Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas and strategies toward building (...) a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. Bioethicists function in an environment in which their peers - healthcare executives, lawyers, nurses, physicians - assert the integrity of their fields through codes of professional ethics. Is it time for bioethics to assert its integrity by developing a code of ethics? Answering in the affirmative, this paper lays out a case by reviewing the historical nature and function of professional codes of ethics. Arguing that professional codes are aggregative enterprises growing in response to a field's historical experiences, it asserts (...) that bioethics now needs to assert its integrity and independence and has already developed a body of formal statements that could be aggregated to create a comprehensive code of ethics for bioethics. A Draft Model Aggregated Code of Ethics for Bioethicists is offered in the hope that analysis and criticism of this draft code will promote further discussion of the nature and content of a code of ethics for bioethicists. In this paper I examine a strategy which aims to bypass the technicalities of the indispensability debate and to offer a direct route to nominalism. The starting-point for this alternative nominalist strategy is the claim that--according to the platonist picture--the existence of mathematical objects makes no difference to the concrete, physical world. My principal goal is to show that the 'Makes No Difference' (MND) Argument does not succeed in undermining platonism. The basic reason why not is that the makes-no-difference claim (...) which the argument is based on is problematic. Arguments both for and against this claim can be found in the literature; I examine three such arguments, uncovering flaws in each one. In the second half of the paper, I take a more direct approach and present an analysis of the counterfactual which underpins the makes-no-difference claim. What this analysis reveals is that indispensability considerations are in fact crucial to the proper evaluation of the MND Argument, contrary to the claims of its supporters. (shrink)

States are rapidly modifying law and policy to increase access to the opioid antidote naloxone, and the provision of naloxone rescue kits for use in the event of overdose is becoming increasingly common. As of late 2014 the majority of states had passed laws increasing naloxone access, and nearly as many have modified emergency responder scope of practice protocols to permit Emergency Medical Technicians and law enforcement officers to administer the medication. While the text of these laws is generally similar, (...) their implementation varies among states.This article outlines experiences and lessons learned from two diverse states, Massachusetts and North Carolina. In Massachusetts naloxone access initiatives were well underway before formal legislative action occurred, while in North Carolina the passage of a naloxone access law served as a catalyst for the creation of new programs and facilitated the scale-up of existing ones. In both states legislative action was necessary to permit the prescription and dispensing of naloxone to the friends and family members of people who use opioids, a key legal change. (shrink)

My discussion of duress falls into three parts. In part I of the paper, I argue chiefly that Xings done under duress remain clear cases of action, and that they are special cases of acting for a reason. In part II, I propose a five-point analysis of acting under duress. In part III, I examine how duress operates as a defence. I maintain that duress is sometimes an excuse and sometimes a justification for conduct, although I further argue that nevertheless (...) it would not be unreasonable to classify duress as an excuse. On September 11, 2001, as everyone knows, the towers of the World Trade Center in New York were attacked. I want to discuss this event in order to motivate a nonreductionist view of the extensions of everyday concepts. Next, I shall set out, and begin to defend, the particular view of nonreductionism that I favor—the Constitution View. Then, I shall consider two venerable metaphysical issues (the nature of vagueness and the mind-independent/mind- dependent distinction) in light of the Constitution View. Ever since the 1970’s, philosophers of mind have engaged in a lively discussion of Externalism. Externalism is the metaphysical thesis that the contents of one’s thoughts are determined partly by empirical features of one’s environment. Externalism appears to clash with another plausible thesis—the epistemological thesis that one can have knowledge of one’s own thoughts, without evidence or empirical investigation. Many have argued that the conjunction of these theses is incompatible. I have argued elsewhere for their compatibility.1 Here I’ll just assume (...) that they are compatible and explore some consequences of conjoining a particular externalist thesis about the contents of thoughts (Social Externalism) with a particular thesis about self-knowledge (First-Person Authority). Many believe strongly that states, even democratic states, commit serious moral harm by adopting policies that allow elective abortions. What avenues are available to citizens of those states who oppose such policies? In this paper I contest Nicholas Dixon’s claim that there is only a very limited scope for acts of civil disobedience in response to pro-abortion state policy. While acknowledging that a state policy of not allowing elective abortions imposes significant burdens on pregnant women, I contend that a consistent (...) political liberalism—committed to the idea of state neutrality—must recognize the validity of significant, even invasive, civil disobedience in response to states that follow a policy of allowing elective abortions. After summarizing my own views of 'I' and the first-person perspective, I consider a well-known autistic, Temple Grandin, who claims that she thinks only in pictures, not in language. I argue, to the contrary, that Grandin's mental life as she describes it in fact requires language, which, as a writer, she undoubtedly has. Finally, I turn to the question of whether thought as Temple Grandin describes it is independent of language.

Images of brains circulate today as rationales for decision-making and selectivity in policies, curriculum, preservice teacher education and inservice professional development. Kazuo Ishiguro’s 2005 science fiction novel Never Let Me Go and Mark Romanek’s 2010 film adaptation depict an alternate past in which human longevity is achieved by harvesting organs from clones. The clones seem ostensibly human and yet are considered nonhuman “creatures.” The book and film use differing strategies to align the nonhuman clones with nonhuman animals, a connection that is often ambivalent and contradictory.
