Emerging research has highlighted the utility of measuring individual differences in decision-making competence (DMC), showing that consistently following normatively rational principles is associated with positive psychosocial and health behaviors. From another level of analysis, functional theories of personality suggest that broad trait dimensions represent variation in underlying self-regulatory systems, providing a mechanistic account for robust associations between traits and similar life outcomes. Yet, the degree to which broad dispositional personality dimensions predict global tendencies to respond rationally is less understood. In (...) a large online community sample (N = 804), we tested the associations between HEXACO personality dimensions, a 6-factor structural trait model, and a subset of DMC indicators (Applying Decision Rules, Resistance to Framing, Recognizing Social Norms, and Consistency in Risk Perception). Additionally, we examined gender differences across the DMC, first considering the potential for measurement non-invariance across groups for the DMC. We observed partial measurement invariance between men and women; only the Applying Decision Rules scale showed evidence of differential functioning across groups. Controlling for these differences, analyses revealed that higher Conscientiousness, Honesty/Humility, and Openness were associated with higher DMC scores. Contemporary theories of criminalisation address, with varying emphasis, themes concerning the harmfulness and the wrongfulness of the conduct. In his article for the present issue, Antony Duff relies chiefly on notions of wrongfulness as the basis for his proposed criminalisation doctrines; whereas in their 2011 volume on criminalisation, Andrew Simester and Andreas von Hirsch invoke both wrongfulness and harmfulness as prerequisites for prohibiting conduct. The present article assesses the comparative merits of these approaches, and argues in favour of (...) the latter, two-element perspective. In this article, the author puts forward a number of reasons suggesting why the two-element approach is preferable. These reasons include, firstly, an inductive argument—that the kinds of wrongful conduct for which criminalisation seems a plausible response are those that include an element of harm or risk of harm. Secondly, a defining role for the state is one of resource-protection: of safeguarding the means and resources through which citizens can live good lives. Thus the concept of citizens’ living resources—and the related conception of harm—should be made a constitutive and explicit element of criminalisation theory, rather than subsuming resource-protection under a general rubric of wrongfulness. Thirdly, a two-element approach provides reciprocal limiting principles concerning the scope of criminalisation. One can, for example, employ wrongfulness requirements to limit the criminalisation of conduct that has remote harmful consequences; and, conversely, use a harmfulness requirement as means for restricting the criminalisation of wrongful acts. He is particularly noted for reinvigorating desert-based theories of punishment, for his development of principled normative constraints on the enactment of criminal laws, and for helping to bridge the gap between Anglo-American and German criminal law scholarship. Underpinning his work is a deep commitment to a liberal vision of the state. This collection brings together a distinguished group of international authors, who pay tribute to von (...) Hirsch by engaging with topics on which he himself has focused. The essays range across sentencing theory, questions of criminalisation, and the relation between criminal law and the authority of the state. Whereas liberals tend to emphasize harm as the decisive criterion for legitimizing criminalisation, moralists take a qualified notion of wrongfulness as sufficient even when no harm is at hand. This comment takes up Andreas von Hirsch ’s “dual element approach” requiring both harm and wrongfulness as necessary conditions for criminalisation and argues that Joel Feinberg’s account of harming as violation of moral rights is perfectly compatible with it. Subsequently, two issues from the liberalism-moralism debate on criminalisation are examined: (...) Andrew Simester and Andreas von Hirsch’s Crimes, Harms, and Wrongs: On the Principles of Criminalisation (Simester and von Hirsch 2011) is an important contribution to the philosophical debate over the nature and ethical limits of criminalisation. As they note in their reply in this symposium, one of the novel aspects of their account is that they do not advance one “unified, grand theory”. In this article, I comment on Simester and von Hirsch’s theory of criminalization and discuss general principles of criminalization. After some brief comments on punishment theories and the role of moral wrongdoing, I examine main lines of contemporary criminalization theories which tend to focus on the issues of harm, offense, paternalism and side-constraints. One of the points of disagreement with Simester and von Hirsch concerns the role of the harm principle. I rely on a straightforward normative concept of (...) “rights of others,” not in the sense of rights granted in positive law but in the sense of rights which are to be justified in political philosophy. With a rights-centered rather than a harm-centered approach, a prima facie reason for criminalization is the violation of others’ rights. It is unnecessary to develop a separate category of “offense to others,” and paternalistic interventions can be criticized straightforwardly because rights can be waived. (shrink)

Over the past century or so, questions concerning the word ‘meaning’ have been understandably prominent in the field of the philosophy of language. There is, however, a historical aspect to the debate that is of especial interest to literary critics – the fact that verbs and expressions of meaning have been applied to different kinds of things in a number of languages spanning the western literary tradition. I shall introduce the topic by focussing on the Latin expressionsibi uelleand on how (...) Roman authors exploited its ambiguities for the purposes of humour (§§ I and II). I shall then move on to a discussion of a later Latin phrase familiar from the pages of the Virgilian commentator Servius,hoc uult dicere, and argue that the assumptions we have about expressions of meaning may lead us to adopt a particular interpretation of it (§§ III and IV). In the final part of the paper (§§ V, VI and VII) I shall proceed to a discussion of why it is important for modern literary critics to pay attention to how they use verbs such as ‘to mean’: I argue that the different functions of the verb facilitate a personification of the text that allows us to equivocate about the role of the author. :Brain–computer interfaces are driven essentially by algorithms; however, the ethical role of such algorithms has so far been neglected in the ethical assessment of BCIs. The goal of this article is therefore twofold: First, it aims to offer insights into whether the problems related to the ethics of BCIs can be better grasped with the help of already existing work on the ethics of algorithms. As a second goal, the article explores what kinds of solutions are available in that body (...) of scholarship, and how these solutions relate to some of the ethical questions around BCIs. In short, the article asks what lessons can be learned about the ethics of BCIs from looking at the ethics of algorithms. To achieve these goals, the article proceeds as follows. First, a brief introduction into the algorithmic background of BCIs is given. Second, the debate about epistemic concerns and the ethics of algorithms is sketched. A simple explanation of theoreticity says that a term is theoretical if and only if it refers to nonobservational entities. Paradigmatic examples of such entities are electrons, neutrinos, gravitational forces, genes etc. There is yet another explanation of theoreticity: a theoretical term is one whose meaning becomes determined through the axioms of a scientific theory. The meaning of the term ‘force’, for example, is seen to be determined by Newton’s laws of motion and further laws about special forces, such as (...) the law of gravitation. Theoreticity is a property that is commonly applied to both expressions in the language of science, and referents and concepts of such expressions. Different people have different perceptions about artificial intelligence (AI). It is extremely important to bring together all the alternative frames of thinking—from the various communities of developers, researchers, business leaders, policymakers, and citizens—to properly start acknowledging AI. This article highlights the ‘fruitful collaboration’ that sociology and AI could develop in both social and technical terms. We discuss how biases and unfairness are among the major challenges to be addressed in such a sociotechnical perspective. First, as intelligent machines reveal their nature (...) of ‘magnifying glasses’ in the automation of existing inequalities, we show how the AI technical community is calling for transparency and explainability, accountability and contestability. Not to be considered as panaceas, they all contribute to ensuring human control in novel practices that include requirement, design and development methodologies for a fairer AI. Second, we elaborate on the mounting attention for technological narratives as technology is recognized as a social practice within a specific institutional context. Not only do narratives reflect organizing visions for society, but they also are a tangible sign of the traditional lines of social, economic, and political inequalities. We conclude with a call for a diverse approach within the AI community and a richer knowledge about narratives as they help in better addressing future technical developments, public debate, and policy. AI practice is interdisciplinary by nature and it will benefit from a socio-technical perspective. (shrink)

Inspired by Pohlers' local predicativity approach to Pure Proof Theory and Howard's ordinal analysis of bar recursion of type zero we present a short, technically smooth and constructive strong normalization proof for Gödel's system T of primitive recursive functionals of finite types by constructing an ε 0 -recursive function [] 0 : T → ω so that a reduces to b implies [a] $_0 > [b]_0$ . The construction of [] 0 is based on a careful analysis of the Howard-Schütte (...) treatment of Gödel's T and utilizes the collapsing function ψ: ε 0 → ω which has been developed by the author for a local predicativity style proof-theoretic analysis of PA. The construction of [] 0 is also crucially based on ideas developed in the 1995 paper "A proof of strongly uniform termination for Gödel's T by the method of local predicativity" by the author. The results on complexity bounds for the fragments of T which are obtained in this paper strengthen considerably the results of the 1995 paper. Indeed, for given n let T n be the subsystem of T in which the recursors have type level less than or equal to n+2. (By definition, case distinction functionals for every type are also contained in T n .) As a corollary of the main theorem of this paper we obtain (reobtain?) optimal bounds for the T n -derivation lengths in terms of ω n+2 -descent recursive functions. The derivation lengths of type one functionals from T n (hence also their computational complexities) are classified optimally in terms of $ -descent recursive functions. In particular we obtain (reobtain?) that the derivation lengths function of a type one functional a ∈ T 0 is primitive recursive, thus any type one functional a in T 0 defines a primitive recursive function. Similarly we also obtain (reobtain?) a full classification of T 1 in terms of multiple recursion. As proof-theoretic corollaries we reobtain the classification of the IΣ n+1 -provably recursive functions. Taking advantage from our finitistic and constructive treatment of the terms of Gödel's T we reobtain additionally (without employing continuous cut elimination techniques) that PRA + PRWO ( $\varepsilon_0) \vdash \Pi^0_2$ - Refl(PA) and PRA + PRWO ( $\omega_{n+2}) \vdash \Pi^0_2$ - Refl(I Σ n+1 ), hence PRA + PRWO( $\epsilon_0) \vdash$ Con(PA) and PRA + PRWO( $\omega_{n+2}) \vdash$ Con(IΣ n+1 ). For programmatic reasons we outline in the introduction a vision of how to apply a certain type of infinitary methods to questions of finitary mathematics and recursion theory. Gödel’s first incompleteness result from 1931 states that there are true assertions about the natural numbers which do not follow from the Peano axioms. Since 1931 many researchers have been looking for natural examples of such assertions and breakthroughs were obtained in the seventies by Jeff Paris [Some independence results for Peano arithmetic. Kirby, Jeff Paris, Accessible independence results for Peano Arithmetic, Bull. of (...) the LMS 14 285–293]) and Harvey Friedman [S.G. Simpson, Non-provability of certain combinatorial properties of finite trees, in: Harvey Friedman’s Research on the Foundations of Mathematics, North-Holland, Amsterdam, 1985, pp. 87–117; R. Smith, The consistency strength of some finite forms of the Higman and Kruskal theorems, in: Harvey Friedman’s Research on the Foundations of Mathematics, North-Holland, Amsterdam, 1985, pp. 119–136] who produced the first mathematically interesting independence results in Ramsey theory and well-order and well-quasi-order theory .In this article we investigate Friedman-style principles of combinatorial well-foundedness for the ordinals below ε0. These principles state that there is a uniform bound on the length of decreasing sequences of ordinals which satisfy an elementary recursive growth rate condition with respect to their Gödel numbers.For these independence principles we classify their phase transitions, i.e. we classify exactly the bounding conditions which lead from provability to unprovability in the induced combinatorial well-foundedness principles.As Gödel numbering for ordinals we choose the one which is induced naturally from Gödel’s coding of finite sequences from his classical 1931 paper on his incompleteness results.This choice makes the investigation highly non-trivial but rewarding and we succeed in our objectives by using an intricate and surprising interplay between analytic combinatorics and the theory of descent recursive functions. For obtaining the required bounds on count functions for ordinals we use a classical 1961 Tauberian theorem of Parameswaran which apparently is far remote from Gödel’s theorem. (shrink)

The main contention of this article is that, since the 20th century, violence has gradually turned into a purely technological concept. This great change amounts to a paradigm shift which can be traced back to Johan Galtung’s seminal article “Violence, Peace, and Peace Research” (1969). First, I show why the traditional view of violence revolving around the notions of force, intent and harm has been thrown into crisis by the technological evolution of the Western world. Second, I indicate how Galtung’s (...) thorough redefinition of violence as “the cause of the difference between the potential and the actual” proves more compatible to technological societies. Finally, I suggest that this new definition of violence has become ever more appealing today in the age of artificial intelligence. (shrink)

In dem Band werden die Ethikberatung, ihre Entwicklung und Anwendung, sowie die Gründung von Gremien in Krankenhäusern, Pflegeeinrichtungen, Hospizen und von niedergelassenen Ärzten anhand von Fallbeispielen erläutert. fMRI is a tool to study brain function noninvasively that can reliably identify sites of neural involvement for a given task. However, to what extent can fMRI signals be related to measures obtained in electrophysiology? Can the blood-oxygen-level-dependent signal be interpreted as spatially pooled spiking activity? Here we combine knowledge from neurovascular coupling, functional imaging and neurophysiology to discuss whether fMRI has succeeded in demonstrating one of the most established functional properties in the visual brain, namely directional selectivity in the (...) motion-processing region V5/ MT+. We also discuss differences of fMRI and electrophysiology in their sensitivity to distinct physiological processes. We conclude that fMRI constitutes a complement, not a poor-resolution substitute, to invasive techniques, and that it deserves interpretations that acknowledge its stand as a separate signal. This paper considers the argument according to which, because we should regard it as a priori very unlikely that we are among the most important people who will ever exist, we should increase our confidence that the human species will not persist beyond the current historical era, which seems to represent a crucial juncture in human history and perhaps even the history of life on earth. The argument is a descendant of the Carter-Leslie Doomsday Argument, but I show that it (...) does not inherit the crucial flaw in its immediate ancestor. Nonetheless, we are not forced to follow the argument where it leads if we instead significantly decrease our confidence that we can affect the long-run future of humanity. This paper is intended to give for a general mathematical audience a survey of intriguing connections between analytic combinatorics and logic. We define the ordinals below ε0 in non-logical terms and we survey a selection of recent results about the analytic combinatorics of these ordinals. Using a versatile and flexible compression technique we give applications to phase transitions for independence results, Hilbert’s basis theorem, local number theory, Ramsey theory, Hydra games, and Goodstein sequences. We discuss briefly universality and renormalization issues (...) in this context. Finally, we indicate how regularity properties of ordinal count functions can be used to prove logical limit laws. The early Schlick developed an evolutionary biological account of play. He contrasted play with work. Where work encompasses all activity that is undertaken for the sake of some practical outcome, play renders what was previously a mere means into an end enjoyable in itself. Schlick thus distinguished between aesthetic, religious, scientific, and ethical game types. This paper shows that this typology underlies his later attempts to naturalize these fields, and allows us to clarify the relation between object-games and their description (...) within the scientific game. Schlick's demarcation between aesthetic and scientific games arguably prefigures the Vienna Circle's anti-metaphysical stance. (shrink)

Friedrich Nietzsche, in his early work, both appropriated and transformed Friedrich Schiller’s idea of aesthetic education. Art must cease to be a mere object of private pleasure and turn into a medium of public communication – this is the vision both philosophers share. As Nietzsche assigns the rôle held by language in Schiller to music, he shifts the project’s meaning. Yet both authors have to address the paradox that art, cut off from political and economic structures they disapprove of, is (...) meant to change these very structures. While Schiller’s response to the paradox terminates in nearly confessed resignation, Nietzsche’s solution is threatened by simplistic euphoria. (shrink)

Sentimentality: this term has had an odd career that converted it from an expression of praise into one of abuse. The obvious suspicion is that the word ‚sentimental‘ has had an entirely different meaning in the 20th and 21st centuries (when it has been deployed for abuse) as compared to the 18th century (when it had been used for praise). Scrutiny shows, however, that this is not the case. Rather the very same aspects of sentimentality that had appeared to, e.g., (...) Sterne as a feat of human imagination, came to be seen from the 19th century onwards as betraying dishonesty. Hence what may look like mere linguistic change implies a substantial philosophical disagreement. Yet mustering the arguments against sentimentality, it turns out that we should be better off with a descriptive account of this attitude. Specimens of sentimentality are not failures vis-à-vis a norm of rationality; whether we like them or not is a matter of taste. (shrink)
