This expansion of the theme outlined in Professor Easton's article of 1962 gives us fulllength accounts of the careers and ideas of four picturesque characters of the Ohio River Valley during the 19th century. The four had little in common except Hegel, and even him they did not really share, for they interpreted him differently and used him for different interests. The author is somewhat generous in calling them "Hegelians" and "followers" of Hegel, for like practically all those Americans who have been influenced by Hegel, they followed him at a safe distance and not very long. But this diversity makes Easton's account all the more fascinating. He portrays not only four characters but also the culture of Cincinati and its environment. J. B. Stallo is better known among American historians and philosophers than the other three, and deservedly so, for he was more philosophical. But he gains in stature here, noteworthy not only for his philosophy of nature but also as a prominent citizen, judge of a Superior Court, and political leader of a large German community. Stallo had two very different careers: the early Catholic student and teacher of Oken's philosophy of nature, mixed liberally with Schelling's similar system and with Hegel's Encyclopedia and his Phenomenology. Emerson was probably right in getting out of Stallo's General Principles an idea of "nature's rhythmic unfolding" rather than an idea of historical dialectic. Then came the later Stallo (after 1855), a convert from Catholicism and transcendentalism to empiricism, and a devoted follower of Ernst Mach. It is this later Stallo, author in 1881 of The Concepts and Theories oJ Modern Physics, who is better known, and who used the term "relativity" to indicate that physics deals not with things-in-themselves but with the data given to observers. Peter Kaufmann is an excellent representative of those pietists who, when they came to the open spaces and free manners of America, made serious attempts to give their religious "perfectionism" a practical social embodiment in utopian, communal economies. He became a teacher in the Rappite "Community of Equality and Social Harmony" and after a few years founded his own "Society of Germans at Teutonia." The members of this society agreed to devote their communal surplus to the education of orphans, the conversion of Indians, the spreading of the Gospel to "the four corners of the earth", and publishing a weekly Herald o] Better Times. After four years of this Society he moved northward to Canton, Ohio, where he settled down comfortably as a publisher and promoter of public education. His major publication, The Temple oJ Truth, incorporated some ideas on dialectic taken from Hegel. He continued his contacts with many utopian communities and urged his fellow citizens to help in making the United States of America "a saviour nation of the rest of mankind." Moncure Conway, a native of Virginia and graduate of Dickinson College, became an itinerant Methodist minister. But in 1853 the Harvard Divinity School made a Unitarian of him and an enthusiast for the higher criticism of Strauss and the transcendentalism of Hegel. In 1858 his wife introduced him to her home town, Cincinnati, and there he became BOOK REVIEWS 379 the minister of a very influential and liberal congregation. Orthodoxy holds that the difference between weakness of will and compulsion is a matter of the resistibility of an agent's effective motivation, which makes control-based views of agency especially well equipped to distinguish blameworthy weak-willed acts from non-blameworthy compulsive acts. I defend an alternative view that the difference between weakness and compulsion instead lies in the fact that agents would upon reflection give some conative weight to acting on their weak-willed desires for some aim other than to extinguish them, but (...) not to their compulsive desires. This view allows identificationist theorists of moral responsibility to explain why weak-willed actions, but not compulsive actions, are attributable to agents such that they can, in theory, be praised or blamed for them. After motivating and presenting the view in detail, I show how it has unique resources for explaining the ethics of managing one's compulsions. (shrink)

This article investigates the causal efficacy of social properties, which faces the following puzzle. First, for both intuitive and scientific reasons, it seems social properties have causal import. But, second, social properties are also characteristically extrinsic: to have some social property depends, in typical cases, on what one’s society is like around them. And, third, there is good reason to doubt that extrinsic properties make a genuine causal contribution. After elaborating on these three claims, I defend the following resolution to (...) the puzzle: social causation occurs at the level at which social properties are intrinsic. (shrink)

How do groups of people persist through time? Groups can change their members, locations, and structure. In this paper, I present puzzles of persistence applied to social groups. I first argue that four-dimensional theories better explain the context sensitivity of how groups persist. I then exploit two unique features of the social to argue for the stage theory of group persistence in particular. First, fusion and fission cases actually happen to social groups, and so cannot be marginalized as “pathological.” Second, (...) it is implausible that groups spatially coincide pre-fission. This means that theories that depend on pre-fission spatial coincidence, such as some endurance theories and the worm theory, cannot explain fission cases. All things considered, the stage theory offers the best explanation of how groups persist. (shrink)

Although emotions play a crucial role in understanding and encouraging sustainable behavior and decision-making, many open questions currently remain unanswered. In this review, we advance three broad areas of particular theoretical and applied importance that affective science and emotion researchers could benefit from engaging with: (1) “ sustainable emotions” or empirically testing the possibility of positive reinforcing feedback loops between anticipatory and experienced emotions following the adoption of sustainable behaviors, (2) “ non- Western emotions” or exploring the extent to which (...) people's understanding and experience of climate-relevant emotions differs across non-WEIRD populations, and (3) “ impactful emotions” or the need to carefully differentiate the conceptual and empirical role of emotions in encouraging the adoption of low-impact (e.g., recycling) versus high-impact (e.g., flying less) environmental behaviors. Much of the literature on impairment to self-governance focuses on cases in which a person either lacks the ability to protect herself from errant urges or cases in which a person lacks the capacity to initiate self-reflective agential processes. This has led to frameworks for thinking about self-governance designed with only the possibility of these sorts of impairments in mind. I challenge this orthodoxy using the case of melancholic depression to show that there is a third way that self-governance can (...) be undermined: an agent may fail to form the desire she most wants to act on. Taking the case of H. pylori and ulcer, Lynch et al., demonstrate how framing Koch’s postulate by an interventionist account clarifies the latter’s explanatory strength in proportionality with the weaknesses in specificity and stability due to the influence of background conditions. They suggest this approach as an efficient way to bypass the enigma of background conditions and microbial activity in the microbiome’s causal relations. However, it is the background conditions and the microbial interactions in the stomach that determine whether the (...) presence of H. pylori results in an ulcer. I agree with their analysis of the problems and challenges with the microbiome causal explanation but argue that their suggested framework is insufficient without a proper understanding and inclusion of the background conditions and microbial interactions. The reductionist approach fits well within the model of causal explanation that centers on one causal entity. However, such a model is weak in specificity and is too broad because it does not address the factors of microbial activity and background conditions. I argue that for a better causal explanation with explanatory strength in specificity, it is essential to include the background conditions and microbial interactions. Furthermore, I argue that this inclusion changes the framework of the causal relations from looking for the causal entity to looking at the causal process. (shrink)

Deep Self views of moral responsibility have been criticized for positing mysterious concepts, making nearly paradoxical claims about the ownership of one’s mental states, and promoting self-deceptive moral evasion. I defend Deep Self views from these pervasive forms of skepticism by arguing that some criticism is hasty and stems from epistemic injustice regarding testimonies of experiences of alienation, while other criticism targets contingent features of Deep Self views that ought to be abandoned. To aid in this project, I provide original (...) naturalistic analyses of “Self” and “internality” that replace the view’s metaphorical language with common-sensical concepts that make clear their usefulness. Western democracies experience profound conflicts that induce concerns about polarization and social cohesion. Yet although conflicts are a core feature of democracies, the forms, functions, and dynamics of democratic conflicts have rarely been subject of political theory. This paper aims at furthering our understanding of democratic conflicts. It analyzes the theory of conflict in Mouffe's agonistic pluralism, confronts it with sociological conflict theory, and presents concrete points of departure for a more comprehensive theory of democratic conflicts. The paper, thus, contributes (...) to two lines of research: (1) Regarding agonistic theories, the paper shows that agonistic pluralism fails to provide a convincing theory of conflict since it underestimates the mechanisms and effects of conflict dynamics (e.g. intergroup cohesion, intragroup conflict, domination, and escalation) and fails to account for the variety of conflict interactions. Proponents of agonistic pluralism should therefore invest more into clarifying their core concept. (2) For a general account of democratic conflicts, the paper proposes to pursue interdisciplinary research on the cognitive concepts shaping conflict interactions, the linked practices of conflict regulation, and the processual dynamics of conflicts. Schneider und Ives Radrizzani unter Mitwirkung von Hans Georg von Manz edierten kritischen Ausgabe des Werks von Johann Gottlieb Fichte in der Fichte-Gesamtausgabe der Bayerischen Akademie der Wissenschaften erschienen. Erscheinungsjahr ist 1999, Erscheinungsort wie zuvor Stuttgart-Bad Cannstatt bei Frommann-Holzboog. Der Band enthält Fichtes philosophische Leistung aus dem Jahr 1811. Primär zu nennen sind »Die Thatsachen des Bewussstseyns«, welche Fichte als Einleitung in die Wissenschaftslehre im Wintersemester 1810/11 gelesen (...) hat, die Wissenschaftslehre von 1811, welche Fichte vom 30. Januar bis 6. April vorgetragen hatte, sowie die populären »Vorlesungen über die Bestimmung des Gelehrten«, von denen anzunehmen ist, Fichte habe sie im Frühjahr 1811 gelesen. Fichte hat »Ueber die Bestimmung des Gelehrten« im Verlauf seiner Lehrtätigkeit dreimal im Rahmen seiner Vorlesungszyklen vorgetragen: ein erstes Mal zu Beginn seiner Lehrtätigkeit in Jena 1794/95. Hiervon sind fünf Vorlesungen in GA I,3 von 1966 wiedergegeben, eine weitere Gruppe um das Thema »Ueber den Unterschied des Geistes und des Buchstabens in der Philosophie« findet sich in GA II,3. Ein zweites Mal las Fichte »Ueber die Bestimmung des Gelehrten, und seine Erscheinungen im Gebiete der Freiheit« vom 25. Mai bis wohl Ende August 1805 in Erlangen. Dieser Zyklus umfaßt zehn Vorlesungen und findet sich in Band I,8 der Akademie-Ausgabe. Ein drittes Mal las Fichte »Ueber die Bestimmung des Gelehrten« wohl im Frühjahr/sommer 1811. Die genauen Daten sind nicht bekannt. Reinhard Lauth verweist im Vorwort zum Text auf ein längeres Schreiben des Studenten August Twesten, vom 28. Mai 1811, worin dieser berichtet, er höre bei Fichte »Reden über das Wesen des Gelehrten«, sowie auf die »Miszellen für die Neueste Weltkunde« vom 25. Mai 1811, wo es heißt: »Unsere Universität hat mit diesem Semester bedeutenden Zuwachs erhalten: man zählt jetzt beinahe vierhundert Studenten, grösstentheils Mediziner. Hufeland lieset über seine Makrobiotik, und Fichte über die Bestimmung des Gelehrten«. Beispiel für künstlerische Tätigkeiten pflegen für Fichte die der Dichter, der Maler, der Bildhauer zu sein, in den Vorlesungen über die Bestimmung des Gelehrten ist es ebenfalls die der Bildhauer. In den Vorlesungen von 1811 hingegen ist es der Musiker, welcher mit dem Denkkünstler verglichen wird: »so jemand in der Musik es zur Meisterschaft bringen will, so bedarf er dazu zu allererst der innern Erregbarkeit durch die Form des Uebersinnlichen, wodurch seine Kunst erst zur Kunst wird«. Nun verweist Reinhard Lauth darauf, daß Fichte vom 4. bis 30. August 1811 in Teplitz zur Badekur weilte, wo vom 4. August bis zum 18. September auch Ludwig van Beethoven sich aufhielt und möglicherweise Fichte musikalisch beeindruckte. Daß es zu einer persönlichen Begegnung gekommen sei, läßt sich jedoch dokumentarisch nicht nachweisen. Als Einführung in die Wissenschaftslehre las Fichte im Wintersemester 1810/11 »Ueber das Studium der Philosophie« und »Ueber die Thatsachen des Bewusstseyns«. Wie Reinhard Lauth rekonstruiert hat, hatte Fichte vom 22. bis 26. Oktober 1810 »Ueber das Studium der Philosophie« gelesen. Der Vorlesungstext ist nicht erhalten. Vom 29. Oktober 1810 bis 14. Januar 1811 trug Fichte erstmals »Ueber die Thatsachen des Bewusstseyns« vor. Diese Vorlesung übernahm, wie Reinhard Lauth im Vorwort erläutert, in der Spätphase Fichtes zusammen mit den Ausführungen über »Transzendentale Logik« die Rolle der Jenaer und Erlanger Vorlesungen über Logik und Metaphysik. Sie sollte auf die genetische Darstellung der Phänomene des Bewußtseins in der WL vorbereiten. Durch Fichte von Beginn an zum Druck bestimmt, erschien die Vorlesungsreihe erstmals nach seinem Tod 1817 in der Cottaischen Buchhandlung. 1845 veröffentlichte auch Immanuel Hermann Fichte in Band 2, S. 534–691 der von ihm herausgegebenen »sämmtlichen Werke« die »Thatsachen« von 1810/11 ein zweites Mal, allerdings nicht ohne unausgewiesene Veränderung ihrer Gliederung, da, wie er ausführte: »das Manuscript, wiewohl ursprünglich für den Druck bestimmt, dennoch die letzte Hand und Feile vom Verfasser nicht erhalten hatte«. Band II,12 der Akademie-Ausgabe enthält nun auch erstmals eine gedruckte Veröffentlichung der WL 1811. Immanuel Hermann Fichte hatte sie in seiner Ausgabe von des Vaters Werken nicht berücksichtigt, ja, nicht einmal erwähnt. Die von fünfundsiebzig Hörern besuchte Vorlesung hatte am 30. Januar begonnen und wurde nach 25 Vorlesungsstunden am 6. April 1811 abgeschlossen. Da sie sorgfältiger ausgeschrieben ist als die späteren und nicht zuletzt als die von 1810, vermutet Reinhard Lauth - gestützt auch auf das Zeugnis von Fichtes Hörer August Twesten –, daß Fichte an eine Veröffentlichung gedacht habe. Twesten, selbst kein schlechter Kopf, hatte 1810 bis 1812 in Berlin studiert. Die These einer geplanten Veröffentlichung wird unterstützt durch das Faktum, daß Fichte schon zum Abschluß seines Vortrags der Wissenschaftslehre 1810 für seine Hörer »Die Wissenschaftslehre in ihrem Umriss« publiziert hatte und daß auch die »Thatsachen des Bewusstseyns« von 1810/11 zum Druck bestimmt waren. Auch ist die WL 1811 sehr viel ausgefeilter und sorgsamer ausgearbeitet als die vorangehende WL 1810, die ein bloßes Vorlesungsskelett darstellt, teilweise aus bloßen Stichworten bestehend. Es gibt somit berechtigten Anlaß zu vermuten, daß Fichte wieder an eine breitere Öffentlichkeit dringen wollte. Zum Inhalt der Wissenschaftslehre von 1811 wäre zu sagen, daß sie von drei Grundthemen dominiert wird: von dem der »Freiheit«, dem der »Fünffachheit« möglicher Standpunkte und dem des »Schemas«. Obgleich „Freiheit“ schon gedankliches Zentrum des frühen Fichte ist, so kommt es doch in seinen ersten Veröffentlichungen so wenig zum Ausdruck, daß Fichte sich in seinem Brief an Reinhold vom 8. Januar 1800 aus einer Position der Defensive zu betonen veranlaßt sieht: »Mein System ist vom Anfange bis zum Ende nur eine Analyse des Begriffs der Freiheit«. Schon in der WL 1801/02 spielt dieser Begriff dann eine bedeutende Rolle. In der WL 1811 hingegen wird der Begriff der Freiheit zentral und zwar im Zusammenhang mit einem zweiten: dem Begriff des „Reflexes“. Es gilt: Die absolute Sichvollziehung der Freiheit bringt das Faktum des Wissens zum Vorschein. Das Wissen führt - - seinen Reflex bei sich: es ist ein sich als Denken verstehenden Denken. Erst so entsteht Bewußtsein. Denn Denken ohne Sich-Sehen wäre ein Wissen ohne Licht, ein Bewußtsein ohne Gehalt. Von „Reflex“ war auch schon in der WL 1801/02 im Zusammenhang mit der »intellektuellen Anschauung« die Rede: »Der Sprung durch das absolute, der Reflex, das für ich seyn desselben, ist in der Mitte«. Dagegen wird die »intellektuelle Anschauung« - noch zentral in der WL 1810 - in der WL 1811 überhaupt nicht mehr genannt. Sie wird verdrängt durch den „Reflex“. In der Wissenschaftslehre 1811 findet also eine gewissen »Intellektualisierung« statt: Es gibt nicht mehr einerseits Anschauung, andererseits Denken, wie in den frühen Fassungen der Wissenschaftslehre, sondern es ist der Verstand, der »Bilder« entwirft. Surveys different potential normative underpinnings of neurodiversity-related access claims, focusing both on their legitimacy and the adjudication of conflicts between them.

I examine the feminist epistemic values in science, presented by Helen Longino, and their role in framing microbiome causality in the study of inflammatory bowel disease (IBD). In particular, I show how values presented as feminist give an alternative view in scientific theories—focusing on ontological heterogeneity and mutuality of interactions rather than simplicity and one causal direction—when looking at relations between organisms and microorganisms, and between organisms (particularly humans) and their environment. I identify two approaches in microbiome study, an immunological (...) approach that looks at the microbiome pathogenicity and an ecological approach that studies the microbial activity and functions. I show the puzzles stemming from the traditional background beliefs of the immune self and germ theory in the study of IBD causality. Furthermore, I argue for the benefits of a shift to the ecological view of body-microbe interrelations. I conclude with the benefits and advantages of feminist values over traditional ones, both in creating new ways of understanding organisms’ physiology and immune systems and for future biomedical studies involving microbiome causality. In Almost Over: Aging, Dying, Dead, Frances Kamm seeks to make sense of people’s widely variant choices about which lives they would choose to continue living. She does this by defending the Prudential Prerogative, which, in analogy to the Moral Prerogative, holds that in a fairly wide range of conditions we are under no intrapersonal rational obligation to choose either to die or to live on. I argue against Kamm's case for the Prudential Prerogative in favor of Life Holism, the (...) view that you ought to live the life that would be best for you as an individual when each potential life is considered as a whole. I argue that the features of the Moral Prerogative that make it an attractive principle do not transfer to the Prudential Prerogative, and that Life Holism can better account for the perspectival and non-summative features of the normative phenomena Kamm wants to capture while retaining a tight connection between reasons and goodness. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 62.3 (2001) 543-564 [Access article in PDF] Eduard Gans and the Crisis of Hegelianism Warren Breckman In a 1834 report on the development of economic associationism in France, Johannes Schön detected an echo in Germany, the stirrings of a debate over the "modern Associationswesen." This discussion, he believed, would be crucial to the future of the "national economy." 1 Schön was an astute (...) observer, for the German discussion of associationism in the early 1830s was indeed but a faint echo of the French; and insofar as the idea of association was addressed by prominent social writers in those years, it was generally greeted with suspicion. This was the case, for instance, with the liberal thinker Robert von Mohl, whose influential 1835 tract on the social question criticized the notion of proletarian associationism. Conversely, by the early 1840s, association was on many tongues as a panacea for the social ills of the age. By 1840 Mohl himself had embraced the "Assoziationsprinzip" as an antidote to the atomized condition of modern social life. 2Among the relatively small number of German writers who did champion association in the 1830s, the claims for its significance were already grandiose. Moses Hess's Die heilige Geschichte der Menschheit (1837) and August von Cieszkowski's Prolegomena zur Historiosophie (1838) both linked social solidarity to millenarian expectations of a new age of humanity. Even before Hess or Cieszkowski, the first German book on Charles Fourier, by one S. R. Schneider, bore the title Das Problem der Zeit und dessen Lösung durch die Assoziation (1834), while another, by Fr. Hr. Tappehorn, was headed Die vollkommene Association, als Vermittlerin der Einheit des Vernunftstaates und der Lehre Jesu (1834). Yet the enormous importance assigned to associationism [End Page 543] in these titles exposes the ambiguity of the idea itself. For if, as one historian has claimed, "free association can be regarded in principle as the central organizational form of modern or industrial society," 3 there was no agreement on its nature. Should the right of association be understood as liberal or socialist, individualistic or collectivist? Is free association the core idea and mode of interaction of a pluralistic and competitive civil society, or is it the principle of unification that will overcome pluralism and competition? These fundamental questions were to preoccupy nineteenth- and early-twentieth-century debates in areas as diverse as revolutionary theory, labor union activism, and the regulation of business cartels. However, in the 1830s, under the pressure of the newly perceived social question, the stirrings of industrialization in Germany, and the revival of democratic politics in the July Revolution, these issues first appeared with a force that drew the attention of intellectuals.Perhaps no German intellectual of the 1830s so perfectly embodies the implicit tensions of the idea of associationism as the Hegelian philosopher of law, Eduard Gans (1797-1839). A student of the Heidelberg legal scholar A. J. Thibaut, Gans later came to be considered by Hegel as one of his most brilliant followers. Once Gans became a professor in the Juristic Faculty at the University of Berlin in the mid-1820s, it was he, not Hegel, who taught a generation of students the intricacies of Hegelian political philosophy. Gans died in 1839 at the age of 42, felled at a luncheon by a stroke while in mid-sentence, a victim, according to the Hallische Jahrbücher, of his own passion for discussion. This volubility is more than evident in his oeuvre, which includes a multi-volume study of inheritance law in world history, dozens of essays on legal philosophy and political and legal issues in his native Prussia and Europe, a popular memoir, and an edition of Hegel's Philosophy of Right. He was instrumental, moreover, in creating the Society for Scientific Critique in 1826, the Hegelian "counter-academy" established in response to the Royal Prussian Academy of Sciences' decision to exclude Hegel, and he was a founder of Die Jahrbücher für wissenschaftliche Kritik, the organization's journal and the main organ of Hegelianism. In 1860 he began publication in Cincinnati of The Dial, successor to the New England transcendentalist journal, and used its pages to promote religious liberalism, philosophical transcendentalism, and social reform. In 1863 he went to London where he became the head of the Ethical Society. Under the influence of Feuerbach and "left-Hegelians" he travelled widely in the (...) interests of "free thought." The most amazing of these four, however, is August Willich: an East Prussian soldier, ready to fight again to restore the 1848 revolution in Germany, discouraged by Marx from doing so, emigrating to Cincinnati to raise funds among the German 1848 refugees there and urging them to continue the lost cause in Germany, then wholeheartedly fighting for the Union Cause as a General in the Civil War, and finally joining the Populist revolt. As Easton points out, these four all illustrate the close relation between Hegel and the spirit of 1848. In addition to the stories of these men and their ideals, the volume contains a hundred pages of excellent specimens of their writngs, and copious references to obscure source-materials. The late Argentinian philosopher Francisco Romero, who died unexpectedly in 1962 after a brilliant career of more than thirty years of teaching and writing, was by common acclaim of his fellow-philosophers in Latin America their most distinguished philosopher in recent years. He received many honors and distinctions both at home and abroad, including the grand award of honor of the Argentinian Society of Writers. The most eminent philosophers in Latin American prepared a notable Festschri]t in honor of his 70th birthday, whose publication was unfortunately delayed and, therefore, could not be presented to him personally in his life time.1 Franci~o Romero was in fact as well as in acclaim the "Dean of Latin American Philosophy." It was high time that his central work Teorga del Hombre 2 should be translated. It is his magnum opus and represents the most comprehensive and systematic development of his philosophy. Romero was fortunate in having as his translator William F. Cooper who knew Romero personally, and was intimately acquainted with his philosophy. In addition, he had the unusual privilege of doing much of the translation in Romero's own library in Buenos Aires. In short, the translation is a labor of love and esteem.8 I myself had the privilege of coming to know Professor Romero in 1943, when as secretarygeneral of our Philosophical Association I was commissioned to make contact with our Latin American fellow-philosophers with a view to exploring the possibility of organizing InterAmerican congresses of philosophy and of forming an Inter-American society of philosophy, both of which projects, in due season, were accomplished. What is informed consent in medicine? For more than a generation, this deceptively simple question has vexed the law, discomfited medicine, and generated much inspired, provocative, and even contentious commentary.The question has also spawned several lawsuits. On one side stand patients who claim that, at the time of consent, they were ignorant of a particular risk; who state that, with more or different information, they would have chosen a different treatment; and who argue that, because of an adverse outcome, they (...) now deserve remuneration. On the other side, doctors uneasily watch the lengthening list of suits. Some, troubled by the law's expectations, have reacted by variously describing informed consent as a myth, a fiction, an unattainable goal, or a snare to entrap physicians. They point to the legal commentary condemning informed consent law as ill-defined, diffuse, and fraught with inconsistency, hazy at its best and virtually indecipherable to physicians at its worst: and lacking a fair standard to determine when a patient has sufficient knowledge to give effective consent. This paper investigates the conceptual possibility for, and the institutions relating to a positive right of private property to data. To do so, it distinguishes between structured data, as a designator, and datapoints, which are data embedded in the timeline. The reasoning being explored here is: the agents generating datapoints – he source of the data – have a right to private property to the datapoints they generate. The agents, then, can choose to retain the datapoints or to sell them (...) to data-users, aggregators, etc. Once these data-users render property of data themselves, they can further market it. There are, however, challenges to this view. One is the relative high cost of managing private property to data versus the relative low cost of misappropriating data and datapoints. In all cases, the problem concerns the proper meaning of subjunctive and counterfactual conditionals. For present purposes, a conditional sentence is one composed of at least two clauses, the central connective of which is, or is understood to be, "if... then." A subjunctive conditional is a conditional sentence in which the clause following the "if," the antecedent, may be true or false, but in which the truth or falsity of the entire sentence does not depend upon the truth or falsity (...) of its two clauses, the antecedent and consequent. John Martin Fischer’s Death, Immortality, and Meaning in Life puts forth a view that individual experiences could provide us with sources of endless fascination, motivation, and value if only we could live forever to continue to enjoy them. In this article I advocate for more caution about embracing this picture by pointing to three points of tension in Fischer's book. First, I argue that taking meaningfulness in life to be holistic is not compatible with the view immortal lives would be (...) recognizably humanlike. Next, I interrogate Fischer’s claim that that worries about boredom in immortal lives are predicated on the false view that our pursuits are compelling to us because we value them instrumentally, showing that he relies on a more controversial view of the value of our pursuits. Finally, I argue that Fischer’s naturalistic reinterpretation of the value of Near-Death experiences falls somewhat short of capturing their poignancy. Given Fischer’s seeming acknowledgment that what we get from an experience is sometimes ineffable, I argue that he ought to be less skeptical that a genuine Near-Death Experience would give the person experiencing it some (defeasible) evidence of the supernatural. While democratic societies experience intense conflicts about topics such as migration and climate action, there is no sound theory of democratic conflict. Agonistic theories emphasize the importance of conflict for democracy, but disregard conflict dynamics. Conflict sociology has focused on international or violent conflicts and neglects democratic conflicts. This article shows how this lacuna can be overcome. First, it develops an innovative, empirically informed processual approach to democratic conflicts. To this end, it draws on a broad range of scholarship from (...) sociology and social psychology, and integrates relevant insights into a processual framework for analyzing democratic conflicts that explores mechanisms of escalation, de-escalation, and reconciliation. Second, the article illustrates how this approach can ground a more elaborated democratic theory of conflict that concretizes how and when conflicts are beneficial to democracy, and explores the practices and institutions that democracies employ to cope with different conflict dynamics. Pandemic-related restrictions can be especially tragic for people whose lives are ending; it seems that the needs and desires of people who are dying should be given extra consideration. Given an additivist view of well-being, however, the last weeks of a person's life can only matter so much relative to the rest of the life they had. This article reflects on the end of my mother's life during the Covid-19 pandemic in order to make the case that the additive view (...) of well-being is part of a broader trend of dehumanizing emergency ethics. Based on Greek mythology, the multiple relationships between singing and weaving, »Flechttanz« (»weaving dance«) and the structural similarities of forms of notation and principles of control in music and weaving are explored. It is found that the relationship between music (as a temporal art) and weaving (as a spatial art) goes far beyond that which the metaphor of »sound tissues« points at. Rather, the relationship between art forms and media expresses mythical and spiritual levels. The transformation of tissues in music (...) or, respectively, music in tissues, makes the creative potential of transposition productive. (shrink)

Metaphysical grounding is often presented as a relation of directed dependence analogous to causation. The relationship between causation, properties, and laws of nature is hotly debated. I ask: what is the relationship between grounding, properties, and laws of metaphysics? I begin by considering the grounding analogue of Humean quidditism. Finding it implausible, I turn to the primitive-laws account of grounding, recently defended by Jonathan Schaffer and others. I argue this view is also unsatisfactory. I then present several possible dispositionalist-like accounts (...) and characterize the notion of a power to ground. I argue for three important conclusions: (i) each property essentially confers grounding powers; (ii) non-fundamental properties can be defined structurally in a particular sense, elucidating the claim that they are ‘nothing over and above’ the fundamental; and (iii) fundamental properties play a central role in grounding the grounding facts. Finally, it is significant that, combined with a causal powers-account of causal explanation, the door is open to a unified account of the metaphysics of causation and grounding: both flow from the natures of fundamental properties. In America today, public policy governing an increasing number of social issues is made through the judicial enforcement of constitutional rights. Cruzan raised the question whether policy regarding the withdrawal of medical care from incompetent patients is to be handled similarly. This essay argues that privacy-rights doctrine provides a poor basis for constructing public policy in this area. It suggests that the Court has been unable to articulate a convincing basis for privacy rights and that the basis the Court seems (...) to assume poorly fits many circumstances to which it is applied. The essay further contends that the Court has been unable to describe a persuasive method of analyzing the state interests that are at stake in privacy cases and to accommodate those interests in a reasonable way. The essay concludes that these are issues as to which policy is better formed through a political, not judicial, process.
