In this paper, I argue for a novel reading of Spinoza’s position in his exchange with Boyle about Boyle’s experiment with nitre. Boyle claimed to have shown through experiments that nitre ceased to be nitre after heating. Spinoza disagreed and proposed the alternative hypothesis that nitre has changed its state and not its nature. Spinoza’s position was construed in the literature as rational scepticism denying that experiments can yield knowledge of essences because all sensory experience is underdetermined and open to (...) multiple interpretations. I argue for an alternative reading of Spinoza’s position which focuses on Bacon’s notion of crucial instance. According to this reading, Spinoza did not deny the possibility of knowing by experimentation whether nitre has changed its nature, he asked for a crucial instance, i.e. an experiment that would refute the hypothesis that nitre has changed merely its state. Spinoza’s argumentative strategy shows that, contrary to the mainstream reading, the representational content of sensory ideas can be determined even if it does not represent the essence of the object: we can know with absolute, rather than merely moral, certainty whether nitre ceased to be nitre without knowing what nitre is. In this paper, I discuss three personal examples of contemporary Austrians' defensive reactions when confronted with the book The Political of Repressed Guilt: The Tragedy of Austrian Silence (Leeb, 2018). The defensive reactions underline that Austrians evaded confronting themselves with their repressed guilt about their violent National Socialist past and failed at working through their past. It also explains the centrality of "embodied reflective spaces" and the idea of the "subject-in-outline" to counter the continuation of the cycle of violence engendered (...) through repressed guilt and to assist a nation's successful working through its past. It is not until the 11th century AD that we can speak of Austria being a thoroughly Christian country. This is all the more astonishing when one considers that even before the turn of the first century most of what is today Austria was part of the Roman Empire and how quickly Christianity spread to other parts of the Roman Empire. But how did the Christianization of Austria come about in the first place? Who were the bearers (...) of mission? What strategies were used? Is the term ‘missionary work’ appropriate at all or was it not rather a superficial, politically motivated Christianization? The cost-effectiveness of 24-hour care makes it a major source of support for elderly people in need of home-based care in Austria. Language barriers, feelings of isolation when living with chronically ill people and a lack of adequate training and quality control create stressful working conditions for 24-hour caregivers in Austria, who mainly come from Slovakia, Hungary and Romania. The challenges not only affect the 24-hour caregivers themselves but also their clients, relatives and registered care agency nurses in (...) care settings. The aim of the qualitative study was to assess user needs in order to develop an app to improve working conditions and quality assurance in 24-hour home-care. The study consisted of guided interviews, focus group and cultural probes and 45 interviewees. The collected data were analyzed using Kuckartz’s method of content structuring qualitative content analysis. The main results show that 24-hour caregivers predominantly require information about common geriatric diseases and the law on 24-hour care. Additionally, medical emergencies can cause insecurities, which creates high interest in professional emergency management skills. Clients and relatives are especially interested in 24-hour caregivers having better German language skills. Care agencies and registered nurses would particularly welcome electronic care documentation to ensure traceability of the activities and measures taken. The study points to the need for a digital tool that would meet demand for an appropriate assistance system for 24-hour home-care that complies with the AAL requirements of the aligned project. Therefore, the intended software solution meets challenges in 24-hour home-care for 24-hour caregivers, persons in need of care, their relatives and professionals involved in the 24-hour care setting. In the aftermath of the “Arab Spring” and of crumbling state structures, an exodus of unknown proportion from the Near East and from Northern Africa has set in and was further exacerbated by civil war and ISIS terror rule over large territories in the Near East. As a consequence, thousands of refugees came to Europe. Many of them fulfilled the conditions for non-refoulement according to Article 33 of the Geneva Convention on the Law of Refugees of 1951 or were at (...) least entitled for temporary protection according to the Common European Asylum System. These instruments did not, however, take into consideration situations of mass influx and neither is there an efficient mechanism for burden sharing within the EU in place. Some countries where overwhelmed by these migration flows. In this contribution, particular attention will be given to the reactions to these developments by the Austrian government. In Austria, as a consequence of mounting pressure by considerable parts of the population demanding a halt to this migration, the government adopted or announced a series of measures that, if implemented, will constitute a blatant violation of international law. This holds true, in particular, for the so-called upper limit for asylum seekers. Legal academia in Austria in part was silent as to these events, in part sustained it after having been engaged for a legal. It is contended here that unilateralism may be effective in a short-time perspective, but the long-term consequences should not be overlooked. It would be better to work on a genuine international burden-sharing mechanism even though this approach is more difficult to sell to national constituencies. (shrink)

It seems impossible to completely cover the field indicated by the title of this report because of the many contributions of individual physicians and non-physicians to problems of the philosophy of medicine in Austria, and to their solution. The main trends are rooted in historic developments and in the current problems of medicine and health care, which are similar world-wide. In Austria famous names like empress Maria Theresia or the physician Ignaz Semmelweis have to be mentioned in connection (...) with the development of the ideas of a philosophy of medicine. In recent times again influential and well-known persons in related fields of medicine and health care are Austrians. However, the main line of new developments goes mostly unseen by the public: activities in medical ethics with the goal to humanize health care, carried on by groups of young physicians, biomedical engineers and students. While this article aims to explore the connections between citizenship and ‘race’, it is the first study to use fictional tools as a sociological resource in exemplifying the deviation between citizenship in principle and practice in an Austrian context. The study involves interviews with 73 Austrians from three ethnic/racial groups, which were subjected to a directed approach to qualitative content analysis and coded based on sentences from George Orwell’s fictional book, ‘Animal Farm’. By using fiction as a conceptual and analytical (...) device, this article goes beyond the orthodox particulars of citizenship to expose the compressed entitlements of some racial/ethnic minorities. In particular, data analysis revealed two related and intertwined central themes: (a) “all animals are not equal or comrades”; and (b) “some animals are more equal than others”. All ‘animals’ may be equal in principle, whereas, in practice, their ‘race’ serves as a critical source of social (dis)advantage in the ‘animal kingdom’. Thus, since citizenship is a precondition for possessing certain rights that non-citizens are not granted, I argue that citizenship cannot only be judged by whom it, in theory, excludes (i.e., non-citizens), but also by how it treats the included (i.e., citizens) on the basis of their ‘race’. I conclude that skin colour is a specific aspect of the hierarchy of citizenship in Austria, which reinforces that ‘some animals are more equal than others’. (shrink)

Healthcare ethics consultation has been developed, practiced, and analyzed internationally. However, only a few professional standards have evolved globally in this field that would be comparable to standards in other areas of healthcare. This article cannot compensate for this situation. It contributes to the ongoing debate on professionalization by presenting experiences with ethics consultation in Austria, though. After exploring its contexts and providing an overview of one of its primary ethics programs, the article analyzes the underlying assumptions of “ethics (...) consultation” as an essential effort on the path to professionalize ethics consultation. In the world of Austrian neonatal intensive care units, the role of ethics is recognized only partially. The normatively tense cases that are at the backdrop of this essay concern the situations around the limit of viability, which is the point in the development of an extremely preterm infant at which there are chances of extra-uterine survival. This essay first outlines the key explicit ethical challenges that are mainly concerned with notions of uncertainty and best interest. Then, it attempts to (...) elucidate the less explicit ethical challenges related to the notion of nudging in the neonatal practice and argue that the role of ethics needs to be recognized more—with the focus on the role of virtue ethics—in order to improve the practice of neonatal medicine. The underrepresentation of women politicians in the media is a persistent feature in many contemporary democracies. Gender bias in election coverage makes it harder for women to reach positions of power in politics. Drawing on the special circumstances in Austria during the 2019 election campaign which saw the first female top candidate of a major party and a caretaker government containing equal numbers of men and women and which was led by the country’s first woman as chancellor, we examine (...) the effect of these developments on women politicians’ representation in campaign coverage. We draw on quantitative content analysis of Austrian newspaper articles (N = 16,125) during four national parliamentary election campaigns (2008, 2013, 2017 and 2019). We show that for women politicians the media ceiling is slowly lifting at best, but that positions of power provide the most promising ways to evade gendered media bias. (shrink)

The present essay seeks, by way of the Austrian example, to make a contribution to what might be called the philosophy of the supranational state. More specifically, we shall attempt to use certain ideas on the philosophy of Gestalten as a basis for understanding some aspects of that political and cultural phenomenon which was variously called the Austrian Empire, the Habsburg Empire, the Danube Monarchy or Kakanien.

This interdisciplinary, social scientific analysis of the regulatory discourse on nanotechnology in the three German-speaking countries of Germany, Austria and Switzerland and in the EU between 2000 and 2013 has shown three distinct phases, characterised by shifts in the configuration of actors and in the thematic scope from nanotechnology to nano-materials. Compared to modes of governance based on traditional statutory law, modes of governance based on less binding forms of soft law and self-regulation (like codes of conduct, guidelines and (...) certification systems) and new modes of governance (like assessment studies, risk management frameworks as well as participatory and cooperative forms of communication and negotiation) have gained importance. Despite some similarities, two different cultures in governing nanotechnology can be distinguished: a product-oriented culture in statutory regulations (when speaking about products, the article is also referring to substances) and a risk-based culture in applying soft law based on new modes of governance. In addition, the different regulatory cultures have led to four strategic approaches: modes of governance mainly based on hard law and soft law at the EU level, modes of governance mainly based on cooperative and self-regulatory approaches in Germany, cooperative governance approaches in Austria and modes of governance mainly based on self-regulatory and soft law approaches in Switzerland. The reform process of the CAP is increasingly open to actors that apply different frames. Recent research reveals the consistent use of five frames during CAP reform processes: the policy mechanism frame, the farmers’ economic frame, the societal concerns frame, the budgetary frame, and the foreign trade frame. Our qualitative content analysis of 1,155 newspaper articles from Austria’s largest agricultural newspaper published between 01/10/2010 and 31/01/2015 confirms that these five frames are also used in national CAP reporting and consist (...) of subframes. The European Commission (EC), the European Parliament, and the Council of the European Union, which are involved in the CAP legislative process, mainly use the policy mechanism frame. The farmers’ economic frame and the policy mechanism frame are applied throughout the reform process. The societal concerns frame is gradually used over time, while the foreign trade frame is limited to specific events. The budgetary frame increasingly refers to public money for public goods, which indicates that the EC and other actors put efforts into legitimising the CAP. The results emphasise that both, agricultural and environmental actors use agricultural media to generate support for or condemnation of agricultural policy and thereby affect political agenda-setting. ObjectiveTo assess the impact of the closure of group-based cardiac rehabilitation training during the first COVID-19 lockdown in spring 2020 on patients’ physical activity, cardiorespiratory fitness, and cardiovascular risk, and to describe the patient experience of lockdown and home-based exercise training during lockdown.DesignMixed methods study. Prospectively collected post-lockdown measurements were compared to pre-lockdown medical record data. Quantitative measurements were supplemented with qualitative interviews about the patient experience during lockdown.SettingOutpatient CR centre in Salzburg, Austria.ParticipantsTwenty-seven patients [six female, mean age 69 (...) years] who attended weekly CR training sessions until the first COVID-19 lockdown in March 2020.Outcome MeasureQuantitative: exercise capacity, cardiovascular risk. Qualitative: individual semi-structured interviews.ResultsExercise capacity had significantly reduced from pre- to post-lockdown: mean power in maximal ergometry 165 vs. 151, p < 0.001; submaximal ergometer training 99 vs. 97, p = 0.038. There was no significant difference in Framingham risk score and other cardiovascular risk factors. Qualitative data showed that almost all patients had kept physically active during lockdown, but 17 said they had been unable to maintain their exercise levels, and 15 felt their cardiorespiratory fitness had deteriorated. Many patients missed the weekly CR training and the motivation and sense of community from training together with others. Several patients stated that without professional supervision they had felt less confident to carry out home-based exercise training at high intensity.ConclusionThis study highlights the importance of group-based supervised exercise training for patients who engage well in such a setting, and the detrimental impact of disruption to this type of CR service on physical activity levels and exercise capacity. Additionally, learning from the COVID-19 pandemic may inform the development and implementation of remote CR modalities going forward. (shrink)

The paper analyses restructuring processes occuring with the introduction of information technologies into firms in Austria and assesses how far the evidence lends support to the thesis of a fundamental change in rationalization patterns as postulated by continental industrial sociologists claiming the emergence of a novel type of ‘systemic rationalization’. Based on a research perspective putting emphasis on several levels of social mediation of technological change the broad conclusion is the following: there are clear indications of a novel ‘systemic’ (...) approach to rationalization but the associated forms of work organization show substantial variation. The analysis of the influence of national-level institutions, industry- and firm-specific conditions, and their role in micro-political processes of system and work design, points towards an underutilization of work humanization potentials and suggests an increase in skill supply as one of the possible intervention strategies. Previous studies have found Forsyth’s Ethical Position Questionnaire (EPQ) to vary between countries, but none has made a systematic evaluation of its psychometric properties across consumers from many countries. Using confirmatory factor analysis and multi-group LISREL analysis, this paper explores the factor structure of the EPQ and the measurement equivalence in five societies: Austria, Britain, Brunei, Hong Kong and USA. The results suggest that the modified scale, measuring idealism and relativism, was applicable in all five societies. The application of the latest technologies in biology and medicine has brought them to a qualitatively new level of possibilities. Worldwide, biobanking is actively developing through the creation of biobanks of various types and purposes, whose resources are used to solve therapeutic or scientific problems. Legal science remains an open question concerning the boundary that runs between the right to data protection and the scope of disclosure of data needed for medical purposes. In this article, the author considers peculiarities of (...) data processing in the context of biobanking activity on the example of Austria and its national legislation. In addition, the article reveals features of the approaches of the European Court of Human Rights (ECtHR) and the Council of Europe to the issue of biobanking in general, its characteristics in the context of data, and legal regulation of this phenomenon in the national law of states. The author devoted an important part of the study to the role of Austria’s experience in the context of data processing for scientific purposes and the development of biobanking for a number of other European states. The aim of the article is to analyze the Austrian legislation on data processing for scientific research and biobanking, the attitude of the Council of Europe to this phenomenon, and the practice of the ECtHR, as well as to consider the impact of the current world situation on these activities. The leading method of research used in the article is the formal-legal method. The article analyzes the Austrian law in the context of data processing in medical research, the relationship of the specifics of personal data protection, and the need to disclose them for scientific purposes. The author pays special attention to the influence of Austrian law on the legislation of other countries, which is reflected in the conclusions to the article. In addition, based on an analysis of the application of the Austrian experience to the legislation of Poland and Ukraine, the author points out the necessary changes that should be made in the laws of these countries. Instead of essentializing and defining what CSR “is”, we analyze CSR as a political discourse in which different actors struggle to fill the empty shell of Corporate Social Responsibility (CSR) with a legitimate interpretation. In this paper we take the current debate on CSR in Austria as an example to demonstrate how this debate is shaped by changes in the greater socio-economic environment. We suggest that this debate might be paradigmatic for the development of CSR in the European/International context. (...) We argue that the debate and the political moves concerning an implicit or an explicit concept of CSR are rooted in a more fundamental question: the societal (re-)embedding or disembedding of companies. In media-centered democracies, political TV interviews can reveal a lot about the relationship between journalists and politicians. However, knowledge about these formats during non-election times is lacking. Against this background, this study aims to generate insights about specific conversation strategies, the staging of politics, and agenda control in a long-term comparison, and to link them with media logic, which has been identified as a factor that shapes agenda-setting strategies in related contexts. Following a static-dynamic approach, a quantitative content analysis was (...) conducted for all statements (N=19,108) from 125 episodes of a specific Austrian interview format in a one-on-one setting broadcast between 1981 and 2016. Regarding the number of statements in which a newly introduced topic is discussed as a measure for agenda control, specific conversation strategies were identified that contribute to a stronger position for journalists. Moreover, specific aspects of media logic help to introduce and anchor a new topic, although their success varies over the decades. (shrink)

Science and technology policy is often confronted with issues that are both complex and controversial and which have to be decided upon in a delicate constellation of policy-makers, experts, stakeholders, non-governmental organizations and the public. One attempt to deal with such a complex problem is via citizen involvement. Participatory technology assessment (pTA) already goes back to several decades, and countries have made various experiences. While in some countries, governments established technology assessment organizations, which also included pTA in their methodological portfolio, (...) others primarily rely on experts to make decisions on science and technology policy. In a third group of countries non-state actors, such as social scientists, experimented with pTA. However, they were often unable to link these experiments to policy-making. This paper deals with the question of why this variation exists and compares the use of pTA in Switzerland and Austria. Despite similarities between the two countries, both had quite different experiences with pTA so far. Whereas several pTAs have been carried out in Switzerland until today, Austrian pTAs have remained infrequent. The aim of this paper is to explain this difference as a result of different ways of policy-making which affect the use and chances of pTA. (shrink)

BackgroundEgg freezing has emerged as a technology of assisted reproductive medicine that allows women to plan for the anticipated loss of fertility and hence to preserve the option to conceive with their own eggs. The technology is surrounded by value-conflicts and is subject to ongoing discussions. This study aims at contributing to the empirical-ethical debate by exploring women’s viewpoints on egg freezing in Austria, where egg freezing for social reasons is currently not allowed.MethodsQ-methodology was used to identify prevailing viewpoints (...) on egg freezing. 46 female participants ranked a set of 40 statements onto a 9-column forced choice ranking grid according to the level of agreement. Participants were asked to explain their ranking in a follow-up survey. By-person factor analysis was used to identify distinct viewpoints which were interpreted using both the quantitative and the qualitative data.ResultsThree distinct viewpoints were identified:(1) “women should decide for themselves”,(2) “we should accept nature but change policy”, and (3) “we need an informed societal debate”. These viewpoints provide insights into how biomedical innovations such as egg freezing are perceived by women in Austria and illustrate the normative tensions regarding such innovations.ConclusionsAcknowledging the different prioritizations of values regarding assisted reproductive technologies is important to better understand the underlying normative tensions in a country where egg freezing for social reasons is currently not allowed. The study adds new empirical insights to the ongoing debate by outlining and discussing viewpoints of those directly affected: women. Following up on the lay persons perspective is particularly important in the context of future biomedical innovations that may challenge established norms and create new tensions. It therefore also adds to the societal debate and supports evidence-informed policy making in that regard. (shrink)

The notion of a “third food regime” implies simultaneous processes of further global concentration and integration and at the same time resistance through new emerging producer–consumer relations. This paper examines these processes by looking at Austria over the last 30 years. While direct producer–consumer cooperatives established at an early point, today forms of community supported agriculture are rare. This paper explains this by identifying a shift of the entire food system from “food from nowhere” to “food from here.” The (...) account follows the early emergence of alternative food networks through the political appeal to consumer patriotism in connection with Austria joining the EU, to a sustained positioning of retail chains with regional and national food products. The paper argues that this satisfies the needs of a large proportion of consumers and discourages the emergence of new food initiatives. The paper follows the development of different approaches and their transformations until today. Thus a picture evolves of changing, and partly progressing consumer–producer relations in response to wider societal and political transformation processes. The results explain why the movement towards CSA is currently weak in Austria, but demonstrate at the same time how alternative food networks may contribute to a transformation of the food system. Stakeholder maneuvers such as Internet media attacks or consumer boycotts can have devastating effects on companies. By contrary, vital relationships between companies and their stakeholders can be highly beneficial. A review of the existing stakeholder-management literature suggests to engage stakeholders in business activities in a positive manner. However, the types of successful engagement activities differ across industries. The purposes of this article are to develop an explanatory framework based on the literature findings, to introduce stakeholder-engagement literature to a segment of (...) the water sourcing industry, and to unfold industry’s stakeholder-engagement measures. Based on a content analysis of 11 cases, we investigate if and how companies in the natural mineral water bottling industry in Austria inform, communicate, and therefore engage with stakeholders. It became evident that fewer than three of eleven companies published information on sustainability or corporate social responsibility reports, open house days, workshops, or international community activities. Most companies maintained a website for their bottled natural mineral water or communicated quality consciousness. We conclude that most companies in the Austrian mineral water industry could increase their stakeholder-engagement activities to positively respond to challenging business environments. (shrink)

Cet article traite de deux aspects de la nomination dans des communautés ashkénazes d’Autriche au Moyen Âge : d’une part, comme caractéristique identitaire quant à l’appartenance religieuse et, d’autre part, en relation avec le genre et l’assignation de genre. Diverses prescriptions juridiques et habitudes spécifiquement genrées pèsent en effet sur le port du nom : dans les sources historiques les hommes juifs sont repérés aussi bien par leur nom « sacré » hébreu que par leur prénom usuel, et éventuellement par (...) un surnom, alors qu’on ne repère le plus souvent les femmes que par leur prénom usuel. Selon le droit juif, les hommes produisent dans leur nom hébreu le nom de leur père ; les matronymes ne sont que rarement donnés, et tout au plus avec le prénom usuel. Les femmes, en revanche, s’identifient par le nom de leur mari. Quant aux noms affectueux et aux noms usuels, ils sont très comparables chez les enfants masculins et féminins. (shrink)

Egg freezing has led to heated debates in healthcare policy and bioethics. A crucial issue in this context concerns the distinction between “medical” and “social” egg freezing —contrasting objections to bio-medicalization with claims for oversimplification. Yet such categorization remains a criterion for regulation. This paper aims to explore the “regulatory boundary-work” around the “medical”–”social” distinction in different egg freezing regulations. Based on systematic documents’ analysis we present a cross-national comparison of the way the “medical”–”social” differentiation finds expression in regulatory frameworks (...) in Austria, Germany, Israel, and the Netherlands. Findings are organized along two emerging themes: the definition of MEF and its distinctiveness—highlighting regulatory differences in the clarity of the definition and in the medical indications used for creating it ; and hierarchy of medical over social motivations reflected in usage and funding regulations. Blurred demarcation lines between “medical” and “social” are further discussed as representing a paradoxical inclusion of SEF while offering new insights into the complexity and normativity of this distinction. Finally, we draw conclusions for policymaking and the bioethical debate, also concerning the related cryopolitical aspects. (shrink)
