Neoliberalism is invariably presented as a governing regime of market and competition-based systems rather than as a set of migratory practices that are re-setting the ethical standards of the academy. This article seeks to explore the way in which neoliberalism is shifting the prevailing values of the academy by drawing on two illustrations: the death of disinterestedness and the obfuscation of authorship. While there was never a golden age when norms such as disinterestedness were universally practiced they represented widely accepted (...) aesthetic ideals associated with academic life. By contrast, neoliberal academics embrace a new set of assumptions and norms that stand in sharp relief to many of the values that were previously espoused. Practices that might have been regarded as ethically dubious by earlier generations of academics, such as grantsmanship, self-justificatory expressions of interestedness and tangential claims to authorship, are now regarded as legitimate and positive virtues in a more aggressive age of hyper-performativity. Ectogenesis, or the use of an artificial womb to allow a foetus to develop, will likely become a reality within a few decades, and could significantly affect the abortion debate. We first examine the implications for Judith Jarvis Thomson’s violinist analogy, which argues for a woman’s right to withdraw life support from the foetus and so terminate her pregnancy, even if the foetus is granted full moral status. We show that on Thomson’s reasoning, there is no right to the death (...) of the foetus, and abortion is not permissible if ectogenesis is available, provided it is safe and inexpensive. This raises the question of whether there are persuasive reasons for the right to the death of the foetus that could be exercised in the context of ectogenesis. Eric Mathison and Jeremy Davis have examined several arguments for this right, doubting that it exists, while Joona Räsänen has recently criticized their reasoning. We respond to Räsänen’s analysis, concluding that his arguments are unsuccessful, and that there is no right to the death of the foetus in these circumstances. (shrink)

Forces including extreme economic inequality, cultural polarization, and the monetizing and privatizing of persons as commodities are undermining the forms of moral recognition and mutuality upon which democratic practices and institutions depend. These underlying factors, together with more direct modes of political corruption, manipulation, and authoritarian nationalism, are undoing Western democracies. This essay identifies and explores some vital underpinnings of democratic citizenship and civic learning that remain open to revitalization and repair. Building care structures and practices from the ground up (...) and developing inclusive and egalitarian modes of solidarity in a pluralistic society are the focus of discussion. The essay argues that solidarity and care are essential relationships and practices of moral recognition upon which democratic political agency and freedom rest. The social‐relational lifeworld and the democratic lifeworld are interdependent. Democratic citizenship is itself a relational practice that supports other practices. Democratic governance properly carried out fosters an underlying social solidarity and care and in turn draws moral and political legitimacy upward from them. (shrink)

Many working in bioethics today are engaging in forms of normative interpretation concerning the meaningful contexts of relational agency and institutional structures of power. Using the framework of relational bioethics, this article focuses on two significant social practices that are significant for health policy and public health: the practices of solidarity and the practices of care. The main argument is that the affirming recognition of, and caring attention paid to, persons as moral subjects can politically motivate a society in three (...) respects. The recognition of solidarity and the attention of care can prompt progressive change toward a democratic willingness: (a) to provide for equal respect for rights and dignity; (b) to provide the social resources and services needed for just health and well‐being; and (c) to focus its creativity and wealth on the actualization of potential flourishing of each and all. Solidarity is discussed as a morally developmental stance that moves from standing up for another, standing up with another, and standing up as another. Care is discussed as a morally developmental stance that moves from the attentive rehabilitation of another, attentive companionship with and for another, and attentive commitment to another. What is the nature of the decision-related personal values of corporate management? Managers' attitudes and behaviors are built upon their personal value systems (PVS). Knowledge about the structure of management's PVS assists in understanding the attributes of corporate decision making. Utilizing a survey instrument developed and used by England (1967, 1975), this article updates this research into corporate managers' personal value systems. England's PVS consists of sixty-six pre-tested values clustered into five groups. As one could expect with personal values, statistical (...) tests reveal that even with dramatic changes in the business environment the overall personal values structure has not changed over the intervening three decades. The results also reveal that corporate managers retain their pragmatic value orientation as discussed by England. (shrink)

This paper offers an account of the important role which an obligation to provide reasons can play in avoiding some of the systematic difficulties encountered in the theory of rational social choice. The paper builds on some of the insights offered by theories of structure-induced equilibrium. It argues that the obligation to provide reasons for certain choices, reasons which must be articulated and structured around a set of generally shared and publicly comprehensible categories of thought, can serve to make the (...) space of possible choices "concept-sensitive" in a very useful way. Concept-sensitivity has the effect of restricting certain movements within the choice space so that some of the difficulties for achieving an equilibrium in social choice, difficulties which arise out of an excess of rational doing, are avoided. The resulting equilibrium is path dependent, of course, but because it is dependent on a choice path which "makes sense" (or is ordered by thought precisely because it is concept-sensitive), it is not the sort of arbitrary path dependent social choice which was of such concern to Kenneth Arrow in his original Nobel prize winning work. The paper illustrates its points with examples taken from the law. The law is a method of making social choices which emphasizes (in a very self-conscious way, and one which has no parallel either in politics or the market) the justificatory significance of the obligation to give publicly accountable reasons which attend to those issues arising in an ordered way out of a highly structured adjudicative process. Thus, the paper has as one of its ambitions the bringing together of two accounts of rational decision-making which, to this point at least, have not had much contact, namely, the theory of rational social choice and the theory of legal reasoning. Ravit Dotan argues that a No Free Lunch theorem from machine learning shows epistemic values are insufficient for deciding the truth of scientific hypotheses. She argues that NFL shows that the best case accuracy of scientific hypotheses is no more than chance. Since accuracy underpins every epistemic value, non-epistemic values are needed to assess the truth of scientific hypotheses. However, NFL cannot be coherently applied to the problem of theory choice. The NFL theorem Dotan’s argument relies upon is a member (...) of a family of theorems in search, optimization, and machine learning. They all claim to show that if no assumptions are made about a search or optimization problem or learning situation, then the best case performance of an algorithm is that of random search or random guessing. A closer inspection shows that these theorems all rely upon assigning uniform probabilities over problems or learning situations, which is just the Principle of Indifference. A counterexample can be crafted that shows that NFL cannot be coherently applied across different descriptions of the same learning situation. To avoid this counterexample, Dotan needs to privilege some description of the learning situation faced by scientists. However, this means that NFL cannot be applied since an important assumption about the problem is being made. So Dotan faces a dilemma: either NFL leads to incoherent best-case partial beliefs or it is inapplicable to the problem of theory choice. This negative result has implications for the larger debate over theory choice. (shrink)

Public health involves the use of power to change institutions and redistribute resources and deliberately to shape individual thought and behavior. This requires normative legitimation and demands ethical critique. This article explores concepts that are vital to public health ethics, but have been relatively neglected. These are membership, solidarity and the concept of place. The article argues that the practice of public health should recognize the equal rights of membership in communities of health justice. Public health should also rely on (...) a sense of obligation and mutual aid in a world of shared vulnerability and reciprocal recognition. Finally, public health achieves its goals not merely—and perhaps not most fundamentally—through information and altering the logical ratiocination of individuals or groups, but rather through the reformation of sense and sensibility. This essay argues that, despite the failure of demarcation criteria for separating science from non-science, the mathematics of design and design-theoretic inferences nonetheless satisfy all the criteria of various competing theories of scientific explanation.

Word in noise identification is facilitated by acoustic differences between target and competing sounds and temporal separation between the onset of the masker and that of the target. Younger and older adults are able to take advantage of onset delay when the masker is dissimilar to the target word, but only younger adults are able to do so when the masker is similar. We examined the neural underpinning of this age difference using cortical evoked responses to words masked by either (...) Babble or Noise when the masker preceded the target word by 100 or 600 ms in younger and older adults, after adjusting the signal-to-noise ratios to equate behavioural performance across age groups and conditions. For the 100 ms onset delay, the word in noise elicited an acoustic change complex response that was comparable in younger and older adults. For the 600 ms onset delay, the ACC was modulated by both masker type and age. In older adults, the ACC to a word in babble was not affected by the increase in onset delay whereas younger adults showed a benefit from longer delays. Hence, the age difference in sensitivity to temporal delay is indexed by early activity in the auditory cortex. These results are consistent with the hypothesis that an increase in onset delay improves stream segregation in younger adults in both noise and babble, but only in noise for older adults and that this change in stream segregation is evident in early cortical processes. Current debate on business ethics in Australia continues apace as the excesses of the 1980s are exposed. Codes of Ethics have been a high profile instrument in the American business scene. A survey of Australia''s largest business corporations reveals a different situation. Codes are not as commonly used, tend to refer to legal requirements and do not have as high a profile within the corporation. Given the changing legal framework in Australia a greater role for Codes of Ethics may emerge.

The idea and use of the concept of intrinsic value in environmental ethics has spawned much debate in environmental ethics/axiology. Although for many, it seems fundamental and necessary for formulating an ethic for environmental protection, it seems to confuse and even undermine such efforts. ' Intrinsic value ' is, I argue, a concept born in the Western intellectual tradition for purposes of insulating and isolating those to whom intrinsic value can be attributed from one another and their environmental context. This (...) is especially true from the Modern period onward. When used as a basis for determining moral considerability, these Modern foundations engender contradictory and self-defeating ways of thinking about the individual/ecosystem relationship. As a result, formulations of moral sensibilities and principles become self-defeating and, vis-à-vis the ecological context, incoherent. On the critique of this Modern residue, an alternative axiological framework is built, using Anthony Weston's idea of interdepending values as a preparation for a more ecologically coherent approach to environmental protection. This approach is dialectical and attempts to formulate an ecological foundation for moral considerability. (shrink)

In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." These conditions impose barriers to justice and set limits on citizenship for one and all. Situated at the nexus of political/social theory, mental health law and jurisprudential ethics, (...) the book examines and critiques constructs such as offenders and victims; self and society; therapeutic and restorative; health; harm; and community. So, too, are three "total confinement" case law data sets on which this analysis is based. The volume stands alone in its efforts to systematically "diagnose" the moral reasoning lodged within prevailing judicial opinions that sustain captivity and risk management practices impacting: (1) the rights of juveniles found competent to stand criminal trial, the mentally ill placed in long-term disciplinary isolation, and sex offenders subjected to civil detention and community re-entry monitoring; (2) the often unmet needs of victims; and (3) the demands of an ordered society. Carefully balancing sophisticated insights with concrete and cutting-edge applications, the book concludes with a series of provocative, yet practical, recommendations for future research and meaningful reform within institutional practice, programming, and policy. Psychology can be based on plans, internally held images of achievement that organize the stimulus-response links of traditional psychology. The hierarchical structure of plans must be produced, held, assigned priorities, and monitored. Consciousness is the operation of the plan-executing mechanism, enabling behavior to be driven by plans rather than immediate environmental contingencies. The mechanism unpacks a single internally held idea into a series of actions. New in this paper is the proposal that language uses this mechanism for communication, unpacking an (...) idea into a series of articulatory acts. Language comprehension uses the plan-monitoring mechanism to pack a series of linguistic events into an idea. Recursive processing results from monitoring one's own speech. Neurophysiologically, the planning mechanism is identified with higher-order motor control. (shrink)

Contemplative or "noetic" knowledge has traditionally been seen as the highest mode of understanding, a view that persists both in many non-Western cultures and in Eastern Christianity, where "theoria physike," or the illumined understanding of creation that follows the purification of the heart, is seen to provide deeper insights into nature than the discursive rationality modernity has used to dominate and conquer it. Working from texts in Eastern Orthodox philosophy and theology not widely known in the West, as well as (...) a variety of sources including mystics such as the Sufi Ibn 'Arabi, poets such as Basho, Traherne, Blake, Hölderlin, and Hopkins, and nature writers such as Muir, Thoreau, and Dillard, The Noetics of Nature challenges both the primacy of the natural sciences in environmental thought and the conventional view, first advanced by Lynn White, Jr., that Christian theology is somehow responsible for the environmental crisis. Instead, Foltz concludes that the ancient Christian view of creation as iconic its "holy beauty" manifesting the divine energies and constituting a primal mode of divine revelation offers the best prospect for the radical reversal that is needed in our relation to the natural environment. A EuropeanCommission report predicted practicaldifficulties in achieving sufficientseparation distances to guarantee lowerthreshold levels proposed for GM material inorganic produce. Evidence of gene flow betweensome crops and their wild relatives has beena key issue in the recent Government consultation toconsult on whether or not to authorizecommercial planting of GM crops, following theresults of the current UK (...) farm scale trials.The admixture of imported Bt transgenes intolandrace varieties of Mexican maize alsopresents difficulties. An ethical evaluationis made of the claim that organic growersshould expect protection from adventitioustraces of GM constructs in their products. Towhat extent – on either side of the debate –can any particular group in society set upagricultural standards for itself that mayeffectively restrain others from an otherwisejust business? The assumptions behind notionslike ``purity'' and ``contamination'' areexamined, together with their underlying viewsof nature and human intervention. The 2001UK Agriculture and Environmental BiotechnologyCommission report is relevant to theseissues. While the Government wishes to promotethe UK biotechnology industry and is underpressure from US claims of trade restraint, astrong organic lobby demands purity from GMcontamination. Does this adversarial framingof the issues reflect broader public opinionin the UK public consultation? Inarriving at policy decisions, the role of thevirtue of tolerance is considered inpost-modern and Christian ethical contexts. (shrink)

The aim of this paper is modest. It is argued that if the nature of the "equivalence" between first-quantized particle theories and second-quantized (Fock Space) theories is examined closely, if the inadequacies of de Muynck's "indexed particle" version of Fock Space are recognized, and if the question is not begged against modal metaphysics, then van Fraassen's attempted deflation of ontological issues in quantum theory can be seen to fail.

The perspective of modelling agents rather than using them for a specificed purpose entails a difference in approach. In particular an emphasis on veracity as opposed to efficiency. An approach using evolving populations of mental models is described that goes some way to meet these concerns. It is then argued that social intelligence is not merely intelligence plus interaction but should allow for individual relationships to develop between agents. This means that, at least, agents must be able to distinguish, identify, (...) model and address other agents, either individually or in groups. In other words that purely homogeneous interaction is insufficient. Two example models are described that illustrate these concerns, the second in detail where agents act and communicate socially, where this is determined by the evolution of their mental models. Finally some problems that arise in the interpretation of such simulations is discussed. (shrink)

Medical ethical thought, imbued with the idealism of traditional medicine, has always grappled with the problem of translating abstract principles into actions that do not violate the sensibilities of the patient or the physician. The problem of translation is minimal for the family physician engaged in routine conversations with patients and their family members. This conversation — staying with details, maintaining the union of values and facts, reflecting without detaching or distancing — suggests a model of ethical reasoning and problem-solving (...) that warrants serious attention. I maintain that George Ripley (1802-1880) is among the most philosophically searching New England transcendentalists. In this essay I argue that Ripley’s denial that God’s miracles are the sole evidence of Christian truth clarifies the issues and debate that divide empiricists who seek evidence for truth through external verification and intuitionists who maintain that religious truth is manifest only within the minds, hearts, and special senses of true believers.

This paper criticizes the epistemological doctrine of moderate rationalism that has been defended in recent years by such writers as Laurence BonJour, Alvin Plantinga, and George Bealer. It is argued that this new form of rationalism is really no better than the old one and that the key claim common to both---that intuition or rational insight provides a satisfactory basis for a priori knowledge---is untenable. Most of the criticism is directed specifically against Laurence BonJour’s recent “dialectical” defense of the doctrine. (...) Since BonJour’s defense is essentially an attempt to show how a priori knowledge is possible, an alternative, empiricist view of a priori knowledge is presented that eludes his objections and is supported by the criticism brought against moderate rationalism.
