In this paper I want to scrutinize one of the key ideas within modern Western aesthetics. Beauty is often considered to derive from a virtuous disinterested attitude towards nature. This kind of view has been advocated by thinkers such as Shaftesbury and Kant in the beginning of the so-called aesthetic turn in philosophy. The problem with this view is that it presupposes that nature exists by itself before human intervention in a kind of ideal pristine state. In this article I examine the role of attention as a defining aspect of photography and documentary film. When we pay attention to how the world looks it might sometimes surprise us. It might perhaps show us that we are too set in our ways of seeing and that the world can reveal things unknown, or as Stanley Cavell remarks: “how little we know about what our relation to reality is, our complicity in it”. This is, I claim, the task (...) in which the documentary image can guide us. In order to arrive at this conclusion I will start by examining how the documentary image adheres to knowledge, without falling back on a generic epistemological or representational framework. I start by discussing the final scene in Werner Herzog's film Echoes from a Somber Empire as an example of the aspect of documentary film, that aids us in refraining from projecting our preconceptions on the uncanny. This article examines the role of attention in encounters with the unknown. By examining this process of the unknown becoming known through a reading of some seminal works, notably by Merleau-Ponty, Wittgenstein, and Waldenfels, the article focuses on the existentially significant characteristics of the function of attention that are disclosed by the encounter with an alien environment. Thereby, attention is considered as being neither fully under the control of the subject, nor completely the result of the external conditioning of our (...) sense perception. Rather, attention will be seen to reside within a reciprocal field of tension between the familiar and the alien. This is related to Merleau-Ponty’s concept of ‘intentional arch’, describing the process of transition from the indeterminate to the determinate. Endorsing this account of attention will allow us to understand the limits of approaches to enacted and embodied cognition that still understand the process of getting to know something new, and even something alien, as a form of ‘domestication’. Recently, many philosophers have been interested in using locative relations to clarify and pursue debates in the metaphysics of material objects. Most begin with the relation of exact location. But what if we begin instead with the relation known as weak location – the relation an object x bears to any region not completely bereft of x? I explore some of the consequences of pursuing this route for issues including coincidence, extended simples, and endurance, with an eye to evaluating the (...) prospects for taking weak location as our fundamental locative relation. The question "What can justify criminal punishment ?" becomes especially insistent at times, like our own, of penal crisis, when serious doubts are raised not only about the justice or efficacy of particular modes of punishment, but about the very legitimacy of the whole penal system. Recent theorizing about punishment offers a variety of answers to that question-answers that try to make plausible sense of the idea that punishment is justified as being deserved for past crimes; answers that try to (...) identify some beneficial consequences in terms of which punishment might be justified; as well as abolitionist answers telling us that we should seek to abolish, rather than to justify, criminal punishment. This book begins with a critical survey of recent trends in penal theory, but goes on to develop an original account (based on Duff's earlier Trials and Punishments) of criminal punishment as a mode of moral communication, aimed at inducing repentance, reform, and reconciliation through reparation-an account that undercuts the traditional controversies between consequentialist and retributivist penal theories, and that shows how abolitionist concerns can properly be met by a system of communicative punishments. In developing this account, Duff articulates the "liberal communitarian" conception of political society (and of the role of the criminal law) on which it depends; he discusses the meaning and role of different modes of punishment, showing how they can constitute appropriate modes of moral communication between political community and its citizens; and he identifies the essential preconditions for the justice of punishment as thus conceived-preconditions whose non-satisfaction makes our own system of criminal punishment morally problematic. Punishment, Communication, and Community offers no easy answers, but provides a rich and ambitious ideal of what criminal punishment could be-an ideal of what criminal punishment cold be-and ideal that challenges existing penal theories as well as our existing penal theories as well as our existing penal practices. I argue that any broadly dispositional analysis of probability will either fail to give an adequate explication of probability, or else will fail to provide an explication that can be gainfully employed elsewhere (for instance, in empirical science or in the regulation of credence). The diversity and number of arguments suggests that there is little prospect of any successful analysis along these lines.

I sketch a new constraint on chance, which connects chance ascriptions closely with ascriptions of ability, and more specifically with 'CAN'-claims. This connection between chance and ability has some claim to be a platitude; moreover, it exposes the debate over deterministic chance to the extensive literature on (in)compatibilism about free will. The upshot is that a prima facie case for the tenability of deterministic chance can be made. But the main thrust of the paper is to draw attention to the (...) connection between the truth conditions of sentences involving 'CAN' and 'CHANCE', and argue for the context sensitivity of each term. Awareness of this context sensitivity has consequences for the evaluation of particular philosophical arguments for (in) compatibilism when they are presented in particular contexts. (shrink)

The tradition of Western philosophy—in particular, the ideals of reason and objectivity—has come down to us from white males, nearly all of whom are demonstrably sexist, even misogynist. What are the implications of this fact for contemporary feminists working within this tradition? The concept of randomness has been unjustly neglected in recent philosophical literature, and when philosophers have thought about it, they have usually acquiesced in views about the concept that are fundamentally flawed. After indicating the ways in which these accounts are flawed, I propose that randomness is to be understood as a special case of the epistemic concept of the unpredictability of a process. I argue for a deflationary answer to the question, “What is it to be a woman?” Prior attempts by feminist theorists to provide a metaphysical account of what all and only women have in common have all failed for the same reason: there is nothing women have in common beyond being women. Although the social kinds man and woman are primitive, their existence can be explained. I say that human sex difference is the material ground of systems of gender; gender (...) systems serve to enable male control of female reproductive capacities. This explains the fact that most women are female, but it does not entail that all women are female or that all females are women. To clarify my position, I draw an analogy between the kind woman and the kind parent. While it is difficult to come up with necessary and sufficient conditions for being a parent, it is clear that the social institution or practice of parenting has its material ground in the biological facts about human reproduction together with facts about infantile dependency. Saying this does not entail that all and only biological progenitors are parents. (shrink)

I want to discuss philosophically, to glance at the logic of, the parts of this expression “the justification of punishment” and then to draw from this discussion one or two morals for discussions of the justification of punishment. This paper is based on one originally given to the Scots Philosophy Club at its Aberdeen meeting in 1953, as the third part of a symposium on The Justification of Punishment.

AFTER DISTINGUISHING PARAPSYCHOLOGY FAVORABLY FROM VARIOUS PRESENTLY POPULAR YET WHOLLY DISREPUTABLE EXERCISES IN FRAUD AND SELF-DECEPTION, THIS PAPER CONSIDERS THREE ASPECTS IN WHICH IT DIFFERS FROM ALL ESTABLISHED HIGH-STATUS SCIENCES. The paper begins with the plausible view that criminal responsibility should track moral responsibility, and explains its plausibility. A necessary distinction is then drawn between liability and answerability as two dimensions of responsibility, and is shown to underpin the distinction in criminal law between offences and defences. This enables us to distinguish strict liability from strict answerability, and to see that whilst strict criminal liability seems inconsistent with the principle that criminal responsibility should track moral responsibility, strict criminal answerability is (...) not. We must ask, therefore, whether, when and why strict criminal responsibility is unacceptable. (shrink)

Locke's contribution to the discussion was fourfold: First , he saw the importance of the problem; Second , he realized that the puzzle cases, the “strange suppositions,” were relevant; Third , he maintained “same” had a different meaning when applied to “person” from its meaning in other contexts; and, Fourth , he offered his much criticized solution of the problem.

Dispositional essentialists are typically committed to two claims: that properties are individuated by their causal role (‘causal structuralism’), and that natural necessity is to be explained by appeal to these causal roles (‘dispositional actualism’). I argue that these two claims cannot be simultaneously maintained; and that the correct response is to deny dispositional actualism. Causal structuralism remains an attractive position, but doesn’t in fact provide much support for dispositional essentialism.

Encounters with art can change us in ways both big and small. This paper focuses on one of the more dramatic cases. I argue that works of art can inspire what L. A. Paul calls transformations, classic examples of which include getting married, having a child, and undergoing a religious conversion. Two features distinguish transformations from other changes we undergo. First, they involve the discovery of something new. Second, they result in a change in our core preferences. These two features (...) make transformations hard to motivate. I argue, however, that art can help on both fronts. First, works of art can guide our attempt to imagine unfamiliar ways of living. Second, they can attract us to values we currently reject. I conclude by observing that what makes art powerful also makes it dangerous. Transformations are not always for the good, and art's ability to inspire them can be put to immoral ends. (shrink)

Gödel argued that intuition has an important role to play in mathematical epistemology, and despite the infamy of his own position, this opinion still has much to recommend it. Intuitions and folk platitudes play a central role in philosophical enquiry too, and have recently been elevated to a central position in one project for understanding philosophical methodology: the so-called ‘Canberra Plan’. This philosophical role for intuitions suggests an analogous epistemology for some fundamental parts of mathematics, which casts a number of (...) themes in recent philosophy of mathematics (concerning a priority and fictionalism, for example) in revealing new light. It is widely assumed that ‘ consciousness ’ is multiply ambiguous within the consciousness literature. Some alleged senses of the term are access consciousness, phenomenal consciousness, state consciousness, creature consciousness, introspective consciousness, self consciousness, to name a few. In the paper I argue for two points. First, there are few if any good reasons for thinking that such alleged senses are genuine: ‘ consciousness ’ is best viewed as univocal within the literature. The second point is that researchers would do (...) best to avoid the semantics of ‘ consciousness ’, since resorting to “semantic ascent” typically serves no clear purpose in the case of consciousness, and confuses matters more than anything else. This article argues that whether and how a firm chooses to adopt Corporate Social Responsibility (CSR) initiatives is conditional in part upon the domestic political institutional structures present in its home market. It demonstrates that economic globalization has increased the pressure applied to companies to develop CSR policies that might help overcome specific governance gaps associated with the globalization phenomenon. Drawing upon an examination of domestic institutions and overall political structure, it argues that the political conditions and expectations present in (...) a company’s home market will condition whether a firm might pursue CSR activity. For home markets, it is posited that perceived electoral salience will be filtered through government type and ideology, and state/societal structures will influence if and how firms will use CSR. Specific arguments are developed from these categorizations. The article concludes with a discussion of how researchers might further explore links between CSR, domestic political structures, and corporate political activity. (shrink)

Russell famously argued that causation should be dispensed with. He gave two explicit arguments for this conclusion, both of which can be defused if we loosen the ties between causation and determinism. I show that we can define a concept of causation which meets Russell’s conditions but does not reduce to triviality. Unfortunately, a further serious problem is implicit beneath the details of Russell’s arguments, which I call the causal exclusion problem. Meeting this problem involves deploying a minimalist pragmatic account (...) of the nature and function of modal language. Russell’s scruples about causation can be accommodated, even as we partially legitimise the pervasive causal explanations in folk and scientific practice. (shrink)

Utterances within the context of telling fictional tales that appear to be assertions are nevertheless not to be taken at face value. The present paper attempts to explain exactly what such 'pseudo-assertions' are, and how they behave. Many pseudo-assertions can take on multiple roles, both within fictions and in what I call 'participatory criticism' of a fiction, especially when they occur discourse-initially. This fact, taken together with problems for replacement accounts of pseudo-assertion based on the implicit prefixing of an 'in (...) the fiction' operator, suggest that pseudo-assertion is best understood as a kind of make-believe. This proposal is elaborated and defended, and some applications to fictionalism are tentatively explored. (shrink)

First published in 1961, this book considers Hume’s request to be judged solely by the acknowledged works of his maturity. It focuses on Hume’s first _Inquiry_ in its own right as a separate book to the likes of his other works, such as the _Treatise _and the _Dialogues, _which are here only used as supplementary evidence when necessary. This approach brings out, as Hume himself quite explicitly wished to do, the important bearing of his more technical philosophy on matters of (...) religion and of world-outlook generally: "Be a philosopher; but amidst all your philosophy, be still a man.". ABSTRACT One striking feature of On the Genealogy of Morals is how it is written. Nietzsche employs a literary style that provokes his readers' emotions. In Beyond Selflessness, Christopher Janaway argues that such a literary approach is integral to Nietzsche's philosophical goals. Feeling the emotions Nietzsche's style arouses is necessary for understanding the views he defends. I argue that Janaway's position is mistaken. The evidence at our disposal fails to establish that emotion is ever necessary for cognition. However, I maintain (...) that we do have good evidence for a slightly weaker claim. The emotionally sensitive person is epistemically better off than the cold and dispassionate person. There are some truths he or she will be more likely to believe and will have better reasons for believing. I conclude that Janaway is right to defend the philosophical importance of Nietzsche's literary writing style. His error is simply that he overstates the case. (shrink)

Papineau’s argument in "Thinking About Consciousness" for the vagueness or indeterminacy of phenomenal concepts is discussed. Several problems with his argument are brought out, and it is concluded that his argument fails to establish his desired conclusion.

Following the pattern set by the early German Romantics, Kierkegaard conveys many of his insights through literature rather than academic prose. What makes him a valuable member of this tradition is the theory he develops to support it, his so-called “theory of indirect communication.” The most exciting aspect of this theory concerns the alleged importance of indirect communication: Kierkegaard claims that there are some projects only it can accomplish. This paper provides a critical account of two arguments Kierkegaard offers in (...) defense of this claim. The first argument is that he needs to use indirect communication in order to discourage people from losing themselves in the “crowd”. The second argument is that he needs to use it in order to help people out of a “monstrous illusion”. It is shown that while both arguments justify Kierkegaard’s decision to use indirect communication, neither one supports the original claim about its indispensability. (shrink)

In ‘Location and Perdurance’ (2010), I argued that there are no compelling mereological or sortal grounds requiring the perdurantist to distinguish the molecule Abel from the atom Abel in Gilmore’s original case (2007). The remaining issue Gilmore originally raised concerned the ‘mass history’ of Adam and Abel, the distribution of ‘their’ mass over spacetime. My response to this issue was to admit that mass histories needed to be relativised to a way of partitioning the location of Adam/Abel, but that did (...) not amount to relativising any fundamental natural intrinsic properties—the latter are all had unrelativised, and (so most perdurantists would say). Because we need to know how clearly about our social thinking and how to resist the allure of self-deception, everyone skeptical about or confused by the findings of the social sciences will appreciate Antony Flew's crisp analysis of the methodological flaws and systematic misunderstandings corrupting their content and application. Thinking About Social Thinking seeks to establish what can and cannot be learned from such studies, indicating where good work has been ignored, or much-needed work has yet to be done. (...) Flew's clear and incisive arguments are illustrated with abundant examples and references -- many entertaining, others surprising. A previously unrecognised argument against deterministic chance is introduced. The argument rests on the twin ideas that determined outcomes are settled, while chancy outcomes are unsettled, thus making cases of determined but chancy outcomes impossible. Closer attention to tacit assumptions about settledness makes available some principled lines of resistance to the argument for compatibilists about chance and determinism. Yet the costs of maintaining compatibilism may be higher with respect to this argument than with respect to existing incompatibilist arguments.

It is not easy being green, but it does beg the question: Does being green pay off on the bottom-line? Unfortunately, that question of becoming ISO 14001 to reap financial benefit remains widely unanswered. In particular, corporate practice is interested in how environmental management impacts firms’ finance through top-line impact, bottom-line impact, or both—as this paves the way for an investment of environmental management. As current findings are mixed, our study tracks financial performance of publicly traded US firms between 1996 (...) and 2005 to test whether ISO 14001 leads to improved financial performance. Employing a rigorous event-study approach, we compare certified firms to different control groups based on several matching criteria that include industry, size, and/or ROA. In the short run, ISO 14001 certification makes only a minor impact on the bottom-line, according to our results. However, these same results show a significant financial improvement over the long haul with ISO 14001 certification. Additionally, this long-term improvement also makes a significant improvement in top-line performance. Thus, we conclude that environmental management pays off along both dimensions. (shrink)

I analyze and criticize Naomi Scheman's argument for the claim that psychological individualism-the thesis that psychological states are entities or particulars over which psychological theories may quantify-has no legitimate philosophical backing and is instead an element of patriarchal ideology. I conclude that Scheman's argument is flawed and that her thesis is false. Psychological individualism is perfectly compatible with and may even be required by feminist political theory.
