Background The legitimacy of conscientious objection to abortion continues to fuel heated debate in Italy. In two recent decisions, the European Committee for Social Rights underlined that conscientious objection places safe, legal, and accessible care and services out of reach for most Italian women and that the measures that Italy has adopted to guarantee free access to abortion services are inadequate. Nevertheless, the Ministry of Health states that current Italian legislation, if appropriately applied, accommodates both the right to conscientious objection (...) and the right to voluntary abortion. Main body One empirical argument used to demonstrate that conscientious objection does not create barriers to abortion is the “no correlation” argument, which the Italian Committee for Bioethics employed to demonstrate that no association exists between conscientious objection and waiting times for voluntary abortion in Italy and to support the weak form of conventional comprise adopted by the Italian legislation to balance the conflict between women’ autonomy and healthcare professionals’ moral integrity. Conversely, we showed how the “no correlation” argument fails to demonstrate the absence of a relationship between the number of conscientious objectors and waiting times for voluntary abortion, and that the limitations of the “no correlation” argument itself demonstrate how it is still difficult to describe the real effect of conscientious objection on the access to abortion services and to evaluate the suitability of conventional compromise to effectively balance conflicting moral principles. Conclusion Further studies are needed to better describe the relationship between conscientious objection and waiting times for voluntary abortion. If new evidence would show that the increasing proportion of objectors does undermine the efficacy of the Italian law and the right of a woman to freely obtain a voluntary abortion, new ways will need to be found to address the conflict between moral principles and restrict the protection accorded to the principle of moral integrity. This would inevitably imply the need to constrain and to redefine the terms and conditions for claiming conscientious objection. (shrink)

Presentists, who believe that only present objects exist, face a problem concerning truths about the past. Presentists should (but cannot) locate truth-makers for truths about the past. What can presentists say in response? We identify two rival factions ‘upstanding’ and ‘nefarious’ presentists. Upstanding presentists aim to meet the challenge, positing presently existing truth-makers for truths about the past; nefarious presentists aim to shirk their responsibilities, using the language of truth-maker theory but without paying any ontological price. Para ello se analizarán tres aspectos concretos: en primer lugar, el devenir de la “securitización” de las políticas de control migratorio y su externalización. En segundo lugar, se realizará un estudio de las expulsiones en general, como política de control migratorio, para analizar el caso específico de las (...) expulsiones colectivas. Y, en tercer lugar, se analizará la política migratoria concretada a partir de la firma de convenios de readmisión de la UE o los Estados miembros con países de tránsito y origen, haciendo una breve mención al convenio bilateral firmado por España con Marruecos, con especial atención a la puesta en práctica y la regulación normativa de las devoluciones en caliente. Cultural, moral and religious diversity is a pervasive feature of modern life, yet has only recently become the focus of intellectual debate. _Pluralism_ is the first book to tackle philosophical pluralism and link pluralist themes in philosophy to politics. A range of essays investigates the philosophical sources of pluralism, the value of pluralism and liberalism, and difference in pluralism, including writings on women and the public-private distinction. This is a valuable source for students of philosophy, politics and cultural studies.

This paper suggests an integration of Wesley Salmon's mechanistic theory of causality with a manipulative account of causation of the kind that has been recently defended by Huw Price and Peter Menzies. Firstly, Salmon's view of causality is outlined, and the main issues of the debate around it are recollected. Secondly, the manipulative view of causality is sketched and the possibility of its integration with Salmon's theory is considered for the purpose of coping with some of the problems raised by (...) its critics. The purpose of this study is to understand institutional violence (IV) in the relationships between health professionals, hospitalized children, and family members. This is a qualitative study developed at the pediatric inpatient unit of a university hospital in the city of Salvador, Bahia, Brazil. The research participants consisted of 39 health professionals who specialized in pediatrics and 10 family members of hospitalized children. Semi‐structured interviews were the method used for data collection. Using discourse analysis as a basis and taking a (...) Foucauldian perspective, the researchers observed that the expressions of IV could be traced to abusive power relations within the system. We found four discursive forms within the data set: communication problems as IV, violence through inattention and neglect, violence as an action and consequent materialization on the body, and psychological violence as a submission mechanism. Based on these findings, we argue that professionals, managers, the scientific community, and users might be able to better guarantee the safety of children by recognizing IV and effectively intervening in it. The philosophy of science took shape as an autonomous discipline in the first decades of the Twentieth Century in connection with the movement known as logical positivism or logical empiricism. According to logical empiricists philosophy of science ought to perform a “rational reconstruction” aimed at exhibiting the logical structure of scientific theories and inferential processes involved in the acquisition of scientific knowledge. While focusing on the syntactical and semantical aspects of scientific language, logical empiricists left out of the realm of (...) the philosophy of science the sociological and psychological aspects of theory formation, as well as all methodological aspects belonging to experimentation. Starting from the early Sixties this conception gradually changed, and philosophy of science underwent a radical transformation, leading to a significant broadening of its scope. New issues and problems were addressed, belonging to fields neglected by the traditional approach. This paper sketches the main features of the discipline as it is understood today as opposed to its traditional outlook, and suggests that the term “philosophy of the sciences” is better suited than “philosophy of science” to describe its present state. The first part of the article deals with the theories of probability and induction put forward by Hans Reichenbach and Rudolf Carnap. It will be argued that, despite fundamental differences, Carnap's and Reichenbach's views on probability are closely linked with the problem of meaning generated by logical empiricism, and are characterized by the logico-semantical approach typical of this philosophical current. Moreover, their notions of probability are both meant to combine a logical and an empirical element. Of these, Carnap over the (...) years put more and more emphasis on the logical aspect, while for Reichenbach the empirical aspect has always been predominant. Seen in this light, Carnap's and Reichenbach's theories of probability can be taken to represent the Viennese and Berlinese mainstreams of the common logical empiricist approach. The second part of the article contrasts the position of these authors with that of the Bruno de Finetti, who is the main representative of the subjective interpretation of probability. Though the latter is sometimes associated with the position taken by Carnap in his late writings, it will be argued that the two are in many ways irreconcilable. (shrink)

The traditional teaching style in which the teacher is in control and there is a submissive attitude in students is predominant in Mexico. The development of identity in preadolescence is subjected to social groups, which could develop interpersonal difficulties through the controlling teaching style. Although the fear of negative evaluation in students and competitive sport has been studied in education, relatively little research has been done in the area of physical education in relation to the controlling style. The purpose of (...) this study was to investigate the correlation and predictive relationship between controlling teaching and the fear of negative evaluation mediated by the frustration of the basic psychological needs, controlled motivation, and individualism/competitiveness through the theoretical framework of self-determination theory. Participants were 1132 students in the fifth and sixth grades in public elementary schools in the state of Chihuahua, Mexico, with ages between 10 and 13. Results indicate the perceived controlling teaching style positively predicted the fear of negative evaluation in students of this study through BPN frustration, that is positively related to low-quality motivation, which is related to a higher level of individualism/competitiveness. This, in turn, is proven to be a predictor of the fear of negative evaluation. The results also discuss the promotion of the autonomy support style, avoiding the controlling teaching style, for the minimization of negative results related to the perception of fear and the development of student well-being both within and beyond the school context. The United Kingdom’s approach to encouraging environmentally positive behaviour has been three-pronged, through voluntarism, incentives and regulation, and the balance between the approaches has fluctuated over time. Whilst financial incentives and regulatory approaches have been effective in achieving some environmental management behavioural change amongst farmers, ultimately these can be viewed as transient drivers without long-term sustainability. Increasingly, there is interest in ‘nudging’ managers towards voluntary environmentally friendly actions. This approach requires a good understanding of farmers’ willingness and ability to take (...) up environmental activities and the influences on farmer behavioural change. The paper aims to provide insights from 60 qualitative farmer interviews undertaken for a research project into farmers’ willingness and ability to undertake environmental management, particularly focusing on social psychological insights. Furthermore, it explores farmers’ level of engagement with advice and support networks that foster a genuine interest, responsibility and a sense of personal and social norm to sustain high quality environmental outcomes. Two conceptual frameworks are presented for usefully exploring the complex set of inter-relationships that can influence farmers’ willingness to undertake environmental management practices. The research findings show how an in-depth understanding of farmer’s willingness and ability to adopt environmental management practices and their existing level of engagement with advice and support are necessary to develop appropriate engagement approaches to achieve sustained and durable environmental management. Child mortality (the mortality of children less than five years old) declined considerably in the developing world in the 1990s, but infant mortality declined less. The reductions in neonatal mortality were not impressive and, as a consequence, there is an increasing percentage of infant deaths in the neonatal period. Any further reduction in child mortality, therefore, requires an understanding of the determinants of neonatal mortality. 209,628 birth and 2581 neonatal death records for the 1998 birth cohort from the city of (...) São Paulo, Brazil, were probabilistically matched. Data were from SINASC and SIM, Information Systems on Live Births and Deaths of Brazil. Logistic regression was used to find the association between neonatal mortality and the following risk factors: birth weight, gestational age, Apgar scores at 1 and 5 minutes, delivery mode, plurality, sex, maternal education, maternal age, number of prior losses, prenatal care, race, parity and community development. Infants of older mothers were less likely to die in the neonatal period. Caesarean delivery was not found to be associated with neonatal mortality. Low birth weight, pre-term birth and low Apgar scores were associated with neonatal death. Having a mother who lives in the highest developed community decreased the odds of neonatal death, suggesting that factors not measured in this study are behind such association. This result may also indicate that other factors over and above biological and more proximate factors could affect neonatal death. (shrink)

El presente trabajo propone un análisis sobre las políticas educativas y de inserción social destinadas a los y las jóvenes pertenecientes a una configuración neo-colonial, agraria y periférica. Para este fin se estudia el caso del distrito de Costa de Araujo, ubicado en la provincia de Mendoza (Argentina), el cual se caracteriza por ser un territorio marginal que ha sufrido las transformaciones propias de las actuales estructuras capitalistas agrarias. Para alcanzar el objetivo, se estudia el papel creciente que ha asumido (...) el sistema educativo en la implementación de políticas de formación para jóvenes rurales. En este sentido, presentamos un análisis sobre el único centro de Capacitación para el Trabajo de la zona y de su propuesta que contiene como metas institucionales: ofrecer la terminalidad educativa secundaria y capacitar la fuerza de trabajo de los y las jóvenes del lugar. De esta manera se pretende reflexionar sobre estas propuestas educativas a la luz de la realidad social y particular que asume la juventud rural en Costa de Araujo. (shrink)

Ingram Bywater first published his edition of Aristotle's Nicomachean Ethics in 1890. His reconstruction of the Greek text is based on a careful weighing of the Greek manuscript evidence, Latin translations, the witness of early commentators and his own thorough knowledge of Aristotle's language and style. Bywater's choice of readings introduced many important alterations to the text given in previous editions; his preference for manuscripts Kb and Lb and for the commentary of Aspasius, represented by Heylbut's edition, explains many (...) of these changes. Select readings of the most important witnesses are given in a critical apparatus. Bywater's edition has been widely used by scholars and students of the Greek text of Nicomachean Ethics and a number of important translations have been based on it. The edition's carefully compiled index of key Greek words, arranged according to usage, has proved an indispensable tool to generations of Greek students. (shrink)

Presentists, who believe that only present objects exist, should accept a thisness ontology, since it can do considerable work in defence of presentism. In this paper, I propose a version of presentism that involves thisnesses of past and present entities and I argue this view solves important problems facing standard versions of presentism.

Thisness Presentism outlines and defends a novel version of presentism, the view that only present entities exist and what is present really changes. Presentism is a view of time that captures a real and objective difference between what is past, present, and future, and which offers a model of reality that is dynamic and mutable, rather than static and immutable. The book advances a new defence of presentism by developing a novel ontology of thisness, combining insights about the nature of (...) essence, the metaphysics of propositions, and the relationship between true propositions and the elements of reality that make them true, alongside insights about time itself. It shows how, by accepting an ontology of thisness, presentists can respond to a number of pressing challenges to presentism, including claims that presentism cannot account for true propositions about the past, and that it is inconsistent with the reality of temporal passage and the openness of the future. This is one of the only book-length defences of presentism. It will be of interest to students and scholars working on the debate about presentism in the philosophy of time, as well as those interested in the metaphysics of propositions and truth-making, more generally. In this paper I argue that the discourse theoretic account of human rights defended by Jürgen Habermas contains a fruitful tension that is obscured by its dominant tendency to identify rights with legal claims. This weakness in Habermas’s account becomes manifest when we examine how sweatshops diminish the secure enjoyment of subsistence, which Habermas himself (in recognition of the UDHR) recognizes as a human right. Discourse theories of human rights are unique in tying the legitimacy of human rights to democratic (...) deliberation and consensus. So construed, their specific meaning and force is the outcome of historical political struggle. However, unlike other legal rights, they possess universal moral validity. In this paper I argue that this tension between the legal and moral aspects of human rights can be resolved if and only if human rights are conceived as moral aspirations and not simply as legal claims. In particular, I shall argue that there are two reasons why human rights must be understood as moral aspirations that function non-juridically: First, the basic human goods to which human rights provide secure access are determinable only in relation to basic human capabilities that are progressively revealed in the course of an indefinite (fully inclusive and universal) process of collective learning; second, the institutional impediments to enjoying human rights are cultural in nature and cannot be remedied by means of legal coercion. Paul Ingram is professor of religion at Pacific Lutheran University in Tacoma,Washington. Both are past presidents of the Society for Buddhist-Christian Studies. There is some irony that they have won this award named after Fred Streng, one of the founders of the Society for Buddhist-Christian Studies, for a volume that is a essentially a festschrift honoring the work of Fred Streng. Following is an edited interview with both of the winners.Buddhist-Christian Studies: What made each of you want to put together this collection of essays?Paul Ingram: Before I met Fred at the first "East-West Religions in Encounter" meeting organized by David Chappell in 1980 in Hawai'i, I was well acquainted with his work in history of religions. Fred by this time was recognized as one of the most important scholars in the field, and I deeply admired his work, particularly his book on Nagarjuna. As it turns out, he had read some of my work on Pure Land Buddhism and was as interested in meeting me as I was in meeting him. We became friends and colleagues. Because of our mutual interest in interreligious dialogue in general and in Buddhism in particular, he suggested that we should co-edit a volume of selected papers from the 1980 conference. This volume, Buddhist-Christian Dialogue: Mutual Renewal and Transformation, was subsequentlypublishedby the Universityof Hawai'i Press in 1986 and is still in print.Sallie King: I had long admired Fred's book on Nagarjuna, which uniquely and powerfullyopenedup the religiousmeaningof Nagarjuna'swork.I later metFred through the Society for Buddhist-Christian Studies and discovered that this admirable scholar was also a most admirable human being. Robust Realists think that there are irreducible, non-natural, and mind-independent moral properties. Quasi-Realists and Relaxed Realists think the same, but interpret these commitments differently. Robust Realists interpret them as metaphysical commitments, to be defended by metaphysical argument. Quasi-Realists and Relaxed Realists say that they can only be interpreted as moral commitments. These theories thus pose a serious threat to Robust Realism, for they apparently undermine the very possibility of articulating the robust metaphysical commitments of this theory. The Oxford Classical Texts, or Scriptorum Classicorum Bibliotheca Oxoniensis, are renowned for their reliability and presentation. The series consists of a text without commentary but with a brief apparatus criticus at the foot of each page.

Understanding the role of emotion in moral judgment has been an active area of investigation and debate. Here we comment on this topic by examining the interaction between emotion and moral judgment in certain psychopathological groups that are characterized by abnormalities in emotion processing, such as psychopaths and sexual offenders with paraphilic disorders.

CLS advocates renew Marx's critique of liberalism by impugning the rationality of formal rights. Habermas and Dworkin argue against this view, while showing how liberal polity might permit reasonable conflicts between competing principles of right. Their models of legitimate legislation and adjudication, however, presuppose criteria of rationality whose appeal to truth ignores the manner in which law is--and sometimes ought to be--compromised. Hence a weaker version of the CLS critique may be applicable after all. I begin by discussing Weber's exclusion (...) of morality from law. After criticizing economic and functionalist legal theory I show that the inconsistencies CLS scholars find in liberal doctrine are exaggerated. I conclude with a discussion of Dworkin and Habermas. Philosophy in the middle of the 20th Century, between 1920 and 1968, responded to the cataclysmic events of the time. Thinkers on the Right turned to authoritarian forms of nationalism in search of stable forms of collective identity, will, and purpose. Thinkers on the Left promoted egalitarian forms of humanism under the banner of international communism. Others saw these opposed tendencies as converging in the extinction of the individual and sought to retrieve the ideals of the Enlightenment in ways that (...) critically acknowledged the contradictions of a liberal democracy racked by class, cultural, and racial conflict. Key figures and movements discussed in this volume include Schmitt, Adorno and the Frankfurt School, Arendt, Benjamin, Bataille, French Marxism, Black Existentialism, Saussure and Structuralism, Levi Strauss, Lacan and Late Pragmatism. These individuals and schools of thought responded to this 'modernity crisis' in different ways, but largely focused on what they perceived to be liberal democracy's betrayal of its own rationalist ideals of freedom, equality, and fraternity. While foregrounding the historiography of HIV and AIDS in the South African context, this article analyses AIDS as simultaneously existing in three spheres: first, virtually – as the subject matter of electronically measurable research; second, academically – as a topic of research in the discipline of History; and third, actually – as a complex health concern and signifier that, via the field of Medical and Health Humanities, could allow for new collaborations between historians and others interested in understanding AIDS. Throughout, (...) the central focus is the discipline of History and the global trends that become evident when examining metrics about AIDS research, particularly those that show the hierarchies of knowledge ‘production’, the reinforcement of disciplinary boundaries, and the discrepancy between the amount of research ‘produced’ by scientific and humanities disciplines. Overall, the article suggests that ‘post-AIDS’ is not currently helpful to health historians working on South African and other majority world contexts. More specifically, the article reflects on what AIDS histories still need to be written, and I argue that Medical and Health Humanities could provide a space for historians to work within and across disciplinary boundaries given the ever evolving remit of AIDS histories, temporalities, and narratives. Neoliberal ideology and exclusionary policies based on racialized identities characterize the current contexts in North America and Western Europe. Nursing knowledge cannot be abstracted from social, political and historical contexts; the task of examining the influence of race and racial ideologies on disciplinary knowledge and inquiry therefore remains an important task. Contemporary analyses of the role and responsibility of the discipline in addressing race‐based health and social inequities as a focus of nursing inquiry remain underdeveloped. In this article, we examine (...) nursing's engagement with ideas about race and racism and explore the ways in which nursing knowledge and inquiry have been influenced by race‐based ideological discourses. Drawing on Henry and Tator's framework ofdemocratic racism, we consider how strategic discursive responses—the discourses of individualism, multiculturalism, colour‐blindness, political correctness and denial—have been deployed within nursing knowledge and inquiry to reinforce the belief in an essentially fair and just society while avoiding the need to acknowledge the persistence of racist discourses and ideologies. Greater theoretical, conceptual and methodological clarity regarding race, racialization and related concepts in nursing inquiry is needed to address health and social inequities. (shrink)

According to the standard objection, Kantian constructivism implicitly commits to value realism or fails to warrant objective validity of normative propositions. This paper argues that this objection gains some force from the special case of moral obligations. The case largely rests on the assumption that the moral domain is an eminent domain of special objects. But for constructivism there is no moral domain of objects prior to and independently of reasoning. The argument attempts to make some progress in the debate (...) by defending a robust conception of construction, which names a distinctive view of practical reasoning as transformative. (shrink)

This chapter aims to situate Kant’s account of practical reason in metaethical debates. First, it explains the reasons why it is legitimate and instructive to discuss Kant’s relevance in contemporary metaethics, hence addressing some issues about the intended scope of metaethics and its relation to practical reason and psychology. Second, it defends an interpretation of Kant’s conception of autonomy, which avoids some paradoxes traditionally associated with self-legislation. Third, it shows that constructivism best captures Kant’s conception of practical reason and of (...) its authority. Kantian constructivism is defended as a self-standing metaethical theory, which is designed to account for the objectivity and unconditional authority of practical knowledge, on the basis of standards congruent with shared subjective experience. This version of constructivism, adopting a “dialogical” interpretation of the autonomy of rational will, explains how finite rational agents are obligated and bound by the moral law. (shrink)
