A bold new approach to combatting the inherent corruption of representative democracy This provocative book reveals how the majority of modern liberal democracies have become increasingly oligarchic, suffering from a form of structural political decay first conceptualized by ancient philosophers. Systemic Corruption argues that the problem cannot be blamed on the actions of corrupt politicians but is built into the very fabric of our representative systems. Building on the anti-oligarchic institutional innovations proposed by plebeian philosophers, she rethinks the republic as a mixed order in which popular power is institutionalized to check the power of oligarchy. Vergara demonstrates how a plebeian republic would establish a network of local assemblies with the power to push for reform from the grassroots, independent of political parties and representative government. Drawing on neglected insights from Niccolò Machiavelli, Nicolas de Condorcet, Rosa Luxemburg, and Hannah Arendt, Systemic Corruption proposes to reverse the decay of democracy with the establishment of anti-oligarchic institutions through which common people can collectively resist the domination of the few. It is commonly understood that over-arching transcendental values (TVs) play a major role in directly influencing individual and group behaviours, including those relating to the environment. This paper challenges this approach, by arguing that there is good evidence to indicate that personal contexts – rather than TVs – inform many decisions that individuals need to make. As such, the paper argues that individuals use their TVs as a guide to forming contextual values, in a way that TVs only influence daily (...) behaviours indirectly. In order to review the potential utility of these arguments, we offer a secondary analysis of the International Social Survey Programme. The results indicate that contexts can influence behaviours independently of the set of (transcendental) values that people may hold. (shrink)

No que toca a filosofia do direito muitas são as dúvidas que recaem sobre as distintas noções de direito consideradas não só nas reflexões teóricas sobre a jurisprudência, mas também aquelas que surgem pela _práxis_ do sistema jurídico. Michel Villey defende a tese de que a única concepção estrita e exequível de direito é aquela criada em Roma que concebe o direito como uma coisa (_res_) atribuída de modo justo, pelos juristas, aos indivíduos. Qualquer noção subjetiva de direito, além de (...) ser desprovida do sentido lato do termo, se atribuída aos filósofos antigos e medievais, não passa de uma reinterpretação errônea. Entretanto, este artigo tem por objetivo mostrar que a argumentação de Villey contém algumas lacunas quanto a sua interpretação da noção de direito em textos como os de Gaio e de Tomás de Aquino. Posição essa sustentada através de autores como Brian Tierney e Alfredo Storck, os quais apresentam uma leitura pluralista acerca das noções de direito da antiguidade e do medievo mostrando que, ainda que não houvesse a presença do termo “direito subjetivo” no vocábulo da jurisprudência da época, por vezes, o direito era empregado nesse período para significar um poder, uma liberdade ou uma vantagem do indivíduo. Group Violence Interventions combine a focused deterrence law enforcement approach with community mobilization and social services. The current study qualitatively examines Project Longevity, Connecticut's largest GVI initiative, to contribute to the limited literature on implementation of gun violence reduction strategies. Relying on interviews with 24 of Project Longevity law enforcement and non-law enforcement partners, we explore the establishment of interagency collaboration, which was viewed by study participants as the most pressing implementation challenge of Project Longevity. Throughout its great history, the feminist movement has thought the different facets of the repressive apparatus of the State, as a political problem and as part of its strategy of struggle and survival. In different contexts, antipunitivism —that is, the political response to the philosophy of punishment as the way to act to social issues— has emerged as a crucial element in the diatribes of antisystemic feminisms. However, we could not claim that there is something like a structuring and structured (...) tradition of antipunitivist feminism. Rather, what we observe is a set of concerns and political approaches of some feminisms to the strategies of punishment, in the moments in which the logics of patriarchal domination intersect with the gender-generic selectivity of the repressive apparatuses of the States. In the present work we would like to make the effort to deliberate the interaction between these approaches in order to enunciate what elements would compose an antipunitivist feminism. (shrink)

En este texto quiero hacer un análisis de las propuestas de paz del gobierno de Uribe Vélez y sus efectos en las instituciones y la cultura democrática colombiana. El análisis no pretende evaluar directamente si las propuestas de paz fueron efectivas para dar por terminado el conflicto, sino mostrar el vínculo que existe entre una democracia débil, como la colombiana, la gran influencia de la personalidad de Uribe Vélez en el imaginario político y sus proyectos de seguridad democrática y de (...) estado comunitario, en la medida en que estos proyectos hicieron parte de sus propuestas de paz. La tesis central que defiendo en este artículo es que precisamente la debilidad democrática colombiana permitió que una propuesta como la de Álvaro Uribe frente a la paz fuera apoyada por una inmensa mayoría, aunque esta propuesta en vez de profundizar la democracia hubiese debilitado más sus instituciones y la cultura ciudadana. Based on a survey and content analysis of 462 peer-reviewed academic articles over the period 1990–2014, this article reviews theories related to the external drivers of corporate social responsibility and the internal drivers of CSR that have been utilized to explain CSR. The article discusses the main tenets of the principal theoretical perspectives and their application in CSR research. Going beyond previous reviews that have largely failed to investigate theory applications in CSR scholarship, this article stresses the importance of theory-driven (...) explanations of CSR and the complementarity of different theories. The article demonstrates that the current mainstream theorizing of CSR is dominated by theories related to the external drivers of CSR and is less developed with regard to the internal dynamics. The article outlines several productive avenues for future research: the need for multi-theory studies and more research at multiple levels of analysis, particularly at the individual level of analysis. It suggests that CSR scholarship can benefit from combining theoretical insights from a range of established theoretical lenses such as institutional theory and RBV, and can gain new insights from theoretical lenses such as Austrian economics and micro-level psychological theories. In this book, Camila Loew analyzes four women's testimonial literary writings on the Holocaust to examine and question some of the tenets of the fields of Holocaust studies, gender studies, and testimony. Through a close reading of the works of Charlotte Delbo, Margarete Buber-Neumann, Ruth Klüger, and Marguerite Duras, Loew foregrounds these authors' search for a written form to engage with their experiences of the extreme. Although each chapter contains its individual focus and features, the book possesses a unity (...) in intention, concerns, and consequences. In the theoretical introduction that unites the four chapters, Loew eschews essentialism and revises the emergence of the field of Women and Holocaust studies from the early 1980s on, and signals some of its shortcomings. In response, and in accordance with a recent turn in various disciplines of the Humanities, Loew highlights the ethical dimension of testimony and its responsible commitment to the other. In dealing with the texts as literary testimonies—a complex genre, between literature and history—, testimony is freed from the obligation to respond to the requirements of factual truth, and becomes a privileged form to voice the traumatic event, and to symbolically explore the role of excess. En este ensayo retomo las narrativas sobre el levante popular de 2013 en Brasil, considerando que tales discursos están aún presentes directa e indirectamente en la manera cómo comprendemos la actualidad, sobre todo la ascensión de la derecha y nuestras posibles resistencias a los múltiples elementos fascistas crecientes hoy en nuestra sociedad. En este sentido, analizo ciertas posiciones corrientes relacionadas con las reacciones conservadoras y punitivas a las protestas populares, que acaban por concluir que las manifestaciones generaron un “mal aún (...) mayor”. Traigo a la luz algunas premisas ocultas en esas afirmaciones que, operando tanto desde puntos de vista historiográficos como filosóficos, comprometen no solamente nuestro pasado, sino también acaban por empeñar nuestro futuro. O presente artigo tem como objetivo relatar um estudo filosófico a partir da experiência em sala de aula sobre o conceito de espanto (thauma), considerando as perspectivas de Aristóteles e de Schopenhauer. Essa atividade foi realizada no âmbito do Programa Institucional de Bolsa de Iniciação à Docência (PIBID), subprojeto Filosofia, da Universidade Estadual de Londrina, no Primeiro Semestre de 2023. O principal propósito das aulas foi compreender o conceito de espanto na filosofia de Aristóteles e a peculiar utilização que Schopenhauer (...) faz desse conceito. Para atingir esse objetivo, adotou-se a metodologia de Silvio Gallo, que consiste na divisão da aula em quatro etapas, quais sejam: sensibilização, problematização, investigação e conceituação. Ao longo do texto, serão expostos tanto o passo a passo quanto os resultados da implementação em sala de aula das etapas da metodologia de Gallo. Além de obras de Aristóteles e de Schopenhauer, foram utilizados trechos deA morte de Ivan Ilitch, de Lev Tolstói, e A Metamorfose, de Franz Kafka,com o intuito de despertar o interesse dos alunos, incentivá-los a refletir sobre o espanto, expressar suas opiniões e dúvidas, explorar e sintetizar o que foi aprendido de maneira clara e objetiva. Os resultados obtidos foram satisfatórios, com os alunos demonstrando maior entendimento sobre o tema e maior capacidade de argumentação. (shrink)

RESUMEN El artículo reflexiona sobre las políticas de la memoria que deberían desarrollarse en sociedades donde han ocurrido masivas violaciones de derechos humanos, y cuyos procesos se guían por los principios normativos de la justicia transicional. Se analizan primero los conceptos de memoria e historia, y la forma como el Holocausto trans formó sus tareas en el siglo XX; luego se examinan dos modelos de responsabilidad propuestos por Iris Marion Young, y se propone cómo usarlos en la justicia transicional. Finalmente, (...) se explican las tareas de la política de la memoria en estos contextos. ABSTRACT The article carries out a reflection on the politics of memory that should be developed in societies where massive human rights violations have occurred and whose pro cesses are being guided by the normative principles of transitional justice. It starts out by analyzing the concepts of memory and history and the manner in which the Holocaust transformed their tasks in the 20th century. Ten it goes on to examine two models of responsibility proposed by Iris Marion Young, and suggests how to use them in transitional justice. The development of neuropsychological assessment methods using virtual reality (VR) is a valid and promising option for the detection of cognitive impairment in the older people, focusing on activities composed of tasks of multiple demands. This study verified the association of age, schooling, and general cognitive status on the performance of neurologically healthy older adults in ECO-VR, a virtual reality task of multiple demands for neuropsychological assessment. A total of 111 older adults answered a sociodemographic questionnaire, the Mini Mental State (...) Examination, the Vocabulary subtest of the Wechsler Intelligence Scale for Adults (third edition), and the ECO-VR. Correlation analyses, multiple linear regression, and comparisons between groups (effects by age and schooling groups) were used to evaluate the results. The ECO-VR total score was significantly associated with age, years of education, MMSE, and Vocabulary subtest. The linear regression models identified that age was the main predictor for total score and rule breaking of ECO-VR. According to the univariate analysis, it was identified the main effect of age group and schooling group in the total ECO-VR score, but there was no interaction effect. The results are discussed in order to understand the role of sociodemographic characteristics in the performance of older adults in a virtual reality task of multiple demands. It was also verified the possibility use of virtual reality for neuropsychological assessment of older adults. (shrink)

Este trabalho tem como objetivo defender a permissibilidade moral da eutanásia ativa voluntária desde a perspectiva utilitarista de John Stuart Mill. A discussão sobre este tema tem levado muitos filósofos a pensarem se é correto ou não matar indivíduos que solicitam morrer em decorrência de doença incurável. Considerando apenas aqueles que defendem a sua permissibilidade, podem-se destacar filósofos contemporâneos como Peter Singer e James Rachels, ambos utilitaristas. No entanto, neste trabalho, é a obra de Mill que norteará a defesa, tendo (...) em vista que dos autores clássicos do utilitarismo, considera-se que o dele possui melhores ferramentas conceituais que ajudam a analisar o problema da eutanásia e a propor uma defesa plausível. Sendo assim, primeiro serão apresentados os conceitos-chave da obra de Mill; em seguida, explicar-se-á o que é eutanásia e o que se entende neste trabalho por “doença incurável”. No terceiro momento serão discutidos os aspectos relevantes que envolvem a competência do indivíduo e se eutanasiar deve ser considerado moralmente errado. Por último será feita a defesa a partir dos princípios millianos. (shrink)

O artigo clarifica em que medida a Lógica, no sentido mais comum e até ingênuo do termo, enquanto composta pelas leis necessárias do pensamento correto, pode ser entendida como Mística. Isto parece estranho, pois a Mística é normalmente entendida como uma vivência de superação das dualidades, onde o pensamento racional colapsa e encontra seu limite. Já a Lógica é entendida como paradigma de pensamento racional. Argumenta-se que as leis mais gerais da razão e do discurso se relacionam com a Mística (...) na medida mesma em que o fundamento da razão é equacionado ao seu limite. A linguagem encontra-se assim com o silêncio e as leis e fundamentações não mais operam como tais. Conclui-se que a adesão necessária que acompanha o colapso entre o sentido e o valor de verdade de determinadas expressões linguísticas constitui o que chamamos de vivência mística. Trata-se de uma vivencia a qual somos conduzidos pelo próprio funcionamento de nossa significação e, ao mesmo tempo, institui o que se compreende por experiência religiosa. Palavras-chave : Mística. Extensão.This paper clarifies the extent to which Logic, in the usual sense (and even naïve) of the term, as composed of the correct thinking’s necessary laws, can be understood as Mystic. This seems strange, because the Mystic is usually understood as an experience of overcoming the dualities, where rational thinking collapses and finds its limit. On the other hand, the logic is understood as the paradigm of rational thinking. It is argued that the most general laws of reason and speech are related to Mystic in the sense that the foundation of the reason is equated to its limit. The language lies thus with the silence and the laws and justifications no longer operate as such. We conclude that the adherence necessary that accompanies the collapse of meaning and truth value of certain linguistic utterances is what we call mystical experience. The judgement of human ability is ubiquitous, from school admissions to job performance reviews. The exact make-up of ability traits, however, is often narrowly defined and lacks a comprehensive basis. We attempt to simplify the spectrum of human ability, similar to how five personality traits are widely believed to describe most personalities. Finding such a basis for human ability would be invaluable since neuropsychiatric disease diagnoses and symptom severity are commonly related to such differences in performance. Here, we identified four (...) underlying ability traits within the National Institutes of Health Toolbox normative data (n= 1, 369): (1) Motor-endurance, (2) Emotional processing, (3) Executive and cognitive function, and (4) Social interaction. We used the Human Connectome Project young adult dataset (n= 778) to show that Motor-endurance and Executive and cognitive function were reliably associated with specific brain functional networks (r2= 0.305 ± 0.021), and the biological nature of these ability traits was also shown by calculating their heritability (31 and 49%, respectively) from twin data. O presente artigo debruça-se na crítica de Diderot à Helvétius. Apesar da crítica ser feita pontualmente a cada trecho comentado do livro De l’Homme de Helvétius, consideramos que ela possui um núcleo principal, que é a diferente concepção de materialismo dos autores e suas consequências para o que ambos anseiam para a sociedade. Por isso, investigamos o que há no horizonte do materialismo de Helvétius e de Diderot no que concerne à educação e como, apesar de estarem próximos no ponto (...) de partida, o materialismo, seu norte é diferente. A escolha do tema da educação justifica-se por tratar-se de algo que ultrapassa a teorização filosófica e busca inserção prática na sociedade, mostrando assim não só as consequências práticas das teses materialistas como também o ideal de sociedade proposto por cada autor. Aqui, apontamos para as principais diretrizes sobre a construção de uma educação institucional em De l’Esprit (1754) e De l’Homme (1771), de Helvétius, nas Em Reflexions sur le livre De l’Esprit (1877) e Refutations suivre l’ouvrage intitule De l’Homme (1877)1, e em outras obras de Diderot. 1 As críticas reunidas de Diderot foram publicadas apenas postumamente. Estima-se que a segunda, dedicada à De l’Homme foi redigida em um longo período, que coincide com a redação do Plan d’Université (1775) e Elements de Phisiologie (1875). (shrink)

Is it possible to provide a theory of truth that is capable of distinguishing the semantic status of paradoxical sentences from that of other ungrounded sentences without bringing meta-linguistic resources into play? We explore an account that extends Kripke's theory of truth with two primitive operators, one standing for the notion of paradoxicality and the other for the notion of hypodoxicality. Our results are mixed. While the paradoxicality operator behaves nicely, a number of restrictions need to be imposed to accommodate (...) the hypodoxicality operator. (shrink)

O objetivo deste artigo é retomar e requalificar a distinção entre conceitos e objetos, tal como proposta por Frege, no célebre Sobre o Conceito e o Objeto (1892), reforçando sua importância para a compreensão da distinção entre dizer e mostrar, proposta pelo Wittgenstein do Tractatus. O texto também estabelece a influência da mencionada distinção para o tratamento pelo primeiro Wittgenstein dos paradoxos por impredicatividade. Retomamos então as análises de Charles Travis sobre o assunto, em: Where Words Fail (2020), levando-se em (...) conta o ponto de vista da filosofia do segundo Wittgenstein. Para Travis, o obstáculo envolvido na distinção entre conceitos e objetos não passaria de uma confusão filosófica, devendo ser ela mesma dissolvida. Os argumentos propostos por Travis são também aqui brevemente passados em revista, mas nosso foco consiste principalmente em concluir que a importância da distinção deve ser rastreada nos limites do que pode ser descrito ou definido adicionalmente, e se configura como fim das explicações na base do que constitui a determinação semântica. Neste sentido, a importância dessa distinção ultrapassaria mesmo o âmbito da influência na filosofia do primeiro Wittgenstein, e apareceria como dizendo respeito à abordagem da generalidade linguística nela mesma. A partir dos questionamentos de uma turma de Sociologia do Ensino Médio, bastante comovida com o assassinato da vereadora Marielle Franco, que causou comoção nacional, foi organizada uma atividade para apresentar sua trajetória pessoal e política. No intuito de fundamentar a aula na perspectiva interseccional, o recurso didático principal representou a silhueta do rosto de Marielle, em forma de desenho, composto de cinco partes indissociáveis. Cada fragmento trazia uma categoria sociológica: classe, raça, gênero, sexualidade e protagonismo, que, debatidas com a (...) turma, previamente à colagem de cada peça, promoveram reflexões sobre o significado dos conceitos e de como se entrelaçam à história de vida de Marielle. O trabalho abordou conceitos clássicos das Ciências Sociais, como o de fato social de Émile Durkheim, por meio de um olhar inventivo e partindo de uma problematização suscitada pela turma. (shrink)

Este artigo visa investigar outros modos de existência civilizacional, a partir dos desafios de reincorporação da (...) alteridade, propondo as inflexões que permeiam as visões do autor acerca da ética da alteridade, pautadas na dialogicidade, na experiência da negatividade do outro e nos imbricamentos entre o sujeito e o alter, bem como na alteridade das coisas, como modos de enfrentamento de tal cenário de barbárie, de maneira a reconfigurar as condições de ser e estar no mundo contemporâneo. Los marcadores discursivos han sido objeto de estudio de numerosas investigaciones en las últimas décadas, y se ha profundizado en su definición y clasificación en el ámbito más general de las partículas, es decir, las partes invariables del discurso. En el presente artículo se describe una propuesta metodológica basada en un enfoque mixto (cuali-cuanti) para la detección automática de marcadores discursivos parentéticos a través de un corpus paralelo inglés-castellano. Proponemos un algoritmo que identifica indicios de una función de marcador discursivo (...) de una unidad y, de ser el caso, su carácter polifuncional. Se presentan resultados de un estudio dirigido a la categoría específica de los conectores causal-consecutivos. El algoritmo en primer lugar determina la eventual condición de marcador discursivo de la unidad, luego señala si pertenece a la categoría específica de conectores causal-consecutivos y, finalmente, señala si hay indicios de polifuncionalidad. Through the works of Plato, Aristotle, Polybius and Machiavelli, it reconstructs a dimension of political corruption particular to popular governments and also engages with recent neo-republican and institutionalist attempts at redefining political corruption. The article concludes that we still lack a proper conception of systemic corruption comparable to the one of the (...) Ancients because we are yet unable to account for the role procedures and institutions play in fostering corruption through their normal functioning and what this means for liberal democratic regimes. Dans cette contribution nous interrogerons la notion d’alèthurgie pour vérifier si la critique dont parle Foucault doit passer par une manifestation de la vérité ou s’il est possible d’inclure dans l’alèthurgie des formes de critique qui refusent l’obligation de dire-vrai sur soi-même – ce qu’on désignera comme « alèthurgie négative ». Ensuite, on cherchera dans l’ Ecce Homo de Nietzsche des stratégies de la critique qui au lieu de s’indexer à la vérité semblent suggérer un renversement parodique qui ancre la (...) critique dans des formes autres de vérité. Enfin, sous l’angle de l’alèthurgie négative, on reviendra sur l’opposition entre parrêsia et rhétorique tracée par Foucault pour remettre en question le primat qu’il accorde à la première. (shrink)

Considerando que a mulher que se encontra numa relação amorosa violenta, muitas vezes, persiste na manutenção dessa conjugalidade, este estudo objetivou investigar a experiência emocional de mulheres que vivenciam ou já vivenciaram uma relação conjugal violenta. Foram realizadas entrevistas individuais com seis mulheres beneficiárias de uma ONG dedicada à violência intrafamiliar. Cada entrevista foi mediada pela apresentação de uma narrativa interativa, a partir da qual a participante era convidada a inventar o desfecho. Após cada entrevista, a entrevistadora redigiu uma narrativa (...) transferencial sobre o encontro. O conjunto das narrativas transferenciais foi analisado psicanaliticamente à luz da Teoria dos Campos. Foi identificado o campo “Infeliz(es) para sempre”, em que as participantes manifestaram sofrimento radical frente à possibilidade de ficarem sozinhas, “preferindo” compartilhar a infelicidade com o cônjuge agressor a lidarem com o desamparo. Considera-se que tais achados podem auxiliar na intervenção dos profissionais que atuam junto a esse grupo social específico. (shrink)

Este artigo perpassa dois momentos da história das teorias da lei natural: em primeiro lugar, Tomás de Aquino que representa a tradição na investigação do conceito e, em segundo lugar, a discussão contemporânea de John Finnis que representa, particularmente, a quebra dessa tradição. A escolha por esses autores não é aleatória visto que, a filosofia de Tomás é considerada por diversos comentadores como uma das teorias mais importantes acerca da lei da natureza e a teoria de Finnis, por outro lado, (...) é uma das mais conhecidas e criticadas na literatura atual sobre a lei. Dito isso, o objetivo deste artigo é, além de apresentar a teoria de cada um dos autores supracitados, discutir algumas questões que surgem a partir da conexão entre Tomás e Finnis que é estabelecida por este segundo, na medida em que ele tem em Tomás uma fonte de autoridade para seus argumentos. Desse modo, por vezes, com o texto de Finnis temos a impressão de estar frente a uma releitura da teoria do aquinate, mas logo compreendemos que essa releitura extrapola os limites aceitos para uma reinterpretação que não distorça a argumentação original. Por consequência, encontramos em Finnis uma teoria com inúmeros problemas do ponto de vista teórico e prático, argumento defendido por comentadores como William May, Jeremy Shearmur e Russel Hittinger os quais serão apresentados durante este texto. In this paper I argue that some examples of what we label ‘algorithmic bias’ would be better understood as cases of institutional bias. Even when individual algorithms appear unobjectionable, they may produce biased outcomes given the way that they are embedded in the background structure of our social world. Therefore, the problematic outcomes associated with the use of algorithmic systems cannot be understood or accounted for without a kind of structural account. Understanding algorithmic bias as institutional bias in particular (as (...) opposed to other structural accounts) has at least two important upshots. First, I argue that the existence of bias that is intrinsic to certain institutions (whether algorithmic or not) suggests that at least in some cases, the algorithms now substituting as pieces of institutional norms or rules are not “fixable” in the relevant sense, because the institutions they help make up are not fixable. Second, I argue that in other cases, changing the algorithms being used within our institutions (rather than getting rid of them entirely) is essential to changing the background structural conditions of our society. The Mapuche people are a native group from the extreme south of Latin America. Their culture is based on the interconnectedness between the cohabitants of the environment, including human and non-human categories of life. The closest concept to consciousness for them would be Mapuche rakizuamor Mapuche thinking, which is defined as a particular kind of reflexivity or state of awareness of the interdependence of people with natural and spiritual entities. This understanding of the human condition represents a relational ontology, which (...) cannot be translated to the predominating individualistic approach. Although the mind–body distinction is not a central point within Mapuche culture, these dimensions can be explored through crucial processes of the life cycle such as socialization, illness, and death. Contributions from cultural psychology and Indigenous psychology are taken into account regarding the challenge to address the interplay between culture and the human psyche more appropriately. Feminisms in the second half of the twentieth century were reshaped by the efforts to end violence against women. Feminist activists in national and international settings invented concepts to refer to previously unquestioned societal practices as oppressive to women and changed the world by naming them. In this article, I engage with the concepts of femicide/feminicidio : the murder of women for gender reasons. I follow the history of this concept and its incursion into the broader political and public sphere (...) in Latin America. Focusing on the Mexican case, I show how the study of national feminist histories is relevant to the history of women’s activism in the international arena. This article contributes to the history of concepts by showing the linguistic distinctions and connections of feminist concepts in different sociocultural environments. Overall, this research argues in favor of studying feminist concepts with Latin American perspectives to articulate the complexity of the world today. (shrink)

This essay reviews Skeggs’ and Wilson’s papers in this issue of Feminist Legal Studies in terms of their development of, and departure from, ideas central to the Italian post-Marxist, post-workerist tradition; specifically their understanding that capital is increasingly converging with the production and reproduction of social life itself. I interrogate the assumed necessity to move beyond ‘the limitations of Marx’ by revealing, via the Communist Manifesto, Grundrisse and Capital, how the ideas of ‘old’ Marx can offer important engagements and interlocutions (...) with the ‘new’ empirical phenomena explored by Skeggs and Wilson. I show how Marx’s notion of creative destruction is in tune with Wilson’s work on the erotic generativity of capitalism, and how his observations on labour-time as the measure of value illuminate the exchange and circulation of Wife Swap. Finally, I suggest that we might be wary not to lose sight of the question of resistance by regarding immaterial labour as productive labour, and thus relinquishing Marx’s conceptual tools of labour, value and capital. The article presents a plebeian strand of republican constitutional thought that recognises the influence of inequality on political power, embraces conflict as the effective cause of free government, and channels its anti-oligarchic energy through the constitutional structure. First it engages with two modern plebeian thinkers – Niccolò Machiavelli and Nicolas de Condorcet - focusing on the institutional role of the common people to resist oppression through ordinary and extraordinary political action. Then it discusses the work of two contemporary republican thinkers (...) – Philip Pettit and John McCormick – and contrasts their models of ‘contestatory’ and ‘tribunician’ democracy. Finally, I incorporate a political economy lens and propose as part of republican constitutionalism not only contestatory and tribunician institutions but also anti-oligarchic basic rules to keep inequality and corruption under control.
