This book explores different theories of law, religion, and tradition, from both a secular and a religious perspective. It reflects on how tradition and change can affect religious and secular legal reasoning, identifying the patterns of legal evolution within religious and secular traditions. It is often taken for granted that, even in law, change corresponds and correlates to progress – that things ought to be changed and they will necessarily get better. There is no doubt that legal changes over the (...) centuries have made it possible to enhance the protection of individual rights and to somewhat contain the possibility of tyranny and despotism. But progress is not everything in law: stability and certainty lie at the core of the rule of law. Similarly, religions and religious laws could not survive without traditions; and yet, they still evolve, and their evolution is often intermingled with secular law. The book asks the questions: What is the role of tradition within religions and religious laws? What is the impact of religious traditions on secular laws, and vice-versa? How are the elements of tradition to be identified? Are they the same within the secular and the religious realm? Do secular law and religious law follow comparable patterns of change? Do their levels of resilience differ significantly? How does the history of religion and law affect changes within religious traditions and legal systems? The overall focus of the book addresses the extent to which tradition plays a role in shaping and re-shaping secular and religious laws, as well as their mutual boundaries. (shrink)

It is common in the autonomy literature to claim that some more demanding theories of autonomy disrespect certain individuals by giving the result that those individuals lack autonomy. This claim is often made in the context of the debate between substantive and content-neutral theories of autonomy. Proponents of content-neutral theories often argue that, in deeming certain people non-autonomous—especially certain oppressed people who seem to have internalized their oppression in certain ways—the substantive theories disrespect those people. They take this as reason (...) to accept content-neutral views over substantive views. Despite its ubiquity, this concern about disrespect is hard to pin down precisely. In this paper, I articulate two questions that need to be answered before we can understand the disrespect objection. First: Who, exactly, is supposedly being disrespected by substantive views? Second: Why is it that excluding people with these features is disrespectful? I consider a number of possible answers to each of these questions, and I argue that none of them gives us a plausible explanation of why we should think substantive theories of autonomy are disrespectful to anyone. No matter how we fill in the details, I will argue, there is simply no reason to prefer content-neutral theories of autonomy over substantive ones on the grounds of respect. (shrink)

When Ripley hears Jonesy's meow, she responds like a mother to a crying baby. Ridley Scott's Alien begins with an (...) image of near‐naked bodies in capsules, awakening from sleep, slightly dazed, slightly confused—intimating birth, or rebirth. In her theory, Stone harks back to the approach of psychoanalysis, claiming that each experience of motherhood repeats the mother's own infantile past and her own traumatic separation from the maternal body. Name any valued human trait—intelligence, wit, charm, grace, strength—and you will find an inexhaustible variety and complexity in its expression among individuals. Yet we insist that such diversity does not provide grounds for differential treatment at the most basic level. Whatever merit, blame, praise, love, or hate we receive as beings with a particular past and a particular constitution, we are always and everywhere due equal respect merely as persons. -/- But why? Most who attempt to answer this question appeal (...) to the idea that all human beings possess an intrinsic dignity and worth—grounded in our capacities, for example, to reason, reflect, or love—that raises us up in the order of nature. Andrea Sangiovanni rejects this predominant view and offers a radical alternative. -/- To understand our commitment to basic equality, Humanity without Dignity argues that we must begin with a consideration not of equality but of inequality. Rather than search for a chimerical value-bestowing capacity possessed to an equal extent by each one of us, we ought to ask: Why and when is it wrong to treat others as inferior? Sangiovanni comes to the conclusion that our commitment to moral equality is best explained by a rejection of cruelty rather than a celebration of rational capacity. Clarifying the nature of possibility is crucial for an evaluation of the phenomenological approach to ontology. From a phenomenological perspective, it is ontological possibility, and not spatiotemporal existence, that has pre-eminent ontological status. Since the sphere of phenomenological being and the sphere of experienceability turn out to be overlapping, this makes room for two perspectives. We can confer foundational priority to the acts of consciousness over possibilities, or to pre-set possibilities over the activity of consciousness. Husserl’s position on this issue (...) seems to change over time. Ultimately, the establishment of a phenomenological perspective must involve a rejection of any hypostatization of pre-set possibilities, but not all implications of this theoretical step seem to be drawn in Husserl’s texts. This paper is devoted to an illustration of how the phenomenological notion of possibility should change when we reject the hypostatization of possibility, that is, when we reject the idea that all acts of consciousness are to be conceived as realizations of pre-set “ideal forms”. We examine this question, first, by trying to clarify the conceptual constellation of “possibility” in Husserl’s texts. This leads to an overall classification of the features of constituted possibilities. Then we distinguish such constituted possibilities from their constituting conditions, which outlines a different sense of “possibility”. In the last instance two “possibilizing” dimensions are shown to lie at the root of all ontic possibilities. This leads to a final suggestion on the nature of the relation between experience and possibility. Actual experiences create the room for possibility: they are possibilizations. In this sense, experience is to be taken as a generative sphere which goes beyond the customary boundary between epistemic and ontological. This essay explores the connection between representation and explanation in the sciences. I suggest that scientific representation schemes be viewed as pragmatic tools for acquiring the sort of articulated awareness that is the hallmark of nontrivial knowledge. Crystal field theory in chemistry illustrates this perspective. Certain representations achieve the status of being paradigmatically explanatory, thereby shaping models of intelligibility. In turn, these explanatory preferences serve largely to define and differentiate disciplinary communities by implicitly endorsing particular epistemic aims and values. Drawing on literature, art, and photography, it explores how the Victorian mathematical conception of form still resonates today.

Current debates on collective intentionality focus on the cognitive capacities, attitudes, and mental states that enable individuals to take part in joint actions. It is typically assumed that collective intentionality is a capacity which is added to other, pre-existing, capacities of an individual and is exercised in cooperative activities like carrying a table or painting a house together. We call this the additive account because it portrays collective intentionality as a capacity that an individual possesses in addition to her capacity (...) for individual intentionality. We offer an alternative view according to which the primary entity to which collective intentionality has to be ascribed is not the human individual, but a “form of life.” As a feature of a form of life, collective intentionality is something more than the specific capacity exercised by an individual when she cooperates with others. Collective intentionality transforms all the capacities of the bearers of this specific form of life. We thus call our proposal the transformative account of collective intentionality. (shrink)

The main purpose of this article is to consider two of the most popular arguments offered in support of the view that emotions do not cause actions. One argument suggests that emotions come after actions and therefore cannot cause them. The other argument suggests that emotions are not necessarily followed by actions and therefore cannot cause them. I argue that neither of these two arguments is compelling. At the same time, some of the concerns of causation skeptics can help us (...) better understand what a theory of the causal connection between emotions and actions should explain. (shrink)

This article considers the impact that this general good faith clause has had upon the UK legal order. It first analyses the Obligation, assessing its scope, function and content. It then reviews the choices made by the UK legislature in implementing this duty and scrutinises the manner in which it (...) has been construed and applied by UK courts, as well as commentators. Intellectual knowledge is omnipresent in human lives and decisions. We are constantly trying to make good and correct decisions. However, responsible decision-making is characterised by rather difficult epistemic conditions. It applies all the more during the pandemic when decisions require not only specialised knowledge in a number of disciplines, scientific consensus, and participants from different fields, but also responsibility and respect for moral principles in order to ensure that the human rights of all groups are observed. Pandemic measures are created (...) by politicians, healthcare policy-makers, and epidemiologists. However, what is the role of ethics as a moral philosophy and experts in ethics? Experts in ethics and philosophy are carefully scrutinising political decisions. Levy and Savulescu have claimed that Ethicists and philosophers are not epistemically arrogant if they question policy responses. They played an important role in the creation of a reliable consensus. This study analyses epistemic and moral responsibility, their similarities, analogies, and differences. Are they interconnected? What is their relationship and how can they be filled with actual content during the pandemic? (shrink)

Phenomenology has been defined by Husserl as “theory of the essences of pure phenomena,” yet the ontological status of essences in Husserlian phenomenology is far from a settled issue. The late Husserlian emphasis on genetic constitution and the historicity of the lifeworld is not immediately reconcilablewith the ‘unchangeable’ nature that is prima facie attributed to essences. However, the problem of the nature of ideality cannot be dropped from phenomenological accounts without jeopardizing the phenomenological enterprise as such. Through an immanent analysis (...) of Husserl’s meditation on essences a positive account of their ontological status is provided. Essences are interpreted as ontological thresholds, primordially rooted in our motivated confrontation with sensuous transcendence. Essences appear as emergent ontological features, which are not reducible to their particular realizations and which exhibit a fundamental continuity between consciousness and being. They manifest themselves as prospectively a priori (a precondition for further experiences), but retrospectively a posteriori (they are founded in experience). Finally, essences manifest the ‘co-essential’ nature of consciousness and sensuous transcendence: they are the way in which we are motivated and constitutively bound to articulate being, which in turn is apt to be thus articulated. The recent debate on new realism has been widely influenced by Putnam’s views, especially by the distinction between scientific realism and natural or common seense realism. I locate the discussion on mathematical realism in the context of this wider debate. I suggest that a parallel distinction between science-based arguments for realism and more immediate forms of realism is avaiable for mathematics too. I point to differences between contemporary empiricist and intellectualist positions, and stress what I take to be some of (...) the most relevant aspects on which research in this area shall be pursued in the near future, especially concerning the problem of whether philosophical priority should be given to pure or applied mathematics. The text commonly known as the Babylonian Poem of Creation has attracted scholarly attention since it was first translated in the late nineteenth century, although critical editions have appeared only recently. In 2014 there was published a lengthy study on enūma eliš that presents a number of original approaches to the ancient composition. This new book is the subject of the following notes.

The aim of this review is to highlight the most relevant contributions on dance in neuroscientific research. Neuroscience has analyzed the mirror system through neuroimaging techniques, testing its role in imitative learning, in the recognition of other people's emotions and especially in the understanding of the motor behavior of others. This review analyses the literature related to five general areas: breakthrough studies on the mirror system, and subsequent studies on its involvement in the prediction, the execution, the control of movement, (...) and in the process of “embodied simulation” within the intersubjective relationship; research focused on investigating the neural networks in action observation, and the neural correlates of motor expertise highlighted by comparative studies on different dance styles; studies dealing with the viewer's experience of dance according to specific dance repertoires, which revealed the relevance of choreographic choices for aesthetic appreciation; studies focused on dance as an aesthetic experience, where both the emotional and the cultural dimension play a significant role, and whose investigation paves the way to further progress both in empirical and in phenomenological research methodologies; collaboration-based experiments, in which neuroscientists and choreographers developed expertise-related questions, especially focusing on the multiple phenomena that underlie motor imagery. The concept of tacit knowledge is widely used in social sciences to refer to all those knowledge that cannot be codified and have to be transferred by personal contacts. All this literature has been affected by two kind of biases : (1) the interest has been focused more on the result (tacit knowledge) than on the process (implicit learning); (2) tacit knowledge has been somehow reduced to physical skills or know-how; other possible forms of tacit knowledge have been neglected. These (...) two biases seem interconnected one with each other. A greater consideration of the role and relevance of implicit learning allows us to consider tacit knowledge as something more than pure physical skills or know how. This is the first step in order to develop more detailed categorisation of the different forms that tacit knowledge can assume. (shrink)

This essay identifies a connection between the capacities required for individual autonomy and the capacities required for a particular form of shared agency. Like other feminist philosophers, I hold that individual autonomy must be understood in relational terms. In the first section of the essay, I argue that that autonomy is constitutively relational in the sense that it depends upon a dialogical disposition to hold oneself answerable to external, critical perspectives. In the second section, I argue that this disposition is (...) intimately tied to a capacity for symmetrically shared or “joint” deliberation. Joint deliberation is, in my view, a centrally important form of shared agency, particularly in the context of informal, personal relationships such as friendship and love. I argue that, in virtue of its dialogical structure, joint deliberation constitutes us as autonomous in relation to one another. This is because joint deliberation depends on the presence of mutually referring attitudes that are also integral to the individual autonomy of the participants. In the final section of the paper I consider the significance of this argument from a feminist point of view, arguing that, under moderately favorable conditions, we should expect joint deliberation to destabilize acceptance of social norms that are in tension with an agent’s own self-presentation as autonomous. This article addresses a strange investment within ‘continental' philosophy, in asserting the impotence of a Derridean approach when it comes to addressing practical (juridical, political, ethical, economic) issues. Such assertions of impotence regularly stand as the foil for whatever is proposed as a more complex, and therefore powerful, means to make sense of concrete phenomena. Invariably, however, the criticism of a Derridean approach is based on reductive misconceptions of its complex logic, and the proposed correctives repeat the very pattern of (...) thinking that Derrida has consistently adopted throughout his writing. A case in point is Zizek's criticism of what he calls ‘Derrida's operation.' While Zizek's critique is more nuanced and contemporary than the hackneyed charge of ‘textualism,' his reductive conception of the logical structure of Derridean thinking remains open to challenge. Further, his Lacanian corrective, whose logic is represented by the figure of a ‘Borromean knot,' precisely matches the ‘plural logic of the aporia' that underpins a Derridean approach to concrete phenomena. Accordingly, what follows is an attempt to show how Lacanian and Derridean discourses can be brought into alliance as a consequence of their isomorphic logical structure. This attempt is motivated by the conviction that one can do well without the pseudo-antagonism generated by the unjust criticism directed at one another by like-minded thinkers, which, moreover, provides such thinkers with a far too facile excuse for dismissing one another, even before opening texts. I also have a hidden agenda of sorts, which is to outline and, indeed, promote the ‘complexity-thinking' characteristic of both Derridean and Lacanian discourses, as the most viable and appropriate approach to practical issues. Resilient socioeconomic unsustainability poses a threat to democracy whose importance has yet to be fully acknowledged. As the prospect of sustainability transition wanes, so does perceived legitimacy of institutions. This further limits representative institutions’ ability to take action, making democratic deepening all the more urgent. I investigate this argument through an illustrative case study, the 2017 People's Climate March. In a context of resilient unsustainability, protesters have little expectation that institutions might address the ecological crisis and this view is likely (...) to spread. The aim of this work is to elucidate the meaning of 'infinity' from a phenomenological perspective, especially within the framework of Husserl’s theory of knowledge and perception. In the first chapter I firstly sketch the basics of Husserl’s phenomenology of knowledge. Thereafter I delve into the questions concerning the reduction to the 'reellen Bestand', which is hold to be the ground of verification of purports in the "Logical Investigations". I then propose an interpretation of the categorial intuition as directed to (...) the laws an 'Auffassung' follows when it organizes the sensual contents related to an object. In the second chapter I briefly expound Husserl’s phenomenology of perception and I show how perception can be hold as an intentional experience. Afterwards I concentrate on the constitution of space and of thing (Ding). I show in which sense the structures of both constitutions are dependent on the sensations and kinesthesis (i.e. proprioceptions) experienced by the subject. In the third chapter I finally deal with the problem of infinity. I face some recent interpretations of Husserl’s theory of perception according to which infinity is somehow intertwined in and even intuited through thing-perception (Dingwahrnehmung). I claim that thing-perception can not be hold as an access to infinity, i.e. no thing-perception is a perception of something as infinite. Following I show how some other kinds of sensual experience can correspond to a perception of infinity. On the base of some Husserl’s manuscripts and through a brief confrontation with Kant’s Analytic of the Sublime I sustain that infinity can be sensually intuited in the senses of limitlessness and of formlessness. I then show that categorial intuition is necessary in order to constitute the meaning of mathematical infinity, i.e. an endless whole of discrete parts. In fact, the idea of such an “entity” is dependent on the capacity of grasping the law of a serial production. In the conclusion I establish that mathematical infinity is the only kind of infinity which can not find any sensual correlate. This is due to the fact that it is a meaning composed by two contradictory prescriptions: 'reach the limitless' and 'go on without an end'. I consequently argue that the idea of infinity is grounded on sensual experience and does not need any supernatural origin. (shrink)

We are still looking for a satisfactory definition of what makes an individual being a human individual. The understanding of human beings in terms of organism does not seem to be satisfactory, because of its reductionistic flavor. It satisfies our need for autonomy and benefits our lives thanks to its medical applications, but it disappoints our needs for conscious and free, self-determination. For similar reasons, i.e. because of its anti-libertarian tone, an organicistic understanding of the relationship between individual and society (...) has also been rejected, although no truly satisfactory alternative for harmonizing individual and social wellness has been put forth. Thus, a reassessment of the very concepts of individual and organism is needed. In this book, the authors present a specific line of thought which started with Leibniz' concept of monad in 17th century, continued through Kant and Hegel, and as a result reached the first Eastern country to attempt to assimilate, as well as confront, with Western philosophy and sciences, i.e. Japan. The line of thought we are tracing has gone on to become one the main voices in current debates in the philosophy of biology, as well as philosophical anthropology, and social philosophy. As a whole, the volume offers a both historical, and systematic account of one specific understanding of individuals and their environment, which tries to put together its natural embedding, as well as its dialectical nature. Such a historical, systematic map will also allow to better evaluate how life sciences impact our view of our individual lives, of human activities, of institutions, politics, and, finally, of humankind in general. This book analyzes how religious and linguistic multiplicities become a pluralism, that is, how they enter into polyphonic relations, as well as how they interconnect, grow together, and why they often clash. The contributors are renown international scholars working in interreligious dialogue, philosophy and sociology of religion, history (...) of religious arts, and the crossroads of religion and science. Some linguist examples are the impact of Artificial Intelligence on religious beliefs, the synergy between science and religion in the alchemist tradition and in magic, as well as the relationship between the COVID-19 pandemic and current religious practices. How many logics do logical pluralists adopt, or are allowed to adopt, or ought to adopt, in arguing for their view? These metatheoretical questions lurk behind much of the discussion on logical pluralism, and have a direct bearing on normative issues concerning the choice of a correct logic and the characterization of valid reasoning. Still, they commonly receive just swift answers – if any. Our aim is to tackle these questions head on, by clarifying the range of possibilities that logical (...) pluralists have at their disposal when it comes to the metatheory of their position, and by spelling out which routes are advisable. We explore ramifications of all relevant responses to our question: no logic, a single logic, more than one logic. In the end, we express skepticism that any proposed answer is viable. This threatens the coherence of current and future versions of logical pluralism. (shrink)

The present study aims to connect more the I/O and the decision-making psychological domains, by showing how some common components across jobs interfere with decision-making and affecting performance. Two distinct constructs that can contribute to positive workplace performance have been considered: decision-making competency (DMCy) and decision environment management (DEM). Both factors are presumed to involve self-regulatory mechanisms connected to decision processes by influencing performance in relation to work environment conditions. In the framework of the job demands-resources (JD-R) model, the present (...) study tested how such components as job demands, job resources and exhaustion can moderate decision-making processes and performance, where high resources are advantageous for decision-making processes and performance at work, while the same effect happens with low job demands and/or low exhaustion. In line with the formulated hypotheses, results confirm the relations between both the decision-making skills, performance (i.e. in-role and extra-role) and moderators considered. In particular, employees with low levels of DMCy show to be more sensitive to job demands toward in-role performance, whereas high DEM levels increase the sensitivity of employees toward job resources and exhaustion in relation to extra-role performance. These findings indicate that decision-making processes, as well as work environment conditions, are jointly related to employee functioning. (shrink)
