Ethical concepts are, or purport to be, normative. They make claims on us: they command, oblige, recommend, or guide. Or at least when we invoke them, we make claims on one another; but where does their authority over us - or ours over one another - come from? Christine Korsgaard identifies four accounts of the source of normativity that have been advocated by modern moral philosophers: voluntarism, realism, reflective endorsement, and the appeal to autonomy. She traces their history, showing (...) how each developed in response to the prior one and comparing their early versions with those on the contemporary philosophical scene. Kant's theory that normativity springs from our own autonomy emerges as a synthesis of the other three, and Korsgaard concludes with her own version of the Kantian account. Her discussion is followed by commentary from G. A. Cohen, Raymond Geuss, Thomas Nagel, and Bernard Williams, and a reply by Korsgaard. (shrink)

This paper argues for a conception of the natural rights of non-human animals grounded in Kant’s explanation of the foundation of human rights. The rights in question are rights that are in the first instance held against humanity collectively speaking—against our species conceived as an organized body capable of collective action. The argument proceeds by first developing a similar case for the right of every human individual who is in need of aid to get it, and then showing why the (...) situation of animals is similar. I first review some of the reasons why people are resistant to the idea that animals might have rights. I then explain Kant’s conception of natural rights. I challenge the idea that duties of aid and duties of kindness to animals fit the traditional category of “imperfect duties” and argue that they are instead cases of “imperfect right.” I explain how you can hold a right against a group, and why it is legitimate to conceive of humanity as such a group. I then argue that Kant’s account of the foundation of property rights is grounded in a conception of the common possession of the Earth that grounds a right to aid and the rights of animals to be treated in ways that are consistent with their good. Finally, I return to the objections to the idea that animals have rights and offer some responses to them. (shrink)

Beginning with liberalism's foundational idea of moral equality as the basis for treating people with equal concern and respect, Christine Koggel offers a modified account of what makes human beings equal and what is needed to achieve equality. Koggel utilizes insights from care ethics but switches the focus from care as a moral response within personal relationships to the broader network of relationships within which care is given or withheld. The result is an account of moral personhood and agency (...) that is richer than the view propounded by liberal theory and care ethics. This exciting and original work challenges theoretical resistance to the idea that relationships are relevant to an understanding of equality, and it provides an opening to a critical analysis of relationships and care that informs and transforms our understanding of what is needed to treat all people with equal concern and respect. In this paper, we consider the question of whether there exists an essential relation between emotions and wellbeing. We distinguish three ways in which emotions and wellbeing might be essentially related: constitutive, causal, and epistemic. We argue that, while there is some room for holding that emotions are constitutive ingredients of an individual’s wellbeing, all the attempts to characterise the causal and epistemic relations in an essentialist way are vulnerable to some important objections. Background: Little is known about what factors may contribute to the growth of a consultation service or how a practice may change or evolve across time. Methods: This study examines data collected from a busy ethics consultation service over a period of more than two decades. Results: We report a number of longitudinal findings that represent significant growth in the volume of ethics consultation requests from 19 in 1990 to 551 in 2013, as well as important changes in the patient (...) population for which ethics help is requested. The findings include (1) a steady growth in requests from primary care providers (e.g., physicians and nurses), as well as increases in ancillary services (e.g., social workers); (2) a decrease in length of stay (days) before ethics help is requested; (3) an increase in the reasons that individuals ask for help from ethics; (4) an upsurge in consults requests from areas outside the intensive care unit (ICU); (5) a decrease in patients that died during hospitalization (e.g., live discharges); and (6) growth in the numbers of patients lacking decision-making capacity. Conclusions: We believe the increases in consult requests reflect appropriate and necessary growth because recent consultations have also been associated with consultations requiring (7) additional interventions and (8) reasonably high time intensity scores. Much thought has been devoted to how metaethical disagreement between moral realism and expressivism can be saved once minimalism starts creeping. Very little thought has been given to how creeping minimalism affects error-theories’ disagreement with their metaethical competitors. The reason for this omission, I suspect, is found in the belief that whilst locating distinctive moral realist and expressivist positions within a minimalist landscape poses a severe challenge, no such difficulties are encountered when differentiating error-theories from moral realism and expressivism. In (...) the first part of this paper, I show that this belief is mistaken: Insofar as moral realists and error-theorists are still taken to disagree, creeping minimalism renders their disagreement moral, but makes these positions metaethically indistinguishable. In the second part of the paper, I present a modified inferentialist solution to the problem of creeping minimalism which seeks to put error-theories back on the metaethical map. Yet, this too comes at a cost, in that it significantly modifies our interpretation of error-theories. Whichever way we turn, then, creeping minimalism not only forces us to re-phrase metaethical positions in a way that is compatible with minimalism, but also requires us to change our very understanding of these positions. Film studies has largely avoided the biocultural turn that has swept through other areas of the humanities. This resistance may be understood in terms of the field’s recent distaste for grand theory—and in terms of the loose, social-constructionist thinking that is one residue of that distaste. Fortunately, a biocultural approach to cinema can offer film studies a necessary and defensible set of assumptions. It can also offer interpretive tools and potential ways of conceptualizing perennial concerns like authorship and genre. This (...) essay demonstrates the last two points through an evolutionary reading of Howard Hawks’s musical Gentlemen Prefer Blondes (1953) and through proposals for new ways of approaching auteurism and pornography. A well-trod debate at the nexus of cognitive science and linguistics, the so-called past tense debate, has examined how rules and exceptions are individually acquired. However, this debate focuses primarily on individual mechanisms in learning, saying little about how rules and exceptions function from a sociolinguistic perspective. To remedy this, we use agent-based models to examine how rules and exceptions function across populations. We expand on earlier work by considering how repeated interaction and cultural transmission across speakers affects the dynamics (...) of rules and exceptions in language, measuring linguistic outcomes within a social system rather than focusing individual learning outcomes. We consider how population turnover and growth effect linguistic rule dynamics in large and small populations, showing that this method has considerable potential particularly in probing the mechanisms underlying the linguistic niche hypothesis. BackgroundThe spread of COVID-19 has disrupted the lifestyles of the world’s population. In the workplace, the pandemic has affected all sectors and has changed the way work is organized and carried out. The health sector has been severely impacted by the pandemic and has faced enormous challenges in maintaining healthcare services while providing care to those infected by the virus. At the heart of this battle, healthcare managers were key players in ensuring the orchestration of operations and the physical and (...) mental availability of employees during the crisis. Although few studies have been conducted to identify organizational practices or leadership skills to be adopted in a crisis context, the concrete behaviors of managers have not been documented yet. Therefore, this study aims at filling this gap by studying middle managers’ behaviors facing COVID-19 crisis in the healthcare sector.MethodsUsing a qualitative approach, eight focus groups were conducted online during the pandemic with 37 middle managers from the healthcare community of a Quebec health establishment from April to June 2020. Thematic analyses were conducted, and a mixed-methods approach was used to analyse the data based on Viitala’s hierarchical model of management skills.ResultsBased on the six managerial skills proposed in the model of Viitala, 21 specific management behaviors were identified as having been deployed by middle managers at the beginning of the pandemic. Considering that the health sector has been profoundly shaken by this health crisis, in addition to being an environment likely to experience other crises, managers need to develop practical skills in various crisis management situations. Thus, the results guide practitioners by highlighting the importance of team-oriented management behaviors, especially in a crisis context. (shrink)

Après avoir chassé les poètes et fustigé les orateurs, le Platon des classiques redevient le théoricien du Phèdre, de l'Ion et des Lois, l'instigateur d'une philosophie éloquente et d'un lyrisme vertueux. Modèle de pensée et d'écriture pour une rhétorique du philosophique d'abord socratique, puis avec les intuitions d'un Claude Fleury, bientôt poétique, le divin philosophe nous invite alors à réfléchir sur le difficile croisement que l'humanisme classique tente d'opérer entre morale et éloquence relevée. Car ce retour d'un platonisme dans la philosophie de la rhétorique s'est effectué au sein de milieux humanistes mondains puis dévots, et a donné lieu à l'élaboration de formes extrêmement raffinées dans l'écriture de la morale. À travers la leçon de Platon, l'éloquence du Sage s'avère désormais séminale pour intégrer dans les belles-lettres une exigence de spirituel et leur accorder ainsi un nouveau prestige. C'est donc un tableau de la littérature morale à la manière de Platon qui, de La Fontaine à La Bruyère et au Fénelon du Télémaque, se trouve ici esquissé. (shrink)

This Article examines normative arguments for legal pluralism in regulation. First I briefly set out what we know in fact about how plural regulatory orderings interact and compete with state agency regulatory action. Second, I sketch, and reject, a simple legal pluralist response to regulatory pluralism. In the third part of the Article I show that "responsive" and "reflexive" approaches to intentional pluralization in the design of law should be seen as providing different but complementary pictures of pluralized law. Finally (...) I argue that this pluralized view of law might provide us with the conceptual tools to identify a type of emergent, pluralistic law, without or beyond the state, which would be relevant to thinking about both transnational regulation and multiculturalism. Previous research suggests that implicit sequence learning is superior for believers in the paranormal and individuals with increased cerebral dopamine. Thirty-five healthy participants performed feedback-guided anticipations of four arrow directions. A 100-trial random sequence preceded two 100-trial biased sequences in which visual targets on trial t tended to be displaced 90° clockwise or counter-clockwise from those on t − 1. ISL was defined as a positive change during the course of the biased run in the difference between pro-bias and counter-bias (...) responses. It was hypothesized that this difference would be greater for believers in the paranormal than for skeptics, for those who received dopamine than for those who received placebo, and for believers who received dopamine than for the other groups. None of the hypotheses were supported by the data. It is suggested that a simple binary guessing task with a focus on prediction accuracy during early trials should be considered for future explorations. (shrink)

At a time when neoliberalism and financial austerity are together encouraging academic scientists to seek market alternatives to state funding, this essay investigates why, a century ago, their predecessors explicitly rejected private enterprise and the private ownership of ideas and inventions available to them through the patent system. The early twentieth century witnessed the success of a long campaign by British scientists to persuade the state to assume responsibility for the funding of basic research : their findings would enter the (...) intellectual commons; their rewards would be primarily reputational . The essay summarizes recent research in three separate fields of British technoscience—electricity, aviation, and agricultural botany—all of which were laying claim, at this time, to a heightened commercial or military importance that raised new questions about the ownership of scientific ideas. It suggests that each of the three established an idiosyncratic relationship with the patent system or with other forms of “intellectual property,” which would both influence their emergent disciplines and affect the extent to which commercial enterprise could remain a viable funding strategy. Recent studies indicate that many people demonstrate resilience to the loss of a spouse, and are able to return fairly quickly to their normal levels of subjective well-being. The question I address here is whether these empirical findings support scepticism about the importance of our loved ones. I argue that we have reason to doubt the correlation posited by the sceptic between the importance of a person’s spouse and his or her reaction to spousal loss. Extreme devastation may not be (...) a sign of love, but may only indicate a person’s dependence on his or her spouse. I also argue that one cannot draw any meaningful conclusions about the value of a loved one on the basis of their reaction to loss, for those reactions will be influenced by factors such as replaceability, which need not correlate with love. I conclude that resilience offers no reason for scepticism about the depth of spousal love. (shrink)

In this paper I explore the possibility of explaining why there is such a thing as the good in naturalistic terms. More specifically, I seek an explanation of the fact that some things are good-for human beings and the other animals in the final sense of good: worth aiming at. I trace the existence of the final good to the existence of conscious agents. I propose that the final good for an animal is her own well-functioning as the kind of (...) creature she is, taken as an end of action, and that having this as her final good makes her better at the activity she is necessarily engaged in, namely, living. A unique authoritative analysis of the individual an social concerns informing the politics of contemporary psychoanalysis.

The allocation of any scarce health care resource, especially a lifesaving resource, can create profound ethical and legal challenges. Liver transplant allocation currently is based upon urgency, a sickest-first approach, and does not utilize capacity to benefit. While urgency can be described reasonably well with the MELD system, benefit encompasses multiple dimensions of patients’ well-being. Currently, the balance between both principles is ill-defined. This survey with 502 participants examines how urgency and benefit are weighted by different stakeholders. Liver transplant patients (...) favored the sickest-first allocation, although all other groups tended to favor benefit. Criteria of a successful transplantation were a minimum survival of at least 1 year and recovery of functional status to being ambulatory and capable of all self-care. An individual delisting decision was accepted when the 1-year survival probability would fall below 50%. Benefit was found to be a critical variable that may also trigger the willingness to donate organs. The strong interest of stakeholder for successful liver transplants is inadequately translated into current allocation rules. (shrink)

No country has yet implemented a pilot to ensure access to or the innovation of new antibiotics for multi-drug infections. A team from national health agencies in Norway, with the support of the Innovative Medicine Initiative-funded project DRIVE-AB, designed a model suitable for the national context, including the selection of the antibiotics, the potential value, and the operational model.

Political philosophers are divided on the question of whether society should guide individuals in their projects and goals in light of the competing, yet overlapping, values of moral independence and human well-being. The lively neutralism-perfectionism debate appears to be significantly muted, however, when it comes to children who, all parties assume, should be guided by adults in their plans of life. Thus, in their stimulating new book, Family Values: the Ethics of Parent-Child Relationships, liberals Harry Brighouse and Adam Swift affirm (...) the role of the family in directing and enabling children’s flourishing. My paper challenges this distinction between parents and children in the liberal position to argue that the idea that it is appropriate to direct children to enable them to flourish, entails in fact, a commitment to policies that promote and enable the flourishing of all. The issue at stake in this volume is the role of science as a way to fulfil a quest for knowledge, a tool in the exploration of foreign lands, a central paradigm in the discourse on and representations of Otherness. The interweaving of scientific and ideological discourses is not limited to the geopolitical frame of the British empire in the nineteenth and early twentieth centuries but extends to the rise of the American empire as well. The fields of research tackled (...) are human and social sciences (anthropology, ethnography, cartography, phrenology), which thrived during the period of imperial expansion, racial theories couched in pseudo-scientific discourse, natural sciences, as they are presented in specialised or popularised works, in the press, in travel narratives at the crossroads of science and literature in essays, but also in literary texts. Contributors examine such issues as the plurality of scientific discourses, their historicity, the alienating dangers of reduction, fragmentation and reification of the Other, the interaction between scientific discourse and literary discourse, the way certain texts use scientific discourse to serve their imperialist views or, conversely, deconstruct and question them. Such approaches allow for the analysis of the link between knowledge and power as well as of the paradox of a scientific discourse which claims to seek the truth while at the same time both masking and revealing the political and economic stakes of Anglo-saxon imperialism. The analysis of various types of discourse and/or representation highlights the tension between science and ideology, between scientific "objectivity" and propaganda, and stresses the limits of an imperialist epistemology which has sometimes been questioned in more ambiguous or subversive texts. Arnold Gehlen is one of the most controversial figures of German intellectual history. Gehlen’s commitment to National Socialism (a commitment he never disavowed) is mostly seen in close connection with his theoretical focus on institutions. According to Gehlen, what mankind requires above all is order and thus the protection of institutions. And yet, by reducing Gehlen’s sociology to the necessity of order one misses the analytical scope of his writings. As this article aims to show, the strength of Gehlen’s sociology (...) lies less in its theory of institutionalization than in its attempt to comprehend change, i.e. the conceptual clarification of the interplay between radical innovation and institutionalization. In order to apprehend Gehlen’s understanding of change we have to look at his sociology of art as it is art which works as ‘a small symbol of society’. To approach Gehlen from this perspective is not to rehabilitate the controversial thinker. Instead, I am trying to show that Gehlen’s theoretical framework is as complex as modern culture itself and should therefore not prematurely be declared a reactionary testimony of the past. (shrink)
