In this paper, we present an informal introduction to Logical English and illustrate its use to standardise the legal wording of the Automatic Early Termination clauses of International Swaps and Derivatives Association Agreements. LE can be viewed both as an alternative to conventional legal English for expressing legal documents, and as an alternative to conventional computer languages for automating legal documents. LE is a controlled natural language, which is designed both to be computer-executable and to be readable by English speakers (...) without special training. The basic form of LE is syntactic sugar for logic programs, in which all sentences have the same standard form, either as rules of the form conclusion if conditions or as unconditional sentences of the form conclusion. However, LE extends normal logic programming by introducing features that are present in other computer languages and other logics. These features include typed variables signalled by common nouns, and existentially quantified variables in the conclusions of sentences signalled by indefinite articles. Although LE translates naturally into a logic programming language such as Prolog or ASP, it can also serve as a neutral standard, which can be compiled into other lower-level computer languages. Formalising deontic concepts, such as obligation, prohibition and permission, is normally carried out in a modal logic with a possible world semantics, in which some worlds are better than others. The main focus in these logics is on inferring logical consequences, for example inferring that the obligation O q is a logical consequence of the obligations O p and O. In this paper we propose a non-modal approach in which obligations are preferred ways of satisfying goals expressed in first-order logic. (...) To say that p is obligatory, but may be violated, resulting in a less than ideal situation s, means that the task is to satisfy the goal p ∨ s, and that models in which p is true are preferred to models in which s is true. Whereas, in modal logic, the preference relation between possible worlds is part of the semantics of the logic, in this non-modal approach, the preference relation between first-order models is external to the logic. Although our main focus is on satisfying goals, we also formulate a notion of logical consequence, which is comparable to the notion of logical consequence in modal deontic logic. In this formalisation, an obligation O p is a logical consequence of goals G, when p is true in all best models of G. We show how this non-modal approach to the treatment of deontic concepts deals with problems of contrary-to-duty obligations and normative conflicts, and argue that the approach is useful for many other applications, including abductive explanations, defeasible reasoning, combinatorial optimisation, and reactive systems of the production system variety. The authors describe a logic programming approach to the representation of legislative texts. They consider the potential uses of simple systems which incorporate a single, fixed interpretation of a text. These include assisting in the routine administration of complex areas of the law. The authors also consider the possibility of constructing more complex systems which incorporate several, possibly conflicting interpretations. Such systems are needed for dealing with ambiguity and vagueness in the law. We prove that certain natural sequent systems for bi-intuitionistic logic have the analytic cut property. In the process we show that the (global) subformula property implies the (local) analytic cut property, thereby demonstrating their equivalence. Applying a version of Maehara technique modified in several ways, we prove that bi-intuitionistic logic enjoys the classical Craig interpolation property and Maximova variable separation property; its Halldén completeness follows.

The Belmont Report’s distinction between research and the practice of accepted therapy has led various authors to suggest that these purportedly distinct activities should be governed by different ethical principles. We consider some of the ethical consequences of attempts to separate the two and conclude that separation fails along ontological, ethical, and epistemological dimensions. Clinical practice and clinical research, as with yin and yang, can be thought of as complementary forces interacting to form a dynamic system in which the whole (...) exceeds the sum of its parts. Just as effective clinical practice cannot exist without clinical research, meaningful clinical research requires the context of clinical practice. We defend this thesis by triangulation, that is, by outlining how multiple investigators have reached this conclusion on the basis of varied theoretical and applied approaches. More confidence can be placed in a result if different methods/viewpoints have led to that result. (shrink)

Il est donc nécessaire, tant dans la recherche que dans les formations, de maintenir une distance critique envers certaines conceptions mythiques de la notion.The concept of cultural mediation has become an institutionalized part of the worlds of both (...) culture and the university. Analysis of the concept covers the context of mediation and the general system of mediations, understood as a repertoire of actions. This brings into play two dimensions, historical and political. Furthering an integrative ethics-as-practice framework, this paper explores the professional practices, self-understanding and ethics of lawyers working in the Germanic legal context. Existing studies of the legal profession often argue that changing conditions in law have led to a ‘constrained morality’ and an ‘erosion of ethos’ among lawyers. While the current study acknowledges shifts in lawyers’ ethos, it challenges the claim of an erosion or ‘lack’ of morality. The narratives of the interviewed practitioners rather suggest that socio-discursively constituted professional practices, (...) identity and ethics are complex and contingent. Focusing on the ‘moral rules in use’ and how lawyers negotiate ethical matters ‘from within’ evokes ongoing ambiguities and struggles inscribed in ethical (self-)positions, pointing, as such, to the limits of assessing lawyers’ conduct as ‘ethical’ or ‘unethical’. The study thereby extends both normative and practice-based business and professional ethics studies. (shrink)

We show that the variety of residuated lattices is generated by its finite simple members, improving upon a finite model property result of Okada and Terui. The reasoning is a blend of proof-theoretic and algebraic arguments.

Approaches to business ethics can be roughly divided into two streams: ‹codes of behavior’ and ‹forms of subjectification’, with code-oriented approaches clearly dominating the field. Through an elaboration of poststructuralist approaches to moral philosophy, this paper questions the emphasis on codes of behaviour and, thus, the conceptions of the moral and responsible subject that are inherent in rule-based approaches. As a consequence of this critique, the concept of a practice-based ‹ethics of responsiveness’ in which ethics is never final but rather (...) always ‹to come’, is investigated. In such an approach the ethical self is understood as being continuously constituted within power/knowledge relations. Following this line, we ask how one can become a responsible subject while also acknowledging certain limits of full responsibility. We thereby explore responsibility as a considered but unconditional openness in response to the other. (shrink)

The paper has two parts preceded by quite comprehensive preliminaries.In the first part it is shown that a subvariety of the variety ${\cal T}$ of all tense algebras is discriminator if and only if it is semisimple. The variety ${\cal T}$ turns out to be the join of an increasing chain of varieties ${\cal D}_n$, which are discriminator varieties. The argument carries over to all finite type varieties of boolean algebras with operators satisfying some term conditions. In the case of (...) tense algebras, the varieties ${\cal D}_n$ can be further characterised by certain natural conditions on Kripke frames.In the second part it is shown that the lattice of subvarieties of ${\cal D}_0$ has two atoms, the lattice of subvarieties of ${\cal D}_1$ has countably many atoms, and for $n>1$, the lattice of subvarieties of ${\cal D}_n$ has continuum atoms. The proof of the second of the above statements involves a rather detailed description of zero-generated simple algebras in ${\cal D}_1$.Almost all the arguments are cast in algebraic form, but both parts begin with an outline describing their contents from the dual point of view of tense logics. Moral distress in health care has been identified as a growing concern and a focus of research in nursing and health care for almost three decades. Researchers and theorists have argued that moral distress has both short and long-term consequences. Moral distress has implications for satisfaction, recruitment and retention of health care providers and implications for the delivery of safe and competent quality patient care. In over a decade of research on ethical practice, registered nurses and other health care practitioners (...) have repeatedly identified moral distress as a concern and called for action. However, research and action on moral distress has been constrained by lack of conceptual clarity and theoretical confusion as to the meaning and underpinnings of moral distress. To further examine these issues and foster action on moral distress, three members of the University of Victoria/University of British Columbia (UVIC/UVIC) nursing ethics research team initiated the development and delivery of a multi-faceted and interdisciplinary symposium on Moral Distress with international experts, researchers, and practitioners. The goal of the symposium was to develop an agenda for action on moral distress in health care. We sought to develop a plan of action that would encompass recommendations for education, practice, research and policy. The papers in this special issue of HEC Forum arose from that symposium. In this first paper, we provide an introduction to moral distress; make explicit some of the challenges associated with theoretical and conceptual constructions of moral distress; and discuss the barriers to the development of research, education, and policy that could, if addressed, foster action on moral distress in health care practice. The following three papers were written by key international experts on moral distress, who explore in-depth the issues in three arenas: education, practice, research. In the fifth and last paper in the series, we highlight key insights from the symposium and the papers in the series, propose to redefine moral distress, and outline directions for an agenda for action on moral distress in health care. Moral distress is a phenomenon of increasing concern in nursing practice, education and research. Previous research has suggested that moral distress is associated with perceptions of ethical climate, which has implications for nursing practice and patient outcomes. In this study, a randomly selected sample of registered nurses was surveyed using Corley’s Moral Distress Scale and Olson’s Hospital Ethical Climate Survey (HECS). The registered nurses reported moderate levels of moral distress intensity. Moral distress intensity and frequency were found to be inversely (...) correlated with perceptions of ethical climate. Each of the HECS factors (peers, patients, managers, hospitals and physicians) was found to be significantly correlated with moral distress. Based on these findings, we highlight insights for practice and future research that are needed to enhance the development of strategies aimed at improving the ethical climate of nurses’ workplaces for the benefit of both nurses and patients. Family members do not have an official position in the practice of euthanasia and physician assisted suicide in the Netherlands according to statutory regulations and related guidelines. However, recent empirical findings on the influence of family members on EAS decision-making raise practical and ethical questions. Therefore, the aim of this review is to explore how family members are involved in the Dutch practice of EAS according to empirical research, and to map out themes that could serve as a starting point (...) for further empirical and ethical inquiry. A systematic mixed studies review was performed. The databases Pubmed, Embase, PsycInfo, and Emcare were searched to identify empirical studies describing any aspect of the involvement of family members before, during and after EAS in the Netherlands from 1980 till 2018. Thematic analysis was chosen as method to synthesize the quantitative and qualitative studies. Sixty-six studies were identified. Only 14 studies had family members themselves as study participants. Four themes emerged from the thematic analysis. 1) Family-related reasons to request EAS. 2) Roles and responsibilities of family members during EAS decision-making and performance. 3) Families’ experiences and grief after EAS. 4) Family and ‘the good euthanasia death’ according to Dutch physicians. Family members seem to be active participants in EAS decision-making, which goes hand in hand with ambivalent feelings and experiences. Considerations about family members and the social context appear to be very important for patients and physicians when they request or grant a request for EAS. Although further empirical research is needed to assess the depth and generalizability of the results, this review provides a new perspective on EAS decision-making and challenges the Dutch ethical-legal framework of EAS. Euthanasia decision-making is typically framed in the patient-physician dyad, while a patient-physician-family triad seems more appropriate to describe what happens in clinical practice. This perspective raises questions about the interpretation of autonomy, the origins of suffering underlying requests for EAS, and the responsibilities of physicians during EAS decision-making. In "Variations on a theme of Curry," Humberstone conjectured that a certain logic, intermediate between BCI and BCK, is none other than monothetic BCI—the smallest extension of BCI in which all theorems are provably equivalent. In this note, we present a proof of this conjecture.

In this paper we show that a variety of modal algebras of finite type is semisimple iff it is discriminator iff it is both weakly transitive and cyclic. This fact has been claimed already in [4] (based on joint work by the two authors) but the proof was fatally flawed.

Following Bernheim,1 we examine aspects of 'felicitometrics,'2 the measurement of the 'quality' term in Quality of Life (QOL). Bernheim argued that overall QOL is best captured as the Gestalt3 of a global self-assessment and suggested that the Anamnestic Comparative Self Assessment (ACSA) approach, in which subjects' memories of the best and worst times of their lives are used to anchor a Visual Analog Scale (VAS), provided a serious answer to the serious question, 'How have you been?' Bernheim compares and contrasts (...) the ACSA to multi-item questionnaire QOL instruments, such as the SF-36, concluding that the ACSA has a number of advantages. His discussion assumes that the use of QOL outcomes in clinical trials is both relevant and appropriate. In the present paper, we document the reasonableness of this latter assumption,4 contribute to the characterization of the similarities and differences between multi-item and individualized QOL instruments, and point to some other individualized instruments that may be used in clinical trial contexts. These 'other individualized instruments' differ from the ACSA in fundamental ways; but they are individualized in that the subject defines those areas in his/her life that are most important, and these may vary from subject-to-subject. The feminist sex wars have been characterized by debates between radical feminists and sex radical feminists about women's experiences of empowerment versus oppression in the sex industry. Based on a qualitative study of the experiences of exotic dancers, this article introduces a new theoretical paradigm to the feminist sex wars that values the contributions of both sex radicals and radical feminists. It articulates a twofold temporal dimension of sex workers' experiences: how women's feelings of pleasure and empowerment gradually decline over (...) time and how good and bad experiences rapidly transform into their opposites over the course of a single evening, making the strip bar a volatile and unsettling space for performers. The paper intends to provide an algebraic framework in which subluminal causation can be analysed. The framework merges Belnap's 'outcomes in branching time' with his 'branching space-time' (BST). it is shown that an important structure in BST, called 'family of outcomes of an event', is a boolean algebra. We define next non-stochastic common cause and analyse GHZ-Bell theorems. We prove that there is no common cause that accounts for results of GHZ-Bell experiment but construct common causes for two other quantum (...) mechanical setups. Finally, we investigate why some setups allow for common causes whereas other setups do not. (shrink)

It’s called survival of the funded, and there is a sense in which paradigms are even more adaptable than species. Despite the obvious duality of physical and non‐physical astral forms in Doctor Strange, the film can't avoid the numerous problems with interactionism and substance dualism in general. This chapter utilizes the good Doctor Stephen Strange to look at how some philosophers attempt to answer the question: Are we simply flesh and bone, as Strange seems to think, or is there more—especially when it comes to the nature of our minds and souls. In the process, the chapter gains some deeper insights (...) about philosophy itself. Some philosophers agree with the Ancient One that the spirit is a thing unto itself and can affect and influence the body, a view called substance dualism. Interactionism is the “explanatory glue” holding Cartesian dualism together, and without it, the Cartesian dualist cannot account for our experience of a unified wholeness of our physical and mental lives. We show that this finiteness result is the best possible, since the analogous fragment of S4, and therefore of [3], in two variables has infinitely many non-equivalent formulae.

Ethical principles concerning foresters were presented in this article in the light of the forest law passed in the interwar period for the whole country, as well as in the light of the documents issued by the local forest administration. For analysis were submitted especially archive documents on foresters’ responsibility for forest goods: wood and game. Ethical attitude of foresters translated, among other things, into efficient functioning of forest management all over Greater Poland.
