A satisfactory sociology of markets requires that both order and disorder in markets be addressed, yet sociologists have seemed more concerned with theorizing market stability and order. Change, however, is too fundamental a part of markets to receive so little sociological attention. One perspective that provides a fertile ground for moving ahead with developing an agenda for studying both stability and change in markets is American pragmatist social theory. This article therefore examines the influence of a pragmatist viewpoint on two (...) broad modern theoretical approaches that have implications for the sociology of markets, one focused on stabilization processes, the other on institutional designs for promoting change. Most particularly, it draws on work carried out from a pragmatist viewpoint and illustrates a pragmatic approach to change in markets using the case of the EU’s Forest, Law Enforcement, Governance and Trade (FLEGT) action plan and initiative. Recent research has begun to explore individual differences in statistical learning, and how those differences may be related to other cognitive abilities, particularly their effects on language learning. In this research, we explored a different type of relationship between language learning and statistical learning: the possibility that learning a new language may also influence statistical learning by changing the regularities to which learners are sensitive. We tested two groups of participants, Mandarin Learners and Naïve Controls, at two time points, 6 (...) months apart. At each time point, participants performed two different statistical learning tasks: an artificial tonal language statistical learning task and a visual statistical learning task. Only the Mandarin-learning group showed significant improvement on the linguistic task, whereas both groups improved equally on the visual task. These results support the view that there are multiple influences on statistical learning. Domain-relevant experiences may affect the regularities that learners can discover when presented with novel stimuli. (shrink)

Vulnerability is an important concern of moral philosophy, political philosophy and many discussions in applied ethics. Yet the concept itself—what it is and why it is morally salient—is under-theorized. _Vulnerability, Autonomy, and Applied Ethics _brings together theorists working on conceptualizing vulnerability as an action-guiding principle in these discussions, as well as bioethicists, medical ethicists and public policy theorists working on instances of vulnerability in specific contexts. This volume offers new and innovative work by Joel Anderson, Carla Bagnoli, Samia Hurst, Catriona (...) Mackenzie and Christine Straehle, who together provide a discussion of the concept of vulnerability from the perspective of individual autonomy. The exchanges among authors will help show the heuristic value of vulnerability that is being developed in the context of liberal political theory and moral philosophy. The book also illustrates how applying the concept of vulnerability to some of the most pressing moral questions in applied ethics can assist us in making moral judgments. This highly innovative and interdisciplinary approach will help those grappling with questions of vulnerability in medical ethics—both theorists and practitioners—by providing principles along which to decide hard cases. The literature on cosmopolitan justice has yet to address what principles to adopt when duties of global justice and duties of social justice are in conflict. In this paper, I address David Miller’s contention that some may fall into the justice gap since we need to prioritize duties of social justice in cases of conflict. I argue that Miller’s analysis depends on three stipulations: the incommensurability of the values underlying duties of social justice and those of global justice; the need (...) to justify duties of justice to their holders; and the need to consider the necessary institutions to realize and implement justice obligations. I argue against the incommensurability clause by showing that both conceptions of justice pursue moral equality as the underlying and commensurate value. Instead, I propose that the currencies of justice we employ in the two contexts of justice are different. Discussing the justifiability clause I agree with the stipulation that we have to justify decisions that affect the realization of justice to those who have to carry the burden of realizing them. This implies, however, that we may have to accept that some prioritize duties of global justice over duties of social justice. If this is the case, it seems as though the state has little recourse to prioritize duties of social justice. Finally, discussing Miller’s institutional clause I ask why the justice relevant institutions can only be those of the state. It is plausible to say that in our current world, institutions of humanitarian aid are effective means to satisfy duties of global justice. (shrink)

In this paper, I challenge the argument that if we take health to be a meta-capability, we will be able to address the vulnerabilities that characterize human life. Instead, I argue that some vulnerabilities, like that attached to being a patient, can not be successfully addressed.

Climate change challenges the means of subsistence for many, particularly in the Global South. To respond to the challenges of climate change, countries increasingly resort to resettling those most affected by land erosion, heat, drought, floods, and the like. In this article, I investigate to what extent resettlement can compensate for the harm that climate-induced migration brings. The first harm I identify is that to individual autonomy. I argue that climate change changes the options of those affected by it to (...) the point that the decision to migrate can no longer count as a voluntary one. In some cases, I argue, the conditions of climate change coerce individuals. Second, I suggest that climate-induced migration severs the ties to territory, explaining the constitutive nature of such ties for accounts of individual autonomy. Third, I argue that severing ties with a traditional and historical territory challenges the capacity to imagine a future for individuals. I conclude that resettlement, even if actively planned and chosen, possibly providing gains in individual well-being and human flourishing, nevertheless harms individual autonomy interests. (shrink)

BrownI was recently asked to settle a friendly debate between two college graduates. The first, my daughter's boyfriend, argued that someone with talent and motivation could become as creative a composer without formal musical training as with it. The other, my daughter, vigorously countered that while someone might compose well on one's own, (...) the result would not be as versatile or thoughtfully developed as it could be with good formal instruction. I saw the musical educations of the debaters reflected in their arguments. My daughter had accumulated fourteen years of formal instruction in violin, cello, voice, and dance and took part in high school choral, theatrical, and orchestral performances. Her studies continued into college and from time to time she performs in community theater. Her boyfriend was the only musically trained member of his family. At his own request he studied piano for five years, later channeling his musical energies into a rock group. Though he did not study music in college, he continues to play keyboard and guitar. Both agree that the ongoing debate between them illustrates the strong connection between musical training and musical valuing. The life-world of their experiences shaped their judgments of musical quality and left imprints on their views of what matters more, talent or training. I will return to this scenario later.I find solid points of agreement with Eva Alerby and Cecilia Ferm starting with their premise that music learning is most effective when taught within a context. While some students prefer learning in a linear, rule-oriented setting, more often than not a musical concept will be comprehended best if it is first experienced within a variety of works. Regarding extra-musical contexts, furthermore, recent evidence supporting the integration of subject areas at the elementary level appears to extend the boundaries of musical learning in a positive direction. Additionally, the authors' description of embodied musical learning holds great interest. Their argument that musical learning must be appropriated within the body resonates strongly within me as I reflect upon performing and teaching piano. Experience with beginning level adult pianists suggests to me that once the awkwardness of newly-learned movements fades with time and effort, students often discover a close interaction between their physical and conceptual knowledge of music. Of related interest is the authors' definition of musicality as taking embodied musical knowledge and making it one's own. This surpasses physical mastery of an instrument and describes a personal [End Page 208] and emotional investment in music. It is at this point in the essay that the recognizable link between mind, body, and emotion in music is most clear.Alongside these engaging ideas, however, are statements throughout the essay that invite further questions or comments. First among these is the statement that the knowledge resulting from learning is not always what was intended or planned. While this is often the case, elaboration upon modes of knowledge in question would help clarify the authors' ideas. Since knowledge takes a variety of forms, as the authors imply, these forms should be explored, defined, and applied to the process of teaching and learning music.Related to that suggestion is my response to the statement that the aim of music education is to produce musical knowledge. I am assuming that musical knowledge includes an age-appropriate blend of performance skill, reading ability, ear training, historical and cultural connections, basic theoretical and stylistic understanding, and acquaintance with creative processes. In many regions of our country, public arts education has been de-valued to the extent that we must convince administrators, parents, and sometimes students, of its importance. Until this situation improves, I must personally consider the aim of music education as producing, alongside musical knowledge, the desire for music as a lifelong pursuit, be it active or passive. Without this desire, musical knowledge gained often goes unused. Referring to my opening anecdote, my daughter is not participating in music while her less extensively trained boyfriend is. This paper sets out to examine the place of theory in preschool education, considering the theories to which practitioners and providers have access and which provide a rationale for everyday practices and shape the experiences of young children. The paper reflects the circumstances of preschool provision, practices and thinking in the UK in general and in Scotland in particular. The central argument is that while there may be little obvious recourse to theorising and limited exposure to explicit theory about children’s (...) development, learning and education, practitioners and those responsible for provision have tacit understandings or implicit theories which can be seen to shape their practices. The paper begins by considering the explicit theory which practitioners are exposed to through the development of practice guidance and professional education. This is followed by an examination of the explicit theories adopted from psychology and more recent theoretical developments which have their roots in other disciplines and perspectives. Some influences on practitioners’ implicit theories are discussed before considering two key aspects of the dominate consensus about good practice: that play is the medium through which children learn and that practice should be child-centred. The paper concludes with a discussion of the ‘identity’ of preschool education theory and the benefits of articulating the implicit theory and folk beliefs on which local practices are based. This essay argues for a conception of law as a normative practice, a conception which departs from traditional, particularly positivist, conceptions. It is argued that Dyzenhaus's book (Dyzenhaus 1991), with its fascinating case study of unjust judicial decisions in South Africa, makes a compelling argument for such a conception. However, the essay takes issue with Dyzenhaus for romanticising the liberal tradition, and inflating the power of law and legal theory. Nonetheless, the essay agrees that positivist accounts tend to downplay the (...) emancipatory promise of law, and ends with some remarks about promise. (shrink)

How do we know if people are equal? Contemporary philosophers consider a number of issues when determining if the goals of egalitarian distributive justice have been achieved: defining the metric of equality; determining whether the goal is equality, or simply priority or sufficiency; establishing whether there should be conditions, e.g. bad brute luck, for the amelioration of inequality. In all this, most egalitarians contend that what is to be equalized is not people’s actual shares of the good in question, but (...) rather, the opportunities to have such shares. I counter this view with an ‘egalitarian flourishing’ approach that, in seeking to make people equal in actual well-being, takes exception to the role of opportunity in contemporary argument. The flourishing view means a focus on outcomes, on how people live, in order to enable people to live equally flourishing lives. I argue that if we consider the complex dynamics of choice and circumstance, the role of nonmaterial considerations and the ideal of an egalitarian community, equality of opportunity proves to be an inadequate approach to the realization of the egalitarian ideal. Die Untersuchung der Formen individuellen Vergessens führt vor Augen, inwiefern der Mensch seinem Denken selbstbestimmt eine Richtung geben kann und auch, inwieweit dies nicht gelingt. Sie liefert damit einen Beitrag zu einer aktuellen Theorie des Gedächtnisses aus geisteswissenschaftlicher, insbesondere philosophischer Perspektive.

We are, as of May 2019, witnessing yet another “caravan” of people fleeing violence in Latin America, bonding together to reach the territory of safer states in the North. Similarly, in the fall of 2015, Europe experienced the movement of many refugees fleeing war, persecution, and grave human rights violations in Syria. These new waves of people on the move have raised anew important questions about asylum and refuge: who should be able to claim asylum? Should the fear of persecution (...) be sufficient, or do asylum seekers need to show that they have actually suffered it? And maybe most controversially, how should asylum‐granting states respond to the plight of those asking for asylum on their territory?The moral principles guiding asylum and refuge are different from the rules usually regulating immigration, which are based on the principle of territorial sovereignty that allows nation‐states to discriminate and select among those who hope to immigrate. Asylum and refuge instead call upon nation‐states to provide refugees with a new home, protect human rights, and over time, provide access to the social, political and civic rights that characterize membership. Included in the list of human rights, I will argue, is the provision of the means for individual physical and psychological well‐being. (shrink)

Liberals are concerned with the equal moral status of all human beings. This article discusses what flows from this premise for moral cosmopolitans when analysing temporary foreign worker programs for low-skilled workers. Some have hailed these programs as a tool to achieve redistributive global goals. However, I argue that in the example of Live-In-Caregivers in Canada, the morally most problematic aspect is that it provokes vulnerability of individual workers. Once in a situation of vulnerability, important conditions of individual autonomy are (...) jeopardized. Even if these programs provide for redistribution of opportunities on a global scale, the challenge such programs pose to the conditions of autonomy can not outweigh these gains. Instead, they need to be re-assessed and changed to fundamentally express equal moral status of all human beings. (shrink)

For me describing a philosophy book as sensible and indeed commonsensical is real praise, for much philosophy exemplifies a vice to which Martha Nussbaum has drawn our attention in ‘Saving Aristotle’s Appearances.’See Language and Logos Studies in Ancient Greek Philosophy, ed. Malcolm Schofield and Nussbaum , pp. 267–293, 277. This is the intellectual vice of philosophers who got ‘fascinated with the (...) internal progress of their argument, even though it ended in a place incredibly remote from and at odds with, human belief.’ Annas’s work is well grounded in the endoxa .I could list all the important theses with which I agree, ranging from the central claim that virtue is analogous to a practical skill, to the very important claim that happiness is not reached by attaining “stuff” such as money, power, prope .. This chapter provides a background for a virtue ethical map of Hume and Nietzsche. A map offers an interpretation of a terrain or subject matter that is “stylized,” “abstract,” and “simplified. A complete map of Nietzsche and Hume, whether or not it involves a virtue ethical map of their ethics, ideally requires a thoroughly explicated conception of their metaphysical perspective. The chapter offers instead a very abstract map of the main issues and the author's general position. Of great importance for (...) a virtue ethical map of Hume and Nietzsche is their emphasis on psychology. Psychological interpretation must not be confused with an “individualistic” interpretation, according to which persons are viewed as if they were not shaped by their cultures. Indeed Nietzsche frequently draws the attention to the virtues of different ages which may be embryonic in earlier ages. (shrink)

The idea that the state has a duty to protect minority cultures has become so influential that cultural rights might seem a logical extension of T. H. Marshall's idea of citizenship rights; that is, the most recent set of rights to enable the citizen to be a fully participating member of the political community. This article takes the view, however, that citizens do not have cultural rights in the sense of rights to the protection of their minority cultures per se. (...) Instead, we should consider how citizens have an entitlement to culture in the broadest sense, as a constituent of equal well-being. On this view, the state has a duty to enable its citizens to live well. Cultural enrichment may require the protection of endangered ways of life—such as those of minority cultures—but only if these cultures do not run afoul of citizens' equal well-being as autonomous individuals. Within the past twenty years, contemporary Pagan leaders, progressive Christian and Goddess theologians, advocates for queer and BDSM communities, and therapeutic bodyworkers have all begun to speak forcefully about the sacredness of the body and of touch. Many assert that the erotic is a divinely transformative force, both for personal development and for social change. Although "the erotic" includes sexuality, it is not limited to it; access to connected nonsexual touch is as profound a need as that for sexual freedom (...) and health. In this book, Christine Hoff Kraemer brings together an academic background in religious studies and theology with lived experience as a professional bodyworker and contemporary Pagan practitioner. Arguing that the erotic is a powerful moral force that can ground a system of ethics, Kraemer integrates approaches from queer theology, therapeutic bodywork, and sexual minority advocacy into a contemporary Pagan religious framework. Addressing itself to liberal religious people of many faiths, Eros and Touch from a Pagan Perspective approaches the right to pleasure as a social justice issue and proposes a sacramental practice of mindful, consensual touch.
