“Public health legal preparedness” is a term born in the ferment, beginning in the late 1990s, that has led to unprecedented recognition of the essential role law plays in public health and, even more recently, in protecting the public from terrorism and other potentially catastrophic health threats.The initial articulation of public health has not kept pace with rapid evolution in the concept and in practical development of public health preparedness itself. This poses the risk that legal preparedness may fall behind (...) construction of general readiness in the public health system—and may, in fact, undercut achievement of comprehensive public health preparedness for massive threats to health in both the United States and world-wide. The potential for biased responses that occur when researchers interact with their study participants has long been of interest to both academicians and practitioners. Given the sensitive nature of the field, researcher interaction biases are of particular concern for business ethics researchers regardless of their preference for survey, experimental, or qualitative methodology. Whereas some ethics researchers may inadvertently bias data by misrecording or misinterpreting responses, other biases may occur when study participants' responses are systematically influenced by the mere introduction of (...) researchers into the participants' environment. Although substantial empirical research has been conducted on the general topic of researcher interaction biases, none has focused specifically on business ethics research. In order to remedy this lack of empirical substantiation in the field, we review the related literature on researcher interaction biases, present an empirical example of how such biases can influence research results in an experiment assessing reactions to insurance fraud, and discuss the implications for business ethics research. Following the collapse of the communist states it was assumed that Marxist philosophy had collapsed with it. In _Introduction to Non-Marxism_, François Laruelle aims to recover Marxism along with its failure by asking the question “What is to be done with Marxism itself?” To answer, Laruelle resists the temptation to make Marxism more palatable after the death of metaphysics by transforming Marxism into a mere social science or by simply embracing with evangelical fervor the idea of communism. Instead Laruelle proposes (...) a heretical science of Marxism that will investigate Marxism in both its failure and power so as to fashion new theoretical tools. In the course of engaging with the material of Marxism, Laruelle takes on the philosophy of Marx along with important philosophers who have extended that philosophy including Althusser, Balibar, Negri as well as the attempt at a phenomenological Marxism found in the work of Michel Henry. Through this engagement Laruelle develops with great precision the history and function of his concept of determination-in-the-last-instance. In the midst of the assumed failure of Marxism and the defections and resentment that followed, Laruelle’s non-Marxism responds with the bold declaration: “Do not give up on theory!”. (shrink)

Most theories of learning would predict a gradual acquisition and refinement of skills as learning progresses, and while some highlight exponential growth, this fails to explain why natural cognitive development typically progresses in stages. Models that do span multiple developmental stages typically have parameters to “switch” between stages. We argue that by taking an embodied view, the interaction between learning mechanisms, the resulting behavior of the agent, and the opportunities for learning that the environment provides can account for the stage-wise (...) development of cognitive abilities. We summarize work relevant to this hypothesis and suggest two simple mechanisms that account for some developmental transitions: neural readiness focuses on changes in the neural substrate resulting from ongoing learning, and perceptual readiness focuses on the perceptual requirements for learning new tasks. Previous work has demonstrated these mechanisms in replications of a wide variety of infant language experiments, spanning multiple developmental stages. Here we piece this work together as a single model of ongoing learning with no parameter changes at all. The model, an instance of the Epigenetic Robotics Architecture embodied on the iCub humanoid robot, exhibits ongoing multi-stage development while learning pre-linguistic and then basic language skills. Giulio Tononi (2008) has offered his integrated information theory of consciousness (IITC) as a “provisional manifesto.” I critically examine how the approach fares. I point out some (relatively) internal concerns with the theory and then more broadly philosophical ones; finally I assess the prospects for IITC as a fundamental theory of consciousness. I argue that the IITC’s scientific promise does carry over to a significant extent to broader philosophical theorizing about qualia and consciousness, though not as directly as Tononi suggests, (...) since the account is much more focused on the qualitative character of experience rather than on consciousness itself. I propose understanding it as “integrated information theory of qualia” (IITQ), rather than of consciousness. (shrink)

Insurance claim fraud costs insurance companies, policymakers, and taxpayers billions of dollars every year and has been described as the second largest white collar crime. The most common insurance fraud activity and one that contributes a significant portion of dollar losses is the practice of padding claim amounts in the event of a loss. One of the largest issues insurance companies face is that policyholders often do not perceive insurance claim padding as an unethical behavior. However, very little research has (...) examined the factors that contribute to such perceptions. Considering how consumers often attempt to justify fraudulent behavior from a fairness perspective, the present work examines how the amount of the deductible in an insurance claim situation can influence feelings of fairness and ethicality. The results of an experimental study show that higher deductible amounts result in stronger perceptions that insurance claim padding is fair to the insurance company, weaker perceptions that the behavior is unethical, and higher proposed claim award amounts. The study also shows, however, that the deductible amount effects are attenuated for consumers who display higher ethical standards as reflected by their scores on the consumer ethics scale. Implications are discussed with respect to the insurance industry, deviant consumer behavior, and general business ethics theory. (shrink)

In this paper I present two arguments against the thesis that we experience qualia. I argue that if we experienced qualia then these qualia would have to be essentially vague entities. And I then offer two arguments, one a reworking of Gareth Evans' argument against the possibility of vague objects, the other a reworking of the Sorites argument, to show that no such essentially vague entities can exist. I consider various objections but argue that ultimately they all fail. In particular (...) I claim that the stock responses to the Sorites argument fail against my reworking of the argument because they require us to make a distinction between a determinate reality and how that reality appears to us, whereas in the case of qualia we can make no such distinction. Jonathan Berg’s insightful and lucid book Direct Belief develops a pragmatic account of our intuitions about Frege-cases. More precisely Berg argues that our practice of belief-reporting normally exhibits certain regularities. He argues that utterances of belief reports typically conversationally implicate that the reports adhere to these regularities. And he uses these implicatures to explain our intuitions about Frege-cases. I explore and unpack Berg’s pragmatic account, considering and offering responses to three natural worries that might be raised. In particular, I respond (...) to the objection that the regularities Berg invokes cannot generate the conversational implicatures he claims. I respond to the objection that the regularities Berg invokes do not, in fact, obtain. And I respond to the worry that Berg cannot explain how these regularities might arise in the first place. The twentieth century proved this true as law contributed to each of the century's ten great public health achievements: vaccination, healthier mothers and babies, family planning, safer and healthier foods, fluoridation of drinking water, the control of infectious diseases, the decline in death from heart disease and stroke, recognition of tobacco use as a health hazard, motor vehicle safety, and safer workplaces.The readers of this journal can give examples of the relevant types of (...) laws with ease: Jacobson v. Let “explanationism” be the view that ontology is fundamentally an explanatory enterprise. What it does is “on a par” with natural science, as Quine put it. Carnap appears to offer a “lighter weight” alternative in “Empiricism, Semantics, and Ontology”: ontology is concerned with semantics and language choice. This paper argues that Carnap’s account of the internal/external distinction is of less use than Carnap suggests for diagnosis of disputes in ontology. But he largely agrees with Quine about explanationism. I propose that (...) explanationism is an attractive metametaphysical position between “heavy weight” and “light weight” views. Its method is abductive inference, which is broader than “light weight” methods. Since it is “on a par” with natural science, ontology contributes nothing beyond the claim that what there is, is what our best theories say there is. Hence, it is not “heavy weight”. (shrink)

This article surveys some of the more important work in the philosophy of punishment in past ten years or so.

This chapter considers the effect of European Union (EU) law in the national courts of the member states and its status vis‐a‐vis overlapping rules of national law. The basic doctrines crafted by the Court of Justice of the European Union (CJEU) marked a significant departure from the standard model of international law and made a major contribution to the early development of the common market. The CJEU added, in many national legal systems the essentials of the legal rules governing State (...) liability have been developed by the courts. The principle of state liability has in practice been applied by the CJEU with restraint. The national courts now routinely apply the doctrines of direct effect and what de Witte calls ordinary primacy. However, the idea that Union law takes precedence over national rules having constitutional status has proved problematic with top national courts, particularly in so‐called dualist member states. One of the recurring problems of animal rights advocacy in recent years has been the difficulty of matching up such advocacy with the broadly liberal political environment in which it operates. Animal advocates may score high on compassion for the animal victims of injustice, but much lower when it comes to political compassion for opponents. Fairly or otherwise, those with a robust, partisan commitment to animal rights have secured a reputation for intolerance. So much so, that it may even be (...) difficult to form a plausible picture of what tolerant animal advocacy would look like, without compromising the partisanship of advocates. This paper attempts to unify partisanship and tolerance within a picture of the tolerant animal advocate as someone whose agency is marked by at least two significant constraining features. Firstly, they will engage in negative appraisals of dietary practices, but will not ordinarily move from such appraisals to any overall judgment of the character of others. Hence, they will be in no position to hold that vegetarians or vegans are in some sense better people than meat eaters. Secondly, they will deploy charges of hypocrisy rarely and with caution. Throughout evolution, there has been interaction and exchange between RNA pools in the environment, and DNA and RNA pools of eukaryotic organisms. Metagenomic and metatranscriptomic sequencing of invertebrate hosts and their microbiota has revealed a rich evolutionary history of RNA virus shuttling between species. Horizontal transfer adapted the RNA pool for successful future interactions which lead to zoonotic transmission and detrimental RNA viral pandemics like SARS‐CoV2. In eukaryotes, noncoding RNA (ncRNA) is an established mechanism derived from prokaryotes to defend against (...) viral attack through innate immunity and regulation of host‐derived mRNA. Transgenerational inheritance of ncRNA is evidence for feedforward adaptive immunity and epigenetically encoded environmental change across generations, which may explain the ‘‘missing heritability’’ of common disease. Causal graph theory and the Price Equation can model epigenetic inheritance involving dynamic internal and external RNA pools. Experimental designs should include metatranscriptomic analyses to understand how ncRNA responds to rapidly changing environmental conditions, within and between organisms, and across generations.
