In their paper ‘Responsibility, second opinions and peer-disagreement: ethical and epistemological challenges of using AI in clinical diagnostic contexts’, Kempt and Nagel discuss the use of medical AI systems and the resulting need for second opinions by human physicians, when physicians and AI disagree, which they call the rule of disagreement.1 The authors defend RoD based on three premises: First, they argue that in cases of disagreement in medical practice, there is an increased burden of proof for the physician (...) in charge, to defend why the opposing view is adopted or overridden. This burden for justification can be understood as an increased responsibility. In contrast, such burden does allegedly not arise, when physicians agree in their judgement. Second, in those medical contexts where humans collaborate with humans such justification can be provided, since human experts can discuss the evidence and reasons that have led them to their judgement, through which the sources of disagreement can be found and a justified decision can be made by the physician in charge. Third, unlike human-to-human collaboration, such communicative exchange is not possible with an AI system. Due to AI’s opacity, the physician in charge has no means of illuminating why the AI disagrees. Conclusively, the authors propose RoD as a solution. RoD suggests that a second human expert should be consulted for advise in cases of human–AI disagreement. Once AI systems become more widespread in clinical practice, it can be expected that such type of disagreement occurs more frequently. Many women professionals traverse settings beyond the office in their work, but research on women professionals rarely follows them out of the office. Using a large, archived data set of focus groups with sales professionals, the authors ask how work in out-of-the-office settings affects women’s careers. The authors distinguish between two types of settings. In “heterosocial” settings, interaction rules are traditionally and normatively gendered; women and men are understood by others as heterosexually linked pairs, women become targets of (...) gossip, and some women report sexual advances and sexual harassment. In “homosocial” settings such as golf courses and strip clubs, women’s disadvantage takes the form of exclusion. (shrink)

Relational, selfless, caring, polite, nice, and kind are not how we imagine a woman giving birth in U.S. culture. Rather, we picture her as screaming, yelling, self-centered, and demanding drugs or occasionally as numbed and passive from pain-killing medication. Using in-depth interviews with women about their labor and childbirth, the author presents data to suggest that white, middle-class, heterosexual women often worry about being nice, polite, kind, and selfless in their interactions during labor and childbirth. This finding is important not (...) only because it contradicts the dominant cultural image of the birthing woman but because it reveals that an internalized sense of gender plays a role in disciplining women and their bodies during childbirth. The feminist sociological literatures on birth are concerned with how women and their bodies are controlled, yet they have overlooked this other dimension of control that is not institutional but is a product of how gender is internalized. For almost 50 years, the Council of Europe through a series of documents has been helping to build up a set of rules, principles, and strategies related to culture, environment, ethics, and sustainable development. At the moment, one of the most important aims of the Council of Europe’s agenda deals with the elaboration of the General Principles for the Protection of the Environment and Sustainable Development, as raised in document CO-DBP (2003)2 related to the environmental subject. The intention of the (...) Council of Europe is to encourage national authorities to implement these General Principles into their national environmental policies. These principles should have an important effect, especially in those countries which are new members of the European Union. The primary target of this paper is the study of these principles and the setting of their entailed implications in order to establish a relation between values and policy making. Quite often, the conclusions adopted by the agreements generated within the framework of the European Union are controversial. Therefore, a study aiming to lay the foundations of these principles will make the exchange of ideas easier, providing a wider and more detailed scope in the European environmental policy. (shrink)

In this article, the authors examine accounts of heterosexuality in media for children. The authors analyze all the G-rated films grossing $100 million dollars or more between 1990 and 2005 and find two main accounts of heterosexuality. First, heterosexuality is constructed through hetero-romantic love relationships as exceptional, powerful, magical, and transformative. Second, heterosexuality outside of relationships is constructed through portrayals of men gazing desirously at women's bodies. Both of these findings have implications for our understanding of heteronormativity. The (...) first is seemingly at odds with theories that claim that heterosexuality's mundane, assumed, everyday ordinariness lends heteronormativity its power. In fact, the authors suggest heterosexual exceptionalism may extend the pervasiveness of heterosexuality and serve as a means of inviting investment in it. We study a refined framework of parameterized complexity theory where the parameter dependence of fixed-parameter tractable algorithms is not arbitrary, but restricted by a function in some family . For every family of functions, this yields a notion of -fixed-parameter tractability. If is the class of all polynomially bounded functions, then -fixed-parameter tractability coincides with polynomial time decidability and if is the class of all computable functions, -fixed-parameter tractability coincides with the standard notion of fixed-parameter tractability. This is a major anthropological study of contemporary Tibetan Buddhist monasticism and tantric ritual in the Ladakh region of North-West India and of the role of tantric ritual in the formation and maintenance of traditional forms of state structure and political consciousness in Tibet. Containing detailed descriptions and analyses of monastic ritual, the work builds up a picture of Tibetan tantric traditions as they interact with more localised understandings of bodily identity and territorial cosmology, to produce a substantial re-interpretation of (...) the place of monks as ritual performers and peripheral householders in Ladakh. We explore the complexity of Sacks’ Splitting Theorem in terms of the mind change functions associated with the members of the splits. We prove that, for any c.e. set A, there are low computably enumerable sets $A_0\sqcup A_1=A$ splitting A with $A_0$ and $A_1$ both totally $\omega ^2$ -c.a. in terms of the Downey–Greenberg hierarchy, and this result cannot be improved to totally $\omega $ -c.a. as shown in [9]. In their book, Darwinism Evolving: Systems Dynamics and the Genealogy of Natural Selection, Depew and Weber argued for the need to address the relationship between self-organization and natural selection in evolutionary theory, and focused on seven “visions” for doing so. Recently, Batten et al. in a paper in this journal, entitled “Visions of evolution: self-organization proposes what natural selection disposes,” picked up the issue with the work of Depew and Weber as a starting point. While the efforts of both sets (...) of authors are to be commended, there are substantive errors in both the presentations of my work and of my work with colleagues that undermine theirs. My purpose here is to correct the errors in question, thereby removing the undermining effects and in so doing reassert the position my colleagues and I first advanced more than two decades ago, and that I still stand by and argue for today. The central points are as follows: Self-organization or spontaneous ordering is a process of selection; this selection process is governed by a “physical selection principle”; this principle is the law of maximum entropy production; and natural selection is a special case where the components are replicating. With the Freudian system these factors vaguely appear, but their form is badlydefined and their delineation incomplete. The criticism of the three systems may be summarised as follows:—that of James is lacking in content, i.e. of the sentiments, while that of McDougall is more in line (...) with a simple self concept than that of a complete personality system and hence is lacking in organisation. That of Freud, while possessing some features in common with that of McDougall appears naive and undeveloped. By combining the systems of the first-mentioned pair, a final system may be obtained, whichmore completely explains personality than any one of them. (2)According to this final system the main features of personality consist of:— (a)A basic system of instincts which tends to operate independently as personality phases; among these first fear, and later, submission and self assertion act as regulative factors. The former of this pair is inhibitive in its general effect on conduct, the latter accentuating it. (b)From a combination of instinctive tendencies focussed upon mental objects the sentiments develop. Like sentiments are grouped into a more or less defined entity styled a social self,this self being a product primarily of a particular environment. More than one social self tends to exist side by side in the same personality, each self retaining a specific set of moral sanctions of its own. Social selves may be independent and contradictory in their “mores” if there exist no overlap of common factors in apperception systems, sentiments and will attitudes. (c)At adolescence a rational process begins. Abstract sentiments and ideal personalities develope, and in place of social authority there is substituted the approbation or disfavour of anideal community existent in the mind of the subject; this forms the background of the promptings of conscience. An ethical code finally emerges whichis more or less universal in its applications. This development may be designated a rational, spiritual, or ethical self, and it acts as a unifying influence upon the social selves by legislating for opposed sanctions, and thus affording a final court of appeal in the case of conflict. Hence it becomes the crowning development of a unified personality. A clarification of the terms “self” and “personality” is thus afforded, whereby the term “self” is regarded as a phase of the latter. (shrink)

We introduce a new hierarchy of computably enumerable degrees. This hierarchy is based on computable ordinal notations measuring complexity of approximation of${\rm{\Delta }}_2^0$functions. The hierarchy unifies and classifies the combinatorics of a number of diverse constructions in computability theory. It does so along the lines of the high degrees (Martin) and the array noncomputable degrees (Downey, Jockusch, and Stob). The hierarchy also gives a number of natural definability results in the c.e. degrees, including a definable antichain.

This paper revisits some recent contributions on ‘Why Management Theory Needs Popper’ to the journal Philosophy of Management. It proposes that those discussions provided an appraisal of the relevance of Popper’s falsification schema to management theory, but that they did not thereby bring to the fore all of the issues pertinent to a balanced and well-rounded understanding of Popper’s philosophy of critical rationalism. It is argued that such an understanding requires a discussion of what Popper himself declared to be the (...) real lynchpin of his thought: fallibilism and a critical approach. It is noted that this represents a rejection of the historical problem situation of philosophy — that knowledge claims need to be positively justified as true. It is argued that this rejection implies an anti-authoritarian, non-justificational philosophy based on the use of critical reason. Its application to several different objects of criticism is demonstrated and its ethical dimensions are explored. “Research assistant” is a term used to describe student researchers across a variety of contexts and encompasses a wide array of duties, rewards, and costs. As critical/qualitative scholars situated in a discipline that rarely offers funded research assistantships to graduate students, we explore how we have engaged in faculty-student research in one particularly understudied context: the independent study. Using narrative writing and reflection within a framework of collaborative autoethnography, the first three authors reflect as three “generations” of protégés who (...) were each mentored through independent studies during their MA programs by the fourth author. We explore the environmental context, mentor facets, and protégé facets that highlight the light and shadow, or successes and struggles, of our mentoring relationships. Reflecting on our own experiences of collaborative research through independent studies, we suggest a model of feminist research mentorship that may be enacted across disciplines. (shrink)

Through careful analysis of shows including The (...) The article builds on a recent literature that has sought to underscore the relevance of Bourdieu’s field theory for historical-sociological analysis. It draws attention to symbolic revolutions, a concept that has been given short shrift in this literature and even in Bourdieu’s own expositions of his field-theoretical apparatus. The article argues that symbolic revolutions denote a universal mechanism of field-internal change which extends and complements a conceptual battery of mostly structural universals of fields. In a synoptic reading of Bourdieu’s field-theoretical (...) work, the article fleshes out an ideal type of symbolic revolutions, with special regard to its dialectical features. It adds further analytical purchase to the concept by highlighting continuities and parallels with the work of Thomas Kuhn and Karl Mannheim. Finally, it argues that more recent studies by other authors on transformations in the psychiatric field, the field of social and human sciences, and the political field are in fact discussing instances of symbolic revolutions. It thus shows how the concept can help identify common properties among highly heterogeneous phenomena, opening up new avenues for historical-sociological investigations that can more systematically relate the general and the particular. Where a person is unable to make medical decisions for themselves, law and practice allows others to make decisions on their behalf. This is common at the end of a person’s life where decision-making capacity is often lost. A further, and separate, decision that is often considered at the time of death (and often preceding death) is whether the person wanted to act as an organ or tissue donor. However, in some jurisdictions, the lawful decision-maker for the donation decision (the (...) ‘donation decision-maker’) is different from the person who was granted decision-making authority for medical decisions during the person’s life. To date, little attention has been given in the literature to the ethical concerns and practical problems that arise where this shift in legal authority occurs. Such a change in decision-making authority is particularly problematic where premortem measures are suggested to maximise the chances of a successful organ donation. This paper examines this shift in decision-making authority and discusses the legal, ethical and practical implications of such frameworks. (shrink)

In a letter to M. Coray, Thomas Jefferson distinguished two distinct notions of political authority. The first was that of ancient Greece, which was characterized by “slavery” and the subjection of the population. Jefferson’s characterization was astute insofar as Aristotle regarded some groups as privileged to rule “by nature,” while all other hereditary groups were fit only to be ruled. The second type, referring to governments of “the present age,” rejected that standard in favor of equality and the promotion of (...) the people’s “happiness.” Unexpectedly, the dichotomy between hereditary privilege systems and egalitarian service to the people maps onto the contrast between “feudal” and “bureaucratic” systems in late imperial Chinese theory. In other words, this insight into the nature of authority was known to theorists both in China and in the “West,” suggesting that it captures something fundamental about the nature of “authority.” This essay probes the dichotomy in two ways, theoretical and historical. In theory, “feudal” systems, east and west, seem to be informed by a substance metaphor, and so both Aristotle and his early modern followers conflated authority with social status, and imagined the latter as a hereditary, noble substance such as gold. In this model, social groups are necessarily ranked, with gold being nobler, for instance, than brass. Because authority inheres in the person as a substance, authority is personalistic. In other words, there is no clear, external standard for checking abuses of power. Classical Chinese bureaucratic theory imagined authority as a tally. In that case, an officer’s performance had to match the office’s public charge. Because the assignment of office is merit-based, tally systems tend to be more egalitarian. Moreover, they naturally provide an external standard for checking abuse, namely, the officer’s effect on the people’s “happiness.” Historically, these two paradigms clashed in England and Europe during the seventeenth and eighteenth centuries, when translations of Chinese texts became available. Using translingual analysis, this essay traces the transformation of authority from a substance model to a tally model in the thinking of several Enlightenment writers, culminating in the writings of Thomas Jefferson. The intensity of metadiscursive production not only gives material form to the intrinsic analytic pertinence and richness of the discourse on which it comments—these are evident—but also shows, independent of the pieces’ intentions, that the proliferation is situated in a process of (re-)production of authority, that it is an integral part of a canonizing effort. The articles and introductions problematize, implicitly or explicitly, the direct accessibility of Bourdieu’s discourse. They make the oeuvre into a complex totality, difficult and diversified to the extreme, whose coherence can be revealed only with the help of a gradual, exegetic, and essentially submissive reading practice.To put it another way, and to examine the question more closely, the metadiscursive (re-)production of the authority of the author we call Pierre Bourdieu reveals itself to be [End Page 20] ambivalent: it is at once innovative—it invites the uninitiated to get to know a fascinating new universe of thought—and authoritarian, indeed even conservative. An introduction is never a simple mediation of discourse between an author and his or her potential readers: it provides a sort of user’s guide, it (re-)produces a reading habitus, an ideology of the correct interpretation the reader must learn and interiorize to be able to distinguish orthodox from false, heterodox, readings. Between the metadiscourse/commentary and the authority it discusses, a relationship of tautological circularity is established that surreptitiously transforms the discourse read into a legend (into what must be read): the possibility of an autonomous reading practice is erased by a pedagogy of legendary decoding. 6The authority of an author, that of Bourdieu for example, is consequently implicated in a dynamic of opening (the proliferation of metadiscourses) and closing (the tendency to discipline reading, to make it obey certain norms of legibility). It would be erroneous, however, to attribute the paradoxical aspect of authority simply to the ambivalent effect of metadiscourses/commentaries. This is because authors who establish authority can only rarely escape the canonizing efforts of which they are the object: in many cases, authors themselves participate in the production and reproduction of a mode of reading and interpretation judged to be legitimate. The fact that no authority can completely and exhaustively control its discursive and institutional space does not in any way contradict, therefore, that other distinctive and essential feature of authority: its intrinsic animation by a desire to control, by the desire to see itself respected. Authority wants to become Law and be recognized as such. Thus the tendency of certain authors to become actively involved in the modes of appropriation of their name and their discourses, to endeavor to make the reading of the author’s work not simply an act of connaissance but also a proof of reconnaissance. Authority detests being insufficiently or poorly known. Let us take the case of Bourdieu. As an author, he is first and foremost the one to whom we owe Raisons pratiques, La distinction, Homo academicus and Les règles de l’art, the producer, in other words, of a series of momentous works that, upon publication, established authority. In this paper, I will argue how Paracelsus's concept of the universal ensoulment of nature may relate to his understanding of the self-healing capacity of the body, as shown in his Grosse Wundartzney (1536). Here, his new approach to medicine is visible, focusing not on retaining or restoring the balance of bodily humours but on strengthening the inner “essence” of life (the so-called “balsam,” “mummy,” “astral spirit,” etc.). This is possible by means of life-endowed essences of healing substances which can (...) affect the body’s vital principle by means of inner sympathies. Here, a link is established to medical alchemy as a way to produce more subtle medicines, the “essences” of things. Such an undertaking is possible only in the framework of the natural magic concept with its underlying microcosm-macrocosm analogy. It is my aim to show not only the principles of Paracelsus's new medicine, alchemy, and his worldview in general, but also how his theories may relate to his predecessors, including Marsilio Ficino, one of the few authors who escaped Paracelsus's harsh critique. “All Authority is from God”. An Aspect of Kant’s Theologico-Political Legacy In this essay, the position of Kant’s metaphysical idea of political authority is examined, first from the point of view of its distinctive position with regard to other modern thinkers on this issue, second – and more substantially – from the point of view of how Kant thinks political authority as being intrinsically dependent from a theological idea. Scrutinizing this theological idea, we argue, first, that it is of a (...) mere aesthetic use; further, that its noumenal referent is a fictitious God as Obligator; furthermore that the necessity by which this idea is inserted into a juridico-political setting is a merely subjective necessity; finally that its expected impact on external freedom is exclusively dependent from the ethical momentum by which external lawgiving is internally formatted. In this consensus report by a diverse group of academics who conduct and/or are concerned about social and behavioral genomics (SBG) research, the authors recount the often‐ugly history of scientific attempts to understand the genetic contributions to human behaviors and social outcomes. They then describe what the current science—including genomewide association studies and polygenic indexes—can and cannot tell us, as well as its risks and potential benefits. They conclude with a discussion of responsible behavior in the context of SBG (...) research. SBG research that compares individuals within a group according to a “sensitive” phenotype requires extra attention to responsible conduct and to responsible communication about the research and its findings. SBG research (1) on sensitive phenotypes that (2) compares two or more groups defined by (a) race, (b) ethnicity, or (c) genetic ancestry (where genetic ancestry could easily be misunderstood as race or ethnicity) requires a compelling justification to be conducted, funded, or published. All authors agree that this justification at least requires a convincing argument that a study's design could yield scientifically valid results; some authors would additionally require the study to have a socially favorable risk‐benefit profile. An influential interpretation of phenomenology construes Husserl's project as an attempt to generalize the Fregean notion of sense- an attempt to extend Frege's analysis of the structure of meaningful expressions to a more general account of the structure of meaning in experience . Michael Dummett has articulated a broadly Fregean critique of this Husserlian program, arguing that the project is misguided and retrograde-a relapse into the psychologism and idealism that Frege sought to avoid. A defense of Husserl is offered, based (...) in part on key elements of the theory of meaning articulated in his Logical Investigations . But the main aim is neither to acquit nor to convict Husserl of Dummett's charges; rather it is to use the exchange to investigate some of the philosophical commitments of a broadly Husserlian phenomenology. If we are to understand how Husserl avoids psychologism then we must come to terms with the paradoxical idea of an anti-psychologistic investigation of consciousness (an anti-psychologistic psychology). If we are to understand his complex stance toward idealism then we must not only understand the grounds for his rejection of subjective idealism but also be attuned to the other forms of idealism to which his project is committed. In the course of investigating these matters the author considers how Husserl can reply to the charge of explanatory vacuity, and shows that Frege himself recognizes the legitimacy of something like the Husserlian project. Seventeenth century philosophers were pre-occupied with the justification for the use of coercion; the nature and scope of the citizen's duty to obey the law was a central concern. The typical philosophical accounts which attempt to articulate the conditions under which a citizen has an obligation to obey the law tend to fall into two camps: those that ground the obligation to obey the law in consent, and those that ground it in benefits received, or possibly a combination of both. (...) More recently, however, some have argued that questions about the obligation to obey the law have been eclipsed by questions about distributive justice. Many leading figures in modern analytic jurisprudence remain concerned with the nature of political obligation. Joseph Raz is a current-day theorist who has recognized the importance of this issue and the need for an answer that is not over-simplistic. Recently Raz has re-examined his account in ?The Problem of Authority: Revisiting the Service Conception, - making an exploration of his theory particularly timely. Raz argues that all governments claim morally legitimate authority, but not all of them actually possess it. His theory seeks to give us the tools by which to distinguish the legitimate claims from imposters. The complexity and flexibility of Raz's understanding of the nature and scope of the individual's obligation to obey the law accounts for its appeal. Upon closer inspection, however, difficulties emerge. I argue that Raz's theory is plagued by a deep-seated tension between his two central theses: the pre-emption thesis and the normal justification thesis. While I explore both theses in further depth, the gist of the pre-emption thesis is that it requires a pre-commitment to authority in order for the law?s mediating role to be performed. Conversely, the normal justification thesis invites a case by case assessment of the bindingness of norms. I argue that instead of offering us a unified conception of authority, Raz vacillates unstably between two models - a consent-based model and a benefits received model. I demonstrate that this tension is ineradicable because the theses are connected to divergent models of law and incompatible methodologies. (shrink)

The authors of this article critically consider selected transhumanist views of new perspectives on humanity in the cosmic future. Their focus is on philosophical and ethical thinking about the futuristic concepts of Cyborgs and Cosmic Beings promoted by Ted Chu. They weight up the possible negative consequences of radical human enhancement and analyse the utilitarian roots of the conceptions discussed. The theory of planetary and cosmic personality appears to be a safer alternative to radical human enhancement but they also (...) pinpoint drawbacks to the theory. The authors conclude that a more conservative and authentic approach to human enhancement is found in the truly human enhancement proposed by Nicholas Agar and consider life-centred ethics an appropriate ethical standpoint in the search for humans’ place in the cosmic future. The article suggests that the Kantian account of mental illnesses is part of his study of logic in an attempt to claim, above all, that they hinder the training of attention, which will later allow us to publicly pursue knowledge. To this, the author elucidates the epistemic place that Kant gives to attention (_Aufmerksamkeit_)_ _in his transcendental, metaphysical, and anthropological remarks, given the important role it plays in the public elaboration of knowledge. Addressing the place that Kant gives to mental (...) weaknesses and illnesses in his anthropology lessons, the article sheds light on some correlations between these pathologies and attention, considering that mental weaknesses, as well as, mental illnesses warp, or are caused by, the fragile attention with which we direct our thoughts. This permits to shed light on a Kantian ideal related to the sovereignty of our attention, understood as a condition of possibility of the individual autonomy. (shrink)

Why 1 = presence and 0 = absence and the digital world formula is x = xn: an exploration of meaning in a universe of infinite replication. In the beginning was the Zero, and the Zero was with God, and God was the One. —All and Nothing In 1854, the British mathematician George Boole presented the idea of a universe the elements of which could be understood in terms of the logic of absence and presence: 0 and 1, all and (...) nothing—the foundation of binary code. The Boolean digits 0 and 1 do not designate a quantity. In the Boolean world, x times x always equals x; all and nothing meet in the formula x = xn. As everything becomes digitized, God the clockmaker is replaced by God the programmer. This book–described by its authors as “a theology for the digital world”—explores meaning in a digital age of infinite replication, in a world that has dissolved into information and achieved immortality by turning into a pure sign. All and Nothing compares information that spreads without restraint to a hydra—the mythological monster that grew two heads for every one that was cut off. Information is thousand-headed and thousand-eyed because Hydra's tracks cannot be deleted. It shows that when we sit in front of a screen, we are actually on the other side, looking at the world as an uncanny reminder of the nondigitized. It compares our personal data to our shadows and our souls, envisioning the subconscious laid out on a digital bier like a corpse. The digital world, the authors explain, summons forth fantasies of a chiliastic or apocalyptic nature. The goal of removing the representative from mathematics has now been achieved on a greater scale than Boole could have imagined. (shrink)
