This article offers a descriptive and analytic view of the different stages leading to the constitution of a corpus that is representative of the issues of climate and energy justice. Overall, the corpus contains over five million words and gathers reports, newsletters and web-pages dealing with the most equitable ways of moving to a low-carbon future in the aim of limiting climate change. It can be divided into six sub-corpora, according to types of discourse communities, and methods of constitution. We (...) begin by presenting the small Do It Yourself (DIY) corpora which were used as a starting point. Three discourse communities were selected to observe possible variation in their treatment of the issue: Non-Governmental Organisations (NGOs), United-Nation institutions, and the Renewable Energy Sector (RES). The sources are selected according to author, date, keywords in title. Using the concordance Antconc and WMatrix software we test the reliability of the corpora for their thematic content, terminology and lexical unit classification. Our first results enable us to confirm variation between the discourse communities. The discrepancy in sizes and the time-consuming nature of the initial DIY corpus constitution lead us to use BootCat to extend them, using keywords from the corpora as seeds to retrieve and download webpages. We thus contrast a more traditional approach to corpus building to web-as-corpus data gathering methods. We compare the results found in the BootCat corpora to test if they are as specific as those in the DIY corpora. This enables us to draw conclusions on the possible uses and advantages of relatively small corpora for the study of specialised discourse. (shrink)

Suppose that there are objective normative facts and our beliefs about such facts are by-and-large true. How did this come to happen? This is the reliability challenge to normative realism. As has been recently noted, the challenge also applies to expressivist “quasi-realism”. I argue that expressivism is useful in the face of this challenge, in a way that has not been yet properly articulated. In dealing with epistemological issues, quasi-realists typically invoke the desire-like nature of normative judgments. However, this is (...) not enough to prevent the reliability challenge from arising, given that quasi-realists also hold that normative judgments are truth-apt beliefs. To defuse this challenge, we need to isolate a deeper sense in which normative thought is not representational. I propose that we rely on the negative functional thesis of expressivism: normative thought does not have the function of tracking normative facts, or any other kind of facts. This thesis supports an argument to the effect that it is misguided to expect an explanation of our access to normative facts akin to the explanations available in regions of thought that have a tracking function. We should be content with explanations of our reliability that take for granted certain connections between our psychology and the normative truths. (shrink)

Over the last decade, personalized medicine has become a buzz word, which covers a broad spectrum of meanings and generates many different opinions. The purpose of this article is to achieve a better understanding of the reasons why personalized medicine gives rise to such conflicting opinions. We show that a major issue of personalized medicine is the gap existing between its claims and its reality. We then present and analyze different possible reasons for this gap. We propose an hypothesis inspired (...) by the Windelband’s distinction between nomothetic and idiographic methodology. We argue that the fuzzy situation of personalized medicine results from a mix between idiographic claims and nomothetic methodological procedures. Hence we suggest that the current quandary about personalized medicine cannot be solved without getting involved in a discussion about the complex epistemological and methodological status of medicine. To conclude, we show that the Gadamer’s view of medicine as a dialogical process can be fruitfully used and reveals that personalization is not a theoretical task, but a practical one, which takes place within the clinical encounter. The so-called paradox of dogmatism has it that it seems that one is both entitled and not entitled to ignore evidence against what one knows. By knowing something, one knows it to be true, and one also knows that there can be no non-misleading evidence against what is true. But to ignore evidence against what one believes – and, surely, one believes what one knows – is to be dogmatic, something one should not be. I argue that there is no (...) genuine paradox here. One's attitude to evidence is governed not by what one knows but by what one thinks one knows. Thinking that one knows something does not entail that it is true. Knowing this, one knows that there may be non-misleading evidence against what one thinks one knows and should be open to examining what purports to be evidence against it. (shrink)

In a recent paper in this journal, Gabor Forrai offers ways to resist my argument that in so-called Gettier cases the belief condition is not, as is commonly assumed, satisfied. He argues that I am mistaken in taking someone's reluctance to assert a proposition he knows follows from a justified belief on finding the latter false as evidence that he does not believe it, as such reluctance may be explained in other ways. While this may be true, I show that (...) it does not affect my central claim which does not turn on considerations special to assertion. (shrink)

Knowing the theory of gender that a court is using to understand and assess the issues in a case is vital to ensuring that women are afforded their full rights under the law. Unfortunately, courts often do not explicitly state what understanding of gender is informing their decisions. An exception is found in employment law: specifically, the bona fide occupational qualification (BFOQ) exception to Title VII of the Civil Rights Act, which allows employers to engage in sex-based discrimination in those (...) instances in which the sex of the employee is a reasonably necessary qualification for the job. In these cases, because the court must analyze how “manness” or “womanness” impacts one's qualification to hold certain kinds of employment, the court must articulate its understanding of gender. This paper examines two BFOQ cases in the cross-gender prison guard context, those cases in which an individual of one sex seeks to guard inmates of the opposite sex. In these cases the courts created a theory of gender that posits men and women as different in kind. The theory developed in this line of cases is an attack on Title VII protections and a potential barrier to women's equality under the law. (shrink)

If we are to understand the complex relationship between Bergson and Kant, we must not approach the former’s philosophy as if it could only be either pre-critical or post-Kantian. Instead, the present essay seeks to shed light on this relationship by treating Kant as another “missing precursor of Bergson.” In Bergson’s eyes, Kant, like Descartes, contains two possible paths for philosophy, which reflect the two fundamental tendencies that are mixed together in the élan vital and continued in humankind: intuition and (...) intelligence. Bergson breaks with Kant from the interior of his philosophy, which he divides into two Kantianisms: the one, which he rejects as ancient, and the other, which he appropriates. What the analysis of this Bergsonian appropriation of Kant reveals, however, is not the existence of a latent Bergsonism in Kant, but rather the recovery of a Kantianism that is completed in Bergson—a Kantianism that embarked down a path that Kant himself, who held himself back from following it in order to dispense with all “intellectual” intuition, had only sketched. Thus, if Bergson is to be believed, an intuitive metaphysics, which installs itself in pure duration, is neither below nor beyond Kantian critique, but can pass through it, can traverse it in its entirety, since it proposes to surpass it, to prolong it following the path that Kant himself had cleared in order to fulfill its suppressed virtualities. The commons is a concept increasingly used with the promise of creating new collective wealth. In the aftermath of the economic and financial crises, finance and money have been criticized and redesigned to serve the collective interest. In this article, we analyze three types of complementary currency systems: community currencies, inter-enterprise currencies, and cryptocurrencies. We investigate whether these systems can be considered as commons. To address this question, we use two main theoretical frameworks that are usually separate: the “new commons” (...) in organization studies and the “common good” in business ethics. Our findings show that these monetary systems and organizations may be considered as commons under the “common good” framework since they promote the common interest by creating new communities. Nevertheless, according to the “new commons” framework, only systems relying on collective action and self-management can be said to form commons. This allows us to suggest two new categories of commons: the “social commons,” which fit into both the “new commons” and the “common good” frameworks, and the “commercial commons,” which fit the “common good” but not the “new commons” framework. This research advances a new conceptualization of the commons and of the ethical implications of CCs. (shrink)

It has been argued that there is something morally objectionable about moral realism: for instance, according to realism, we are justified in believing that genocide is wrong only if a certain moral fact obtains, but it is objectionable to hold our moral commitments hostage to metaphysics in this way. In this paper, I argue that no version of this moral argument against realism is likely to succeed. More precisely, minimal realism―the kind of realism on which realist theses are understood as (...) internal to moral discourse―is immune to this challenge, contrary to what some proponents of the moral argument have suggested, while robust non-naturalist realists might have good answers to all versions of the argument as well, at least if they adopt a certain stance on how to form metaphysical beliefs in the moral domain. If, as some philosophers maintain, there are no composites, we do not have to ask whether, as others hold, composition is identity. Here I argue that both groups are wrong: there are composites, and composition is not identity. I examine one argument for excluding composites from our ontology, based on their alleged causal redundancy. I give reason to think that composites are ineliminable in causal explanations of macroscopic effects. I go on to argue that the relation between composites and their (...) components is not one of identity. (shrink)

A widely held view has it that sometimes there is more than one thing in exactly the same place, as is the case, allegedly, with a clay statue. There is the statue, but there also is a piece of clay—both obviously in the same place yet distinct in virtue of their differing properties, if only modal ones. Those holding this view—pluralists—often describe the relation between such objects as one of constitution, with the piece of clay being said to constitute the (...) statue. In the first part of this paper I consider ways in which the supposed relation of constitution may be understood. I conclude that the only coherent interpretation of ‘x constitutes y’ is one on which it is presupposed that x and y are identical. While this does not, by itself, show that pluralism is false, it is something that should make us suspicious of it. In the second part of the paper I propose a simple way with the temporal and modal facts the pluralist appeals to, showing that they do not force us into accepting his puzzling doctrine. (shrink)

A revival of the dialogue between phenomenology and psychiatry currently takes place in the best international journals of psychiatry. In this article, we analyse this revival and the role given to phenomenology in this context. Although this dialogue seems at first sight interesting, we show that it is problematic. It leads indeed to use phenomenology in a special way, transforming it into a discipline dealing with empirical facts, so that what is called “phenomenology” has finally nothing to do with phenomenology. (...) This so-called phenomenology tallies however with what we have always called semiology. We try to explain the reasons why phenomenology is misused in that way. In our view, this transformation of phenomenology into an empirical and objectifying discipline is explained by the role attributed to phenomenology by contemporary authors, which is to solve the problems raised by the Diagnostic and Statistical Manual of Mental Disorders. In this paper we defend a particular version of the epistemic approach to argumentation. We advance some general considerations in favor of the approach and then examine the ways in which different versions of it play out with respect to the theory of fallacies, which we see as central to an understanding of argumentation. Epistemic theories divide into objective and subjective versions. We argue in favor of the objective version, showing that it provides a better account than its subjectivist rival (...) of the central fallacy of begging the question. We suggest that the strengths of the objective epistemic theory of fallacies provide support for the epistemic approach to argumentation more generally. (shrink)

In defending the startling claim that that there are no artifacts, indeed, no inanimate material objects of the familiar sort, Peter van Inwagen has argued that truths about such putative objects can be paraphrased as truths that do not make essential reference to them and that we should endorse only the ontological commitments of the paraphrase. In this note I argue that the paraphrases van Inwagen recommends cannot meet his condition. Read one way, they lose us some truths. Read another, (...) they entail the existence of the very objects they are supposed to rid us of. However, we need not share van Inwagen's distaste for the latter: to say that they exist is not to say that anything exists in addition to the simples composing them. (shrink)

It is often claimed that there is an explanatory divide between an expressivist account of normative discourse and a realist conception of normativity: more precisely, that expressivism and realism offer conflicting explanations of (i) the metaphysical structure of the normative realm, (ii) the connection between normative judgment and motivation, (iii) our normative beliefs and any convergence thereof, or (iv) the content of normative thoughts and claims. In this paper I argue that there need be no such explanatory conflict. Given a (...) minimalist approach to the relevant metaphysical and semantic notions, expressivism is compatible with any explanation that would be acceptable as a general criterion for realism. This new nonexistence of the Très Riches Heures is, I would argue, crucial to the existence of its replications. It is essential for each numbered copy of the limited facsimile edition that the original manuscript not be available for all to see. Most art historians, no matter how "contextual" or theoretical, would still emphasize the necessity of looking at the objects they study with that oddly singular, egocentrically well-trained "eye"/I. Left, however, with only the piles of reproductions I am forced (...) to ask myself and my students not what is the Très Riches Heures but what are the books, pamphlets, postcards, facsimiles, and the laser discs that scholars working on the manuscript at Chantilly are now shown instead of the original? The manuscript now has the status of one of those hypothetical "lost prototypes," beloved of scholars of manuscript illumination, that can only be seen refracted in its subsequent copies. Just as hypothesizing on the influence of early medieval "lost models" on existing works has always seemed to me a futile approach to medieval book painting, and preferring to view every manuscript as an object in its own right, I am not concerned with the lost and now forever invisible Très Riches Heures itself but rather with the power of its many reproductions. That in Gettier's alleged counterexamples to the traditional analysis of knowledge as justified true belief the belief condition is satisfied has rarely been questioned. Yet there is reason to doubt that a rational person would come to believe what Gettier's protagonists are said to believe in the way they are said to have come to believe it. If they would not, the examples are not counter-examples to the traditional analysis. I go on to discuss a number of examples inspired by (...) Gettier's and argue that they, too, fail to be counter-examples either for reasons similar to those I have urged or because it is not clear that their subject does not know. (shrink)

A number of writers have deployed the notion of a point of view as a key to the allegedly theory-resistant subjective aspect of experience. I examine that notion more closely than is usually done and find that it cannot support the anti-objectivist's case. Experience may indeed have an irreducibly subjective aspect, but the notion of a point of view cannot be used to show that it does.

The authors examine the nursing practice of disposing unaltered controlled substances into public water systems as an issue for nurses concerned with the environmental harm it can cause. A summary of the history of controlled substance management reveals inconsistencies in the interpretation of current regulations that have led to disposal policies that vary by institution, according to a benchmarking survey of regional hospitals. Much attention has been given to the phenomenon of conscientious objection in the context of patient care that (...) conflicts with a nurse’s moral integrity. Nurses who are compelled to dispose narcotics down drains may also face this struggle. The authors submit that this disposal method is based on a type of double effect logic where preventing diversion is viewed as a good effect of flushing unused controlled substances that outweighs any harm it may cause, though there is little evidence to support this conclusion. Consequently, the topic deserves further study so that nurse managers and administrators can support and offer alternatives to nurses who object to flushing drugs down the drain. (shrink)

La question de la religion - de son essence, de sa fonction, de son origine - a été centrale dans la sociologie et l'anthropologie classiques. Pour la tirer des impasses et de la stagnation où elle est reléguée de nos jours, Camille Tarot propose ici un bilan critique des œuvres des meilleurs comparatistes, à travers leurs théories si contradictoires de la religion. Huit auteurs principaux sont soumis à examen : Emile Durkheim, Marcel Mauss, Mircéa Eliade, Georges Dumézil, Claude Lévi-Strauss, (...) René Girard, Pierre Bourdieu et Marcel Gauchet. L'important en la matière est d'abord d'esquiver les faux irénismes comme les querelles stériles ou haineuses, pour confronter les doctrines en profondeur et systématiquement. Ensuite, de déceler l'impensé et les refoulements que produit chaque cadre théorique, pour proposer le modèle ou l'idéal-type de la religion qui paraît le mieux fondé. Au fil de cet examen, il apparaît que l'essence du fait religieux est à rechercher à l'intersection du symbolique et du sacré, à comprendre à partir des fondations d'Emile Durkheim et de Marcel Mauss, complétées par les apports de René Girard. La possible fécondité du modèle qui se dégage ainsi s'atteste par sa capacité à relire les sources et à renouveler en profondeur les vieux problèmes des fonctions de la religion, qui n'avaient guère avancé depuis Emile Durkheim. What the rational thing to do in the face of disagreement by an epistemic peer is has been much discussed recently. Those who think that a peer’s disagreement is itself evidence against one’s belief, as many do, are committed to a special form of epistemic dependence. If such disagreement is really evidence, it seems reasonable to take it into account and to adjust one’s belief accordingly. But then it seems that the belief one ends up with depends, in part, on (...) what someone else believes, even if one does not know why that someone believes what he does. While the practical impossibility of finding actual cases of peer disagreement has been often noted, its conceptual possibility has gone unquestioned. Here we challenge this consensus and argue, first, that, strictly speaking, peer disagreement is impossible and, second, that cases of – all-too-common – near-peer disagreement present no special puzzle and require nothing more than adhering to standard principles of sensible epistemic conduct. In particular, we argue that in such cases there is no good reason to adopt the widely accepted principle that evidence of evidence is evidence. If so, even if one takes a near-peer’s disagreement as a reason for reexamining one’s belief, one is not epistemically dependent in the sense one would be if that disagreement were evidence concerning the matter in question. L'intérêt des sciences humaines pour les rapports entre TIC, langues et savoirs n'est pas nouveau. Cependant l'intelligibilité d'une construction épistémologique des relations reste un domaine en friche dans le contexte de la mondialisation. Le présent article essaie de s'en prendre à ce vide épistémologique en interrogeant particulièrement les enjeux des langues africaines dans le travail de structuration et de dissémination du savoir global et des savoirs locaux. Ces savoirs, chacun à sa manière, tentent de se construire un statut nouveau en (...) s'insérant dans les divers marchés de la connaissance. Pour cela, ils tirent profit du renouvellement des thématiques occidentales vis-à-vis des consommateurs africains d'information scientifique. En conséquence, des politiques de productivité et de circularité des savoirs s'érigent dans des stratégies d'uniformisation épistémologique. Parallèlement, la mode de la «diversité linguistique et culturelle», censée protéger les langues et savoirs locaux, risque de les transformer en de simples objets ethnographiques.The interest of the humanities to the relationship between ICT and language knowledge is not new. However, the intelligibility of a construction epistemological relations remains a fallow field in the context of globalization. This article tries to take this empty epistemological questioning particularly the issues of African languages ​​in the work of structuring and dissemination of global knowledge and local knowledge. This knowledge, in their own way, trying to build a new status by inserting themselves into the various markets for knowledge. For this, they benefit from the renewal of western themed vis-à-vis African consumers of scientific information. As a result, productivity and political knowledge circularity themselves up in uniform epistemological strategies. Meanwhile, the fashion of the "linguistic and cultural diversity," intended to protect indigenous knowledge and languages, may turn them into mere ethnographic objects. (shrink)

Because it focuses primarily on the sick body (disease), medicine ignores many of the concerns and needs of sick people. By listening to the stories of patients in the clinic, on the Internet, and in published book form, health care providers could gain a better understanding of the impact of disease on the person (illness), what it means to patients over and above their physical symptoms and what they might require over and above surgery or chemotherapy. Only by familiarizing themselves (...) with the entire emotional landscape of illness, which includes fear, anger, shame, guilt, and above all loneliness, can the healthy—medicine as well as society in general—hope to heal in a comprehensive manner. This article underlines the relevance of Mikel Dufrenne's early works (published between 1946 and 1953) for contemporary social sciences. Indeed, Dufrenne was interested in American cultural anthropology, and in Abram Kardiner's concept of “basic personality” in particular. Dufrenne tested Kardiner's concept against Kant's transcendental tradition and the phenomenological theory of Mitsein (the concept of being-with). More importantly, in this article, I demonstrate that Dufrenne's project raises the psychological question of the historicity of categories of experience.
