No existing normative decision theory adequately handles risk. Expected Utility Theory is overly restrictive in prohibiting a range of reasonable preferences. And theories designed to accommodate such preferences (for example, Buchak's (2013) Risk‐Weighted Expected Utility Theory) violate the Betweenness axiom, which requires that you are indifferent to randomizing over two options between which you are already indifferent. Betweenness has been overlooked by philosophers, and we argue that it is a compelling normative constraint. Furthermore, neither Expected nor Risk‐Weighted Expected Utility Theory (...) allow for stakes‐sensitive risk‐attitudes—they require that risk matters in the same way whether you are gambling for loose change or millions of dollars. We provide a novel normative interpretation of Weighted‐Linear Utility Theory that solves all of these problems. (shrink)

Fanatics claim that we must give up guaranteed goods in pursuit of extremely improbable Utopia. Recently, Wilkinson has defended Fanaticism by arguing that nonfanatics must violate at least one plausible rational requirement. We reject Fanaticism. We show that by taking stakes-sensitive risk attitudes seriously, we can resist the core premises in Wilkinson’s argument.

This paper takes a recently published text and, in examining it closely, argues that it exemplifies trends within feminist scholarship in law, which might be characterised asestablishing a form of orthodoxy. The paper explores some of the ways in which thiso rthodoxy is constructed and presented, and argues that it is characterised by a commitment both to `grand theory' and Hegelian dialectics. The adoption of this model of work seems to offer a chance to hold together the triangular figure of (...) women/theory/law reform. The paper will argue that, whilst this model is clearly a valid choice, and attractive to feminist scholars in the promise it seems to hold, the model is not to be presumed but rather should be examined and considered in terms of its potential for feminist scholarship. Both within its own terms, and as part of the construction of an orthodoxy, the paper will argue that it is in fact problematic and that feminist scholarship would be better served by seeking an alternative theoretical model. An alternative is suggested, using the work of Deleuze, but it is acknowledged that this will require the acceptance of a very different theoretical configuration from that suggested by the triangular model of women/theory/lawreform. Béatrice Longuenesse presents an original exploration of our understanding of ourselves and the way we talk about ourselves. In the first part of the book she discusses contemporary analyses of our use of 'I' in language and thought, and compares them to Kant's account of self-consciousness, especially the type of self-consciousness expressed in the proposition 'I think.' According to many contemporary philosophers, necessarily, any instance of our use of 'I' is backed by our consciousness of our own body. For Kant, (...) in contrast, 'I think' just expresses our consciousness of being engaged in bringing rational unity into the contents of our mental states. In the second part of the book, Longuenesse analyzes the details of Kant's view and argues that contemporary discussions in philosophy and psychology stand to benefit from Kant's insights into self-consciousness and the unity of consciousness. The third and final part of the book outlines similarities between Kant's view of the structure of mental life grounding our uses of 'I' in 'I think' and in the moral 'I ought to, ' on the one hand; and Freud's analysis of the organizations of mental processes he calls 'ego' and 'superego' on the other hand. Longuenesse argues that Freudian metapsychology offers a path to a naturalization of Kant's transcendental view of the mind. It offers a developmental account of the normative capacities that ground our uses of 'I, ' which Kant thought could not be accounted for without appealing to a world of pure intelligences, distinct from the empirical, natural world of physical entities. What potential can be found in the work of Deleuze and Guattari for critical legal scholarship? The authors argue that their work can be deployed to re-think ‘critique’ by directly addressing the place and role of the ‘critic’. It is argued that the continued commitment to a stance of ‘resistance’ in CLS is underpinned by never-ending dualisms which, if not confronted and replaced, can only make CLS ever more redundant. The authors ask: ‘what is critique beyond the dualism of power (...) and resistance, of state and nomad?’ This question arises from a belief that critique is still capable of being effective, but only if there is the courage to experiment, and to think creatively. In this sense, the ‘exhaustion’ of critique is framed as an opportunity to re-think and re-engage with the politics of law. The paper diagrams, through image and film, a critical thought: the potential of the artisan. Film is utilised not as representation, nor as illustration, but as a thinking mind in its own right, through which questions relating to the state, political action, and creative thinking can be framed. Such a re-framing is essential, it is argued, for an engagement with the emergence of societies of control. (shrink)

Hegel's Science of Logic has received less attention than his Phenomenology of Spirit, but Hegel himself took it to be his highest philosophical achievement and the backbone of his system. Up to the present, there have not been any specific norms regarding medically assisted human reproduction in Romanian legislation. Due to this situation the general legislation regarding medical assistance, the Penal and Civil law and the provisions of the Code of Deontology of the Romanian College of Physicians are applied to the field of medically assisted human reproduction. By analysing the ethical and legal conflicts regarding medically assisted human reproduction in Romania, some characteristics cannot be set apart because they derive (...) from religious, cultural and socio-economic aspects. In this article the authors identify the development stages of medically assisted human reproduction in Romania, beginning from these characteristics and insisting upon the failure of the legal system in this specific field. The authors consider that the law regarding medically assisted human reproduction cannot be effective because it did not take into account the ethical and cultural aspects that might appear. Furthermore, in this framework of the legal process, no public debate involving the representatives of civil society was undertaken although the Council of Europe Oviedo Convention approved by our country according to law no. 17/2001 stipulated exactly this working method. In France, the Kouchner law of 2002 has allowed for a rethinking of patients’ rights; as well, it introduced the notion of health democracy. For example, in oncology, advocacy groups for patients and ex-patients now provide support and information to patients, representation of patients in health care institutions and state agencies, education to caregivers, and opportunities for participation in research. In fact, such advocacy groups have been so impactful that some patients have gone on to work in the health care (...) system itself; it is this rise in professionalism that is of interest in this article, where we will discuss the first results of two ongoing research projects on the subject. In response to Henry Allison's and Sally Sedwick's comments on my recent book, Kant and the Capacity to Judge, I explain Kant's description of the understanding as being essentially a "capacity to judge", and his view of the relationship between the categories and the logical functions of judgment. I defend my interpretation of Kant's argument in the Transcendental Deduction of the Categories in the B edition. I conclude that, in my interpretation, Kant's notions of the "a priori" and the "given" (...) are more complex and flexible than is generally perceived. Nevertheless, Kant maintains a strict distinction between receptivity and spontaneity, the "passive" and the "active" aspects of our representational capacities. This separates him from his German idealist successors, most notably Fichte and Hegel. Contrary to Sedgwick's and Allison's suggestions, I do not think that my interpretation tends to blur this distinction. (shrink)

Le présent essai tente de tirer au clair les différentes significations des termes « conscient » et « conscience » dans la philosophie critique de Kant et en particulier dans la Critique de la raison pure. On considère d’abord les divers types de représentations et ce que veut dire Kant lorsqu’il les dit « avec » ou « sans » conscience. On considère ensuite le concept de conscience tel qu’il apparaît dans la Déduction transcendantale des catégories, où il ne réfère (...) pas à une qualité de représentations particulières, mais à une attitude active de l’esprit. Considérée dans son ensemble, la conception kantienne de la « conscience » mêle inséparablement un aspect que nous appelons, après T. Nagel, « conscience phénoménale », et un aspect proche de la « conscience d’accès » selon N. Block, dans lequel cependant la conscience de soi, exprimable par la proposition « Je pense », joue un rôle central. Cette combinaison fait de Kant un interlocuteur unique dans les débats contemporains sur la conscience et son rôle dans notre vie mentale, ainsi que sur l’IA et sa signification pour l’avenir de l’humanité. Our reality constitutes itself as being one of pictures. Landscape is a product of aesthetic reflection as well as the perception of reality and virtual reality of the first order (VR 1). Pictorial representation of a landscape is virtual reality of the second order (VR 2). A picture is a structure of relations with a specific topology or an interrelationship. A picture is set in relation. Topology relates to relational similarities and differences as well as their transfer into other interrelationships, (...) other topologies. The differences between nature, landscape (VR 1), metaphor of landscape and pictorial representation of landscape, etc. (VR 2) describe a change of the interrelationship. These changes happen in a physical-psychic-mental production of reality. We are involved in the events of particular relationships of the picture. The Topology of Being and Appearance reflects the inconspicuous similarities of relations and proportions in the relationship of the world in association with our physical-psychic-mental existential orientation in the world. This study investigated visual statistical learning (VSL) in 24 deaf signers and 24 hearing non‐signers. Previous research with hearing individuals suggests that SL mechanisms support literacy. Our first goal was to assess whether VSL was associated with reading ability in deaf individuals, and whether this relation was sustained by a link between VSL and sign language skill. Our second goal was to test the Auditory Scaffolding Hypothesis, which makes the prediction that deaf people should be impaired in sequential processing tasks. (...) For the VSL task, we adopted a modified version of the triplet learning paradigm, with stimuli presented sequentially across space and time. Results revealed that measures of sign language skill (sentence comprehension/repetition) did not correlate with VSL scores, possibly due to the sequential nature of our VSL task. Reading comprehension scores (PIAT‐R) were a significant predictor of VSL accuracy in hearing but not deaf people. This finding might be due to the sequential nature of the VSL task and to a less salient role of the sequential orthography‐to‐phonology mapping in deaf readers compared to hearing readers. The two groups did not differ in VSL scores. However, when reading ability was taken into account, VSL scores were higher for the deaf group than the hearing group. Overall, this evidence is inconsistent with the Auditory Scaffolding Hypothesis, suggesting that humans can develop efficient sequencing abilities even in the absence of sound. (shrink)

Kant's use of the leading thread of his table of logical forms of judgment to analyze judgments of taste yields more results than Allison's account allows. It reveals in judgments of taste the combination of two judgments: a descriptive judgment about the object, and a normative judgment about the judging subjects. Core arguments of Kant's critique of taste receive new light from this analysis.

Reviewing her recent environmental works in a framework of deconstructive ecopsychology, Beatrice will address through theoretical and practice based models how far the artist and landscape form a dynamic synthesis within the collaborative experience of landscape. Jarvis will debate how far site specific performance and the practice of long (...) distance walking offers an embodied landscape narrative. This paper raises the seminal question how can the body can become mirror to its surroundings, asking through embodied practice, photography, film and writing; how does the body become a living archive? Drawing on the work of Paul Virilio, this paper addresses changes in the architectural and legal topography of the urban landscape through an examination of regulatory patterns, which increasingly intensify governance through, and as, ‘control’. Such regulation is ambivalent in that it cuts across many traditionally discrete regimes of power melding them into new forms with new effects; as a consequence it is no longer sufficient to think in terms of such distinctions as private/public, civil/criminal, and so on. This paper (...) argues that a concern with patterns of enclosure and privatisation in our urban centres must now be placed within the context of changes in architectural practice and technology, which the authors term ‘open architecture’, and the embedding of governance through partnership, which give particular emphasis to the use of dematerialised and diffused modes of control. The paper utilises Virilio’s history and image of the fortress, which he tracks from a material form to a dematerialised form, to envisage these developments and to provide the foundation for an understanding of the importance of the development of practices of surveillance into, what the authors term, ‘total registration’ as a feature and function of governance through ‘control’.
