Two decades of critique have sensitized historians and philosophers of science to the inadequacies of conventional dichotomies between theory and practice, thereby prompting the search for new ways of writing about science that are less beholden than the old ways to the epistemological mores of theoretical physics, and more faithful to the actual practices not only of physics but of all the natural sciences. The need for alternative descriptions seems particularly urgent if one is to understand the place of theory (...) (and, in parallel, the role of modeling) in contemporary molecular biology, a science where, until now, no division between theory and experiment has obtained, and where distinctions between representing and intervening, and more generally, between basic and applied science, are daily becoming more blurred. Indeed, the very division between theory and experiment threatens to slight the extensive and sophisticated theoretical analyses (and even modeling) on which experimental work in contemporary molecular biology so often depends. My aim in this paper is to find a way of talking about theoretical practices in biology that is directly rooted in the mix of conceptual and material work that biologists do. As an example of such theoretical practices, I choose for the focus of my analysis the development of a model for gene regulation out of the experimental work of Eric Davidson and his colleagues at Cal Tech. Consciousness is central to what we study in psychology and how we study it. This paper provides a description of the fundamental features and processes of consciousness. Based on Husserl's phenomenology, it begins with a description of Husserl's two most foundational, phenomenological claims: that we 'see' conscious acts, and that we 'see' that we 'see' them. Upon this footing, I explore two forms of skepticism, and I demonstrate their inherent problems. With skepticism described, I explicate an ontology of consciousness. First, (...) We argue that human rights are best conceived as norms arising from a fiduciary relationship that exists between states and the citizens and noncitizens subject to their power. These norms draw on a Kantian conception of moral personhood, protecting agents from instrumentalization and domination. They do not, however, exist in the abstract as timeless natural rights. Instead, they are correlates of the state's fiduciary duty to provide equal security under the rule of law, a duty that flows from the state's (...) institutional assumption of irresistible sovereign powers. A 1999–2000 national study of U.S. hospitals raised concerns about ethics consultation (EC) practices and catalyzed improvement efforts. To assess how practices have changed since 2000, we administered a 105-item survey to “best informants” in a stratified random sample of 600 U.S. general hospitals. This primary article details the methods for the entire study, then focuses on the 16 items from the prior study. Compared with 2000, the estimated number of case consultations performed annually rose by 94% to 68,000. The (...) median number of consults per hospital was unchanged at 3, but more than doubled for hospitals with 400+ beds. The level of education of EC practitioners was unchanged, while the percentage of hospitals formally evaluating their ECS decreased from 28.0% to 19.1%. The gap between large, teaching hospitals and small, nonteaching hospitals widened since the prior study. We suggest targeting future improvement efforts to hospitals where needs are not being met by current approaches to EC. (shrink)

To address the current lack of knowledge about clinical ethics fellowship programs (CEFPs), we surveyed all 36 programs in the U.S. and Canada. The number of CEFPs has grown exponentially over the last 40 years and far exceeds previous estimates. Commonalities among CEFPs include: 88.8% require an advanced degree or rarely accept applicants without one; 91.7% of programs do not restrict applicants to a specific background such as medicine or philosophy; and 88.9% of programs compensate fellows. CEFPs vary widely on (...) numbers of fellows trained in the last 3 years (1–111), numbers of consultations performed by each fellow (0–450), and salaries paid ($0-$95,000). Less than half of programs meet CEFP standards established by ABPD. Nonpaying programs and larger programs tend to have lower admission standards and lower expectations for fellows. We hope these data will help inform CEFP standards that promote quality and consistency without stifling desirable diversity and innovation. (shrink)

A Logical Form (LF) is a syntactic structure that is interpreted by the semantic component. For a particular structure to be a possible LF it has to be possible for syntax to generate it and for semantics to interpret it. The study of LF must therefore take into account both assumptions about syntax and about semantics, and since there is much disagreement in both areas, disagreements on LF have been plentiful. This makes the task of writing a survey article in (...) the field fairly difficult, a difficulty that is amplified by the amount of material that needs to be covered if the result is going to be in any way representative. My response to this difficulty is to limit my objectives. As a start, I will confine myself to issues relating to the syntactic positions of Quantificational Noun Phrases (QNPs) at LF and to various interpretive consequences. But even within these relatively narrow confines, I will not attempt anything close to a comprehensive survey. Instead my goal will be restricted to the presentation of one leading idea and to the discussion of some evidence that might bear on it.1 Much research on the nature of LF has consisted in attempts to account for the meaning of sentences containing QNPs. Context: Although ethics consultation is commonplace in United States (U.S.) hospitals, descriptive data about this health service are lacking. Objective: To describe the prevalence, practitioners, and processes of ethics consultation in U.S. hospitals. Design: A 56-item phone or questionnaire survey of the "best informant" within each hospital. Participants: Random sample of 600 U.S. general hospitals, stratified by bed size. Results: The response rate was 87.4%. Ethics consultation services (ECSs) were found in 81% of all general hospitals in the U.S., and (...) in 100% of hospitals with more than 400 beds. The median number of consults performed by ECSs in the year prior to survey was 3. Most individuals performing ethics consultation were physicians (34%), nurses (31%), social workers (11%), or chaplains (10%). Only 41% had formal supervised training in ethics consultation. Consultation practices varied widely both within and between ECSs. For example, 65% of ECSs always made recommendations, whereas 6% never did. These findings highlight a need to clarify standards for ethics consultation practices. (shrink)

This article addresses how bodily integrity has been mobilised in the context of genital cutting of male infants and the extent to which the concept is taken into account in legal decision-making in the United Kingdom. While bioethicists have debated whether interventions on children's bodies are more appropriately determined on the basis of hypothetical consent or in the child's best interest, it is clear that in law the relevant test is whether interventions are in the child's best interest. As the (...) issue of nonconsensual genital cutting of infants has become more contested, courts have been asked to adjudicate on the best interests of infants in situations where their caregivers disagree about procedures. Although this body of jurisprudence remains (surprisingly) small, in this article we argue that, while there are now discernible trends in such cases (e.g. deferring decision-making until the child has the requisite capacity to decide, engaging with certain human rights norms), too often judicial reasoning about a child's best interests remains largely empty of reasoned content, and in certain respects is regressing. Using the recent case of Re P to exemplify this logic, and drawing on our previous work advocating the value of embodied integrity, we argue that judges should adopt a more substantive framework of values in judging the child's corporeal and other interests in such cases. This would move best interests assessments beyond a mere formalistic exercise and lead to better reasoned legal judgements. (shrink)

Augustine is the person from the ancient world about whom we know most. He is the author of an intimate masterpiece, the Confessions, which continues to delight its many admirers. In it he writes about his infancy and his schooling in the classics in late Roman North Africa, his remarkable mother, his sexual sins ('Give me chastity, but not yet,' he famously prayed), his time in an outlawed heretical sect, his worldly career and friendships and his gradual return to God. It has inspired philosophers, Christian thinkers and monastic followers, but it still leaves readers wondering why exactly Augustine chose to compose a work like none before it. To design effective strategies to improve ethics consultation (EC) practices, it is important to understand the views of ethics practitioners. Previous U.S. studies of ethics practitioners have overrepresented the views of academic bioethicists. To help inform EC improvement efforts, we surveyed a random stratified sample of U.S. hospitals, examining ethics practitioners’ opinions on EC in general, on their own EC service, on strategies to improve EC, and on ASBH practice standards. Respondents across all categories of hospitals had very positive perceptions (...) of their own ethics consultation service (ECS) and few concerns about quality. Our findings suggest that the ethics-related needs of small, rural, non-teaching hospitals may be very different from those of academic medical centers, and therefore, different approaches to addressing ethical issues might be warranted. This paper will be concerned with the conjunctive interpretation of a family of disjunctive constructions. The relevant conjunctive interpretation, sometimes referred to as a “free choice effect,” (FC) is attested when a disjunctive sentence is embedded under an existential modal operator. I will provide evidence that the relevant generalization extends (with some caveats) to all constructions in which a disjunctive sentence appears under the scope of an existential quantifier, as well as to seemingly unrelated constructions in which conjunction appears under (...) the scope of negation and a universal quantifier. Many bioethicists have recently shifted from using “physician-assisted suicide” (PAS) to “medical aid-in-dying” (MAID) to refer to the act of voluntarily hastening one’s death with the assistance of a medical provider. This shift was made to obscure the practice’s connection to “suicide.” However, as the charge of “suicide” is fundamental to arguments against the practice, “MAID” can only be used by its proponents. The result has been the fragmentation of the bioethical debate. By highlighting the role of human agency—as opposed (...) to natural processes—in causing death, the term “PAS” makes it easier both to perceive potential risks to vulnerable populations and to affirm suicide as a potentially autonomous choice. As such, “PAS” thus more transparently expresses the arguments of both supporters and opponents of the “right to die,” while avoiding the unnecessary stigmatization of suicide and suicidal people which is a result of the usage of “MAID.”. Biogenetic research is capable of producing new life forms whose effects may alter the intricate balance of Nature in ways no one can foretell. "Superpigs" that grow larger than any pig before, cows that breed on an accelerated cycle, "new" vegetables, tomatoes that won't freeze - such new life forms can now be patented, making (...) them potential sources of enormous profits for biotech companies. And the record of government, academia, and industry is spotty at best at protecting the earth - yet these same forces are in control of the biogenetic future. Superpigs and Wondercorn is at once an eye-opening survey of a dramatic, sometimes frightening new technology and an impassioned plea to use these new tools in the long-term interests of the global ecosystem. The annual volume of ethics consultations (ECs) has been a topic of interest in the bioethics literature, in part because of its presumed relationship to quality. To better understand factors associated with EC volume, we used multiple linear regression to model the number of case consultations performed in the last year based on a national survey. We found that hospital bed size, academic affiliation, and urban/rural location were all associated with EC volume, but were not the primary drivers. Instead, these (...) variables affected EC volume through three other variables, all of which relate to ethics staffing: the percentage of case consultations performed by a single individual; whether the survey respondent’s main role at the hospital contained the word “ethics”; and especially, the number of full-time ethics program staff. We conclude that EC is an example of supply-sensitive care, and further research is needed to determine the optimal level of EC activity. (shrink)

In a recent paper, Martin Hackl and I identified a variety of circumstances where scalar implicatures, questions, definite descriptions, and sentences with the focus particle only are absent or unacceptable (Fox and Hackl 2006, henceforth F&H). We argued that the relevant effect is one of maximization failure (MF): an application of a maximization operator to a set that cannot have the required maximal member. We derived MF from our hypothesis that the set of degrees relevant for the semantics of degree (...) constructions is always dense (the Universal Density of Measurement, UDM). The goal of this paper is to present an apparent shortcoming of F&H and to argue that it is overcome once certain consequences of the proposal are shown to follow from more general properties of MF. Specifically, the apparent problem comes from evidence that the core generalizations argued for in F&H extend to areas for which an account in terms of density is unavailable. Nevertheless, I will argue that the account could still be right. Certain dense sets contain "too many alternatives" for there to be a maximal member, thus leading to MF. But, there are other sets that lead to the same predicament. My goal will be to characterize a general signature of MF in the hope that it could be used to determine the identity of alternatives in areas where their identity is not clear on independent grounds. Despite increasing scientific interest in self-generated thought-mental content largely independent of the immediate environment-there has yet to be any comprehensive synthesis of the subjective experience and neural correlates of affect in these forms of thinking. Here, we aim to develop an integrated affective neuroscience encompassing many forms of self-generated thought-normal and pathological, moderate and excessive, in waking and in sleep. In synthesizing existing literature on this topic, we reveal consistent findings pertaining to the prevalence, valence, and variability of emotion in (...) self-generated thought, and highlight how these factors might interact with self-generated thought to influence general well-being. We integrate these psychological findings with recent neuroimaging research, bringing attention to the neural correlates of affect in self-generated thought. We show that affect in self-generated thought is prevalent, positively biased, highly variable (both within and across individuals), and consistently recruits many brain areas implicated in emotional processing, including the orbitofrontal cortex, amygdala, insula, and medial prefrontal cortex. Many factors modulate these typical psychological and neural patterns, however; the emerging affective neuroscience of self-generated thought must endeavor to link brain function and subjective experience in both everyday self-generated thought as well as its dysfunctions in mental illness. The laboratory animal environment: room for concern.

In this paper we address an important issue in the development of an adequate formal theory of underspecified semantics. The tension between expressive power and computational tractability poses an acute problem for any such theory. Generating the full set of resolved scope readings from an underspecified representation produces a combinatorial explosion that undermines the efficiency of these representations. Moreover, Ebert (2005) shows that most current theories of underspecified semantic representation suffer from expressive incompleteness. In previous work we present an account (...) of underspecified scope representations within Property Theory with Curry Typing (PTCT), an intensional first-order theory for natural language semantics. We review this account, and we show that filters applied to the underspecified-scope terms of PTCT permit expressive completeness. While they do not solve the general complexity problem, they do significantly reduce the search space for computing the full set of resolved scope readings in non-worst cases. We explore the role of filters in achieving expressive completeness, and their relationship to the complexity involved in producing full interpretations from underspecified representations. Foundations: A Manual for the Beginning Student of Epistemology provides the tools required for understanding traditional western epistemology, and an appreciation for its development into contemporary theories without using the traditional historic approach. Instead of requiring students to struggle through a myriad of epistemological works, each with its own unique perspective, presuppositions, and terminology in hopes that they emerge with a general sense of the field, Claude L. Fox conveys the traditional concepts of western epistemology by identifying its key components (...) and providing the student with an understanding of them. Equipped with this knowledge, students will possess the basic tools for understanding any traditional work they may study. Dr. Fox accomplishes this by first describing epistemology and ontology, then explaining how they constitute the field of metaphysics. We present an argument for revising the theory of alternatives for Scalar Implicatures and for Association with Focus. We argue that in both cases the alternatives are determined in the same way, as a contextual restriction of the focus value of the sentence, which, in turn, is defined in structure-sensitive terms. We provide evidence that contextual restriction is subject to a constraint that prevents it from discriminating between alternatives when they stand in a particular logical relationship with the assertion or (...) the prejacent, a relationship that we refer to as symmetry. Due to this constraint on contextual restriction, discriminating between alternatives in cases of symmetry becomes the task of focus values. This conclusion is incompatible with standard type-theoretic definitions of focus values, motivating our structure-sensitive definition instead. (shrink)

The paper presents Property Theory with Curry Typing where the language of terms and well-formed formulæ are joined by a language of types. In addition to supporting fine-grained intensionality, the basic theory is essentially first-order, so that implementations using the theory can apply standard first-order theorem proving techniques. The paper sketches a system of tableau rules that implement the theory. Some extensions to the type theory are discussed, including type polymorphism, which provides a useful analysis of conjunctive terms. Born in 1515, Teresa of Avila survived the Spanish Inquisition and was a key reformer of the Carmelite Order. Her experience of ecstasy, which she intimately described in her writings, released her from her body and led to a complete realization of her consciousness, a state Julia Kristeva explores as it was expressed in Teresa's writing. Incorporating notes from her own psychoanalytic practice, as well as literary and philosophical references, Kristeva builds a fascinating dual diagnosis of contemporary society and the (...) individual psyche while sharing unprecedented insights into her own character. Almost all philosophers agree that a necessary condition on lying is that one says what one believes to be false. But, philosophers haven’t considered the possibility that the true requirement on lying concerns, rather, one’s degree-of-belief. Liars impose a risk on their audience. The greater the liar’s confidence that what she asserts is false, the greater the risk she’ll think she’s imposing on the dupe, and, therefore, the greater her blameworthiness. From this, I arrive at a dilemma: either the belief (...) requirement is wrong, or lying isn’t interesting. I suggest an alternative necessary condition for lying on a degree-of-belief framework. Building on previous works which argued that scalar implicatures can be computed in embedded positions, this paper proposes a constraint on exhaustification which restricts the conditions under which an exhaustivity operator can be licensed. We show that this economy condition allows us to derive a number of generalizations, such as, in particular, the ‘Implicature Focus Generalization’: scalar implicatures can be embedded under a downward-entailing operator only if the scalar term bears pitch accent. This exploration into spirituality and climate change employs the “four paths” of the creation spirituality tradition. The author recognizes those paths in the rich teachings of Pope Francis’s encyclical, Laudato Si' and applies them in considering the nobility of the scientist's vocation. Premodern thinkers often resisted any split between science and religion. The author then lays out the basic archetypes for recognizing the sacredness of creation, namely, the Cosmic Christ (Christianity); the Buddha Nature (Buddhism); the Image of God (Judaism); the (...) “Primordial Man” (Hinduism), as well as the premodern universal teaching of “God as Beauty.” He addresses the subject of evil which deserves serious attention in the face of the realities posed by climate change and the resistance to addressing them. In the concluding section, the author speaks of a new Order of the Sacred Earth that was launched in fall 2017 to gather persons of whatever spiritual tradition or none to devote themselves to preserving Mother Earth.
