The Patient Self Determination Act of 1991 brought much needed attention to the importance of advance care planning and surrogate decision-making. The purpose of this law is to ensure that a patient’s preferences for medical care are recognized and promoted, even if the patient loses decision-making capacity. In general, patients are presumed to have DMC. A patient’s DMC may come under question when distortions in thinking and understanding due to illness, delirium, depression or other psychiatric symptoms are identified or suspected. (...) Physicians and other healthcare professionals working in hospital settings where medical illness is frequently comorbid with depression, adjustment disorders, demoralization and suicidal ideation, can expect to encounter ethical tension when medically sick patients who are also depressed or suicidal request do not resuscitate orders. This article probes the relationship among constitutionalism, extra-legal prerogative power, and citizen judgment. While much has been written about the nature of Lockean prerogative, and while his theory serves as a direct inspiration for contemporary "normative extra-legalists," key participants in the debate over emergency powers, less attention has been paid to how the people judge prerogative. Attention to this issue is useful because an examination of the process of political judgment of extra-legalism in Locke leads to a complication of the (...) current extra-legalist vision of democratic mechanisms of accountability. The author argues that the extra-legal approach is right to consider the role of democratic publics in potentially constraining the exercise of emergency powers but wrong to formulate that role as one extra-constitutional power checking another extra-constitutional power. The author situates both prerogative power and citizen judgment of it at the threshold of the constitutional order. (shrink)

In the dyadic and triadic sharing of emotions, intentions, and behaviors in families, interactive synchrony is important to the early life experiences that contribute to the development of cultural cognition. This synchrony likely depends on neurobiological circuits, currently under study with brain imaging, that involve attention, stress response, and memory.

The main question that Firestone & Scholl (F&S) pose is whether “what and how we see is functionally independent from what and how we think, know, desire, act, and so forth” (sect. 2, para. 1). We synthesize a collection of concerns from an interdisciplinary set of coauthors regarding F&S's assumptions and appeals to intuition, resulting in their treatment of visual perception as context-free.

Face perception is a highly conserved process that directs our attention from infancy and is supported by specialized neural circuitry. Oxytocin can increase accuracy and detection of emotional faces, but these effects are mediated by valence, individual differences, and context. We investigated the temporal dynamics of oxytocin’s influence on the neural substrates of face perception using event related potentials (ERP). In a double blind, placebo controlled within-subject design, 21 healthy male adults inhaled oxytocin or placebo and underwent ERP imaging during (...) two face processing tasks. Experiment 1 investigated effects of oxytocin on neural correlates of fearful versus neutral facial expressions, and Experiment 2 manipulated point-of-gaze to neutral faces. In Experiment 1, we found that oxytocin reduced N170 latency to fearful faces. In Experiment 2, N170 latency was decreased when participant gaze was directed to the eyes of neutral faces; however, there were no oxytocin-associated effects in response to different facial features. Findings suggest oxytocin modulates early stages of social perception for socially complex information such as emotional faces relative to neutral. These results are consistent with models suggesting oxytocin impacts the salience of socially informative cues during processing, which leads to downstream effects in behavior. Future work should examine how oxytocin affects neural processes underlying basic components of social behavior (such as, face perception) while varying emotional expression of stimuli or comparing different characteristics of participants (e.g., gender, personality traits). Vasubandhu is perhaps the most influential figure in the history of Buddhist philosophy, yet the very breadth of his contribution across many schools and traditions has led to a fragmentation of his works, as interpreters have tended to read them through the lens of narrow scholastic perspectives, finding little continuity or coherence. Some modern scholars, doubtful that anyone could have held such varied views, have gone so far as to divide Vasubandhu himself into two distinct philosophers, with two different and (...) irreconcilable views. Psychological construction constitutes a different paradigm for the scientific study of emotion when compared to the current paradigm that is inspired by faculty psychology. This new paradigm is more consistent with the post-Darwinian conceptual framework in biology that includes a focus on (a) population thinking (vs. typologies), (b) domain-general core systems (vs. physical essences), and (c) constructive analysis (vs. reductionism). Three psychological construction approaches (the OCC model, the iterative reprocessing model, and the conceptual act theory) are discussed with respect to (...) these ideas. (shrink)

Plato, Aristotle, Kant, Brentano, Moore, and Chisholm have suggested marks or criteria of intrinsic goodness. I distinguish among eight of these. I focus in this paper on four: (a) unimprovability, (b) unqualifiedness, (c) dependence upon intrinsic natures, and (d) incorruptibility. I try to show that each of these is problematic in some way. I also try to show that they are not equivalent – they point toward distinct conceptions of intrinsic goodness. In the end it appears that none of them (...) is fully satisfactory. Insofar as none of these succeeds, a fundamental problem remains for those who make use of the concept of intrinsic value. Cambridge, Mass: Harvard University Press, 2002. xiv + 386 pp. Cloth, $39.95. This survey of Jewish culture outside of Palestine, that is, the diaspora, during the period from Alexander the Great to Nero challenges the sensus communisin point after point through a fresh, nuanced rereading of the primary texts. (...) Gruen's greatest contribution is that he sees the events, particularly alleged anti-Semitism, of Jewish history and the literature produced by Hellenistic Jews against the backdrop of the events of contemporary non-Jewish history and culture.An excellent example of Gruen's extremely sensible and balanced evaluation of primary sources is to be seen in his examination of the Jewish community of Rome. In particular, he focuses on the periodic expulsions of the Jews from Rome in the late Republic and early Principate. Gruen rightly calls attention to the fact that the expulsion in 139 B.C.E.included others, namely Chaldeans and worshippers of Sabazius, besides Jews. Even more important, he correctly concludes that the expulsion did not discourage Jews from dwelling in the city, since they continued to be there in sizable numbers by the age of Cicero, as we know from Pro Flacco. Gruen appositely notes that a mere two decades earlier, in 161 B.C.E., the Senate authorized the expulsion of philosophers and rhetors, but that in 155 B.C.E.Greek philosophers were again in Rome. Similarly, many sumptuary laws were repeatedly passed (hence unenforced), which were plainly unenforceable. In short, the Jews continued to feel comfortable in Rome. [End Page 313]As to the pogrom in Alexandria in the year 38 C.E., Gruen, through a careful reading of Philo, convincingly concludes that the deep-rooted hostility of which he speaks applies primarily to rank and file, lower-class Egyptians rather than to Greeks. And yet, we may remark, the fact that in the wake of this pogrom a Greek embassy went to the Emperor in Rome would seem to indicate that the Greeks had formed an unholy alliance with the Egyptians and that the event that triggered the uprising was the triumphal visit of Agrippa I, who had just been crowned king of Judea in Rome, and the charge of dual loyalty that his visit brought to the surface. But, as Gruen notes, the Jewish community in Alexandria had fared well politically and economically, except for this incident, which was clearly exceptional.Another excellent example of fresh insight is Gruen's analysis of the background of the documents preserved by Josephus that consist of Roman responses to Jewish appeals for protection of their rights, which were endangered by the actions of Greek cities in Asia Minor. Other scholars have viewed these documents as evidence that the Jews were persecuted by local Greek officials and were regularly rescued by Roman intervention. Gruen has convincingly shown that most of the documents belong to a very brief period of time when Rome was in the midst of a seemingly endless series of civil wars and realignments and that the circumstances were exceptional rather than representative. On the contrary, the documents themselves demonstrate that the Jewish communities were flourishing during this period.One factor to which Gruen does give due consideration but dismisses is the Roman resentment of proselytism by Jews. He notes Tacitus' statement (Histories5.5.2) that proselytes abandoned their ancestral religions, scorned their native gods, deserted their nation, and do not care for parents, children, or siblings. Tacitus, he says, here excoriates apostates but suggests no Jewish menace. Tacitus' language, however, is strong even for a rhetorician and does suggest a Jewish menace for the Roman nation, of which the native religion was an integral part. Horace, to be sure a satirist, likewise alludes to the Jews' zeal in seeking converts as if it were proverbial: "We are more numerous, and like the Jews we shall force you to defer [concedere, yield] to our throng" (Satires1.4.142-43). According to the conceptual act theory, emotions emerge when physical sensations in the self and physical actions in others are meaningfully linked to situations during a process that can be called both cognitive and perceptual (creating emotional experiences, and emotion perceptions, respectively). There are key four hypotheses: (a) an emotion (like anger) is a conceptual category, populated with instances that are tailored to the environment; (b) each instance of emotion is constructed within the brain’s functional architecture of domain-general core systems; (...) (c) the workings of each system must be holistically understood within the momentary state of the brain, the body, and the surrounding context; (d) being emergent states, emotional episodes have functional features that physical states, alone, do not have. In a recent note, D. Braund has challenged my identification of the Pollio (Josephus,Antiquities15.343) at whose home in Rome Herod's sons Alexander and Aristobulus stayed in 22 b.c. as Gaius Asinius Pollio, the famous consul of 40 b.c., who was a close friend of Julius Caesar and to whom Virgil dedicated his Fourth Eclogue. Braund's argument rests upon five grounds. (1) If this Pollio were a man of the stature of Asinius Pollio, we would expect Josephus to make his identity (...) clear and not to describe him solely as one of Herod's most devoted friends (⋯νδρ⋯ς τ⋯ν μάλιστα σπουδασάντων περ⋯ τ⋯ν Ἡρώδου ɸιλίαν). (2) Josephus' reference to Pollio here is different from the definite references to Asinius Pollio elsewhere in Josephus, where he is referred to as Asinius (Ant.14.138) or Gaius Asinius Pollio (Ant.14.389). (3) In the latter passage his name is spelledΠωλίωνος, whereas the name of the host of Herod's sons is spelledΠολλίωνος. (4) When Herod sent two other sons to Rome, they stayed ‘with a certain Jew’ (Ant.17.20), and hence it seems likely that the two other sons likewise stayed with a Jew. In 1982, Feldman and Ballard published "Connectionist models and their properties" in Cognitive Science , helping to focus attention on a family of similarly inspired research strategies just then under way, by giving the family a name: "connectionism." Now, seven years later, the connectionist nation has swelled to include such subfamilies as "PDP" and "neural net models." Since the ideological foes of connectionism are keen to wipe it out in one fell swoop aimed at its "essence", it is worth (...) noting the diversity of not only the models but also the aspirations of the modelers. There is no good reason to suppose that they all pledge allegiance to any one principle.. (shrink)

Linguists intuitions about language change can be captured by adynamical systems model derived from the dynamics of language acquisition.Rather than having to posit a separate model for diachronic change, as hassometimes been done by drawing on assumptions from population biology (cf.Cavalli-Sforza and Feldman, 1973; 1981; Kroch, 1990), this new modeldispenses with these independent assumptions by showing how the behavior ofindividual language learners leads to emergent, global populationcharacteristics of linguistic communities over several generations. As thesimplest case, we formalize the example (...) of two grammars and show that eventhis situation leads directly to a nonlinear (quadratic) dynamical system.We study this one parameter model in a variety of situations for differentkinds of acquisition algorithms and maturational times, showing howdifferent learning theories can have very different evolutionaryconsequences. This allows us to formulate an evolutionary criterion for theadequacy of grammatical and learning theories. An application of thecomputational model to the historical loss of Verb Second from Old French toModern French is described showing how otherwise adequate grammaticaltheories might fail the evolutionary criterion. The so-called internalism/externalism debate is of interest in epistemology since it addresses one of the most fundamental questions in the discipline: what is the basic nature of epistemic justification? What has been called epistemic internalism holds, as the label suggests, that all the relevant factors that determine positive epistemic status of a belief must be “internal”. A common way that the “internal” is understood is those things that are, or easily can be, available to the agent’s conscious awareness. However, there (...) is another, and increasingly popular, way of spelling out the epistemically “internal”. A view advocated by Feldman and Conee which they regard as a kind of epistemic internalism, called ‘Mentalism’, holds that epistemic justification strongly supervenes upon the mental. In this paper I will show that even many of those who claim to deny an awareness requirement implicitly appeal to it to motivate their accounts of justification. By considering the arguments for ‘Mentalism’ I will show that, unless an awareness requirement is presupposed, the cases that such arguments appeal to are of no intuitive force. Therefore, insofar as one wants to be an internalist about epistemic justification, one needs to motivate, articulate, and defend an access/awareness condition. Epistemic Internalism, properly construed, ought to stress the epistemic significance of consciousness and the first person perspective. (shrink)

Is the United States "the land of equal opportunity" or is the playing field tilted in favor of those whose parents are wealthy, well educated, and white? If family background is important in getting ahead, why? And if the processes that transmit economic status from parent to child are unfair, could public policy address the problem? Unequal Chances provides new answers to these questions by leading economists, sociologists, biologists, behavioral geneticists, and philosophers.New estimates show that intergenerational inequality in the United (...) States is far greater than was previously thought. Moreover, while the inheritance of wealth and the better schooling typically enjoyed by the children of the well-to-do contribute to this process, these two standard explanations fail to explain the extent of intergenerational status transmission. The genetic inheritance of IQ is even less important. Instead, parent-offspring similarities in personality and behavior may play an important role. The goal of this study was to determine whether it is possible to teach children with serious decoding problems four text comprehension strategies in listening contexts. The subjects were 9-11 year old students from special schools for children with learning disabilities. All the students were very poor at decoding; half of the group were also poor listeners, whereas the other half consisted of normal listeners. The experimental children were trained in strategies of clarifying, questioning, summarising and predicting through a combination (...) of reciprocal teaching and direct instruction. The results indicated significant programme effects on a strategic listening comprehension test. A transfer effect on general listening comprehension and general reading comprehension tests was not found. The poor listeners within the experimental group did not perform better than the normal listeners. (shrink)

Hemos tomado algunos de los diálogos socráticos de Platón para pesquisar cómo opera esto ahí, cuál es su motivación última y cuál su sentido. El supuesto básico es que cabe, en algún sentido, pensar la actividad filosófica como un “saber del saber”. El hilo conductor lo constituye el (...) examen de ciertos pasajes ejemplares en donde aparece la llamada “analogía del arte”, a través de la cual se ponen al descubierto ciertos caracteres esenciales del saber. Finalmente se concluye que la motivación de un “saber referido al saber” no puede ser “epistemológica” sino fundada en la preocupación por alcanzar una vida de excelencia. (shrink)

A skew in sex ratio at birth occurs across much of Asia and North Africa. The resulting gender imbalance in favor of men in the adult population causes a number of serious social problems, including increased violence against women and an increasing number of “forced bachelors” in many areas. Here we concentrate on the sex ratio at birth in China and model two causal factors specific to Chinese culture: a traditional preference for sons over daughters and a preference for brides (...) to move to their husband’s natal home (virilocal marriage). We use cultural niche construction models to explore the interacting effect of both son preference and marriage-type preference on the demography of the region. Finally, we discuss the implications of this model for policy interventions in the future. (shrink)
