The central focus of this monograph is the concept of higher education reform in the light of an international and global comparative perspective. This volume takes a close look at these changes, the drivers of change, their effects and possible future scenarios.

The paper - originally a lecture in the "40th Anniversary Lecture Series 2001-2002" - gives a survey of the development of philosophy of science in Germany and of the role tthe Pittsburgh Center for Philosophy of Science plays in this development. Leading biologists and philosophers of biology discuss the basic theories and concepts of biology and their connections with ethics, economics, and psychology, providing a remarkably unified report on the “state of the art” in the philosophy of biology.

Why did Kierkegaard prefer to write his masterpieces under different pseudonyms and what was the theatrical logic behind the constant playfulness of an author otherwise doomed to melancholy? What were the reasons of his ongoing philosophical, theological and aesthetic hide-and-seek that he did not want to finish until the very last, nearly tragic phase of his authorship? How much inspiration did Kierkegaard receive from theatrical performances, from playwrights and even from actors and actresses of 19th-century Copenhagen, which seemed to be (...) sometimes stronger than the influence exercised on him by his professors, masters and theologians of Denmark’s “Golden Age”? Can the difference between direct and indirect communication that basically characterized Kierkegaard’s oeuvre be described in theatrical terms or even to approach it as an ongoing dramatic dialogue? Should we rather call it a “polylogue” as different actors are present throughout the texts that were often polemic with each other, simultaneously reflecting certain issues from different angles and finally Kierkegaard denying that any of those were written by him? Could his own name be a pseudonym, as his brother suggested when giving the eulogy on the prodigal son, who learned to doubt from Socrates and from Descartes, yet could not give up his intention to question even the final axioms of human existence? The author tries to find answers to these questions by reconstructing the very special Kierkegaardian method, so familiar from the stage, in the spiritual, cultural and theatrical context of Kierkegaard’s Denmark. The article analyzes ethnic data collection pertaining to criminal justice in Hungary. With such a sensitive and delicate issue at hand, Hungary has decided on an evasive approach, resisting ethnic data collection by law enforcement authorities. The author argues that this approach has become one of the obstacles in fighting discrimination and ethnic profiling. Moreover, Hungary’s restrictive approach to ethno-national data classification also causes severe constitutional problems in other, noncriminal legal circumstances, where ethnic data is used in the context of (...) additional rights and affirmative protection provided for ethno-national minorities. The first part of the article describes general problems relating to ethnic data collection and analyses of the Hungarian minority protection framework, in particular, the minority self-government structure (a unique constitutional institution). The second part focuses on the criminal justice system; the author’s aim is to show that prohibiting the official recognition and collection of data on ethnicity by criminal justice authorities has potentially ethnically discriminatory consequences. There is widespread agreement that democracy today faces unprecedented challenges. Populism has pushed governments in new and surprising constitutional directions. Analysing the constitutional system of illiberal democracies and illiberal phenomena in 'mature democracies' that are justified in the name of 'the will of the people', this book explains that this drift to mild despotism is not authoritarianism, but an abuse of constitutionalism. Illiberal governments claim that they are as democratic and constitutional as any other. They also claim that they are (...) more popular and therefore more genuine because their rule is based on conservative, plebeian and 'patriotic' constitutional and rule of law values rather than the values liberals espouse. However, this book shows that these claims are deeply deceptive - an abuse of constitutionalism and the rule of law, not a different conception of these ideas. (shrink)

Žižek’s recent commentaries on the topics of gender identity, sexuality, and consent have provoked outraged reactions from the politically correct neoliberal consensus. This paper argues these reactions emerge in part due to Žižek & Zupančič’s recent explorations into the ontological and political ramifications of Lacan’s thesis ‘ il n'y a pas de rapport sexuel’. Specifically, these explorations pose a threat to the contemporary definition of the subject as the subject of trauma, and the economy of moralistic outrage which sustains this (...) subjectivization. Following the recent commentaries by both Žižek and Zupančič, we argue this economy produces a valorization of affects, in which subjectivity becomes directly expressed in proportion to the subject’s expressed suffering. We argue the properly feminist question today must be how to escape what has become an economy of moralist satisfaction; an economy that seduces the subject into a cycle in which their own suffering becomes a currency – an end in itself – rather than a strategy to overcome the social inequalities that created the conditions for this very exploitation. This paper aims at offering an explanation of the traumatic reactions against Žižek and Zupančič’s recent investigations into sexuality, as well as to continue their investigation in the direction of trauma and subjectivity itself. We study a propositional bimodal logic consisting of two S4 modalities £ and [a], together with the interaction axiom scheme a £ϕ → £ aϕ. In the intended semantics, the plain £ is given the McKinsey-Tarski interpretation as the interior operator of a topology, while the labelled [a] is given the standard Kripke semantics using a reflexive and transitive binary relation a. The interaction axiom expresses the property that the Ra relation is lower semi-continuous with respect to the topology. The (...) class of topological Kripke frames characterised by the logic includes all frames over Euclidean space where Ra is the positive flow relation of a differential equation. We establish the completeness of the axiomatisation with respect to the intended class of topological Kripke frames, and investigate tableau calculi for the logic, although tableau completeness and decidability are still open questions. Individualists hold that moral responsibility can be ascribed to single human beings only. An important collectivist objection is that individualism is morally deficient because it leaves a normative residue. Without attributing responsibility to collectives there remains a “deficit in the accounting books” (Pettit). This collectivist strategy often uses judgment aggregation paradoxes to show that the collective can be responsible when no individual is. I argue that we do not need collectivism to handle such cases because the individualist analysis leaves no (...) responsibility-deficit. Harm suffered in such situations can have only two sources. Harm is either due to culpable wrongdoing by individuals. Harm is then redressed by holding these individuals responsible. Or harm does not result from culpable wrongdoing. Such harm may have to be redressed too, but not because anyone is responsible for it. Therefore, the charge of moral insensitivity against individualist accounts can be rejected. Furthermore, in the last section of the chapter I will show that collectivist talk about moral responsibility can be used for ethically questionable purposes as well. Collectivists cannot claim the moral high ground. (shrink)

We propose a logic for reasoning about metric spaces with the induced topologies. It combines the 'qualitative' interior and closure operators with 'quantitative' operators 'somewhere in the sphere of radius r.' including or excluding the boundary. We supply the logic with both the intended metric space semantics and a natural relational semantics, and show that the latter (i) provides finite partial representations of (in general) infinite metric models and (ii) reduces the standard '∈-definitions' of closure and interior to simple constraints (...) on relations. These features of the relational semantics suggest a finite axiomatisation of the logic and provide means to prove its EXPTIME-completeness (even if the rational numerical parameters are coded in binary). An extension with metric variables satisfying linear rational (in)equalities is proved to be decidable as well. Our logic can be regarded as a 'well-behaved' common denominator of logical systems constructed in temporal, spatial, and similarity-based quantitative and qualitative representation and reasoning. Interpreted on the real line (with its Euclidean metric), it is a natural fragment of decidable temporal logics for specification and verification of real-time systems. On the real plane, it is closely related to quantitative and qualitative formalisms for spatial representation and reasoning, but this time the logic becomes undecidable. (shrink)

This paper argues that group attitudes can be assessed in terms of standards of rationality and that group-level rationality need not be due to individual-level rationality. But it also argues that groups cannot be collective epistemic agents and are not collectively responsible for collective irrationality. I show that we do not need the concept of collective epistemic agency to explain how group-level irrationality can arise. Group-level irrationality arises because even rational individuals can fail to reason about how their attitudes will (...) combine with those of others. In some cases they are morally responsible for this failure, in others they are not. Moreover, the argument for collective epistemic agency is incoherent because reasons-for-groups are ipso facto reasons-for-individual. Instead of talking about reasons-for-groups, we should therefore distinguish between self-regarding reasons and group-regarding reasons. Both kinds of reasons are reasons-for-individuals. These conceptual considerations in favour of moderate individualism are strengthened by an analysis of our moral practice of responding to collective shortfalls of rationality and by the unpalatable moral implications of collectivism about epistemic agency. There is no need to change the subject. Groups can be rational or irrational, but they do not reason. (shrink)

We construct a normal extension of K4 with the finite model property whose minimal tense extension is not complete with respect to Kripke semantics.

Mutually beneficial exchanges in markets can be exploitative because one party takes advantage of an underlying injustice. For instance, employers of sweatshop workers are often accused of exploiting the desperate conditions of their employees, although the latter accept the terms of their employment voluntarily. A weakness of this account of exploitation is its tendency for over-inclusiveness. Certainly, given the prevalence of global and domestic socioeconomic inequalities, not all exchanges that take place against background injustices should be considered exploitative. This paper (...) offers a framework to identify exploitation in mutually beneficial exchange, focusing on the case of sweatshop labor. It argues that an employer can be viewed as taking unfair advantage of an underlying injustice if and only if the employer’s surplus from the exchange in the unjust state of affairs exceeds the surplus it could maximally obtain in a just state of affairs. The paper illustrates the applicability of this framework using three different conceptions of justice and argues that it is superior to microlevel accounts of exploitation that regard background justice as irrelevant. The paper concludes by describing some normative implications that follow from judging an exchange exploitative. (shrink)

Prior to the advent of whole-genome sequencing in ancient humans, the likelihood that Homo sapiens and Neanderthals admixed has long been debated, mostly on the basis of phenotypic assessments alone. Today, evidence for archaic hominin admixture is being documented in an increasing number of studies, expanding the evidential basis of the debate on whether Homo sapiens and Neanderthals merit separate specific taxonomic status. Here we argue that while new evidence has provided us with a finer-grained picture of ancient intra- and (...) intergroup demographic dynamics, it does not yet justify merging the Neanderthals in an expanded concept of Homo sapiens or abandoning specific taxonomies. We approach this issue and the apparent conflict between molecular and morphology-based taxonomies from a diachronic perspective on lineage divergence, highlighting how different taxonomic properties are expected to arise at different points in time, and from an integrative perspective on different species conceptions and delimitation criteria. We argue that in light of similar “invasions” of the genome among other animal taxa, full reproductive isolation as the final, litmus test for distinct species status should be rather considered a biologically misplaced expectation. Therefore, we suggest that specific nomenclature should not be perceived with embarrassment but rather be justifiably applied in human paleogenomic publications, maintaining congruence with zoological literature. We then briefly consider and problematize recent suggestions that human evolutionary diversification should now be best represented by a ‘braided stream” or a network. We conclude by putting our paleoanthropological case study in the broader context of species delimitation in the genomic era. (shrink)

As regards the question of what matters in survival two views have been identified: on the one hand, we have the view that what matters is identity (the so-called 'commonsense view') and, on the other hand, we have the view that what matters is the holding of certain psychological connections between various mental states over time (the relation R). Several attempts have tried to reconcile these two views involving the so-called 'multiple occupancy view' or 'cohabitation thesis'. Even if the latter (...) comes in several formulations, common elements are, positing the appropriateness of a description of the fission case according to which the post-fission persons existed prior to fission and also, that what determines that two persons who exist at a certain time are distinct can be facts about what is the case at other times. The paper discusses three of the most influential formulations of the multiple occupancy view, which intend to reconcile identity with what matters, and argues that for various reasons these at least do not work in this regard. As forms of private self-regulation, multi-stakeholder initiatives have emerged as an important empirical phenomenon in global governance processes. At the same time, MSIs are also theoretically intriguing because of their inherent double nature. On the one hand, MSIs spell out CSR standards that define norms for corporate behavior. On the other hand, MSIs are also the result of corporate and stakeholder behavior. We combine the perspectives of institutional theory and club theory to conceptualize this double nature of MSIs. Based on (...) a stage model that looks at the interplay of actor and institutional dynamics, we generate insights into why actors join a voluntary MSI, how the various motivations and intentions of the actors influence the standard development, and how these as well as the MSI design are subsequently influenced by both external and internal dynamics. Michael Ende’s bestseller/The Neverending Story/is set in a magical world called “Fantastica”. In Fantastica, there are heroes and villains, just as in the world of universities and academies. There is even an entity, or better: a non-entity of shaky existence, das Nichts, the Nothingness – loved by some philosophers like Martin Heidegger. In Fantastica Nothingness is able to create trouble and destruction. The same is true in the land of academic history and philosophy of science – let us call it (...) “HOPOSia”. In HOPOSia, particularly in its Anglophone provinces, Nothingness of knowledge and information has succeeded in building up strong opinions about the topic “Mach and Relativity”, and has created confusion and disinformation. However, you may slightly relax; our story in HOPOSia is less cruel so far and more peaceful than what happens in Fantastica. Sometimes it has even entertaining aspects. There are similarities, though: If there had not been lies and manipulation of believes, our story would have ended years ago. It went on instead and will possibly do so forever. (shrink)

An aesthetic sense—a taste for the creation and/or appreciation of that which strikes one as, e.g., attractive or awesome—is often assumed to be a distinctively H. sapiens phenomenon. However, recent paleoanthropological research is revealing its archaeologically visible, deeper roots. The sensorimotor/perceptual and cognitive capacities underpinning aesthetic activities are a major focus of evolutionary aesthetics. Here we take a diachronic, evolutionary perspective and assess ongoing scepticism regarding whether, and to what extent, aesthetic capacity extends to our evolutionary cousins, the Neanderthals. The (...) goal of this article is twofold. First, it serves as a defence of the attribution of Neanderthal aesthetic capacity by marshalling archaeological data best explained by positing a Neanderthal aesthetic sense. Second, it offers an opportunity to make progress on understanding some epistemically relevant features of the wider debate in evolutionary aesthetics. First, we outline and analyse a range of distinct ‘sceptical arguments’ derived from attitudes and claims found in the literature and broader debate that aim to dial down the case for Neanderthal aesthetic capacity. We show that these arguments not only miss their target, they divert the debate away from more compelling questions. We then consider the case for protoaesthetic capacities and sensitivities in the Acheulean stone tool industry and argue that Neanderthals likely inherited the protoaesthetic package from ancient ancestors that they shared with H. sapiens. Finally, we sketch and defend a research agenda for framing Neanderthal aesthetic niche(s) beyond H. sapiens-derived standards, which we see as a priority for future archaeological, cognitive, and philosophical research. While we resist sceptical arguments and the often-implied inferiority of Neanderthals to humans, we also deny that Neanderthals and ancient humans were indistinguishable. Understanding the differences is an important goal of interpretation, and we apply this line of reasoning to the case of aesthetics. (shrink)

Few people, if any, still argue that science in all its aspects is a value-free endeavor. At the very least, values affect decisions about the choice of research problems to investigate and the uses to which the results of research are applied. But what about the actual doing of science? -/- As Science, Values, and Objectivity reveals, the connections and interactions between values and science are quite complex. The essays in this volume identify the crucial values that play a role (...) in science, distinguish some of the criteria that can be used for value identification, and elaborate the conditions for warranting certain values as necessary or central to the very activity of scientific research. -/- Recently, social constructivists have taken the presence of values within the scientific model to question the basis of objectivity. However, the contributors to <I>Science, Values, and Objectivity</I> recognize that such acknowledgment of the role of values does not negate the fact that objects exist in the world. Objects have the power to constrain our actions and thoughts, though the norms for these thoughts lie in the public, social world. -/- Values may be decried or defended, praised or blamed, but in a world that strives for a modicum of reason, values, too, must be reasoned. Critical assessment of the values that play a role in scientific research is as much a part of doing good science as interpreting data. (shrink)
