Is pornography within the coverage of the First Amendment? A familiar argument claims that it is not. This argument reasons that the free speech principle protects the communication of ideas, which appeal to the reason ; pornography communicates no ideas and appeals to the passions rather than the reason ; therefore pornography is not protected by the free speech principle. This argument has been specified in different ways by different writers. The most prominent and careful of these are Frederick (...) class='Hi'>Schauer and John Finnis. Both founder on the attempt to distinguish pornography from art, which both would protect. If art, film, and literature should be protected, then this protection should extend to the pornographic subsets of these genres. (shrink)

This article presents a critical reevaluation of the thesis—closely associated with H. L. A. Hart, and central to the views of most recent legal philosophers—that the idea of state coercion is not logically essential to the definition of law. The author argues that even laws governing contracts must ultimately be understood as “commands of the sovereign, backed by force.” This follows in part from recognition that the “sovereign,” defined rigorously, at the highest level of abstraction, is that person or entity (...) identified by reference to game theory and the philosophical idea of “convention” as the source of signals with which the subject population has become effectively locked, as a group, into conformity. This volume consists of papers given to the Royal Institute of Philos ophy Conference on 'Philosophy and the Visual Arts: Seeing and Abstracting' given at the University of Bristol in September 1985. The contributors here come about equally from the disciplines of Philosophy and Art History and for that reason the Conference was hosted jointly by the Bristol University Departments of Philosophy and History of Art. Other conferences sponsored by the Royal Institute of Philosophy have been concerned with links between (...) Philosophy and related disciplines, but here, with the generous support of South West Arts and with the enthusiastic co-operation of the staff of the Arnolfini Gallery in Bristol we were able to attempt even more in the way of bridge building; not only were we able to hold some of our meetings in as possible to the general the Gallery, thus making them as accessible public, but we were also privileged in having our discussions supported by two exhibitions of contemporary painting that together presented contrasting aspects of the abstracting enterprise. One, featuring works by Ian McKeever, and drawings and painting by Frank Auerbach, some of which are discussed and illustrated in the present volume, was about the painterly exploration of 'abstracting from' images in nature and in painting itself. The other, curated by Waldemar Januszczak, while showing some figurative works, was concerned with the 'pure' power of colour perceived 'abstractly, in its own right. (shrink)

Andrew Youpa offers an original reading of Spinoza's moral philosophy, arguing it is fundamentally an ethics of joy. Unlike approaches to moral philosophy that center on praiseworthiness or blameworthiness, Youpa maintains that Spinoza's moral philosophy is about how to live lovingly and joyously. His reading expands to examinations of the centrality of education and friendship to Spinoza's moral framework, his theory of emotions, and the metaphysical foundation of his moral philosophy.

Nihilism is one of Nietzsche’s foremost philosophical concerns. But characterizing it proves elusive. His nihilists include those in despair in the wake of the “death of God.” Yet they also include believing Christians. We have, among these nihilists, those fervently committed to frameworks of cosmic meaning. But we also have those who lack any such commitment, epitomized in the “last man.” We have those who want to escape this life. And we have those who wouldn’t dream of such a prospect. (...) Extant accounts have shed helpful light on the particularities of these various manifestations of nihilism. Yet they have not explained what ties these together. In this paper, I propose a unifying thread. Nihilists, on my reading of Nietzsche, are those who have come unmoored from the most important values. That is not to say that there is nothing more to nihilism than being wrong. But it is to say that we don’t understand Nietzschean nihilism fully if we just focus on the descriptive psychology of valuers. The unifying thread of Nietzschean nihilism, on my reading, in fact turns out to be structurally similar to the familiar idea of it we get in a number of other 19th century thinkers and authors—and ironically with those moralists who brand Nietzsche himself a nihilist. Where he differs from them is not in his account of what nihilism fundamentally is, but in the values he sees nihilists as having come unmoored from. (shrink)

An overview of attempts to define music in the Western philosophical tradition.

Programmed cell death (PCD) in unicellular organisms is in some instances an altruistic trait. When the beneficiaries are clones or close kin, kin selection theory may be used to explain the evolution of the trait, and when the trait evolves in groups of distantly related individuals, group or multilevel selection theory is invoked. In mixed microbial communities, the benefits are also available to unrelated taxa. But the evolutionary ecology of PCD in communities is poorly understood. Few hypotheses have been offered (...) concerning the community role of PCD despite its far-reaching effects. The hypothesis we consider here is that PCD is a black queen. The Black Queen Hypothesis (BQH) outlines how public goods arising from a leaky function are exploited by other taxa in the community. Black Queen (BQ) traits are essential for community survival, but only some members bear the cost of possessing them, while others lose the trait In addition, BQ traits have been defined in terms of adaptive gene loss, and it is unknown whether this has occurred for PCD. Our conclusion is that PCD fulfils the two most important criteria of a BQ (leakiness and costliness), but that more empirical data are needed for assessing the remaining two criteria. In addition, we hold that for viewing PCD as a BQ, the original BQH needs to include social traits. Thus, despite some empirical and conceptual shortcomings, the BQH provides a helpful avenue for investigating PCD in microbial communities. (shrink)

In our contribution we will observe phenomenal architecture of a mind and operational architectonics of the brain and will show their intimate connectedness within a single integrated metastable continuum. The notion of operation of different complexity is the fundamental and central one in bridging the gap between brain and mind: it is precisely by means of this notion that it is possible to identify what at the same time belongs to the phenomenal conscious level and to the neurophysiological level of (...) brain activity organization, and what mediates between them. Implications for linguistic semantics, self-organized distributed computing algorithms, artificial machine consciousness, and diagnosis of dynamic brain diseases will be discussed briefly. (shrink)

Hayek, one of the key thinkers of the twentieth century, has also been much misunderstood. Such thinkers as John Stuart Mill, Gerald Dworkin, and Richard Doerflinger have appealed to the value of freedom to explain both what is wrong with slavery and what is wrong with selling oneself into slavery. Practical ethicists, including Dworkin and Doerflinger, sometimes use selling oneself into slavery in analogies intended to illustrate justifiable forms of paternalism. I argue that these thinkers have misunderstood the moral problem with slavery. Instead of being a central value in itself, I argue that freedom is (...) a means of serving the real value of autonomy. Moreover, I argue that autonomy is ambiguous. In cases of conflict, autonomous choice, here called "shallow autonomy", can justifiably be limited to serve "deep autonomy", or self-rule. I use these notions to give a better understanding of the problem with selling oneself into slavery, and argue that the work of Dworkin has to be seriously revised, and Doerflinger's position has to be given up altogether.\\\ John Stuart Mill, Gerald Dworkin y Richard Doerflinger han recurrido al valor de la libertad para explicar tanto porque está mal moralmente la esclavitud como venderse uno mismo como esclavo. This bold and unabashedly utopian book advances the thesis that Marx's notion of communism is a defensible, normative ideal. However, unlike many others who have written in this area, Levine applies the tools and techniques of analytic philosophy to formulate and defend his radical, political programme. The argument proceeds by filtering the ideals and institutions of Marxism through Rousseau's notion of the 'general will'. Once Rousseau's ideas are properly understood it is possible to construct a community of equals who share (...) some vision of a common good that can be achieved and maintained through cooperation or coordination that is at once both voluntary and authoritative. The book engages with liberal theory in order to establish its differences from Rousseauean-Marxian political theory. Objective: The value of spontaneous EEG oscillations in distinguishing patients in vegetative and minimally conscious states was studied. Methods: We quantified dynamic repertoire of EEG oscillations in resting condition with closed eyes in patients in vegetative and minimally conscious states (VS and MCS). The exact composition of EEG oscillations was assessed by the probability-classification analysis of short-term EEG spectral patterns. Results: The probability of delta, theta and slow-alpha oscillations occurrence was smaller for patients in MCS than for VS. Additionally, only (...) patients in MCS demonstrated fast-alpha oscillation occurrence. Depending on the type and composition of EEG oscillations, the probability of their occurrence was either aetiology dependent or independent. The probability of EEG oscillations occurrence differentiated brain injuries with different aetiologies. Conclusions: Spontaneous EEG oscillations have a potential value in distinguishing patients in VS and MCS. Significance: This work may have implications for clinical care, rehabilitative programs and medical–legal decisions in patients with impaired consciousness states following coma due to acute brain injuries. Are the characteristics and relationships among spatio-temporal entities "real" or are they simply conventional terms that note similarities among things in the world but lack any reality of their own? Or if they are real, what sort of reality do they have? Do we live in a world of causes and effects, or is this relation a useful contrivance for our convenience? Newton ’s laws of motion imply that any plurality of particles whatsoever considered as a whole obeys Newton ’s laws. Nevertheless, I define a Newtonian composite object as an object for the purposes of Newtonian mechanics in which the atoms act in casual dependence on one another in such a way that the whole is structurally stable in many interactions. An elastic solid object is a type of a Newtonian composite object in which each atom is in stable spatial equilibrium (...) relative to the others — it can only move slightly relative to its position in the lattice of inter-atomic spatial relations. This paper briefly review a current trend in neuroscience aiming to combine neurophysiological and physical concepts in order to understand the emergence of spatio-temporal patterns within brain activity by which brain constructs knowledge from multiple streams of information. The authors further suggest that the meanings, which subjectively are experienced as thoughts or perceptions can best be described objectively as created and carried by large fields of neural activity within the operational architectonics of brain functioning.

pseudo-Master's thesis Since Jacques Derrida’s 1989 essay “Force of Law: the Mystical Foundations of Authority,” Carl Schmitt has been a perennial subject of Derrida’s political critique. I will argue that Derrida’s concept of auto-immunity is uniquely applicable to Derrida’s interpretation of Schmitt’s political philosophy. Therefore, my argument will consist of two interrelated but equally divergent parts; the digressive structure will attempt to mimic Derrida’s complex style of weaving opposed concepts into a coherent whole. First, I will demonstrate the many forms (...) of Derrida’s concept of auto-immunity. Second, I will exhibit how this schema uniquely applies to Derrida’s criticisms of Schmitt and the contemporary state of politics. (shrink)

Jean-Francois Lyotard was one of the founding members of the College Internationale de philosophie. Ha has taught at Vincennes, Saint Denis and is currently Professor of Philosophy at the University of California at Irvine. Several of his books have appeared in English, notable The Postmodern Condition, Just Gaming and The Dirrerend.
