“Is X good for the Jews?” This is the formula Bruno Chaouat borrows for the title of his recent book. It’s a cliché of a question, one that suggests notes of antisemitic caricature as well as Jewish self-parody. The formula may be imagined in the voice of the antisemite, whose perennial accusation against the Jews is that they are insular and parochial, exclusively concerned for their own, tribal welfare. Alternatively, it may be imagined in the voice of the shlemiehl, the (...) Jewish version of the fool archetype, scripted to say such things by a self-reflective and self-parodic Jewish comedy writer. Marks individually or in combination constitute images that represent objects. How do those images represent those objects? Marks vary in style, both between and within images. Images also vary in style. How do those styles relate to each other and to the objects that those images represent? Referencing a diverse range of images, we answer the first question with a response-dependence theory of image representation derived from Mark Johnston, differentiating Lockean primary qualities of marks from secondary qualities of images. Reflection on testimony provides novel arguments for anti-individualism. What is anti-individualism? Sanford Goldberg's book defends three main claims under this heading: first, facts about the contents of beliefs do not supervene on individualistic facts about the believers ; second, an individual's epistemic entitlement to accept a piece of testimony depends on facts about her peers ; third, processes by which some humans acquire knowledge from testimony includes activities performed for them by others. Each of these three claims is argued (...) for separately from premises about the ways in which humans, adult and child, succeed in gaining knowledge by testimony. The three arguments provide the structure for Anti-Individualism.Goldberg's argument for the first claim – that the contents of beliefs do not supervene on individualistic facts about the believers – begins from uncontroversial facts about testimony. Gaining knowledge by testimony depends on knowing the meanings of some utterances, and it is possible to know the meaning of a person's utterance while knowing little that would distinguish this person from anyone else. The best explanation of how this is possible involves postulating linguistic norms which entail facts about the linguistic meanings of utterances. Now in some cases of testimony, a hearer acquires a belief whose content is the linguistic meaning of a speaker's utterance, where the linguistic meaning of this utterance is determined by linguistic norms. But linguistic norms might have been different from what they are even while the person's and her audience's non-relational properties remained unaltered. And in such a case, the hearer would have acquired a belief with a different content. In this book, public health ethicist Daniel S. Goldberg sets out to characterize the subjective experience of pain and its undertreatment within the US medical establishment, and puts forward public policy recommendations for ameliorating the undertreatment of pain. The book begins from the position that the overwhelming focus on opioid analgesics as a means for improving the undertreatment of pain is flawed, and argues instead that dominant Western models of biomedicine and objectivity delegitimize subjective knowledge of the body and (...) pain in the US. This general intolerance for the subjectivity of pain is part of a specific American culture of pain in which a variety of actors take part, including not only physicians and health care providers, but also pain sufferers, caregivers, and policymakers. Concentrating primarily on bioethics, history, and public policy, the book brings a truly interdisciplinary approach to an urgent practical ethical problem. Taking up the practical challenge, the book culminates in a series of policy recommendations that provide pathways for moral agents to move beyond contests over drug policy to policy arenas that, based on the evidence, hold more promise in their capacity to address the devastating and inequitable undertreatment of pain in the US. Economic analysis is being applied by scholars to an increasing range of legal problems. This collection brings together some of the main contributions to an important area of this work, the economics of contract law. The essays and illuminating notes, questions, and introductions provided by the editor outline the Law and Economics framework for analyzing contractual relationships. The first two parts of the book present a number of useful concepts - adverse selection, moral hazard, and rent seeking - and a (...) general way of thinking about the economics of contracting and contract law. The remainder of the book considers a wide range of topics and issues. The recurring theme is that contracting parties want to assign the responsibility for adjusting to particular contingencies to the party best able to control the costs of adjustment. The adjustment problem is exacerbated by the fact that the parties might engage in various types of strategic behavior, such as opportunism, moral hazard, and rent-seeking. In this paper I explore the epistemic significance of practical reasons to inquire. I have in mind the range of practical reasons one might have to do such things as collect (additional) evidence, consult with various sources, employ certain methods or techniques, double-check one’s answer to a question, etc. After expanding the diet of examples in which subjects have such reasons, I appeal to features of these sorts of reason in order to question the motivation for pragmatic encroachment in epistemology. (...) Once we reject pragmatic encroachment, it can seem that we are forced to treat practical reasons to inquire as having no distinctly epistemic significance. This is not so; I conclude by sketching an alternative account of what the epistemic significance of such reasons might be. (shrink)

In this paper I will be arguing that there are cases in which a subject, S, should have known that p, even though, given her state of evidence at the time, she was in no position to know it. My argument for this result will involve making two claims. The uncontroversial claim is this: S should have known that p when another person has, or would have, legitimate expectations regarding S’s epistemic condition, the satisfaction of these expectations would require that (...) S knows that p, and S fails to know that p. The controversial claim is that these three conditions are sometimes jointly satisfied. I will spend the majority of my time defending the controversial claim. I will argue that there are two main sources of legitimate expectations regarding another’s epistemic condition: participation in a legitimate social practice ; and moral and epistemic expectations more generally . In developing my position on this score, I will have an opportunity to defend the doctrine that there are “practice-generated entitlements” to expect certain things, where it can happen that the satisfaction of these expectations requires another’s having certain pieces of knowledge; to contrast practice-generated entitlements to expect with epistemic reasons to believe; to defend the idea that moral and epistemic standards themselves can be taken to reflect legitimate expectations we have of each other; to compare the “should have known” phenomenon with a widely-discussed phenomenon in the ethics literature—that of culpable ignorance; and finally to suggest the bearing of the “should have known” phenomenon to epistemology itself. The following three propositions appear to be individually defensible but jointly inconsistent: (1) reliability is a necessary condition on epistemic justification; (2) on contested matters in philosophy, my beliefs are not reliably formed; (3) some of these beliefs are epistemically justified. I explore the nature and scope of the problem, examine and reject some candidate solutions, compare the issue with ones arising in discussions about disagreement, and offer a brief assessment of our predicament.

Pain policy is not drug policy. If society wants to improve the lives of people in pain and compress the terrible inequalities in its diagnosis and treatment, we have to tailor policy to the root causes driving our problems in treating pain humanely and equitably. In the United States, we do not. Instead, we have proceeded to conflate drug policy with pain policy, relying on arguably magical thinking for the conclusion that by addressing the drug overdose crisis, we are simultaneously (...) addressing the pain crisis. This is a category error, decades of commitment to which have resulted mostly in a worsening of both public health problems. Disentangling our problems in treating pain fairly and equitably from our problems with drugs and substance use is the only path to humane and ethical policy for each. (shrink)

Elsewhere I and others have argued that evidence one should have had can bear on the justification of one's belief, in the form of defeating one's justification. In this paper, I am interested in knowing how evidence one should have had (on the one hand) and one's higher-order evidence (on the other) interact in determinations of the justification of belief. In doing so I aim to address two types of scenario that previous discussions have left open. In one type of (...) scenario, there is a clash between a subject's higher-order evidence and the evidence she should have had: S's higher-order evidence is misleading as to the existence or likely epistemic bearing of further evidence she should have. In the other, while there is further evidence S should have had, this evidence would only have offered additional support for S's belief that p. The picture I offer derives from two “epistemic ceiling” principles linking evidence to justification: one's justification for the belief that p can be no higher than it is on one's total evidence, nor can it be higher than what it would have been had one had all of the evidence one should have had. Together, these two principles entail what I call the doctrine of Epistemic Strict Liability: insofar as one fails to have evidence one should have had, one is epistemically answerable to that evidence whatever reasons one happened to have regarding the likely epistemic bearing of that evidence. I suggest that such a position can account for the battery of intuitions elicited in the full range of cases I will be considering. (shrink)

In this paper I argue that epistemically normative claims regarding what one is permitted or required to believe are sometimes true in virtue of what we owe one another as social creatures. I do not here pursue a reduction of these epistemically normative claims to claims asserting one or another interpersonal obligation, though I highlight some resources for those who would pursue such a reduction.

Substance addiction affects millions of individuals worldwide and yet there is no consensus regarding its conceptualisation. Recent neuroscientific developments fuel the view that addiction can be classified as a brain disease, whereas a different body of scholars disagrees by claiming that addictive behaviour is a choice. These two models, the Brain Disease Model and the Choice Model, seem to oppose each other directly. This article contends the belief that the two models in the addiction debate are polar opposites. It shows (...) that it is not the large amount of addiction research in itself what sets the models apart, but rather their extrapolated conclusions. Moreover, some of the most fiercely debated aspects - for instance, whether or not addiction should be classified as a disease or disorder - are irrelevant for the conceptualisation of addiction. Instead, the real disagreement is shown to revolve around capacities. Discussing addiction-related capacities, especially regarding impaired control, rather than the assumed juxtaposition of the two models can be considered the true addiction debate. More insight into the extent to which the capacities of the addicted individual were affected would be highly useful in various other areas, especially legal responsibility. (shrink)

Many epistemologists agree that even very young children sometimes acquire knowledge through testimony. In this paper I address two challenges facing this view. The first (building on a point made in Lackey (2005)) is the defeater challenge, which is to square the hypothesis that very young children acquire testimonial knowledge with the fact that children (whose cognitive immaturity prevents them from having or appreciating reasons) cannot be said to satisfy the No-Defeaters condition on knowledge. The second is the extension challenge, (...) which is to give a motivated, extensionally-adequate account of the conditions on testimonial knowledge in early childhood. Neither challenge can be met merely by endorsing externalism about knowledge; but we can meet both by reconceiving the process that eventuates in the child’s consumption of testimony. My central thesis is that this process should be seen as implicating features of the child's social environment. The result is a novel anti-individualistic externalism about knowledge. (shrink)

This paper answers a question of Usuba [Extendible cardinals and the mantle, Arch. Math. Logic 58(1–2) (2019) 71–75], establishing the optimality of the large cardinal assumption of his remarkable theorem that if there is an extendible cardinal, there is a minimum inner model from which the universe of sets can be obtained as a forcing extension.

In this paper I formulate the thesis of the Division of Epistemic Labor as a thesis of epistemic dependence, illustrate several ways in which individual subjects are epistemically dependent on one or more of the members of their community in the process of knowledge acquisition, and draw conclusions about the cognitively distributed nature of some knowledge acquisition.

It has been alleged that the demands of friendship conflict with the norms of epistemology—in particular, that there are cases in which the moral demands of friendship would require one to give a friend the benefit of the doubt, and thereby come to believe something in violation of ordinary epistemic standards on justified or responsible belief :329–351, 2004; Stroud in Ethics 116:498–524, 2006; Hazlett in A luxury of the understanding: on the value of true belief, Oxford University Press, Oxford, 2013). (...) The burden of this paper is to explain these appearances away. I contend that the impression of epistemic partiality in friendship dissipates once we acknowledge the sorts of practical and epistemic reasons that are generated by our values: value-reflecting reasons. The present proposal has several virtues: it requires fewer substantial commitments than other proposals seeking to resist the case for epistemic partiality ; it is independently motivated, as it cites a phenomenon—value-reflecting reasons—we have independent reasons to accept; it provides a single, unified account of how various features of friendship bear on belief-formation; and makes clear how it is the very value we place on friendship itself that ensures against epistemic partiality. I believe that the sort of disagreements we encounter in philosophy—disagreements that often take the form that I have elsewhere called system- atic peer disagreements—make it unreasonable to think that there is any knowledge, or even justified belief, when the disagreements themselves are systematic. I readily acknowledge that this skeptical view is quite controversial; I suspect many are unconvinced. However, I will not be defending it here. Rather, I will be exploring a worry, or set of worries, that arise on (...) the assumption that this view is correct. For if it is unreasonable to think that there is justified belief in contexts of systematic philosophical disagreements, by what right do we continue to advance philosophical claims in such contexts? Indeed, by what right do we believe the philosophical claims we advance? And if we don’t believe them, why do we advance them in the first place? An inability to respond to these worries would leave us with the dis- tinct impression that the practice or activity of philosophy is quite suspect: what sort of practice or activity would have us believe unreasonably, assert unwarrantedly, and perhaps exhibit insincerity to boot? Trust is central to the therapeutic relationship, but the epistemic asymmetries between the expert healthcare provider and the patient make the patient, the trustor, vulnerable to the provider, the trustee. The narratives of pain sufferers provide helpful insights into the experience of pain at the juncture of trust, expert knowledge, and the therapeutic relationship. While stories of pain sufferers having their testimonies dismissed are well documented, pain sufferers continue to experience their testimonies as being epistemically downgraded. This kind of epistemic (...) injustice has received limited treatment in bioethics. In this paper, we examine how a climate of distrust in pain management may facilitate what Fricker calls epistemic injustice. We critically interrogate the processes through which pain sufferers are vulnerable to specific kinds of epistemic injustice, such as testimonial injustice. We also examine how healthcare institutions and practices privilege some kinds of evidence and ways of knowing while excluding certain patient testimonies from epistemic consideration. We argue that providers ought to avoid epistemic injustice in pain management by striving toward epistemic humility. Epistemic humility, as a form of epistemic justice, may be the kind disposition required to correct the harmful prejudices that may arise through testimonial exchange in chronic pain management. In the Minos orOn Law Socrates asks a nameless companion out of the blue, “What is law for us?” knowing full well, it seems, that the companion himself will not be able to give a satisfactory answer. Why on earth, then, would Socrates bother to ask the question of the companion—a man clearly more ignorant than himself? The mystery only deepens when the companion mishears and misunderstands Socrates’ decisive contribution to the conversation and Socrates doesn’t even bother to set him (...) straight. Rather, he uses the definition of law the companion mistakenly thinks he heard to lead him, via the companion’s own opinions, to a position that Socrates does not himself hold. In this chapter, Goldberg hopes to uncover the deep philosophical reasons for Socrates’ procedure in conducting so strange a conversation. (shrink)

In this paper I present an internal difficulty for the hypothesis that mentalistic explanation is causal explanation. My thesis is that intuitively acceptable mentalistic explanations appear to violate constraints imposed by the mental causation hypothesis.

Recent developments in neuroscience that purport to reduce religious experience to specific parts of the brain will not diminish the fundamental cultural or legal standing of religion. William James debunked this possibility in The Varieties of Religious Experience when he noted that “the organic causation of a religious state of mind” no more refutes religion than the argument that scientific theories are so caused refutes science. But there will be incremental legal change in areas like civil commitment where judges must (...) sometimes distinguish between mental disorder and religious belief. The paradox is that the ecstatic religious experience of unorthodox individuals will fare less well in the courts than the beliefs of conventional groups, which is precisely the opposite of James’ view of authentic religious life.
