Carl Gustav Carus nasceu, em 3 de janeiro de 1789, na cidade de Leipzig. Seupai, August Gottlob Carus, veio de uma família de comerciantes dedicada àtinturaria. Para receber uma melhor educação, o pai de Carus decidiu enviá-lo à casados avós maternos. Ali, ele receberia, até os 12 anos de idade, aulas domiciliares, bemcomo passou a admirar o seu tio, Daniel Jäger, naturalista que havia estudadoquímica na França durante o efervescente período da Revolução Francesa. A paixãopela química e ciências humanas foi (...) o legado do tio. Em suas memórias -Lebenserinnerungen und Denkwürdigkeiten -, publicadas em 1865, Carus relembra dostempos felizes da infância em Leipzig, onde mantinha seus olhos atentos aocotidiano da cidade, à igreja gótica local, ao mercado medieval, aos jardins e aotribunal. Book reviewed in this article: The Abuse of Casuistry: A History of Moral Reasoning. By Albert R. Jonsen and Stephen Toulmin.

I begin this commentary with an expanded typology of theories that endorse an internal morality of medicine. I then subject these theories to a philosophical critique. I argue that the more robust claims for an internal morality fail to establish a stand-alone method for bioethics because they ignore crucial non-medical values, violate norms of justice and fail to establish the normativity of medical values. I then argue that weaker versions of internalism avoid such problems, but at the cost of failing (...) to provide a clear sense in which their moral norms are internal or can ground a comprehensive approach to moral problems. Finally, I explore various functions that an internal morality might serve, concluding with the observation that, while there may be a core of good sense to the notion of an internal morality of medicine, our expectations for it must be drastically lowered. This article begins with some preliminary remarks about the general features and basic varieties of reflective equilibrium in moral reflection. It then considers a couple of preliminary doubts about this method. One of these doubts claims that the most plausible interpretation of RE is so comprehensive that it risks paralyzing our thinking, while the other claims that this same version of RE is insufficiently determinate in practical contexts and will thus fail to be sufficiently action-guiding. The article then explicates the (...) sense in which RE qualifies as a coherence theory of justification, and considers several objections to RE that flow from its reliance on the putative connection between coherence and moral justification. The number of available legal documents has presented an enormous growth in recent years, and the digital processing of such materials is prompting the necessity of systems that support the automatic relevant information extraction. This work presents a system for ontology-based information extraction from natural language texts, able to identify a set of legal events. The system is based on an innovative methodology based on domain ontology of legal events and a set of linguistic rules, integrated through inference mechanism, resulting (...) in a flexible approach and scalable approach. A case study with the use of documents from the Superior Court in Brazil is related, with satisfactory results in precision and recall. (shrink)

In this commentary, I critically discuss the respective views of Gert and Beauchamp–Childress on the nature of so-called common morality and its promise for enriching ethical reflection within the field of bioethics. Although I endorse Beauchamp and Childress’ shift from an emphasis on ethical theory as the source of moral norms to an emphasis on common morality, I question whether rouging up common morality to make it look like some sort of ultimate and universal foundation for morality, untouched by the (...) dialectics of time and reflective equilibrium, was an equally good move. As for Gert’s magisterial conception of common morality, I conclude that certain elements of his system are controversial at best and woefully inadequate at worst. He has a tendency to find in common morality what he himself put there, and his highly restricted conception of duties of assistance strikes this reader as ad hoc, inadequately defended, and unworthy of a project whose goal is to lessen the amount of misery in the world. Neste artigo, o foco será a relação entre a filosofia de Hegel e o gênero do Western, além da introdução aos princípios gerais sobre o fenômeno da modernidade e seus três estratos: o clássico, o agonal e o híbrido.

Resumo: O artigo aborda o tema “Revolução”, analisado por Holanda em Raízes do Brasil. A leitura foi mediada pela filosofia de Nietzsche, onde exploramos as noções de má consciência, ideal ascético e as críticas à modernidade. Além de duas referências explícitas ao filósofo, as abrangentes noções nietzschianas subsidiam as avaliações de Holanda sobre os “novos tempos” no Brasil. No entanto, a crítica do brasileiro foi direcionada àquelas “superfetações liberais”, dado o seu caráter exógeno às tradições brasileiras. Em contrapartida, considerou positivos (...) os valores do personalismo, subjacentes ao nosso modo de vida, favoráveis à criação de forma política concernente à sociedade.: The article presents an approach to the theme “Revolução”, debated by Holanda on his book “Raízes do Brasil”. The analysis was based on Nietzsche’s philosophy, by exploring concepts concerning bad consciousness, ascetic ideal and criticism of the modernity. Besides two explicit references to the philosopher, the embracing Nietzschian notions support Holanda’s assessment of the “new times” in Brazil. Nonetheless, the Brazilian’s criticism was targeted at those “liberal superfetation”, owing to its exogenous feature to the Brazilian traditions. In contrast, he considered positively the values of personalism, implicit in our way of life, favorable to the invention of a politic shape as far as the society is concerned. (shrink)

This article examines the emergence of casuistical case analysis as a methodological alternative to more theory-driven approaches in bioethics research and education. Focusing on The Abuse of Casuistry by A. Jonsen and S. Toulmin, the article articulates the most characteristic features of this modernday casuistry (e.g., the priority allotted to case interpretation and analogical reasoning over abstract theory, the resemblance of casuistry to common law traditions, the ‘open texture’ of its principles, etc.) and discusses some problems with casuistry as an (...) ‘anti-theoretical’ method. It is argued that casuistry so defined is ‘theory modest’ rather than ‘theory free’ and that ethical theory can still play a significant role in casuistical analysis; that casuistical analyses will encounter conflicting ‘deep’ interpretations of our social practices and institutions, and are therefore unlikely sources of increased social consensus on controversial bioethical questions; that its conventionalism raises questions about casuistry's ability to criticize norms embedded in the societal consensus; and that casuistry's emphasis upon analogical reasoning may tend to reinforce the individualistic nature of much bioethical writing. It is concluded that, notwithstanding these problems, casuistry represents a promising alternative to the regnant model of ‘applied ethics’ (i.e., to the ritualistic invocation of the so-called ‘principles of bioethics’). The pedagogical implications of casuistry are addressed throughout the paper and include the following recommendations: (1) use real cases, (2) make them long, richly detailed and comprehensive, (3) present complex sequences of cases, (4) stress the problem of ‘moral diagnosis’, and (5) be ever mindful of the limits of casuistical analysis. It has often been remarked that bioethics is a quintessentially American phenomenon. Broadly speaking, bioethics as a field has tended to enshrine the value of autonomy, it places individual rights above communal well-being, and it has adopted a largely permissive and optimistic view of emerging biotechnologies. In contrast to much European thinking at the intersection of ethics and medicine, American-style bioethics has been resolutely middlebrow, eschewing grand philosophical schemes in favor of pragmatic policy-making and democratic consensus. It was, then, perhaps (...) only a matter of time before various theorists began proposing a marriage between bioethics and pragmatism, which is the homegrown American philosophy. (shrink)

Resumo: Neste artigo, a partir de pesquisa teórica, objetiva-se refletir sobre os sentidos do conceito de autonomia da universidade moderna e algumas das suas importantes limitações epistemológicas, políticas e curriculares. Para isso, buscou-se dados nas fontes bibliográficas citadas e referenciadas no texto, de modo especial no pensamento de Bacon, Kant e Descartes. A metodologia adotada consistiu na leitura, análise, comentário e crítica dos textos selecionados, tomando-se cada um enquanto unidade de sentido, mas também confrontando e problematizando os enunciados e teses (...) diversas numa tentativa de “desconstrução” e “ampliação” de significados. Nesse exercício de reflexão, compreendeu-se que os diversos sentidos de autonomia são símbolos privilegiados da atividade universitária desde a sua origem até os dias atuais, atravessando o debate entre liberalismo e marxismo, característico da modernidade. Verificou-se que há possibilidades e limites contextuais para o exercício da autonomia e que o jogo entre ser e dever-ser da universidade atravessa diversos discursos e tempos, reunindo em torno de si uma complexa e contraditória rede de compreensões em torno deste conceito. Palavras-chave: Autonomia; Universidade; Modernidade Autonomy as a regulatory ideal of the Modern University: meanings and limits Abstract: This article, based on theoretical research, aims to reflect on the meanings of the concept of autonomy in the modern university and some of its important epistemological, political and curricular limitations. For this, information was sought in the bibliographic sources cited and referenced in the text, especially in the thinking of Bacon, Kant and Descartes. The methodology consisted of reading, analyzing, commenting and criticizing the selected texts, taking each one as a unit of meaning, but also confronting and problematizing the different statements and ideas in an attempt to “deconstruct” and “enlarge” meanings. In this exercise of reflection, it was understood that the various senses of autonomy are privileged symbols of university activity from its origins to the present, crossing the debate between liberalism and marxism, characteristic of modernity. It was found that there are possibilities and contextual limits for the exercise of autonomy and that the game between being and being-ought of the university crosses different discourses and times, gathering around itself a complex and contradictory network of comprehensions around this concept. La autonomía como ideal regulador de la Universidad Moderna: significados y límites Resumen: Este artículo, basado en investigación teórica, tiene como objetivo reflexionar sobre los significados del concepto de autonomía en la universidad moderna y algunas de sus importantes limitaciones epistemológicas, políticas y curriculares. Para ello se buscó información en las fuentes bibliográficas que se citan y referencian en el texto, especialmente en el pensamiento de Bacon, Kant y Descartes. La metodología adoptada consistió en leer, analizar, comentar y criticar los textos seleccionados, tomando cada uno como unidad de sentido, pero también confrontando y problematizando los diferentes enunciados y tesis en un intento de “deconstruir” y “ampliar” los significados. En este ejercicio de reflexión, se entendió que los diversos sentidos de autonomía son símbolos privilegiados de la actividad universitaria desde sus orígenes hasta la actualidad, atravesando el debate entre el liberalismo y el marxismo, característico de la modernidad. Buscamos nas referências ao pensamento do filósofo dinarmaquês explícitas em seus escritos, mapear citações e indicações, além da resenha que Benjamin escreveu sobre a obra Kierkegaard de Adorno. Levou-se em consideração comentários de alguns intérpretes de Kierkegaard e de Benjamin que se ocuparam da aproximação entre os dois filósofos. Desta apresentação, indicamos um vínculo teórico de virtual importância, presente na obra de Benjamin sobre o drama barroco (...) alemão. (shrink)

There are many good reasons for a merger between bioethics and human rights. First, though, significant philosophical groundwork must be done to clarify what a human right to health would be and—if we accept that it exists—exactly how it might influence the practical decisions we face about who gets what in very different contexts.

This paper represents the first installment of alarger project devoted to the relevance of pragmatism forbioethics. One self-consciously pragmatist move would be toreturn to the classical pragmatist canon of Peirce, James andDewey in search of substantive doctrines or methodologicalapproaches that might be applied to current bioethicalcontroversies. Another pragmatist (or neopragmatist) move wouldbe to subject the regnant principlist paradigm to Richard Rorty'ssubversive assaults on foundationalism in epistemology andethics. A third pragmatist method, dubbed ``freestandingpragmatism'' by its proponents, embraces a ``pragmatist'' approachto practical (...) reasoning without discernable moorings either to theclassical canon or to Rorty's neopragmatism. This thirdpragmatist approach to method in practical ethics is the subjectof this article. I begin with an examination of freestandingpragmatism in the theory of judicial decision making. I arguethat this version of legal pragmatism – so described on account ofits commitments to contextualism, instrumentalism, eclecticism,and freedom from grand theory – bears a striking resemblance tomuch self-described pragmatist work in bioethics today. Ifurther argue that if this is what we mean by ``pragmatism,'' thenin a certain sense ``we are all pragmatists now.''. (shrink)

Apesar do crescente interesse despertado pela figura de Christian Wolff nas últimas décadas, a compreensão de seu pensamento ainda enfrenta obstáculos e desafios. De um lado, na história da filosofia, não é raro encontrarmos um Wolff compreendido a partir de Kant. De outro, na história da psicologia, pode-se falar de uma estranha negligência do papel exercido por Wolff no desenvolvimento de uma ciência psicológica autônoma, especialmente na tradição alemã, que vai culminar na separação radical entre filosofia e psicologia a partir (...) do século XX. O objetivo deste artigo é situar historicamente o projeto wolffiano de uma ciência da alma, mostrando não só o seu sentido específico, mas também suas principais contribuições e algumas de suas consequências para o posterior desenvolvimento da psicologia alemã nos séculos XVIII e XIX. As pessoas com deficiência, nessas circunstâncias, são sujeitadas a maior vulnerabilidade do que ocorreria em circunstâncias normais. À luz dessa realidade, nos propomos a apresentar alguns critérios de alocação de recursos empregados durante a crise, destacando seu caráter nocivo para às pessoas com deficiência, e analisar de que forma o princípio da não-discriminação pode, se tomado como referência, contribuir para a reflexão ética e política (...) sobre os protocolos de racionamento.
