This chapter introduces values-based practice as a resource for working with individually diverse values in health and social care, and describes its origins in an on-going development through the resources of philosophy. The chapter is in two main sections. Section I, Values-Based Practice, builds on two brief interactive exercises to introduce and explain the key features of values-based practice. As a relatively recent addition to the range of resources for working with values in health and social care, values-based practice is (...) distinctive in focussing on the diversity of values comprising individual lived experience. Like evidence-based practice, values-based practice is a process-driven rather than an outcome-driven methodology. That is to say, rather than offering prescribed answers, both approaches offer processes that support decision-makers in coming to answers for themselves based on the particular circumstances presented by the situation in question. Although entirely complementary, the processes involved are of course different. Where evidence-based practice relies on meta-analyses of the results of high-quality clinical trials to inform a consensual model of decision-making, values-based practice builds on learnable clinical skills and other process elements to inform a dissensual model of decision-making rather than seeking to overcome value-conflicts in reaching consensus. Working within a premise of mutual respect for differences of values, and guided by three key principles linking values and evidence, values-based practice, as described in the chapter, supports dissensual decision-making, balanced according to the circumstances presented by the decision in question, within frameworks of locally-set frameworks of shared values. Section II, The Theory-Practice Dynamic, then outlines the theory-practice dynamic on which values-based practice is based. The origins of values-based practice in mid-twentieth century ordinary language philosophy of the Oxford School are outlined. As the chapter illustrates, although a limited area of analytic philosophy, many aspects of values-based practice are informed by ordinary language philosophy, ranging from its premise, through the training exercises and other process elements described in Section I, to its role in hybrid empirical studies supporting its model of service delivery. The development of values-based practice, furthermore, as section II goes on to describe, is ongoing, with key initiatives drawing not only on both analytic and Continental traditions of European philosophy, but also on non-European philosophies such as those of Africa and the Caribbean. The law of informed consent to medical treatment has recently been extensively overhauled in England. The 2015 Montgomery judgment has done away with the long-held position that the information to be disclosed by doctors when obtaining valid consent from patients should be determined on the basis of what a reasonable body of medical opinion agree ought to be disclosed in the circumstances. The UK Supreme Court concluded that the information that is material to a patient’s decision should instead be judged (...) by reference to a new two-limbed test founded on the notions of the ‘reasonable person’ and the ‘particular patient’. The rationale outlined in Montgomery for this new test of materiality, and academic comment on the ruling’s significance, has focused on the central ethical importance that the law now accords to respect for patient autonomy in the process of obtaining consent from patients. In this paper, we dispute the claim that the new test of materiality articulated in Montgomery equates with respect for autonomy being given primacy in re-shaping the development of the law in this area. We also defend this position, arguing that our revised interpretation of Montgomery’s significance does not equate with a failure by the courts to give due legal consideration to what is owed to patients as autonomous decision-makers in the consent process. Instead, Montgomery correctly implies that doctors are ethically obliged to attend to a number of relevant ethical considerations in framing decisions about consent to treatment, which include subtle interpretations of the values of autonomy and well-being. Doctors should give appropriate consideration to how these values are fleshed out and balanced in context in order to specify precisely what information ought to be disclosed to a patient as a requirement of obtaining consent, and as a core component of shared decision-making within medical encounters more generally. Although cognitive science started in the 1970s as a multidisciplinary field with the goal of becoming an interdisciplinary one over time, it is now dominated by cognitive psychology. The question becomes whether this matters, and if it does, what should cognitive scientists do about it? I propose that the multidisciplinarity and interdisciplinarity of cognitive science does matter because it leads to potential generation of new ideas, models, and methods. I offer a few recommendations for reforming cognitive science based, in part, (...) on the recent 41st annual meeting of the Cognitive Science Society that sought to reopen cognitive science to minority disciplines comprising cognitive science. The meanings in which the word "word" can be taken, the interpretations that the relevant meanings would necessitate of the "word-equals-world" thesis, and the extent to which Bhartṛhari can be said to be aware of or receptive to these interpretations are considered. The observation that more than one interpretation would have been acceptable to Bhartṛhari naturally leads to a discussion of his notion of truth, his perspectivism, and his understanding of the nature of philosophizing as an activity in which language (...) plays a basic role and epistemology and ontology are interdependent. The difference of Bhartṛhari's thinking from that of the Vedāntins of Śaṅkara's tradition is identified, and a brief comment on the history of vivarta and pariṇāma as philosophical terms is offered. Estimation of Distribution Algorithms, which employ probabilistic models to generate the next population, are new promising methods in the field of genetic and evolutionary algorithms. In the case of conventional Genetic and Evolutionary Algorithms are applied to Constraint Satisfaction Problems, it is well-known that the incorporation of the domain knowledge in the Constraint Satisfaction Problems is quite effective. In this paper, we constitute a memetic algorithm as a combination of the Estimation of Distribution Algorithm and a repair method. Purpose The internet has provided a gamut of benefits to consumers. The digital world, however, also provides space for various illegal or unethical consumer activities. Consumers may not always be fully aware of the unethical or illegal nature of some of the online activities that they engage in. This study aims to examine the questionable side of online consumer behaviour in an emerging market where internet penetration and smart phone accessibility is rapidly expanding. Using a third-person technique, this study attempts (...) to empirically capture the perceptions of Indian adults regarding the prevalence of various questionable online activities such as unauthorized downloading of digital content, spreading fake news/misinformation and fraudulent returns and to understand the extent to which these respondents believe that such actions are acceptable or illegal and unethical. Design/methodology/approach An online questionnaire was used to collect primary data from 212 consumers. Non-probability convenience and snowball sampling was used for the purpose. Findings Unauthorized watching or downloading of online content is reported to be the most prevalent among the various types of questionable behaviours examined. However, it is behaviours such as fraudulent returns and spreading misinformation through online channels which are considered to be the most unethical or illegal. Certain behaviours which may be deemed to be unethical and illegal nevertheless are seen as acceptable. Significant differences between demographics in the case of several of the unethical activities are reported. Research limitations/implications This study examines the grey and dark side of online behaviours among consumers in an emerging market and points to the need for action on several fronts to increase consumer awareness and sensitivity about the unethical or illegal nature of some of their online activities and the implications for multiple stakeholders. Based on the findings of this study, recommendations directed at consumers, marketers and policymakers are discussed. Originality/value Although the benefits of online communication channels have been extensively studied, their ability to facilitate certain unethical and even illegal activities is an under-researched area. The inclination to engage in these types of questionable behaviours may have been exacerbated by the restrictions imposed by the COVID-19 pandemic. This study highlights the importance of research on various grey consumer activities in the digital space and paves the way for further investigations by identifying online actions which are considered as most prevalent and/or unethical and illegal. The essays included in this book break new ground in the philosophy of reason by situating rationality - logical theory, ontology, first philosophy, philosophical hermeneutics - in a global context and tapping the global essence of natural reason. The essays formulate and resolve a fundamental problem in the human condition which has not been adequately dealt with: how discourse between two profoundly different worlds is possible. The formulation and solution of this vital human concern requires the clarification of the universal (...) logos in natural reason - the universal logic which is the common ground between worlds. The essays open the way to the emerging frontier of global reason in expanding the foundations of logic, ontology, hermeneutical practice and the discourse of philosophy in a global context. This calls for a paradigm shift in rational practice from egocentric reason to dialogical or global reason. (shrink)

As is the case with most pre‐modern philosophers of India, very little historical information is available about Bhartṛ‐hari. There are many interesting legends, some turned into extensive plays and poems, current about him. However, it is impossible to determine on their basis even whether there was only one philosopher called Bhartṛ‐hari. The appellation “philosopher” could unquestionably be applied to the author or authors of at least two Sanskrit works that are commonly ascribed to Bhartṛ‐hari.

The proteasome is a proteolytic complex that is known to degrade proteins marked by the attachment of ubiquitin. Recently, it has become apparent that the proteasome has non-proteolytic roles. Several studies have implicated the proteasome in the regulation of transcription. An important function in all scholarly and academic activities is the participation in the peer review system. One aspect of this peer review evaluation is service on committees judging candidates for important awards, prizes and fellowships. Some reflective observations on this process are made in which a number of factors determining the final choice are identified. It is pointed out that the decisions of such committees are based not only on relevant and objective criteria but are also influenced by a (...) number of irrelevant criteria; caution must be exercised to minimize the effect of the latter factors in order to maintain the highest ethical standards in the selection process. The ranking practices of awards committees, national academies and learned societies are briefly reviewed by pointing out some ethical pitfalls, anecdotal incidents, and the ways to avoid the tarnishing of the selection process. In this article, I examine the presence of Spinoza within Jean-Luc Nancy’s deconstruction of Christianity project. Although the debt Nancy owes to other philosophers such as Derrida and Heidegger has been recognized, less well known is his reliance on a Spinozist frame of reference throughout his writings on Christianity. Analyzing Nancy’s reading of key moments within the deconstruction of Christianity—the doctrines of creation ex nihilo and the incarnation—I explore how the coupling of transcendence and immanence in a Heideggerian ontological mode (...) can be enlightened by Spinoza’s philosophy. What takes shape is a profoundly embodied and affective relationality that I argue is the central resource Nancy wishes to expose at the heart of both Christianity and the secular West. (shrink)

This article aims to explore the philosophical approach to faith after deconstruction as manifested in the work of Jean-Luc Marion and Jean-Luc Nancy. By taking the saturated phenomenon as its focus, the analysis seeks to demonstrate that whilst Marion’s thinking proves to be an innovative re-imagining of the possibilities of phenomenology, its problematic recourse to a supplementary hermeneutic means that saturation can never be adequately applied to faith without simultaneously compromising the excessive intuition upon which it relies. The article then (...) explores whether Nancy’s suggestion that saturation be re-framed as faith can offer a viable alternative approach. Whilst the post-phenomenological modality within which Nancy operates means it may be problematic to retain the term ‘saturation’ in the exact sense Marion gives it, it is argued that Nancy’s version of saturated faith allows us to approach the binary divide between philosophy and theology from a different direction, resulting in a vision of faith that cuts across theism and atheism, destabilising them from within. Although Nancy’s thought in this area certainly does nothing to respond to persistent questions surrounding the place of institutionalized religion within secular modernity, it nevertheless serves as a powerful tool for thinking the possibilities of faith in the twenty-first century. Purpose Along with their immense benefit, online channels of communication and information-sharing also present a myriad set of challenges. The unauthorized downloading and sharing of copyrighted content such as music and movies is one such issue. This study aims to examine the factors related to the unauthorized downloading of content amongst young internet users in an emerging market. Design/methodology/approach An online structured questionnaire was used to collect primary data from 219 internet users between 17 and 24 years of age. The (...) partial least squares structural equation modelling was used to analyse the primary data. Findings The study findings report that monetary savings and social influence are the main drivers underlying the propensity to engage in unauthorized downloading amongst young adults. Perceptions of harm caused to artists and producers appear to be a deterrent. Though the respondents perceive the quality of content downloaded from unauthorized sites to be less than desirable, and there is also a higher perceived threat from viruses, this does not appear to deter unauthorized downloading behaviour amongst this segment of consumers. Research limitations/implications Combating unauthorized downloading and other forms of questionable online behaviours is a challenge for multiple stakeholders. Consumption of unauthorized digital content is examined in the context of online consumers whose demographic profile is often associated with this category of questionable behaviour. The study adds to the extant understanding of the aetiology of what are often considered online unethical and illegal behaviours and makes both practical and theoretical contributions to the subject field. Originality/value The study examines an important aspect of rapidly evolving internet technologies. The internet provides a veil to individuals engaging in unethical online activities. Despite the existence of laws declaring these activities to be illegal, instances of copyright violations of music and movies abound. The insights regarding the drivers and deterrents of a form of online unauthorized activity are used to present a set of strategies aimed at addressing such behaviours. (shrink)

In this Part 1, Material Conditions, I look at the changing material conditions of capital in the most labour-intensive manufacturing sectors in world production. I argue that these changes are leading to a waning in monopsony power. The paper introduces a universal logic that governs competition and reshapes the chain around the question of monopsony in the global supply chain. Put simply, deregulation produces high degrees of monopsony power, increasing the value share for the lead firm. This intensifies competition, exerts (...) downward pressure, and winnows the number of suppliers able to compete. The result is a supplier consolidation. Consolidation increases the surviving suppliers’ share of value, which expands access to finance, facilitates self-investment, and raises entry barriers. In Part 2, Subjective Agency, I look at how this leads to the emergence of market spatial inflexibility, which has given labour new openings by increasingly their disruptive power. (shrink)

In the energy–momentum density expressions for a relativistic perfect fluid with a bulk motion, one comes across a couple of pressure-dependent terms, which though well known, are to an extent, lacking in their conceptual basis and the ensuing physical interpretation. In the expression for the energy density, the rest mass density along with the kinetic energy density of the fluid constituents due to their random motion, which contributes to the pressure as well, are already included. However, in a fluid with (...) a bulk motion, there are, in addition, a couple of explicit, pressure-dependent terms in the energy–momentum density, whose presence to an extent, is shrouded in mystery, especially from a physical perspective. We show here that one such pressure-dependent term appearing in the energy density, represents the work done by the fluid pressure against the Lorentz contraction during transition from the rest frame of the fluid to another frame in which the fluid has a bulk motion. This applies equally to the electromagnetic energy density of electrically charged systems in motion and explains in a natural manner an apparently paradoxical result that the field energy of a charged capacitor system decreases with an increase in the system velocity. The momentum density includes another pressure-dependent term, that represents an energy flow across the system, due to the opposite signs of work being done by pressure on two opposite sides of the moving fluid. From Maxwell’s stress tensor we demonstrate that in the expression for electromagnetic momentum of an electric charged particle, it is the presence of a similar pressure term, arising from electrical self-repulsion forces in the charged sphere, that yields a natural solution for the notorious, more than a century old but thought by many as still unresolved, 4/3 problem in the electromagnetic mass. A range of emergent studies have explored the idea of a renewed human-centered society, termed “Society 5.0,” and the role therein, of servant leadership. In this regard, in East Asian cultural contexts, existing scholarship does not yet provide sufficient theoretical and practical guidance for intercultural contexts, such as when a predominantly individualistic UK business culture interacts with generally collectivist Japanese culture. This is an important gap because if Society 5.0 is to be realized then a more in-depth intercultural contextual appreciation (...) and understanding are required. The study examines the UK/Japan setting and adopts a social constructivist epistemology and case study approach to illustrate dimensions of servant leadership (DSLs) manifesting in the lived experience of a UK business leader in Japan. Connections to business leader training are drawn and the importance of intercultural dyad specificity is highlighted. The study is also important because recent widespread exposure of various global corporate scandals creates a view that many business leaders care only for themselves or organizational profits, especially in individualistic-orientated societies. This original case study research herein commences the process of developing detailed and focal studies on underpinning drivers and raises hope that ethical behavior, as comprised in the DSLs, can potentially manifest in an individualistic UK/collectivist Japan intercultural dyad context. The thesis of the paper is that the root cause of clash or reconciliation among civilizations is housed in the drama of consciousness! Two models of consciousness that highlight this drama are put forward here. First is Jean Gebser’s view, which asserts that the history of human civilization is nothing more than the manifestations of the development of consciousness. This development has taken place through five distinct stages: the archaic, magical, mythic, mental and integrative. Clash in civilizations is due to (...) the fixation on the first four stages whereas reconciliation is possible through the use of the integrative stage. The second is the Tantric Yoga view of consciousness in terms of the seven chakras or wheels of consciousness. These chakras are spread out in the body like seven colors of the rainbow—starting with the base of the spine to the genitals, the belly button, the heart, the throat, the forehead and ending in the crown of the head. Clash in civilizations is due to the fixation on the first three levels (chakras) of consciousness whereas reconciliation is possible through the use of the upper fourwheels of consciousness (chakras), which are focused at developing universal consciousness. Since religion and civilization are intimately connected and several of the prominent civilizational clashes have been due to the religious differences, religious consciousness will be taken as the paradigm of this paper.How can humanity move from clash towards reconciliation? Such a possibility is suggested by both Gebser and Tantric Yoga whose theories point towards the development of an integrative universal consciousness: an encompassing consciousness that will transcend as well as incorporate all limited religious consciousness perspectives in its fold! The views of Vivekananda, a scholar-monk of India, on “one religion/one spirituality” are of particular interest in this context. They indicate an approach, which might lead to a possible future solution thus paving a path towards one-world-spiritual-peaceful order! (shrink)

It is shown that the well-known disparity in classical electrodynamics between the power losses calculated from the radiation reaction and that from Larmor’s formula, is succinctly understood when a proper distinction is made between quantities expressed in terms of a “real time” and those expressed in terms of a retarded time. It is explicitly shown that an accelerated charge, taken to be a sphere of vanishingly small radius \, experiences at any time a self-force proportional to the acceleration it had (...) at a time \ earlier, while the rate of work done on the charge is obtained by a scalar product of the self-force with the instantaneous value of its velocity. Now if the retarded value of acceleration is expressed in terms of the present values of acceleration, then we get the rate of work done according to the radiation reaction equation, however if we instead express the present value of velocity in terms of its time-retarded value, then we get back the familiar Larmor’s radiation formula. From this simple relation between the two we show that they differ because Larmor’s formula, in contrast with the radiation reaction, is written not in terms of the real-time values of quantities specifying the charge motion but is instead expressed in terms of the time-retarded values. Moreover, it is explicitly shown that the difference in the two formulas for radiative power loss exactly matches the difference in the temporal rate of the change of energy in the self-fields between the retarded and real times. From this it becomes obvious that the ad hoc introduction of an acceleration-dependent energy term, usually referred to in the prevalent literature as Schott-term, in order to make the two formulas comply with each other, is redundant. K. Satchidananda Murty (1924-2011) was a vociferous writer and an iconoclast. This volume is a collection of his unpublished writings It presents Murty's unpublished keynote addresses, papers presented in seminars, and lectures which show his reflections and arguments in contrast to contemporary philosophers with regard to recent developments in philosophy. The writings reveal Murty's rejection of established theories by well-known eastern and western philosophers, as well as his arguments in their support, and present a new interpretation of their contention in (...) the contemporary idiom. Murty critically evaluates the contemporary arguments of Malcolm, James Ross, Alvin Plantinga, Charles Hawthorne, Jean-Paul Sartre, Anthony Flew, E.H. Madden, and P.H. Hare. An important contribution, the book assesses K. Satchidananda Murty's contribution to philosophy during sixty-one years of his engagement with active writing and teaching. It will be of great interest to scholars, teachers, and students of Indian philosophy, Hindu philosophy, Vedāntic philosophy, Advaita Vedānta, comparative philosophy, religious studies, and South Asian studies.
