The June 1975 issue of the Hastings Center Report published the Deliberations and Recommendations of the National Commission for the Protection of Human Subjects concerning the regulation of fetal experimentation. The Commission's most controversial conclusions were as follows: First, it voted to allow non‐therapeutic research on the human fetus, provided important biomedical knowledge could not be gained in any other way, proper consent had been obtained, and the research imposed “minimal or no risk to the well‐being of the fetus” (Recommendation (...) 4). Because interpretations of the last phrase varied in the case of fetuses scheduled for abortion, the Commission recommended that a national ethical review body be able to rule on disputed cases (Recommendation 5). In the case of research during abortion and research on the non‐viable fetus ex utero, the Commission's interpretation of permissible “harm” was restricted to the proviso that “no intrusion into the fetus [may be] made which alters the duration of life” (Recommendation 6). The Commission also recommended further research on abortion techniques (Recommendation 12). The Secretary of Health, Education and Welfare accepted the Commission's Recommendations almost without change—the major modification was to request paternal consent rather than to rely on the fact that “the father has not objected.” The DHEW regulations were published in the Federal Register on Friday, August 8, 1975, and written comments on them were invited. Already, however, a number of commentators including several members of the Commission had offered either dissenting or qualifying remarks. Some are printed here. (shrink)

The National Institutes of Health and other federal health agencies are considering establishing a national biobank to study the roles of genes and environment in human health. A preliminary public engagement study was conducted to assess public attitudes and concerns about the proposed biobank, including the expectations for return of individual research results. A total of 141 adults of different ages, incomes, genders, ethnicities, and races participated in 16 focus groups in six locations across the country. Focus group participants voiced (...) a strong desire to be able to access individual research results. Recognizing the wide range of possible research results from a large cohort study, they repeatedly and spontaneously suggested that cohort study participants be given ongoing choices as to which results they received. If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

He can find no reason for abandoning the spontaneous commonsense conviction that the puffing I hear is that of the locomotive I am looking at, that the chocolate I am tasting is the one I have put in my mouth, that what I am smelling is the rose (...) I am seeing and also perhaps holding; and, to return to Berkeley, that I perceive the surface I am seeing to be the very one that I am touching with my finger. Mr. Armstrong seems to be laying down the basis of a general theory of perception, that no given perception can be reduced to the datum proper to the sense-organ used plus an associate, a guess, or an inference. To turn this negative statement into a positive one, to say what the activity is that grasps more than the presumed datum, and what makes it reliable, is, as the history of the theory of perception makes plain, desperately hard. Far from grumbling at Mr. Armstrong for not having gone forward to this task, I am grateful for his having given us a book that is so intelligent, acute, clear, stimulating, and blessedly concise--one that deserves to be read by anyone interested in Berkeley, or the theory of vision, or the theory of perception generally. HUME AND SPINOZA It is strange that there has been so little interest in comparing two great philosophers, Hume and -Spinoza, who were both so important and influential in bringing about the decline of traditional religion. Jessop's bibliography indicates no interest in Hume and Spinoza up to the 1930 's. The Hume conferences of 1976, as far as I have been able to 2 determine, avoided the topic. (...) In one of the better new Hume volumes, Livingston and King, Hume, A Re-evaluation, 3 Spinoza is cited twice, and once incorrectly at that. On the other hand, in the massive new Spinoza volume edited by Siegfried Hessing, Speculum Spinozanun 1677-1977, Hume is mentioned four times, but only one of these has any real relevance to Hume's views vis-a-vis Spinoza's. Some discussion of Hume's comments, usually brief, occurs in the commentators. B. M. Laing, in David Hume, (London 1932), has just three short references to Spinoza. John Laird, in Hume's Philosophy of Human Nature, (London 1932) has a couple of cursory references to Spinoza, plus a bit more extended statement of Pierre Bay le" s critique of him. In H. H. Price, Hume's Theory of the External World, (Oxford 1940), there is one paragraph on Hume and Spinoza. In Norman Kemp Smith, The Philosophy of David Hume (London 1941), there are three references to Spinoza. Rachel Kydd, Reason and Conduct in Hume's Treatise (Oxford 194 6), has the greatest number of references to Spinoza. She was concerned to compare him with Hume on other matters than are dealt with in this paper, namely Spinoza's theory of reason and 9 the passions. In contrast, André Leroy, David Hume, (Paris 1953), has just one paragraph on Spinoza dealing with the immateriality of the soul; and Ernest C. Mossner, in his monumental Life of David Hume, (Austin 1954), has only one reference to Spinoza - James Beattie's denunciation of Hume, Hobbes, Malebranche, Leibniz and Spinoza. Lastly, in a fairly recent commentary by James Noxon, Spinoza is mentioned 66. three times, but not for anything in Hume's text. Noxon does point out (p. 75) that Spinoza is not mentioned in ] 2 Hume's correspondence. John H. Randall has offered an explanation for this neglect of Spinoza by Hume scholars, namely that "Hume stands for all time as the antithesis of Spinoza in his thought". In the England of Hume's day, Spinoza was little known, but still better known at the time than he was in France or England. Spinoza's Tractatus Theologico-Politicus 14 had been twice translated into English anonymously. He had been attacked by Bishop Stillingfleet, by John Evelyn, by Berkeley and several others. But Spinoza was not a major figure, except to the English Deists, and to Hume's early patron, the Chevalier Andrew Michael Ramsay. Most of the information known about Spinoza came from Pierre Bayle' s Historical and Critical Dictionary, where the article "Spinoza" is the longest in the Dictionary, about three hundred pages in length. My suspicion, or hypothesis, is that Hume first became interested in Spinoza through Ramsay, and then learned what he knew about Spinoza from Bayle' s article. When the young David Hume went to France to write his A Treatise of Human Nature in 1734, he went first to see the Chevalier Ramsay, who entertained Hume for about two weeks. Ramsay was a leading Scottish Catholic, was the teacher of Bonnie Prince Charlie, a leading Scottish revolutionary, 18 as well as the Grand Master of the Free Masons. With Ramsay's eclectic views it is not odd that he had a serious interest in Spinoza's theory, and that he was composing answers to it. Ramsay advised Hume about his own book, and Hume felt he had to show Ramsay the Treatise before he 19 brought it back to England. In the Treatise there is a not too well studied section on Spinoza, Of the immateriality of the soul 20 (T240-45). In introducing Spinoza into the discussion of 67. the immateriality of the soul, Hume follows what was common practice in his day, namely to insult Spinoza and his theory... (shrink)

He provides broad coverage of the ancient material, from pre-Platonic to Old Stoic treatments; and, in the contemporary period, from World War II to the present. Examination of the nature (...) of pleasure in ancient philosophy largely occurred within ethical contexts but in the contemporary period has, to a greater extent, been pursued within philosophy of mind and psychology. This divergence reflects the dominant philosophical preoccupations of the times. But Professor Wolfsdorf argues that the various treatments are complementary. David Webster explores the notion of desire as found in the Buddhist Pali Canon. Beginning by addressing the idea of a 'paradox of desire', whereby we must desire to end desire, the varieties of desire that are articulated in the Pali texts are examined. A range of views of desire, as found in Western thought are presented as well as Hindu and Jain approaches. An exploration of the concept of ditthi (view or opinion) is also provided, exploring the way (...) in which 'holding views' can be seen as analogous to the process of desiring. Other subjects investigated include the mind-body relationship, the range of Pali terms for desire, and desire's positive spiritual value. The authors use empirical research into the environmental practices of 31 manufacturing small and medium-sized enterprises (SMEs) to show that ‚business performance’ and ‚regulation’ considerations drive behaviour. They suggest that this is inevitable, given the market-based decision-making frames that permeate and dominate the industry in which manufacturing SMEs operate. Since the environment is a pillar of corporate social responsibility (CSR), the findings have important implications for CSR policy, which promotes voluntary actions predicated on a business case. It is argued that (...) this approach will not alter the behaviour of manufacturing SMEs significantly because CSR practice will be regarded as an optional and costly ‚extra’ affecting core business activity. Consequently, the use and development of existing regulatory structures, providing minimum standards for many activities covered by CSR, remains the most effective means through which the behaviour of manufacturing SMEs will be changed in the short to medium-term. Another feature of the paper is the distinction made between ‚business performance’ and the ‚business case’ argument. Business performance emphasises cost reductions and efficiency whereas the business case accentuates the benefits to shareholders of good practices as their firms become more attractive to stakeholders and society. Manufacturing SMEs␣try to improve business performance because of the pressures placed on them by market-dominated decision-making frames. These frames do not encourage manufacturing SMEs to undertake voluntary actions for the benefit of wider stakeholders and society. (shrink)

In this paper, I present a new semantics for demonstratives. Now some may think that David Kaplan (1989a,b) has already given a more than satisfactory semantics for demonstratives, and that there is no need for a new one. But I argue below that Kaplan's theory fails to describe the linguistic meanings of 'that' and other true demonstratives. My argument for this conclusion has nothing to do with cognitive value, belief sentences, or other such contentious matters in semantics and the (...) philosophy of mind. Rather, it appeals to the obvious fact that there can be true utterances of certain sentences containing several occurrences of the same demonstrative (for instance, 'That is taller than that'). My argument can be answered by making a fairly modest revision in Kaplan's theory. But I believe that the resulting revised version of Kaplan's theory ignores or distorts various important semantic features of 'that'. Thus I ultimately argue in favor of a more substantial departure from Kaplan's theory. Perhaps the most remarkable feature of the theory I favor is that it ascribes three distinct sorts of meanings to demonstratives. (shrink)

This article examines a particular debate between Eamonn Callan and William Galston concerning the need for a civic education which counters the divisive pull of pluralism by uniting the citizenry in patriotic allegiance to a single national identity.

Philosophy and anthropology need to integrate their accounts of what a morality is. I identify three desiderata that an account of morality should satisfy: (1) it should recognize significant diversity and variation in the major kinds of value, (2) it should specify a set of criteria for what counts as a morality, and (3) it should indicate the basis for distinguishing between more or less justifiable moralities, or true and false moralities. I will discuss why these three desiderata are hard (...) to satisfy at the same time, and why they are controversial. Anthropologists and philosophers will differ on which ones they are inclined to reject. I argue that all three should be accepted and can be satisfied. (shrink)

I develop an account of naturalness in physics which demonstrates that naturalness assumptions are not restricted to narrow cases in high-energy physics but are a ubiquitous part of how interlevel relations are derived in physics. After exploring how and to what extent we might justify such assumptions on methodological grounds or through appeal to speculative future physics, I consider the apparent failure of naturalness in cosmology and in the Standard Model. I argue that any such naturalness failure threatens to undermine (...) the entire structure of our understanding of intertheoretic reduction, and so risks a much larger crisis in physics than is sometimes suggested; I briefly review some currently-popular strategies that might avoid that crisis. The view defended is one sense externalist on the relation between moral reasons and motivation: A's having a moral reason to do X does not necessarily imply that A has a motivation that would support A's doing X via some appropriate deliberative route. However, it is in another sense externalist in holding that there are the kind of moral reasons there are only if the relevant motivational capacities are generally present in human beings, if not in all individuals. The process (...) of socialization is an attempt to embed the recognition of what we have moral reason to do in the intentional content of one's feelings. E.g., learning that about others' suffering embeds their suffering as a reason to help in the intentional content of incipient compassionate feelings. This endows the reason with motivational efficacy while conferring further direction to the feelings in ways that shape us for social cooperation. (shrink)

Scholars ubiquitously refer to the method εξ υποθεσεως, introduced at Meno 86e1-87d8, as a method of hypothesis. In contrast, this paper argues that the method εξ υποθεσεως in Meno is not a hypothetical method. On the contrary, in the Meno passage, υποθεσις means “postulate”, that is, cognitively secure proposition. Furthermore, the method εξ υποθεσεως is derived from the method of geometrical analysis. More precisely, it is derived from the use of geometrical analysis to achieve reduction, that is, reduction of a (...) less tractable problem to a more tractable problem. As such, the method εξ υποθεσεως does not by itself serve to solve problems. (shrink)

There are three possible justifications of the claim cultural communities make for their right to transmit an identity to their children. A group strategy and a parenting strategy are both defective. More promising is the view that there is value to children in the sharing of a familial life. But parental authority is limited by the requirement that children acquire sufficient autonomy. Some multicultural policies are thus not ruled out by the recognition of the need to accommodate children's interests.

Fragments of Modernity provides a critical introduction to the work of three of the most original German thinkers of the early 20th century. In their different ways, all three illuminated the experience of the modern in urban life, whether in mid-19th-century Paris or in Berlin at the turn of the century or later as the vanguard city of the Weimar Republic. I develop an account of how mathematized theories in physics represent physical systems, in response to the frequent claim that any such account must presuppose a non-mathematized, and usually linguistic, description of the system represented. The account I develop contains a circularity, in that representation is a mathematical relation between the models of a theory and the system as represented by some other model --- but I argue that this circularity is not vicious, in any case refers in linguistic accounts (...) of meaning and representation, and is simply a consequence of the fact that we have no unmediated, representation-independent access to the world. Timothy Williamson offers a proof of the counterintuitive claim that, if an object exists, then it exists necessarily. David Wiggins argues that this result reveals the philosophical disadvantage of a first level (or ‘ticking over’) view of the very ‘exists’ and the advantage of the second level account offered by Frege and Russell. The author seeks to show how, using an idea of G.
