In her newest book, Alex Sharpe makes a persuasive case against the bringing of sexual offence prosecutions on the basis of “gender identity fraud”. Adopting a perspective in which queer and gender non-conforming identities are acknowledged and centred rather than doubted and dissected, Sharpe aims to destabilise the conceptual foundations upon which such prosecutions depend. In this review I place Sharpe’s contribution in its legal context, and offer an overview of her argument along with some reservations.

BackgroundImplementation science research, especially when using participatory and co-design approaches, raises unique challenges for research ethics committees. Such challenges may be poorly addressed by approval and governance mechanisms that were developed for more traditional research approaches such as randomised controlled trials.DiscussionImplementation science commonly involves the partnership of researchers and stakeholders, attempting to understand and encourage uptake of completed or piloted research. A co-creation approach involves collaboration between researchers and end users from the onset, in question framing, research design and delivery, (...) and influencing strategy, with implementation and broader dissemination strategies part of its design from gestation. A defining feature of co-creation is its emergent and adaptive nature, making detailed pre-specification of interventions and outcome measures impossible. This methodology sits oddly with ethics committee protocols that require precise pre-definition of interventions, mode of delivery, outcome measurements, and the role of study participants. But the strict requirements of ethics committees were developed for a purpose – to protect participants from harm and help ensure the rigour and transparency of studies. We propose some guiding principles to help square this circle. First, ethics committees should acknowledge and celebrate the diversity of research approaches, both formally and informally ; without active support, their members may not understand or value participatory designs. Second, ground rules should be established for co-design applications and communicated to committee members and stakeholders. Third, the benefits of power-sharing should be recognised and credit given to measures likely to support this important goal, especially in research with vulnerable communities. Co-design is considered best practice, for example, in research involving indigenous peoples in New Zealand, Australia and Canada. (shrink)

Social justice is put forth as a core professional nursing value, although conceptualizations within foundational documents and among nurse educators remain inconsistent and contradictory. The purpose of this study was to explore how faculty teach social justice in theory courses in Baccalaureate programs. This qualitative study utilized constructivist grounded theory methods to examine processes informing participants' teaching. Participants utilize four overarching approaches: fostering engaging classroom climates, utilizing various naming strategies, framing diversity and culture as social justice, and role modeling a (...) critical stance. They deploy specific strategies, varying largely by race, educational background, and nursing specialty. A background in social sciences supports pedagogy that interrogates health inequities rather than merely raising awareness about disparities. Findings also reveal that faculty of color navigate institutional structures predicated upon colorblind racism and problematic views of culture, which many white faculty teaching non‐Community Health Nursing courses described doing. To enact social justice and be answerable to our communities, concerted anti‐oppression efforts are needed across education, research, practice, and policy. This includes sustained commitment to address colonialism and whiteness in every institution that defines, promotes, and claims to advance nursing so that we can fulfill our responsibility to address unjust systems and structures to serve our communities. Suicide has long been the subject of philosophical, literary, theological and cultural–historical inquiry. But despite the diversity of disciplinary and methodological approaches that have been brought to bear in the study of suicide, we argue that the formal study of suicide, that is, suicidology, is characterized by intellectual, organizational and professional values that distinguish it from other ways of thinking and knowing. Further, we suggest that considering suicidology as a “social practice” offers ways to usefully conceptualize its epistemological, philosophical and (...) practical norms. Recent theorizing about the nature of the cognitive impairment in autism suggests that autistic individuals display abnormally weak central coherence, the capacity to integrate information in order to make sense of one’s environment. Our article shows the relevance of computational models of coherence to the understanding of weak central coherence. Using a theory of coherence as constraint satisfaction, we show how weak coherence can be simulated ina a connectionist network that has unusually high inhibition compared to excitation. Utilising empirical ethics analysis, we evaluate the merits of systems proposed to increase deceased organ donation in South Africa. We conclude that SA should maintain its soft opt-in policy, and enhance it with ‘required transplant referral’ in order to maximise donor numbers within an ethically and legally acceptable framework. In SA, as is the case worldwide, the demand for donor organs far exceeds the supply thereof. Currently utilising a soft opt-in system, SA faces the challenge of how to increase donor (...) numbers in a context which is imbued with inequalities in access to healthcare, multiplicitous personal beliefs and practices, distrust of organ transplant and varying levels of education and health literacy. We argue that a hard opt-in, opt-out or mandated consent system would be problematic, and we present empirical data from Gauteng Province illustrating barriers to ethically sound practice in soft consent systems. Ultimately, we argue that in spite of some limitations, a soft opt-in system is most realistic for SA because its implementation does not require extensive public education campaigns at national level, and it does not threaten to further erode trust at a clinical level. However, to circumvent some of the clinical-level barriers identified in our empirical study, we propose a contextually sensitive option for “enabling” soft opt-in through “required transplant referral”. We argue that this system is legally defensible, enhances ethical practice and could also increase donor numbers as it has in many other countries. (shrink)

As an institution, the ?postmodern university? is central to the canon of today's research on higher education policy. Yet in this essay I argue that the postmodern university is a fiction that frames and inhibits our thinking about the future university. To understand why the postmodern university is a fiction, I first turn to grand theory and ask whether we can make sense of the notion of ?post?-postmodernity. Second, I turn to the UK higher education sector and show that the (...) postmodern university is a chimera, a modern artefact of competing instrumentalist, gothic, and postmodernist discourses. Third, I discuss competing visions of the future university and find that the progressive (yet modernist) agendas that re-imagine the public value of knowledge production, transmission, and contestation, are those that can move us beyond the palliative and panacea of the postmodern university. Two aspects of dynamic systems approaches that are pertinent to developmental models of reading are the emergence of a system with self-organizing characteristics, and its evolution over time to a stable state that is not easily modified or perturbed. The effects of dynamic stability may be seen in the differences obtained in the processing of print by beginner readers taught by different approaches to reading (phonics and text-centered), and more long-term effects on adults, consistent with these differences. However, there is (...) little direct evidence collected over time for the same participants. In this study, lexicalized (implicit) phonological processing, and explicit phonological and letter-sound skills are further examined in a precocious reader whose early development at 3 and 5 years has been extensively described (Cognition, 2000, 2004). At ages 10 and 14 years, comparisons were made with these earlier reports and skilled adult readers, using the same tasks for evidence of changes in reading processes. The results showed that along with an increase of reading accuracy and speed, her pattern of lexicalized phonological responses for reading did not change over time. Neither did her pattern of explicit phonological and letter-sound skills, aspects of which were inferior to her lexicalized phonological processing, and word reading. These results suggest dynamic stability of the word reading system. The early emergence of this system with minimal explicit skill development calls into question developmental reading theories that require such skills for learning to read. Currently, only the Knowledge Sources theory of reading acquisition can account for such findings. Consideration of these aspects of dynamic systems raise theoretical issues that could result in a paradigm shift with regard to best practice and intervention. (shrink)

In this article, we question to what extent origin-food labels, namely Geographical Indications and Slow Food Presidia, may effectively account for cultural biodiversity. Building on Foucault’s discourse theory, we question how the Slow Food movement and GI promoters have developed their own discourse and practice on CB, how these discourses contrast, and how they inform projects. Focusing on the practices to cultivate the microbiological life of three origin labeled cheeses, we have revealed the gap between these institutional discourses and what (...) happens on the ground. We argue that how actors’ relationships in the marketplace unfold, from public authorities to the collectives of producers to consumers, may threaten the effects that these experiences of alternative food productions may have in the defense of biodiversity, causing, for instance, the loss of diversity of the invisible microbial ecosystems of artisan raw milk cheese. However, we conclude that, despite limitations, the mediatized institutional narrative on CB can amplify the political voice of local actors by fostering community and social relationships between the farmers. The development of a `theory of mind' may not only be important for understanding the minds of others but also for using one's own mind. To investigate this supposition, forty children between the ages of three and four were given false-belief and creativity tasks. The numbers of appropriate and of original responses in the creativity test were found to correlate positively with performance on false-belief tasks. This association was robust, as it continued to be strong and significant even when age (...) and verbal intelligence were partialled out. The results support the hypothesis that the metarepresentational skills involved in theory of mind also affect the way children can access and scan their own mental repertoire beyond the areas of currently activated content (i.e. divergent thinking). With the advent of theory of mind a basic cognitive shift takes place in human development, and possibly took place in cognitive evolution. (shrink)

In this paper back-and-forth structures are applied to the semantics of natural language. Back-and-forth structures consist of an event structure and an interval structure communicating via a relational link; transitions in the one structure correspond to transitions in the other. Such entities enable us to view temporal constructions (such as tense, aspect, and temporal connectives) as methods of moving systematically between information sources. We illustrate this with a treatment of the English present perfect, and progressive aspect, that draws on ideas (...) developed in Moens & Steedman (1988), and discuss the role of rich ontologies in formal semantics. Gender, Power and Sexuality is a collection of original and exciting articles by well-known feminists which makes a major contribution to our understanding of the ways in which men exercise control over girls and women in their daily lives, in the home, at school, at work and in the courts. Women are seen to resent and challenge male power, but, the institutionalisation of male power is shown to mitigate against women taking control over their own lives.

Following a recent trend in the field of the history of philosophy and medicine, this paper stresses the necessity of recognizing empiricism’s patent indebtedness to the sciences of the body. While the tribute paid to the Hippocratic method of observation in the work of Thomas Sydenham is well known, it seems necessary to take into account a trend more critical of ancient medicine developed by followers of chemical medicine who considered the doctrine of elements and humours to be a typical (...) example of the idols that hinder the improvement of medical knowledge and defend the necessity of experimentation. In light of the fact that modern discoveries resulted in a “new frame of human nature,” they developed a critical reading of ancient empiricism. As a consequence, we can distinguish between two distinct anti-speculative traditions in the genesis of philosophical empiricism. The first recommends an active investigation into nature and refers to the figure of Democritus, the ancient philosopher who devoted himself to the dissection of beasts. Defenders of this first tradition refuse point-blank to be called ‘empiricists’, a label which had a very negative meaning during the seventeenth century, when it was used to dismiss charlatans and quacks. The other tradition, stressing as it does the role of description and observation, is more sceptical of the ability of dissection or anatomy to give us access to causes of diseases. This later tradition comes closer to the definition of ancient empiricism and to the figure of Hippocrates. (shrink)

The literature on rights in both moral and legal philosophy is voluminous, so voluminous that there may seem to be little justification for one more symposium to swell its ranks. But the discussion of rights has been fairly tightly organized around several narrow topics of debate, among them whether rights should be explained in terms of interests or choices, 1 whether rights are strictly correlative with duties, 2 and the relation between rights and utility. 3 The inspiration for the present (...) symposium is the sense that one topic of central importance has generally been given short shrift: the question of whether rights can conflict. There is, of course, a perfectly good explanation for why this topic has received so little attention; namely that contemporary rights theorists have generally assumed that rights cannot conflict. 4 But this assumption seems to be out of keeping with the way people commonly speak about rights as well as the way in which rights are usually understood in our constitutional tradition. The use of collaborative online social media applications as tools of communication is increasing in contemporary society. Correspondingly, a number of contemporary artists are exploring online interaction in their material public art practice, as a new form of documentation, promotion and creative collaboration. Mapping and analysing these new forms of interaction provide a method to determine the scope of their contribution to new artistic knowledge. This paper argues that contemporary public art practice can be cognisant of both physical and virtual (...) contributions as equally active participants in collaboration. It also identifies the convergence between artist and audience in virtual and physical space, and examines how this is affected by certain conditions and models of behaviour, which influence how a new collaborative creative discourse in public art can be constructed. In the 1970s and 1980s a strong opposition and anxiety towards biological and naturalizing knowledges was the norm in feminist discourse. In the past decades the certainties of that ‘anti-biologism’ have been challenged, in part because of a new recognition of the role of contingency in both biological determination and biological science. What seems to have survived the shift is a set of normative assumptions concerning the role of determinacy and contingency in the political implications of ontological claims: an assumed (...) political valorization of contingency. This article challenges those assumptions. It draws attention to the embrace of contingency and processuality on the part of supremacist biopolitical discourse, and suggests the need to think again about the politics of contingency and becoming. Focusing on the issue of racism and supremacist-specification, the article takes a genealogical look at ‘second-wave’ feminist anti-biologism. Monique Wittig’s materialist feminist attack on naturalizing ideology and ‘the myth of woman’ provides the historical example. The article draws attention to curious absences in Wittig’s anti-biologistic statements concerning early 20th-century biologistic feminism: the absence of a critique of eugenics, racism and supremacism. Arguably the condemnation of biology as a conservative ‘ideology of the status quo’ created masks for biopolitical ontology, obscuring the progressive, dynamic, processual character of biologism and of modern racism. While dislodging some powers of biologistic discourse, feminist anti-biologism might also have played a part in facilitating the revitalization of biopolitical racism within the constructivist culturalist rubric. The aim of the article is not to critique ‘second-wave’ feminism from the perspective of contemporary scholarship, but to help generate new ways of thinking and feeling about the role of ontology, contingency and temporality in the present politics of classification. This commentary questions the applicability of the Newell Test for evaluating the utility of connectionism. Rather than being a specific theory of cognition (because connectionism can be used to model nativist, behaviorist, or constructivist theories), connectionism, we argue, offers researchers a collection of computational and conceptual tools that are particularly useful for investigating and rendering specific fundamental issues of human development. These benefits of connectionism are not well captured by evaluating it against Newell's criteria for a unified theory of cognition.

Cet article se propose d’étudier la question de la corruption démocratique à partir d’un cas précis, celui de la crise du traitement des déchets à Naples, communément nommée « crise des ordures ». En analysant trois formes ou niveaux de corruption démocratique lors de cette crise, l’article souhaite souligner que le terme de corruption démocratique, loin de désigner un mécanisme précis, qualifie, au contraire, des actes, des pratiques et des phénomènes très divers.La crise napolitaine est marquée, d’une part, par l’implication (...) du réseau mafieux local – la Camorra – et, d’autre part, par de graves problèmes environnementaux. L’article analyse donc, dans un premier temps, le phénomène de corruption démocratique lié à la présence d’un réseau mafieux et s’attache ensuite à montrer que ce phénomène n’est pas uniquement lié à la présence de la Camorra. En montrant que la mise en place des commissariats extraordinaires est une réponse gouvernementale technocratique à la crise napolitaine, l’article met ensuite en exergue le lien peu évident existant entre corruption démocratique et environnement. Il démontre la difficulté pour nos démocraties libérales et représentatives de répondre démocratiquement à l’enjeu environnemental contemporain et soutient que cette difficulté relève d’une forme de corruption démocratique.
