Over the last three decades, the art market has undergone a remarkable transformation. Before the 1990s, artworks were sold with hardly any concern about whether they had been stolen or looted, whereas now any reputable gallery or auction house checks the “provenance” of any substantial work before sale. This transformation reflects interlocking changes in law, norms, and institutions. New York’s and more broadly the United States’ assertion of jurisdiction and application of U.S. substantive law has destabilized title to stolen and (...) looted goods worldwide because American statutes of limitations generally provide weaker protection for those who possess stolen or looted goods even in good faith. Application of American law has had a profound effect, especially for the high end of the market, because European or Asian investors who purchase art outside of the U.S. may eventually want to sell or display their works in the U.S. Defective title under American law thus affects prices worldwide. The tightening and broader application of American law reflects both longstanding legal principles and changes in social norms towards the redress of historical wrongs, most notably prominent campaigns relating to art confiscated or sold under duress in Nazi Germany. New institutions, most importantly searchable databases recording stolen and looted art such as the Art Loss Register, are also changing perceptions about minimum standards for good faith purchase, which in turn affects both social norms and court cases. These new norms, induced by both legal changes and better information, have influenced the market even for less valuable art, for which sale or display in the U.S. is not a relevant consideration and for which the threat of costly legal action is not credible. The fact that social and institutionalized norms play an important role in protecting original owners is probably good, because norms and institutions can be effective even where law is not and often do so at lower cost. Ethical thought experiments such as the trolley dilemma have been investigated extensively in the past, showing that humans act in utilitarian ways, trying to cause as little overall damage as possible. These trolley dilemmas have gained renewed attention over the past few years, especially due to the necessity of implementing moral decisions in autonomous driving vehicles. We conducted a set of experiments in which participants experienced modified trolley dilemmas as drivers in virtual reality environments. Participants had to make decisions between (...) driving in one of two lanes where different obstacles came into view. Eventually, the participants had to decide which of the objects they would crash into. Obstacles included a variety of human-like avatars of different ages and group sizes. Furthermore, the influence of sidewalks as potential safe harbors and a condition implicating self-sacrifice were tested. Results showed that participants, in general, decided in a utilitarian manner, sparing the highest number of avatars possible with a limited influence by the other variables. Derived from these findings, which are in line with the utilitarian approach in moral decision making, it will be argued for an obligatory ethics setting implemented in ADVs. (shrink)

Police officers around the world must often select between equally unappealing, uncertain courses of action in an attempt to achieve the best outcome. Despite the immense importance of such decisions, there remains a lack of understanding in the study of individual differences in police decision-making. Here, using a sample of senior police officers recruited from decision-making training events across the United Kingdom (n = 96), we used the Least-worst Uncertain Choice Inventory For Emergency Responses (LUCIFER) to measure the effect of (...) maximization on both domain-specific (police) and domain-general (military) decisions. In line with a wealth of research on traditional “consumer” decisions, we found that police officers who were “maximizers” found decisions more difficult. Gender and previous military experience also influenced the process of decision-making. Specifically, police officers with military experience took more time to assess the situation but were faster to choose a course of action and commit to it. Female police officers also were slower to assess the situation. As recent events show, the outcomes of police decisions have significant consequences for the public, the officers involved, the police force as a whole, and the wider population, yet psychological research has yet to fully explore the role of individual differences in how such decisions are made. While this study does not seek to identify factors associated with “good” or “better” decision-makers, it provides strong support for the need to factor in perspectives of the individual when creating theory, or applied tools, in support of police decision-making. The focus of this article is on elderly patients’ and nursing staff perceptions of privacy in the care of elderly patients/residents in five European countries. Privacy includes physical, social and informational elements. The results show that perceptions of privacy were strongest in the UK (Scotland) and weakest in Greece. Country comparisons revealed statistically significant differences between the perceptions of elderly patients and also between those of nurses working in the same ward or long-term care facility. Perceptions of privacy by patients (...) and their nursing staff were quite similar in Finland, Germany and the UK. In contrast, in Greece and Spain these perceptions were different: nurses believed that they took account of their patients’ privacy needs more often than the patients themselves felt this was the case. Among Spanish and UK patients, an association was found between lower levels of independence and comparatively less positive perceptions of privacy. No associations were established between nurses’ perceptions and their demographic factors. This is the third of a set of five articles published together in this issue of Nursing Ethics in which the results of this comparative research project are presented. (shrink)

Background: Despite the growing potential of mobile-based technologies, innovative interventions targeting the reduction of acute stress in daily life remain under-researched. Music listening is an easy-to-administer activity that is associated with lower levels of biological and self-reported stress. However, the application of music as an intervention in moments of acute stress in daily life remains to be examined. We developed a just-in-time intervention delivering music in moments of stressful experiences in daily life and tested its feasibility using a mixed methods (...) approach.Methods: In this uncontrolled pilot study, the ecological momentary music intervention was tested by 10 chronically stressed women aged 23.5 ± 3.3 years. Over 18 consecutive days, whenever participants reported stressful experiences, they were encouraged to listen to a self-compiled playlist. Subjective stress levels and saliva samples were assessed at three time points per stress report. We analyzed app-based log data, in-the-moment responses, questionnaire data, and semi-structured interview data.Results: On average, participants’ compliance with the study protocol lay at 70%. Overall, 65 stressful experiences were reported, 51 of which were followed by music listening, for an average duration of 12:53 min. Complete data were provided for 46 stressful experiences. Participants reported immediate relaxation and distraction through music listening. The interviews revealed that the intervention was easy to use and that music listening in moments of perceived stress was viewed as a new and pleasant activity. Several aspects of the protocol were identified, which should be improved in future studies.Conclusion: Since repeated stressful experiences in daily life can pose a threat to physical and mental integrity, interventions that are easily applicable and deliver support when needed most are necessary. Following minor adaptations, the EMMI can be considered as a feasible approach to target psychobiological stress responses in daily life, which is worthy of investigation in future larger-scale trials. Feministische Aktivist*innen haben sich schon immer verschiedener Medien bedient, um zu kommunizieren, sich zu artikulieren und zu vernetzen. Durch die Digitalisierung und die damit verbundenen Möglichkeiten erweitern sich feministische Aktionsräume und verlagern sich zunehmend ins Social Web. So lässt sich feststellen, dass Plattformen wie twitter, instagram oder auch facebook vielfach genutzt werden, um feministische Anliegen in die Öffentlichkeit zu tragen. Der gegenwärtige mediale Diskurs um feministische Ideen und Forderungen wird dabei maßgeblich durch antifeministische Akteur*innen beeinflusst, deren Anliegen es ist, feministische (...) Stimmen aus dem medialen Raum zu verbannen. Die vorliegende Arbeit greift diese Thematik auf und geht der Frage nach, wie feministische Aktivist*innen antifeministische, digitale Gewalt wahrnehmen und damit umgehen. Die Ergebnisse verweisen darauf, dass insbesondere Aspekte der Sexuellen Identität und der Mehrfachdiskriminierung entscheidend sind für das Ausmaß der digitalen Gewalt, die erfahren wird. Weiterhin wird deutlich, welche Rolle Solidarität, Vernetzung und Empowerment im Kampf gegen den Antifeminismus spielen. Die Autorin Anja Roß studierte Pädagogik und Soziologie an der Universität Bielefeld. Sie arbeitet als wissenschaftliche Mitarbeiterin am Institut für Pädagogik an der Universität Oldenburg. Prepositions name spatial relationships. But they are also used to convey abstract, non-spatial relationships —raising the question of how the abstract uses relate to the concrete spatial uses. Despite considerable success in delineating these relationships, no general account exists for the two most frequently extended prepositions: in and on. We test the proposal that what is preserved in abstract uses of these prepositions is the relative degree of control between the located object and the reference object. Across four experiments, we (...) find a continuum of greater figure control for on and greater ground control for in. Den Hori­ zont dieser Perspektive bildet die Demokratie, dessen Unerreichbarkeit in der politischen Praxis der Demokratisierung affirmiert wird. Dekonstruktion und Demokratisierung stehen dabei weder in einem parallelen noch einem additiven Verhiiltnis, auch wenn die Konjunktion "und" dies suggerieren mag. Es (...) handelt sich um zwei offene, einander verschiebende Prozesse, deren Verschriinkung diese Studie darlegen mochte. Eine temporale Meta­ pher tragt dabei solange, wie sie nicht teleologisch miBverstanden wird: Die Demokratie ist die Zukunft der Dekonstruktion,2 wenn die Dekonstruktion die andere Gegenwart bleibt. Die Spur einer dekonstruktiven Bewegung hat sich lange schon, minde­ stens seit einem Jahrhundert, vergegenwartigt.3 An sie gekoppelt ist gleich­ wohl die Angst vor einem Nihilismus, der das emanzipatorische Verspre­ chen verneinen konnte. What is the wrong behind the widely criticized presentist bias of democracies? In this paper I argue that it is not that future generations are excluded from present-day democratic decision-making quite generally. Rather, I claim that due to the unique risks associated with representing future generations and the limitations on affecting future generations both institutionally and causally, the focus ought to be on including them on a more specific, narrower, set of issues, namely only those that threaten to lead to (...) their domination. I identify such issues as those that may end up being purpose-determining: that may subject future generations to previous generations’ will by forcing them to exert a substantial amount of their energies on dealing with problems caused by their predecessors. I conclude by reflecting on the extent to which political representation together with providing avenues of contestation can minimize the risk of intergenerational domination. (shrink)

Introspective as well as empirical evidence indicates that emotions shape our thinking in numerous ways. Yet, this modificatory aspect of emotions has received relatively little interest in the philosophy of emotion. I give a detailed account of this aspect. Drawing both on the work of William James and adverbialist conceptions of perception, I sketch a theory of emotions that takes these aspects into consideration and suggest that we should understand emotions as manners of thinking.

Kant attacks the Leibnizians on various fronts but the objection that occurs most frequently in his writings is that they are committed to an untenable conception of the relation between sensible and intellectual representations. They regard the difference between intellectual and sensible representations as a merely ‘logical’ difference that concerns their form, namely, their different degrees of distinctness, while in truth it is a difference in kind that concerns their nature, origin, and content. In the first part of this essay, (...) I provide a detailed reconstruction of what exactly this objection amounts to, and show why Kant takes this misconception to be so significant that he keeps coming back to it over and over again. The misconception is so significant because virtually all of the other mistaken doctrines of the Leibnizians can be traced back to it. Several commentators have argued that Leibniz is not guilty of the confusion of sensible and intellectual representations that Kant accuses him of. But this does not automatically clear him from all the other errors that Kant takes to be closely connected with this confusion. In the second part of this essay, I take a look at Leibniz's theory of confused perceptions and examine whether he is committed to one of these errors, namely, the view that we could learn something about things in themselves by experience if our senses were acute enough or our powers of 'disfusing' perceptions were strong enough. The agri-food system is facing a range of social-ecological threats, many of which are caused and amplified by industrial agriculture. In response, numerous sustainable agriculture narratives have emerged, proposing solutions to the challenges facing the agri-food system. One such narrative that has recently risen to prominence is regenerative agriculture. However, the drivers for the rapid emergence of regenerative agriculture are not well understood. Furthermore, its transformative potential for supporting a more sustainable agri-food system is underexplored. Through a genealogical analysis of (...) four prominent sustainable agriculture narratives; organic agriculture, conservation agriculture, sustainable intensification, and agroecology; we consider how regenerative agriculture’s growing momentum can be contextualised within existing narratives and explore the implications this might have for its transformative potential. This analysis reveals that the genealogies of these sustainable agriculture narratives have led to a number of contestations and complementarities which have coalesced to drive the emergence of regenerative agriculture. We also find that, in contrast to agroecology, regenerative agriculture shares with other Global North narratives a limited scope for offering transformative pathways for agricultural production. This is largely due to their inadequate consideration of power and equity issues in the agri-food system. We argue that regenerative agriculture therefore risks inhibiting deeper agri-food system transformations that address both social and ecological challenges and is not the unifying sustainable agriculture narrative it claims to be. Nonetheless, regenerative agriculture could contribute towards a broader plurality of sustainable agriculture narratives that collectively might enable a transformation to a more sustainable, diverse, and just agri-food system. In this paper I formulate three objections to Axel Gosseries’s account of what we owe to future generations when it comes to addressing problems related to climate change. First, I challenge Gosseries’s use of the term justice, quite generally, to apply to both human-induced as well as to natural, that is, non-human-induced, detrimental effects. I argue that this liberal use of the term justice constructs a view that implausibly lacks reference to human agency. Second, I challenge the way Gosseries applies (...) the notion of distributive justice, more specifically, across generations. I show that he makes use of this notion too indiscriminately, as if principles of distributive justice simply applied between humans across time and space, regardless of whether they stand in any relationship of cooperation to each other. Third, I reject the claim that our concern with justice _across_ generations should persuade us not to save for the future if those who are worst-off across time—and who can be “reached” by transfers—are among the currently living. I suggest that there may be value connected to saving for the future for all concerned, including the presently worst-off. Saving therefore does not necessarily directly compete with the duty to maximize the position of the worst-off, wherever in time they may be situated. (shrink)

Compulsory labor, justice and the foundations of social law The author argues that normative questions in social law are in need of a more philosophical approach. This is particularly true for the evaluation of Work-first arrangements. She proposes to evaluate workfare policies from the perspective of the reciprocity principle as it is deployed in the work of the liberal egalitarians John Rawls and Stuart White. While Rawls’ interpretation of the reciprocity principle seems to be at odds with Dutch jurisprudence on (...) workfare policies, which allows for Work-first arrangements within the boundaries that are set by article 4 of the European Convention on Human Rights (a prohibition on compulsory labor), White’s approach rather encourages work obligations for welfare recipients, on the condition that citizens acquire individual drawing rights on collective participation funds. The approach of cameraethnography developed by Bina Elisabeth Mohn links ethnographic description to a “permanent work on gazes.” The aim of this essay is to decipher this approach in pedagogical, as well as in methodological, terms by referring to an empirical study within artistic research.

Many people claim that music is a universal language considering the impact and beneficial results that it usually triggers, whereas others reject the idea due to contextual or cultural sentiments and parameters that must be considered. Both sides’ arguments make sense but, despite skepticism, music should be considered as a universal language, which becomes clear by depicting it in the context of peacebuilding and by exploring its linguistics and therapeutic effects, through various domains such as philosophy, music theory and the (...) contemporary world. The author argues that considering the counter-arguments and balancing it with this central claim, it is possible to reach an inspiring and complementary common ground between performing arts as music and philosophy. Die gängigen Prognosen, nach denen die Religionen im Kontext der Moderne oder im Zuge der Globalisierung an Bedeutung verlieren würden, haben sich nicht bestätigt. Das Gegenteil ist der Fall: Jenseits von nihilistischen Entwürfen und virtuellen Konstruktionen öffneten sich auch und gerade in der Literatur Räume für die Belebung religiöser Weltsicht. Ausgehend von Heinrich Böll und seiner Anfang der 1960er Jahre eingeleiteten Distanzierung von der Institution Kirche, wird am Beispiel von Botho Strauß und Peter Handke, die seit den 1970er und 1980er (...) Jahren eine ins Metaphysische zielende Subjektivität repräsentieren, eine Renaissance des Religiösen konstatiert, die sich in den Werken des jüngeren Autors Ralf Rothmann seit den 1990er Jahren mit selbstbewusster Deutlichkeit fortschreibt. Anhand der geistesgeschichtlichen Trias Gnostizismus, Philosophie und Mystik nimmt die Verfasserin eine Fokussierung vor, die die ästhetischen Konzeptionen der Autoren deutlich werden lässt und sie zueinander in Beziehung setzt. Research on cognitive control has sparked increasing interest in recent years, as it is an important prerequisite for goal oriented human behavior. The paced auditory serial addition task has been used to test and train cognitive control functions. This adaptive, challenging task includes continuous performance feedback. Therefore, additional cognitive control capacities are required to process this information along with the already high task-load. The underlying neural mechanisms, however, are still unclear. To explore the neural signatures of the PASAT and particularly (...) the processing of distractive feedback information, feedback locked event-related potentials were derived from 24 healthy participants during an adaptive 2-back version of the PASAT. Larger neural activation after negative feedback was found for feedback related negativity, P300, and late positive potential. In early stages of feedback processing, a larger difference between positive and negative feedback responses was associated with poorer overall performance. This association was inverted in later stages. Together, our findings indicate stage-dependent associations between neural activation after negative information and cognitive functioning. Conceivably, increased early responses to negative feedback signify distraction, whereas higher activity at later stages reflects cognitive control processes to preserve ongoing performance. Drawing on interviews with women and men who serve on the supervisory boards of German stock-listed companies, this qualitative study examines why some female directors seek to augment gender equality in their organizations while others do not. Those who take action do so both in formal board processes and in informal settings. A sense of belonging to women as a social group and a sense of responsibility for women in the organization are key factors in explaining why some female directors (...) contribute to gender equality. In addition, the study highlights the relevance of a board culture supportive of gender equality and positive expectations by other organizational members about female directors’ role in advancing gender equality. Board chairs influence how supportive female directors perceive the organizational context to be. Where the organizational context is not seen as supportive, those who take equality-related action anyway are experienced directors. Surprisingly, the presence of other women on the board does not appear to be related to whether or not female directors take action. Examining female directors’ actions and paying close attention to both their identities and their specific organizational settings shows how the interplay between social identity and situational opportunities and constraints affects board behavior. “12 × 12 = 144”. Psychological Certainty versus Logical Exclusion of Error in On Certainty, Illustrated by the Example of Artihmetic. The aim of this paper is to exemplify Wittgenstein’s distinction between a psychological certainty and the logical exclusion of error by considering his discussion of our use of simple calculations like “12 × 12 =144” in On Certainty. Three aspects seem to be relevant in this context: 1. Wittgenstein’s notes on our use of the word “to know” in the (...) context of these simple calculations (and on the irrelevance of inner states or processes for this use); 2. his discussion of the wish for “transcendental certainty” (OC 1975: 47); 3. his remarks on the logical exclusion of error. The view that agents are not obliged to do more than their initial fair shares when their fellow duty bearers fail to comply has prominent defenders, including Liam Murphy and David Miller. While Murphy thinks that asking agents to take up other agents’ slack would be unfair, Miller claims that slack-taking cannot be required because primary responsibility does not migrate from noncompliers to compliers. This paper argues, by contrast, that there are a number of circumstances in which there is a (...) duty to take up the slack even though it is unfair and even though responsibility stays where it is. The central claim is that what agents owe to third parties is a separate issue from how they relate to fellow duty bearers. This proposal also runs counter to familiar defenses of slack-taking that weigh its unfairness against the moral importance of the interests at stake for third parties. (shrink)

Introduction - This paper is aimed at gaining more insight into the effects of camera-surveillance on behavior. This study investigates the effects of three different ways of ‘framing’ camera presence on cheating behavior and pro-social behavior. First, we explore the effect of presenting the camera as the medium through which an intimidating authority watches the participant. Second, we test the effect of presenting the camera as being a neutral, non-intimidating viewer. Third, we investigate whether a participant watching themselves via a (...) camera has an effect on their behavior. In contrast to most studies of camera surveillance, we will conduct our experiments in an indoor setting, enabling us to investigate behavior to a much greater detail. We will also explore possible moderating effects of personality traits. Methods - 86 students participated in this experiment, distributed over four conditions: three different ways of framing the camera presence, plus a control condition. Our main dependent variables were various kinds of cheating and pro-social behavior. We established the participant’s relevant personality traits in a separate session. Results - For cheating behavior, findings showed that the ‘authorative’ way of framing camera presence and the situation in which participants viewed themselves, differed significantly from a situation without camera-surveillance. We did not find significant effects of camera surveillance on pro-social behavior during the experiment. Looking at personality traits, we found an indication that people with an internal locus of control are more inclined to cheat when there is no camera present compared to people with an external locus of control. However, the effects of our manipulations were stronger. Conclusion - These results support the idea that the framing of a camera’s presence does indeed influence cheating behavior, adding to the preventive effects of camera-surveillance. Additionally, this study provides some valuable insights into the influence of camera presence on behavior in general. (shrink)
