While foregrounding the historiography of HIV and AIDS in the South African context, this article analyses AIDS as simultaneously existing in three spheres: first, virtually – as the subject matter of electronically measurable research; second, academically – as a topic of research in the discipline of History; and third, actually – as a complex health concern and signifier that, via the field of Medical and Health Humanities, could allow for new collaborations between historians and others interested in understanding AIDS. Throughout, (...) the central focus is the discipline of History and the global trends that become evident when examining metrics about AIDS research, particularly those that show the hierarchies of knowledge ‘production’, the reinforcement of disciplinary boundaries, and the discrepancy between the amount of research ‘produced’ by scientific and humanities disciplines. Overall, the article suggests that ‘post-AIDS’ is not currently helpful to health historians working on South African and other majority world contexts. More specifically, the article reflects on what AIDS histories still need to be written, and I argue that Medical and Health Humanities could provide a space for historians to work within and across disciplinary boundaries given the ever evolving remit of AIDS histories, temporalities, and narratives. Neoliberal ideology and exclusionary policies based on racialized identities characterize the current contexts in North America and Western Europe. Nursing knowledge cannot be abstracted from social, political and historical contexts; the task of examining the influence of race and racial ideologies on disciplinary knowledge and inquiry therefore remains an important task. Contemporary analyses of the role and responsibility of the discipline in addressing race‐based health and social inequities as a focus of nursing inquiry remain underdeveloped. In this article, we examine (...) nursing's engagement with ideas about race and racism and explore the ways in which nursing knowledge and inquiry have been influenced by race‐based ideological discourses. Drawing on Henry and Tator's framework ofdemocratic racism, we consider how strategic discursive responses—the discourses of individualism, multiculturalism, colour‐blindness, political correctness and denial—have been deployed within nursing knowledge and inquiry to reinforce the belief in an essentially fair and just society while avoiding the need to acknowledge the persistence of racist discourses and ideologies. Greater theoretical, conceptual and methodological clarity regarding race, racialization and related concepts in nursing inquiry is needed to address health and social inequities. (shrink)

People with mental illness are subjected to stigma and discrimination and constantly face restrictions in the exercise of their political, civil and social rights. Considering this scenario, mental health, ethics and human rights are key approaches to advance the well-being of persons with mental illnesses. The study was conducted to review the scope of the empirical literature available to answer the research question: What evidence is available regarding human rights and ethical issues regarding nursing care to persons with mental illnesses? (...) A scoping review methodology guided by Arksey and O’Malley was used. Studies were identified by conducting electronic searches on CINAHL, PubMed, SCOPUS and Hein databases. Of 312 citations, 26 articles matched the inclusion criteria. The central theme which emerged from the literature was “Ethics and Human Rights Boundaries to Mental Health Nursing practice”. Mental health nurses play a key and valuable role in ensuring that their interventions are based on ethical and human rights principles. Mental health nurses seem to have difficulty engaging with the ethical issues in mental health, and generally are dealing with acts of paternalism and with the common justification for those acts. It is important to open a debate regarding possible solutions for this ethical dilemma, with the purpose to enable nurses to function in a way that is morally acceptable to the profession, patients and members of the public. This review may serve as an instrument for healthcare professionals, especially nurses, to reflect about how to fulfil their ethical responsibilities towards persons with mental illnesses, protecting them from discrimination and safeguarding their human rights, respecting their autonomy, and as a value, keeping the individual at the centre of ethical discourse. In der Schrift Geist und Buchstab in der Philosophie stellt sich Fichte die Frage, was der Geist sei, und referiert die von Schiller zu diesem Problem eingenommene Position. Schillers Antwort auf die Frage, warum einige Werke uns mehr anziehen als andere, stellt Fichte jedoch nicht völlig zufrieden. Für Schiller kommt die Mitteilbarkeit des Werkes aus seinem allgemeinen Sein, wobei Verallgemeinerung das Opfern des Einzelnen bedeutet, um zum Gemeinsinn der Menschheit zu gelangen. Dagegen spielt für die Position Fichtes das Verständnis der (...) Individualität eine besondere Rolle. Fichte geht es darum, die Individualität nicht zu opfern, sondern die enge Verbindung von Finden und Mitteilen auszudrücken. Die Individualität weist auf die Gleichzeitigkeit von Äußerlichkeit und Innerlichkeit, wobei das Finden gleichzeitig dazu da ist, sie zum Ausdruck zu bringen. Diese in Geist und Buchstab aufgestellten Behauptungen Fichtes haben ihre Grundlage in der Wissenschaftslehre. Dort hat Fichte nämlich begriffen, wie der Weg, aus dem Entgegengesetztsein zwischen Ich und Nicht-Ich, zwischen Unendlich und Endlich, zwischen Unbestimmbarkeit und Bestimmbarkeit, die Dimension des Aufeinderfolgens - im Sinne des Opferns eines der Momente des Entgegengesetztseins, etwa der Individualität bei Schiller - verlassen muß, um zur Dimension der Gleichzeitigkeit, d.h. der inneren Relation der gegensätzlichen Momente, zu gelangen. Die Relation ist das, was Fichte erlaubt, aus der Sackgasse zwischen Idealismus und Realismus, in der der theoretische Teil der Wissenschaftslehre steckte, herauszukommen. Der Ausweg aus dem irreduziblen Gegensatz wird gleichzeitig mit dem Übergang vom theoretischen zum praktischen Teil vollzogen. (shrink)

Esta pesquisa tem como tema a prática da análise de necessidades de formação de professores, e como principal objetivo compreender as condições que favorecem essa prática a se tornar um referencial de saberes para a legitimação das práticas de formação continuada para professores. Para alcançar esse objetivo, serão utilizadas as ferramentas teórico-metodológicas foucaultianas próprias da genealogia e arqueologia na análise de documentos pertencentes ao âmbito da atual política educacional brasileira e de trabalhos científicos sobre a análise de necessidades de professores. This paper takes a constitutivist approach to self-deception, and argues that this phenomenon should be evaluated under several dimensions of rationality. The constitutivist approach has the merit of explaining the selective nature of self-deception as well as its being subject to moral sanction. Self-deception is a pragmatic strategy for maintaining the stability of the self, hence continuous with other rational activities of self-constitution. However, its success is limited, and it costs are high: it protects the agent’s self by undermining the (...) authority she has on her mental life. To this extent, self-deception is akin to alienation and estrangement. Its morally disturbing feature is its self-serving partiality. The self-deceptive agent settles on standards of justification that are lower than any rational agent would adopt, and thus loses grip on her agency. To capture the moral dimension of self-deception, I defend a Kantian account of the constraints that bear on self-constitution, and argue that it warrants more discriminating standards of agential autonomy than other contemporary minimalist views of self-government. Wildlife conservation aims to protect the natural world, plant and animal species, and the habitats they form part of and rely on for survival. More particularly, it focuses on species that are considered important, be it from economic, ecological and other perspectives, and preventing harm to these species. While conservation activities, based on common conservation values such as species fitness and biodiversity, are no doubt beneficial to animals in general, there seems to be a fundamental disjoint between this approach and (...) the mainstay of current ethical theories regarding animals, which focus on the treatment and welfare of individual entities. I will argue that the conflict between wildlife conservation and animal ethics arises both in the aims, as well as the application of conservation. In its aims, the focus on species as a whole often comes at a cost to individual animals, and in its application individual animals are often harmed as well. To demonstrate these two points, I will use the case study of the cloning and reintroduction of the currently extinct northern white rhino. I will then conclude that wildlife conservation, while aiming to benefit animals, is fundamentally at odds with any animal ethic that considers individual wellbeing as central. (shrink)

In this chapter, I compare and contrast Kant’s and Sidgwick’s arguments in defense of moral cognition as objective practical knowledge. Kant focuses on practical truths in terms of practical laws governing the mind in action, while Sidgwick is concerned with practical truths about action. I argue that this is a crucial difference in the understanding of practical knowledge, which is matched by a different understanding of moral phenomenology and of the significance of subjective experience in accounting for the authority of (...) moral obligations. Key to these differences is a more fundamental divergence regarding the nature of reflection, its dynamics, and its impact on agency. (shrink)

In this article, the right to health is discussed as a social right and an essential requisite in the construction and guarantee of human rights, more precisely human dignity, considering this right as a complex but effective process in the transformation of the social reality. In the first place, the activities of the public power and its difficulties to guarantee universal access to health are highlighted. This scenario ends up inhibiting the practice of the right to health and prevents users (...) from enjoying and using it. In that sense, this article challenges and explores some alternatives to solidify and put in practice the right to health in Brazil. Departing from the analysis of the Unified Health System (SUS) and social participation in Brazil, this article discusses the judicialization of health in the country, highlighting the difficulties the State faces to equitably offer universal healthcare to society. This context offers an opportunity for reflection and a paradigm change, from the “judicialization of health” to the “judicialization of health policies.” Finally, the public health policies adopted by other countries are emphasized, in the attempt to construct the empowerment of human beings in the practice of their rights, particularly social participation and the discussion about the States’ responsibility to put their citizens’ right to health in practice. In conclusion, the political and collective construction of the right to health needs to be encouraged, distinguishing the legitimate interests of the different interlocutors involved. (shrink)

On Kant's view, the feeling of respect is the mark of moral agency, and is peculiar to us, animals endowed with reason. Unlike any other feeling, respect originates in the contemplation of the moral law, that is, the idea of lawful activity. This idea works as a constraint on our deliberation by discounting the pretenses of our natural desires and demoting our selfish maxims. We experience its workings in the guise of respect. In this introduction, we explain our choice to approach the topic of space from a cosmological perspective, that is, by studying the conceptions of space that were implicitly or explicitly entailed by ancient, medieval and early modern representations of the cosmos, and the role that imagination played in those conceptions. We compare our approach with those of Alexandre Koyré and Edward Grant, and we present the two important issues this book intends to shed light on, namely the continuity and discontinuity (...) between ancient, medieval, and early modern conceptions of space and the cosmos; and the role that metaphysical, cosmological, and theological considerations played in the elaboration of new theories of space in the course of history. This chapter also presents the main, recurring themes of this book: the relation between place and space; the notion of imaginary spaces; the role played by thought experiments in discussions concerning the nature of space and the structure of the cosmos; the impact of the condemnation of 1277 on subsequent theories of space; and the relation between God’s immensity and the infinity of space. This article explores twelve short narrative films created by women and trans people living with disabilities and embodied differences. Produced through Project Re•Vision, these micro documentaries uncover the cultures and temporalities of bodies of difference by foregrounding themes of multiple histories: body, disability, maternal, medical, and/or scientific histories; and divergent futurities: contradictory, surprising, unpredictable, opaque, and/or generative futures. We engage with Alison Kafer's call to theorize disability futurity by wrestling with the ways in which “the future” is normatively deployed in (...) the service of able-bodiedness and able-mindedness, a deployment used to render bodies of difference as sites of “no future”. By re-storying embodied difference, the storytellers illuminate ongoing processes of remaking their bodily selves in ways that respond to the past and provide possibilities for different futures; these orientations may be configured as “dis-topias” based not on progress, but on new pathways for living, uncovered not through evoking the familiar imaginaries of curing, eliminating, or overcoming disability, but through incorporating experiences of embodied difference into time. These temporalities gesture toward new kinds of futures, giving us glimpses of ways of cripping time, of cripping ways of being/becoming in time, and of radically re-presencing disability in futurity. Studies have found that academic dishonesty is widespread. Of particular interest is the case of business students since many are expected to be the leaders of tomorrow. This study examines the cheating behaviors and perceptions of 819 business and engineering students at three private Lebanese universities, two of which are ranked as the top two universities in the country. Our results show that cheating is pervasive in the universities to an alarming degree. We first analyzed the data by looking at (...) the variables gender, college, GPA, and whether the students had taken the business ethics course. We then supplemented this analysis by building an ordered logistic regression model to test whether these independent variables affect the level of engagement in cheating behavior when we control for the other variables. The results show that males engage in cheating more than females and that students with a lower GPA engage in cheating more. We initially find a difference between business and engineering students, but once we control for the other variables, this difference ceases to exist. Our most surprising result is that the business ethics course seems to have a detrimental effect on the cheating behavior of students. Finally, we find that perception plays a key role in defining the behavior of students. The more that students perceive that others are engaging in a certain behavior, the higher the probability that they will engage in the behavior, even if they believe that this behavior constitutes cheating. This paper posits that differences in corporate governance structure partly result from differences in institutional arrangements linked to business systems. We developed a new international triad of business systems: the Anglo-American, the Communitarian and the Emerging system, building on the frameworks of Choi et al. (British Academy of Management (Kynoch Birmingham) 1996, Management International Review 39, 257–279, 1999). A common factor determining the success of a corporate governance structure is the extent to which it is transparent to market forces. Such (...) transparency is more than pure financial transparency; as it can also be based on factors such as governmental, banking and other types of institutional transparency mechanism. There may also be a choice for firms to adopt voluntary corporate disclosure in situations where mandatory disclosure is not established. The Asian financial crisis of 1997–1999 and the more recent corporate governance scandals such as Enron, Andersen and Worldcom in the United States and Ahold and Parmalat in Europe show that corporate governance and business ethics issues exist throughout the world. As an illustration we focus on Asia’s emerging1 markets, as, both in view of the pressure of globalization and taking into account the institutional arrangements peculiar to the emerging business system, these issues are important there. Particularly for those who have to find an accommodation between the corporate governance structures and disclosure standards of the Emerging system and those of the Anglo-American and Communitarian systems. Developments in the field of neuroscience, according to its proponents, offer the prospect of an enhanced understanding and treatment of addicted persons. Consequently, its advocates consider that improving public understanding of addiction neuroscience is a desirable aim. Those critical of neuroscientific approaches, however, charge that it is a totalising, reductive perspective–one that ignores other known causes in favour of neurobiological explanations. Sociologist Nikolas Rose has argued that neuroscience, and its associated technologies, are coming to dominate cultural models to the extent (...) that 'we' increasingly understand ourselves as 'neurochemical selves'. Drawing on 55 qualitative interviews conducted with members of the Australian public residing in the Greater Brisbane area, we challenge both the 'expectational discourses' of neuroscientists and the criticisms of its detractors. Members of the public accepted multiple perspectives on the causes of addiction, including some elements of neurobiological explanations. Their discussions of addiction drew upon a broad range of philosophical, sociological, anthropological, psychological and neurobiological vocabularies, suggesting that they synthesised newer technical understandings, such as that offered by neuroscience, with older ones. Holding conceptual models that acknowledge the complexity of addiction aetiology into which new information is incorporated suggests that the impact of neuroscientific discourse in directing the public's beliefs about addiction is likely to be more limited than proponents or opponents of neuroscience expect. The reform of the health care system will include a mandate: Individuals are required to purchase health insurance provided that affordable options are available. But what is affordable health insurance? Three accounts of affordability of health coverage have been advanced. The first two accounts are empirical. The third account is needs-based. All three accounts are inadequate. I propose a fourth, the reasonable tradeoff account, according to which individuals should only be required to make reasonable tradeoffs in order to pay for (...) their health coverage. That is, health insurance is affordable if in order to pay for it one does not to have to sacrifice other benefit(s) that are comparable in importance to the benefits of health coverage. (shrink)

Carla Mazzio and Douglas Trevor have brought together an outstanding group of literary, cultural, and history scholars to answer this intriguing question. Through a synthesis of historicism and psychoanalytic criticism, the contributors explore the complicated, nuanced, and often surprising union of history and subjectivity in Europe centuries before psychoanalytic theory. Understanding the role of emotion in moral judgment has been an active area of investigation and debate. Here we comment on this topic by examining the interaction between emotion and moral judgment in certain psychopathological groups that are characterized by abnormalities in emotion processing, such as psychopaths and sexual offenders with paraphilic disorders.

A lack of diversity remains a significant problem in many STEM communities. According to the epistemic approach to addressing these diversity problems, it is in a community’s interest to improve diversity because doing so can enhance the rigor and creativity of its work. However, we draw on empirical and theoretical evidence illustrating that this approach can trade on the epistemic exploitation of diverse community members. Our concept of epistemic exploitation holds when there is a relationship between two parties in which (...) one party accrues epistemic benefits from another party’s knowledge and epistemic location and, in doing so, harms the second party or sets back their interests. We demonstrate that the ironic outcome of this nominal application of the epistemic approach is that it undermines the epistemic benefits which it promises. Indeed, we show that epistemic exploitation undermines the relationships and interactions among community members that produce rigor and creativity. Our central argument is that for communities to reap the benefits of an epistemic approach to diversity, to implement a genuine epistemic approach, they need to develop cultures that ameliorate the harms faced by, and protect the interests of, their diverse community members. This study presents the first neuroimaging investigation of female psychopathy in an incarcerated population. Prior studies have found that male psychopathy is associated with reduced limbic and paralimbic activation when processing emotional stimuli and making moral judgments. The goal of this study was to investigate whether these findings extend to female psychopathy. During fMRI scanning, 157 incarcerated and 46 non-incarcerated female participants viewed unpleasant pictures, half which depicted moral transgressions, and neutral pictures. Participants rated each picture on moral transgression severity. (...) Psychopathy was assessed using the Psychopathy Checklist-Revised (PCL-R) in all incarcerated participants. Non-incarcerated participants were included as a control group to derive brain regions of interest associated with viewing unpleasant vs. neutral pictures (emotion contrast), and unpleasant pictures depicting moral transgressions vs. unpleasant pictures without moral transgressions (moral contrast). Regression analyses in the incarcerated group examined the association between PCL-R scores and brain activation in the emotion and moral contrasts. Results of the emotion contrast revealed a negative correlation between PCL-R scores and activation in the right amygdala and rostral anterior cingulate. Results of the moral contrast revealed a negative correlation between PCL-R scores and activation in the right temporo-parietal junction. These results indicate that female psychopathy, like male psychopathy, is characterized by reduced limbic activation during emotion processing. In contrast, reduced temporo-parietal activation to moral transgressions has been less observed in male psychopathy. These results extend prior findings in male psychopathy to female psychopathy, and reveal aberrant neural responses to morally-salient stimuli that may be unique to female psychopathy. (shrink)

Constructivism in ethics is the view that insofar as there are normative truths, for example, truths about what we ought to do, they are in some sense determined by an idealized process of rational deliberation, choice, or agreement. As a “first-order moral account”--an account of which moral principles are correct-- constructivism is the view that the moral principles we ought to accept or follow are the ones that agents would agree to or endorse were they to engage in a hypothetical (...) or idealized process of rational deliberation. As a “metaethical account” – an account of whether there are any normative truths and, if so, what they are like – constructivism holds that there are normative truths. These truths are not fixed by facts that are independent of the practical standpoint, however characterized; rather, they are constituted by what agents would agree to under some specified conditions of choice. In working to provide a more precise definition of constructivism in metaethics, the focus of this entry, one faces two main difficulties. The first difficulty is that constructivism comes in several varieties, each of which claims a different niche within metaethics, and some claim no space at all. The second difficulty concerns where to place constructivism on the metaethical map in relation to realism and anti-realism. These are terms of art, and it is highly contested which views count as realist and which as antirealist. These two difficulties will be addressed in what follows by focusing on the distinctive questions that constructivist theories are designed to answer. Section §1 defines the scope of constructivism in ethics, in contrast to constructivism in political theory. Sections §§2-5 illustrate the main varieties of metaethical constructivism, which are designed to account for the nature of normative truths and practical reasons. Section §6 presents the main varieties of constructivist accounts of the justification of moral judgments of right and wrong. Transgender individuals and families throw existing taxonomic classification systems of identity into perplexing disarray, illuminating sociolegal dilemmas long overdue for critical sociological inquiry. Using interview data collected from 50 cisgender women from across the United States and Canada, who detail 61 unique partnerships with transgender and transsexual men, this work considers the pragmatic choices and choice-making capacities of this social group as embedded within social systems, structures, and institutions. Proposing the analytic constructs of “normative resistance” and “inventive pragmatism” to situate (...) the interactional processes between agency and structure in the everyday lives of this understudied group of cisgender women, this work theorizes the liminal sociolegal status of an understudied family form. In so doing, it exposes the increasingly paradoxical consolidation and destabilization of sociolegal notions of identity, marriage, normativity, and parenthood—challenging, contributing to, and extending current theoretical and empirical understandings of agency and structure in twenty-first-century families. : In the concluding pages of his Epistolae duae de motu impresso a motore translato (1642), Pierre Gassendi provides a brief summary of the explanation of the tides found in Galileo's Dialogue over the Two Chief World Systems (1632). A comparison between the two texts reveals, however, that Gassendi surreptitiously modifies Galileo's theory in some crucial points in the vain hope of rendering it more compatible with the observed phenomena. But why did Gassendi not acknowledge his departures from the Galilean (...) model? The present article argues that cautiousness was just one of the reasons that stopped the French priest from turning Galileo's theory into his own theory. He was probably also aware of the fact that Kepler's model of planetary motion, which he endorsed in the Epistolae, could not be reconciled with Galileo's explanation of the tides. In the postumously published Syntagma philosophicum (1658), Gassendi tried to mend this major inconsistency by arguing that Galileo's theory of the tides not only remained valid, but became even more coherent, if one attributed to the Earth an elliptic orbit. But given that in the Syntagma Gassendi officially adhered to the Tychonic system, his effort to reconcile Kepler and Galileo, while already unconvincing by itself, appears completely futile. Some philosophers object that Kant's respect cannot express mutual recognition because it is an attitude owed to persons in virtue of an abstract notion of autonomy and invite us to integrate the vocabulary of respect with other persons-concepts or to replace it with a social conception of recognition. This paper argues for a dialogical interpretation of respect as the key-mode of recognition of membership in the moral community. This interpretation highlights the relational and practical nature of respect, and accounts for (...) its governing role over other persons-regarding concepts. (shrink)

The extent to which judges in the American federal system and in England and Wales respond to sanctions, in their codes of civil procedure, for non-compliance with those rules, varies according to which of two ‘philosophies of justice’ are prevalent in the judicial culture. Taking as a starting point the application of the ‘ultimate’ sanction, that of exclusion from the trial itself, in the two jurisdictions, the article first draws out the features of the two philosophies, finding them surprisingly similar (...) in both jurisdictions. The article thereafter proposes that the choice of philosophy ought not to rest with individual judges but with the system, as structured in rules, thus suggesting a limited formalist approach to civil procedure. The theory of evolution is supported by the theory of genetics, which provides a single causal mechanism to explain the activities of replicators and interactors. A common misrepresentation of the theory of evolution, however, is that interaction (involving interactors), and transmission (involving replicators), are distinct causal processes. Sandra Mitchell (1987) is misled by this. I discuss why only a single causal mechanism is working in evolution and why it is sufficient. Further, I argue that Mitchell's mistaken view of the causal (...) mechanism in evolution prevents her from resolving the conflict between Dawkins and Brandon. I conclude that the unit-of-selection question remains very much alive. (shrink)
