Stethoscopes, x-rays and other medical technologies are two-edged swords. They make medical treatment and diagnosis more accurate and effective, but do at the same time reveal our perceptual inadequacy. By transcending our senses, these technologies reveal that we can be seriously diseased without experiencing any symptoms at all. This situation has changed our attitude towards our relations and ourselves. The situation can be analysed using Jürgen Habermas’ conception of systems colonisation of the lifeworld. In this article, tragedy and utopia are juxtaposed, and it is proposed that the problem of “medicalisation” is better understood in a framework of tragedy than in a utopian one. In utopia, it is presupposed that there is an error behind every setback and every side effect, whereas tragedy brings to light how side effects can be the result of irreconcilable conflicts. Medicalisation is to some extent the result of such a tragic conflict. We are given power by medical progress, (...) but are also confronted with our fallibility, thus provoking insecurity. This situation is illustrated by the sudden infant death syndrome . Recent epidemiological investigations have shown that infants sleeping in a prone position have a 15–20 times higher risk of dying from SIDS than infants sleeping in a supine position. A simple means of preventing infant death is suggested by this discovery, but insecurity is also created. What else has been overlooked? Perhaps a draught, or wet diapers, or clothes of wool are just as dangerous as sleeping prone? Further investigations and precautions will be needed, but medicalisation prevails. (shrink)

Supported by Ian Hacking’s concept of “intervention,” and Charles Taylor’s concept of “intentionality,” this article argues that doubting is acting, and that doubting is therefore subject to the same demands of responsibility as any other action. The argument is developed by using medical practice as a test-case. The central suggestion is that the demand of acting responsibly limits doubt in medicine. The article focuses on two such limitations to doubt. Firstly, the article argues that it is irresponsible to doubt that (...) our actions can harm other people. Secondly, the article argues that it is irresponsible not to strive for coherence between our utterances of doubt and our other actions. Incoherence here can cause “cultural impoverishment.” In a larger context this article also argues that medicine can enrich our epistemology, because medical knowledge displays important traits of knowledge that are downplayed in traditional epistemology derived from mathematics and physics. In particular, medicine makes it possible to get the relation between ethics and epistemology into sharper focus. The endpoint in medical epistemology is “responsible action,” and not certainty in and of itself. (shrink)

In this article, I defend luck at the expense of risk. Or, more precisely, I try to make a distinction that gives both concepts fair treatment. I start by making it clear that luck stands in opposition to control and not to causation. Both luck and risk are related to causal uncertainty. But it is warranted to talk about risk only when the uncertainty involved is brought under control, as it is in some familiar forms of fair gambling such as (...) dicing and roulette. Life is however not a fair gamble. We rarely have the kind of control over the preconditions of life that we have over the preconditions of say dicing. Luck therefore has profound influence on our lives and our health. This means that the standard conception of responsibility - that is, that we stand responsible only for consequences that we control - breaks down far more often than what is usually acknowledged. I therefore end the article by arguing that the standard conception of responsibility ought to be supplemented with a different conception that I have called "responsibility because of social involvement.". This paper describes the significance of key empirical findings from the recent and landmark study Caring and Aging with Pride: The National Health, Aging and Sexuality Study (with Karen I. Fredriksen‐Goldsen as the principal investigator), on lesbian, gay, bisexual, and transgender aging and health disparities. We will illustrate these findings with select quotations from study participants and show how nonconscious bias (i.e., activation of negative stereotypes outside conscious awareness) in the clinical encounter and health care setting can threaten shared (...) decision‐making and perpetuate health disparities among LGBT older adults. We recognize that clinical ethicists are not immune from nonconscious bias but maintain that they are well situated to recognize bias and resulting injustice by virtue of their training. Further, we discuss how clinical ethicists can influence the organization's ethical culture and environment to improve the quality and acceptability of health care for LGBT older adults. (shrink)

Indeed, believing in the importance of this sort of work, we have each spent much of our careers studying the women writers absent (...) from our own graduate-school education. What follows, however, is a cautionary tale about discovery and reclamation: first, our discovery of what we thought was a hitherto-neglected text by eminent seventeenth-century writer Madeleine de Scudéry—her Lettres amoureuses de divers auteurs de ce temps (1641); second, our discovery that the text was not (even as indexed in Gerritsen Collection of Women’s History microfilm collection) authored by Scudéry but was written instead by a Franciscan priest, Jacques Du Bosc. Clearly, our second discovery pointed out both our own rush to judgment as well as that of other literary scholars interested in the tenuous project of historical reclamation. In this essay, we seek to explore the implications of attribution and authorship for our cautionary tale. Does the fact that a work is not Scudéry’s Lettres amoureuses but instead Du Bosc’s Nouveau recueil de lettres des dames de ce temps (1635) diminish its importance to the history of women’s letters?The First DiscoveryWe became interested in Scudéry’s Lettres amoureuses because of a brief description of the text in Joan DeJean’s Tender Geographies, a pioneering study of women novelists of the seventeenth century. DeJean describes a one-volume work that constituted the first publication of one of the most important writers of the seventeenth century, Madeleine de Scudéry. This work was a reversal of and “forceful response to” the so-called Ovidian model of epistolary fiction in which a “seduced and abandoned” woman complains in letter form about the infidelity of her male lover. In Scudéry’s text, however, men wrote long letters complaining about the women who did not reciprocate their love (DeJean, Tender Geographies 79).We obtained a copy of the Lettres amoureuses from the Women’s History microfilm collection, which was created in the 1970s (published 1983) in order to make available [End Page 1] an extensive array of texts and documents relating to women’s lives. We were surprised to see that all of the letters in the Lettres amoureuses were written by women—not men. Moreover, most of the letters were written by women to other women. No letters by men were included at all. Our copy of Lettres amoureuses contained letters and responses written between women, meant to show the excellence of women’s writing skill. The letters discussed and debated a wide variety of topics of interest to seventeenth-century French women; more strikingly, however, they reflected a close-knit homosocial world of women who openly expressed love, devotion, desire, and longing for each other’s company.Given the differences between our copy of Lettres amoureuses and the text described by DeJean, we wondered if we were looking at the same book. Was our collection the one to which DeJean referred? Yes and no. In another DeJean article about the Lettres amoureuses, we discovered that DeJean had used a particular copy of the text, one found in the holdings of Harvard’s Houghton Library. Upon first obtaining a microfilm copy of the Houghton volume, and later examining the physical book itself in Houghton’s rare books room, we saw that it (unlike our own copy) did indeed contain only letters by men who complain about their female beloveds. At this point, we thought we had discovered a second volume to Scudéry’s work: it seemed clear to us that the Lettres amoureuses had been halved at some point in the last several centuries and that we had a chance to reunite the volumes. There are very few (published) accounts of editorial misconduct, and those that do exist are almost exclusively focused on medicine-related areas. In the present article we detail a case of editorial misconduct in a rather underexplored domain, the social sciences. This case demonstrates that although legal systems provide different instruments of protection to avoid, compensate for, and punish misconduct on the part of journal editors, the social and economic power unbalance between authors and publishers suggests the importance of alternative solutions (...) before or instead of bringing a lawsuit to court. It puts forward strong arguments in favour of the need for effective regulatory bodies so as to achieve and maintain a culture of research integrity by all involved in the process. (shrink)

The phenomenon of cheating in higher education is of overwhelming importance in that the students engaging in these acts are unlikely to have the skills necessary for their future professional life. Despite its relevance, the empirical evaluation of cheating in universities has been almost exclusively focused on the US context. Little is known about cheating at the European level, let alone in Portugal. Even less is explored at the regional level. In this paper we present evidence on the perception of (...) cheating by Portuguese undergraduate students of economics/business degrees. We undertake a large-scale survey, involving 2675 students from all Portuguese mainland public universities. We found that copying-favourable environments are associated with a higher propensity to cheat. Moreover, in universities where ‘codes of honour’ exist, this propensity tends to be lower. Finally, the propensity to copy seems to be highly influenced by the cultural systems and socially-related factors of different regions. (shrink)

The aim of this article is to highlight the epistemic dimension present in the testimony of victims of sexual violence, which takes place through various mechanisms of epistemic injustice, whether testimonial or hermeneutic. In order to show the effects of the relation between epistemic wrongs and sexual violence, I focus on some cases of sexual injustice in Mexican society which support the contention that the systematic recurrence of sexual violence and epistemic injustices lead to a particular form of epistemic dehumanization.

Phenomenology and structuralism are commonly understood as two opposing and largely incompatible schools of thought. Indeed, if the former is thought of as the philosophy of subjectivity par excellence, and the latter as the tradition in which the “death of man” is declared, it seems difficult to challenge the antagony between them. On closer inspection, however, it becomes clear that this picture represents an oversimplification and turns out to be, to a great extent, fallacious. The aim of this paper is (...) to show that the philosophy of the early Husserl – notably as exposed in the Logical Investigations – ought to be fully considered as both part of the wide tradition of Transcendental philosophy as well as Structuralism. To this end, the paper mainly addresses Husserl’s notion of Wissenschaftslehre and the mereology developed in the Third logical investigation and, as a result, tries to show how Husserl’s position can be defined in terms of a “phenomenological structuralism” or a “structural phenomenology” or, as I propose, a “transcendental structuralism”. This particular roundtable falls at the end of a four-year networking project (COST Action IS1307 New Materialism: Networking European Scholarship on ‘How Matter Comes to Matter’) and reflects upon the genealogies of new materialism and how these flow into the individual working practices of participants. The texts below were contributed remotely via email by members of the group, following face-to-face meetings in Barcelona, Maribor, Warsaw, Liverpool, Paris and Utrecht. Authors were unaware of each other’s responses and in this way the (...) dialogue has unfolded a little like a game of Exquisite Corpse or Consequences, with questions acting like a trail of breadcrumbs to follow. Accordingly, the text is the product of a partially bounded experimental system ‘designed to give unknown answers to questions that the experimenters themselves are not yet able to clearly ask’ (Rheinberger 1997: 28). Thus, it both ruminates upon work to date and is intended to generate novel responses from authors and readers alike. (shrink)

_Abstract_: In this paper we carve out a _reformist_ agenda within the debate on the foundations of cognitive science, incorporating some important ideas from the 4E cognition literature into the computational-representational framework. We are deeply sympathetic to this reformist program since we think that, despite strong criticism of the concept of computation and the related notion of representation, computational models should still be at the core of the study of mind. At the same time, we recognize the need for a (...) liberalization of the computational and representational framework that can address deep dissatisfaction with the anti-biologism and radical internalism of classical cognitive science. However, reform is a difficult task, so in this article we focus on two open questions within the reformist agenda. The first concerns the possibility of combining mechanistic-computational and dynamical explanations. Tuttavia, riformare è un compito difficile. In questo articolo ci concentriamo su due problemi aperti nell’agenda riformista. A questionnaire relating to attitudes towards setting economic priorities within the health care system was sent to all 151 general practitioners in Northern Norway. Of these, 109 (72 per cent) responded. Ninety-six per cent of the respondents agreed or partly agreed that the setting of economic priorities within the health care system was necessary. Ninety-three per cent had experienced a conflict between their responsibility towards the individual patient and the requirement for them to manage the health budget. The responses suggest (...) that doctors act more in the interests of their patient than the interests of society. However, 68 per cent reported having refrained from giving the best treatment to patients because it was too expensive. As many as 60 per cent of the respondents wanted more public guidelines. Only 10 per cent wanted doctors to have more influence in difficult questions arising from setting priorities. (shrink)

In appearance, Husserl’s writings seem not to have had any influence on linguistic research, nor does what the German philosopher wrote about language seem to be worth a place in the history of linguistics. The purpose of the paper is exactly to contrast this view, by reassessing both the position and the role of Husserl’s early masterpiece — the Logical Investigations — within the history of linguistics. To this end, I will focus mainly on the third (On the theory of (...) wholes and parts) and fourth (The distinction between independent and non-independent meanings) Investigations, paying special attention to Husserl’s mereology and to the idea of a general pure grammar. The paper tries to situate the third and fourth Logical Investigation within the general context of late nineteenth-century and early twentieth-century linguistics and furthermore attempts to show the historical and theoretical importance of the Logical Investigations for the birth and the development of one of the most important linguistic “schools” of the twentieth century, namely structural linguistics. This paper explores the scholastic debate about antiperistasis, a mechanism in Aristotle’s dynamics described in the first book of Meteorology as an intensification of a quality caused by the action of the contrary one. After having distinguished this process from a homonymous, but totally different, principle concerning the dynamics of fluids that Aristotle describes in his Physics, I focus on the medieval reception of the former. Scholastic commentators oriented their exegetical effort in elaborating a consistent explanation of an apparently paradoxical (...) process like the intensification of a quality by the opposite one. From the fourteenth century onwards, most of the commentators resorted to the theory of the multiplication of species, according to which each entity acts through the emission of simulacra of the objects (species) that spread spherically in the medium. When these rays encounter an obstacle, such as a contrary quality, they are pushed back towards their source. The reflection of the species determined by the surrounding and opposite quality produces a concentration of the first one, which is therefore intensified. Another distinctive feature of the scholastic interpretation of Aristotle’s antiperistasis is the convergence between the discussions on inorganic and organic matter, physical and medical discourse. This convergence found its most significant expression in the adoption of the model described in the first book of Aristotle’s Meteorology to the biological context of Hippocrates’s Aphorisms I, 15. Following Galen’s exegesis of this passage, medieval commentators established a link between physics and medicine substantially extraneous to Aristotle’s theory. (shrink)
