Who owns frozen human embryos? Are "surrogate motherhood" arrangements dangerous for women? Should access to in vitro fertilization be limited or increased? With the development of complex reproductive technologies and the ensuing controversies in reproductive ethics, there is an urgent need for more careful examination of moral principles, current practices, and social policies pertaining to reproduction. The issues examined in this collection of nine papers focusing of the Canadian experience include abortion, the cryopreservation of embryos, the selective termination of fetuses (...) within multiple pregnancies, social policy for gestational "surrogacy," and the regulation of in vitro fertilization. Adopting a feminist perspective, the book places reproductive autonomy at the center of debates about the control of reproduction. (shrink)

Metaethics is traditionally understood as a non-moral discipline that examines moral judgements from a standpoint outside of ethics. This orthodox understanding has recently come under pressure from anti-Archimedeans, such as Ronald Dworkin and Matthew Kramer, who proclaim that rather than assessing morality from an external perspective, metaethical theses are themselves substantive moral claims. In this paper, I scrutinise this anti-Archimedean challenge as applied to the metaethical position of expressivism. More precisely, I examine the claim that expressivists do not avoid moral (...) commitments when accounting for moral thought, but instead presuppose them; they do not look at ethics from the outside, but operate from within ethics. This paper defends the non-moral status of expressivism against anti-Archimedeanism by rejecting a new anti-Archimedean challenge which, on the basis of Hume’s Law, aims to exploit expressivist explanations of supervenience in order to show that expressivism is a substantive moral position. The historic Christian tradition of offering hospitality to strangers provides moral, theological and practical insights for contemporary responses to the needs of refugees, asylum seekers and immigrants. Ancient writers were explicit about the difficulties, blessings, and necessity of welcoming strangers. In this paper, specific components of the tradition, especially as they are evident in the writings of Chrysostom, Calvin and Wesley, are discussed. Suggestions are offered for points of intersection with contemporary concerns related to asylum and immigration.

The term “Socratic method” is so pervasive in education across the disciplines that it has largely lost its meaning, and it has lost its roots in its originator—the historical Socrates. In this article we draw from the original source, Plato's ancient dialogues, to understand the theory and principles behind the questioning used in Socratic method. A deep understanding of Socratic method is particularly timely now as nursing leaders call for increased use of theory‐based debriefing across the nursing curriculum. Socratic questioning (...) is ideally suited as a method for debriefing in nursing classrooms because of its ability to enhance critical thinking and self‐reflection of the learner and because of its basis in care for the learner through a learner‐centred design. We present an analysis of the Socratic method in Plato's works and provide an overview of the key Socratic principles and techniques. We illustrate these principles and techniques with examples of how Socratic teaching can be applied in the nursing classroom, and we address the challenges and rewards for nursing faculty implementing Socratic method. Learning about Socratic method directly from Plato's dialogues can provide a richer and more robust understanding of this key pedagogical technique and help nurse educators practice more intentional and informed Socratic questioning and debriefing. In this reply, I argue that the worries raised by Kurth and this coauthors are not fatal for the perceptual theory of emotions. A first point to keep in mind in discussing the analogy argument in favor of that account is that what counts is the overall balance of similarities and differences, given their respective weight. In any case, I argue that none of the alleged differences between sensory perceptual experiences and emotions are such as to rule out that emotions (...) are a kind of perceptual experience which can confer epistemic justification of our evaluative beliefs. Finally, I suggest that the perceptual theory is in a position to nicely capture what happens when we disagree about evaluative issues. (shrink)

Heterosexuality, which I define as a romantic and sexual orientation toward persons not of one's own sex, is apparently a very general, though not entirely universal, characteristic of the human condition. In fact, it is so ubiquitous a part of human interactions and relations as to be almost invisible, and so natural-seeming as to appear unquestionable. Indeed, the 1970 edition of The Shorter Oxford English Dictionary defines ‘heterosexual’ as ‘pertaining to or characterized by the normal relation of the sexes.’.

This article begins with discussing challenges encountered while managing the epistemology of legal modes of thinking and social science, and the limits of relying on discipline-based methodologies for the advancement of empirical legal scholarship. In then discusses two approaches to empirical legal training employed in New York. Through this, it seeks to demonstrate the strengths of collaborative research with illustrations of a cross-national collaboration. Empirical research on law is a multi-method phenomenon. Ideally, empirical legal training means that students need and (...) can further foster a background in a broad range of social science methods and in a set of methods that can use triangulation or juxtaposition to capture the factors that explain law as a social phenomenon. In seventeenth- and eighteenth-century London and Paris, growing numbers of poor alarmed notables and city officials who would come to view a policy of confinement as an appropriate social, economic, religious, and political solution. This work examines the motivations of patrons to support these institutions (called hospitals). In particular, this study looks at their support for the construction (or renovations) of chapels (e.g. chapel at La Salpêtrière and the chapel at the Lock Hospital) and their visitations to these hospitals. Vagrants, (...) beggars, prostitutes, and idlers of other sorts healthy or not were confined not necessarily for theirhealth but for their souls and for the social order of the city. The locations of these hospitals indicate a geographical isolation not only in their “placement” outside the city walls but even in the Christian charitable rhetoric or visitations by benefactors that emphasized their separateness. “Unclean livers” or destitute beggars were put on view so that the morally upright who patronized these institutions could view for instructional purposes and could be viewed for purposes of salvation, but remained as separate nonetheless. Great masses and grand sermons were heard in the chapels that adorned these institutions, but a clear policy of segregation existed that kept the godly patrons separate from the “polluted.”. A highly controversial issue in criminal law theory has been the use of strict liability offenses, i.e., offenses which create liability ‘without fault.’ The collection of strict liability offenses is varied according to the element of the particular offense with respect to which liability is strict. For example, a statute prohibiting the filing of a false financial statement with the Secretary of State might impose liability despite a reasonable error as to the truth of the statement, or as to the (...) financial nature of the statement, or as to the identity of the official in question. What all strict liability offenses have in common is the imposition of liability despite the possibility of reasonable mistake or due care regarding some important element of the offense. Generally, then, a strict liability offense is one to which a claim of no-negligence is not a defense. Indeed, such a claim will not even be heard. All that the prosecution need prove is the voluntary commission of the proscribed acts by the defendant; no other question concerning the defendant's efforts or opportunity to obey the law is relevant to liability or conviction. The integrative memory model formalizes a new conceptualization of memory in which interactions between representations and cognitive operations within large-scale cerebral networks generate subjective memory feelings. Such interactions allow to explain the complexity of memory expressions, such as the existence of multiples sources for familiarity and recollection feelings and the fact that expectations determine how one recognizes previously encountered information.

The aim of the paper is to investigate the effects of the corporate governance model on social and environmental disclosure (SED). We analyze the disclosures of the 100 U.S. Best Corporate Citizens in the period 2005–2007, and we posit a series of simultaneous relationships between different attributes of the governance system and a multidimensional construct of corporate social performance (CSP). We consider both the extent and the quality of SED, with the purpose of identifying increasing levels of corporate commitment to (...) stakeholders and shedding some light on whether SED is used as a signal or rather as a legitimacy tool. Our empirical evidence shows that the stakeholders’ orientation of corporate governance is positively associated with CSP and SED. On the other hand, we do not find support for the monitoring intensity of corporate governance being negatively associated with social performance. We also find that CSP in the “product” dimension is positively associated with the extent and quality of SED whilst CSP in the “people” dimension is negatively associated with the extent and quality of SED. At a time when shareholders and stakeholders share more common aspects in their relationships with firms, this is a significant area to explore and this research fills an important lacuna in this respect. Der vorliegende Band enthält Predigten zu 56 Terminen des Jahres 1824 sowie ergänzend 28 dazugehörige Liederblätter Schleiermachers. Mit Ausnahme der zahlreichen Kasualpredigten und zweier im Urlaub gehaltener Kanzelreden ist Schleiermachers Predigttätigkeit damit für das genannte Jahr lückenlos dokumentiert. Die Editionsbasis bilden neben Drucktexten und einem Autograph Schleiermachers mehrheitlich die qualitativ hochwertigen Nachschriften des Theologiestudenten Johann Gottfried Andrae. Zu 22 Terminen existierte bislang keine Predigtveröffentlichung; zu 34 Terminen liegen bereits Drucke vor. Für 12 der insgesamt 15 von Schleiermacher selbst redigierten und (...) publizierten Texte konnte allerdings eine abweichende Vorlage ausgemacht und ediert werden, wodurch ein besonderes Licht auf seine Vorgehensweise bei der Herstellung der literarischen Predigten fällt. The Routledge Handbook of Critical Pedagogies for Social Work traverses new territory by providing a cutting-edge overview of the work of classic and contemporary theorists, in a way that expands their application and utility in social work education and practice; thus, providing a bridge between critical theory, philosophy, and social work. Each chapter showcases the work of a specific critical educational, philosophical and/or social theorist including: Henry Giroux, Michel Foucault, Cornelius Castoriadis, Herbert Marcuse, Paulo Freire, bell hooks, Joan Tronto, Iris (...) Marion Young, Karl Marx, Antonio Gramsci and many others to elucidate the ways in which their key pedagogic concepts can be applied to specific aspects of social work education and practice. The text exhibits a range of research-based approaches to educating social work practitioners as agents of social change. It provides a robust and much needed, alternative paradigm to the technique-driven ‘conservative revolution’ currently being fostered by neoliberalism in both social work education and practice. The volume will be instructive for social work educators who aim to teach for social change, by assisting students to develop counter-hegemonic practices of resistance and agency, and reflecting on the pedagogic role of social work practice more widely. La genèse de la construction médicale de la ménopause est ici appréhendée en croisant des approches empruntées à l’histoire sociale des savoirs. Cela conduit en premier lieu à revenir sur la variété des termes employés pour désigner la « cessation des règles ». Ces évolutions doivent être examinées en regard des nouvelles échelles de la vie humaine élaborées au cours de la période. Est-ce qu’une sexuation des âges de la vie, absente jusque-là, y transparaît? L’expression « âge de retour » (...) désigne-t-elle un âge propre aux femmes comme le laissent penser certains auteurs? La médicalisation de la ménopause peut ainsi être remise en perspective, avant d’étudier de plus près les temps forts de sa construction au cours de la période considérée (1770-1836). Enfin, un dernier volet questionne l’existence d’un discours sur l’âge de retour au masculin et analyse la fabrique des asymétries sexuées dans les dispositifs hygiénistes destinés aux quarantenaires et aux cinquantenaires des deux sexes.
