Pathologizing ugliness refers to the framing of unattractive features as a type of disease or deformity. By framing ugliness as pathology, cosmetic procedures are reframed as therapy rather than enhancement, thereby potentially avoiding ethical critiques regularly levelled against cosmetic surgery. As such, the practice of pathologizing ugliness and the ensuing therapeuticalization of cosmetic procedures require an ethical analysis that goes beyond that offered by current enhancement critiques. In this article, I propose using a thick description of the goals of medicine (...) as an ethical framework for evaluating problematic medical practices. I first describe the goals of medicine based on Daniel Callahan's account. I then propose that the goals work best in conjunction with ancillary ethical concepts, namely medical knowledge and skills, standards of practice and medical duties and virtues. Next, I apply the thick description of the goals of medicine in critiquing the practice of framing ugliness as disease. Here, I demonstrate ethical conflicts between aesthetic judgments that underpin the practice of pathologizing ugliness and medical judgments that inform ethical medical practices. In particular, the thick description of the goals of medicine helps reveal ethical conflicts in at least three key domains common to clinical practices, which include (a) disease determination, (b) diagnostic evaluation and (c) establishing clinical indications. My analysis offers a novel way of critiquing the practice of pathologizing ugliness in cosmetic surgery, which tends to be neglected by enhancement critiques. (shrink)

This article provides a critical comparative analysis of the substantive and procedural values and ethical concepts articulated in guidelines for allocating scarce resources in the COVID-19 pandemic. We identified 21 local and national guidelines written in English, Spanish, German and French; applicable to specific and identifiable jurisdictions; and providing guidance to clinicians for decision making when allocating critical care resources during the COVID-19 pandemic. US guidelines were not included, as these had recently been reviewed elsewhere. Information was extracted from each (...) guideline on: 1) the development process; 2) the presence and nature of ethical, medical and social criteria for allocating critical care resources; and 3) the membership of and decision-making procedure of any triage committees. Results of our analysis show the majority appealed primarily to consequentialist reasoning in making allocation decisions, tempered by a largely pluralistic approach to other substantive and procedural values and ethical concepts. Medical and social criteria included medical need, co-morbidities, prognosis, age, disability and other factors, with a focus on seemingly objective medical criteria. There was little or no guidance on how to reconcile competing criteria, and little attention to internal contradictions within individual guidelines. Our analysis reveals the challenges in developing sound ethical guidance for allocating scarce medical resources, highlighting problems in operationalising ethical concepts and principles, divergence between guidelines, unresolved contradictions within the same guideline, and use of naïve objectivism in employing widely used medical criteria for allocating ICU resources. Pathologizing ugliness refers to the use of disease language and medical processes to foster and support the claim that undesirable features are pathological conditions requiring medical or surgical intervention. Primarily situated in cosmetic surgery, the practice appeals to the concept of “aesthetic pathology”, which is a medical designation for features that deviate from some designated aesthetic norms. This article offers a two-pronged conceptual analysis of aesthetic pathology. First, I argue that three sets of claims, derived from normativist and naturalistic accounts (...) of disease, inform the framing of ugliness as a disease. These claims concern: (1) aesthetic harms, (2) aesthetic dysfunction, and (3) aesthetic deviation. Second, I introduce the notion of a hybridization loop in medicine, which merges the naturalist and normative understanding of the disease that potentially enables pathologizing practices. In the context of cosmetic surgery, the loop simultaneously promotes the framing of beauty ideals as normal biological attributes and the framing of normal appearance as an aesthetic ideal to legitimize the need for cosmetic interventions. The article thus offers an original discussion of the conceptual problems arising from a specific practice in cosmetic surgery that depicts ugliness as the disease. (shrink)

Background There is a growing concern about artificial intelligence (AI) applications in healthcare that can disadvantage already under-represented and marginalised groups (eg, based on gender or race). Objectives Our objectives are to canvas the range of strategies stakeholders endorse in attempting to mitigate algorithmic bias, and to consider the ethical question of responsibility for algorithmic bias. Methodology The study involves in-depth, semistructured interviews with healthcare workers, screening programme managers, consumer health representatives, regulators, data scientists and developers. Results Findings reveal considerable (...) divergent views on three key issues. First, views on whether bias is a problem in healthcare AI varied, with most participants agreeing bias is a problem (which we call the bias-critical view), a small number believing the opposite (the bias-denial view), and some arguing that the benefits of AI outweigh any harms or wrongs arising from the bias problem (the bias-apologist view). Second, there was a disagreement on the strategies to mitigate bias, and who is responsible for such strategies. Finally, there were divergent views on whether to include or exclude sociocultural identifiers (eg, race, ethnicity or gender-diverse identities) in the development of AI as a way to mitigate bias. Conclusion/significance Based on the views of participants, we set out responses that stakeholders might pursue, including greater interdisciplinary collaboration, tailored stakeholder engagement activities, empirical studies to understand algorithmic bias and strategies to modify dominant approaches in AI development such as the use of participatory methods, and increased diversity and inclusion in research teams and research participant recruitment and selection. The popularity of surgical modifications of race-typical features among Asian women has generated debates on the ethical implications of the practice. Focusing on blepharoplasty as a representative racial surgery, this article frames the ethical discussion by viewing Asian cosmetic surgery as an example of medicalization, which can be interpreted in two forms: treatment versus enhancement. In the treatment form, medicalization occurs by considering cosmetic surgery as remedy for pathologized Asian features; the pathologization usually occurs in reference to western features as (...) the norm. In the enhancement form, medicalization occurs by using medical means to improve physical features to achieve a certain type of beauty or physical appearance. Each type of medicalization raises slightly different ethical concerns. The problem with treatment medicalization lies in the pathologization of Asian features, which is oppressive as it continues to reinforce racial norms of appearance and negative stereotypes. Enhancement medicalization is ethically problematic because cosmetic surgery tends to conflate beauty and health as medical goals of surgery, overemphasizing the value of appearance that can further displace women’s control over their own bodies. I conclude that in both forms of medicalization, cosmetic surgery seems to narrowly frame a complex psychosocial issue involving physical appearance as a matter that can be simply solved through surgical means. This review aims to identify (1) sources of knowledge and (2) important themes of the ethical debate related to surgical alteration of facial features in East Asians. This article integrates narrative and systematic review methods. In March 2014, we searched databases including PubMed, Philosopher’s Index, Web of Science, Sociological Abstracts, and Communication Abstracts using key terms “cosmetic surgery,” “ethnic*,” “ethics,” “Asia*,” and “Western*.” The study included all types of papers written in English that discuss the debate on rhinoplasty and blepharoplasty (...) in East Asians. No limit was put on date of publication. Combining both narrative and systematic review methods, a total of 31 articles were critically appraised on their contribution to ethical reflection founded on the debates regarding the surgical alteration of Asian features. Sources of knowledge were drawn from four main disciplines, including the humanities, medicine or surgery, communications, and economics. Focusing on cosmetic surgery perceived as a westernising practice, the key debate themes included authenticity of identity, interpersonal relationships and socio-economic utility in the context of Asian culture. The study shows how cosmetic surgery of ethnic features plays an important role in understanding female identity in the Asian context. Based on the debate themes authenticity of identity, interpersonal relationships, and socio-economic utility, this article argues that identity should be understood as less individualistic and more as relational and transformational in the Asian context. In addition, this article also proposes to consider cosmetic surgery of Asian features as an interplay of cultural imperialism and cultural nationalism, which can both be a source of social pressure to modify one’s appearance. Seattle, Prague, Quebec, Nice, Gothenburg, Genoa, Brussels, Barcelona, ≡ All these cities formed the setting of mass globalization protests. In most mass media reports, the presence of thousands of peaceful demonstrators has been outshone by the pictures of radical activists smashing McDonald's and Niketown. In the search for an adequate theological response to today's context of globalization, this article takes precisely this radical activism as a starting–point. In line with those postmodern iconoclasts’ own legitimation, a theological approach to this case (...) leads to the Marxist theory of fetishism and idolatry as it has already been investigated by liberation theologians two decades ago. Surprisingly, a renewed version of this critique of the theologization of economics can be found in No Logo , the trend–setting globalization critique written by the Canadian journalist Naomi Klein. A theological close reading of this best–selling book brings to the light a recurrent use of religious metaphor to characterize the corporate logo as a major aesthetic figure in the context of globalization. In order to understand the aesthetic and theological processes involved, a confrontation with the theological aesthetics of Hans Urs von Balthasar delivers a striking formal parallel between the Church's cross and today's corporate logo. Beyond an at first sight similar theo–aesthetic programme, Balthasar's theological aesthetics however opens up a position which enables us to expose the contemporary global socio–economic system as a subtly inverted Christianity. A simple surveying being excluded, other methods have to be considered, and first the spotting of privileged directions from high points (such as the Puy-de-Dôme, the Montagne de Dun, the Mont Dardon, the hill of Sion-Vaudémont…) allowing a kind of primitive triangulation. It has been noticed that in the obtained patterns, the places known as Mediolanum play a major role. Thus Milano, Mediolanum of (...) the Insubri and Châteaumeillant, home of the Biturigi, can be connected by a straight line across the Mont Blanc and the Montagne de Dun, this last one being the center of several equidistances leading to Meilhan-sur-Garonne, Saintes, Évreux, all of them ancient Mediolanum. Geometrical relations, not less striking, link among others, the Mediolanum de Samoreau (landmark on the bank of the Seine) to Maulain (Haute-Marne), Mâlain (Côte‑d’Or) and Moliens (Oise). Consistant with the Celtic tradition, the sacralization of the central points adds up to a real endeavour of Gallic geodesy, the chronology of which should be elaborated. (shrink)

Beyond the dragon of the tales, reduced to its function as an adversary, most Celtic dragons are linked to a site, most often in relation to the water regime: flood plains, confluences, torrents (the Drac). In Christianised versions, a saint, rather than exterminating them, is responsible for leading them back to their maritime or underground origin. Princes use it differently. Their confrontation with the dragon is a qualifying fight wich allows them to appropriate the monster’s strength. Represented on their (...) sword or their shield, or even integrated into their name (Uther Pendragon), the dragon becomes a talisman. Cities and nations (Wales) make it their emblem. In time, dragons are linked to the four great Celtic calendar festivals. The fight of two dragons, split ouroboros, symbolises the two seasons of the year, alternately dark and light. In space, the dragon maintains a privileged relationship with the notion of central place, leading back to the problem of the omphaloi (Delphi) or the Gallic Mediolanum. At the astronomical level, the constellation of the Dragon, where the Greeks saw the metamorphosis of the dragon (and the river) Ladon, becomes in Breton Avank Du, “the black Beaver”, allowing us to imagine a monstrous beaver blocking the waters as the Vedic Vrtra. Active in the three functions, present at the three levels of the world in verticality, the Celtic dragon thus joins its congeners from other mythologies, attesting to its immemorial origin. Proche de la cour de Saint Louis et des ordres mendiants, détracteur du Talmud, l'évêque a laissé une oeuvre importante mais peu étudiée.

Le pancratiaste périodonique Markos Aurèlios Dèmostratos Damas de Sardes est connu par de nombreux témoignages trouvés dans sa patrie, à Rome, à Éphèse, à Delphes et en Egypte. Leur réexamen permet de reconstruire avec précision la carrière du champion, comme d'éclairer certains points de l'histoire des concours qu'il a remportés. Deux inscriptions d'Éphèse qui lui ont été rapportées ne doivent sans doute pas l'être. On peut proposer de nouveaux suppléments aux palmarès de Sardes et de Delphes ; un autre texte (...) delphique est identifié comme une nouvelle liste chronologique des victoires de Dèmostratos Damas. Le pancratiaste, dont le floruit se situe sous le règne de Marc Aurèle, a brillé en fin de carrière dans la boxe. Les statues dont on a retrouvé les bases ont été érigées essentiellement après sa carrière sportive, lorsqu'il exerce, sous Septime Sévère, les plus hautes charges au sein de l'association des athlètes. Les errements d'Yves de Vallone (1666/67-1705) et les péripéties de sa carrière sont remarquables. Engagé malgré lui dans la Congrégation de Sainte-Geneviève à l'âge de 16 ans, il s'enflamme lorsqu'il est informé qu'il existe une "petite Église" de sociniens au sein de son ordre. Il accuse les directeurs génovéfains d'hérésie et subit une persécution très éprouvante, mais finit par faire démettre le supérieur général et ses acolytes, non pas à cause de leur hérésie, mais à cause de la persécution (...) qu'ils lui ont infligée. La nouvelle direction génovéfaine cherchant à venger l'ancienne, Vallone s'échappe en Suisse et en Allemagne et se convertit au protestantisme en 1697. Appelé à Zwolle aux Provinces-Unies, il s'érige en apologiste rationaliste de la doctrine calviniste de la prédestination dans deux écrits dirigés contre les luthériens. Cependant, ne voulant abandonner la métaphysique aux libertins ; il se laisse emporter par la logique de sa propre conception malebranchiste de l'Être infiniment parfait et se heurte à la critique de Jacques Bernard et à la censure par un synode de l'Église réformée en 1703. Il abandonne alors, non pas son rationalisme malebranchiste, mais la doctrine du péché originel qui avait entraîné toutes ses difficultés : sous l'influence de Leenhof, et à l'aide des œuvres de Richard Simon, de Pierre Bayle et de Spinoza, il dresse une histoire accablante de la doctrine chrétienne et élabore un système philosophique où Dieu, principe intelligent de tout ce qui existe, agit par la nécessité de sa propre nature et finit par se confondre avec la Nature."--Page 4 of cover. Pestieau, intéressant et substantiel, s’articule autour de trois thèmes on ne peut plus actuels: la fragmentation des nations, la mondialisation de l’économie et l’impact de ces deux phénomènes sur la souveraineté de l’État et la santé des institutions démocratiques. Concernant le premier thème, l’auteur aborde entre autres les questions du nationalisme, du multiculturalisme et du droit de sécession. Au sujet du second, l’auteur traite des effets de la mondialisation sur l’emploi et la répartition des richesses, de l’aide (...) au développement, de la pertinence des interventions économiques de l’État, de la constitution de grands blocs économiques, etc. Enfin, considérant les défis soulevés par les deux thèmes précédents, l’auteur fait le point sur la démocratisation des institutions et associations internationales, le fédéralisme, le patriotisme constitutionnel et le nationalisme culturel. Sur toutes ces questions, le propos se veut général et universel, mais les cas du Canada et du Québec servent souvent d’exemples. Accompagne cette ambitieuse table des matières, une bibliographie considérable que l’auteur semble tout à fait maîtriser. (shrink)

Désormais accessible du fait de l’ouverture des archives vaticanes pour le pontificat de Pie XII, le dossier de la Congrégation du Saint-Office sur le Père Congar fait toute la lumière sur les trois passages du théologien devant elle. Le premier, en janvier 1939, concerne Chrétiens désunis qui s’en tire avec un avertissement bénin, mais suffisant pour que la seconde version du livre ne soit jamais publiée. Le second, en 1951-1952, concerne Vraie et fausse réforme dans l’Église qui est interdit (...) de réédition et de traduction. Alors que les deux premiers se sont déroulés en l’absence du Père Congar et à son insu, le troisième voit sa comparution au Saint-Office, en décembre 1954, pour un interrogatoire sur l’ensemble de son œuvre. Deux dominicains français, les Pères Garrigou-Lagrange et Gagnebet ont été mêlés de près à ces différentes procédures. En octobre 1955, le théologien est assigné à Cambridge par le maître général des dominicains, avec soumission à la censure romaine du moindre de ses écrits. Son exil ne finira qu’en décembre 1956 avec son assignation au couvent de Strasbourg. (shrink)

Woznicki points out that Duns Scotus's insistance on the primacy of essence over exist· ence led to a metaphysics quite different from that of Saint Thomas, in which existence had priority over essence, Woznicki emphasizes (...) that Ockham's denial of the validity of analogy has bequeathed to us an instrumentalistic understanding of being as being; the real unity of being is replaced by a unity that is the product of our minds. What actually happens in Ockham is that metaphysics is subordinated to the demands of logic. Ockham's metaphysics also resembles the Heraclitean philosophy of becoming, and Woznicki points to Nietzsche as evidence that such a philosophy of becoming necessarily leads to nihilism. In his criticism of Ockham as well as in his criticism of Descartes, Kant, and Whitehead, Woznicki not only makes Thomas seem more attrac· tive but also, at least implicitly, reveals the deleterious effect that influential false philosophies can have on the human adventure. Woznicki 's explanation of Thomas's doctrine of esse does involve abstract thinking, but the result, the rooting of order in esse, is anything but irrelevant. Metaphysics does bury its undertakers; bad metaphysics creates victims. Father Woznicki has produced a fine work as the author of this first volume in the series Catholic Thought from Lublin. Almost sixty years have passed between the first appearance of Jn. troduction al'ontologie du connaitre and its English translation. But even though we have had to wait so long, we now have this treasure in hand. An Introduction to Metaphysics of Knowledge leaves no doubt that here is a thinker of the first water. Simon's writings never fail to exemplify the medieval fusion of the concepts " teacher " and " master " in the Latin " magister." As I observed when reviewing one of his posthumously published books, Work, Society, and Culture, BOOK REVIEWS 155 Simon had the knack for using concrete words and vivid imagery drawn from everyday life to carry the reader to the very heart of pro· found thoughts. That testifies to more than just a good prose style; the freedom from reliance on jargon and formalized academic language shows that Simon was neither a " scholastic" (in the pejorative sense of the word) nor a pedant or mere academician. His ready access to everyday language is simply one more indication that he was an independent philosophical thinker for whom reflective personal experience, not the text, was the ultimate court of appeal for arriving at the truth. A case in point is the book's structure. Flipping through its pages, one notices the frequent extended discussions in the footnotes and the abundant citation of classical texts, often leaving room for no more than three or four lines of Simon's own prose on a given page. This may well remind the reader of the musty pedantry of so many doctoral dissertations. But although Simon frequently cites the texts of Aristotle, St. Thomas, Cajetan, and John of St. Thomas, the arguments he advances clearly do not depend on any appeal to the authority of these authors. Although a Thomist, he assumes complete responsibility for his critique of knowledge; he is a thinker whose arguments stand on their own merit. All the references to the aforementioned authorities are truly footnotes; they are never an essential part of Simon's own text. (This bears mention for the benefit of the august members of "The Guardianship of the Undefiled Text of St. Thomas Aquinas," who can be counted upon to insist that commentators, such as John of St. Thomas, are unreliable interpreters of the master's texts.) Twentieth-century French philosophers Jacques Maritain and Yves R. Simon pioneered new approaches to understanding and defending political democracy in the wake of two world wars. Rather than break from a religious tradition that seemed to struggle against modernity and certain forms of democratic theory and practice, these thinkers instead looked back to the philosophy of Aristotle and Thomas Aquinas to propel Catholic political philosophy forward. The profound influence of Maritain and Simon is manifest in the dramatic achievements of Vatican (...) II and in the work of the scholars of political philosophy who learned from them. John P. Hittinger, one of the finest of these scholars, provides in Liberty, Wisdom, and Grace a comprehensive survey of the Thomists' contributions to contemporary political thought as well as a detailed analysis of their approach to democracy. Hittinger treats criticism of Maritain, including the work of Catholic political writer Aurel Kolnai, and discusses the alternative democratic visions of John Locke and David Richards. Elle est, ailleurs, consideree comme le divertissement d'un jour, l'occasion d'une promenade sans enjeu. In his Florentine Histories, Machiavelli offers an ambivalent portrayal of the revolt of the textile workers in late fourteenth-century Florence, known as the tumult of the Ciompi. On the face of it, Machiavelli's depiction of the insurgent workers is not exactly flattering. Yet this picture is undermined by a firebrand speech, which Machiavelli invents and attributes to an unnamed leader of the plebeian revolt. I interpret this speech as a radical and egalitarian vector of thought opened up by Machiavelli's text. (...) The revolutionary address reveals an untimely and not entirely self-conscious political radicalism, a plebeian politics that repudiates the logic of oligarchic privilege and is simultaneously not available for subsumption under the mantle of civic republicanism. In 2007, a private corporation specializing in deep-sea salvage retrieved a treasure-laden shipwreck in international waters southwest of the Iberian Peninsula. The wreck was that of a Spanish warship that sunk during the Napoleonic wars. Following the discovery, a legal dispute arose in U.S. federal courts, between the corporate salvors, the Kingdom of Spain, and other litigants. At issue in the legal proceedings was the status of the shipwreck and whether it was protected by sovereign immunity. At the heart of (...) this case are differing political imaginations concerning the authority of states and the role of corporations in the contemporary global order. Through a close reading of court documents and the narratives in which the courts’ rulings are embedded, we demonstrate that the case is symptomatic of the tension in neoliberal sovereignty between two overlapping and at times competing political rationalities: the neoliberal logic of capital and commerce and the logic of sovereign prerogative. Dans cet article, je propose une analyse des débats récents sur la « justice climati­que », c’est-à-dire les enjeux de justice distributive liés aux phénomènes des changements climatiques. Je me propose d’y faire trois choses : premièrement, je propose une série de distinctions conceptuelles permettant de faire la cartographie des enjeux normatifs en cause et des taches que doivent réaliser nos théories en éthique environnementale. Deuxiè­mement, je tente d’attirer l’attention sur un problème de taille, mais quelque peu négligé dans la (...) littérature : le problème de la distribution des responsabilités. Troisiè­mement, je défends la désirabilité d’un passage des éthiques environnementales vers les philosophies politiques de l’environnement. (shrink)
