In contrast to eminent historical philosophers, almost all contemporary philosophers maintain that slavery is impermissible. In the enthusiasm of the Enlightenment, a number of arguments gained currency which were intended to show that contractual slavery is not merely impermissible but impossible. Those arguments are influential today in moral, legal and political philosophy, even in discussions that go beyond the issue of contractual slavery. I explain what slavery is, giving historical and other illustrations. I examine the arguments for the impossibility of (...) contractual slavery propounded in the Enlightenment and their offspring expounded in recent writings, including those by Barnett, Cassirer, Ellerman, Rawls, Roberts-Thomson, Satz and Steiner. I show that they involve confusions between abilities and rights, free will and freedom, directing and doing, what may be true sequentially and what may be true simultaneously, default rights and universal rights, impermissibility and impossibility, and metaphorical and literal uses of language. There is ample discussion of MBA self-serving values in the corporate social responsibility literature, and yet empirical studies regarding the corporate manifestations and consequences of those values are scant. In a comprehensive study of major US public corporations, we find that MBA CEOs are more apt than their non-MBA counterparts to engage in short-term strategic expedients such as positive earnings management and suppression of R&D, which in turn are followed by compromised firm market valuations.

The literature on the interplay between geographic communities and organizations has largely ignored the role of individual residents. In adopting a meso-perspective, we examine a potentially vital relationship between corporate conduct and pro-social behavior demanding sacrifice from individuals. Drawing on Weber ), we theorize that organizations in a community legitimize personal social conduct in three ways—by serving as role models, imparting norms and values, and routinizing forms of interaction. We study the relationship between corporate social responsibility behavior by local firms (...) and the social distancing of citizens in US counties during the Covid-19 pandemic, a core ethical outcome. We argue and find that the residents of communities in which firms exhibit higher levels of CSR engaged in more SD during the Covid-19 pandemic. This was true when firms were long-established, isomorphic in their CSR, and major employers and vendors. Moreover, CSR relating to the treatment of employees as well as positive and negative extremes in CSR bore especially strong relationships with SD. Implications are drawn for the study of business ethics, as modeled by CSR, as a force for ethical personal behavior and public health in communities. (shrink)

The article examines the compatibility of agonistic democracy and populism as well as their relationship to the idea of constitutionalism. The first part shows that Chantal Mouffe’s recent attempts to reconcile her normative approach of an agonistic pluralism with a populist style of politics are not fully convincing. Although there are undeniable commonalities between an agonistic and a populist understanding of politics – the appreciation of conflict, the rejection of moralistic and juridical modes of conflict resolution etc. – the populist (...) mode of the construction of the people (and the denunciation of political opponents as enemies of the people) risks impeding the transformation of antagonistic into agonistic modes of political contest. The tensions between agonism and populism are especially evident in matters of constitutionalism. This topic is examined in the second part of the article, which provides some ideas for reducing the normative and institutional blind spots of contemporary theories of agonistic democracy. It focuses on elementary principles for an agonistic concept of democratic constitutionalism that differs from the populist view of the relationship between politics and law, especially in respect of its interpretation of the concept of ‘resistibility’ of legal norms. This essay examines an aesthetics of disgust through an analysis of the work of Scottish painter Jenny Saville. Saville's paintings suggest that there is something valuable in retaining and interrogating our immediate and seemingly unambivalent reactions of disgust. I contrast Saville's representations of disgust to the repudiation of disgust that characterizes contemporary corporeal politics. Drawing on the theoretical work of Elspeth Probyn and Julia Kristeva, I suggest that an aesthetics of disgust reveals the fundamental ambiguity of embodiment, allowing us to (...) critically attend to the aesthetic and cultural objectification of the female body. According to the epistemic account of request normativity, a request gives us reasons by revealing normatively relevant information. The information is normative, not the request itself. I raise a new objection to the epistemic account based on situations where we might try to avoid someone requesting something of us. The best explanation of these situations seems to be that we do not want to acquire a new reason to do something. For example, if you know I am going to ask (...) you to read a draft of my paper, you might avoid running into me so as to avoid acquiring a reason to read a draft of my paper. I then argue that the epistemic account can successfully reply to this objection and that in fact the epistemic account does a better job of accounting for cases like this than competing views of the normativity of requests. Summary This paper reconceptualizes Thomas Clifford Allbutt's contributions to the making of scientific medicine in late nineteenth-century England. Existing literature on Allbutt usually describes his achievements, such as his design of the pocket thermometer and his advocacy of the use of the ophthalmoscope in general medicine, as independent events; and his work on the development of comparative pathology is largely overlooked. In this paper I focus on this latter aspect. I examine Allbutt's books and addresses and claim that Allbutt argued (...) for the centrality of comparative pathology in the advancement of medical knowledge. He held that diseases should be studied as biological phenomena and that medicine should be made a biological science. He also argued that comparative pathology should be based upon the idea of evolution, and its study should embrace other nineteenth-century sciences including neurology, embryology and bacteriology. Allbutt's writings reveal that his endorsement of comparative pathology, his promotion of the use of the ophthalmoscope and the thermometer in clinical medicine, and his support of the hospital unit system were part of a single programme. All were grounded in his scientific vision of medicine which emphasized a research culture, a stringent nosological attitude and an integration of laboratory sciences and clinical medicine. (shrink)

Building on previous works which argued that scalar implicatures can be computed in embedded positions, this paper proposes a constraint on exhaustification which restricts the conditions under which an exhaustivity operator can be licensed. We show that this economy condition allows us to derive a number of generalizations, such as, in particular, the ‘Implicature Focus Generalization’: scalar implicatures can be embedded under a downward-entailing operator only if the scalar term bears pitch accent. This paper will be concerned with the conjunctive interpretation of a family of disjunctive constructions. The relevant conjunctive interpretation, sometimes referred to as a “free choice effect,” (FC) is attested when a disjunctive sentence is embedded under an existential modal operator. I will provide evidence that the relevant generalization extends (with some caveats) to all constructions in which a disjunctive sentence appears under the scope of an existential quantifier, as well as to seemingly unrelated constructions in which conjunction appears under (...) the scope of negation and a universal quantifier. This paper examines W.E.B. Du Bois's Darkwater as an existentialist text offering a conception of socialism best characterized as Africana existentialist socialism. It argues for a conception of Africana existentialism as inclusive of issues of collective, and not solely individual responsibility. Darkwater is interpreted in terms of a unifying thematic of a humanist anti-theodicy, our of which emerges Du Bois's conception of an ideal of "service without servants." The Iran depicted in the headlines is a rogue state ruled by ever-more-defiant Islamic fundamentalists. Yet inside the borders, an unheralded transformation of a wholly different political bent is occurring. Many contemporary legal positivists have argued that legal theory is evaluative because it requires the theorist to make judgments of importance. At the same time they argue that it is possible to know without resort to evaluative considerations. I distinguish between two senses of : in one sense it refers to legal validity, in another to the content of legal norms, and I argue that legal positivism is best understood (as indeed some legal positivists have explicitly said) as a claim (...) about legal content. Understood this way, however, it is open to the objection that knowing the content of legal norms requires evaluative considerations for reasons similar to those offered by positivists for thinking that legal theory is requires evaluative considerations. I then distinguish between evaluative considerations in general and moral considerations and argue that because of the subject-matter of legal norms, there are good reasons for thinking that it is moral considerations, and not just any other evaluative considerations, that are required for knowing the content of legal norms. In this paper, the process for firms to decide whether or not to invest in corporate social responsibility is treated from a real option perspective. We extend the Husted framework with an important extra parameter that allows us to understand the timing of CSR investment and explain why some companies drag their feet over CSR investments. Our model explicitly allows for the impact of the opportunity cost of delaying the CSR investment decision, providing firms with tools to determine the optimal (...) moment of exercising the CSR investment option. We illustrate our timing model through a case study and analyze governmental support strategies for CSR from a real options perspective. (shrink)

A Dialogue between American pragmatists in the Deweyan tradition and Saskia Sassen is profitable in at least two ways. First, Sassen’s call for “analytic tactics” might be understood in terms of Dewey’s understanding of “soft method.” Second, Sassen is a model of the publicly engaged scholar, not only because she lives the work but also because she connects theory and empirical research in ways that are necessary if we are to follow the Deweyan call to philosophers to address social problems (...) rather than problems internal to philosophy. David Miller propounds a theory of objective knowledge from which he mistakenly derives some consequences about question-begging and persuasion that appear to be false. He makes a further claim about persuasion that also seems false. I argue that Miller’s account of objective knowledge is explanatorily weak unless supplemented with an account of subjective knowledge and that the latter enables us to extricate Miller’s theory from the falsehoods he associates with it.

Many of the current debates in jurisprudence focus on articulating the boundaries of law. In this essay I challenge this approach on two separate grounds. I first argue that if such debates are to be about law, their purported subject, they ought to pay closer attention to the practice. When such attention is taken it turns out that most of the debates on the boundaries of law are probably indeterminate. I show this in particular with regard to the debate between (...) inclusive and exclusive positivists: I present several ways of understanding what this debate is about and argue that none of them is defensible. My second argument focuses more on the purpose of jurisprudential inquiry. I argue there that even if some jurisprudential debates have determinate answers, it does not follow that they deserve our attention, because not all true facts are worth knowing. After discussing and rejecting the claim that jurisprudence could be justified as knowledge for its own sake, I propose one possible justification for engaging in legal philosophy and outline its implications for the kind of issues that should be pursued. The article inquires about the role of language in Cristina Peri Rossi’s Panic Signs [Indicios pánicos]. The hypothesis of the work is that language, as a mimetic instrument of representation and creation, established itself as a way to upgrade the relations of power during the Uruguayan pre-dictatorship. Being a qualitative research based on a hermeneutical approach, the article has the following aims: i) reconstruct the background to the dictatorship leaded by Juan Maria Bordaberry, ii) frame the work within the tradition (...) of dictator novel following Lukács’ socio-critical approach and Pierre Bourdieu’s field theory, iii) explain how language works as an instrument of representation and power, iv) analyze Peri Rossi’s work in the light of the aforementioned framework. It concludes, first, that the work responds to a mimetic language of representation, which involves taking a stance that is based on the notions of hegemony or counter-hegemony; and, second, that provided the scarce studies concerning the circumstantial situations of the work, the article might be regarded as a significant contribution to literary criticism. This paper discusses gender, sexuality and race through the analysis of Ann Walker, who is a character in the Tv show Gentleman Jack (2019). It aims to focus on the encounter and on the latent desire between Ann and the series’ protagonist to then explore the tensions and established pacts within the limits of femininity, heterossexuality and whiteness, through an elusive gaze to the paranoid reading. Therefore, desire emerges as a theoretical-analytical category by the writings of Deleuze and Guattari (1997; (...) 1995) and Deleuze and Parnet (1998). Lugones’ theory (2014; 2007; 1994) on the coloniality of gender, purity and creativity also contributes to operating a racially aware analysis. Through her desire for the protagonist, Ann constitutes a pact with the demon, in Deleuzo-Gauttarian terms, which ambivalently culminates in the expropriation of herself and in the production of another self, elusive to the expectations of gender and sexuality, however sustained by the limits and possibilities of whiteness. This is a collection of nineteen essays in the tradition of critical rationalism (as advocated by Karl Popper). All but one of the essays is previously unpublished and the one previously published paper has undergone significant revisions. The first four essays tackle topics in the philosophy of science, the first being an exposition of Popper's views, the others discussing falsifiability, truth, the aim of science, and ceteris-paribus law-statements. Five essays follow concerned with Reason, reasoning and reasons, in which faulty conceptions (...) of theoretical and practical reason are criticised, the nature and uses of argument are discussed, and the rationality of debate, agreement and disagreement are explained. Next, there are two papers on economics, one of which is a substantial critique of the so-called subjective theory of value, the other a brief discussion of entrepreneurial insight. The last section of the book contains a miscellany of eight critical essays in which some errors of contemporary philosophers are exposed regarding issues including the interpretation of Popper’s work, the Gettier problem, no-platforming, open-mindedness, homosexual equality, tolerance, philosophical heuristics and the conduct of debate. People in rich countries increasingly rely on paid workers to care for many of their health and personal care needs. We expect that, in most families, love or filial piety underpin caring relationships, and that these moral bonds ensure good quality care. If paid caring relationships are not underpinned by love, what moral bonds can they rely on? Exploring contract, professional duty, and compassionate gift as normative “resources” for good paid care, I conclude that we cannot expect paid carers to (...) reproduce an idealized private sphere. Instead we can expect “good enough” care, supported by a range of normative resources. (shrink)

De forma similar a outras ciências, a Arqueologia é uma área permeável à experimentação e aplicação de conceitos teórico-práticos exógenos que levou, inclusive, à formação de diversas especialidades que unem (...) a Arqueologia e outras áreas, como a Zooarqueologia. Como aconteceu ao longo da sua história, o meio académico está perante um momento de mudança na forma como se processa a aquisição de conhecimento. O fato de estarmos na Era Digital da globalização faz com que a adaptação do meio académico a esta realidade seja mais continuada, não sendo a Arqueologia alheia a esta transformação. We present an argument for revising the theory of alternatives for Scalar Implicatures and for Association with Focus. We argue that in both cases the alternatives are determined in the same way, as a contextual restriction of the focus value of the sentence, which, in turn, is defined in structure-sensitive terms. We provide evidence that contextual restriction is subject to a constraint that prevents it from discriminating between alternatives when they stand in a particular logical relationship with the assertion or (...) the prejacent, a relationship that we refer to as symmetry. Due to this constraint on contextual restriction, discriminating between alternatives in cases of symmetry becomes the task of focus values. This conclusion is incompatible with standard type-theoretic definitions of focus values, motivating our structure-sensitive definition instead. (shrink)

This paper argues in favor of two claims: (a) that Scope Shifting Operations (Quantifier Raising and Quantifier Lowering) are restricted by economy considerations, and (b) that the relevant economy considerations compare syntactic derivations that end up interpretively identical. These ideas are shown to solve several puzzles having to do with the interaction of scope with VP ellipsis, coordination, and the interpretation of bare plurals. Further, the paper suggests a way of dealing with the otherwise puzzling clause-boundedness of Quantifier Raising.

In a recent paper, Martin Hackl and I identified a variety of circumstances where scalar implicatures, questions, definite descriptions, and sentences with the focus particle only are absent or unacceptable (Fox and Hackl 2006, henceforth F&H). We argued that the relevant effect is one of maximization failure (MF): an application of a maximization operator to a set that cannot have the required maximal member. We derived MF from our hypothesis that the set of degrees relevant for the semantics of degree (...) constructions is always dense (the Universal Density of Measurement, UDM). The goal of this paper is to present an apparent shortcoming of F&H and to argue that it is overcome once certain consequences of the proposal are shown to follow from more general properties of MF. Specifically, the apparent problem comes from evidence that the core generalizations argued for in F&H extend to areas for which an account in terms of density is unavailable. Nevertheless, I will argue that the account could still be right. Certain dense sets contain "too many alternatives" for there to be a maximal member, thus leading to MF. But, there are other sets that lead to the same predicament. My goal will be to characterize a general signature of MF in the hope that it could be used to determine the identity of alternatives in areas where their identity is not clear on independent grounds. A central problem of political philosophy is that of explaining how a state could have the moral authority to enforce laws, promulgate laws which citizens are thereby obliged to obey, give new duties to citizens and levy taxes. Many rival solutions to this problem of political authority have been offered by contemporary and recent philosophers but none has obtained wide acceptance. The current debate takes no cognisance of George Berkeley’s ‘Passive Obedience’, in which he defends the exceptionless duty of not (...) using force to resist the state and offers a rule-consequentialist account of morality which indicates an explanation of political authority as grounded in the social connectedness of human beings. I expound, criticise and develop Berkeley’s explanation to provide a promising solution to the problem of political authority. The solution impugns the political authority of all existing states as well as the duty of passive obedience. (shrink)

In ‘The Open Society and its Enemies,’ Karl Popper contrasts closed and open societies. He evaluates irrationalism and the different kinds of rationalism and he argues that critical rationalism is superior. Living in an open society bestows great benefits but involves a strain that may in some people engender a longing to return to a closed society of tribal submission and an attraction for irrationalism. Attempts to recreate a closed society lead to totalitarianism. In the light of Popper’s arguments I (...) criticise contemporary identity politics and I show that identity politics is irrationalist and tends to totalitarianism. (shrink)
