Many jurisdictions prohibit or severely restrict the use of evidence about a defendant’s character to prove legal culpability. Situationists, who argue that conduct is largely determined by situational features rather than by character, can easily defend this prohibition. According to situationism, character evidence is misleading or paltry. -/- Proscriptions on character evidence seem harder to justify, however, on virtue ethical accounts. It appears that excluding character evidence either denies the centrality of (...) character for explaining conduct—the situationist position—or omits probative evidence. Situationism is, after all, presented as antithetical to virtue ethics. -/- This essay provides a virtue ethical defense of character evidence exclusion rules. We show that existing virtue ethical rebuttals to situationism themselves support prohibitions on character evidence; even if behavior arises from stable character traits, character evidence should be prohibited. In building our case, we provide a taxonomy of kinds of character judgment and reconcile the ubiquity and reasonableness of character judgments in ordinary life with the epistemic legitimacy of character evidence prohibitions in law. The question addressed here is whether evidence concerning defendants' past criminal records should be introduced at their trials because such evidence reveals their character and thus reveals whether they are the kinds of persons likely to have committed the crimes with which they are currently charged. I strongly caution against the introduction of such evidence for a number of reasons. First, the link between defendants' past criminal records and claims about their standing dispositions to think and (...) act is tenuous, at best. Second, noncharacter, or trace, evidence should have primacy in determining the guilt or innocence of defendants. Third, character evidence will vary in its freshness and specificity. Other things being equal, only relatively fresh and specific character evidence has probative value. Moreover, such evidence will have greater probative value in criminal cases where the issue before the court is whether a crime has been committed than in cases where the issue is whether it was the defendant who committed the crime. Finally, we might be more sanguine about the introduction of fresh and specific character evidence under conditions likely to work against its misuse or misinterpretation. However, the relevant conditions may not often be satisfied in the real world of criminal trials and defendants. (shrink)

Cognitive research on Ego-Reference-Point models of time in English traditionally shows that “FUTURE IS IN FRONT OF EGO” and “PAST IS IN BACK OF EGO.” Recently, however, this view has been challenged by other results, showing that there exists a major static model of time wherein “FUTURE IS IN BACK OF EGO” and “PAST IS IN FRONT OF EGO.” However, evidence for both conceptual systems comes predominantly from linguistic and gestural forms of expression. For instance, convincing empirical evidence (...) coming from the manifestation mode of cinema is still lacking. This article attempts to fill this gap by bringing the discussion of temporal metaphors to the foreground of character subjectivity in film. Using concise case-studies taken from various films, this study provides evidence that a majority of flashback scenes seem to base their conceptions of time on a static Ego-Reference-Point model in which the past appears to be in front of the character’s eyes on screen. We examine Galileo's theory of evidence as presented in his Dialogue on the Two Chief World Systems. It is argued that for Galileo evidence not only had to be tied to the senses, but, that for purposes of evidential relevance, epistemologically significant experience is only of terrestrial objects and events. This account forms the first part of an argument for understanding Galileo as an instrumentalist. The second part of the argument consists in examining Galileo's views on the limits (...) of knowledge. Given his conviction that we cannot know everything and his requirement that evidence be tied to terrestrial phenomena, claims for instrumentalism seem warranted. (shrink)

I argue for the thesis that causal evidence is context-dependent. The same causal claim may be warranted by the same piece of evidence in one context but not another. I show this in particular for the type of causal evidence characteristic of the manipulability theory defended by Woodward (Making things happen: a theory of causal explanation. Oxford University Press, Oxford, 2003). My thesis, however, generalises to other theories—and at the end of the paper I outline the generalization (...) to counterfactual theories. The paradigmatic form of causal evidence in the manipulability theory is provided by tests of the functional invariance of the relation between putative cause and effect under interventions (on the putative cause). I show that such evidence exhibits at least two kinds of context-relativity: personal, or epistemic; and situational, or objective. (shrink)

In this chapter, I will discuss employing exemplars in moral and character education promoting virtue development with the involvement of embodiment. Virtue ethicists propose two phases of virtue development: early virtue habituation and later phronesis cultivation. I will overview prior research on the mechanism of habituation at the biological and neural levels to examine why embodiment is fundamental during the first phase, virtue habituation. Then, I will review recent philosophical and psychological studies about the nature of phronesis, i.e., practical (...) wisdom, to consider how educational activities cultivate it. Based on these preliminary examinations of the course of virtue development, I will examine the previous literature about the role and importance of using exemplars in moral and character education involving concrete and interactive activities with the exemplars involving embodiment during the learning process. Finally, I will draw upon the Self-determination theory about supporting students’ need for autonomy, competence, and relatedness to consider a way to improve the effectiveness of exemplar-applied education along with embodiment. After examining the relevant theoretical frameworks mentioned above, I will discuss several practical guidelines for using exemplars involving character embodiment for virtue development. (shrink)

Using evidence from experimental psychology, some social psychologists, moral philosophers and organizational scholars claim that character traits do not exist and, hence, that the philosophical tradition of virtue ethics is empirically inadequate and should dispose of the notion of character to accommodate the empirical evidence. In this paper, I systematically address the debate between dispositionalists and situationists about the existence, status and properties of character traits and their manifestations in human behavior, with the ultimate goal (...) of responding to the question whether virtue ethicists need to abandon the very enterprise of building a character-based moral theory in business ethics and organizational behavior. In the course of this paper, I shall defend the claim that the situationist argument relies on a misinterpretation of the experimental evidence. (shrink)

With two eye movements tracking experiments, present study sought to establish whether predictability of target words facilitate characters processing in Chinese reading. Target Words embedded in sentences in both experiments were composed by 2 Chinese characters. Predictability of target words were manipulated in both experiments, beyond that, frequency of targets' first characters were manipulated in Experiment 1, frequency of targets' second characters were manipulated in Experiment 2. Pervasive predictability effects were observed on almost all of eye movement measures in both (...) experiments. It also yield reliable characters frequency effect in Experiment 1 & 2, on some measures. None reliable interaction effects of predictability and first character frequency were observed in Experiment 1, but predictability and second character frequency interactively impacted on some measures of eye movement. The use of character in the criminal trial raises a number of controversial issues such as the nature of criminal responsibility, the link between past and future behaviour, and the way juries and judges reason about evidence of prior wrongdoing. This book reassesses and reflects on the significance of the law's increasing emphasis on character.

Philosophers have recently argued that traditional discussions of virtue and character presuppose an account of behaviour that experimental psychology has shown to be false. Behaviour does not issue from global traits such as prudence, temperance, courage or fairness, they claim, but from local traits such as sailing-in-rough-weather-with-friends-courage and office-party-temperance. The data employed provides evidence for this view only if we understand it in the light of a behaviourist construal of traits in terms of stimulus and response, rather than (...) in the light of the more traditional construal in terms of inner events such as inclinations. More recent experiments have shown this traditional conception to have greater explanatory and predictive power than its behaviourist rival. So we should retain the traditional conception, and hence reject the proposed alteration to our understanding of behaviour. In Chinese orthography, the most common character structure consists of a semantic radical on the left and a phonetic radical on the right ; the minority, opposite arrangement also exists. Recent studies showed that SP character processing is more left hemisphere lateralized than PS character processing. Nevertheless, it remains unclear whether this is due to phonetic radical position or character type frequency. Through computational modeling with artificial lexicons, in which we implement a theory of hemispheric asymmetry (...) in perception but do not assume phonological processing being LH lateralized, we show that the difference in character type frequency alone is sufficient to exhibit the effect that the dominant type has a stronger LH lateralization than the minority type. This effect is due to higher visual similarity among characters in the dominant type than the minority type, demonstrating the modulation of visual similarity of words on hemispheric lateralization. Five experiments provide evidence for a class of ‘dual character concepts.’ Dual character concepts characterize their members in terms of both (a) a set of concrete features and (b) the abstract values that these features serve to realize. As such, these concepts provide two bases for evaluating category members and two different criteria for category membership. Experiment 1 provides support for the notion that dual character concepts have two bases for evaluation. Experiments 2-4 explore the claim (...) that dual character concepts have two different criteria for category membership. The results show that when an object possesses the appropriate concrete features, but does not fulfill the appropriate abstract value, it is judged to be a category member in one sense but not in another. Finally, Experiment 5 uses the theory developed here to construct artificial dual character concepts and examines whether participants react to these artificial concepts in the same way as naturally occurring dual character concepts. The present studies serve to define the nature of dual character concepts and distinguish them from other types of concepts (e.g., natural kind concepts), which share some, but not all of the properties of dual character concepts. More broadly, these phenomena suggest a normative dimension in everyday conceptual representation. (shrink)

Despite the flourishing of positive education, understanding of whether different character strengths have different predictive effects on academic achievement/ well-being and the mechanisms of actions between character strengths is limited. Specifically, this study adopted strength use as a mediator to understand well how character strength (assessed by caring, inquisitiveness, and self-control) is associated with students’ end-of-year academic achievements and well-being. Survey data from 349 adolescents from three different schools showed that three factors of character strengths have (...) positive correlations with academic achievements and well-being. Regression models indicated that inquisitiveness and self-control predicted academic achievements, while caring, inquisitiveness, and self-control predicted well-being, with the foremost as the strongest predictor. Mediation analyses indicated that (1) strengths use fully mediated the relationship between inquisitiveness, self-control, and academic achievements/well-being, while (2) caring had a direct effect on well-being. These findings provided possible explanations on how character strengths could affect students’ academic achievements or well-being and theoretical and empirical evidence for practices that aim to enhance students’ academic achievements and positive developments via interventions based on character strengths. In Values and the Reflective Point of View (2006), Robert Dunn defends a certain expressivist view about evaluative beliefs from which some implications about self-knowledge are explicitly derived. He thus distinguishes between an observational and a deliberative attitude towards oneself, so that the latter involves a purely first-person point of view that gives rise to an especially authoritative, but wholly non-observational, kind of self-knowledge. Even though I sympathize with many aspects of Dunn's approach to evaluative beliefs and also with his (...) stress on the practical significance of self-knowledge, I argue that his proposal seriously misinterprets the role of observation and evidence within the first-person point of view and, derivatively, in the formation of evaluative beliefs. John Doris has recently argued that since we do not possess character traits as traditionally conceived, virtue ethics is rooted in a false empirical presupposition. Gopal Sreenivasan has claimed, in a paper in Mind, that Doris has not provided suitable evidence for his empirical claim. But the experiment Sreenivasan focuses on is not one that Doris employs, and neither is it relevantly similar in structure. The confusion arises because both authors use the phrase ‘cross-situational consistency’ to describe the (...) aspect of character traits that they are concerned with, but neither defines this phrase, and it is ambiguous: Doris uses it in one sense, Sreenivasan in another. Partly for this reason, the objections Sreenivasan raises fail to block the argument Doris provides. In particular, the most reliable data Doris employs, Milgram’s famous study of authority, is entirely immune to Sreenivasan’s objections. Sreenivasan has not shown, therefore, that Doris provides unsuitable evidence for his claim. (shrink)

Chinese characters are central to understanding how learners learn to read a logographic script. However, researchers know little about the role of character writing in reading Chinese as a second language (CSL). Unlike an alphabetic script, a Chinese character symbol transmits semantic information and is a cultural icon bridging embodied experience and text meaning. As a unique embodied practice, writing by hand contributes to cognitive processing in Chinese reading. Therefore, it is essential to clarify how Chinese character (...) writing (bodily activity), language distance (past language usage), and cultural background (bodily coupling with the environment) influence CSL reading proficiency. Based on extant research on L2 reading acquisition and strength of key theoretical perspectives of embodied cognition theory (ECT), this study tested a regression model for CSL reading involving individual-level factors (Chinese character writing proficiency [CCWP]) and group-level predictors (language distance and cultural background). This study collected big data in a sample of 74,362 CSL learners with 67 diverse L1s. Results of hierarchical linear modeling showed a significant effect of CCWP and significant language distance × CCWP interaction effect on reading proficiency; however, cultural background × CCWP interaction effect was not significant. These results conform to the ECT and indicate that bodily activity, past language usage, and cultural background aided reading. CCWP may benefit from withstanding the negative transfer from L1s. Furthermore, CCWP and cultural background are not synergistic predictors of reading. This study may open novel avenues for explorations of CSL reading development. (shrink)

Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. In recent years, much uncertainty and outright scepticism surrounds the notion of character. In the arts—painting, the novel, drama, film—the notion of character has receded into the background. The loss of character is especially conspicuous in those artistic forms in which it traditionally occupied centre-stage: drama, the novel, films. The withdrawal of character from the arts has in fact become a topic of debate in the theory and criticism of the arts. In the arts themselves, the (...) difficulty, if not the impossibility, of attaining character is a common subject. Since ordinary sentiments are readily reflected in the fine arts, it is natural to suspect that character is not held in high regard in everyday life. Even if we take a dim view of the suggestion that the arts mirror ordinary sentiments with little distortion, a decline in the importance of character is evident in other humane disciplines: history is a striking example. Indeed, if we attend to our major social institutions—the family, the courts, the bureaucracy—it would be difficult to point to any in which the question of character is more than a peripheral concern. Indeed, it appears that the appraisal of character is of central concern in modern society only when the individual is in some way beyond the pale: in institutions of punishment, rehabilitation, mental health. This paper introduces a body of research on Organizational Behavior and Industrial/organizational Psychology that expands the range of empirical evidence relevant to the ongoing character-situation debate. This body of research, mostly neglected by moral philosophers, provides important insights to move the debate forward. First, the OB/io scholarship provides empirical evidence to show that social environments like organizations have significant power to shape the character traits of their members. This scholarship also describes some of the mechanisms through (...) which this process of reshaping character takes place. Second, the character-situation debate has narrowly focused on situational influences that affect behavior episodically and haphazardly. The OB/io research, however, highlights the importance of distinguishing such situational influences from influences that, like organizational influences, shape our character traits because they are continuous and coordinated. Third, the OB/io literature suggests that most individuals display character traits that, while local to the organization, can be consistent across situations. This puts pressure on the accounts of character proposed by traditional virtue ethics and situationism and provides empirical support to interactionist models based on cognitive-affective processing system theories of personality. Finally, the OB/io literature raises important challenges to the possibility of achieving virtue, provides valuable and untapped resources to cultivate character, and suggests new avenues of normative and empirical research. Gilbert Harman claims that we would be better off if we abandoned appeal to character in order to explain action. He argues that the idea of character is a hangover from folk psychology and conflicts with the more reliable evidence of experimental psychology. The cash value of abandoning any appeal to character is given in the following terms: appeals to character reinforce our stereotyping and general misunderstanding of others, abandoning it will help to improve the (...) quality of our understanding of others. What follows will be part contrast and part argument. My concern will be to reject Harman’s character scepticism by resisting his account of what it is to have a character trait. He fails to give desire its due. To set out a contrasting desire-centred view I will draw upon Iris Murdoch. The paper concludes by challenging Harman’s treatment of the experimental evidence. This paper defends the following principle: For any visually perceptible set of objects and any visual phenomenal character, there could be a veridical perception of exactly those objects with that character. This principle is rejected by almost all contemporary theories of perception, yet rarely addressed directly. Many have taken the apparent inconceivability of a certain sort of “shape inversion” — as compared to the more plausible, frequently discussed “color inversion” — as evidence that the spatial characters of (...) our perceptions are uniquely suited to and/or revelatory of the structure of their objects, such that alleged perceptions of those objects that differed radically in spatial character could not be veridical. I argue that these conclusions are unjustified: I claim that the difficulty involved in constructing coherent “shape inversion” scenarios is attributable to the complex relations among visual and tactile shape experiences, as opposed to relations between shape experiences and worldly shape properties. Considerations of scientific evidence are often thought to provide externalism with the dialectical upper hand in the internalism–externalism debate. How so? A couple of reasons are forthcoming in the literature. (1) Williamson (2000) argues that the E = K thesis (in contrast to internalism) provides the best explanation for the fact that scientists appear to argue from premises about true propositions (or facts) that are common knowledge among the members of the scientific community. (2) Kelly (Philosophy Compass, 3 (5), (...) 933–955, 2008; 2016) argues that only externalism is suited to account for the public character of scientific evidence. In this article, I respond to Williamson and Kelly’s arguments. First, I show that the E = K thesis isn’t supported by the way in which we talk about scientific evidence, and that it is unable to account for facts about what has been regarded as scientific evidence and as justified scientific belief in the history of science. Second, I argue that there are internalist views that can account for the publicity of scientific evidence, and that those views indeed do better in that regard than the (externalist) view proposed by Kelly. The upshot is that considerations of scientific evidence do not favor externalism over internalism. (shrink)

If God exists, where can we find adequate evidence for God's existence? In this book, Paul Moser offers a new perspective on the evidence for God that centers on a morally robust version of theism that is cognitively resilient. The resulting evidence for God is not speculative, abstract, or casual. Rather, it is morally and existentially challenging to humans, as they themselves responsively and willingly become evidence of God's reality in receiving and reflecting God's moral (...) class='Hi'>character for others. Moser calls this 'personifying evidence of God,' because it requires the evidence to be personified in an intentional agent - such as a human - and thereby to be inherent evidence of an intentional agent. Contrasting this approach with skepticism, scientific naturalism, fideism, and natural theology, Moser also grapples with the potential problems of divine hiddenness, religious diversity, and vast evil. Tracking representationalism is the theory that phenomenal consciousness is a matter of tracking physical properties in an appropriate way. This theory holds that phenomenal character can be explained in terms of representational content, and it also entails that there is unlikely to be a strong correlation between phenomenal character and neural states. However, the empirical evidence shows that both claims cannot be true. So, tracking representationalism is wrong. Its fault is due to ignoring the internal correlation of (...) experience, the existence of which shows that phenomenal character is shaped by neural states to a large extent, so it cannot be wholly explained by representational content. A lot is at stake in character judgment. How we treat others is influenced by what kinds of persons we take them to be. Our rational plans of life depend upon our insights into our own character and the character of those close to us. Given the importance of the way we judge character, the virtues and vices of character judgment deserve much closer attention than they have received in the philosophical literature. Some philosophers have (...) discussed duties of friendship and how they impact upon the beliefs and judgments of friends. However, virtue theorists have had little to say about the specific virtues and vices of character judgment. This is odd because habits of character judgment are themselves very important aspects of character. We may develop good habits of judgment or bad. We may judge character with diligence and respect for evidence or with thoughtless haste. We may judge others fairly or in selfserving ways, with good motives or bad. The neglect of the virtues and vices of character judgment is especially odd because there is a philosophically troubling tension between apparently virtuous ways in which we may judge character. Should we judge others with clear-eyed impartiality, or is there a role for kindness and sympathy in the judgment of others? Both ways seem to constitute the exercise of a virtue, but on occasions, they pull in opposite directions. (shrink)

Neo‐Aristotelian virtue ethics makes essential reference to the notion of a stable, robust character‐trait. It also claims to be constrained by at least a minimal degree of psychological realism. Recent developments in empirical psychology have drawn into question the evidence for the existence of such robust traits, arguing that it rests on what has been called a ‘fundamental attribution error’. Virtue ethics has thus seemingly been made vulnerable to criticisms that it is essentially dependent on an erroneous, folk‐psychological, (...) notion of character and, so, must either abandon their characteristic notion of virtue or forego any pretensions to psychological realism. I develop a two‐pronged response to this objection. First, I argue that there is reason to question much of the empirical evidence and that such evidence as does exist can easily be accommodated by virtue ethics. Next, I argue that even if we allow that neo‐Aristotelian virtue ethical theories does sometimes presuppose a stronger conception of character‐traits than is warranted by the evidence, this does not significantly undermine the virtue ethicist's project. The increased demand for evidence-based medicine has proven much more challenging for psychiatry to accept than for medicine in general. Among the concerns is a perception that EBM does not respond appropriately to the character and complexity of psychiatric disorders and treatments, that the concept of ‘evidence’ is too narrowly construed, and that it may encourage a false sense of competence. It has also been claimed that EBM may encourage a kind of ‘cookbook medicine,’ leaving out tacit (...) knowledge and the empathic and caring aspects of the psychiatrist– patient relationship. The relation of normic support offers a novel solution to the proof paradox: a paradox in evidence law arising from legal cases involving merely statistical evidence (Smith 2018). Central to the normic support solution has been the thesis that merely statistical evidence cannot confer normic support. However, it has been observed that there are exceptions to this: there exist cases where merely statistical evidence can give rise to normic support (Blome-Tillmann 2020). If correct, this fact seems (...) to undermine the normic support solution to the proof paradox. This paper explores a resolution: normic support can resolve the proof paradox even though merely statistical evidence sometimes gives rise to normic support. The key to understanding this resolution lies with a source of evidential support that arises out of bodies of evidence that involve *character evidence* (Colyvan, et al. 2001). It turns out that character evidence can provide normic support when it is grounded in our knowledge of a certain kind of disposition individuals can have: *goal-directed dispositions*. The upshot is the recovery of the normic support solution to the puzzle of whether statistical evidence can meet legal standards of proof. (shrink)

I advance an account of quantitative character, a species of phenomenal character that presents as an intensity (cf. a quality) and includes experience dimensions such as loudness, pain intensity, and visual pop-out. I employ psychological and neuroscientific evidence to demonstrate that quantitative characters are best explained by attentional processing, and hence that they do not represent external qualities. Nonetheless, the proposed account of quantitative character is conceived as a compliment to the reductive intentionalist strategy toward qualitative (...) states; I argue that an account of perceptual experience that combines a tracking account of qualitative character with my functionalist proposal for quantitative character permits replies to some notoriously difficult problems for tracking representationalism without sacrificing its chief virtues. This article studies the moral metaphor system focusing on a subsystem consisting of five pairs of MORAL and IMMORAL metaphors whose source concepts represent some contrastive categories in our visual experience: WHITE and BLACK, LIGHT and DARK, CLEAR and MURKY, CLEAN and DIRTY, PURE and IMPURE. The study examines whether these moral metaphors are manifested in Chinese and English, looking for linguistic evidence in both languages. It is found that the studied moral metaphors are applicable in both languages at (...) varying degrees. This finding suggests that these metaphors may range from being widespread to being universal. The study then further analyzes them regarding whether they are primary or complex metaphors and whether they are equal in status, applying a decompositional approach to metaphor analysis. The result suggests that the moral metaphors under study are complex rather than primary metaphors, and that they are actually not equal in status, some depending on others in meaning making in our moral cognition. If the analysis is valid, the implications are: some conceptual metaphors are more fundamental than others, those that are more fundamental are more likely to be widespread or universal, and hypotheses can be made about conceptual metaphors based on in-depth analysis of their conceptual composition. The aim of the My Character project was to develop a better understanding of how interventions designed to develop character might enhance moral formation and futuremindedness in young people. Futuremindedness can be defined as an individual’s capacity to set goals and make plans to achieve them. Establishing goals requires considerable moral reflection, and the achievement of worthwhile aims requires character traits such as courage and the capacity to delay gratification. The research team developed two new educational interventions (...) – a website and a hard-copy journal – with the specific aim of developing future-mindedness. After development, the website and journal were piloted over a one-year period by over 1,000 11–14 year olds in six schools across England. Various research methods, including group interviews and case studies, were implemented to assess impact. In addition, a pilot RCT was conducted to assess the feasibility of using experimental methods to measure character. The main findings from the research are that: - Students benefit from opportunities in school to think about future-mindedness; this can be successfully taught through character education. - Harnessing new technology, such as the Internet, offers exciting opportunities for character education. - It is beneficial to investigate the impact of new character education resources in order to bring greater clarity about ‘what works’. The most useful approach is a mixed methods one that allows for triangulation of evidence. - It is possible to run RCTs and other experimental research in schools to assess developmental projects of this kind, but applying the method in schools and creating suitable outcome measures present challenges for researchers. - A positive indicator of the success is that five out of the six pilot schools have embedded My Character into their curriculum. In addition, many new schools, both in Britain and internationally, have started to use the website and / or journal. This report describes the research, analyses the impact of My Character and concludes with recommendations for policy makers, practitioners and researchers embarking on similar projects. These recommendations include: i) advocating that schools create space in the curriculum to teach future-mindedness through character education; ii) enhancing traditional character education teaching methods with opportunities brought by Internet technologies; iii) evaluating character education interventions using triangulated evidence drawn from a mixture of research methods. Freud justified his extensive theorizing about dreams by the observation that they were “the royal road” to something much more general: namely, our unconscious mental life. The current preoccupation with the theory of excuse in criminal law scholarship (including my own) can be given a similar justification, for the excuses are the royal road to theories of responsibility generally. The thought is that if we understand why we excuse in certain situations but not others, we will have also gained a (...) much more general insight into the nature of responsibility itself. Nowhere has this thought been more evident than in the century-old focus of criminal law theoreticians on the excuse of insanity, a focus that could not be justified by the importance of the excuse itself.In this paper I wish to isolate two theories of excuse, each of which instantiates its own distinctive theory of responsibility. One is what I shall callthe choice theory of excuse, according to which one is excused for the doing of a wrongful action because and only because at the moment of such action's performance, one did not have sufficient capacity or opportunity to make the choice to do otherwise. Such a choice theory of excuse instantiates a more general theory of responsibility, according to which we are responsible for wrongs we freely choose to do, and not responsible for wrongs we lacked the freedom (capacity and opportunity) to avoid doing. The second I shall callthe character theory of excuse, according to which one is excused for the doing of a wrongful action because and only because such action is not determined by (or in some other way expressive of) those enduring attributes of ourselves we call our characters. My thesis is that perceptual awareness is richly multisensory. I argue for this conclusion on the grounds that certain forms of multisensory perceptual experience are incompatible with the claim that each aspect of a perceptual experience is associated with some specific sensory modality or another. First, I explicate what it is for some feature of a conscious perceptual episode to be modality specific. Then, I argue based on philosophical and experimental evidence that some novel intermodal features are perceptible only (...) through the coordinated use of multiple senses. I appeal to cases that involve consciously perceptible feature instances and feature types that could not be perceptually experienced through the use of individual sense modalities working on their own or simply in parallel and co-consciously. Finally, I offer an account of how to type perceptual experiences by modality that makes room for richly multisensory experiences. (shrink)

According to philosophical situationists, empirical psychology suggests that most people are not virtuous, and that we should be skeptical about the possibility of cultivating virtue. I argue against the second claim by offering an empirically informed model of character formation. The model begins with ancient formational wisdom emphasizing emotion education, the practice of spiritual exercises, self-monitoring, and willpower, and is confirmed, nuanced, and supplemented by insights from recent empirical psychology. Many ancient philosophers, recent social psychologists, and philosophers of emotion (...) agree that emotions are central to moral cognition. I defend a perceptual account of emotion, and show how this account suggests a practical upshot that empirical psychologists tend not to emphasize, but that the ancients would endorse: emotion education should be a primary focus of character formation. I dilate on this practical point using the remediation of inappropriate anger as a test case. Taking my remedial cues from the Stoic and Christian traditions, I argue that training the emotions through self-monitoring, willpower, and the use of “spiritual exercises”—practices of mind and body whereby one digests the doctrines of one’s philosophical school, so that those doctrines are not matters of mere notional understanding, but actually take up residence in one’s vision of the world—provides hope for meaningful movement in the direction of virtue. The rigorous practice of spiritual exercises involves difficult work. To have much success, the moral trainee will need at least the seeds of what I call “remedial virtues”: character excellences that enable an agent to do the demanding work of re-cultivating her character. The remedial virtues include self-vigilance and the virtues of willpower. I develop empirically informed philosophical analyses of self-vigilance and the virtues of willpower, and offer empirical evidence to support the claim that they can be cultivated. Then I show how the remedial virtues can help us resist temptation, leverage temptation in the interest of further growth in character, and correct for the subtle situational forms of moral interference that situationists emphasize. Such questions concern the concrete ways in which God works in the lives of peoples of different religions, the unique and normative (...) role of Christ in the history of salvation, the function of non-Christian religions as mediations of salvation, and so on. And the debate on these issues rages on among Catholic as well as non-Catholic theologians! One wishes that Sullivan had given a fuller account of this debate which is central in interreligious dialogue. More directly connected with the method and approach of the book itself are the questions of dogmatic development and the hermeneutics of doctrines. To put it more concretely, was Leonard Feeney, with whose ironic fate the book opens and ends, simply expressing the ancient doctrine of the deposit of the faith concerning salvation in the Church in a negative and imperfect fashion? Or was he (and more importantly, popes and official teachers of the faith) wrong in affirming the exclusiveness implicit in the formula extra ecclesiam nulla salus (which apparently they did)? Kupperman's Character are "that character is of central importance to ethics and that ethical philosophy will have to be restructured once this is understood " (p. 3). The argument has three stages: the first three chapters explicate the notion of character and its relationship to the notions of the self and of responsibility; the next two consider the dominant, rival theories in contemporary ethics; the last two address the topics of value and the place of character in ethics. In two appendices, Kupperman applies the substantive conclusions of the work to the issues of moral psychology and the education of character. A brief review cannot communicate the many nuances of argument and the precise and lucid style that distinguish the book. While certain parts of the argument seem problematic, or at least in 698 BOOK REVIEWS need of further development, the work deserves the attention of professional ethicists and of inquisitive non-professionals. The opening chapter offers the following definition of character: "X's character is X's normal pattern of thought and action, especially with respect to concerns and commitments in matter affecting the hap· piness of others or of X, and most especially in relation to moral choices" (p. 17). In the second chapter, Kupperman considers three views: Enduring Self (ES), No Self (NS), and Constructed Self (CS). The ES appears to be seH-evidently true. But what exactly is the self and where is it to he found? It is difficult to fix the abiding " I " amid or behind the flux of our self-experience. On the other hand, even Hume's skepticism concerning the self presumes that " we know where to look " for it. The " I " is simultaneously obvious and elusive, stable and unstable (p. 40). Thus, both the ES and the NS are problematic, The third option is the Constructive Self, Kupperman holds that, as children, we begin with a "protoseH." The full-fledged self is often the result of orientations, habits, and traits of character developed before one has even begun deliberating about the kind of character one would like to have. Like the self, character is constructed mostly through unreflective choices. But this raises questions about responsibility, which is the focus of the third chapter. If we have not willed to be the sorts of persons we now are, how can we be held responsible for who we are or what we do? Actions do not " flow from character like water from a pipe " (p, 59). The theory and practice of contemporary comparative biology and phylogeny reconstruction (systematics) emphasizes algorithmic aspects but neglects a concern for the evidence. The character data used in systematics to formulate hypotheses of relationships in many ways constitute a black box, subject to uncritical assessment and social influence. Concerned that such a state of affairs leaves systematics and the phylogenetic theories it generates severely underdetermined, we investigate the nature of the criteria of homology and their application to character (...) conceptualization in the context of transformationist and generative paradigms. Noting the potential for indeterminacy in character conceptualization, we conclude that character congruence (the coherence of character statements) relative to a hierarchy is a necessary, but not a sufficient, condition for phylogeny reconstruction. Specifically, it is insufficient due to the lack of causal grounding of character hypotheses. Conceptualizing characters as homeostatic property cluster natural kinds is in accordance with the empirical practice of systematists. It also accounts for the lack of sharpness in character conceptualization, yet requires character identification and re-identification to be tied to causal processes. (shrink)

Throughout Western history there have been two sharply differentiated beliefs about the character of creativity. However, one of these beliefs—Judaeo-Christian and neo-Platonic—has occupied such a dominant position that the very existence of the other has been obscured and ignored. Yet the evidence for this second belief is no less extensive or vivid. It has never been formulated in the same way as the first and so has never constituted a tradition as such; yet it has existed over as (...) long a period of time and can therefore be called a tradition. Moreover, this second belief seems to bear a closer relation to the character of creativity displayed by people regarded as ‘creative’, as well as to what we have learnt about creativity in this century from psychologists. Attitudes to creativity in the modern period have generally been based on the first tradition, but the activities of creative people have borne out the validity of the second tradition. The attitudes, in other words, have been based on false expectations. To recover the lost tradition, therefore, may enable us to see more accurately what we may or may not achieve by being creative. This article is devoted to a phenomenological analysis and interpretation of the basic concepts involved in phenomenology. The first concept that deserves our attention is that of “apodicticity” along with the related concept of “apodictic evidence”. The next concept is that of “correlation,” which manifests its apodictic character in bringing together all transcendental facts. With the transition from traditional discourses to modern discourse, the concept of apodicticity continues to deepen; at the same time, it is accepted that some (...) metaphysical presuppositions continue to lurk at the foundation of this concept. Apodicticity, as the principle of knowledge, is an idea that lies in the infinity of universal experience, which includes both agreed and mismatched moments. This mismatch, in turn, refers to correlative connections between the transcendental Ego, the world and intersubjectivity. Transcendental subjectivity has a correlative nature, which is due to its self-transcending character, resulting in gaps and distinctions being found within subjectivity. (shrink)

Price commits the Fallacy of Novelistic Presumption. This is clearly evident to his earlier essay ["The Other Self"], but it is certainly implicit in "People of the Book." He assumes that the novel possesses a history that is independent of other modes of fiction and that it may be discussed independently of the history of literature. In this perspective, a specific element of the novel will seem validly detachable from literary history in general. I think that this is an error (...) and that if a theory of character should emerge, it will necessarily account for—go to the heart of—all instances of character, symbolic, allegorical, naturalistic, whether in the novel, in epic, in romance, in drama, or in lyric. This is a unique collection of new and recently-published articles which debate the merits of virtue-theoretic approaches to the core epistemological issues of knowledge and justified belief. The readings all contribute to our understanding of the relative importance, for a theory of justified belief, of the reliability of our cognitive faculties and of the individuals responsibility in gathering and weighing evidence. Highlights of the readings include direct exchanges between leading exponents of this approach and their critics.

Colleagues are not only an integral part of many people’s lives; empirical research suggests that having a good relationship with one’s colleagues is the single most important factor for being happy at work. However, so far, no one has provided a comprehensive account of what it means to be a colleague. To address this lacuna, we have conducted both an empirical as well as theoretical investigation into the content and structure of the concept ‘colleague.’ Based on the empirical evidence (...) that we present in this paper, we argue that ‘colleague’ is a dual character concept that has both a descriptive and a normative basis for categorization. Its descriptive dimension is characterized by three features, according to which two people are colleagues if they work for the same institution and know each other, or if they work for the same institution and work in the same field. An independent normative dimension is revealed, which shows that, as colleagues, we are expected to fulfill substantial normative expectations. Understanding the expectations that are encoded in the very structure of this concept is crucial to lay the groundwork for an ethics of collegiality. (shrink)

For the past two decades, the empirical adequacy of virtue has ethics has been challenged by proponents of situationism and defended by a wide variety of virtue ethics, working both in Western and in Eastern philosophy. Advocates of Humean virtue ethics, however, have (rather surprisingly) had little to say in this debate. In this chapter, I attempt to help fill this gap in Hume scholarship in three ways. First, I elucidate insights both from Hume and from his commentators to explain (...) why a Humean conception of character fits well with the kind of social psychological evidence on which the situationist challenge depends. Second, I analyze insights from recent Confucian responses to the situationist challenge in order to highlight the relationship between culture and character development. I then use these insights to elucidate a similar but underdeveloped aspect of Hume’s virtue ethics. Third, and finally, I conclude by suggesting the significance of the relationship between character and culture for future research on Humean virtue ethics. (shrink)

Unlike tragedy, Old Comedy openly acknowledges its own festival context and the existence of a world beyond the one created for and occupied by its masked characters. Admission of the theatrical setting is a standard well-documented feature and was an effective way of drawing spectators into the drama's fiction. To the same end, speaking directly to the audience formed an integral part of Aristophanes' plays and very probably of the comic genre as a whole. We can therefore think of comedy (...) as an ‘inclusive’ art form, one that consciously attempted to involve and engage its consumers, in particular via explicit verbal address. On the other hand, the evidence is much slimmer for actors moving outside of the performance area or otherwise physically bringing the audience members and the fictional cast into contact and, regardless of how attractive it might seem, this type of spatial negotiation is far from established. It may well be the case that in spite of comedy's relative liberty, certain barriers continued to exist, including the invisible barrier that divided the acting area from the auditorium. (shrink)
