesis that grounds possible experience. This material synthesis, which is an idea of reason that defines a thing as thoroughly determined with regard to all of its possible predicates and has mere regulative status, can by implication not be determined by the forms of the understanding, which synthesise only a limited set of predicates. As a result, given this definition of ‘thing in itself’, any object (appearance) as at best44 a limited set of determinations of the thing can never be numerically identical to the thing in itself as thoroughly determined individual. This undercuts a standard assumption about the identity relation between appearances and things in themselves in many contemporary interpretations of Kant’s transcendental idealism. (shrink)

We argued in earlier work that South Africa's democratic transition accomplished more than abolishing formal apartheid and replacing it with civil and political democracy. The transition also established a platform for “transformative constitutionalism,” an aspiration and generous constitutional framework for South Africa to embark on a postliberal path toward becoming an egalitarian social and economic democracy. Manifestly, the promised social and economic transformation remains largely unfulfilled. Many South Africans blame the constitutional settlement for this failure of delivery, seeing it as (...) a weak compromise with the old regime that restricts socio-economic transformation. We reject this view and assign blame for the failure of the transformative project squarely on the politics and policies of ANC governments in power over three decades. The transformative project was not blocked by the constitutional settlement; it was never attempted. The ANC brought mostly conventional, liberal democratic goals to the transition negotiations. It embraced neoliberalism before the 1996 Constitution was drafted, indeed before the 1994 elections brought the ANC to power. Ironically, during the Final Constitution drafting process (1994-1996), ANC negotiators moved left under the inspiration of and pressure from the Mass Democratic Movement (MDM). The 1996 text is transformative in aspiration and in its toolbox of innovative legal technologies, but the ANC never took it seriously as a guide to policy. If South African politics ever realigns, future activists will find in the 1996 text a storehouse of legal values and tools meant to nourish radical social and economic change. (shrink)

One of the most powerful arguments against socialism consists in the claim that it is incompatible with liberty. In the works of F.A. Hayek, this argument is developed in a sophisticated and systematic manner. Hayek’s attempt to prove the incompatibility of socialism and freedom relies on a concept of liberty that derives from the tradition of classical republicanism, and bears significant resemblance to the one used by current neo-republicans. To be free means not to be ruled in an arbitrary manner, (...) not to be ruled by people, but by laws. Socialism however, Hayek claims, implies the direct and discretionary rule of bureaucrats over the whole economy, and thereby violates liberty. The paper will examine this argument in detail, illuminate its connection to republicanism, and refute it. Such a refutation will not be directed against the concept of liberty employed by Hayek; instead, it will be shown that socialism properly implemented can conform to the demands of Hayek’s liberty. This article reacts to Oyowe’s understanding of the personal existence of ancestral persons as real mind-dependent entities. The article’s author’s contention is that Oyowe has not managed to rule out the alternative that the author is sympathetic to, namely, that ancestral persons are real mind-independent entities that continue to exist even when, through forgetfulness, they cease to exist in the memory of humans. This article calls Oyowe’s mind-dependent alternative the “safe” one, as it appears easier to defend than the “unsafe,” (...) mind-independent alternative, which the article’s author has yet to develop convincing reasons for. What are the assumptions and tasks hidden in contemporary calls to "overcome" the metaphysical tradition? Reflecting upon the internal contradictions of the notions of "tradition" and "finiteness," Dennis J. Schmidt offers novel insights into how philosophy must relate to its traditions if it is to retain a vital sense of the plurality of "edges" that constitute its finiteness. He does this through a close examination of issues found in the work of Hegel and Heidegger, two philosophers who made the (...) ideas of both tradition and finiteness the center of their concern.Schmidt begins by asking how Heidegger can claim to have destroyed metaphysics despite Hegel's claim to have perfected its possibilities. Systematically following the development of Heidegger's critique of Hegel, Schmidt generates a dialogue between them. The topic of that dialogue is the nature of finiteness as it is articulated in time, nothing, the dialectical and hermeneutical circles, and in the notions of experience, work, technology, history, and preSocratic thought.Beginning with Heidegger's critique of Hegel in Being and Time, Schmidt's strategy is to disclose the complexities of philosophical discourse about the finite by drawing out the proximities between Hegel and Heidegger. The dialogue that results presents novel portraits of both philosophers. It also reveals that Heidegger's early, unacknowledged failure to separate himself from the Hegelian dialectic is the motive behind many of the turns and decisions of his later career.In concluding, Schmidt offers an interpretation of the wider significance of the results of that dialogue, and connects his study to other contemporary discussions of postmodernism. It is a commonplace that one of the primary tasks of natural science is to discover the laws of nature. Those who don’t think that nature has laws will of course disagree; but of those who do, most will be in accord with Armstrong when he writes that natural science, having discovered the kinds and properties of things, should “state the laws” which those things “obey” (Armstrong What is a law 3). No Scholastic philosopher would have included the discovery of (...) the laws of nature among the aims of natural philosophy. Regularities there may be in an Aristotelian world, but the focus of inquiry is elsewhere —on natural kinds, powers, qualities, temperaments. There must have been a change of view at some point. The obvious period in which to look for that change is that period in which the notion of law came to the fore in natural philosophy: the seventeenth century. Though there has been occasional dissension, that notion has been with us ever since. Scientists are quite happy to talk about all sorts of laws, from the basic laws of conservation to “phenomenological” and statistical laws. Philosophers, on the other hand, have found them puzzling. The character attributed to laws seems to be in need of explanation, and yet no convincing explanation is at hand; indeed, as I have mentioned, some philosophers think that natural science has no laws, or at least that it doesn’t need to appeal to them to accomplish its ends.
