In 1850, Jacob Frerichs produced the first and until now the only edition of Friedrich Schleiermacher’s important lectures on Practical Theology. It is a mix and compilation of students’ transcripts from six different semesters, redundant and at times contradictory, which doesn’t correspond to Schleiermacher’s actual lectures. Most of the transcripts used by Frerichs are still preserved and have now been evaluated for a new edition of Schleiermacher’s Practical Theology. This paper elucidates the philosophical origins of the conception of plants as machines and analyses the contemporary technical and ethical consequences of that thinking. First, we explain the historical relationship between the explicit animal machine thesis of Descartes and the implicit plant machine thesis of today. Our hypothesis is that, although it is rarely discussed, the plant machine thesis remains influential. We define the philosophical criteria for both a moderate and radical interpretation of the thesis. Then, assessing the compatibility of (...) current botanical knowledge with both interpretations, we find that neither withstands scrutiny. We trace how biological and agricultural sciences have historically relied upon thinking of plants as machines and how they continue to do so today through rhetoric centred on breeding, biotechnology, and production. We discuss some of the most important legal and ethical consequences of obscuring the vitality of plants. Finally, we explore less reductive and destructive ways of thinking about, and using, plants. The global ecological crisis is upon us. From global warming to the long-term implications of ocean acidification, air and water pollution, deforestation, and the omnipresent dangers of nuclear technology the future of our planetary home is threatened. Yet in the midst of the unfolding crisis, the conventional ideologies of the twentieth century and their representations of nature remain unchallenged by both the defenders of capitalism and capitalism's most radical critics. The Distortion of Nature's Image illustrates how the anti-naturalism of late (...) capitalist society, in which nature is reified into the emptiness of mere matter, simply a thing to be dominated, is subtly complemented by the failure of the Left to go both beyond the historic limitations of Marx's ninteenth-century viewpoint and beyond anarchism's blind faith in "natural law." However, an alternative for comprehending nature and the ecological crisis as historical and social phenomena remains open in the dialectical naturalism of Western Marxism and Murray Bookchin's social ecology. By examining in closer detail how Bookchin's social ecology politicizes the concept of nature, as well as how precursory models in Western Marxist thought provide a foundation for this, Damian Gerber illustrates how the notion of an ecological society remains a decisively political question. Article III of the U.S. Constitution establishes an independent federal judiciary: federal courts constitute a separate branch of the national government, federal judges enjoy tenure during good behavior, and their salaries cannot be diminished while they hold office. The framers who drafted Article III in 1787 were not working from whole cloth. Rather, they were familiar with the preceding colonial and state practices, including those from New York. This essay provides a case study of New York's judicial history: the Dutch (...) period, 1621-1664; the Ducal proprietary period, 1664-1685; the Royal period, 1685-1776; and the early state period. As will be seen, New York—among the most significant of the original thirteen states—was a state groping towards a new ideal of judicial independence: an ideal that became a reality a decade after its own constitution was enacted in 1777 and at a different level of government. Significantly, the uncertain status of New York's judiciary had profound consequences for the ultimate expression of judicial independence, judicial review. (shrink)

When culture makes itself at home in motion, where does an anthropologist stand? In a follow-up to The Predicament of Culture, one of the defining books for anthropology in the last decade, James Clifford takes the proper measure: a moving picture of a world that doesn't stand still, that reveals itself en route, in the airport lounge and the parking lot as much as in the marketplace and the museum. In this collage of essays, meditations, poems, and travel reports, (...) Clifford takes travel and its difficult companion, translation, as openings into a complex modernity. He contemplates a world ever more connected yet not homogeneous, a global history proceeding from the fraught legacies of exploration, colonization, capitalist expansion, immigration, labor mobility, and tourism. Ranging from Highland New Guinea to northern California, from Vancouver to London, he probes current approaches to the interpretation and display of non-Western arts and cultures. Wherever people and things cross paths and where institutional forces work to discipline unruly encounters, Clifford's concern is with struggles to displace stereotypes, to recognize divergent histories, to sustain "postcolonial" and "tribal" identities in contexts of domination and globalization. Travel, diaspora, border crossing, self-location, the making of homes away from home: these are transcultural predicaments for the late twentieth century. The map that might account for them, the history of an entangled modernity, emerges here as an unfinished series of paths and negotiations, leading in many directions while returning again and again to the struggles and arts of cultural encounter, the impossible, inescapable tasks of translation. Schleiermacher, der selbst immer wieder im Fokus der Demagogenverfolgung stand, setzt sich nachdrücklich und zugleich taktisch klug für die Freiheit der Wissenschaften und der Kirche ein. 1819/20 war Schleiermacher zum vierten und letzten Mal Dekan der Theologischen Fakultät und setzte sich u.a. für die Unterstützung bedürftiger Studenten ein. Privat ist das Jahr 1820 auch von der Geburt seines ersten und einzigen Sohns geprägt. Professor Kai Nielsen is one of the most forceful proponents of the view that theological assertions have no factual reference because they are compatible with any empirical state of affairs; no evidence, it is alleged, is allowed to count as falsification of such assertions, and therefore they spuriously purport to be what they are not. In this he follows the well-known essay by Professor Antony Flew in which the same argument was advanced, and Nielsen's own most recent contribution on the (...) subject in Religious Studies should be read against the background of his earlier controversy with Professors John Hick and George Mavrodes in The Canadian Journal of Theology. In this latest article he broadens the canvas to question the significance of applying language and concepts appropriate to the realm of empirical observation to anything that is held to transcend it; and this is the substance of Part II of his paper, in which he engages in debate with Professor Ian Crombie, treading well-worn ground that has been the subject of innumerable philosophical discussions. The rest of the paper, however, is a restatement of his earlier contention, and it is with this more limited issue that I shall be concerned in what follows. For I believe that Nielsen is wrong in two quite fundamental respects: he is mistaken in supposing that theological assertions are compatible with any empirical state of affairs: he bases his critique of theological assertions on a far too uncritical appraisal of the principles of verification and falsification in the case of ordinary factual statements. If I am right, the larger questions raised in Part II will still remain open, but it is high time that the ‘verification-falsification argument’ should be shown to be unfounded. (shrink)

This article reviews the 2017 English translation of Achille Mbembe’s book _Critique of Black Reason._ It suggests that a key to understanding the work concerns the theme of the double, for instance, the critique of the double discourse on Blackness which explains the title of the book. Despite some passages of the text being overly poetic and difficult to understand, Mbembe’s critical contribution in this work, to not only the philosophical debate on otherness but also critical race theory, is the (...) attempt to rethink the relation of the particular and the universal, or in this instance Africa and the world, in order to think more critically about the responsibility of repairing the dignity of humanity in thinking our shared world beyond race and racism. The longstanding debates aver how to enforce codes of ethics reflect a serious flaw in understanding the nature of ?accountability.?; Fuzziness aver that basic notion has allowed the quantity of codes to expand, without any improvement in their quality or in media behavior. The essay maintains that we repeat the same arguments today that moralistic journalists did in the 1920s, because we lack intellectual precision aver such issues as internal vis a vis external controls, ethics vis a vis First Amendment (...) freedoms, and different forms and degrees of accountability to government, to fellow professionals, and to the general public. A social responsibility (SR) theory of the press has emerged in various democratic societies worldwide since World War II. The Hutchins Commission in the United States is the source of this paradigm in some cases, but a similar emphasis on serving society rather than commerce or government has also arisen in parallel fashion without any connection to Hutchins. Professionalism and codes of professional ethics are too narrow to serve as the framework for a global SR paradigm of the 21st century. (...) Instead, universal ethical principles are the most appropriate framework, and the cross-cultural axis around which these principles revolve is the sacredness of human life. Embedded in the protonorm of human sacredness are such ethical principles as human dignity, truthtelling, and nonmaleficence. These principles are citizen ethics rather than professional ethics; they are set in the social domain where SR gets its rationale. They provide a frame of reference internationally for assessing local news media practices and formulating codes of ethics. (shrink)

The traditional description of A- and B-time is that the former consists of a mind-independent past, present, and future, and that the latter consists solely of the time relations--earlier than, simultaneous with, and later than. Although this description makes it look as if there are two clearly contrasting concepts of time, it does not differentiate the passage of A-time from the succession in B-time. Nor does it explain what it means for events in B-time to be equally real and for (...) events in A-time not to be equally real. I argue that although McTaggart and numerous others have thought that there is a difference between the two kinds of time, it remains undescribed. (shrink)

Utilitarianism has dominated media ethics for a century. For Mill, individual autonomy and neutrality are the foundations of his On Liberty and System of Logic, as well as his Utilitarianism. These concepts fit naturally with media ethics theory and professional practice in a democratic society. However, the weaknesses in utilitarianism articulated by Ross and others direct us at this stage to a dialogic ethics of duty instead.
