Die allogene Transplantation von Blutstammzellen aus dem Körper von Kindern, die der Spende nicht selbst zustimmen können, in den Körper eines kranken Geschwisterkindes wirft schwierige ethische Fragen auf. Wie kann ein risikobehafteter, fremdnütziger medizinischer Eingriff ethisch gerechtfertigt werden? In dieser Arbeit werden Argumente kritisch untersucht, nach denen das Spenderkind eine Pflicht habe, bei der Transplantation mitzumachen. Die Idee der Pflicht ist nachvollziehbar aus der Perspektive der Eltern, die zwar in einem Fürsorgekonflikt sind (ein Kind zu Gunsten der Rettung des anderen (...) verletzen zu müssen), aber selbst eine Pflicht haben, für das Leben des kranken Kindes zu kämpfen. Eine Analyse des Pflichtbegriffs zeigt jedoch, dass die Erfüllung einer Pflicht daran gebunden ist, entscheidungskompetent zu sein. Drei Wege werden untersucht, eine solche Pflicht dennochzuzuschreiben: i) die Eltern übertragenihre Pflicht auf das Kind; ii) die Interessen des Spenderkindes implizieren eine Pflicht; iii) Geschwisterkinder haben aufgrund ihrer vertrauten Familienbeziehungen Pflichten untereinander, die auch die Pflicht zu spenden beinhalten. Alle drei Zuschreibungsstrategien werden als unhaltbar kritisiert. Das Ergebnis lautet, dass die Pflicht, einem Geschwisterkind Körpergewebe zu spenden, einem nicht-einwilligungsfähigen Kind nicht zugeschrieben werden kann. Andere philosophische Ansätze zur Stammzellspende von Kindern an Familienangehörige müssten entwickelt und geprüft werden. (shrink)

The aim of this article is to investigate whether choosing the appropriate referring expression requires taking into account the hearer’s perspective, as is predicted under some versions of bidirectional Optimality Theory but is unexpected under other versions. We did this by comparing the results of 25 young and 25 elderly adults on an elicitation task based on eight different picture stories, and a comprehension task based on eight similar written stories. With respect to the elicitation task, we found that elderly (...) adults produce pronouns significantly more often than young adults when referring to the old topic in the presence of a new topic. With respect to the comprehension task, no significant differences were found between elderly and young adults. These results support the hypothesis that speakers optimize bidirectionally and take into account hearers when selecting a referring expression. If the use of a pronoun will lead to an unintended interpretation by the hearer, the speaker will use an unambiguous definite noun phrase instead. Because elderly adults are more limited in their processing capacities, as is indicated by their smaller working memory capacity, as speakers they will not always be able to reason about the hearer’s choices. As a result, they frequently produce non-recoverable pronouns. (shrink)

According to conventionalist accounts of personal identity, persons are constituted in part by practices and attitudes of certain sorts of care. In this paper, we concentrate on the most well-developed and defended version of conventionalism currently on offer (namely, that proposed by David Braddon-Mitchell, Caroline West, and Kristie Miller) and discuss how the conventionalist appears forced either (1) to accept arbitrariness concerning from which perspective to judge one's survival or (2) to maintain egalitarianism at the cost of making “transfiguring” decisions (...) such as Pascal's Wager rationally intractable. We consider three ways the egalitarian conventionalist could make these choices tractable and show that each one comes at significant cost to the view. We end the paper by considering whether accepting arbitrariness would be a better move for the conventionalist and conclude that, even here, she runs the risk of transfiguring choices being rationally intractable. Development of ontology development tools and ontology-enhanced software applications requires thorough understanding of ontology languages in order to implement them according to their specification. We present a formal specification of the ontologies part of the Web Services Modeling Language WSML documentation as a conceptual model in ORM2. Such an approach abstracts the semantics about ontological constructs, axioms, and properties from their implementation in arbitrary formats, thereby making the model easily understandable and reusable. This formal model in ORM2, which is understandable (...) by both logician and software developer, can be used as any other conceptual model to develop applications, thereby ensuring smooth transition from theory to implementations that are faithful to the theory. Centred on the diaries of Violet Thompson and Betty Whitla-Lucas, this exploratory paper self-reflexively plots key feminist problematics of integrating the personal with scholarship, while also enacting and working them through. By addressing my own familial connection to the archive, I explore the experience of using personal material within scholarship. Considering the increased incorporation of personal narrative into feminist scholarship, I question what is at stake in the production and reception of women’s life-writing. I propose a model of motivation and (...) desire for the process of reading and writing of women’s life-narratives, probing the relationship of desire that exists between women. Returning to the archive, Violet’s and Betty’s records of pregnancy are read as sites of power relations, examining the existence of inter-discursive networks of empowerment that disrupt the dominant cultural precepts on female sexuality. In closing, I reflect upon the interplay of private fantasy with public history and imagine the potential for the disparate forms of women’s life-writing, not only as feminist interventions in the cultural field but as contributions to discussions on the nature of feminine inscriptions. Microaggressions are a new moral category that refers to the subtle yet harmful forms of discriminatory behavior experienced by members of oppressed groups. Such behavior often results from implicit bias, leaving individual perpetrators unaware of the harm they have caused. Moreover, microaggressions are often dismissed on the grounds that they do not constitute a real or morally significant harm. My goal is therefore to explain why microaggressions are morally significant and argue that we are responsible for their harms. I offer (...) a conceptual framework for microaggressions, exploring the central mechanisms used for identification and the empirical research concerning their harm. The cumulative harm of microaggressions presents a unique case for understanding disaggregation models for contributed harms, blame allocation, and individual responsibility within structural oppression. Our standard moral model for addressing cumulative harm is to hold all individual contributors blameworthy for their particular contributions. However, if we aim to hold people responsible for their unconscious microaggressions and address cumulative harm holistically, this model is inadequate. Drawing on Iris Marion Young's social connection model, I argue that we, as individual perpetrators of microaggressions, have a responsibility to respond to the cumulative harm to which we have individually contributed. This book provides an introduction to the emerging field of continental philosophy of religion by treating the thought of its most important representatives, including its appropriations by several thinkers in the United States. Part I provides context by examining religious aspects of the thought of Martin Heidegger, Emmanuel Levinas, and Jacques Derrida. Christina Gschwandtner contends that, although the work of these thinkers is not apologetic in nature, it prepares the ground for the more religiously motivated work of more recent (...) thinkers by giving religious language and ideas some legitimacy in philosophical discussions. Part II devotes a chapter to each of the contemporary French thinkers who articulate a phenomenology of religious experience: Paul Ricoeur, Jean-Luc Marion, Michel Henry, Jean-Louis Chrétien, Jean-Yves Lacoste, and Emmanuel Falque. In it, the author argues that their respective philosophies can be read as an apologetics of sorts--namely, as arguments for the coherence of thought about God and the viability of religious experience--though each thinker does so in a different fashion and to a different degree. Part III considers the three major thinkers who have popularized and extended this phenomenology in the U.S. context: John D. Caputo, Merold Westphal, and Richard Kearney. The book thus both provides an introduction to important contemporary thinkers, many of whom have not yet received much treatment in English, and also argues that their philosophies can be read as providing an argument for Christian faith. This paper argues that the dirty hands literature has overlooked a crucial distinction in neglecting to discuss explicitly the issue of, what I call, symmetry. This is the question of whether, once we are confronted with a dirty hands situation, we could emerge with our hands clean depending on the action we choose. A position that argues that we can keep our hands clean I call “asymmetrical” and one that says that we will get our hands dirty no matter what (...) we do I call “symmetrical”. Not acknowledging this distinction is a problem because, firstly, it adds to the existing confusions about how best to define what dirty hands are. Secondly, it prevents the concept of dirty hands from being applied properly to other contexts such as, for example, the responsibility and accountability of politicians. I argue that we have good reason to favour a symmetrical understanding because it gives a more convincing account of what makes an action dirty and because it more accurately captures our complex moral decision-making when faced with dirty hands situations. The paper concludes by outlining possible implications that the distinction between the symmetry view and the asymmetry view has on wider debates surrounding the problem of dirty hands. (shrink)

In this paper, I present and explore some ideas about how factive emotional states and factive perceptual states each relate to knowledge and reasons. This discussion will shed light on the so-called ‘perceptual model’ of the emotions.

This article contends that environmental organisations vary in type, scale and purpose in ways that help stewards self-sort into the opportunities that align with their individual motivations and environmental concerns. To explore these potential links between personal motivations and environmental organisational attributes, we rely on descriptive and inferential statistics from surveys of two partner environmental organisations: one local scale community based-organisation and one a broader scale environmental non-profit organisation, both located in Central Texas, USA. These partners were selected based on (...) their compatible pro-environmental missions but disparate spatial scales of operation. The survey results (n=377) revealed meaningful between-organisation differences in volunteer environmental stewards, which raise the possibility of a ‘First Law of Environmental Stewardship’ whereby all stewards are related (by their values), but stewards in the same organisation are more related than stewards in different organisations. These findings expose some of the nuances of environmental volunteerism by highlighting connections between personal motivations, geographic scale, and organisation type. (shrink)

This paper considers three arguments by David Shugarman and Maureen Ramsay for why dirty hands cannot be democratic. The first argues that it is contradictory, in principle, to use undemocratic means to pursue democratic ends. There is a conceptual connection between means and ends such that getting one’s hands dirty is incompatible with acting in accordance with democratic ends. The second claims that using dirty-handed means, in practice, will undermine democracy more than it promotes it and therefore cannot be justified. (...) The final criticism states that politicians with dirty hands are a sign that politics is no longer meeting the criteria necessary to be called democratic. The paper shows that such rejections of democratic dirty hands are based on misunderstandings of the nature of dirty hands and democratic politics. (shrink)

Positive emotions are highly valued and frequently sought. Beyond just being pleasant, however, positive emotions may also lead to long-term benefits in important domains, including work, physical health, and interpersonal relationships. Research thus far has focused on the broader functions of positive emotions. According to the broaden-and-build theory, positive emotions expand people’s thought–action repertoires and allow them to build psychological, intellectual, and social resources. New evidence suggests that positive emotions—particularly gratitude—may also play a role in motivating individuals to engage in (...) positive behaviors leading to self-improvement. We propose and offer supportive evidence that expressing gratitude leads people to muster effort to improve themselves via increases in connectedness, elevation, humility, and specific negative states including indebtedness. This book is an unusually readable and lucid account of the development of Derrida's work, from his early writings on phenomenology and structuralism to his most recent interventions in debates on psychoanalysis, ethics and politics. Christina Howells gives a clear explanation of many of the key terms of deconstruction - including differance, trace, supplement and logocentrism - and shows how they function in Derrida's writing. She explores his critique of the notion of self-presence through his engagement with Husserl, and (...) his critique of humanist conceptions of the subject through an account of his ambivalent and evolving relationship to the philosophy of Sartre. The question of the relationship between philosophy and literature is examined through an analysis of the texts of the 1970s, and in particular Glas, where Derrida confronts Hegel's totalizing dialectics with the fragmentary and iconoclastic writings of Jean Genet. The author addresses directly the vexed questions of the extreme difficulty of Derrida's own writing and of the passionate hostility it arouses in philosophers as diverse as Searle and Habermas. Background: Ethical nursing practice is increasingly challenging, and strategies for addressing ethical dilemmas are needed to support nurses’ ethical care provision. Conscientious objection is one such strategy for addressing nurses’ personal, ethical conflicts, at times associated with conscience. Exploring both conscience and conscientious objection provides understanding regarding their implications for ethical nursing practice, research, and education. Research aim: To analyze the concepts of conscience and conscientious objection in the context of nurses. Design: Concept analysis using the method by Walker and (...) Avant. Research context: Data were retrieved from Philosopher’s Index, PubMed, and CINAHL with no date restrictions. Ethical consideration: This analysis was carried out per established, scientific guidelines. Findings: Ethical concepts are integral to nursing ethics, yet little is known about conscientious objection in relation to conscience for nurses. Of note, both concepts are well established in ethics literature, addressed in various nursing codes of ethics and regulatory bodies, but the meaning they hold for nurses and the impact they have on nursing education and practice remain unclear. Discussion and conclusion: This article discusses the relevance of conscience and conscientious objection to ethical nursing practice and proposes a model case to show how they can be appreciated in the context of nurses. Conscientious objection is an option for ethical transparency for nurses but is situated in contentious discussions over its use and has yet to be fully understood for nursing practice. Conscience is an element in need of more exploration in the context of conscientious objection. Further research is warranted to understand how nurses respond to conscience concerns in morally, pluralistic nursing contexts. (shrink)

The global segmentation of production and distribution has resulted in highly complex global value chains where vertical and horizontal dynamics are equally important in determining working conditions and providing points of leverage for labour. Borrowing notions of multi-level governance, we propose an analytical framework for describing and explaining success and failure of labour agency when attempting to improve working conditions along GVCs. Our starting point is that the high complexity of GVCs and the absence of a global overarching authority have (...) been balanced by the emergence of governance mechanisms of different forms and at different levels. An assessment of these mechanisms, which emphasize process over institutions, reveals how different types of interactions and interdependencies along GVCs impact on labour’s use of power. We argue that, in order to fully situate labour agency within governance debates, any future research agenda needs to be driven by micro-level bottom-up approaches. (shrink)

Background: While conscientious objection is a well-known phenomenon in normative and bioethical literature, there is a lack of evidence to support an understanding of what it is like for nurses to make a conscientious objection in clinical practice including the meaning this holds for them and the nursing profession. Research question: The question guiding this research was: what is the lived experience of conscientious objection for Registered Nurses in Ontario? Research design: Interpretive phenomenological methodology was used to gain an in-depth (...) understanding of what it means to be a nurse making a conscientious objection. Purposive sampling with in-depth interview methods was used to collect and then analyze data through an iterative process. Participants and research context: Eight nurse participants were interviewed from across practice settings in Ontario, Canada. Each participant was interviewed twice over 9 months. Ethical considerations: This study was conducted in accordance with Health Science Research Ethics Board approval and all participants gave consent. Findings: Six themes emerged from data analysis: encountering the problem, knowing oneself, taking a stand, alone and uncertain, caring for others, and perceptions of support. Discussion: This study offers an initial understanding of what it is like to be a nurse making a conscientious objection in clinical practice. Implications for nursing practice, education, policy, and further research are discussed. Conclusion: Addressing ethical issues in nursing practice is complex. The need for education across nursing, healthcare disciplines and socio-political sectors is essential to respond to nurses’ ethical concerns giving rise to objections. Conscience emerged as an informant to nurses’ conscientious objections. The need for morally inclusive environments and addressing challenging ethical questions as well as the concept of conscience are relevant to advancing nursing ethics and ethical nursing practice. The phenomenon and implications of stigma have been recognized across many contexts and in relation to many discrete issues or conditions. The notion of spatial stigma has been developed within stigma literature, although the importance and relevance of spatial stigma for rural places and rural people have been largely neglected. This is the case even within fields of inquiry like public and rural health, which are expansively tasked with addressing the socio-structural drivers of health inequalities. In this paper, we argue (...) that developing a better understanding of rural place stigma is critical for addressing contemporary patterns of spatial injustice and health inequalities affecting rural communities globally. Drawing on international literature and examples from the reported experiences of rurally living Australians and news and other media, we present an analysis highlighting the power in rural place stigma. In doing so, we build a case for the relevance and importance of interrogating rural place stigma, especially in the fields of public and rural health, for changing the conditions within—and the broader positioning of—the rural in the public and political landscapes. Socialist society is a society whose basic economic law and goal is the fullest possible satisfaction of human needs. Proceeding from this, the Twenty-fourth Congress of the CPSU set a course for a more profound turn in the economy toward solution of the various tasks related to improving the well-being of Soviet people, not only for the five-year plan period but also as the general orientation of the economic development of the country for the long term.

Academics across widely ranging disciplines all pursue knowledge, but they do so using vastly different methods. Do these academics therefore also have different ideas about when someone possesses knowledge? Recent experimental findings suggest that intuitions about when individuals have knowledge may vary across groups; in particular, the concept of knowledge espoused by the discipline of philosophy may not align with the concept held by laypeople. Across two studies, we investigate the concept of knowledge held by academics across seven disciplines (N (...) = 1,581) and compare these judgments to those of philosophers (N = 204) and laypeople (N = 336). We find that academics and laypeople share a similar concept of knowledge, while philosophers have a substantially different concept. These experiments show that (a) in contrast to philosophers, other academics and laypeople attribute knowledge to others in some “Gettier” situations; (b) academics and laypeople are much less likely to attribute knowledge when reminded of the possibility of error, but philosophers are not affected by this reminder; and (c) non‐philosophy academics are overall more skeptical about knowledge than laypeople or philosophers. These findings suggest that academics across a wide range of disciplines share a similar concept of knowledge, and that this concept aligns closely with the intuitions held by laypeople, and differs considerably from the concept of knowledge described in the philosophical literature, as well as the epistemic intuitions of philosophers themselves.
