This article responds to Gavan Duffy's critique of AnalogiesatWar in his recent essay on the agent-structure debate in the JJPS (2001, 2: 161giving structure its duestructure” with process, perceptual, and personality variables; (3) misinterprets my assumptions while neglecting the findings of recent works that corroborate the findings of AnalogiesatWar; and (4) fails to demonstrate one of his key suggestions, i.e. the importance of showing how agents and structures are mutually constitutive. Incidents of racism against Asians have been rising since the COVID-19 pandemic turned global in early 2020. Employing Foucault’s concept of panopticism and Kathryn Lofton’s insights on the function of religion to demarcate group boundaries, this article argues that American religion constructs Asian American stereotypes to limit the discursive space within which Asian Americans may negotiate their identities. These discursive limitations have, in turn, buttressed white supremacy. This article examines how some Asians and Asian Americans respond to anti-Asian sentiments during (...) the pandemic by performing a close reading of an op-ed by prominent Asian American politician Andrew Yang in The Washington Post. This reading reveals that Yang’s colorblind solution upholds whiteness as the American gnosis and limits the discursive space in which Asian Americans may negotiate their identities. This article also discusses how the myth of America as a white Christian country withstands challenges from minority groups contesting its dominance. (shrink)

How is the sense (knowledge and feelings) of community produced? What roles do various units of society play in producing such knowledge and feelings? What are the values of the ethic engendered by such knowledge and feelings? I suggest that a communitarian theory indigenous to African culture enables us to respond to these questions. Against the objections of those who advocate an ideology of modern democratic liberalism, I argue that the values of individual worth and freedom are indeed compatible with (...) those of communitarianism. Further, while I agree that communities are natural orders into which individuals are born, I deny any ontological determinism that would seek to restrict such orders in terms of ethnicity or race. Rather, communities also need to be understood as products of deliberate human organization and choices. (shrink)

We praise Arbib et al.'s Neural organization for its support of the integration of different levels of analysis, while noting that it does not always achieve what it advocates. We extend this approach into an area of neuropsychological activity in need of the structure offered by Organization at the intersection of the conflated fields of executive function and frontal lobe function.

Revisiting African philosophy’s classic questions, D. A. Masolo advances understandings of what it means to be human—whether of African or other origin. Masolo reframes indigenous knowledge as diversity: How are we to understand the place and structure of consciousness? How does the everyday color the world we know? Where are the boundaries between self and other, universal and particular, and individual and community? From here, he takes a dramatic turn toward Africa’s current political situation and considers why individual rights and (...) freedoms have not been recognized, respected, demanded, or enforced. Masolo offers solutions for containing socially destructive conduct and antisocial tendencies by engaging community. The following article is a response to the position paper of the Hastings Center, “Ethical Challenges of Chronic Illness”, a product of their three year project on Ethics and Chronic Care. The authors of this paper, three prominent bioethicists, Daniel Callahan, Arthur Caplan, and Bruce Jennings, argue that there should be a different ethic for acute and chronic care. In pressing this distinction they provide philosophical grounds for limiting medical care for the elderly and chronically ill. We give a critical (...) survey of their position and reject it as well as any attempt to characterize the physician-patient relationship as a commercial contract. We emphasize, as central features of good medical practice, a commitment to be the patient's agent and a determination to acquire and be guided by knowledge. These commitments may sometimes conflict with efforts to have the physician serve as an instrument of social and economic policies limiting medical care. (shrink)

Objections to the use of assistive technologies in elite sports are generally raised when the technology in question is perceived to afford the user a potentially “unfair advantage,” when it is perceived as a threat to the purity of the sport, and/or when it is perceived as a precursor to a slippery slope toward undesirable changes in the sport. These objections rely on being able to quantify standards of “normal” within a sport so that changes attributed to the use of (...) assistive technology can be judged as causing a significant deviation from some baseline standard. This holds athletes using assistive technologies accountable to standards that restrict their opportunities to achieve greatness, while athletes who do not use assistive technologies are able to push beyond the boundaries of these standards without moral scrutiny. This paper explores how constructions of fairness and “normality” impact athletes who use assistive technology to compete in a sporting venue traditionally populated with “able-bodied” competitors. It argues that the dynamic and obfuscated construction of “normal” standards in elite sports should move away from using body performance as the measuring stick of “normal,” toward alternate forms of constructing norms such as defining, quantifying, and regulating the mechanical actions that constitute the critical components of a sport. Though framed within the context of elite sports, this paper can be interpreted more broadly to consider problems with defining “normal” bodies in a society in which technologies are constantly changing our abilities and expectations of what normal means. Kant's answer to Hume is seen to comprise the following: agreement with Hume that causal connection cannot be inferred from experience; moving beyond Hume in making causal conceptions presuppositions of experience ; distinguishing causality from other, more basic presuppositions of experience . Not only is causality a Verknuepfung, rather than a Bedingung, thereby relegating it to a lower level of generality, but its presence in the table of categories simply signifies the possibility of its application at any time, not the (...) necessity for a universally valid interpretation of temporal succession as given in the manifold, a specification that is only introduced after the schematism, in the Analogies of experience. Furthermore, unlike e.g. the transcendental unity of apperception, cause involves regulative, not constitutive principles. Failure to recognize all of this has created unnecessary controversy concerning the relative merits of Kant's response to the problem of justifying induction. (shrink)

Health care workers with needlestick exposures to patients' blood often request a test of the patient for evidence of infection with human immunodeficiency virus. If the patient refuses the test, a conflict develops between the interests of the health care worker and those of the patient. Traditional approaches to this dilemma attempt to balance the rights or utilities of abstract patients and health care workers. While these approaches have the advantage of offering clear guidelines in advance of conflict, the interests (...) of the actual participants may differ from those used to create the guidelines. In nonmedical settings, conflicts are often resolved efficiently through negotiation and monetary exchanges. Although negotiated monetary settlements between health care workers and patients may be an impractical way to resolve medical conflicts, models developed from these perspectives provide insights into the individual interests of physicians and patients. Changing existing rules about medical record documentation, or increasing the penalties for the misuse of medical information, may satisfy the interests on both sides of the conflict and so represent integrative bargaining solutions. Even so, as the relationship between health care workers and their patients evolves, more explicit strategies for negotiation may become a reasonable solution to the problem of conflict. (shrink)

Between 1234 and 1258 King Henry III, having emerged from the tutelage of ministers inherited from his father, controlled the government of England himself. Looking at this period of personal rule, it would be easy to gain the impression that Henry's kingship, in its theory, and also to some extent its practice, challenged the position of the magnates. M. T. Clanchy, for example, in a justly famous article has suggested that in the 1240s and 1250s Henry III evolved a theory (...) of royal absolutism, a theory which had threatening implications for the magnates. He has also stressed the extent to which Henry was “the initiator both of the methods and of the theory” behind Edward I's quo warranto campaign, which questioned the liberties possessed by the magnates in the field of local government. As for Henry's court, the impression has been given by R. F. Treharne that few English barons were present there, and that the king was largely surrounded by officials and foreign relatives — the latter being his wife's Savoyard uncles and his own Poitevin half-brothers of the house of Lusignan. G. W. S. Barrow has written that Henry “appeared to be excluding the barons as a class from membership of his royal council.” The question whether Henry, like his father John, was pressing magnates to pay their debts has never been investigated; but Matthew Paris's picture of the king as a “vigilant and indefatigable searcher after money” might indicate that the revolution of 1258, like that of 1215, was a “rebellion of the king's debtors.”.
