National and international criminal law systems are continually seeking doctrinal and theoretical frameworks to help them impose individual liability on collective perpetrators of crime. The two systems move in parallel and draw on each other. Historically, it has been mostly international criminal law that leaned on domestic legal systems for its collective modes of liability. Currently, however, it is the emerging jurisprudence of the International Criminal Court that is at the forefront of innovation, with the doctrine of indirect co-perpetration (...) taking the lead in international prosecutions. The article assesses the potential contribution as well as the limits of this compound doctrine to domestic criminal law jurisprudence, particularly with regard to small-group criminality. Four modes of indirect co-perpetration are discussed, namely shared control, concerted control, controlling board, and flawed triangle perpetration. A doctrine of indirect co-perpetration would enable liability in these modes of perpetration, perhaps with the exception of the latter, which marks the limits of its applicability. (shrink)

There are a number of ways in which a person can share the guilt of another's wrongdoing. He might advise it, command it or consent to it. He might provoke it, praise it, flatter the wrongdoer, or conceal the wrong. He might stay silent when there is a clear duty to denounce the wrong or its perpetrator; or he might positively defend the wrong done. Finally, he might actively participate or cooperate in the wrongdoing. These various activities, apart from cooperation, (...) typically occur before or after the commission of the wrong itself, only provocation being essentially before the fact. As such they fall into the categories of seduction or comfort, seduction being essentially pre-commission and comfort post-commission. In seduction, the seducer typically leads another into doing wrong who has not definitely made up his mind. He does not assist in the commission, but he leads to its occurring. If the principal has made up his mind, actions which might otherwise amount to seduction are best characterized as amounting to scandal, since they do not lead to wrong but reinforce the principal in his wrongful intent or provide to third parties a bad example since they connote approval of the principal's action. Closely related to the concept of seduction is that of solicitation, though perhaps these are best thought of as two aspects of the same kind of activity. Seduction can be thought of as a strong form of inducement to wrong, typified by command, counsel and enticement through praise or provocation. Solicitation is a softer form of inducement typically involving requests, appeals, and invitations. Whereas the seducer or solicitor leads another into wrong but does not assist in its commission, the co-operator does not lead the principal into wrong but assists in its commission. (shrink)

Exposure to bullying at work is a serious social stressor, having important consequences for the victim, the co-workers, and the whole organization. Bullying can be understood as a multi-causal phenomenon: the result of individual differences between workers, deficiencies in the work environment or an interaction between individual and situational factors. The results of the previous studies confirmed that some characteristics within an individual may predispose to bullying others and/or being bullied. In the present study, we intend to clarify the relationships (...) between workplace bullying considered from the victim’s and the perpetrator’s points of view, the employee Machiavellianism as a personality factor and the perceptions of organizational culture as depicted by Cameron and Quinn. The sample consisted of 117 workers, employed in different organizations in Poland. The empirical data regarding both being exposed to bullying as well as being a perpetrator of bullying were obtained by the use of self-reports from participants. According to the expectations, Machiavellianism predicted involvement in bullying others. The groups of bullies and bully-victims had a higher Machiavellianism level compared to the groups of victims and persons non-involved in bullying. The results showed that being bullied was negatively related to the perceptions of clan and adhocracy cultures and positively related to the perceptions of hierarchy culture. The results of a moderated regression analysis demonstrated that Machiavellianism was a significant moderator of the relationships between the perceptions of adhocracy and hierarchy cultures and being bullied. Theoretical and practical implications of the results were discussed. (shrink)

This study compared the family characteristics, victimization histories, and number of perpetration offenses of juvenile offenders who admitted to having had sex with animals to juvenile offenders who did not. The study found that 96% of the juveniles who had engaged in sex with nonhuman animals also admitted to sex offenses against humans and reported more offenses against humans than other sex offenders their same age and race. Those juveniles who had engaged in sex with animals were similar to (...) other sex offenders in that they also came from families with less affirming and more incendiary communication, lower attachment, less adaptability, and less positive environments. Those juveniles who had engaged in sex with animals reported victimization histories with more emotional abuse and neglect and a higher number of victimization events than other offenders. This would seem to indicate that sex with animals may be an important indicator of potential or co-occurring sex offenses against humans and may be a sign of severe family dysfunction and abuse that should be addressed in the arenas of psychological intervention, juvenile justice programs, and public policy. The introduction of information and communication technologies in the workplace has extended the scope of bullying behaviors at work to the online context. However, less is known about the role of situational factors in encouraging cyberbullying behavior in the workplace. The purpose of this study is to investigate the role of perceived organizational politics in fueling cyberbullying in the workplace, and to examine the central role of negative emotions in this process. The sample comprised 279 faculty members of three large (...) public sector universities in Islamabad, Pakistan. Results demonstrated that perceived organizational politics was positively associated with discrete negative emotions of anger and fear. Moreover, results indicated that anger was positively associated with cyberbullying perpetration, whereas fear was positively associated with face-to-face bullying victimization. Results also supported the idea that victims of face-to-face bullying may develop a positive attitude toward cyberbullying and retaliate against their more powerful face-to-face bullies online, possibly anonymously. We contribute to the literature by demonstrating that both forms of bullying can co-occur in the workplace as a consequence of perceived organizational politics, and the two roles—bully and victim—may be swapped among victims and perpetrators. Violence has been linked to the co-occurrence of cognitive dysfunction and altered activations in several brain regions. Empirical evidence demonstrated the benefits of acute exercise on motor inhibition and error detection and their neuronal processing. However, whether such effects also hold for the population with violent behaviors remains unknown. This study examined the effects of acute aerobic exercise on inhibitory control and error monitoring among violent offenders. Fifteen male violent offenders were counterbalanced into experimental protocols, which comprised a 30-min moderately (...) aerobic exercise [60% heart rate reserve] and a 30-min reading control session. After each session, participants performed an emotional stop signal task while event-related potentials were recorded simultaneously. Results showed insignificant changes in ERPs components [i.e., N2, P3, error-related negativity, and error-positivity amplitudes] and the behavioral performance in go condition, stop accuracy, and post-error adjustments by exercise. However, the current study demonstrated that the acute exercise facilitated stop signal reaction time when compared to the control session regardless of emotional conditions. This is the first research to exhibit the improvements in inhibitory performance by acute exercise for violent offenders. Most importantly, this effect was independent of affective settings, expanding the existing knowledge of the influences of acute exercise on cognition. Our findings implicate the perspective of acute exercise for clinical and correctional practices. (shrink)

Most current criticisms against the intervention in Iraq have tackled the two justifications articulated by the members of the coalition: that the United States had to neutralize the threats that Iraq generated for their own security and to the political stability in the Middle Eastand that the war in Iraq can be justified as a necessary stage in the war against international terrorism. The principal objection against justification is that it was, and remains, unfounded. Against justification, many have replied that (...) the intervention in Iraq had no connection,or at best had merely an indirect connection, with the fight against terrorism. In a recent text,Fernando Tesón claims that the American intervention in Iraq can nevertheless be morally justified as a case of humanitarian intervention. By “humanitarian intervention”, one must understand a coercive action taken by a state or a group of states inside the sphere of jurisdiction of an independent political community, without the permission of the latter, in order to preventor to end a massive violation of individual rights perpetrated against innocent persons which are not co-nationals inside this political community. I argue in this article that the American intervention in Iraq does not satisfy the conditions of a legitimate humanitarian intervention, as opposed to what Fernando Tesón claims. (shrink)

Digital business has marked an era of transformation, but also an unprecedented growth of cyber threats. While digital explosion witnessed by the banking sector since the COVID-19 pandemic has been significant, the level and frequency of cybercrimes have gone up as well. Cybercrime officials attribute it to remote working—people using home computers or laptops with vulnerable online security than office systems; malicious actors relentlessly developing their tactics to find new ways to break into enterprise networks and grasping defence evasion; persons (...) unemployed during the pandemic getting into hacking; cloud and data corruption; digital fatigue causing negligence; etc. This study adopts a case-based approach to explore the importance of business ethics, information sharing and transparency to build an information-driven society by scouting the case of Punjab and Maharashtra Co-operative (PMC) Bank, India. PMC defaulted on payments to its depositors and was placed under Reserve Bank of India’s directions due to financial irregularities and a massive fraud perpetrated by bank officials by orchestrating the bank’s IT systems. The crisis worsened when panic-stricken investors advanced their narrative through fake news peddled via social media channels, resulting in alarm that caused deaths of numerous depositors. It exposed several loopholes in information management in India’s deposit insurance system and steered the policy makers to restructure the same, thus driving the country consistent with its emerging market peers. The study further identifies best practices for aligning employees towards ethical behaviour in a virtual workplace and the pedagogical approaches for information management in the new normal. Acts of intimate partner violence and abuse of nonhuman animals are common, harmful, and co-occurring phenomena. The aim of the present study was to identify perpetrator subtypes based on variable paths hypothesized to influence physical violence toward both partners and nonhuman animals: callousness and instrumental representations of aggression and rejection-sensitivity and expressive representations of aggression. Strong associations emerged between callousness and instrumental representations and between rejection-sensitivity and expressive representations. For males, callousness directly predicted both IPV and animal abuse. For females, (...) rejection-sensitivity predicted IPV. Instrumental representations mediated the relationship between callousness and animal abuse for females but not for males. Results suggest that IPV and animal abuse functionally interconnect, that perpetration of animal abuse may differ in function across gender, and that identifying distinct pathways to violence may facilitate violence prediction and prevention. Sexual violence of various forms, be it sexual harassment or sexual abuse, perpetrated by male professors against their female students has gained societal visibility through media broadcasts. This article tells the tale of the 2013 recruitment to the University of Iceland of a former political party leader, minister and ambassador. He was publicly called out in 2012 for his alleged sexual offences, perpetrated some years earlier. The story is told from two different viewpoints: from that of the media and from (...) the article author’s own standpoint as assistant professor in gender studies with co-responsibility for his de-recruitment. In the media story, opinion leaders from the political, judicial and media spheres take centre stage. The author thus utilizes the concepts patriarchal homosociality and influencers. Based on the findings from the media analyses, the author lays out her defence and justification, using embodiment as the core of her argument. She draws on black feminist knowledge validation processes, more specifically, the ethic of caring and personal accountability. Furthermore, she explores affective feminist pedagogy, i.e. connecting mind and body through self-actualization. By contrasting the two accounts, that of the media and her own feminist standpoint, the author sheds light on the role that influencers play in preserving patriarchal power and the status quo against ‘fire-raising feminists’ in academia and society at large. B-events are matters which are better known to listeners than to speakers. This paper studies the detectives’ use of B-event statements in two different environments in their interactions with suspects/witnesses. The first type of environment are relatively co-operative sequences during which the aim is the reconstruction of events and constructing the record; here, B-event statements are realised as confirmation seeking questions. The second type of environment, a hostile interactional environment, is composed of argumentative sequences in which detectives aim to determine (...) who are the perpetrators of crimes; in these sequences, the detectives’ B-event statements are realised as accusations. While performing the two activities, the detectives signal different epistemic levels and stances at the turn level. Thus, the former B-event statements are mostly epistemically downgraded, while the latter are mostly upgraded, in order to facilitate undertaking these different activities during police questioning. Tim Scanlon has recently argued that an action is *blameworthy* if it "show[s] something about the agent's attitudes toward others that impairs the relations that others can have with him or her" and hence that "to *blame* a person is to judge him or her to be blameworthy and to take your relationship with him or her to be modified in a way that this judgment of impaired relations holds to be appropriate" (*Moral Dimensions*, 128--29). Given this, Scanlon argues, reactive (...) attitude accounts of blame, while they can capture some of the ways blaming attitudes vary depending on one's relationship to the wrongdoer, are in general "too thin" and cannot explain all the relevant changes in our attitudes, "including changes in our readiness to interact with [the wrongdoer] in specific ways" (143). Yet Scanlon does not provide clear accounts of what types of relationships matter for blame and how violations of the "standards" of these relationships justifies what new attitudes. My aim is to address this. -/- To do this, we need to turn not merely to particular reactive attitudes but to broad, interpersonal rational patterns of reactive attitudes in terms of which we can make sense of what I have come to call "communities of respect". My claim is that the sort of relationship whose impairment is relevant to blame is that of co-membership in a community of respect, so that the significance of the agent's wrongdoing relevant for blame is the significance those actions and attitudes have *for us* in the community. However, accommodating the variability of blame on which Scanlon rightly insists requires a more careful examination of two additional factors that affect how it is proper for one to respond to the impairment to those relationships that the wrongdoing represents: one's role in a given case as perpetrator, victim, or witness, and one's personal commitments. For, I argue, these factors provide one with excuses for failing to treat the perpetrator with the normal trust and respect we demand of each other, and the validity of these excuses itself depends on the overall rational structure of the patterns of reactive attitudes within the community. Consequently, both the individual and the community are important in defining the relationships and modifications of relationships that are central to blame; however, such modifications to personal relationships are a *consequence* of blame rather than, as Scanlon claims, part of its content. COVID-19 has caused far-reaching humanitarian challenges. Amongst the emerging impacts of the pandemic is on the dynamics of human trafficking. This paper presents findings from a multi-methods study interrogating the impacts of COVID-19 on human trafficking in Sudan—a critical source, destination, and transit country. The analysis combines a systematic evidence review, semi-structured interviews, and a focus group with survivors, conducted between January and May of 2021. We find key risks have been exacerbated, and simultaneously, critical infrastructure for identifying victims, providing (...) support, and ensuring accountability of perpetrators has been impeded. Centrally, the co-occurrence of the pandemic and the democratic transition undercut the institutional and governance capacity, limiting the anti-trafficking response and exposing already vulnerable groups to increased risks of human trafficking. Findings point to increased vulnerabilities for individuals with one or more of the following identities: migrants, refugees, females, and informal labourers. (shrink)

To most of us – believers and non-believers alike – the possibility of a perfect God co-existing with the kinds of evil that we see calls out for explanation. It is unsurprising, therefore, that the belief that God must have justifying reasons for allowing all the evil that we see has been a perennial feature of theistic thought. Recently, however, a growing number of authors have argued that the existence of a perfect God is compatible with the existence of gratuitous (...) evil. Given powerful, millenia-long sensibilities about power and love and justice, it isn’t hard to find that suggestion simply incredible. Nonetheless, in this paper I will argue that the most prominent theistic alternatives to what has seemed incredible to most of us throughout most of history are themselves patently unacceptable for the theist as well. On any of the most widely accepted accounts of how God could have justifying reasons for permitting some evils, God’s existence means that we have justifying reasons for perpetrating and allowing every evil that we see. That's hard to swallow too. If I’m right about all of this, then two competing outcomes seem to present themselves as a possible result. On the one hand, for the theist, the apparently outrageous suggestion that the existence of a perfect God is compatible with gratuitous evil no longer looks like it faces a formidable, hard-to-resist alternative. On the other hand, some like me might think that my arguments go no distance at all towards dispelling the incredibility of the gratuitous evil nouvelle vague. On this line, theism may seem now to be between the rock and the hard place: it seems hard to make sense of the existence of a perfect God whether or not He has justifying reasons for allowing all the evil that we see. In lieu of an abstract, here is a brief excerpt of the content:The Cycle of Violence and Feminist Constructions of Selfhood Jennifer L. Rike University ofDetroit Mercy Violence is the heart and secret soul ofthe sacred" (Girard 1977, 31). René Girard reaches this shocking conclusion by tracing the dynamics ofthe generation ofviolence in history, and the ingenious ways in which humanity has learned to funnel violence into ritual sacrifice to avoid apocalypse. His argument pivots upon his understanding ofhumanity as inherently (...) flawed, as fated to conflict in the struggle to survive. Ifthe sacred mechanism of ritual sacrifice is not deployed, violence takes on a power and personality all its own: "If left unappeased, violence will accumulate until it overflows its confines and floods the surrounding area. The role ofsacrifice is to stem this rising tide... and redirect violence into 'proper' channels" (10). Girard's theory about the violent origins ofthe sacred institutions of ritual sacrifice, law, and myth highlights perhaps the chief paradox of religion: it has been used to promote as much as to oppose violence. Today, as feminists explore how women in particular have been the objects ofsuch violence, they too have turned to Girard to understand this paradox, and yet most have ended up criticizing Girard for falsely universalizing typically Eurocentric and androcentric conceptions of humanity, violence, and religion (Shea, Kirk-Duggan, Nowak 24-6).' While they may be right on certain points, it is also possible that the rush offeminist scholars to charge 1 Nancy Jay has also criticized Girard for androcentrism, in particular because "he still grounds all community and culture on male control of male violence" (130). 22Jennifer L. Rike Girard with androcentrism reflects their own refusals to confront how the dark face of violence appears in women as well as in men. Rather than evaluating specific feminist criticisms ofGirard in this regard, I propose a more global approach—to delineate in greater detail how feminist constructions of selfhood need to be informed by Girard's theory of the violent origins ofthe sacred in order for feminism to achieve its own goals. In Girard's view, the ritual ofsacrifice and the law are generated out ofthe socio-psychological mechanisms ofacquisitive mimesis and scapegoating as the sacred's way of controlling violence. In ways he leaves largely implicit, these mechanisms reflect the devastating cyclical effects of violence upon its victims. Girard stops short of reflecting on the roles gender plays in the cyclical processes of violence, and yet, as my subsequent analyses shall demonstrate, there can be little doubt that women participate in these processes in ways both like and unlike men. Women have been scapegoated throughout history, but not all women end up as victims ofviolence and the rituals constructed to appease it. Nor do many women remain simply victims of the tides of violence: many repeat the cycle of victimization and themselves become perpetrators. Moreover, some escape the cycle ofviolence by a variety ofmeans whose patterns are well worth scrutinizing. My point is that women's modes of participation in the processes through which violence makes and remakes itself are far more complex than has been recognized, and merit our full attention. From the perspective of feminist constructions of selfhood, the question then becomes, how does gender affect one's experience of acquisitive mimesis and scapegoating, victimage and perpetration? To claim that only women are victims and only men—and the women they have co-opted—are perpetrators may be politically correct, but that claim ignores some hard but ultimately helpful truths about what women must do to bring about the changes necessary for revolutionizing our society by transforming its violent ways into peaceful ones. My plan, then, is to suggest how Girard might be used to advance the theory and praxis of feminism further by delving into the psychological mechanisms underlying acquisitive mimesis and scapegoating. I shall argue that using object relations theory to understand the ways in which violence splits the human psyche complements Girard's conception of acquisitive mimesis and scapegoating to disclose the complete dynamics ofthe cycle ofviolence. Such understanding is essential to feminist reconstructions of selfhood, because it makes the defeat of sexism and violence possible by exposing them at their roots. In this article I discuss T. Wartenberg’s claim that the film The Act of Killing, which has as protagonists and quasi co-authors perpetrators of the 1965–66 Indonesian massacre, ‘confirms’ and ‘supplements’ Arendt’s ‘banality of evil’ thesis. I argue for a more moderate version of the first part of this claim and expand upon the second. Thus, I suggest that the film gives us clues to articulate Arendt’s thesis with theories of alienation, hence also with Marxist theorizing. Central here is the (...) idea that deficient sensibility, which, according to Wartenberg’s claim, supplements Arendt’s idea of ‘thoughtlessness’, is related to an alienating process within which cinema plays a prominent role. Thus, my argument revolves around the premise that in the film the question of mass evil-doing is intertwined with positing its own medium as an object of reflection, revealing cinema as carrying a contradictory potential. The critical upholding of Arendt’s thesis that the film enables also concerns the relationship of ‘banality’ to ideological motivation, a rather problematic issue in Arendt’s thesis. The film, I argue, suggests that ‘banality’ does not necessarily exclude ideological zealotry. (shrink)

People may be subjected to discrimination from a variety of sources in the workplace. In this study of mental health workers, we contrast four potential perpetrators of discrimination (managers, co-workers, patients, and visitors) to investigate whether the negative impact of discrimination on victims’ well-being will vary in strength depending on the relative power of the perpetrator. We further explore whether the negative impact of discrimination is at least partly explained by its effects on people’s sense of organizational justice, and whether (...) the strength of mediation varies according to the source of discrimination. Using survey data from 1,733 UK mental health workers, a structural equation model was designed to test these hypotheses following a bootstrap approach. Discrimination from all sources was related to well-being, with that from managers having the strongest effects. The results support an explanation of the effect of discrimination on well-being in terms of organizational justice perceptions for discrimination from managers and from visitors, but less so for discrimination from co-workers or from patients. The study highlights the importance of differentiating amongst sources of discrimination at work and the salience of organizational justice perceptions in explaining the effects of discrimination from some sources. The aim of this paper is to map the reconfiguration and displacement of the emerging trauma of the Holocaust in the cinematic narratives of SFR Yugoslavia. The analysis of three nearly forgotten Yugoslav films of the 1960s - Killer on Leave, Witness Out of Hell and Smoke - follows Kansteiner?s thesis about the changes of Holocaust memorial narratives in the films shown on German television in the 1970s. Accordingly, I claim that the analyzed films position the trauma of the Holocaust (...) as a crime committed by others, over there, and then in the past. Further, they broaden the trauma to accommodate the diversified roles of victims, perpetrators, witnesses and bystanders, and help the Germans come to terms with the Nazi criminal legacy and their own role. The co-productional terms allow the films to balance the memory of the Holocaust as both anti-fascist and cosmopolitan, multidirectional within the real Yugoslav/German symbolic narrative space and its intrinsic poetics. "Contra la postmodernidad" entabla una polémica con las principales contribuciones políticas, sociológicas y filosóficas de los últimos tiempos. Comparecen ante el tribunal pensadores como Zygmunt Bauman, Anthony Giddens, Agnes Héller, Toni Negri, Simon Critchley, Gianni Vattimo, Eloy Fernández Porta y Jean-François Lyotard, entre otros. Se discuten las falacias de la economía neoclásica, el fetichismo de la alteridad radical y la retórica de la diferencia. A esto se añade una ardua polémica con aquella forma de filosofía obsesionada con el suicidio de (...) la razón, la muerte de la metafísica y la superación de la Modernidad. También se debate sobre la crisis del proyecto europeo y sobre movimientos sociales recientes como el 15-M o la primavera árabe. La tesis principal del libro afirma que la postmodernidad hace tiempo que llegó a su fin, sus categorías no son aplicables a un tiempo como el nuestro, marcado por una grave crisis económica, ecológica y social. Asistimos al regreso de la lucha de clases, la geopolítica, las estrategias neocoloniales, el populismo y el fundamentalismo étnico, cultural y religioso. En este contexto de grandes transformaciones, la apuesta normativa del postmodernismo resulta intelectualmente muy pobre y políticamente inútil. El afán por las cuestiones culturales e identitarias lleva a que muchos de sus autores olviden deliberadamente el análisis económico del sistema. Por este motivo, el postmodernismo resulta ser, en la mayor parte de los casos, una réplica exacta de la ideología neoliberal. (shrink)

Esta contribución, enmarcada en las V y VI convocatorias de proyectos de innovación docente de la Universidad de Cantabria (España), demuestra los resultados obtenidos tras la incorporación de metodologías docentes de gamificación y de creación de video-píldoras informativas en el contexto de aprendizaje de Geo-tecnologías. El alumnado participante mostró un grado de satisfacción muy elevado con el proyecto de innovación, alcanzando una media de 4.45 sobre 5 y las competencias de la asignatura se lograron satisfactoriamente. La experiencia es exportable a (...) otros contextos docentes sin necesidades de financiación específicas. (shrink)
