In the tradition of justified true belief theory, I provide an epistemic responsibility-based philosophical analysis of collective knowledge which is both coherentist and reliabilist.

This essay provides a critical philosophical assessment of “offensiphobia,” which is the belief that higher educational academic freedom ought to be to some important extent censured because of the mere offensiveness of certain kinds of expressions, whether those expressions are perceived as being racist, sexist, etc., effectively holding that the offensiveness of such expressions is a sufficient condition to justify its prohibition. This paper concisely sets forth the general legal parameters of the United States constitutional First Amendment right to freedom (...) of expression. Subsequently, it follows Joel Feinberg in distinguishing between harms and offenses and explains why the law should only protect against harms and not mere offenses. Following this, logical and moral considerations are brought to bear in order to further assess the implicitly supporting view of offensiphobia that faculty and students in higher educational contexts have a claim right to not be offended correlated with a duty of others to not offend them. For example, the use-mention distinction is discussed in order to explain why linguistic intent is crucial for the determination of what genuinely counts as being racist, sexist or otherwise offensive discourse. In the end, there are a variety of reasons for thinking that there is no moral right to not be offended correlated with a moral duty of others to not offend in higher educational contexts and that the law and public policy ought to track this fact. Without a right to not be offended, those who seek to curtail higher educational academic freedom rights by way of censorship stand on unreasonable ethical grounds to do so, though the law seems to permit private institutions to delimit offensive expressions. Offensiphobia ought to be rejected as it is unsupported by the balance of reason. (shrink)

Given the hundreds of articles and books that have been written in epistemology over the span of just the past few decades, relatively little has been written specifically on epistemic responsibility. What has been written rarely considers the nature of epistemic responsibility and its possible role in epistemic justification or knowledge. Instead, such work concerns philosophical analyses and arguments about related concepts such as epistemic virtues or duties, rather than epistemic praiseworthiness and blameworthiness.2 It is epistemic responsibility in the blameworthiness (...) and praiseworthiness senses that is the primary concern of this paper, though the duty sense of epistemic responsibility is explored in terms of its pertinence to epistemic virtue. This paper explicates and challenges John Rawl's argument concerning a rule-utilitarian theory of punishment. In so doing, it argues in favour of a retributivist theory of punishment, one that seeks to justify, not only particular forms of punishment, but the institution of punishment itself. Some crucial objections to retributivism are then considered: one regarding the adverse effects of punishment on the innocent, another concerning proportional punishment, a third pertaining to vengeance and retribution, a Marxian concern with retributive punishment, and a (...) concern with the concept of desert. Each objection is deflected in order to ward-off what seem to be the most serious criticisms of a retributivist view of punishment and to clarify the depth of the retributivist position. (shrink)

This paper seeks to provide some of the roles of philosophy in the field of academic ethics.

In some recent articles, Dr. Leigh Turner [Doffing the Mask: Why Manuscript Reviewers Ought to Be Identifiable,” Journal of Academic Ethics, 1 (2003), pp. 41–48; “Promoting F.A.I.T.H. in Peer Review: Five Core Attributes in Effective Peer Review,” Journal of Academic Ethics, 1 (2003), pp. 181–188.] makes some rather critical observations regarding the processes of peer-review in academic journals. I shall note them in turn, note wherein I concur and wherein I disagree, and discuss some of Turner's suggestions to resolve such (...) difficulties. It is hoped that my comments on Turner's much-appreciated points will engage readers of this august and well-edited journal to take more seriously Turner's arguments for the sake of the betterment of academic research. Digital contact tracing is used in different countries to help contain the COVID-19 pandemic. It raises challenging empirical and ethical questions due to its complexity and widespread effects calling for a broader approach in ethical evaluation. However, existing approaches often fail to include all relevant value perspectives or lack reference to empirical data on the artifact in question. In this paper, we describe the development of an interdisciplinary framework to analyze digital contact tracing from an empirical and ethical perspective. Starting (...) with an analysis of methodological tensions in the attempt to analyze digital contact tracing, we, firstly, set out three methodological premises regarding (a) a specific view of technology, (b) a fruitful normative perspective, and (c) ways to gather empirical knowledge about the object under investigation. Secondly, we inspect consequences of these premises to develop our research methodology. In doing so, we argue for a postphenomenological perspective on technology, solidarity as an important concept to guide the ethical perspective, and an empirical approach based on qualitative social science research and the concept of affordances. We illustrate these considerations by referring to our analysis of the German Corona-Warn-App as an instance of contact tracing based on the Exposure Notification Framework by Google and Apple. We then discuss the implications of using such a framework, including considerations concerning future developments of technologies similar to or inspired by the current concepts of contact tracing. The history of scholarship, philosophical or otherwise, about Plato and his writings reveals a quandary pertaining to the interpretation of the contents of Plato's dialogues. To understand Plato one must come to terms with this problem: how ought Plato's writings to be interpreted?

Health technologies such as apps for digital contract tracing [DCT] played a crucial role in containing and combating infections during the COVID-19 pandemic. Their primary function was to prevent the spread of SARS-CoV-2 by consistently generating and disseminating information related to various events such as encounters, vaccinations or infections. While the functionality of DCT has been well researched, the necessity of transparency in the use of DCT and the consent to share sensitive information such as users’ health, vaccination and location (...) status remains unclear. On one hand, DCT enabled the continuous monitoring of various risk factors, including data-based calculations of infection probabilities. On the other hand, digital monitoring of health risks was closely associated with various uncertainties, such as the ambiguous storage of personal data and its potential future misuse, e.g., by tech companies or health authorities. Our contribution aims to retrospectively analyze the COVID-19 pandemic from a post-pandemic perspective and utilize it as a case study for the implementation of new technological measures. We argue that under the condition of voluntary use of DCT, transparency plays a key role in convincing individuals to install health technologies on their mobile devices, keep them activated and consent to the sharing of sensitive data. We support our argument with qualitative data from an expert survey conducted between 2020 and 2021 and analyzed according to the principles of Grounded Theory. (shrink)

Primero se examina la definición enciclopédica del ideal y la noción de obra de arte contenida en ella. Luego se aborda la disputada cuestión de la autonomización del arte respecto de la religión. Conhecido como Debate Hart-Dworkin, o entrechoque de opiniões entre esses dois autores gerou intensa discussão acerca do positivismo jurídico e das teorias que buscam refutar suas teses fundamentais. Neste contexto, Ronald Dworkin se empenha em repreender a doutrina positivista demonstrando que as noções elementares dessa teoria não são capazes de produzir uma doutrina eficaz sobre a natureza do direito. No presente artigo, pretendo analisar as críticas lançadas por Dworkin ao positivismo jurídico e às conceituações de Herbert Hart, com específica atenção (...) para o conceito de discricionariedade que Dworkin imputa ao positivismo. A partir de uma discussão teórica envolvendo as principais obras desses autores, procuro confirmar a hipótese de que a teoria positivista moderna não está comprometida com o sentido atribuído por Dworkin à noção de discricionariedade, prejudicando assim o fundamento da crítica de Dworkin acerca da interpretação no positivismo jurídico. Ao final, irei considerar também a gravidade desta vicissitude para a teoria dworkiniana como um todo, avaliando se as críticas de Dworkin restam comprometidas ou resistem a este empecilho. (shrink)

This paper summarizes some of the major concepts of Raimo Tuomela’s social ontology as it is articulated and defended in his most recent major works and provides a set of objections to it. It also suggests some ways to plausibly revise Tuomela’s analysis of social groups in order to evade our concerns.

This paper amounts to a reply to Professor Donald G. Brown’s thoughtful comment on my “Ethical Issues in Journal Peer-Review”, which appeared in this journal.

In a recent paper in this journal Charles B. Saunders et al. argue that corporations have no social responsibility regarding alienation in the workplace in that there is no significant degree of alienation in the workplace, at least in white collar and management level positions in corporate America.Contrary to Saunders et al., this paper defines the concept of alienation. Having done that, it proceeds to show that the argument Saunders et al. make flounders on logical grounds. I conclude that Saunders (...) et al. provide no evidence for the claim that alienation is lacking (in any degree) in corporate America. (shrink)

It has recently been argued that there is probably no theory of punishment to be found in Immanuel Kant’s writings, but that “if one selects carefully among the many remarks and insights that Kant has left us about crime and punishment, one might even be able to build such an edifice from the bricks provided.” In this paper, I seek to provide part of a foundation of a Kantian theory of punishment, one which is consistent with many, if not all, (...) of Kant’s own insights on justice. In his famous essay, "A Puzzle About Belief," Saul Kripke poses a puzzle regarding belief. In this paper I shall first describe Kripke's puzzle. Second, I shall introduce and examine five positions one might take in attempting to solve Kripke's Puzzle. In so doing, I shall show why each of these attempts fails to solve Kripke's Puzzle. The significance of this analysis is that if Kripke's Puzzle remains unresolved, then (as Kripke himself claims) the normal apparatus for belief ascription needs (...) rethinking. (shrink)

This paper is an elaboration of my previous paper published in Philosophy, ‘Making Sense of retributivism,’ which was a criticism of John Rawls' attempt in ‘Two Concepts of Rules’ to develop a rule utilitarian theory of punishment wherein utilitarianism is best construed as a justificatory basis for the institution of punishment and retributivism is best construed as serving as a justificatory basis for particular forms of punishment. I challenge this claim, arguing that retributivism must and can provide a justification both (...) for the institution of punishment and for particular forms of punishment. In the end, I develop an analysis of the nature of desert as responsibility and proportionality. This notion of desert makes the best sense of retributivism. (shrink)

The second section engages Feinberg's work on rights and punishment. The paper ends with numerous quotations from Feinberg's vast array of writings, words that express his ideas on a number of important problems that occupied his mind throughout his fruitful and influential career.

Entre Mead e Heidegger: a interioridade desdobrada e a formaçâo humana Resumo: O artigo visa aproximar a abordagem da psicologia social de Mead e a perspectiva fenomenológico-existencial de Martin Heidegger da noção de interioridade desdobrada. Tal aproximação permite sustentar que há uma radical e inseparável reciprocidade entre homem/mulher e mundo. A radicalidade de tal reciprocidade suplanta a dicotomia interioridade e exterioridade, reaproximando o corpo do tempo, lugar mesmo da abertura existencial humana. Apresenta-se a noção de “self” como processo e a (...) mente como resposta comportamental interativa com vistas a relacioná-la ao modo de ser-no-mundo. Também, uma breve incursão à psicologia de viés fenomenológico-existencial, buscando articular o interacionismo de Mead e a analítica existencial de Heidegger e suas implicações para o campo da formação humana.Palavras-chave: Self. In this article, we seek to discuss the recurrence of racism and prejudice toward black lives and childhoods, in spite of repeated initiatives to overcome it by social and educational policy-makers. Following the investigations launched by Michel Foucault on the biopower hypothesis, we revisit some of his interpreters, with the objective of discussing the challenges posed by racism to pedagogical provisions for black children and—following on a concept offered by Emmanuel Levinas--an education of the Face, as a weapon in the (...) political field of struggle against the thanatological dimension of biopolitics. To do so, we retrace some scenes from the history of inclusion devices – especially those policies aimed at black populations. We reflect on the racism embedded in our historical unconscious and discuss how it affects the education of the black Face in our country. We problematize the peculiarities of Brazilian racial prejudice and explore its necropolitical positioning when it comes to the governance of black childhoods. We conclude that the current form of governmentality and education needs a movement of de-rostification—deconstuction of the black Face--in order to identify a future for black children that makes it possible to rise up against the hegemonic order of the white-male-heterosexual-christian-European, and to create processes of subjectivation that can build solidarity with the multiplicity of others-becoming-minoritarian. Autism is a neurodevelopmental disorder typically assessed and diagnosed through observational analysis of behavior. Assessment exclusively based on behavioral observation sessions requires a lot of time for the diagnosis. In recent years, there is a growing need to make assessment processes more motivating and capable to provide objective measures of the disorder. New evidence showed that motor abnormalities may underpin the disorder and provide a computational marker to enhance assessment and diagnostic processes. Thus, a measure of motor patterns could provide (...) a means to assess young children with autism and a new starting point for rehabilitation treatments. In this study, we propose to use a software tool that through a smart tablet device and touch screen sensor technologies could be able to capture detailed information about children’s motor patterns. We compared movement trajectories of autistic children and typically developing children, with the aim to identify autism motor signatures analyzing their coordinates of movements. We used a smart tablet device to record coordinates of dragging movements carried out by 60 children during a cognitive task. Machine learning analysis of children’s motor patterns identified autism with 93% accuracy, demonstrating that autism can be computationally identified. The analysis of the features that most affect the prediction reveals and describes the differences between the groups, confirming that motor abnormalities are a core feature of autism. (shrink)

This paper challenges the claim that the traditional Christian (Augustinian, Thomistic, Anselmian) idea of hell as a form of eternal punishment (damnation and torment) for human sin cannot be made consistent with the idea of proportionate punishment, and it raises concerns with the notion that divine justice requires divine forgiveness and mercy. It argues that divine justice entails or at least permits retribution as the meting out of punishment by God to those who deserve it in proportion to the degree (...) and amount of harm unduly and responsibly caused by sinners to others. For God to fail to punish those who deserve it in proportion to their harmful wrongdoings would imply God’s failure to be both just and omnibenevolent. (shrink)
