Drawing on Butler’s theoretical background, research on the ethics of violence has focused on the importance of dominant society-wide schemes and norms in building individuals’ moral sense of violence. Studies explain how violence is normalized and made socially acceptable. In our analysis, we build on the pragmatic sociology of Boltanski and Thévenot that places particular importance on the fact that fairness must always be appreciated in situations and provide a “grammar” to describe competing normative approaches. Studying rugby, we show how (...) the different market players (consumers, broadcasters, journalists) justify the violence that occurs during rugby matches. We contribute to the literature on the ethics of violence by providing a pragmatic understanding of violence. We contribute to the economies of worth by investigating violence in a regime of justice and justification work in a reality test (in contrast to a test of worth). This understanding of violence enables us to offer some recommendations to encourage more responsible justification work about violence. (shrink)

The recent literature on social norms has stressed the centrality of emotions in explaining punishment and norm enforcement. This article discusses four negative emotions (righteous anger, indignation, contempt, and disgust) and examines their relationship to punitive behavior. I argue that righteous anger and indignation are both punitive emotions strictly speaking, but induce punishments of different intensity and have distinct elicitors. Contempt and disgust, for their part, cannot be straightforwardly considered punitive emotions, although they often blend with a colder form of (...) indignation to favor low-cost, indirect, and collective forms of punishment such as mockery, exclusion, and ostracism. Dubreuil provocatively proposes an extremist rethinking of the limits of politics - toward a break from politics, the political and policies. He calls for a refusal of politics, suggesting a form of apolitics that would make our lives more liveable. The first chapter situates the refusal of politics in relation to different contemporary theoretical attempts to renew politics, and makes the case for a greater rupture. The second moment takes up what is liveable in life by way of apolitical (...) experience, in contrast to appropriations of the collective, including a discussion of the arts. In this book, Benoît Dubreuil explores the creation and destruction of hierarchies in human evolution. Combining the methods of archaeology, anthropology, cognitive neuroscience and primatology, he offers a natural history of hierarchies from the point of view of both cultural and biological evolution. This volume explains why dominance hierarchies typical of primate societies disappeared in the human lineage and why the emergence of large-scale societies during the Neolithic period implied increased social differentiation, the creation of status hierarchies, and, eventually, (...) political centralisation. It is widely agreed that humans have specific abilities for cooperation and culture that evolved since their split with their last common ancestor with chimpanzees. Many uncertainties remain, however, about the exact moment in the human lineage when these abilities evolved. This article argues that cooperation and culture did not evolve in one step in the human lineage and that the capacity to stick to long-term and risky cooperative arrangements evolved before properly modern culture. I present evidence that Homo heidelbergensis (...) became increasingly able to secure contributions form others in two demanding Paleolithic public good games (PPGGs): cooperative feeding and cooperative breeding. I argue that the temptation to defect is high in these PPGGs and that the evolution of human cooperation in Homo heidelberngensis is best explained by the emergence of modern-like abilities for inhibitory control and goal maintenance. These executive functions are localized in the prefrontal cortex and allow humans to stick to social norms in the face of competing motivations. This scenario is consistent with data on brain evolution that indicate that the largest growth of the prefrontal cortex in human evolution occurred in Homo heidelbergensis and was followed by relative stasis in this part of the brain. One implication of this argument is that subsequent behavioral innovations, including the evolution of symbolism, art, and properly cumulative culture in modern Homo sapiens , are unlikely to be related to a reorganization of the prefrontal cortex, despite frequent claims to the contrary in the literature on the evolution of human culture and cognition. In November 1996, Catherine Clément and Julia Kristeva began a correspondence exploring the subject of the sacred. In this collection of those letters Catherine Clément approaches the topic from an anthropologist's point of view while Julia Kristeva responds from a psychoanalytic perspective. Their correspondence leads them to a controversial and fundamental question: is there anything sacred that can at the same time be considered strictly feminine? The two voices of the book work in tandem, fleshing out ideas and (...) blending together into a melody of experience. The result is a dialogue that delves into the mysteries of belief -- the relationship between faith and sexuality, the body and the senses -- which, Clément and Kristeva argue, women feel with special intensity. Although their discourse is not necessarily about theology, the authors consider the role of women and femininity in the religions of the world, from Christianity and Judaism to Confucianism and African animism. They are the first to admit that what they have undertaken is "as impossible to accomplish as it is fascinating." Nevertheless, their wide-ranging and exhilarating dialogue succeeds in raising questions that are perhaps more important to ask than to answer. (shrink)

Renaud, the chronicler. “JXR” is not exactly recording facts and documents, although he often paints on the basis of “found images,” taking digital photos he collects from websites as a basis for his own work. He is not an archivist either, although he uses collage and routinely incorporates pictures or logotypes into his digital drawings. The chronicling work remains. In Renaud’s oeuvre, the times are being shown in all their glorious stupidity. An optimist nevertheless, the artist exhibits (...) through the grotesque dehiscence of the ordinary the raw nature of survival. By his alliance of artistic métier and critical force, of iconoclastic crudeness and reflection on society, of laughter and precision, Renaud’s art is undoubtedly related to that of Honoré Daumier, George Grosz, or Philip Guston. JXR has in common with all three painters that he excels at displaying the ridicule of adventitious grandeur and the vulgarity of the norm. (shrink)

In this paper, we point out that explainability is useful but not sufficient to ensure the legitimacy of algorithmic decision systems. We argue that the key requirements for high-stakes decision systems should be justifiability and contestability. We highlight the conceptual differences between explanations and justifications, provide dual definitions of justifications and contestations, and suggest different ways to operationalize justifiability and contestability.

This article offers a critical assessment of Cristina Bicchieri and Jon Elster’s recent attempt to distinguish between social, moral, and quasi-moral norms. Although their typologies present interesting differences, they both distinguish types of norms on the basis of the way in which context, and especially other agents’ expectations and behavior, shapes one’s preference to comply with norms. We argue that both typologies should be abandoned because they fail to capture causally relevant features of norms. We nevertheless emphasize that both Bicchieri (...) and Elster correctly draw attention to important and often neglected characteristics of the psychology of norm compliance. (shrink)

The actin crosslinking proteins exhibit marked diversity in size and shape and crosslink actin filaments in different ways. Amino acid sequence analysis of many of these proteins has provided clues to the origin of their diversity. Spectrin, α‐actinin, ABP‐120, ABP‐280, fimbrin, and dystrophin share a homologous sequence segment that is implicated as the common actin binding domain. ABSTRACT : Many philosophers and psychologists think that moral norms have a different nature as rules from convention: while we are obliged to respect moral norms because of what they are in themselves, our respect for conventions depends on our attitude toward a particular social context. I question this distinction between moral norms and conventions and argue that conventions depend on social context because the context structures the agents’ expectations, sets reference points for the assessment of gains and losses, and (...) helps the observer to infer the presence and the seriousness of harms. In this work, Colleen Clements presents her case for the need to subject the field of bioethics to a critical external analysis apart from the current postmodern assumptions. Clements argues that, since the 1970s, bioethics has refuted human values in favour of political consensus building. This failure to recognize basic human values in the ethical critique of modern medicine has lead to a dehumanization of the medical system by the field. This article explores the category of biopolitics through the use Roberto Esposito and Giorgio Agamben make of two Greek words, bios and ōē. In particular, I argue that the separation of bios and ōē as introduced in Homo Sacer has no "natural" nor "lingual" relevance. The exposition of such a fabulous antinomy simply ruins the historical matter of Agamben's discourse on biopolitics. Here, Esposito's research could be read as an attempt to found the category of biopolitics anew without repeating the (...) fiction of a bifurcation between ōē and bios. However, Esposito, in his own celebration of biopower, undermines the very power of language and, thus, ignores the variation of the invariant that is history. Esposito's and Agamben's difficulties lead us back to the possible ambition of all politics to absorb all life, as it was already expressed by Aristotle. In this sense, "modern biopolitics" becomes a case study for the totalitarian temptation of political order. (shrink)

An important challenge when creating automatically processable laws concerns open-textured terms. The ability to measure open-texture can assist in determining the feasibility of encoding regulation and where additional legal information is required to properly assess a legal issue or dispute. In this article, we propose a novel conceptualisation of open-texture with the aim of determining the extent of open-textured terms in legal documents. We conceptualise open-texture as a lever whose state is impacted by three types of forces: internal forces (the (...) words within the text themselves), external forces (the resources brought to challenge the definition of words), and lateral forces (the merit of such challenges). We tested part of this conceptualisation with 26 participants by investigating agreement in paired annotators. Five key findings emerged. First, agreement on which words are open-texture within a legal text is possible and statistically significant. Second, agreement is even high at an average inter-rater reliability of 0.7 (Cohen’s kappa). Third, when there is agreement on the words, agreement on the Open-Texture Value is high. Fourth, there is a dependence between the Open-Texture Value and reasons invoked behind open-texture. Fifth, involving only four annotators can yield similar results compared to involving twenty more when it comes to only flagging clauses containing open-texture. We conclude the article by discussing limitations of our experiment and which remaining questions in real life cases are still outstanding. (shrink)

The emotion of anger has a long love–hate relationship with morality. On the one hand, anger often motivates us to sanction wrongdoing and uphold demanding moral standards. On the other hand, it can prompt aggression behaviors that are at odds with morality and even lead to moral disasters. This article describes this complex relationship. I argue that the intensity of anger elicited by moral transgressions is highly sensitive to key variables, including the identity of the person wronged, the nature of (...) the wrongdoing, and expectations about what should and will be done. Depending on the context, we sometimes experience more anger than would be commendable and sometimes less. These characteristics of anger, in turn, explain the ubiquity of norms and discourses aimed at governing the expression of this emotion. (shrink)

En épistémologie des sciences sociales, Jon Elster est connu pour sa défense de l’individualisme méthodologique et sa critique des explications de haut niveau. Cette note critique la plus récente formulation de sa position . D’une part, nous montrons que les problèmes relatifs aux explications au niveau agrégé s’appliquent également aux explications en termes de mécanismes psychologiques, privilégiées par Elster. Si les mécanismes psychologiques contribuent à l’explication en sciences sociales, ce n’est pas parce qu’ils font explicitement référence à des états intentionnels, (...) mais parce qu’ils rendent mieux compte que les autres hypothèses de ce qui fait la différence entre deux faits ou événements. D’autre part, nous soutenons que l’individualisme ne doit pas servir d’idéal régulateur dans la recherche en sciences sociales. Si l’explication des comportements individuels est souvent essentielle pour produire une bonne explication, il existe des situations où elle est susceptible de nuire à la qualité de celle-ci en introduisant des éléments inadéquats.In epistemology of the social sciences, Jon Elster is well known for his defense of methodological individualism and his criticism of high-level explanations. This note criticizes the most recent version of his position . First, I argue that the problems related to explanations at the aggregate level also pertain to explanations in terms of psychological mechanisms, favored by Elster. If psychological mechanisms contribute to explanation in the social sciences, it is not because they explicitly refer to intentional states, but rather because they account better than alternative hypotheses for the difference between two facts or events. Second, I contend that individualism should not be taken as a regulative ideal for research in the social sciences. If accounts of individual behavior are often essential to good explanations, there are situations in which they are likely to be detrimental to them by encouraging the introduction of irrelevant factors. The field of computational law has increasingly moved into the focus of the scientific community, with recent research analysing its issues and risks. In this article, we seek to draw a structured and comprehensive list of societal issues that the deployment of automatically processable regulation could entail. We do this by systematically exploring attributes of the law that are being challenged through its encoding and by taking stock of what issues current projects in this field raise. This article adds to (...) the current literature not only by providing a needed framework to structure arising issues of computational law but also by bridging the gap between theoretical literature and practical implementation. Key findings of this article are: (1) The primary benefit (efficiency vs. accessibility) sought after when encoding law matters with respect to the issues such an endeavor triggers; (2) Specific characteristics of a project—project type, degree of mediation by computers, and potential for divergence of interests—each impact the overall number of societal issues arising from the implementation of automatically processable regulation. Thanks to his unsurpassed eye and his fearless willingness to take a stand, Clement Greenberg (1909 1994) became one of the giants of 20th century art criticism a writer who set the terms of critical discourse from the moment he burst onto the scene with his seminal essays Avant Garde and Kitsch (1939) and Towards a Newer Laocoon (1940). In this work, which gathers previously uncollected essays and a series of seminars delivered at Bennington in 1971, Greenberg provides his most (...) expansive statement of his views on taste and quality in art, arguing for an esthetic that flies in the face of current art world fashions. Greenberg insists despite the attempts from Marcel Duchamp onwards to escape the jurisdiction of taste by producing an art so disjunctive that it cannot be judged that taste is inexorable. He argues that standards of quality in art, the artist's responsibility to seek out the hardest demands of a medium, and the critic's responsibility to discriminate, are essential conditions for great art. The obsession with innovation the epidemic of newness leads, in Greenbergs view, to the boringness of so much avant garde art. He discusses the interplay of expectation and surprise in aesthetic experience, and the exalted consciousness produced by great art. Homemade Esthetics allows us particularly in the transcribed seminar sessions, never before published to watch the critics mind at work, defending (and at times reconsidering) his theories. In defining the theological problem of participation as the question of how created beings, namely human beings, can participate in the transcendent Uncreated God towards deification without a pantheistic blurring of essences, this article examines the Christologically intuitive way in which Maximus the Confessor would have responded. Specifically, Maximus’ Cyrilline Chalcednonianism, featuring an unconfused perichoretic union between Christ's two natures in his hypostatic union, serves directly as an apologetic and hermeneutic for humanity's and creation's participation in God. In addition, taking (...) into account the scholarly debate over Maximus’ understanding of the relationship between the Logos and the logoi, it is argued that this indirectly provides a second Christological way forward to resolve the problem at hand, particularly when the two types of logoi are correctly distinguished. Insofar as the Logos and the logoi, not to mention the notions of participation and deification, were viewed by Maximus through his Cyrilline Chalcedonian lens, his Cyrilline Chalcednonian Christology was ultimately his answer to the theological problem of participation. Philosophy lacks criteria to evaluate its philosophical theories. To fill this gap, this essay introduces nine criteria to compare worldviews, classified in three broad categories: objective criteria (objective consistency, scientificity, scope), subjective criteria (subjective consistency, personal utility, emotionality), and intersubjective criteria (intersubjective consistency, collective utility, narrativity). The essay first defines what a worldview is and exposes the heuristic used in the quest for criteria. After describing each criterion individually, it shows what happens when each of them is violated. From the (...) criteria, it derives assessment tests to compare and improve different worldviews. These include the is-ought, ought-act, and is-act first-order tests; the critical and dialectical second-order tests; the mixed-questions and first-second-order third-order tests; and the we-I, we-it, and it-I tests. The essay then applies these criteria and tests to a concrete example, comparing the Flying Spaghetti Monster deity with Intelligent Design. For another application, it draws more general fruitful suggestions for the dialogue between science and religion. (shrink)

Poetry and Mind shows that poetry--a widespread and perhaps universal phenomenon among humans--arises through syntactic structures, cognitive binding, and mental regulations, but that, in going through them, it also exceeds them. The best poems, then, are not only thought experiments but actual thinking experiments for the unthinkable. They expand the usual semantics of natural languages, and singularly deploy the rhetorical armature of speech. Made of iterations and linguistic reorganizations, they exceed their own algorithms and, often, they become reflexive, strange, and cognitively dissonant. Biobanks correspond to different situations: research and technological development, medical diagnosis or therapeutic activities. Their status is not clearly defined. We aimed to investigate human biobanking in Europe, particularly in relation to organisational, economic and ethical issues in various national contexts. Data from a survey in six EU countries were collected as part of a European Research Project examining human and non-human biobanking. A total of 147 institutions concerned with biobanking of human samples and data were investigated by questionnaires and (...) interviews. Most institutions surveyed belong to the public or private non-profit-making sectors, which have a key role in biobanking. This activity is increasing in all countries because few samples are discarded and genetic research is proliferating. Collections vary in size, many being small and only a few very large. Their purpose is often research, or research and healthcare, mostly in the context of disease studies. A specific budget is very rarely allocated to biobanking and costs are not often evaluated. Samples are usually provided free of charge and gifts and exchanges are the common rule. Good practice guidelines are generally followed and quality controls are performed but quality procedures are not always clearly explained. Associated data are usually computerised. Biobankers generally favour centralisation of data rather than of samples. Legal and ethical harmonisation within Europe is considered likely to facilitate international collaboration. We propose a series of recommendations and suggestions arising from the EUROGENBANK project. (shrink)

Concerns over students engaging in various forms of academic misconduct persist, especially with the post-COVID19 rise in online learning and assessment. Research has demonstrated a clear role of the personality trait psychopathy in cheating, yet little is known about why this relationship exists. Building on the research by Curtis et al. (Personality and Individual Differences, 185, 111277, 2022a), this study tested an extended Theory of Reasoned Action (TRA) model, including psychopathy as a precursor to attitudes and subjective norms, and measures (...) of anticipated moral emotions (shame and guilt), to predict cheating intentions and cheating behaviours. A cross-sectional survey was administered online to university students from around the globe (n = 257). Results from a serial mediation analysis revealed that psychopathy predicted academic misconduct behaviours indirectly through attitudes, subjective norms, anticipated guilt (but not anticipated shame), and intentions. These findings indicate that cheating may be reduced by modifying attitudes to cheating, subjective norms regarding cheating, and anticipated feelings of guilt related to engaging in academic misconduct. In addition, the results revealed high rates of several forms of cheating, particularly in unsupervised online tests, which have been used more widely since the COVID-19 pandemic. This finding raises concerns regarding the poor security of such assessments. (shrink)
