ABSTRACTThis article studies multi-stakeholder initiatives as spaces for both deliberation and contestation between constituencies with competing discourses and disputed values, beliefs, and preferences. We review different theoretical perspectives on MSIs, which see them mainly as spaces to find solutions to market problems, as spaces of conflict and bargaining, or as spaces of consensus. In contrast, we build on a contestatory deliberative perspective, which gives equal value to both contestation and consensus. We identify four types of internal contestation which can be (...) present in MSIs—procedural, inclusiveness, epistemic, and ultimate-goal—and argue that embracing contestation and engaging in ongoing revision of provisional agreements, criteria, and goals can enhance the democratic quality of MSIs. Finally, we explore the implications of this perspective for theorizing about the democratic quality in MSIs and about the role of corporations in transnational governance. (shrink)

In this groundbreaking work, Christa Davis Acampora offers a profound rethinking of Friedrich Nietzsche’s crucial notion of the agon. Analyzing an impressive array of primary and secondary sources and synthesizing decades of Nietzsche scholarship, she shows how the agon, or contest, organized core areas of Nietzsche’s philosophy, providing a new appreciation of the subtleties of his notorious views about power. By focusing so intensely on this particular guiding interest, she offers an exciting, original vantage from which to view this (...) iconic thinker: Contesting Nietzsche. Though existence—viewed through the lens of Nietzsche’s agon—is fraught with struggle, Acampora illuminates what Nietzsche recognized as the agon’s generative benefits. It imbues the human experience with significance, meaning, and value. Analyzing Nietzsche’s elaborations of agonism—his remarks on types of contests, qualities of contestants, and the conditions in which either may thrive or deteriorate—she demonstrates how much the agon shaped his philosophical projects and critical assessments of others. The agon led him from one set of concerns to the next, from aesthetics to metaphysics to ethics to psychology, via Homer, Socrates, Saint Paul, and Wagner. In showing how one obsession catalyzed so many diverse interests, Contesting Nietzsche sheds fundamentally new light on some of this philosopher’s most difficult and paradoxical ideas. (shrink)

The dam rush in the upper-Brahmaputra River basin and local, minority resistance to it are the result of complex geopolitical and parochial causes. India and China’s competing claims for sovereignty over the watershed depend upon British and Qing Dynasty imperial precedents respectively. And the two nation-states have extended and enhanced their predecessors’ claims on the area by continuing to erase local sovereignty, enclose the commons, and extract natural resources on a large scale. Historically, the upper basin’s terrain forestalled the thorough (...) integration of this region into both nation-states, but recent technological and economic advances have enabled the two states and their agents to dramatically transformed these landscapes. Many of their projects have perpetuated the interventionist hydrological regimes that India and China also inherited from their imperial forebears. Nevertheless, as with their definition of their borders, neither state has highlighted this historical contingency. Instead, both governments have consistently presented their hydropower projects as shining examples of necessary and benevolent development. Their economy-focused, monolithic development paradigms have, not coincidently, also enabled the systemic side-lining of non-majority cultures, religions and histories. The combination of this cultural exclusion and the nation-states’ late integration of this peripheral region has laid the ground for conflict with local groups over the dam rush. Local identities and experiences have evolved around complex religious, cultural and trade networks, many of which were heavily influenced by the now-defunct Tibetan polity, rather than via modern Chinese and Indian nationalist discourses of development. The dam clashes highlight both the basin’s complex cultural matrixes and the ambiguous relationship Asia’s two most populous nation-states have with their respective imperial pasts. And as the situation remains unresolved, the watershed is an ecological catastrophe in waiting. (shrink)

The normativity in understanding the hadiths of male physical appearances, such as lengthening the beard, isbal prohibition, and wearing a robe, was still debated by Muslims. This issue was evident, especially in Islamic communities with strong progressive and conservative characters at the same time, like Muhammadiyah. This paper aimed to elucidate the existence of contestation among Muhammadiyah members in understanding and practicing traditions regarding physical appearance. This paper discussed three subjects: first, contestation in the hadith of maintaining a beard; second, (...) the hadith of isbal prohibition; and third, contestation of understanding the hadith of a robe. By using a qualitative descriptive method, it was found that: first, four views of Muhammadiyah members regarding the hadith of keeping a beard: mandatory, Sunnah, ittibâ' to the Prophet, and permissible; second, four views of Muhammadiyah members regarding the hadith of isbal prohibition: haram, makruh, permissible and haram only when worshiping; third, two views of Muhammadiyah members about wearing a robe, having virtue and no virtue. This polarization was influenced by the environmental situation, recitation circles, and book readings. The contestation among Muhammadiyah occurred between progressive groups driven by Muhammadiyah activists and conservative groups driven by Salafists. The infiltration of conservative Salafist forces in Muhammadiyah needs more serious attention from its leaders to immediately address this issue to maintain a moderate Islamic character of Muhammadiyah. Contested Knowledge d is a new sociological theory text. For the undergraduate or graduate course which inspires students to think afresh about sociological theory, it will be essential reading.

An argumentative passage that might appear to be an instance of denying the antecedent will generally admit of an alternative interpretation, one on which the conditional contained by the passage is a preface to the argument rather than a premise of it. On this interpretation. which generally is a more charitable one, the conditional plays a certain dialectical role and, in some cases, a rhetorical role as welL Assuming only a very weak principle of exigetical charity, I consider what it (...) would take in a given case to justify accepting the less charitable interpretation. I then present evidence that those conditions are seldom met. Indeed, I was unable to find a single published argument that can justifiably be charged with denying the antecedent. (shrink)

Editors' introduction to a special issue of Hypatia on "Contested Terrains: Women of Color, Third World Women, Feminisms and Geopolitics.

The introduction of new energy technologies may lead to public resistance and contestation. It is often argued that this phenomenon is caused by an inadequate inclusion of relevant public values in the design of technology. In this paper we examine the applicability of the value sensitive design approach. While VSD was primarily introduced for incorporating values in technological design, our focus in this paper is expanded towards the design of the institutions surrounding these technologies, as well as the design of (...) stakeholder participation. One important methodological challenge of VSD is to identify the relevant values related to new technological developments. In this paper, we argue that the public debate can form a rich source from which to retrieve the values at stake. To demonstrate this, we have examined the arguments used in the public debate regarding the exploration and exploitation of shale gas in the Netherlands. We identified two important sets of the underlying values, namely substantive and procedural values. This paper concludes with two key findings. Firstly, contrary to what is often suggested in the literature, both proponents and opponents seem to endorse the same values. Secondly, contestation seems to arise in the precise operationalization of these values among the different stakeholders. In other words, contestation in the Dutch shale gas debate does not arise from inter-value conflict but rather from intra-value conflicts. This multi-interpretability should be incorporated in VSD processes. (shrink)

Two major developments of the last two decades have radically undermined traditional justifications of leftist politics: the failure of 20th-century `socialist' experiments, and what might be termed the deessentializing movement in contemporary philosophy. However, the social injustices that animated revolutionary thinkers in many respects remain, and some have arguably worsened in the era of globalized capitalism. This article investigates whether it is possible to articulate a new theoretical underpinning for progressive politics that nevertheless avoids the essentialist moves of Marxism. Ethico-political (...) readings of Derrida — one of the most influential anti-essentialist thinkers — are compared to Ernesto Laclau's attempts at formulating a post-Marxist progressive politics built around the notions of `hegemony' and `radical democracy'. Laclau's intervention in the Marxist tradition is to deconstruct its traditional categories so as to take account of contingency; his intervention in deconstruction is to introduce what in this article is described as `contestation', so as to provide a more coherent account of the political. The article concludes that neither deconstruction nor radical democracy provides an adequate basis for poltical action, but that the latter's account of the political is a meaningful development of the theoretical schema articulated by the former and does point to the possibility of a non-essentialist progressive politics. ABSTRACT:This article provides a normative justification for unions. It discusses three arguments. The argument from consent justifies unions in some circumstances, but if the employer prefers to not bargain with unions, it may provide very little justification. The argument from contestability takes as its starting point the fact that employment contracts are incomplete contracts, where authority takes the place of complete contractual terms. This theory of contracts implies that consent to authority has been given under ignorance, and, therefore, that authority (...) cannot be justified by consent. Contestability is a mechanism that can handle this problem for consent theory. It demands transparency, channels for voice, and a forum where contestations can be evaluated. This idea can be implemented in firms in different ways, but the argument from the separation of powers implies that unions are uniquely suited to implement contestability, since they are organized outside of the employer’s domain of authority. : This essay examines the increasing commodification of the body with respect to tissues, gametes, and embryos. Such commodification contributes to a diminishing sense of human personhood on an individual level, even as it erodes commitments to human flourishing at the societal level. After the case for social harm resulting from the increasing commodification of the body is made, the question becomes whether that harm is best remedied by following any of three approaches by which government traditionally seeks to promote (...) the flourishing of its citizens. The author concludes that it is not, and that what is needed is a pragmatic and somewhat casuistic approach to the regulation of contested commodities--that which legal scholar Margaret Jane Radin calls "incomplete commodification.". A significant part of contemporary social ontology has been focused on understanding forms of collective intentionality. It is suggested in this paper that the contested nature of some institutional matters makes this kind of approach problematic, and instead an alternative approach is developed, one that is oriented towards a micro-level analysis of the institutional constraints that we face in everyday life and which can make sense of how there can be institutional facts that are deeply contested and yet still real. In recent discussions on the meaning of derogatory terms, most theorists base their investigations on the assumption that slurring terms could in principle have some neutral, i.e. purely descriptive, counterpart. Lauren Ashwell has recently shown that this assumption does not generalize to gendered slurs. This paper aims to challenge the point and benefit of approaching the meaning of derogatory terms in contrast to their allegedly purely descriptive counterparts. I argue that different discursive practices among different communities of practice sometimes change (...) the semantics of a term. By the example of the term ‘black,’ I show in what ways these different practices may amount to semantic contestations which complicate the assessment of whether a specific politically significant term is purely descriptive. My discussion of politically significant terms provides insights into further phenomena such as the appropriation of derogatory terms by the target group or meaning change more generally. Moreover, it not only accounts for the political aspects of a linguistic phenomenon, but equally highlights and explains the oft-neglected but crucial role that language plays in social and political struggles. It thus contributes to ongoing discussions both in philosophy of language and in social and political philosophy. (shrink)

Patients who are imminently dying sometimes experience symptoms refractory to traditional palliative interventions, and in rare cases, continuous sedation is offered. Samuel H. LiPuma, in a recent article in this Journal, argues that continuous sedation until death is equivalent to physician-assisted suicide/euthanasia based on a higher brain neocortical definition of death. We contest his position that continuous sedation involves killing and offer four objections to the equivalency thesis. First, sedation practices are proportional in a way that physician-assisted suicide/euthanasia is (...) not. Second, continuous sedation may not entirely abolish consciousness. Third, LiPuma’s particular version of higher brain neocortical death relies on an implausibly weak construal of irreversibility—a position that is especially problematic in the case of continuous sedation. Finally, we explain why continuous sedation until death is not functionally equivalent to neocortical death and, hence, physician-assisted suicide/euthanasia. Concluding remarks review the differences between these two end-of-life practices. (shrink)

This article contributes to ongoing studies in conversation analysis dealing with the way in which epistemic authority is displayed, claimed, contested and negotiated in social interaction. More particularly, it focuses on the articulation between action format, sequential organization, membership categorization and epistemic authority. The article offers an empirical analysis of the way in which knowledge is distributed and recognized in social gatherings, with a special focus on guided visits. Guided visits are a perspicuous setting for this analysis, since it is (...) an activity in which the guide displays knowledge in comments and explanations and the guided seeks for knowledge in questions. However, this distribution of knowledge is regularly challenged. The article offers a systematic study of a collection of sequences initiated by turns beginning with ‘et là’ and locating a new referent in the environment, either in informings or in questions. While the former are frequently produced by the guide, assuming a knowing status, and the latter by the guided, assuming a not knowing, it is possible to observe informings initiated by the guided, who, by so doing, claims a revision of his or her epistemic authority. Likewise, in second position, questions are generally answered by the guide, but can also be answered by another person, claiming alternative epistemic rights. By examining the details of turn and action design in these environments, the article shows how they either reproduce and confirm the current epistemic status of the participants or challenge, negotiate and transform them. The latter case is particularly revealing of the fact that epistemic status and stance are constantly reflexively elaborated by the participants in social interaction. (shrink)

Did Alcidamas invent the story of the contest of Homer and Hesiod? Martin West has argued that he did , 433 ff.). I believe that there are a number of reasons for thinking this improbable. The stories of the deaths of Homer and Hesiod were traditional before Alcidamas. Heraclitus knew the legend of the riddle of the lice and Homer's death , and the story of Hesiod's death was well known by Thucydides’ time . The first attempt to record (...) information about Homer's life is ascribed to Theagenes of Rhegium, in the late sixth century b.c. . By that time it seems likely that there was already a considerable body of legends about the early poets. The pieces of hexameter verse in the Herodotean Life of Homer, some of which show detailed knowledge of the area around Smyrna in the archaic period, probably date from before 500 b.c. In relating the stories of the poets’ deaths Alcidamas is recording the results of στορα, and this is what he implies in Michigan papyrus 2754 . West's theory requires one to assume that he has incorporated with these traditions his own fiction of the contest. This seems to me to go against what we know in general about the activity of sophists such as Alcidamas. Although they were capable of inventing myths , there is no evidence that they created such stories about earlier historical figures, rather than collecting popular legends about them, and using these for their own purposes. It is true that Critias used the evidence of Archilochus’ own poetry to draw conclusions about his life . But this is not the same as inventing a story virtually from scratch. Hesiod's own testimony about his poetic victory , the original starting-point for the legend of the contest with Homer, did not on its own provide a basis from which such inferences could be drawn. It seems more likely that the legend is the product of earlier popular embroidery, at a time when speculation about these early poets’ lives was becoming common. (shrink)

In 1956, W.B. Gallie introduced his idea of essentially contested concepts. In my paper, I offer a novel interpretation of his theory and argue that his theory, thus interpreted, is correct. The key to my interpretation lies in a condition Gallie places on essentially contested concepts that other interpreters downplay or dismiss: that the use of an essentially contested concept must be derived “from an original exemplar whose authority is acknowledged by all the contestant users of the concept.” This reveals (...) a similarity between Gallie’s views and the semantic externalist views of Hilary Putnam, and others, about natural kind terms like “water” and “tiger.” I argue that natural kind terms and terms for essentially contested concepts are two species of a single semantic genus. In the case of natural kind terms, a term refers to a natural kind, the exemplars are instances of that kind, and the relation between the exemplars and anything to which the term applies is co-membership of the kind. In the case of terms for essentially contested concepts, a term refers to an historical tradition, the exemplar is a stage or temporal part of that tradition, and the relation between the exemplar and anything to which the term refers is being the heir of. This allows me to understand the contests that alerted Gallie to the phenomenon of essentially contested concepts as contests over the ownership of historical traditions. (shrink)

Contested Borders broadens understandings of dissident sexualities in Africa through focusing specifically on the Maghreb. It examines new representations of same-sex desire emerging in new francophone life writing, memoir, and literature from Algeria, Morocco, and Tunisia.

Radical ecology typically brings to mind media images of ecological activists standing before loggers' saws, staging anti-nuclear marches, and confronting polluters on the high seas. Yet for more than twenty years, the activities of organizations such as the Greens and Earth First! have been influenced by a diverse, less-publicized group of radical ecological philosophers. It is their work—the philosophical underpinnings of the radical ecological movement—that is the subject of _Contesting Earth's Future_. The book offers a much-needed, balanced appraisal of radical (...) ecology's principles, goals, and limitations. Michael Zimmerman critically examines the movement's three major branches—deep ecology, social ecology, and ecofeminism. He also situates radical ecology within the complex cultural and political terrain of the late twentieth century, showing its relation to Martin Heidegger's anti-technological thought, 1960s counterculturalism, and contemporary theories of poststructuralism and postmodernity. An early and influential ecological thinker, Zimmerman is uniquely qualified to provide a broad overview of radical environmentalism and delineate its various schools of thought. He clearly describes their defining arguments and internecine disputes, among them the charge that deep ecology is an anti-modern, proto-fascist ideology. Cities today are dynamic urban ecosystems with evolving physical, socio-cultural, and technological infrastructures. Many contestations arise from the effects of inequitable access and intersecting crises currently faced by cities, which may be amplified by the algorithmic and data-centric infrastructures being introduced in urban contexts. In this article, I argue for a critical lens into how inter-related urban technologies, big data and policies, constituted as Urban AI, offer both challenges and opportunities. I examine scenarios of contestations in _urban mobility_, defined broadly (...) to include equitable access, movement, and liberty to engage with the socio-cultural, political, and urban fabric of cities. I anchor my arguments through a framework of _rights, risks,_ and _responsibilities_ for critically examining and configuring the roles, values and ethical implications for all stakeholders including human, AI and non-human entities within an urban ecosystem. As a way forward, I examine the European Commission’s proposed regulations on AI systems through an illustrative case study of an automated parking control system introduced by the City of Amsterdam. In moving beyond the city to broader urban ecosystems, I highlight the role of engaging Indigenous perspectives for designing and reconciling the implications of equitable and sustainable Urban AI ecosystems in the future. Contesting Carceral Logic provides an innovative and cutting-edge analysis of how carceral logic is embedded within contemporary society, emphasizing international perspectives, the harms and critiques of using carceral logic to respond to human wrongdoing, and exploring penal abolition thought. With chapters from scholars across many disciplines, people in prison, as well as penal abolition activists, the book explores what a future without carceral logic would look like, as well as how such a future is to be developed. The book is (...) also an exploration of penal abolition thought as it is developing in the twenty-first century. Diverse geographical, cultural, identity and experiential frames inform the book's themes of analysing carceral logic as it harms disparate people in disparate places, creating anti-carceral knowledge, exploring case studies pointing to radical alternatives, and to contesting carceral logic from below. Ultimately, Contesting Carceral Logic provides the reader with an alternative and critical perspective from which to reflect on carceral logic, the punitive state and the criminalizing systems that almost exclusively dominate across the world. Finally, it raises the questions of how we are to build communities as well as transform our response to human wrongdoing in ways that are not defined by racism/ethnocentrism, class war and heteropatriarchy. Contesting Carceral Logic will be of great interest to not only scholars and activists, but also provides an introduction to key carceral issues and debates for students of penology, criminology, social policy, geography, politics, philosophy, social work and social history programmes in countries all around the world. Evaluative and normative terms and concepts are often said to be "essentially contestable". This notion has been used in political and legal theory and applied ethics to analyse disputes concerning the proper usage of terms like democracy, freedom, genocide, rape, coercion, and the rule of law. Many philosophers have also thought that essential contestability tells us something important about the evaluative in particular. Gallie (who coined the term), for instance, argues that the central structural features of essentially contestable concepts secure (...) their evaluativeness. I'll argue that these (widely held) central features are exemplified by many evaluative and non-evaluative terms alike, owing to more general factors (such as multidimensionality) which have nothing in particular to do with being evaluative. The role of these factors in semantic interpretation is subject to a certain kind of "metasemantic" disputes which have the features of the disputes characteristically admitted by essentially contestable concepts (whether evaluative or not) and which can be similarly substantive and worthwhile. In closing I'll discuss how my argument shows that our understanding of evaluative disagreement needs refinement. The overall upshot is that essential contestability shows nothing deep or distinctive about the evaluative in particular. (shrink)

Since the introduction of photography by commercial studio photographers and the colonial state in Kenya, this global medium has been intensely debated and contested among Muslims on the cosmopolitan East African coast. This book does not only explore the making, circulation, and consumption of popular photographs, but also the other side, their rejection and obliteration, an essential aspect of a medium's history that should not be neglected. It deals with various »social spaces of refusal« in the local Muslim milieu and (...) in that of »traditional« spirit mediums in which visibility was contested in various and creative ways. It focuses on the »aesthetics of withdrawal«: the various ways and techniques that process the photographic act as well as the photographic image to theatricalize the surface of the image in new ways by veiling, masking, and concealing. In a fragmented historical perspective, Heike Behrend seeks to complement, decenter, and counter the history of photography as it has been told by the West and to narrate another history beginning with preceding local media such as textiles and spirit possession. In this paper we analyse the connection between the contested ethno-cultural labelling of Gipsy-Travellers in Wales and their position of social marginalisation, with special reference to spatial issues, such as the provision of campsites and public housing. Our main aim is to show how the formal and informal (mis)labelling of minority groups leads to a number of morally and politically questionable outcomes in their treatment on the part of political authorities. Our approach combines a close reading of official policy documents, (...) government-commissioned and independent empirical research with a theoretical framework drawn mainly from contemporary political philosophy, and especially from the debate on redistribution and recognition. In recent years, artificial intelligence has been deployed by online platforms to prevent the upload of allegedly illegal content or to remove unwarranted expressions. These systems are trained to spot objectionable content and to remove it, block it, or filter it out before it is even uploaded. Artificial intelligence filters offer a robust approach to content moderation which is shaping the public sphere. This dramatic shift in norm setting and law enforcement is potentially game-changing for democracy. Artificial intelligence filters carry (...) censorial power, which could bypass traditional checks and balances secured by law. Their opaque and dynamic nature creates barriers to oversight, and conceals critical value choices and tradeoffs. Currently, we lack adequate tools to hold them accountable. This paper seeks to address this gap by introducing an adversarial procedure— – Contesting Algorithms. It proposes to deliberately introduce friction into the dominant removal systems governed by artificial intelligence. Algorithmic content moderation often seeks to optimize a single goal, such as removing copyright-infringing materials or blocking hate speech, while other values in the public interest, such as fair use or free speech, are often neglected. Contesting algorithms introduce an adversarial design which reflects conflicting values, and thereby may offer a check on dominant removal systems. Facilitating an adversarial intervention may promote democratic principles by keeping society in the loop. An adversarial public artificial intelligence system could enhance dynamic transparency, facilitate an alternative public articulation of social values using machine learning systems, and restore societal power to deliberate and determine social tradeoffs. The Global Reporting Initiative (GRI) has successfully become institutionalized as the preeminent global framework for voluntary corporate environmental and social reporting. Its success can be attributed to the “institutional entrepreneurs” who analyzed the reporting field and deployed discursive, material, and organizational strategies to change it. GRI has, however, fallen short of the aspirations of its founders to use disclosure to empower nongovernmental organizations (NGOs). The authors argue that its trajectory reflects the power relations between members of the field, their strategic (...) choices and compromises, their ability to mobilize alliances and resources, and constraints imposed by the broader institutions of financial and capital markets. The authors draw three notable implications from this study. First, institutional theory needs to pay more attention to economic structures, strategies, and resources. Second, institutional entrepreneurship by relatively weak societal groups such as NGOs is inherently constrained by the structural power of wider institutions and by the compromises required to initiate change. Third, the strategies of NGOs represent a form of power capable of shifting, if not transforming, the field of corporate governance. (shrink)

Sjoerd Griffioen investigates the polemics between Löwith, Blumenberg and Schmitt in the German secularization debate (1950’s-1980’s). ‘Secularization’ is revealed as a contested concept in ideological struggles over modernity and religion, both in this debate and contemporary postsecularism.

In this chapter, the author explains Rorty's neopragmatist feminism and some feminist criticism of his work, limiting her to questions not yet settled in the literature. She argues that Rorty can defeat the criticisms that his reformism is too conservative and that his feminism flounders without representationalist truth. "Feminism and Pragmatism" discusses the apparent paradox that injustices, on a Rortyan view, are not injustices until they are so perceived. Thus, if our society begins to accept gay marriage, passes legislation supporting (...) gay marriage, and begins criticizing those who oppose gay marriage, we have made a significant change in our practices, norms, and language. Our society still, at least at this time, thinks of "gay marriage" as a somewhat different category than "marriage," despite the fact that we treat both as marriages. We still rely on legislatures and courts to determine the legality of our marriage practices. (shrink)

In the contemporary literature of educational philosophy and theory, it is almost routinely assumed or claimed that 'education' is a 'contested' concept: that is, it is held that education is invested – as it were, 'all the way down' - with socially constructed interests and values that are liable to diverge in different contexts to the point of mutual opposition. It is also often alleged that post-war analytical philosophers of education such as R. S. Peters failed to appreciate such contestability (...) in seeking a single unified account of the concept of education. Following a brief re-visitation of Peters' analytical influences and approach and some consideration of recent 'post-analytical' criticisms of analytical educational philosophy on precisely this score, it is argued that much of the case for the so-called 'contestability' of education rests on a confusion of different concepts with different senses of 'education' that proper observance of well-tried methods of conceptual analysis easily enables us to avoid. With their intensive use of data to classify and price risk, insurers have often been confronted with data-related issues of fairness and discrimination. This paper provides a comparative review of discrimination issues raised by traditional statistics versus machine learning in the context of insurance. We first examine historical contestations of insurance classification, showing that it was organized along three types of bias: pure stereotypes, non-causal correlations, or causal effects that a society chooses to protect against, are thus the main sources (...) of dispute. The lens of this typology then allows us to look anew at the potential biases in insurance pricing implied by big data and machine learning, showing that despite utopic claims, social stereotypes continue to plague data, thus threaten to unconsciously reproduce these discriminations in insurance. To counter these effects, algorithmic fairness attempts to define mathematical indicators of non-bias. We argue that this may prove insufficient, since as it assumes the existence of specific protected groups, which could only be made visible through public debate and contestation. These are less likely if the right to explanation is realized through personalized algorithms, which could reinforce the individualized perception of the social that blocks rather than encourages collective mobilization. In contemporary development and political studies the Capability Approach as proposed by Amartya Sen and Martha Nussbaum has become an alternative analytical framework used to conceptualise the promotion of well-being (‘capabilities’) in society. Notably, an important component of this framework is agency, which underscores the various ‘transformation mechanisms’ towards realising well-being in societies. This study straddles the area of political theory and development studies and seeks to contribute to the literature on the Capability Approach from a fresh perspective of the (...) contest for agency between the different political stakeholders in society’s development arena. The study interrogates the agency roles of different stakeholders in society’s development focusing on the liberal-communitarian and the state-in-society debates on the politics of state from the perspective of the Capability Approach. The paper introduces the “Contest Paradox”: on the one hand, rational competitors employ the most effective means to achieve the constitutive end of games - winning; On the other hand, apparently rational competitors often employ means that are sub-optimal for winning, e.g., playing beautifully or fairly. Nevertheless, the actions of such competitors are viewed as rational. Are such competitors rational? I reject the possibility of resolving the paradox by appealing to additional ends or norms to winning, such as playing (...) sportingly. Instead, I argue that the constitutive end of games is not a win simpliciter, but a type of win, such as winning-beautifully or winning-fairly. This interpretive framework is theoretically advantageous because it accounts better for the ‘unity of action’ or ‘flow’ competitors experience, better deals with various cases, and accommodates different traditions of competing. This piece discusses the account of contested territories and of corrective justice Moore offers in A Political Theory of Territory. In Chapter 6, Moore offers an occupancy account of boundary-drawing. My discussion focuses on the status of Moore's occupancy account compared to the statist and nationalist accounts it aims to replace. Specifically, I consider whether these other accounts are as unsuccessful as Moore suggests, and whether Moore's account is as distinct from these accounts as she suggests. In Chapter 7, Moore (...) offers a distinction between three different types of rights violations involved in the unjust taking of territory, and considers potential remedies for each. My discussion focuses on the arguments Moore offers to justify the presence or absence of certain remedies, in particular the right of return and the redistribution of land. I conclude that the territorial claims of historically wronged groups are too quickly dismissed, and I suggest that this is problematic from the point of view of Moore's own account. (shrink)

I argue that capitalism presents a threat to “democratic contestation”: the egalitarian, socially distributed capacity to affect how, why, and whether power is used. Markets are not susceptible to mechanisms of accountability, nor are they bearers of intentions in the way that political power-holders are. This makes them resistant to the kind of rational, intentional oversight that constitutes one of democracy’s social virtues. I identify four social costs associated with this problem: the vulnerability of citizens to arbitrary interference, the insensitivity (...) of markets to relevant interests, failures of trust in the market system, and the inhibition of social deliberation about matters of public concern. I make general two suggestions about how we might ameliorate these problems: First, as a way of introducing some measure of intentionality to large-scale patterns of business activity, the reconceptualization of such activity as participation in larger group actions; second, the development of deliberative bodies that bring together business actors, policy experts, and diverse citizens in an effort to better characterize and transmit the public values that business should serve. While open-mindedness as an intellectual trait has been recognized for centuries, Western philosophers have not explicitly endorsed it as a virtue until recently. This acknowledgment has been roughly coincident with the rise of virtue epistemology. As with any virtue, it is important to inform contemporary discussion of open-mindedness with reflection on sources from the history of philosophy. Here I do just this. After reviewing two major accounts of open-mindedness, which I dub "Contest" and "Indifference," I explore some ideas pertinent (...) to the subject in four philosophers spanning eighteen centuries: Sextus Empiricus, John Locke, John Stuart Mill, and Paul Feyerabend. Despite their varying concerns and terminology, their contributions may valuably inform current reflection on the virtue of open-mindedness, whether construed in terms of the Contest or Indifference account. Sometimes speakers within a linguistic community use a term that they do not conceptualize as a slur, but which other members of that community do. Sometimes these speakers are ignorant or naïve, but not always. This article explores a puzzle raised when some speakers stubbornly maintain that a contested term t is not derogatory. Because the semantic content of a term depends on the language, to say that their use of t is semantically derogatory despite their claims and intentions, we (...) must individuate languages in a way that counts them as speaking our language L, assigns t a determinately derogatory content in L, and still accommodates the other features of slurs’ linguistic profile. Given the difficulty of doing this, there is some reason to give a non-semantic analysis of the derogatory aspect of slurs. The author suggests that rather than dismissing the stubborn as semantically incompetent, we would do better to appeal to expected uptake as moral reasons for the stubborn to adjust their linguistic practices. Contestable motives of filing reports comprise a set of factors which were not present in the origin of the reported criminal act, as stated by the reporting individual. The objective of such reports is to create circumstances which would lead to the either an imaginary or implicated perpetrator being brought to criminal justice. These types of reports generate a number of doubts and investigative problems. Recently, in the light of newly introduced legislative changes into the methods of investigative procedures in (...) relation to sexual assault, this issue has become much more significant. The following publication includes a detailed description of the legal and psychological situation of an individual who has been classified as a victim in a case of sexual assault. The article includes an analysis of statistical data encompassing the period after the introduction of the aforementioned legislative changes in the type of investigative procedures as well as a qualitative analysis of the major factors influencing the process of filing contestable reports of such crimes. The research has been conducted on the basis of analysing a total of 50 cases. It is the opinion of the author that an expert court psychologist, whose presence is mandatory in these types of cases and whose opinion formulated in the course of preparatory proceedings ought to play a key role in the disclosure of false pretences accompanying such reports. As the use of AI systems continues to increase, so do concerns over their lack of fairness, legitimacy and accountability. Such harmful automated decision-making can be guarded against by ensuring AI systems are contestable by design: responsive to human intervention throughout the system lifecycle. Contestable AI by design is a small but growing field of research. However, most available knowledge requires a significant amount of translation to be applicable in practice. A proven way of conveying intermediate-level, generative design knowledge is (...) in the form of frameworks. In this article we use qualitative-interpretative methods and visual mapping techniques to extract from the literature sociotechnical features and practices that contribute to contestable AI, and synthesize these into a design framework.
