Background: Ethical and legal issues are increasingly being reported by health caregivers; however, little is known about the nature of these issues in geriatric care. These issues can improve work and care conditions in healthcare, and consequently, the health and welfare of older people. Aim: This literature review aims to identify research focusing on ethical and legal issues in geriatric care, in order to give nurses and other health care workers an overview of existing grievances and possible solutions to take (...) care of old patients in a both ethical and legally correct way. Methods: Using a systematic approach based on Aveyard, a search of the PubMed, CINAHL, and Ethicshare databases was conducted to find out the articles published on ethical and legal issues in geriatric care. Ethical considerations: The approval for the study was obtained from UMIT-The Health and Life Sciences University, Austria. Results: Only 50 articles were included for systematic analysis reporting ethical and legal issues in the geriatric care. The results presented in this article showed that the main ethical issues were related to the older people’s autonomy, respect for their needs, wishes and values, and respect for their decision-making. The main legal issues were related to patients’ rights, advance directives, elderly rights, treatment nutrition dilemma, and autonomy. Conclusion: Further education for professional caregivers, elderly people, and their families is needed on following topics: care planning, directive and living wills, and caregiver-family member relationships to guide and support the elderly people within their decision-making processes and during the end-of-life care. Background The ethical governance of Artificial Intelligence (AI) in health care and public health continues to be an urgent issue for attention in policy, research, and practice. In this paper we report on central themes related to challenges and strategies for promoting ethics in research involving AI in global health, arising from the Global Forum on Bioethics in Research (GFBR), held in Cape Town, South Africa in November 2022. Methods The GFBR is an annual meeting organized by the World Health (...) Organization and supported by the Wellcome Trust, the US National Institutes of Health, the UK Medical Research Council (MRC) and the South African MRC. The forum aims to bring together ethicists, researchers, policymakers, research ethics committee members and other actors to engage with challenges and opportunities specifically related to research ethics. In 2022 the focus of the GFBR was “Ethics of AI in Global Health Research”. The forum consisted of 6 case study presentations, 16 governance presentations, and a series of small group and large group discussions. A total of 87 participants attended the forum from 31 countries around the world, representing disciplines of bioethics, AI, health policy, health professional practice, research funding, and bioinformatics. In this paper, we highlight central insights arising from GFBR 2022. Results We describe the significance of four thematic insights arising from the forum: (1) Appropriateness of building AI, (2) Transferability of AI systems, (3) Accountability for AI decision-making and outcomes, and (4) Individual consent. We then describe eight recommendations for governance leaders to enhance the ethical governance of AI in global health research, addressing issues such as AI impact assessments, environmental values, and fair partnerships. Conclusions The 2022 Global Forum on Bioethics in Research illustrated several innovations in ethical governance of AI for global health research, as well as several areas in need of urgent attention internationally. This summary is intended to inform international and domestic efforts to strengthen research ethics and support the evolution of governance leadership to meet the demands of AI in global health research. El artículo analiza el caso de científicas negras en universidades colombianas, desde dos cuestiones fundamentales: El lugar que ocupan dichas mujeres dentro del campo científico, tomando en cuenta tanto los sistemas de medición oficiales como las asignaciones que ellas mismas, de modo reflexivo, otorgan a su papel dentro del sistema. Y segundo, analiza cómo a partir de prácticas comunicativas concretas, que asumimos como constitutivas del quehacer científico, estas mujeres se contactan con aquellos que están fuera del campo científico y se (...) constituyen como públicos no expertos. Nuestro análisis parte de la idea de que estas prácticas comunicativas construyen tecnologías del contacto, que pueden comprenderse desde un ethos del cuidado que aboga por un sentido de reparación y repolitización de la producción de conocimiento científico. Propósito: la adecuación del esfuerzo terapéutico es una decisión clínica basada en la evidencia que pretende evitar la futilidad médica. Se han señalado diferentes factores que pueden influir en esta toma de decisiones los cuales se relacionan con el paciente, el profesional médico que toma de las decisiones, barreras del sistema, cultura y economía, entre otros. El presente estudio pretende identificar aquellos factores que influyen en los médicos especialistas que laboran en la institución referente del cáncer en Colombia, a fin (...) de planear acciones que mejoren el abordaje de la toma de decisiones con respecto a la adecuación del esfuerzo terapéutico en pacientes con cáncer. Metodología: diseño cualitativo basado en 13 entrevistas en profundidad a médicos especialistas del Instituto Nacional de Cancerología de Colombia. Resultados: participaron 3 mujeres y 10 hombres, con un promedio de edad de 36 años, 7 pertenecientes a la especialidad de oncología de adultos, 2 a oncohematología pediátrica, 1 a cuidados intensivos de adultos y 3 a cuidados intensivos pediátricos. Los factores hallados se agruparon en cuatro categorías: 1) conocimiento, 2) aspectos relacionados con la toma de decisiones, 3) quién decide, 4) tipo de decisión que se toma; a su vez, estas categorías se agruparon en temas que hacen alusión a los factores que influyen en la toma de decisiones de los especialistas para adecuar los esfuerzos terapéuticos. Conclusión: la adecuación de los esfuerzos terapéuticos es importante para evitar procedimientos médicos fútiles que prolonguen el sufrimiento. Se evidenciaron algunos factores que influyen en la toma de decisiones de los especialistas: falta de preparación de los profesionales de salud en el tema de toma de decisiones al final de la vida, uso reducido de escalas que permitan mejorar la información del pronóstico y desconocimiento sobre voluntades anticipadas; estos son algunos de aquellos factores que deben fortalecerse para generar acciones que mejoren el abordaje de esta temática. Resumen: Dada la multiplicidad de planos que acompañan a las observaciones de la actual pandemia, importa identificar aquellas que alcanzan una mayor resonancia. Así, observamos cómo los ciudadanos y los agentes de decisión han incrementado sus demandas de informaciones validadas por medio de la aplicación de la racionalidad, los métodos y los procedimientos de la ciencia de manera exponencial. En este trabajo desarrollamos en forma sintética un conjunto seleccionado de lineamientos sobre cómo se aborda la actual pandemia desde las ciencias (...) sociales sistémicas, para luego exponer algunas de sus propuestas respecto a las condiciones, a nivel organizacional, las cuales podrían permitir alcanzar los niveles de diálogo y cooperación requeridos para enfrentar la pandemia actual.: Given the multiplicity of perspectives that accompany the observation of the current pandemic, becomes relevant to identify those that achieve the greatest resonance. Thus, it is observed how citizens and decision makers have increased their demands for valid information by applying rationality, methods, and procedures of science in an exponential manner. In this paper we develop a synthetic set of selected guidelines on how the current pandemic is approached from systemic social sciences, and then present some of their proposals regarding the conditions, at the organizational level, which could enable the achievement of the levels of dialogue and cooperation required to address the current pandemic. Emotional stimuli (e.g. words, images) are often remembered better than neutral stimuli. However, little is known about how memory is affected by an environmentally induced emotional state (without any overtly emotional occurrences) – the focus of this study. Participants were randomly assigned to discovery (n = 305) and replication (n = 306) subsamples and viewed a desktop virtual environment before rating their emotions and completing objective (i.e. item, temporal-order, duration) and subjective (e.g. vividness, sensory detail, coherence) memory measures. In both (...) samples, a Partial Least Squares Correlation analysis showed that an emotional state characterised by high negative emotion (i.e. threat, fear, anxiety) and arousal was reliably associated with better memory in both objective (i.e. item) and subjective (i.e. vividness and sensory detail) domains. No reliable associations were observed for any temporal memory measures (objective or subjective). Thus, an environmentally induced state of negative emotion corresponds with enhanced memory for indices of episodic memory pertaining to “what” happened, but not necessarily “when” it happened. Research on language evolution is an established subject area yet permeated by terminological controversies about which topics should be considered pertinent to the field and which not. By consequence, scholars focusing on language evolution struggle in providing precise demarcations of the discipline, where even the very central notions of evolution and language are elusive. We aimed at providing a data-driven characterisation of language evolution as a field of research by relying on quantitative analysis of data drawn from 697 reviews on (...) 255 submissions from the Joint Conference on Language Evolution 2022 (Kanazawa, Japan). Our results delineate a field characterized by a core of main research topics such as iconicity, sign language, multimodality. Despite being explored within the framework of language evolution research, only very recently these topics became popular in linguistics. As a result, language evolution has the potential to emerge as a forefront of linguistic research, bringing innovation to the study of language. We also see the emergence of more recent topics like rhythm, music, and vocal learning. Furthermore, the community identifies cognitive science, primatology, archaeology, palaeoanthropology, and genetics as key areas, encouraging empirical rather than theoretical work. With new themes, models, and methodologies emerging, our results depict an intrinsically multidisciplinary and evolving research field, likely adapting as language itself. (shrink)

The study investigates the effects of ESG washing on banks' reputational exposure. We define ESG washing as a disparity between a bank's environmental and social disclosure level and the practical implementation of the relative measures. The analysis involves an international sample of 120 banks operating across 35 countries from 2014 to 2020. The results evidence a different effect based on the pillar considered: the higher the inconsistency on environmental issues, the higher a bank's reputational exposure. Conversely, higher levels of disclosure (...) compared to performance on social issues appear to reduce reputational exposure. In addition, citizen movements and the country's legal system play a significant role in amplifying or mitigating a bank's reputational exposure. Our findings offer insight into the phenomenon of ESG washing in the banking industry, supporting the need for more verified information across countries and all economic sectors. (shrink)

Background: Depressive disorder is one of the main health problems worldwide. Many risk factors have been associated with this pathology. However, while the association between risks factors and adult depression is well established, the mechanisms behind its impact remains poorly understood. A possible, yet untested explanation is the mediating impact of levels of personality functioning, i.e., impairments with regard to self and interpersonal.Method: Around 162 patients were assessed at the beginning of their therapy, with regard to risk factors, such as (...) sociodemographic, physical, hereditary, and adverse childhood experiences. Depressive symptoms and personality functioning were also measured. Associations between the related variables as well as other possible covariates were examined by means of zero-order correlations and bootstrapping-based mediation analysis.Results: Of all the risk factors taken into account, level of education and physical illness were associated with depression. On the other hand, the most significant predictor of depressive symptomatology was ACE, and this relationship was mediated by personality functioning. This indicates that patients presenting adverse childhood experiences are more likely to develop deficiencies in personality functioning, which in turn increases their likelihood of developing depressive symptomatology.Conclusion: These results reaffirm the importance of incorporating risk and vulnerability factors such as personality functioning in understanding depression. El presente artículo aborda la estrategia escritural de Daniela Catrileo. Se propone revisar la elaboración del concepto de piñen examinando la relación entre lenguaje y colonialidad, para, de ese modo, subrayar el potencial político y reivindicativo que comporta en la novela del mismo nombre, Piñen (2019). Dicha hipótesis articulará el ejercicio de lectura aquí propuesto, atendiendo principalmente las estrategias narrativas empleadas –servirse de un polilingüismo que rompe estructuras gramaticales– para descentrar el lenguaje de su determinismo colonial. Así, interpretamos dicha (...) estrategia escritural en consonancia con las potencias micropolíticas y descolonizadoras del arte descritas por Suely Rolnik y, en consecuencia, apostando por la posibilidad de diagramar un devenir minoritario que dispute los imaginarios del inconsciente colonial-capital. The article examines cultural anthropological approaches to cultural boundaries and cultural change. It suggests that these approaches to cultural change can be made fruitful for understanding how cultural elements spread across different scienti?c communities, and the possible effects such dynamics could have on the negotiation of boundaries in the ?eld. The article is based on an ethnographic study of nanoscale research and re?ects on where to look for moments of boundary transgression in this ?eld that is characterized by its multiple (...) dimensions of inclusion and distinction. Literature discloses beliefs, cultural values, myths and ideologies which reveal concepts of morality of the environments when and where it was produced. This article proposes to investigate male and female characters in different literatures to analyze the female figure and the maternal cry in the Hebrew Bible and Rabbinic literature. Rabbinical Hebrew literature teaches social practices through traditions. This context reveals the development of gender archetypes from the Hebrew Bible and in the rabbinical Hebrew literature universe of the Orthodox Judaism, (...) which determines social patterns from religious specific sexist models. The purpose of this article is to expose the maternal cry in the Hebrew Bible and in the rabbinical exegesis; revealing that men are progenitors and women should be instinctively maternal, because having children is the central feminine role. The research carried out wants to prompt the reflection about the symbolism of the maternal crying as a sacred suffering, as an altruistic act, which in many religions, doctrines and cultures transcend the motherhood itself perceived as sacrifice. In the present article we exploit the logical notions of correctness and completeness to provide an analysis of some fundamental problems that can be encountered by a software developer when transforming norms for traffic circulation into programming instructions. Relying on this analysis, we then introduce a question and answer procedure that can be helpful, in case of an accident, to clarify which components of an existing framework should be revised and to what extent software developers can be held responsible.

Justified belief is a core concept in epistemology and there has been an increasing interest in its logic over the last years. While many logical investigations consider justified belief as an operator, in this paper, we propose a logic for justified belief in which the relevant notion is treated as a predicate instead. Although this gives rise to the possibility of liar-like paradoxes, a predicate treatment allows for a rich and highly expressive framework, which lives up to the universal ambitions (...) of investigating epistemological concepts. We start with a base theory for justified belief, and then systematically present putative additional axioms for justified belief. We provide an overview of consistency results when the additional principles are added to the base theory, and discuss their philosophical plausibility. (shrink)

Crowdfunding is regarded a financing mechanism that could improve the funding opportunities of businesses with a pro-social orientation. Indeed, it is assumed that on digital platforms, citizens are inclined to provide more support to projects with a social benefit than to those without such an orientation, with significant ethical implications for the common good. Yet, extant empirical evidence regarding such a claim is still inconclusive. To advance this discussion, the present paper analyzes the conditions that influence crowd support for projects (...) displaying a pro-social orientation on a reward-based crowdfunding platform. To build our hypotheses, we adopt the lens of framing theory, and we relate it to the digital context. Beginning from the premise that, on crowdfunding platforms, information about projects has a hierarchical structure, we argue that a project’s success crucially depends on how much its proponent emphasizes the pro-social cues within this structure. Moreover, we propose that because pro-social cues demarcate a project over others, the effectiveness of pro-social framing is enhanced when the number of projects on the platform, i.e., its crowdedness, increases. Logit estimates on 8631 Kickstarter projects indicate that pro-social framing is positively associated with success as we expected, yet only when it is moderately emphasized. Further, we find that crowdedness on the platform positively moderates the effect of pro-social orientation on success. (shrink)

It is generally believed that one argument advanced by Aristotle in favor of the political authority of the multitude is that large groups can make better decisions by pooling their knowledge than individuals or small groups can make alone. This is supported by two analogies, one apparently involving a “potluck dinner” and the other aesthetic judgment. This article suggests that that interpretation of Aristotle’s argument is implausible given the historical context and several features of the text. It argues that Aristotle’s (...) support for the rule of the multitude rested not on its superior knowledge but rather on his belief that the virtue of individuals can be aggregated and even amplified when they act collectively. This significantly alters our understanding of Aristotle’s political thought and presents a powerful alternative to the epistemic defenses of mass political activity popular today. (shrink)

The article intends to present Nancy Fraser’s main criticism of Judith Butler’s thought, around the issue of the agency capacity of political subjects, taking sides in defending Butler’s thought. It is argued that Fraser fails to understand how Butler conceives an idea of power based on Michel Foucault, whose very functioning demands another understanding not only of what a subject is, but also of what we can call political action. Thus showing how Butler constructs a gender theory based on the (...) concept of performativity and with the influences of Foucault and Derrida, we argue that the author conceives an idea of radical intersectionality, from which power becomes diffuse and positive and the political agency is understood within the flaws and fissures operated by the functioning of power itself. The various problems associated with co-authorship of research articles have attracted much attention in recent years. We believe that this growing awareness is a very welcome development. However, we will argue that the particular and increasing importance of authorship and the harmful implications of current practices of research authorship for junior researchers have not been emphasised enough. We will use the case of our own research area to illustrate some of the pitfalls of current publishing practices—in particular, the impact on (...) the evaluation of one’s work in the area of employment or funding. Even where there are explicit guidelines, they are often disregarded. This disregard, which is often exemplified through the inflation of co-authorship in some research areas, may seem benign to some of us; but it is not. Attribution of co-authorship for reasons other than merit in relation to the publication misrepresents the work towards that publication, and generates unfair competition. We make a case for increasing awareness, for transparency and for more explicit guidelines and regulation of research co-authorship within and across research areas. We examine some of the most sensitive areas of concern and their implications for researchers, particularly junior ones, and we suggest several strategies for future action. (shrink)

Mamardashvili always engaged in a dialogue with thinkers of the past, particularly with those philosophers whom he considered to have founded the phenomenological analysis of consciousness. He had a particular fascination for Kant. Not only did Mamardashvili devote to him a series of lectures, but he referenced Kantian themes throughout the entirety of his work. This article focuses on two of those themes. The first is transcendental consciousness, considered as that which makes experience possible without being itself reducible to experience. (...) Consciousness is at the basis of all the different “forms” that make possible our experience of the world. Thinking is possible only in the context of cultural tradition, which is embedded in language. The second is individual moral responsibility. Everyone everywhere takes a stance at all times, here and now, thereby assuming the whole responsibility for their action. Mamardashvili’s dialogue with Kant leads us to consider some of the ethical problems of human civilization. (shrink)

Deleuze's theory of time set out in Difference and Repetition is a complex structure of three different syntheses of time – the passive synthesis of the living present, the passive synthesis of the pure past and the static synthesis of the future. This article focuses on Deleuze's third synthesis of time, which seems to be the most obscure part of his tripartite theory, as Deleuze mixes different theoretical concepts drawn from philosophy, Greek drama theory and mathematics. Of central importance is (...) the notion of the cut, which is constitutive of the third synthesis of time defined as an a priori ordered temporal series separated unequally into a before and an after. This article argues that Deleuze develops his ordinal definition of time with recourse to Kant's definition of time as pure and empty form, Hölderlin's notion of ‘caesura’ drawn from his ‘Remarks on Oedipus’ (1803) and Dedekind's method of cuts as developed in his pioneering essay ‘Continuity and Irrational Numbers’ (1872). Deleuze then ties together the conceptions of the Kantian empty form of time and the Nietzschean eternal return, both of which are essentially related to a fractured I or dissolved self. This article aims to assemble the different heterogeneous elements that Deleuze picks up on and to show how the third synthesis of time emerges from this differential multiplicity. (shrink)

This paper explores a distinctive form of social interaction—interpersonal inquiry—in which two or more people attempt to understand one another by engaging in conversation. Like many modes of inquiry into human beings, interpersonal inquiry partly shapes its own objects. How we conduct it thus affects who we become. I present an ethical ideal of conversation to which, I argue, at least some of our interpersonal inquiry ought to aspire. I then consider how this ideal might influence philosophical conceptions of the (...) self. (shrink)

Self-referential sentences have troubled our understanding of language for centuries. The most famous self-referential sentence is probably the Liar, a sentence that says of itself that it is false. The Liar Paradox has encouraged many philosophers to establish theories of truth that manage to give a proper account of the truth predicate in a formal language. Kripke’s Fixed Point Theory from 1975 is one famous example of such a formal theory of truth that aims at giving a plausible notion of (...) truth by allowing truth value gaps. However, not only the concept of truth gives rise to paradoxes. A syntactical treatment of epistemic notions like belief and knowledge leads to contradictions that very much resemble the Liar Paradox. Therefore, it seems to be fruitful to apply the established theories of truth to epistemic concepts. In this paper, I will present one such attempt of solving the epistemic paradoxes: I adapt Kripke’s Fixed Point Theory and interpret truth, knowledge and belief within the framework of a partial logic. Thereby I find not only the fixed point of truth but also the fixed points of knowledge and belief. In this fixed point, the predicates of truth, belief and knowledge find their definite interpretation and the paradoxes are avoided. (shrink)

The coronavirus disease 2019 health crisis is strongly affecting the psychological well-being of the general population. According to a very recent literature, the imposed lockdown and social distancing measures have generated a series of negative outcomes, including fear of the future, anxiety, and somatization symptoms. Few studies have investigated the impact of the COVID-19 pandemic on the well-being of parents and children, and still fewer studies have assessed the relationship between the psychological health of parents and children. The present study (...) aimed at understanding the effect of parents’ psychological distress and verbal aggression on behavioral and emotional symptoms of children during the COVID-19 lockdown. Using an online survey administered in the first weeks of the lockdown in Italy, we explored the mediating effects of parent verbal hostility and child emotional symptoms on the relationship between parent distress and child hyperactivity/inattention in a sample of 878 Italian parents. Two hypotheses were proposed: parent distress would significantly predict child hyperactivity/inattention, and parent verbal hostility and child emotional symptoms would mediate the association between parent distress and child hyperactivity/inattention. The serial mediated model confirmed both hypotheses, suggesting that higher rates of psychological distress in parents were associated with higher levels of hyperactivity/inattention in children. Parent verbal hostility and child emotional problems were also found to positively mediate this relation. Our results may be used to improve sociopsychological interventions in the general population in the near future. They may also contribute to the clinical definition of therapeutic paths for parents and families. (shrink)

It is widely believed that we ought not to criticize others for wrongs that we ourselves have committed. The author draws out and challenges some of the background assumptions about the practice of criticism that underlie our attraction to this claim, such as the tendency to think of criticism either as a social sanction or as a didactic intervention. The author goes on to offer a taxonomy of cases in which the moral legitimacy of criticism is challenged on the grounds (...) that the critic him- or herself engages in the behavior that he or she criticizes in others. The author argues that, in each type of case, the would-be critics should not constrain their participation in moral discourse on the grounds that they are not themselves innocent of the wrongdoing they criticize in others.
