ABSTRACT:In a series of reports the United Nations Special Representative on the issue of Human Rights and Transnational Corporations has emphasized a tripartite framework regarding business and human rights that includes the state “duty to protect,” the TNC “responsibility to respect,” and “appropriate remedies” for human rights violations. This article examines the recent history of UN initiatives regarding business and human rights and places the tripartite framework in historical context. Three approaches to human rights are distinguished: moral, political, and legal. (...) It is argued that the tripartite framework’s grounding of the responsibility of TNCs to respect human rights is properly understood as moral and not merely as a political or legal duty. A moral account of the duty of TNCs to respect basic human rights is defended and contrasted with a merely strategic approach. The main conclusion of the article is that only a moral account of the basic human rights duties of TNCs provides a sufficiently deep justification of “the corporate responsibility to respect human rights” feature of the tripartite framework. In this study, I will first introduce Husserl’s analysis in Studien zur Struktur des Bewußtseins by emphasizing the reasons that motivate these analyses on descriptive psychology and their status in Husserl’s transcendental phenomenology in the late Freiburg period. I will then focus on the structure of acts, with particular emphasis on three aspects stressed by Husserl in Studien: intentionality, the taxonomy of acts, and Brentano’s principle of the Vorstellungsgrundlage. The last three parts of this study outline the characteristic features of (...) three fundamental aspects of affective life in Husserl’s phenomenology: emotions, sense feelings, and moods. I will conclude with some general remarks on the status of affects and values in Husserl’s phenomenology. (shrink)

The need to create art is found in every human society, manifest in many different ways across many different cultures. Is this universal need rooted in our evolutionary past? The Art Instinct reveals that it is, combining evolutionary psychology with aesthetics to shed new light on fascinating questions about the nature of art.

We review recent developments in ethical pluralism, ethical particularism, Kantian intuitionism, rights theory, and climate change ethics, and show the relevance of these developments in ethical theory to contemporary business ethics. This paper explains why pluralists think that ethical decisions should be guided by multiple standards and why particularists emphasize the crucial role of context in determining sound moral judgments. We explain why Kantian intuitionism emphasizes the discerning power of intuitive reason and seek to integrate that with the comprehensiveness of (...) Kant’s moral framework. And we show how human rights can be grounded in human agency, and explain the connections between human rights and climate change. (shrink)

The standard relation of logical consequence allows for non-standard interpretations of logical constants, as was shown early on by Carnap. But then how can we learn the interpretations of logical constants, if not from the rules which govern their use? Answers in the literature have mostly consisted in devising clever rule formats going beyond the familiar what follows from what. A more conservative answer is possible. We may be able to learn the correct interpretations from the standard rules, because the (...) space of possible interpretations is a priori restricted by universal semantic principles. We show that this is indeed the case. The principles are familiar from modern formal semantics: compositionality, supplemented, for quantifiers, with topic-neutrality. (shrink)

Standard Kripke models are inadequate to model situations of inexact knowledge with introspection, since positive and negative introspection force the relation of epistemic indiscernibility to be transitive and euclidean. Correlatively, Williamson’s margin for error semantics for inexact knowledge invalidates axioms 4 and 5. We present a new semantics for modal logic which is shown to be complete for K45, without constraining the accessibility relation to be transitive or euclidean. The semantics corresponds to a system of modular knowledge, in which iterated (...) modalities and simple modalities are not on a par. We show how the semantics helps to solve Williamson’s luminosity paradox, and argue that it corresponds to an integrated model of perceptual and introspective knowledge that is psychologically more plausible than the one defended by Williamson. We formulate a generalized version of the semantics, called token semantics, in which modalities are iteration-sensitive up to degree n and insensitive beyond n. The multi-agent version of the semantics yields a resource-sensitive logic with implications for the representation of common knowledge in situations of bounded rationality. (shrink)

Libertarian theories of the normative core of the corporation hold in common the view that is the responsibility of publicity held corporations to return profits to shareholders within the bounds of certain moral side-constraints. Side-constraints may be either weak (grounded in the rules of the game) or strong (grounded in rights). This essay considers libertarian arguments regarding the normative core of the corporation in the context of global capitalism and in the light of actual corporate behavior. First, it is argued (...) the weak side-constraints view is conceptually incoherent when applied in a global context. Second, it is argued that proponents of the libertarian strong side-constraints view lack an adequate theory of rights. Third, both the weak side-constraints view and the strong side-constraints view are shown to be unsatisfactory insofar as they fail to adequately address the coercive power of corporations. The main conclusion of this essay is that a viable libertarian theory of the corporation has yet to be articulated. (shrink)

The standard semantic definition of consequence with respect to a selected set X of symbols, in terms of truth preservation under replacement (Bolzano) or reinterpretation (Tarski) of symbols outside X, yields a function mapping X to a consequence relation ⇒x. We investigate a function going in the other direction, thus extracting the constants of a given consequence relation, and we show that this function (a) retrieves the usual logical constants from the usual logical consequence relations, and (b) is an inverse (...) to—more precisely, forms a Galois connection with—the Bolzano-Tarski function. This study attempts to situate Carl Stumpf's theory of emotions with regard to that of his teacher, Franz Brentano, and to the sensualist theory of William James. We will argue that Stumpf's theory can be considered an attempt to reconcile James's sensualism, which emphasizes the role of bodily feelings, with what we will call, for the purposes of this study, Brentano's intentionalism, which conceives of emotions as intentional states. Stumpf claims that James's sensory feelings and Brentano's affective intentional states are (...) two sides of the same coin in that they constitute two essential ingredients of a full-fledged theory of emotions. The question is whether Stumpf's ecumenism avoids the objections that he himself raises against James's and Brentano's theories. The paper is divided into four parts: the first part presents Stumpf's classification of psychical functions; the second part presents his criticism of James's theory of emotions; the third part is a summary of Stumpf's complex debate with Brentano on emotions and sensory feelings; the last part examines Stumpf's attempt to incorporate into his theory of affects the phenomenological and intentional aspects of emotions. Good explanations are not only true or probably true, but are also relevant to a causal question. Current models of causal explanation either only address the question of the truth of an explanation, or do not distinguish the probability of an explanation from its relevance. The tasks of scenario construction and conversational explanation are distinguished, which in turn shows how scenarios can interact with conversational principles to determine the truth and relevance of explanations. The proposed model distinguishes causal discounting from (...) causal backgrounding , and makes predictions concerning the differential effects of contextual information about alternative explanations on: (a) the kind of mental models constructed; (b) belief revision about probable cause; and (c) the perceived quality of a focal explanation. Four experiments are reported that test these predictions. The significance of the notion of explanatory relevance for research on causal explanation is then discussed. (shrink)

Il adopte une position singulariste quant au contenu du souvenir et critique la justification méta-sémantique relationnaliste de cette position. Selon celle-ci, le contenu du souvenir est singulier parce que le souvenir consiste en une relation d’accointance avec l’événement passé. L’article oppose un argument causal et un argument sémantique à cette analyse puis montre que les deux traits du souvenir (...) que l’idée d’accointance est censée expliquer – la phénoménologie et la singularité du souvenir – peuvent l’être au moyen de modèles singularistes non fondés sur l’accointance. A common view about the phenomenology of episodic remembering has it that when we remember a perceptual experience, we can relive or re-experience many of its features, but not its characteristic presence. In this paper, we challenge this common view. We first say that presence in perception divides into temporal and locative presence, with locative having two sides, an objective and a subjective one. While we agree with the common view that temporal and objective locative presence cannot be relived in (...) remembering, we argue that subjective locative presence – the feeling of being immersed in a certain scene – can be so. Our argument for this claim starts by determining independently the underpinning mechanisms of subjective locative presence in quasi-perceptual imagination. These mechanisms are self-projection, imaginative pretence, and attentional focus. We then proceed to establish that they have been found to underpin conscious states of episodic remembering too. We conclude that episodic remembering can bring us to relive the subjective locative presence characteristic of a perceptual experience, and that the common view is mistaken. Our view – ‘mnemonic immersivism’ – has important consequences regarding the relationships between memory and imagination and the phenomenology of episodic remembering. (shrink)

Spinoza discovered and studied Descartes's philosophy at the school of Van den Enden and then at the University of Leiden. Spinoza is seen as providing metaphysical views of unparalleled audacity, which remain highly exciting and offer a source of inspiration and a source of theoretical models in a wide variety of fields, including neurobiology. The most general of Spinoza's intentions is to expound in accordance with “the prolix Geometric order” what Descartes had left in a more informal one. Spinoza's original (...) distance from Cartesian conceptions, before becoming obvious in the metaphysical views of the Ethics, is already noticeable in the TIE. In metaphysics, the Spinoza‐Descartes relationship is complex, but cannot be said to take the form of an implicit dialogue or a community of inspiration. Descartes's emphasis on the use of free will, the gap between the two authors in matters of moral anthropology is therefore quite limited. (shrink)

After providing a brief history of global climate change, we consider and reject the influential position that free markets and responsive democracies relieve corporations of obligations to protect the environment. Five main objections to the free market view are presented, focusing in particular on the roles of business organizations in the transportation and electricity generation sectors. Ethically grounded management and public policy recommendations are offered.

This paper aims to provide a psychologically-informed philosophical account of the phenomenology of episodic remembering. The literature on epistemic or metacognitive feelings has grown considerably in recent years, and there are persuasive reasons, both conceptual and empirical, in favour of the view that the phenomenology of remembering—autonoetic consciousness, as Tulving influentially referred to it, or the feeling of pastness, as we will refer to it here—is an epistemic feeling, but few philosophical treatments of this phenomenology as an epistemic feeling have (...) so far been proposed. Building on insights from the psychological literature, we argue that a form of feeling-based metacognition is involved in episodic remembering and develop an integrated metacognitive feeling-based view that addresses several key aspects of the feeling of pastness, namely, its status as a feeling, its content, and its relationship to the first-order memories the phenomenology of which it provides. Molecular and developmental studies of limb pattern formation have recently gained widespread attention. The fact that vertebrate limbs are amenable to both genetic and embryological manipulations has established this model system as a valuable paradigm for studying vertebrate development. Limb buds are polarised along all three major axes and the establishment of the dorso‐ventral (DV) polarity is dependent upon cues localised in the trunk, where a DV ectodermal interface is produced by confrontation of dorsal and ventral identities. By analogy to (...) Drosophila imaginal disc development, this interface has been proposed to determine and position an ectodermal organising centre, the Apical Ectodermal Ridge (AER), controlling limb bud outgrowth. Recent fate mapping studies(1) and studies of genes regulating DV limb polarity(2‐6), AER formation(7,8) and differentiation(9) suggest, however, that DV patterning and AER induction, though coordinately regulated during limb bud outgrowth, may early on be more dissociated than expected. Le déficit d’explicabilité des techniques d’apprentissage machine (AM) pose des problèmes opérationnels, juridiques et éthiques. Un des principaux objectifs de notre projet est de fournir des explications éthiques des sorties générées par une application fondée sur de l’AM, considérée comme une boîte noire. La première étape de ce projet, présentée dans cet article, consiste à montrer que la validation de ces boîtes noires diffère épistémologiquement de celle mise en place dans le cadre d’une modélisation mathématique et causale d’un phénomène physique. (...) La différence majeure est qu’une méthode d’AM ne prétend pas représenter une causalité entre les paramètres d’entrées, qui peuvent être de plus de haute dimensionnalité, et ceux de sortie. Nous montrons dans cet article l’intérêt de mettre en œuvre les distinctions épistémologiques entre les différentes fonctions épistémiques d’un modèle, d’une part, et entre la fonction épistémique et l’usage d’un modèle, d’autre part. The problem of logical constants consists in finding a principled way to draw the line between those expressions of a language that are logical and those that are not. The criterion of invariance under permutation, attributed to Tarski, is probably the most common answer to this problem, at least within the semantic tradition. However, as the received view on the matter, it has recently come under heavy attack. Does this mean that the criterion should be amended, or maybe even that (...) it should be abandoned? I shall review the different types of objections that have been made against invariance as a logicality criterion and distinguish between three kinds of objections, skeptical worries against the very relevance of such a demarcation, intensional warnings against the level at which the criterion operates, and extensional quarrels against the results that are obtained. I shall argue that the first two kinds of objections are at least partly misguided and that the third kind of objection calls for amendment rather than abandonment. (shrink)

It is commonly thought that evolution is a chance process, an idea found in popular writings on evolution, but also in academic writing in a broad range of scientific disciplines: scientific, philosophical and theological. One problem is that words such as ‘chance’ and ‘random’ are used with a range of different meanings according to context, and in evolutionary biology the word ‘chance’ is sometimes used in a way that is different from its use in mathematics and philosophy. The present article (...) aims to clarify the range of meanings and to argue the case that the evolutionary process is far from being a ‘theory of chance’ from biological, mathematical, or indeed philosophical and theological perspectives. The dual character of invariance under transformations and definability by some operations has been used in classical works by, for example, Galois and Klein. Following Tarski, philosophers of logic have claimed that logical notions themselves could be characterized in terms of invariance. In this article, we generalize a correspondence due to Krasner between invariance under groups of permutations and definability in L∞∞ so as to cover the cases that are of interest in the logicality debates, getting McGee’s theorem about quantifiers (...) invariant under all permutations and definability in pure L∞∞ as a particular case. We also prove some optimality results along the way, regarding the kinds of relations which are needed so that every subgroup of the full permutation group is characterizable as a group of automorphisms. Jeffrey conditioning tells an agent how to update her priors so as to grant a given probability to a particular event. Weighted averaging tells an agent how to update her priors on the basis of testimonial evidence, by changing to a weighted arithmetic mean of her priors and another agent’s priors. We show that, in their respective settings, these two seemingly so different updating rules are axiomatized by essentially the same invariance condition. As a by-product, this sheds new light on (...) the question how weighted averaging should be extended to deal with cases when the other agent reveals only parts of her probability distribution. The combination of weighted averaging and Jeffrey conditioning is a comprehensive updating rule to deal with such cases, which is again axiomatized by invariance under embedding. We conclude that, even though one may dislike Jeffrey conditioning or weighted averaging, the two make a natural pair when a policy for partial testimonial evidence is needed. (shrink)

La présente étude s’intéresse moins aux problèmes les plus classiques soulevés par l’interprétation de Gueroult qu’aux chapitres finaux de l’ouvrage, qui concernent la médecine et surtout la morale. Quelle relation entre la morale cartésienne et l’ordre des raisons? Cette morale a-t-elle (...) ou non statut de science? Qu’elle soit science ou « succédané » de science, comment la caractériser dans son objet? This study is about an aspect of the reception of Herbatianism in Austria which has not been thoroughly investigated so far. It pertains to a controversy opposing Robert Zimmermann and Franz Brentano in the context of discussions which took place in the Philosophical Society of the University of Vienna. This study looks more specifically at three important episodes involving the Philosophical Society, first, the controversy over Herbartianism, second that over the evaluation of Schelling’s philosophy, and finally the reception of Bolzano (...) in Austria. I will first describe the circumstances that led Zimmermann to get involved in the Philosophical Society and the source of his controversy with Brentano and his followers. I will then comment Zimmermann’s address as chairman of the Philosophical Society and Brentano’s reaction to Zimmermann’s remarks on Schelling and the historical period to which he belongs. I will complete my analysis of Brentano’s reaction with a summary of his evaluation of Herbart’s philosophical program to which Zimmermann adhered. The last part focuses on Zimmermann’s decisive role in the reception of Bolzano in Vienna in connection with the Bolzano Commission established by the Philosophical Society. I will conclude with brief remarks on Zimmermann’s legacy in Vienna. (shrink)

Hintikka makes a distinction between two kinds of games: truthconstituting games and truth-seeking games. His well-known game-theoretical semantics for first-order classical logic and its independence-friendly extension belongs to the first class of games. In order to ground Hintikka’s claim that truth-constituting games are genuine verification and falsification games that make explicit the language games underlying the use of logical constants, it would be desirable to establish a substantial link between these two kinds of games. Adapting a result from Thierry Coquand, (...) we propose such a link, based on a slight modification of Hintikka’s games, in which we allow backward playing for ∃loïse. In this new setting, it can be proven that sequent rules for first-order logic, including the cut rule, are admissible, in the sense that for each rule, there exists an algorithm which turns winning strategies for the premisses into a winning strategy for the conclusion. Thus, proofs, as results of truth-seeking games, can be seen. (shrink)

What is a logical constant? In which terms should we characterize the meaning of logical words like “and”, “or”, “implies”? An attractive answer is: in terms of their inferential roles, i.e. in terms of the role they play in building inferences. More precisely, we favor an approach, going back to Dosen and Sambin, in which the inferential role of a logical constant is captured by a double line rule which introduces it as reflecting structural links (for example, multiplicative conjunction reflects (...) comma on the right of the turnstyle). Rule-based characterizations of logical constants are subject to the well known objection of Prior’s fake connective, tonk. We show that some double line rules also give rise to such pseudo logical constants. But then, we are able to find a property of a double line rules which guarantee that it defines a genuine logical constant. Thus we provide an alternative answer to Belnap’s requirement of conservatity in terms of a local requirement on double line rules. (shrink)

The aim of this essay is to examine the place of the people in the constitutions of democratic nations. While the meaning of democracy and the degree to which it is achieved vary within the family of nations considered democratic, the idea common to all is that the people are self-governing. In its origins, the idea is tied to liberty: not to be self-governing is to be subject to the will of another and so not to be free. What constitutes (...) self-government is open to interpretation, although this is not the place to examine the possible meanings. Nor is this the place to set out the history of the idea or to show how it became central to modern constitutions, except to note the number of nations qualifying as democratic has steadily increased in recent years to just under a half of the total. It seems reasonable to assume that a democratic nation, a self-governing people, would want to make sure that the constitution, the basic of government and of relations between the people and government, provide for and protect self-government and hence democracy. In this vivid memoir, Denis Guénoun excavates his family's past and progressively fills out a portrait of an imposing, enigmatic father. René Guénoun was a teacher and a pioneer, and his secret support for Algerian independence was just one of the many things he did not discuss with his teenaged son. To be Algerian, pro-independence, a French citizen, a Jew, and a Communist were not, to René's mind, dissonant allegiances. He believed Jews and Arabs were bound by an authentic (...) fraternity and could only realize a free future together. René Guénoun called himself a Semite, a word that he felt united Jewish and Arab worlds and best reflected a shared origin. He also believed that Algerians had the same political rights as Frenchmen. Although his Jewish family was rooted in Algeria, he inherited French citizenship and revered the principles of the French Revolution. He taught science in a French lycée in Oran and belonged to the French Communist Party. His steadfast belief in liberty, equality, and fraternity led him into trouble, including prison and exile, yet his failures as an activist never shook his faith in a rational, generous future. René Guénoun was drafted to defend Vichy France's colonies in the Middle East during World War II. At the same time, Vichy barred him and his wife from teaching because they were Jewish. When the British conquered Syria, he was sent home to Oran, and in 1943, after the Allies captured Algeria, he joined the Free French Army and fought in Europe. After the war, both parents did their best to reconcile militant unionism and clandestine party activity with the demands of work and family. The Guénouns had little interest in Israel and considered themselves at home in Algeria; yet because he supported Algerian independence, René Guénoun outraged his French neighbors and was expelled from Algeria by the French paramilitary Organisation Armée Secrète. He spent his final years in Marseille. Gracefully weaving together youthful memories with research into his father's life and times, Denis Guénoun re-creates an Algerian past that proved lovely, intellectually provocative, and dangerous. There is a widespread phenomenon that we call linguistic imposters. Linguistic imposters are systematic misuses of expressions that misusers mistake with their conventional usages because of misunderstanding their meaning. Our paper aims to provide an initial framework for theorising about linguistic imposters that will lay the foundation for future philosophical research about them. We focus on the misuses of the expressions ‘grooming’ and ‘critical race theory’ as our central examples of linguistic imposters. We show that linguistic imposters present a distinctive (...) phenomenon by comparing them to some adjacent phenomena, namely conceptual engineering, linguistic hijacking and dogwhistles. We also address four objections about the extensional adequacy of our definition of linguistic imposters. Finally, we argue that, as linguistic imposters spread, they make some inferences featuring misused expressions more cognitively accessible and seemingly socially licensed to misusers and discuss four types of harms that linguistic imposters are conducive to through these effects. For many of the past twenty-five years it has enjoyed the sponsorship of Whitman College and the extraordinarily capable coeditorship of Patrick Henry. Bard College now assumes sponsorship, and the journal will be edited jointly by us, with Pat Henry ascending to the (...) empyrean to look down upon us as Editor Emeritus.From its first issue (a mere 124-page wisp of a journal, but with robust essays by Hazel Barnes, Monroe Beardsley, and a smart young thinker named Martha Nussbaum), PHILOSOPHY AND LITERATURE has provided a home for anyone convinced by the initially counterintuitive notion that a close study of fiction can play an irreplaceable role in epistemology, ethics, philosophy of language, and even metaphysics. Philosophy is about life from the broadest possible human perspective, and so is literature. But how different the perspectives! Plato saw fiction, poetry, drama, and passion dug in on one side of the battle lines, with science, philosophy, and reason on the other. Not for the first time, nor the last, he was right. At this journal, we're on no peace mission, and we don't relish vapid compromises. Both sides in Plato's War of the Worldviews will be discomfited and annoyed to learn that they have features in common. Would-be peacemakers will be disappointed to see fresh hostilities breaking out just when they thought differences were being at last reconciled. We're interested more in the facts, arguments, and the healthy entertainment of battle than we are in making anybody comfortable. And let's admit it: the kinds of scholarly disputes we encourage in this journal can be exciting and fun.Watch these pages, therefore, not only for fresh news of ancient disputes, but also for exciting studies that break old boundaries, exploring the myriad linkages between traditional aesthetics and such empirical disciplines as psychology, anthropology, and biology. It is well known that classical logics are able to represent only some aspects of ordinary reasoning. In particular, by accepting the law of obversion, they remove the possibility of defining any but a propositional negation; certain natural uses of negation thus elude them. Logical theories do exist, however, that are exempt from such limitations. Among these theories are those of S. Leśniewski, which differ profoundly from classical formal systems. Unlike the latter, they do not have a determined list of (...) functors of syntactical-semantical categories. Due to formalized directives for definitions, the logics of Leśniewski are constructed progressively, making new theses and consequently functors of new syntactical-semantical categories accessible. In this article we use some of these theses-definitions to define a principle of appropriateness. With this principle it is possible to represent certain logical subtleties that are used quite naturally but are neglected due to the law of obversion. (shrink)
