Research has consistently shown ‘ability’ grouping (tracking) to be prey to poor practice, and to perpetuate inequity. A feature of these problems is inequitable and inaccurate practice in allocation to groups or ‘tracks’. Yet little research has examined whether such practices might be improved. Here, we examine survey and interview findings from a large-scale intervention study of grouping practices in 126 English secondary schools. We find that when schools are encouraged to allocate students and move them between groups according to (...) equitable principles by participation in a ‘best practice’ intervention, there is some increased equity of practice (i.e. a reduction in non-attainment factors used in allocation). However, the majority of schools continue to use subjective and potentially biased information to group students. Furthermore, some schools that claim to be using attainment setting appear to be using the inequitable practice of streaming. Our findings show that improvements in equity are constrained by operational and strategic factors, including timetabling, finance, and teachers’ values and beliefs relating to student ability and progression. We suggest strategies for encouraging schools to change their grouping practices, drawing on approaches for working with complex organisations. (shrink)

My paper addresses a topic--the implications of Rawls's justice as fairness for affirmative action--that has received remarkably little attention from Rawls's major interpreters. The only extended treatments of it that are in print are over a quarter-century old, and they bear scarcely any relationship to Rawls's own nonideal theorizing. Following Christine Korsgaard's lead, I work through the implications of Rawls's nonideal theory and show what it entails for affirmative action: viz. that under nonideal conditions, aggressive forms of formal equality of (...) opportunity (e.g., sensitivity training, outreach efforts, external monitoring and enforcement) and compensating support (e.g., special fellowship programs, childcare facilities, mentoring, co-op opportunities, etc.) can be justified, but that "hard" and even "soft" quotas are difficult to defend under any conditions. I conclude the paper by exploring the implications of these surprising results for contemporary liberalism more broadly and for constitutional law and public policy. (shrink)

There is an overriding orthodoxy amongst philosophers that attention is a ‘unified phenomenon’, subject to explanation by one monistic theory. In this article, I examine whether this philosophical orthodoxy is reflected in the practice of psychology. I argue that the view of attention that best represents psychological work is a variety of conceptual pluralism. In the United States, interest in urban agriculture has grown dramatically. While community gardens have sprouted across the landscape, home food gardens—arguably an ever-present, more durable form of urban agriculture—have been overlooked, understudied, and unsupported by government agencies, non-governmental organizations, and academics. In part a response to the invisibility of home gardens, this paper is a manifesto for their study in the Global North. It seeks to develop a multi-scalar and multidisciplinary research framework that acknowledges the garden’s social and ecological (...) or material dimensions. Given the lack of existing research, we draw on the more extensive literature on home gardens in the South and community gardens in the North to develop a set of hypotheses about the social-ecological effects of urban home food gardens in the North. These gardens, we hypothesize, contribute to food security, community development, cultural reproduction, and resilience at multiple scales; conserve agrobiodiversity; and support urban biodiversity. They may also have negative ecological effects, such as stormwater nutrient loading. Because of the entanglement of the social and the ecological or material in the garden, we review three theoretical perspectives—social ecological systems theory, actor-network theory, and assemblage theory—that have been or could be applied to the multi-scalar and multidisciplinary study of the garden. We also review sampling and analytic methods for conducting home garden research. The paper concludes with a discussion of opportunities to extend the research agenda beyond descriptive analysis, the primary focus of garden research to date. (shrink)

In the longstanding debate between liberals and libertarians over the morality of redistributive labor taxation, liberals such as John Rawls and Ronald Dworkin have consistently taken the position that such taxation is perfectly compatible with individual liberty, whereas libertarians such as Robert Nozick and Murray Rothbard have adopted the (very) contrary position that such taxation is tantamount to slavery. In this paper, I argue that the debate over redistributive labor taxation can be usefully reconstituted as a debate over the incidents (...) (or components) of self-ownership, with liberals arguing for a narrow definition of the concept and libertarians arguing for a broad one. By using what Alan Ryan has called the “language of proprietorship,” I pinpoint precisely the source of the disagreement between liberals and libertarians and assess the relative strengths of their arguments. I also show that the respective definitions of self-ownership used by liberals and libertarians are deeply problematic—though for strikingly different reasons. (shrink)

A liberal antinomy of parenting exists: strong liberal intuitions militate in favor of both denying special resources to parenting projects (on grounds of project-neutrality) and granting them (on grounds of respect for personhood). I show that we can reconcile these two claims by rejecting a premise common to both--viz. that liberalism is necessarily committed to extensive procreative liberties--and limiting procreation and subsequent parenting to adults who meet certain psychological and especially financial criteria. I also defend this argument, which provides a (...) Kantian complement to utilitarian arguments for restricting procreation, against a variety of objections. (shrink)

The powerful qualities view of properties is currently enjoying a surge in popularity. Recently, I have argued that the standard version of the view is no different from a rival view: the pure powers position. I have also argued that the canonical version of the powerful qualities view faces the same problem as the pure powers view: the dreaded regress objection. Joaquim Giannotti disagrees. First, Giannotti thinks that the standard version of the powerful qualities view can be differentiated from the (...) pure powers view. Second, Giannotti argues that the powerful qualities view is not susceptible to the regress objection. Third, he argues that there is another reasonable version of the powerful qualities view available, which makes use of the notion of ‘aspects’. In this note, I respond to Giannotti. I argue that all three of Giannotti’s arguments are unsuccessful. (shrink)

David Chalmers’ ‘conceivability’ argument against physicalism is perhaps the most widely discussed and controversial argument in contemporary philosophy of mind. Recently, several thinkers have suggested a novel response to this argument, which employs the ‘powerful qualities’ ontology of properties. In this paper, I argue that this response fails because it presupposes an implausible account of the physical/phenomenal distinction. In the course of establishing this, I discuss the so-called ‘ultimate’ argument for the claim that dispositional properties form the subject matter of (...) physics. I argue that the ultimate argument can be interpreted in a strong or a weak way, and that the strong interpretation is implausible. I argue that this undermines the powerful qualities based response to the conceivability argument. I also argue for a general conclusion: that we should not define ‘the physical’ exclusively in terms of a distinction drawn from ontology. (shrink)

A common criticism of plurality voting is that it fails to reflect the degree of intensity with which voters prefer the candidate or policy that they vote for. To rectify this, many critics of plurality voting have argued that vote buying should be allowed. Persons with more intense preferences for a candidate could buy votes from persons with less intense preferences for the opposing candidate and then cast them for the candidate that they intensely support.
